3

The overall context

Sharing and spread of territorial information, available at Public Administration bodies, assume an important role in Geographic Information field.

New web services and digital media make geodata widely available: geographic contents can be easily shared, used and reused across the geospatial domain.

4

The overall context

This involves a particular attention towards:

Providers: about checking the flow of their

intellectual properties;

End users: about use rights related to a

specific resource

5

The overall context

Piedmont Region, thanks to the experience in legal interoperability, started with the realization of the “Discipline of use” for the Spatial Data Infrastructure SITAD, has continued on this way with a new analysis, supported by a specific CSI research scholarship.

“Development and reuse of geodata“

6

The overall context

Goals of the research “Development and reuse of geodata”: regulate use, reuse and dissemination of

geodata available at Public Administration bodies;

define a new way of sharing, using and reusing geodata, away from an “all rights reserved” approach towards a “some rights reserved” approach.

Research phases

Legal context about geodata use and reuse

PHASE I

Matrix “data/use categories/access”

PHASE II

“Some rights reserved” approach: a business model for licensing geographic information, based on a set of rights associated with specific geospatial resources.

8

Phase I

Phase I:understand the legal context related to the use, dissemination and reuse of geospatial resources (data and software):

International activities of managing use rights of geodata: OGC, ISO TC 211, RELs;

European and Italian legal context about use, diffusion ad reuse of digital information;

Rights Management (RM) and the application in the geospatial marketplace (GeoRM).

9

Phase I

The INSPIRE Directive recognises the importance of public authorities intellectual property rights, by using GeoRM.

Geo Rights Management: is “an instrument which allow public

authorities to electronically specify distribution’s policies”;

“supports the automated transfer of legal rights to final users” using licences.

Phase II

Phase II: working out of the matrix of “data/use

categories/access”:

helps data owner (licensor) to have a background

about all possible uses;

summarizes all possible kinds of access to different types of user.

Guidelines about the use of geographic information

Matrix of “data/use categories/access” has been

useful to create:

“Guide-lines about the use of geodata”: a tool to

regulate the complex geodata of Piedmont Region,

defining use and reuse policies for the digital

information;

a set of “standard geolicences” to protect

geospatial resources of Public Administration bodies.

GEOLICENCE

19

Standard geolicence

Geolicence: defines terms and conditions for the licensee (end

user), who acquires a set of rights (permitted uses, display, download, format, distribution);

it could be useful to express geolicenses using two forms:

• “legal code”, a legally expression of terms and conditions of the license;

• “user friendly”, a simplified readable version for the web, expressing key terms and conditions.

20

Standard geolicence

Piedmont Region, in the next months, will implement a sort of “Click Licences”, automatically composed by:

User information (name, surname, e-mail…);

Use categories (Commercial, Non-Commercial…)

Access conditions (specific user type…)
