The 1987 Philippine Constitution recognizes the private sector as the government’s partner in

development. Its role as the main engine of growth and development has been most prominent

in critical infrastructure and development projects that can best be undertaken through Public-

Private Partnerships (PPPs). It is through this partnership with the private sector that government,

with its limited resources, addressed the power crisis in the early 1990s under Executive Order

No. 215, series of 1987, which, through the Build-Operate-and-Transfer (BOT) Law, later evolved

into other forms of PPPs aimed at meeting the infrastructure requirements of a growing economy.

The Philippines has been one of the countries which successfully brought to fruition real public-

private partnership. The extensive use of project finance or limited recourse financing manifests

the private sector’s interest even for infrastructure projects which traditionally relied on direct

government interventions to get implemented, given a conducive policy and regulatory regime

to entrepreneurial initiatives. While we cannot claim that our current policy regime offers the

best incentives, still we believe, that notwithstanding the points for improvement, it has been

instrumental in encouraging private sector participation in infrastructure development.

In an effort to keep pace with the globalization of trade and services, the Philippine government

has broadened the investment opportunities in the area of infrastructure development for the

private sector. Now under the streamlined PPP Program, the former Build-Operate-Transfer

(BOT) Program, which offered vast investment opportunities under the BOT scheme and all its

variants, has been expanded to include joint venture agreements, concession arrangements,

lease and affermage, among others. More than a change in name, the new PPP Program offers a

more holistic approach towards infrastructure development.

Private-Public Participation (PPP) Program is a key strategy of the Philippine development plan. With the end view of fostering an environment conducive for private sector entrepreneurial initiatives, the government has developed a policy environment that strongly supports private sector participation in its development activities. Th is policy environment has two fundamental cornerstones: First, economic structural adjustments have been geared towards opening the economy to competition and levelling the playing fi eld of enterprise. Second, a clear policy and institutional framework has been put in place to permit unencumbered fl ow of private resources into the government’s development program, especially for the infrastructure sector.

At the helm of the PPP Program is the PHILIPPINE PUBLIC-PRIVATE PARTNERSHIP (PPP) CENTER. Th e PPP Center, equipped with the technical know-how and extensive experience in project development, provides various services and assistance to implementing agencies (IAs), government-owned and controlled corporations (GOCCs), state universities (SUCs) and local government units (LGUs) as well as to the private sector in the development and implementation of critical infrastructure projects.

Project Development. Provide advisory and technical assistance to IAs and LGUs in the development and implementation of PPP projects both at national and local government levels.

Project Development and Monitoring Facility. Manage and administer a revolving fund for pre-investment activities, i.e., preparation of business case, pre-feasibility and feasibility studies and tender documents, to ensure that PPP projects are properly structured.

Project Facilitation. Conduct project facilitation and assistance to the IAs, GOCCs, SUCs and LGUs in addressing impediments or bott lenecks in the implementation of PPP programs and projects.

Project Monitoring. Monitor and facilitate the implementation of the priority PPP Programs and Projects of the IAs/LGUs which shall be formulated by respective IAs/LGUs in coordination with the NEDA Secretariat.

Policy Advocacy. Participate in the formulation of PPP policy reforms for doing PPP in the Philippines.

Information Management. Provide information on the PPP Program and PPP projects. A monitoring system will be put place to keep track of the status of PPP projects.

Capacity Building. Conduct intensive training, seminars, and workshops through its institution building program to improve the capabilities IAs/LGUs in all phases of the PPP project development life cycle.
