Minutes of 201 st SEAC Meeting Date 30/01/2015 The 201 st meeting of SEAC was held in Directorate of Environment, U.P. on 30/01/2015. Following members were present in the meeting along with Secretary, SEAC: 1. Dr. M. S. Khan, Chairman 2. Shri S.C. Bramhchari Member 3. Dr. D. C. Gupta, Member 4. Dr. R.K. The 201st meeting of SEAC was held in Directorate of Environment, U.P. on

30/01/2015. Following members were present in the meeting along with Secretary,

SEAC:

The Chairman welcomed the members to the 201th

SEAC meeting.

The minutes of 200th

SEAC meeting dated 12/01/2015 were confirmed.

The Members of SEAC unanimously taken following decisions on the agenda points

discussed:

General Discussion:

1. The SEAC committee has decided that the project proponent/Consultant while

submitting the project/reply/EIA/mining plan and all related documents at the

Secretariat, SEAC will have to make assure that the copy of the same shall be

made available to all committee members and also be e-mailed.

2. The reply should be point wise and that should be be e-mailed to all committee

members.

3. In case of mining plan summary should also be posted to all committee

members.

1- Sand/Moram Mining at Arazi No-107, Khand-8, Vill-Surawandalapur, Meja,

Uafaabad. (Leased Area-5,00 Acre) Sri Amarjeet, Mahuarikala, Allahabad. File

N0.-2141/AD(Sub)

The project proponent did not appear in the meeting. Request application from

the project proponent for not appearing in the meeting dated 30/01/2015 due to the

illness was received. The committee directed to consider the case in the next meeting

if a request to this effect is received from the project proponent and that to be

considered along with the medical certificate.

2- Sand Moram mining project at vill-Adawal Ahatmali, Tehsil & District-Fatehpur

(Leased area 1.2780 ha.) Shri Shiv Kumar, Vill-Dareyapur, Bindki, Fatehpur (File

No. 2147 DD(Y).

The committee noted that the matter was earlier discussed in SEAC meeting dated

12/01/2015 wherein the consultant of the project was not present alongwith the project

proponent in that case the Committee deliberated that the matter should be closed and shall

be open only after submission of request letter from the project proponent alongwith

commitment of the consultant they shall appear for the presentation, as and when scheduled

for SEAC.

The case was considered in the SEAC meeting dated 30/01/2015. The committee

noted that an application dated 10/03/2014 was made by the project proponent for

environmental clearance of Sand Moram mining project at Gata No. 346 ka, 348, 350,

351, 352, 353 and 354 ka, Vill-Adawal Ahatmali, Tehsil & District-Fatehpur (Leased area

1.456 ha.). Later, howsoever the mining lease for Gata no. 352(lease area 1.2780 Ha.)

only is conditionally granted by the concerned authority, vide letter no. 103/30 Khanij

(2014-15) dated 08/01/2015 to the applicant Shri Shiv Kumar for 03 months i.e. for 90

days from the date of execution of lease and is also directed to stop the mining work till

submission of environmental clearance in the matter. Renewal of the mining lease shall

be applied after issuance of environmental clearance.

A presentation was made by project proponent alongwith their consultant M/s Ind Tech

House Consult. The proponent, through the documents submitted and the presentation

made, informed the committee that:

1. The environmental clearance as per the revised application is sought for Sand Mining

project at Gata no. 352, Vill-Adawal Ahatmali, Tehsil & District-Fatehpur (Leased

area 1.2780 ha.).

2. As per revised form-1, collection of 20,000m3 sand/moram is proposed from 1.2780

ha. mining lease area.

3. Mining Lease area was granted to the applicant Shri Shiv Kumar for 03 months i.e.

for 90 days from the date of execution of lease District Magistrate, Fatehpur through

his letter dated 08/01/2015 directed to stop the mining work till submission of

environmental clearance in the matter. Renewal of the mining lease shall be applied

after issuance of environmental clearance.

4. The mining is proposed from the open field which is in close vicinity of river Yamuna

flowing at the distance of 1.2 km. The sand acclimated on to the field due to the flood

occurrence.

5. 300 working days is proposed from mining activity.

6. The mining plan has been prepared by Shri UPS Chauhan (RQP No.-

RQP/DDN/165/2005/A).

7. 18 persons shall be employed for mining work.

8. Mining will be opencast type and manual method. No drilling and blasting is

proposed.

9. The water requirement will be limited to 10.0 KLD (Domestic use- 0.8 KLD and dust

suppression- 8.0 KLD and 1.2 KLD from Green belt). Water requirement shall be met

through nearby existing dugwells/borewells.

10. The ultimate depth of mining will be restricted to 03 meter/water table, whichever is

less.

11. The mining would be restricted to unsaturated zone only above the phreatic water

table and will not intersect the ground water table at any point of time.

12. The mining operation will not be carried out in safety zone of any bridge or

embankment or in eco-fragile zone such as habitat of any wild fauna.

13. Only sand lying on the field by flood occurrence shall be collected. No earth is to be

evacuated or will be removed.

14. There is no litigation pending in any court regarding the project.

15. The District Magistrate letter dated 12/01/2015 has been submitted by project

proponent that there is no existing operating mine with environmental clearance

accorded within 500 m from the periphery of the proposed site.

16. This project does not attract any of the general conditions applicable on mining

projects specified in EIA Notification 14/09/2006.

17. The project proposal fall under category 1(a) of EIA Notification, 2006 (as amended).

The committee discussed the matter and recommended grant of environmental

clearance for the project proposals as above with general and specific conditions attached as

annexure-1 and annexure-2 to these minutes.

The committee also stipulated following conditions:

1. The mining will be carried out above the mean sea level.

2. Mining will be carried out strictly according to the approved mining plan.

3. Approach road should be made motorable.

4. A buffer/safe zone shall be maintained from the habitation as per mining guidelines.

5. Only sand lying on the field by flood occurrence should be collected. No earth shall

be evacuated or will be removed.

6. The CSR to be increased to Rs. 01.0 Lacs/annum and detail of works to be executed is

to be submitted with an affidavit.

3- Sand /Morum Mining at Gata N0- 22Kh, Vill-Nagwa Medwa, Sakaldiha, Chandauli

(Leased Area 1.72 Hac) Smt Shanti Devi, Vill/Post-Kethi, Varansi. (File No.2183/

AD-Sub.)

The project proponent did not appear in the meeting dated 30/01/2015. The

committee directed to consider the case in the next meeting. The proponent should be

informed accordingly and also that no mining is to be done without conceiving the

environmental clearance.

4- Sand Mine at Vill- SifathNagar, Mohanlalganj, Lucknow. (Leased Area 4.04Hac)

Sri Brijmohan, Vill-Hamirpur,Banthara,District Lucknow, (File no.-2224/DD-Y)

The committee noted that the matter was earlier discussed in SEAC meeting dated

14/11/2014 wherein the project proponent did not appear. The committee directed to close the

case and to reopen only, if a request to this effect is received from the project proponent

The case was considered in the SEAC meeting dated 30/01/2015. The committee

noted that an application dated 21/03/2014 was made by the project proponent for

environmental clearance of Sand Moram mining project at Gata No. 111Zha, 111DA, 111Ga,

111Cha, 111Chay & 88, Village-Sifathnagar Tehsil-Mohanlalganj & District- Lucknow (U.

(Lease area 4.04 ha.).The mining lease for aforesaid Gata no. is conditionally granted by the

concerned authority; vide letter nos. 441 dated: 10/09/2013 and 380/ vari. Saha. Khanan

/2014 dated 16/12/2014 to the applicant Sri Brijmohan for 01 year 23 days from the date of

execution of lease and is also directed to stop the mining work till submission of

environmental clearance in the matter. Renewal of the mining lease shall be applied after

issuance of environmental clearance. And in furtherance it is also made clear that there is no

mining area or mining lease / mining permission granted within 500 mt. in vicinity of the

aforesaid lease area.

A presentation was made by project proponent alongwith their consultant M/s Global

Environment & Mining Services, Lucknow. The proponent, through the documents

submitted and the presentation made, informed the committee that:

1. The environmental clearance is sought for Sand/Moram mining project at Gata No.

111Zha, 111DA, 111Ga, 111Cha, 111Chay & 88, Village-Sifathnagar Tehsil-

Mohanlalganj & District- Lucknow (U.P.) (lease area 4.04 ha.).

2. As per form-1, collection of 25,000 TPA of sand/moram is proposed from lease area

4.04 ha. mining lease area.

3. Mining Lease at Gata no. is conditionally granted by the concerned authority; vide

letter nos. 441 dated: 10/09/2013 and 380/ vari. Saha. Khanan /2014 dated

16/12/2014 to the applicant Sri Brijmohan for 01 year 23 days from the date of

execution of lease and is also directed to stop the mining work till submission of

environmental clearance in the matter. Renewal of the mining lease shall be applied

after issuance of environmental clearance. And in furtherance it is also made clear that

there is no mining area or mining lease / mining permission granted within 500 mt. in

vicinity of the aforesaid lease area.

5. 20 working days is proposed from mining activity.

6. The mining plan has been prepared by Shri Pankaj Pande (RQP No.-

RQP/DDN/086/95/A).

7. Mining will be opencast type and manual method. No drilling and blasting is

proposed.

8. The water requirement will be limited to 2 KLD (Domestic use- 1.0 KLD and dust

suppression- 1.0 KLD and 1.2 KLD from Green belt). Water requirement shall be met

through nearby existing dugwells/borewells supplied from the nearby villages by

tankers.

9. The ultimate depth of mining will be restricted to 03 meter/water table, whichever is

less.

10. The mining would be restricted to unsaturated zone only above the phreatic water

table and will not intersect the ground water table at any point of time.

11. The mining operation will not be carried out in safety zone of any bridge or

embankment or in eco-fragile zone such as habitat of any wild fauna.

12. Only sand lying on the field by flood occurrence shall be collected. No earth is to be

evacuated or will be removed.

13. There is no litigation pending in any court regarding the project.

14. The District Magistrate letter dated 16/12/2014 has been submitted by project

proponent that there is no existing operating mine with environmental clearance

accorded within 500 m from the periphery of the proposed site.

5- Sand Stone Mining at Gata No-2885 Vill-Viojaypur, Sadar, Mirzapur . (Leased

Area-2.5 Acer) Sri Gulam Sarvar, Vill-Paschim Mohal, Gopiganj, Bhadohi. (File

no.-2145/AD-VB)

The committee noted that the matter was earlier discussed in SEAC meeting dated

12/01/2015 wherein the project proponent informed the committee that their consultant M/s

Eko Pro Engineers Pvt. Ltd. are not present and requested for deferment of the matter till next

meeting. The committee expressed its displeasure as deferment of the matter amounts to

wastage of slot/committee time that is fixed for hearing of the matter. The committee directed

that the matter should be closed and shall be open only after submission of request letter from

the project proponent alongwith commitment of the consultant they shall appear for the

presentation, as and when scheduled for SEAC

The case was considered in the SEAC meeting dated 30/01/2015. The committee

noted that an application dated 07/03/2014 was made by the project proponent for

environmental clearance of Stone Mining at Gata No-2885 Vill-Viojaypur, Sadar, Mirzapur

(lease area 1.15 ha.).

The mining lease for aforesaid Gata no. 2885 was granted by the concerned authority;

vide letter dated 27/11/208 to the applicant Sri Gulam Sarvar for 05 years from 13/8/2008

to12/08/2008. The project proponent submitted that the lessee applied for the renewal of the

lease on 29/01/2013, copy of renewal application has also been submitted. Also, in

furtherance vide letter no. memo/khanij/a.p./2014 dated: 12/8/2014 approved by mine officer,

Mirzapur in which it is made clear that there is no mining area or mining lease / mining

permission granted within 500 mt. in vicinity of the aforesaid lease area.

The case is being heard on request of proponent. Instructed to bring M/s Eko Pro

Engineers Pvt. Ltd. consultant other the cases will not be heard in future.

A presentation was made by project proponent alongwith their consultant M/s Eko Pro

Engineers Pvt. Ltd. The proponent, through the documents submitted and the presentation

made, informed the committee that:

1. The environmental clearance is sought for Sand Stone Mining at Gata No. 2885, Vill-

Viojaypur, Sadar, Mirzapur . (Leased Area-2.5 Acer)

2. As per mining Plan, collection of 12,000 m3 /Annum is proposed from lease area 1.01

ha.(2.5 Acer) mining lease area.

3. Mining Lease area was granted to the applicant Sri Gulam Sarvar for 05 years from

13/8/2008 to12/08/2008. Application is applied for renewal of mining lease.

4. A 7.5 wide strip will be left at periphery of the lease area which will be used to store

overburden generated and later will be converted into green belt. Bench height will be

kept 3m.

5. Mining will be done from the highest level of RL 115 mt. to an ultimate depth of RL

91 mt. as per commitment with the committee.

6. 22 working days is proposed from mining activity.

7. The mining plan has been prepared by Shri U.P.S.Chauhan (RQP No.-

RQP/DDN/165/2005/A).

8. Mining will be opencast type and manual method. No drilling and blasting is

proposed.

9. The water requirement will be limited to: Average demand-4.5KLD. Peak demand-

4.5KLD. Water requirement shall be met through nearby existing dugwells/borewells

supplied from the nearby villages by tankers.

10. The ultimate depth of mining will be restricted to 03 meter/water table, whichever is

less.

11. The mining would be restricted to unsaturated zone only above the phreatic water

Area-5.00 Acres) Sri Pankaj Maheshwari, Karvi, Chitrakoot. (File no.-2189/DD-Y)

The project proponent did not appear in the meeting. Request application from

the project proponent for not appearing in the meeting dated 30/01/2015 due to the

illness was received. The committee directed to consider the case in the next meeting

Area-3.00 Acres) Sri Balkrishna, R/o Tilauli, Mau, Chitrakoor. (File no.-2190/ADS)

The committee discussed the matter and directed the project proponent to submit

following information:

1. Copy of receiving letter of mining plan submitted in Directorate of Geology and

Mining, Govt. of Uttar Pradesh.

2. Declaration letter from the competent authority that there is no mining area or

mining lease / mining permission granted within 500 mt. in vicinity of the

aforesaid lease area.

3. Affidavit regarding regarding CSR commitment of

4. NOC from forest department.

5. Approved mining plan to be submitted.

6. The kutcha road is to be constructed motorable.

7. CSR to be increased to Rs. 02.00 Lacs and the details of CSR with an affidavit is

to be given for proper execution of works.

The matter shall be discussed after submission of information as above.

8- Granite Stone Mining at Arazi No-714, Vill-Gonda, Karvi, Chitrakoot. (Leased

Area-3.00 Acres) Sri Shambhu Singh, Akbarpur,Karvi, Chitrakoot. (File no.-

2191/ADH)

The committee discussed the matter and directed the project proponent to submit

following information:

1. Copy of receiving letter of mining plan submitted in Directorate of Geology and

Mining, Govt. of Uttar Pradesh.

2. Declaration letter from the competent authority that there is no mining area or

mining lease / mining permission granted within 500 mt. in vicinity of the

aforesaid lease area.

3. Affidavit regarding regarding CSR commitment of Rs. 02.00 Lacs.

4. NOC from forest department.

5. The morum waste to be used as filling works and royalty should also be paid to

mining department.

The matter shall be discussed after submission of information as above.

Jalaun (Leased Area 16.19 Ha) Sri Babu Lal Nishad, Jalaun,U.P. (File no.-

1223/JDCA-S)

The committee discussed the matter related to file number 1223; however the consultant

of the project was not present alongwith the project proponent. The Project proponent made a

request in this regard to kindly defer the case for next meeting. In that case the committee

deferred the case to the upcoming SEAC meeting.

11- Sand/Morum Mining at Gata No. 2556, 2557, Khand N0.-5A, Vill-Bandhauli, The-

Orai, Distt-Jalaun, U.P. (Leased Area-90.0 Acres) Sri Anurudh Kr Gupta, Vill-

Gopal Ganj, The –Orai, Distt- Jalaun, U.P.(File no.- 1363/ AD-H)

The committee discussed the matter related to file number 1363; however the consultant

of the project was not present alongwith the project proponent. The Project proponent made a

request in this regard to kindly defer the case for next meeting. In that case the committee

deferred the case to the upcoming SEAC meeting.

12- Sand/Morum Mining at Gata No. 240 (Khand No. 3) Vill-Hemanpura, Tehsil-Kalpi,

Distt-Jalaun (Leased Area 16.19 Ha) Sri Chakki Lal S/o Sri Kunji Lal, Vill-

Saidnagar, Tehsil-Orai, Distt-Jalaun, U.P.(File no.- 1226/ DD-Y)

The committee discussed the matter related to file number 1226; however the consultant

of the project was not present alongwith the project proponent. The Project proponent made a

request in this regard to kindly defer the case for next meeting. In that case the committee

deferred the case to the upcoming SEAC meeting.

"The committee discussed the matter and directed the proponent to submit a self explanatory

note regarding the specific period for which the environmental clearance is applied along with

that the lease period of submitted mining plan does not match with erstwhile lease period

regarding the site i.e. 22/01/2010 to 21/01/2013 as per presentation documents submitted by

the proponent.

The committee directed the proponent to submit mining plan regarding the proposed

project as submitted to Mining Department for approval alongwith following information:

1. 10% of the width of the river is to be left for safety zone. According plans should

2. NOC required from reserve forest Manpur Khurd for the purpose of mining.

consultant alongwith the project proponent of the project was not upto the mark.

Hence,the committee directed the consultant alongwith the project proponent to:

1. Correction of the date of lease period is to be done in report.

2. The Committee observed that the proponent must thoroughly study the the report

before presentation before the Committee.

The committee noted that the matter was earlier discussed in SEAC meeting dated

07/06/2014 wherein the project proponent directed to submit following information:

3. Letter of intent from District Magistrate/Mining Officer, Hamirpur should be

submitted to justify claim of applicant on the proposed mining site.

4. Mining plan for proposed mining activity.

5. Details of year wise production.

6. Source of information about mineral reserves as mentioned in the project report.

7. Plan for plantation around the project site.

8. Provision of green belt along all side of the proposed site in width of 7.5 m along

with plantation of trees to be proposed.

9. The reserve of mine along with production should be shown in cubic meter and to

be corrected accordingly.

The project proponent informed the committee that environmental clearance in the

matter was earlier issued by SEIAA through letter dated 11/10/2013 for production capacity

1,80,000 TPA. The project proponent through letter dated 26/12/2014 submitted a revised

form-1 for sand/moram mining on the same site with revised production capacity 7,20,000

TPA.

A presentation was made by Shri Prakash Chandra Dwivedi project proponent

alongwith their consultant M/s GRC India Pvt. Ltd. The proponent, through the documents

submitted and the presentation made, informed the committee that:

1. The environmental clearance is sought for Kanwara Sand/Morum Mining at Khand

No. 3, Khasra No. 28 & 29, Village-Kanwara, Taluka-Banda, District-Banda, U.P.

(Leased Area 36.42 Ha).

2. Proponent has been granted EC on 11/10/2013 for a production of 1, 80,000 TPA.

through the documents submitted and the presentation made, informed the committee that:

1. The environmental clearance is sought for Sand/Morum Mining Project at Khasra No-

788, Vill-Laxmipur, Tahsil-Sadar, Distt-Maharajganj (Area 2.428 Hac)

2. Proponent has been granted EC on 17/04/2013 for a production of 6,000 TPA.

3. The proposed project is for expansion of Production from 6,000 tonnes per annum to

63,000 tonnes per annum for same area & location.

4. As per form-1 and presentation made collection of 63,000 TPA of sand/moram is

proposed from 2.428 Ha mining lease area.

5. The mining is proposed from the river bed of river Rohin.

6. The mining plan has been prepared by Shri UPS Chauhan (RQP No.-

RQP/DDN/165/2005/A).

7. 250 days/year shall be working days.

8. Lease for the project was granted for 03 years from 04/04/2012 to 03/04/2015.

9. Mining will be opencast type and manual. No drilling and blasting is proposed.

TPA.

1- The reply Submitted by the project Proponent appeared to be satisfactory on the

basis of the the actual facts based on the project site, whereas the points raised

by the complainer seems to be irrelevant regarding the mining in district

Kausambi U.P. therefore the committee feels that the Environmental Clearance

may be granted as per specified genral and Specific conditions.

2- The matter may be studied from the file and as per the co-ordinate units on the

site should be intimated to District Magistrate and Mining Officer accordingly.

3- The letter is in concern with SEIAAUP it is not related to the SEAC meeting.

4- The committee took the decision on file number 2464 & 2465 and deliberated

that the file should be studied in detail and as per the decision of SEIAA meeting

dated 12.01.2015 that all the files should be kept in chronological order in the

Annexure-1

GENERAL CONDITIONS PRESCRIBED BY SEIAA/SEAC, UP FOR SAND/MORUM

MINING PROPOSALS General Conditions:

1. This environmental clearance is subject to allotment of mining lease in favour of project

proponent by District Administration/Mining Department.

2. Forest clearance shall be taken by the proponent as necessary under law.

3. Any change in mining area, khasra numbers, entailing capacity addition with change in process

and or mining technology, modernization and scope of working shall again require prior

Environmental Clearance as per the provisions of EIA Notification, 2006 (as amended).

4. Precise mining area will be jointly demarcated at site by project proponent and officials of

Mining/Revenue department prior to starting of mining operations. Such site plan, duly verified

by competent authority along-with copy of the Environmental Clearance letter will be displayed

on a hoarding/board at the site. A copy of site plan will also be submitted to SEIAA within a

period of 02 months.

5. Mining and loading shall be done only within day hours time.

6. No mining shall be carried out in the safety zone of any bridge and/or embankment.

7. It shall be ensured that standards related to ambient air quality/effluent as prescribed by the

Ministry of Environment & Forests are strictly complied with. Water sprinklers and other dust

control majors should be applied to take-care of dust generated during mining operation.

Sprinkling of water on haul roads to control dust will be ensured by the project proponent.

8. All necessary statutory clearances shall be obtained before start of mining operations. If this

condition is violated, the clearance shall be automatically deemed to have been cancelled.

9. Parking of vehicles should not be made on public places.

10. No tree-felling will be done in the leased area, except only with the permission of Forest

Department.

11. No wildlife habitat will be infringed.

12. It shall be ensured that excavation of minor mineral does not disturb or change the underlying

soil characteristics of the river bed /basin, where mining is carried out.

13. It shall be ensured that mining operation of Sand/Moram will not in any way disturb the,

velocity and flow pattern of the river water significantly.

14. It shall be ensured that there is no fauna dependant on the river bed or areas close to mining for

its nesting. A report on the same, vetted by the competent authority shall be submitted to the

RO, PCB and SEIAA within 02 months.

15. Primary survey of flora and fauna shall be carried out and data shall be submitted to the RO,

PCB and SEIAA within six months.

16. Hydro-geological study shall be carried out by a reputed organization/institute within six

months and establish that mining in the said area will not adversely affect the ground water

regime. The report shall be submitted to the RO, PCB and SEIAA within six months. In case

adverse impact is observed /anticipated, mining shall not be carried out.

17. Adequate protection against dust and other environmental pollution due to mining shall be

made so that the habitations (if any) close by the lease area are not adversely affected. The

status of implementation of measures taken shall be reported to the RO, UPPCB and SEIAA

and this activity should be completed before the start of sand mining.

18. Need-based assessment for the nearby villages shall be conducted to study economic measures

which can help in improving the quality of life of economically weaker section of society.

Income generating projects/tools such as development of fodder farm, fruit bearing orchards,

vocational training etc. can form a part of such program me. The project proponent shall

provide separate budget for community development activities and income generating

programmes.

19. Green cover development shall be carried out following CPCB guidelines including selection of

plant species and in consultation with the local DFO/Horticulture Officer.

20. Separate stock piles shall be maintained for excavated top soil, if any, and the top soil should be

utilized for green cover/tree plantation.

21. Dispensary facilities for first-aid shall be provided at site.

22. An Environmental Audit should be annually carried out during the operational phase and

submitted to the SEIAA.

23. The District Mining Officer should quarterly monitor compliance of the stipulated conditions.

The project proponent will extend full cooperation to the District Mining Officer by furnishing

the requisite data/information/monitoring reports. In case of any violations of stipulated

conditions the District Mining Officer will report to SEIAA.

24. The project proponent shall submit six monthly reports on the status of compliance of the

stipulated environmental clearance conditions including results of monitored data (both in hard

& soft copies) to the SEIAA, the District Officer and the respective Regional Office of the State

Pollution Control Board by 1st June and 1st December every year.

25. A copy of the clearance letter shall be sent by the proponent to concerned Panchayat, Zila

Parisad/ Municipal Corporation and Urban Local Body.

26. Transportation of materials shall be done by covering the trucks / tractors with tarpaulin or other

suitable mechanism to avoid fugitive emissions and spillage of mineral/dust.

27. Waste water, from temporary habitation campus be properly collected & treated before

discharging into water bodies the treated effluent should conform to the standards prescribed by

MoEF/CPCB.

28. Measures shall be taken for control of noise level to the limits prescribed by C.P.C.B.

29. Special Measures shall be adopted to protect the nearby settlements from the impacts of mining

activities. Maintenance of Village roads through which transportation of minor minerals is to be

undertaken, shall be carried-out by the project proponent regularly at his own expenses.

30. Measure for prevention & control of soil erosion and management of silt shall be undertaken.

Protection of dumps against erosion, if any, shall be carried-out with geo textile matting or

other suitable material.

31. Project Proponent shall explore the possibility of using solar energy wherever possible.

32. Under social corporate responsibility a sum of 5% of the total project cost or total income

whichever is higher is to be earmarked for total lease period. Its budget is to be separately

maintained. CSR component shall be prepared based on need of local habitant. Income

generating measures which can help in upliftment of poor section of society, consistent with the

traditional skills of the people shall be identified. The programme can include activities such as

development of fodder farm, fruit bearing orchards, free distribution of smokeless Chula etc.

33. Possibility for adopting nearest three villages shall be explored and details of civic amenities

such as roads, drinking water etc proposed to be provided at the project proponent’s expenses

shall be submitted within 02 months from the date of issuance of Environment Clearance.

34. The funds earmarked for environmental protection measures should be kept in separate account

and should not be diverted for other purpose. Year wise expenditure should be reported to the

Ministry of Environment and Forests and its Regional Office located at Lucknow, SEIAA, U.P

and UPPCB.

35. Action plan with respect to suggestion/improvement and recommendations made and agreed

during Public Hearing shall be submitted to the District mines Officer, concern Regional

Officer of UPPCB and SEIAA within 02 months.

36. Environmental clearance is subject to obtaining clearance under the Wildlife (Protection) Act,

1972 from the competent authority, if applicable to this project.

37. The proponent shall observe every 15 day for nesting of any turtle in the area. Based on the

observations so made, if turtle nesting is observed, necessary safeguard measures shall be taken

in consultation with the State Wildlife Department. For the purpose, awareness shall be created

amongst the workers about the nesting sites so that such sites, if any, are identified by the

workers during operations of the mine for taking required safeguard measures. In this regards

the safety notified zone should be left so that the habitat/nesting area is undisturbed.

38. The project proponent shall undertake adequate safeguard measures during extraction of river

bed material and ensure that due to this activity the hydro geological regime of the surrounding

area shall not be affected.

39. The project proponent shall obtain necessary prior permission of the competent Authorities for

withdrawal of requisite quantity of water (surface water and groundwater), required for the

project.

40. Appropriate mitigative measures shall be taken to prevent pollution of the river in consultation

with the State Pollution Control Board. It shall be ensured that there is no leakage of oil and

grease in the river from the vehicles used for transportation.

41. Vehicular emissions shall be kept under control and regularly monitored. The vehicles carrying

the mineral shall not be overloaded.

42. Provision shall be made for the housing of construction labour within the site with all necessary

infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, safe drinking

water, medical health care, crèche etc. (MoEF circular Dated : 22-09-2008 regarding stipulation

of condition to improve the living conditions of construction labour at site).

43. Personnel working in dusty areas should wear protective respiratory devices and they should

also be provided with adequate training and information on safety and health aspects.

Occupational health surveillance program of the workers should be undertaken periodically to

observe any contractions due to exposure to dust and take corrective measures, if needed.

44. A copy of the clearance letter shall be sent by the proponent to concerned Panchayat, Zila

Parishad/ Municipal Corporation, Urban Local Body and the Local NGO, if any, from whom

suggestions/ representations, if any, were received while processing the proposal. The clearance

letter shall also be put on the website of the Company by the proponent.

45. The environmental statement for each financial year ending 31st March in Form-V as is

mandated to be submitted by the project proponent to the concerned State Pollution Control

Board as prescribed under the Environment (Protection) Rules, 1986, as amended subsequently,

shall also be put on the website of the company along with the status of compliance of

environmental clearance conditions and shall also be sent to the Regional Office of the Ministry

of Environment and Forests, Lucknow by e-mail.

46. The green cover development/tree plantation is to be done in an area equivalent to 20% of the

total leased area either on river bank or along road side (Avenue Plantation).

47. Debris from the river bed will be collected and stored at secured place and may be utilized for

strengthen the embankment.

48. Safety measures to be taken for the safety of the people working at the mine lease area should

be given, which would also include measure for treatment of bite of poisonous reptile/insect

like snake.

49. Periodical and Annual medical checkup of workers as per Mines Act and they should be

covered under ESI as per rule.

Annexure-2

Specific Conditions for Sand Moram Mining:

1. The Environmental clearance will be co-terminus with the mining lease period.

2. Project falling with in 05 KM area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco-sensitive zone is not earmarked.

3. The project proponent will submit the approved mining plan within 03 month from the date of

issuance of the E.C. letter. Failing which E.C. will be deemed to be cancelled.

4. Social Corporate Responsibility (SCR) plan along with budgetary provision amounting to 5%

of total project cost shall be submitted within three month on need base assessment study in

the study area. Income generating measures which can help in up-liftment of weaker section

of society consistent with the traditional skills of the people identified. The programme can

include activities such as development of fodder farm, fruit bearing orchards, vocational

training etc. In addition, vocational training for individuals shall be imparted so that poor

section of society can take up self employment and jobs. Separate budget for community

development activities and income generating programmes shall be specified.

5. The mining work will be open-cast and exclusively manual. No mechanical work or

drilling/blasting should be involved at any stage.

6. It shall be ensured that there shall be no mining of any type within 03 m or 10% of the width

which-ever is less, shall be left on both the banks of precise area to control and avoid erosion

of river bank. The mining is confined to extraction of sand/moram from the river bed only.

7. The project proponent shall undertake adequate safeguard measures during extraction of river

bed material and ensure that due to this activity the hydro-geological regime of the

surrounding area shall not be affected.

8. The project proponent shall adhere to mining in conformity to plan submitted for the mine

lease conditions and the Rules prescribed in this regard clearly showing the no work zone in

the mine lease i.e. the distance from the bank of river to be left un-worked (Non mining area),

distance from the bridges etc. It shall be ensured that no mining shall be carried out during the

monsoon season.

9. The project proponent shall ensure that wherever deployment of labour attracts the Mines

Act, the provision thereof shall be strictly followed.

10. The project proponent will provide personal protective equipment (PPE) as required, also

provid adequate training and information on safety and health aspects. Periodical medical

examination of the workers engaged in the project shall be carried out and records

maintained. For the purpose, schedule of health examination of the workers should be drawn

and followed accordingly.

11. The critical parameters such as PM10, PM2.5, SO2 and NOx in the ambient air within the

impact zone shall be monitored periodically. Further, quality of discharged water if any shall

also be monitored [(TDS, DO, pH, Fecal Coliform and Total Suspended Solids (TSS)].

12. Effective safeguard measures, such as regular water sprinkling shall be carried out in critical

areas prone to air pollution and having high levels of particulate matter such as loading and

unloading point and all transfer points. Extensive water sprinkling shall be carried out on haul

roads.

13. It should be ensured that the Ambient Air Quality parameters conform to the norms

prescribed by the Central Pollution Control Board in this regard.

14. The extended mining scheme will be submitted by the proponent before expiry of present

mining plan.

15. Four ambient air quality-monitoring stations should be established in the core zone as well as

in the buffer zone for monitoring PM10, PM2.5, SO2 and NOx. Location of the stations

should be decided based on the meteorological data, topographical features and

environmentally and ecologically sensitive targets and frequency of monitoring should be

undertaken in consultation with the State Pollution Control Board.

16. Common road for transportation of mineral is to be maintained collectively. Total cost will be

shared/worked out on the basis of lease area among users.

17. Proponent will provide adequate sanitary facility in the form of mobile toilets to the labours

engaged for the project work.

18. Solid waste material viz., gutkha pouchs, plastic bags, glasses etc. to be generated during

project activity will be separately storage in bins and managed as per Solid Waste

Management rules.

19. Green area/belt to be developed along haulage road in consultation of Gram Sabha/Panchyat.

20. Natural/customary paths used by villagers should not be obstructed at any time by the

activities proposed under the project.

21. Digital processing of the entire lease area in the district using remote sensing technique

should be done regularly once in three years for monitoring the change of river course by

Directorate of Geology and Mining, Govt. of Uttar Pradesh. The record of such study to be

maintained and report be submitted to Regional office of MoEF, SEIAA, U.P. and UPPCB.

22. A copy of clearance letter will be marked to concerned Panchayat / local NGO, if any, from

whom suggestion / representation has been received while processing the proposal. The

clearance letter shall also be put on the website of the company.

23. State Pollution Control Board shall display a copy of the clearance letter at the Regional

office, District Industry Centre and Collector’s office/Tehsildar’s Office for 30 days.

24. The project authorities shall advertise at least in two local newspapers widely circulated, one

of which shall be in the vernacular language of the locality concerned, within 7 days of the

issue of the clearance letter informing that the project has been accorded environmental

clearance and a copy of the clearance letter is available with the State Pollution Control Board

and also at web site of the SEIAA at http://www.seiaaup.com and a copy of the same shall be

forwarded to the Regional Office of the Ministry located in Lucknow, CPCB, State PCB.

25. The MoEF/SEIAA or any other competent authority may alter/modify the above conditions or

stipulate any further condition in the interest of environment protection.

26. Concealing factual data or submission of false/fabricated data and failure to comply with any

of the conditions mentioned above may result in withdrawal of this clearance and attract

action under the provisions of Environment (Protection) Act, 1986.

27. Any appeal against this environmental clearance shall lie with the National Green Tribunal, if

preferred, within a period of 30 days as prescribed under Section 11 of the National

Environment Appellate Authority Act, 1997.

28. Waste water from potable use be collected and reused for sprinkling.

29. During the school opening and closing time vehicle movement will be restricted.

Annexure-3

General Conditions for Stone Mining Projects:

1. This environmental clearance is subject to allotment of mining lease in favour of project

proponent by District Administration/Mining Department.

2. Forest clearance shall be taken by the proponent as necessary under law.

3. Any addition of the mining area, change of Khasra numbers, enhancement of capacity, change

in mining technology, modernization and scope of working shall again required prior

environmental clearance as per EIA notification, 2006.

4. No change in the calendar plan including excavation, quantum of mineral and waste shall be

made.

5. Mining will be carried out as per the approved mining plan. In case of any violation of mining

plan, the Environmental Clearance given by SEIAA will stand cancelled.

6. Four ambient air quality monitoring stations shall be established in the core zone as well as in

the buffer zone for RSPM, SPM, SO2, NOx monitoring. Location of the stations should be

decided based on the meteorological data, topographical features and environmentally and

ecologically sensitive targets and frequency of monitoring should be undertaken in consultation

with the State Pollution Control Board. The monitored data for criteria pollutants shall be

regularly up loaded on the company's website and also displayed at website.

7. Data on ambient air quality (RPM, SPM, SO2, NOx) should be regularly submitted to the

Regional office, MoEF, GoI, Lucknow and the State Pollution Control Board / Central

Pollution Control Board once in six months.

8. Ambient air quality at the boundary of the mine premises shall confirm to the norms prescribed

in MoEF notification no. GSR/826(E) dt. 16.11.09.

9. Fugitive dust emissions from all the sources shall be controlled regularly. Water spraying

arrangement on haul roads, loading and unloading and at transfer points shall be provided and

properly maintained.

10. Measures shall be taken for control of noise levels below 85 dBA in the work

environment. Workers engaged in operations of HEMM, etc. shall be provided with ear plugs /

muffs and health records of the workers shall be maintained.

11. Industrial waste water (workshop and waste water from the mine) should be properly collected,

treated so as to conform to the standards prescribed under GSR 422 (E) dated 19th May, 1993

and 31st December, 1993 or as amended from time to time. Oil and grease trap shall be

installed before discharge of workshop effluents.

12. Personnel working in areas shall be provided with protective respiratory devices like mask

and they shall also be imparted adequate training and information on safety and health aspects.

13. Special measures shall be adopted to prevent the nearby settlements from the impacts of

mining activities.

14. The transportation of the materials shall be limited to day hours time only.

15. Provision shall be made for the housing the labourers within the site with all necessary

infrastructure and facilities such as fuel for cooking, mobile toilets, safe drinking water,

medical health care, crèche etc. The housing may be in the form of temporary structures to be

removed after the completion of the project.

16. A separate Environmental Management Cell with suitable qualified personnel shall be set­up

under the control of a Senior Executive, who will report directly to the Head of the

Organization.

17. The Project Proponent shall inform to the Regional Office, MoEF, GoI, Lucknow and

State Pollution Control Board regarding date of financial closures and final approval of the

project by the concerned authorities and the date of start of land development work.

18. The funds earmarked for environmental protection measures shall be kept in separate

account and shall not be diverted for other purpose. Year wise expenditure shall be reported to

the MoEF, GoI, Lucknow and State Pollution Control Board

19. The Regional Office, MoEF, GoI, Lucknow and State Pollution Control Board shall monitor

compliance of the stipulated conditions. A complete set a documents including Environment

Impact Assessment Report, Environmental Management Plan, Public hearing and other

documents information should be given to Regional Office of the MoEF, GoI, Lucknow and

State Pollution Control Board

20. A copy of the environmental clearance shall be submitted by the Project Proponent to the Heads

of the Local Bodies, Panchayat and Municipal Bodies as applicable in the matter.

21. The Project Proponent shall advertise at least in two local newspapers widely circulated,

one of which shall be in the vernacular language of the locality concerned, within 7 days of the

issue of the clearance letter informing that the project has been accorded environmental

clearance and a copy of the clearance letter is available with the State Level Environment

on 1st June and 1st December of each calendar year.

interest of environment protection.

Annexure-4

Specific Conditions for Stone Mining projects:

1. A comprehensive EIA including mining areas within 15 K.M. to assess impact of the

mining activity on the surrounding area shall be undertaken and report submitted to this

Authority within one year. 2. No two pits shall be simultaneously w o r k e d i.e before the first is exhausted and

reclamation work completed, no mineral bearing area shall be worked.

3. After exhausting the first mine pit and before starting mining operations in the next pit,

reclamation and plantation works in the exhausted pit shall be completed so as to ensure

that reclamation, forest cover and vegetation are visible during the first year of mining

operations in the next pit. This process will follow till the last pit is exhausted. Adequate

rehabilitation of mined pit shall be completed before any new ore bearing area is worked

for expansion.

4. Adequate buffer zone shall be maintained between two consecutive mineral bearing

deposits.

5. Sprinkling of water on haul roads to control dust will be ensured by the project

proponent.

6. Green belt development shall be carried out considering CPCB guidelines including

selection of plant species and in consultation with the local DFO / Agriculture

Department. Herbs and shrubs shall also form a part of afforestation programme besides

tree plantation. The company shall involve local people for plantation programme.

Details of year wise afforestation programme including rehabilitation of mined out area

shall be submitted to the Regional Office, MoEF, GoI, Lucknow every year.

7. Blast vibrations study shall be conducted and a observation report submitted to the

Regional office, MoEF, GoI, Lucknow and UPPCB within six months. The report shall

also include measures for prevention of blasting associated impact on nearby houses and

agricultural fields.

8. Controlled blasting techniques with sequential blasting shall be adopted. The blasting shall

be carried out in the day time only.

9. Appropriate arrangement for shelter and drinking water for the mining workers has to be

ensured at the mining site.

10. Maintenance of village roads used for transportation of minerals are to be done by

the company regularly at its own expenses. The roads shall be black topped.

11. Rain water harvesting shall be undertaken to recharge the ground water source.

12. Status of implementation shall be submitted to the Regional Office,

MoEF,GoI,Lucknow and UP Pollution Control Board within six months and thereafter

every year from the next consequent year.

13. Measures for prevention and control of soil erosion and management of silt shall be

undertaken. Protection of dumps against erosion shall be carried out with geo textile

matting or other suitable material, and thick plantations of native trees and shrubs shall be

carried out at the dump slopes. Dumps shall be protected by retaining walls.

14. Trenches / garland drains shall be constructed at foot of dumps and coco filters

installed at regular intervals to arrest silt from being carried to water bodies.

Adequate number of Check Dams and Gully Plugs shall be constructed across

seasonal/perennial nallahs, if any flowing through the ML area and silts arrested. De­ silting

at regular intervals shall be carried out.

15. Garland drain of appropriate size, gradient and length shall be constructed for both mine pit

and for waste dump and sump capacity shall be designed keeping 50% safety margin

over and above peak sudden rainfall (based on 50 years data) and maximum discharge in

the area adjoining the mine site. Sump capacity shall also provide adequate retention

period to allow proper settling of silt material. Sedimentation pits shall be constructed at the

corners of the garland drains and de­ silted at regular intervals.

16. Ground and surface water, if any in and near the core zone (within 5.0 km of the lease)

shall be regularly monitored for contamination and depletion due to mining activity and

records maintained. The monitoring data shall be submitted to the Regional Office,

MoEF, GoI, Lucknow and U.P.Pollution Control Board regularly. Further, monitoring

points shall be located between the mine and drainage in the direction of flow of ground

water shall be set up and records maintained.

17. Fugitive dust generation shall be controlled. Fugitive dust emission shall be regularly

monitored at locations of nearest human habitation (including schools and other

public amenities located nearest to sources of dust generation as applicable) and records

submitted to the Regional Office, MoEF, GoI, Lucknow and U.P.Pollution Control Board

regularly.

18. Baseline data for ambient air quality shall be generated and maintained and RSPM level in

ambient air in the nearby human habitation (villages) shall also be monitored along with

other parameters.

19. Transportation of minerals shall be done by covering the trucks with tarpaulin or other

suitable mechanism so that no spillage of mineral/dust takes place.

20. Occupational health and safety measures for the workers including identification of work

related health hazards, training on malaria eradication, HIV, and health effects on exposure

to mineral dust etc. shall be carried out. Periodic monitoring for exposure to respirable

mineral dust on the workers shall be conducted and records maintained including health

records of the workers. Awareness programme for workers on impact of mining on their

health and precautionary measures like use of personal equipments etc. shall be carried out

periodically. Review of impact of various health measures shall be conducted followed by

follow up action wherever required.

21. The project proponent will ensure for providing employment to local people as per

requirement, necessary protection measures around the mine pit and waste dump and

garland drain around the mine pit and waste dump.

22. Top soil / solid waste shall be stacked properly with proper slope and adequate safeguards

and shall be utilized for backfilling (wherever applicable) for reclamation and rehabilitation

of mined out area. Top soil shall be separately stacked for utilization later for reclamation

and shall not be stacked along with over burden.

23. Over burden (OB) shall be stacked at earmarked dump site(s) only and shall not be kept

active for long period. The maximum height of the dump shall not exceed 20 m, each stage

shall preferably be of maximum 10 m and overall slope of the dump shall not exceed 35o.

The OB dump shall be backfilled. The OB dumps shall be scientifically vegetated with

suitable native species to prevent erosion and surface run off.

24. Monitoring and management of rehabilitated areas shall continue until the vegetation

becomes self sustaining. Compliance status shall be submitted to the Regional Office,

Ministry of Environment & Forests, GoI, Lucknow and U.P.Pollution Control Board on

six monthly basis.

25. Slope of the mining bench and ultimate pit limit shall be as per the mining scheme

approved by Indian Bureau of Mines.

26. Permission for abstraction of ground water shall be taken from Central Ground Water

Board. Regular monitoring of ground and surface water sources for level and quality shall

be carried out by establishing a network of existing wells and constructing new

piezometers during the mining operation. The monitoring shall be carried out four times

in a year i.e. pre­monsoon (April­May), monsoon (August), post­monsoon (November) and

winter (January) and the data thus collected shall be regularly sent to MoEF, Central

Ground Water Authority and Regional Director, Central Ground Water Board.

27. The waste water from the mine shall be treated to conform to the prescribed

standards before discharging in to the natural stream. The discharged water from the

Tailing Dam, if any shall be regularly monitored and report submitted to the

Regional Office, Ministry of Environment & Forests, GoI, Lucknow, Central Pollution

Control Board and the State Pollution Control Board.

28. Hydro geological study of the area shall be reviewed by the project proponent

annually. In case adverse effect on ground water quality and quantity is observed mining

shall be stopped and resumed only after mitigating steps to contain any adverse

impact on ground water is implemented.

29. Vehicular emissions shall be kept under control and regularly monitored. Vehicles used

for transportation of minerals and others shall have valid permissions as prescribed

under Central Motor Vehicle Rules, 1989 and its amendments. The vehicles

transporting minerals shall be covered with a tarpaulin or other suitable enclosures so that

no dust particles / fine matters escape during the course of transportation. No overloading

of minerals for transportation shall be committed. The trucks transporting minerals shall not

pass through wild life sanctuary, if any in the study area.

30. Prior permission from the Competent Authority shall be obtained for extraction of ground

water, if any.

31. A final mine closure plan, along with details of Corpus Fund, shall be submitted to the

Regional office, Ministry of Environment & Forests, GoI, Lucknow and U.P. Pollution

Control Board 5 years in advance of final mine closure for approval.

32. Project Proponent shall explore the possibility of using solar energy where ever

possible.

33. Commitment towards CSR has to be followed strictly.

34. Regular health check­up record of the mine workers has to be maintained at site in a proper

register. It should be made available for inspection whenever asked.

35. Project Proponent has to strictly follow the direction/guidelines issued by MoEF,

CPCB and other Govt. Agencies from time to time.

36. The blasting will be done only after getting the permission from the Mining Department.
