A. Implementation

§5-101. Election Under Construction Code Act.East Vincent Township hereby elects to administer and enforce the provisions of

the Pennsylvania Construction Code Act, Act 45 of 1999, 35 P.S. §§7210.101-7210.1103,as amended from time to time, and its regulations.(Ord. 176, 6/2/2004, §1)

§5-102. Uniform Construction Code.The Uniform Construction Code, contained in 34 Pa.Code, Chapters 401-405, as

amended from time to time, is hereby adopted and incorporated herein by reference asthe municipal building code of East Vincent Township with the following exceptions:

A Section 403.43(g) is amended to replace "5 years" with "1 year."B. Section 403.62.(c).1. (xvii) is deleted in its entirety.C. Section 403.64 is deleted in its entirety, and §113.0 of the BOCA National

Building Code, Thirteenth Edition, 1996, as amended by the 1998 Supplement,shall remain in full force and effect.

§5-103. Administration and Enforcement.Administration and enforcement of the Code shall be undertaken in any of the

following ways as determined by the Board of Supervisors from time to time byresolution:

A. By the designation of an employee of the Township to serve as themunicipal code official to act on behalf of the Township.

B. By the retention of one or more construction code officials or third-partyagencies to act on behalf of the Township.

C. By agreement with one or more other municipalities for the jointadministration and enforcement of this Part through an inter-municipal agree-ment.

D. By entering into a contract with another municipality for the administra-tion and enforcement of this Part on behalf of the Township.

E. By entering into an agreement with the Pennsylvania Department ofLabor and Industry for plan review, inspections and enforcement of structuresother than one-family or two-family dwelling units and utility and miscellaneoususe structures.

A Board of Appeals shall be established by resolution of the Board of Supervisorsof East Vincent Township in conformity with the requirements of the relevantprovisions of the Code, as amended from time to time, and for the purpose set forththerein. If at any time enforcement and administration is undertaken jointly with oneor more other municipalities, said Board of Appeals shall be established by joint actionof the participating municipalities.(Ord. 176, 6/2/2004, §4)

§5-105. Saving Clause.1. All building code ordinances or portions of ordinances which were adopted by

the Township on or before July 1, 1999, and which equal or exceed the requirements ofthe Code shall continue in full force and effect until such time as such provisions failto equal or exceed the minimum requirements of the Code, as amended from time totime.

2. All building code ordinances or portions of ordinances which are in effect as ofthe effective date of this Part and whose requirements are less than the minimumrequirements of the Code are hereby amended to conform with the comparableprovisions of the Code.

3. All relevant ordinances, regulations and policies of East Vincent Township notgoverned by the Code shall remain in full force and effect.(Ord. 176, 6/2/2004, §5)

§5-106. Fees.Fees assessable by the Township for the administration and enforcement

undertaken pursuant to this Part and the Code shall be established by the Board ofSupervisors by resolution from time to time.(Ord. 176, 6/2/2004, §6)

B. Construction and Development in Designated Flood Hazard Districts

§5-111. Amendment to the Building Code.This is an amendment to the Building Code of East Vincent Township (Interna-

tional Building Code (hereafter “IBC”)) to provide compliance with §60.3(d) of theNational Flood Insurance Program and the Pennsylvania Floodplain Management Actof 1978 (1978-166). A new Chapter 36 is adopted herein for purposes of managementof construction and development in designated flood hazard districts of East VincentTownship. If any later version of International Code is adopted by the Township, thefollowing Chapter 36 shall be automatically adopted as a part of said code and shall beassigned a new chapter number following the last published number of said code. [Ord.185]

CHAPTER 36

CONSTRUCTION AND DEVELOPMENT INDESIGNATED FLOOD HAZARD DISTRICTS

SECTION 3600.1 - GENERAL

3600.1 Scope: The provisions of this chapter shall govern all construction anddevelopment within designated floodplain districts.

3600.2 Performance Standards: The provisions of this chapter shall be theminimum standards for construction and development within designated floodplain andflood hazard districts and shall not supersede, but shall be in addition to applicableprovisions of other chapters of this code and of other lawfully adopted statutes,ordinances, rules and regulations. Except as may be otherwise specifically provided inthis chapter, the interpretation of the provisions of this chapter is intended to be suchthat whenever the provisions contained herein are at variance with applicableprovisions of other provisions of this code or of other lawfully adopted statutes,ordinances, rules and regulations, the most restrictive provisions shall govern.

SECTION 3601.0 - DEFINITIONS

3601.1 Application of Terms: The terms defined in this section, together with thegeneral definitions set forth in chapter 2 of this code, shall be used to interpret theprovisions of this chapter. In the event that the meanings of terms defined herein areat variance with those set forth in chapter 2 of this code, the meanings contained in thissection shall control.

3601.2 Definitions: Unless otherwise expressly stated, the following terms, for thepurposes of this chapter, shall have the meanings indicated:

Basement - any area of the building having its floor subgrade (below groundlevel) on all sides.

Completely dry space - a space which will remain totally dry during flooding;the structure is designed and constructed to prevent the passage of water andwater vapor.

Construction - the construction, reconstruction, renovation, repair, extension,expansion, alteration, or relocation of a building or structure including theplacement of mobile homes or manufactured homes.

Designated flood hazard districts - those floodplain or flood hazard districtsspecifically designated in the East Vincent Township Zoning Ordinance [Chapter27], as amended. [Ord. 185]

Designated floodway district or area - the FW Floodway Floodplain Districtand/or the floodway portion of the FA General Floodplain District designated in theEast Vincent Township Zoning Ordinance, as amended. [Ord. 185]

Development - any man-made changes to improved or unimproved real estate,including but not limited to buildings or other structures, the placement ofmanufactured homes, streets, and other paving, utilities, mining, dredging, filling,grading, excavation, or drilling operations, the storage of equipment or materials,and the subdivision of land.

Essentially dry space - a space which will remain dry during flooding, exceptfor the passage of some water vapor or minor seepage; the structure is substantiallyimpermeable to the passage of water.

Floodproofing - any combination of structural and nonstructural additions,changes, or adjustments to structures which reduce or eliminate flood damage toreal estate or improved real property, water and sanitary facilities, structures, andtheir contents.

Floodway - the area of a designated flood hazard or floodplain district requiredto carry and discharge flood waters of a given magnitude. For the purposes of thischapter, the floodway shall be capable of accommodating a flood of the 100-yearmagnitude.

Historic structure - any structure that is:(1) Listed individually in the National Register of Historic Places (a

listing maintained by the Department of the Interior) or preliminarilydetermined by the Secretary of the Interior as meeting the requirements forindividual listing on the National Register.

(2) Certified or preliminarily determined by the Secretary of the Interioras contributing to the historical significant of a registered historic district ora district preliminarily determined by the Secretary to qualify as a registeredhistoric district.

(3) Individually listed on a state inventory of historic places in states withhistoric preservation programs which have been approved by the Secretary ofthe Interior.

(4) Individually listed on a local inventory of historic places in communi-ties with historic preservation programs that have been certified either:

(a) By an approved state program as determined by the Secretary ofthe Interior.

(b) Directly by the Secretary of the Interior in states withoutapproved programs.

Lowest floor - the lowest floor of the lowest fully enclosed area (including

basement). An unfinished or flood resistant enclosure, usable solely for parking ofvehicles, building access or storage in an area other than a basement area is notconsidered a building's lowest floor; provided, that such enclosure is not built as torender the structure in violation of the applicable nonelevation design require-ments of this chapter.

Manufactured home - see "mobile home."Mobile home - a transportable, single-family dwelling intended for permanent

occupancy, office or place of assembly, contained in one or more sections, built ona permanent chassis, which arrives at a site complete and ready for occupancyexcept for minor and incidental unpacking and assembly operations, andconstructed so that it may be used with or without a permanent foundation. Theterm includes park trailers, travel trailers, recreational and other similar vehicleswhich are placed on a site for more than 180 consecutive days.

Mobile home park - a parcel or contiguous parcels of land under singleownership which has been planned and improved for the placement of two or moremobile homes for non-transient use.

New construction - Structures for which the "start of construction" commencedon or after August 20, 1969, which is the effective date of the original floodplainmanagement regulations adopted by the Township of East Vincent and includesany subsequent improvement to such structures.

Obstructions - any wall, dam, wharf, embarkment, levee, dike, pile abutment,projection, excavation, channel, rectification, culvert, building, fence, stockpile,refuses, fill, structure, or matter in, along, across, or projecting into any channel,watercourse, or designated floodplain district, which may impede, retard, or changethe direction of the flow of water either in itself or by catching or collecting debriscarried by such water or is placed where the flow of the water might carry the samedownstream to the damage of life and property.

One-hundred year flood - a flood that, on the average, is likely to occur onceevery 100 years (i.e., that has a 1 percent chance of occurring each year, althoughthe flood may occur in any year).

Recreational vehicle - a vehicle which is:(1) Built on a single chassis.(2) 400 square feet or less when measured at the largest horizontal

projection.(3) Designed to be self-propelled or permanently towable by a light duty

truck.(4) Designed primarily not for use a permanent dwelling but as temporary

living quarters for recreational, camping, travel, or seasonal use.Regulatory flood elevation - the 100-year flood elevation plus a freeboard safety

factor of 1½ feet.Street - any way used or intended to be used by vehicular traffic or pedestrians,

whether public or private, including, without limitation, a street, avenue,boulevard, road, highway, freeway, parkway, lane, alley, and viaduct.

Substantial damage - damage of any origin sustained by a structure whereby

the cost of restoring the structure to its before damaged condition would equal orexceed 50 percent of the market value of the structure before the damage occurred.

Substantial improvement - any reconstruction, rehabilitation, addition, or otherimprovement of a structure, the cost of which equals or exceeds 50 percent of themarket value of the structure before the "start of construction" of the improvement.This term includes structures which have incurred "substantial damage,"regardless of the actual repair work performed. The term does not, however,include either:

(1) Any project for improvement of a structure to correct existingviolations of state or local health, sanitary, or safety code specifications whichhave been identified by the local code enforcement official and which are theminimum necessary to assure safe living conditions.

(2) Any alteration of a "historic structure," provided that the alterationwill not preclude the structure's continued designation as a "historic struc-ture."

SECTION 3602.0 - ELEVATION STANDARDS

3602.1 Residential Structures: Within any designated flood hazard district, thelowest floor (including basement) of any improved existing residential structure allowedas a special exception or by variance shall be at least 1½ feet above the 100-year floodelevation.

3602.2 Nonresidential Structures:A. Within any designated floodplain district, the lowest floor (including

basement) of any improved existing nonresidential structure allowed as a specialexception or by variance shall be at least 1½ feet above the 100-year flood elevationor be designed and constructed so that the space enclosed by such structure shallremain either completely or essentially dry during any flood up to that height.

B. Any existing structure, or part thereof, which will not be completely oradequately elevated, shall be designed and constructed to be completely oressentially dry in accordance with the standards contained in the publicationentitled "Floodproofing Regulations" (U.S. Army Corps of Engineers, June 1972, asamended March 1992) for that type of construction.3602.3 Fully Enclosed Area Below Lowest Floor: Except as hereinafter provided,

a fully enclosed area below the lowest floor (including basement) of any residential ornon-residential structure, which areas are subject to flooding, shall be prohibited.Existing fully enclosed areas below the lowest floor of any residential or non-residentialstructure, which areas are subject to flooding and usable solely for parking of vehicles,building access, or storage in an area other than a basement, shall be allowed tocontinue provided such areas are designed to automatically equalize hydrostatic floodforces on exterior walls by allowing for the entry and exit of floodwaters. Designs formeeting this requirement either must be certified as meeting this requirement by aregistered professional engineer or architect, or must meet or exceed the followingminimum criteria: (A) a minimum of two openings having a total net area of not lessthan 1 square inch for every square foot of enclosed area subject to flooding shall beprovided; (B) the bottom of all openings shall be no higher than 1 foot above grade; and

(C) openings may be equipped with screens, louvers, valves, or other coverings ordevices provided that they permit the automatic entry and exit of floodwaters.

SECTION 3603 - DESIGN AND CONSTRUCTION STANDARDS

3603.1 Drainage Facilities: Storm drainage facilities shall be designed to conveythe flow of stormwater runoff in a safe and efficient manner. The system shall insureproper drainage at all points along streets; and provide positive drainage away frombuildings. The system shall also be designed to prevent the discharge of excess runoffonto adjacent properties.

3603.2 Sanitary Sewer Facilities: All new or replacement sanitary sewer facilities(including all pumping stations and collector systems) shall be designed to minimize oreliminate infiltration of flood waters into the systems and discharges from the systemsinto the flood waters. In addition, they should be located and constructed to minimizeor eliminate flood damage and impairment.

3603.3 Water Facilities: All new or replacement water facilities shall be designedto minimize or eliminate infiltration of flood waters into the system, and be located andconstructed to minimize or eliminate flood damages.

3603.4 Streets: The finished elevation of proposed new streets in any FloodHazard District shall be no more than 1 foot below the regulatory flood elevation.

3603.5 Utilities: All utilities such as gas lines, electrical, and telephone systemsshould be located, elevated (where possible) and constructed to minimize the chance ofimpairment during a flood.

3603.6 Fill: If fill is allowed under a special exception or variance, it shall:A. Extend laterally at least 15 feet beyond the building line from all points.B. Consist of soil or small rock materials only. Sanitary landfills shall not be

permitted.C. Be compacted to provide the necessary permeability and resistance to

erosion, scouring or settling.D. Be no steeper than one vertical to two horizontal, unless substantiated

data, justifying steeper slopes are submitted to, and approved by the TownshipEngineer.

E. Be used to the extent to which it does not adversely affect adjacentproperties.3603.7 Placement of Buildings and Structures: All new buildings and structures

shall be constructed and placed on the lot so as to be totally outside of any flood hazardarea.

3603.8 Anchoring:A. All existing buildings and structures shall be firmly anchored in

accordance with accepted engineering practices to prevent flotation, collapse orother movement thus reducing the threat to life and property and decreasing thepossibility of the blockage of bridge openings and other restricted sections of thewatercourse.

B. All existing air ducts, large pipes and storage tanks located at or below the

regulatory flood elevation shall be firmly anchored in accordance with acceptedengineering practices to prevent flotation.3603.9 Floor, Walls and Ceilings: For existing buildings in a flood hazard area

where located at or below the regulatory flood elevation:A. Wood flooring shall be installed to accommodate a lateral expansion of the

flooring, perpendicular to the flooring grain, without incurring structural damageto the building.

B. Plywood shall be of an "exterior" or "marine" grade and of a water resistantor waterproof variety.

C. Walls and ceilings shall have sufficient wet strength and be so installedas to survive inundation.

D. Windows and frames, doors and frames, doorjambs, and other componentsshall be made of metal or other water-resistant material.3603.10 Electrical Systems:

A. All electric water heaters, electric furnaces, electric air conditioning andventilating systems, and other electrical equipment or apparatus shall be permittedonly at elevations above the regulatory flood elevation.

B. No electrical distribution panels shall be allowed at an elevation less than3 feet above the level of the 100-year flood elevation.

C. Separate electrical circuits shall serve lower levels and shall be droppedfrom above.3603.11 Plumbing and Other Systems (Existing Structures):

A. Water heaters, furnaces and other mechanical equipment or apparatusshall be permitted only at elevations above the regulatory flood elevation.

B. No part of any on-site sewage disposal system shall be expanded withinany designated flood hazard or floodplain district.

C. Water supply systems and sanitary sewage systems shall be designed topreclude infiltration of flood waters into the systems and discharges from thesystem into flood waters.

D. All gas and oil supply systems for existing structures shall be designed topreclude the infiltration of flood waters into the systems and discharges from thesystems into flood waters. Additional provisions shall be made for the drainage ofthese systems in the event that flood water infiltration occurs.3603.12 Paints and Adhesives: For existing structures where located at or below

the regulatory flood elevation:A. Adhesives shall have a bonding strength that is unaffected by inundation

(i.e., "marine" or water-resistant quality).B. All wooden components such as doors, trim and cabinets, shall be sealed

with a "marine" or water-resistant quality or similar product.C. Paints or other finishes shall be capable of surviving inundation (i.e.,

"marine" or water-resistant quality).3603.13 Storage: All existing materials that are buoyant, flammable, explosive, or

in time of flooding, possibly injurious to human, animal or plant life, and not listed in

§27-1501.9.C of the Township Zoning Ordinance [Chapter 27], shall either be relocatedand stored at or above the regulatory flood elevation and/or floodproofed to themaximum extent possible or completely removed from any area affected by flooding.[Ord. 185]

SECTION 3604.0

SPECIAL FLOOD DAMAGE CONTROL PROVISIONS FOREXISTING MOBILE HOMES AND EXISTING MOBILE HOME PARKS

3604.1 Application: The provisions contained in this Section shall apply to anyexisting mobile homes and mobile home parks located in designated floodplain districts,and shall be in addition to other applicable provisions of this chapter.

3604.2 Anchoring: All existing mobile homes and any permitted additions theretoby special exception or variance shall be anchored to resist flotation, collapse, or lateralmovement by providing over-the-top and frame ties to ground anchors in accordancewith the American National Standards Institute and the National Fire ProtectionAssociation Standards as specified in the Standard for the Installation of Mobile HomesIncluding Mobile Home Park Requirements (NFPA N. 501A-1974 (ANSI A119.3-1975))as amended for Mobile Homes in Hurricane Zones or other appropriate standards suchas the following:

A. Over-the-top ties shall be provided at each of the four corners of the mobilehome, with two additional ties per side at intermediate locations for units 50 feetor more in length, and one additional tie per side for units less than 50 feet inlength.

B. Frame ties shall be provided at each corner of the mobile home, with fiveadditional ties per side at intermediate locations for units 50 feet or more in length,and four additional ties per side for units less than 50 feet in length.

C. All components of the anchoring system shall be capable of carrying a forceof 4,800 pounds per square inch.3604.3 Elevation: All existing mobile homes and any additions thereto shall also

be placed on a permanent foundation and elevated in accordance with the followingrequirements:

A. The stands or lots shall be elevated on compacted fill, or on pilings so thatthe lowest floor of the mobile home will be at or above the elevation of theregulatory flood. No expansion or enlargement of an existing mobile home shall beallowed within any floodway which would cause any increase in the elevation of the100-year flood.

B. Adequate surface drainage is provided.C. Adequate access for a hauler is provided.D. Where pilings are used for elevation, the lots shall be large enough to

permit steps; piling foundations shall be placed in stable soil no more than 10 feetapart; reinforcement shall be provided for pilings that will extend for 6 feet or moreabove the ground level.3604.4 Evacuation Plan: An evacuation plan for mobile home parks, indicating

alternate vehicular access and escape routes, shall be filed with the Code EnforcementOfficer.

3604.5 Prohibition in Floodway: No existing mobile homes or existing mobile homeparks shall be expanded or allowed in any designated floodway district or area.

SECTION 3605.0

OTHER EXISTING STRUCTURES IN DESIGNATEDFLOODPLAIN DISTRICTS

3605.1 Application: Structures lawfully existing in any designated flood hazardor floodplain district prior to the enactment of this chapter, but which are not incompliance with the provisions of this chapter, may continue to remain subject to theprovisions of this section.

3605.2 Offsetting Flood Height Effects: Existing structures located in a designatedFloodway District or area shall not be expanded or enlarged, unless the effect of theproposed expansion or enlargement on flood heights is fully offset by accompanyingimprovements.

3605.3 Alterations Under 50 Percent: Any modification, alteration, reconstructionor improvement of any kind to an existing structure, to an extent or amount of less than50 percent of its market value, shall be elevated and/or floodproofed to the greatestextent possible.

3605.4 Alterations of or Greater Than 50 Percent: Any modification, alteration,reconstruction or improvement of any kind to an existing structure, to an extent oramount of 50 percent or more of its market value shall constitute a substantialimprovement and shall be undertaken only in full compliance with the provisions of thischapter.

SECTION 3606.0 - CODE VARIANCES1

3606.1 General: If compliance with the elevation or floodproofing requirementsstated in this chapter would result in an exceptional hardship for a prospective builder,developer, or land owner, the Board of Supervisors may, upon written application, grantrelief from the strict application of the requirements, in accordance with the terms ofthis section.

3606.2 Standards for Review: Requests for variances to the strict application ofthe elevation or floodproofing requirements of this chapter may be granted by theBoard of Supervisors in accordance with the following standards:

A. No variance shall be granted for any construction, development use oractivity within any designated floodway district or area that would cause anyincrease in the 100-year elevation.

B. No variances shall be granted unless all structures proposed thereby shallbe designed and constructed so as to have the capability of resisting the hydrostatic

and hydrodynamic loads and pressures, and the effects of buoyancy of the 100-hundred year flood.

C. Except for a possible modification of the freeboard requirement involved,no variance shall be granted to or from any requirements pertaining specifically totypes of development, obstructions or activities regulated under the provisions of§27-1501 of the Township Zoning Ordinance [Chapter 27], including withoutlimitation those types of development, activities and obstructions requiring aspecial permit. [Ord. 185]

D. In reviewing any requests for a variance, the Board of Supervisors shallconsider, but not be limited to, the following:

(1) That there is good and sufficient cause for the variance.(2) That the failure to grant the variance will result in exceptional

hardship to the applicant.(3) That the granting of the variance will not result in any unacceptable

or prohibited increased flood heights, additional threats to public safety,extraordinary public expense; create nuisances; cause fraud on or victimizationof the public; or conflict with any other applicable local or State ordinances andregulations.E. If granted, the variance shall involve only the least modification of the

requirement in question necessary to provide relief.F. In granting any variance, the Board of Supervisors may attach whatever

reasonable conditions and safeguards it considers necessary in order to protect thepublic health, safety and welfare, and to achieve the objectives of this chapter.3606.3 Notification: Whenever a code variance is granted, the Board of

Supervisors shall notify the applicant in writing that:A. The granting of the variance may result in increased premium rates for

flood insurance.B. Such variance may increase risks to life and property.

3606.4 Records: A complete record of all variance requests, decisions thereon, andrelated actions shall be maintained by the Board of Supervisors. In addition, a reportof all variances granted during the year shall be included in the annual report of theTownship to the Federal Insurance Administration.

SECTION 3607.0 - SUPPLEMENTARY ADMINISTRATIVE PROVISIONS

3607.1 General: In addition to the permit application requirements andprocedures set forth in chapter 1 of this code, all proposed construction and develop-ment for expansion of an existing use within a designated floodplain district shallcomply with the permit application and procedures set forth in this section.

3607.2 Additional Documentation and Information: The following specificdocuments and information shall be included as part of the application for a permit toallow construction or development in a designated flood hazard or floodplain district:

A. A plan of the entire site, drawn at a scale of 1 inch being equal to 100 feetor less, showing the following:

(1) North arrow, scale and date.(2) A location map showing the vicinity in which the proposed activity or

development is to be located within the Township.(3) Topography based upon the National Geodetic Vertical Datum

showing existing and proposed contours at intervals of 2 feet.(4) All property and lot lines including dimensions, and the size of the site

expressed in acres, and square feet.(5) The location of all existing streets, drives and other accessways with

information concerning widths, pavement types and construction, andelevations.

(6) The location of any existing bodies of water or watercourses, buildings,structures and other, public or private, facilities, and any other natural orman-made features affecting, or affected by, the proposed activity or develop-ment.

(7) The location of the flood hazard or floodplain district boundary line;the floodway line if available; information and spot elevations concerning the100-hundred year flood elevations; and information concerning the flow ofwater including direction and velocities.

(8) A general plan of the entire site accurately showing the location of allproposed buildings, structures, and any other improvements, including thelocation of any existing or proposed subdivision and land development in orderto assure that:

(a) All such proposals are consistent with the need to minimize flooddamage.

(b) All utilities and facilities, such as sewer, gas, electrical and watersystems are located and constructed to minimize or eliminate flooddamage.

(c) Adequate drainage is provided so as to reduce exposure to floodhazards.

B. Plans of all proposed buildings, structures and other improvements, drawnat suitable scale showing the following:

(1) A detailed architectural or engineering drawings including buildingsize, floor plans, sections, and exterior building elevations as appropriate.

(2) The proposed lowest floor elevations of any proposed building basedupon National Geodetic Vertical Datum.

(3) Complete information concerning flood depths, pressures, velocities,impact and uplift forces, and other factors associated with a 100-year flood.

(4) Detailed information concerning any proposed flood-proofingmeasures.

(5) Cross-section drawings for all proposed streets, drives, and otheraccessways and parking areas showing all rights-of-way and pavement widths.

(6) Profile drawings for all proposed streets, drives and vehicularaccessways including existing and proposed grades.

(7) Plans and profiles of all proposed sanitary and storm sewer systems,water supply systems, and any other utilities and facilities.

(8) Soil types.C. The following data and documentation:

(1) A document, certified by a registered professional engineer orarchitect, which states that the proposed construction has been adequatelydesigned to withstand the 100-year flood elevations, pressures, velocities,impact, and uplift forces and other hydrostatic, hydrodynamic and buoyancyfactors associated with the 100-year flood. Such statement shall include adescription of the type and extent of floodproofing measures which have beenincorporated into the design of the structure and/or development.

(2) The appropriate component of the "Planning Module for LandDevelopment" of the Pennsylvania Department of Environmental Protection.

(3) Where any excavation or grading is proposed, a plan meeting therequirements of the Pennsylvania Department of Environmental Protection toimplement and maintain erosion and sedimentation control.

3607.3 Review by Chester County Conservation District: A copy of all applicationsand plans for construction and development related to expansion of an existing use inany designated floodplain district to be considered for approval shall be submitted bythe Code Enforcement Officer to the Chester County Conservation District for reviewand comment prior to the issuance of a permit.

3607.4 Review by Others: A copy of all plans and applications for any proposedconstruction or development for expansion of an existing use in any designated floodhazard or floodplain district to be considered for approval may be submitted by the CodeEnforcement Officer to any other appropriate agencies and/or individuals, such as,without limitation, the Township Planning Commission and the Township Engineer,for review and comment.

3607.5 Other Permit Issuance Requirements: Prior to the issuance of any permit,the Code Enforcement Officer shall review the application for such permit to determinethat all other necessary governmental permits have been obtained, such as thoserequired by state and federal laws, including, without limitation, the PennsylvaniaSewage Facilities Act, Act of January 24, 1966, P.L. (1965) 1535, as amended, the DamSafety and Encroachments Act, Act of November 25, 1978, P.L. 1375, as amended; andthe Federal Water Pollution Control Act Amendments of 1972, §404, 33 U.S.C. §1334.No permit shall be issued until such determination has been made.

3607.6 Additional Requirements and Procedures for the Application and Issuanceof Special Permits:

A. In addition to other permit application and issuance requirements of thisSection, the following information and documentation shall be required in applyingfor any special permit which may be required in the future by the Township ZoningOrdinance [Chapter 27] to allow activities, uses, construction, construction anddevelopment in a designated flood hazard or floodplain district:

(1) Certification from the applicant that the site upon which the activityor development is proposed is an existing and single parcel, owned by theapplicant or the client he represents.

(2) Certification from a registered professional engineer or architect thatthe proposed construction has been adequately designed to protect againstdamage from the 100-year flood.

(3) A statement, certified by a registered professional engineer, architect,or other qualified person which contains a complete and accurate descriptionof the nature and extent of pollution that might possibly occur from thedevelopment during the course of a 100-year flood including a statementconcerning the effects such pollution may have on human life.

(4) A statement certified by a registered professional engineer, whichcontains a complete and accurate description of the effects the proposeddevelopment will have on 100-year flood elevations and flows.

(5) A statement, certified by a registered professional engineer, whichcontains a complete and accurate description of the kinds and amounts of anyloose buoyant materials or debris that may possibly exist or be located on thesite below the 100-year flood elevation and the effects such materials anddebris may have on 100-year flood elevations and flows.

(6) An evacuation plan which fully explains the manner in which the sitewill be safely evacuated before or during the course of a 100-year flood.B. Upon filing of an application for a special permit with the Township, the

following procedures shall apply in addition to all other applicable permitprocedures:

(1) Within 3 working days following filing of the application, a completecopy of the application and all accompanying documentation shall be forwardedto the Chester County Planning Commission by registered or certified mail forits review and recommendation. Copies of the application shall also beforwarded to the Township Planning Commission and Township Engineer forreview and comment.

(2) If the application is incomplete, the Code Enforcement Officer shallnotify the applicant in writing, stating in what respects the application isdeficient.

(3) If the Township, by and through the Code Enforcement Officer,decides to disapprove the application, the Code Enforcement Officer shallnotify the applicant, in writing, of the reasons for the disapproval.

(4) If the Township, by and through the Code Enforcement Officer,approves the application, it shall file written notification thereof, together withthe application and all pertinent information with the Pennsylvania Depart-ment of Economic and Community Development, registered mail, within 5working days after the date of approval.

(5) Before issuing the special permit, the Code Enforcement Officer shallallow the Pennsylvania Department of Economic and Community Development30 days, after the receipt by the Department of the written notification ofapproval, to review the application and the decision made by the Township byand through its Code Enforcement Officer.

(6) If the Township does not receive any communication from thePennsylvania Department of Economic and Community Development during

the 30-day review period, the Code Enforcement Officer may issue the specialpermit to the applicant if all other persons or agencies have approved thesubmission.

(7) If the Pennsylvania Department of Economic and CommunityDevelopment should decide to disapprove the application, it shall notify theTownship and the applicant, in writing, of the reasons for the disapproval, andthe Code Enforcement Officer shall not issue the special permit.C. In addition to any other applicable requirements, the following provisions

shall also apply to the activities requiring a special permit. If there is any conflictbetween any of the following requirements and any otherwise applicable provision,the more restrictive provision shall apply.

(1) No application for a special permit shall be approved unless it can bedetermined that the structure or activity will be located, constructed andmaintained in a manner which will:

(a) Fully protect the health and safety of the general public and anyoccupants of the structure. At a minimum, all new structures shall bedesigned, located and constructed so that:

1) The structure shall survive inundation by waters of the 100-year flood without any lateral movement or damage to either thestructure itself, or to any of its equipment or contents below the 100-year flood elevation.

2) The first floor elevation shall be at least at the regulatoryflood elevation.

3) The occupants of the structure can remain inside for anindefinite period of time and be safely evacuated at any time duringthe 100-year flood.(b) Prevent any significant possibility of pollution, increased flood

levels, flows, or debris endangering life and property.(2) All hydrologic and hydraulic analyses shall be undertaken only by

professional engineers or others of demonstrated qualifications, who shallcertify that the technical methods used correctly reflect currently acceptedtechnical concepts. Studies, analyses, computations, and the like shall besubmitted in sufficient detail to allow a thorough technical review by the CodeEnforcement Officer, Township Engineer, and other appropriate governmentalofficials and agencies, and by the Pennsylvania Department of Economic andCommunity Development.

SECTION 3608.0 - WARNING AND DISCLAIMER OF LIABILITY

3608.1 Warning: The degree of flood protection sought by the provisions of thischapter is considered reasonable for regulatory purposes and is based on acceptableengineering methods of study. Larger floods may occur in rare occasions. Flood heightsmay be increased by man-made or natural causes, such as ice jams and bridge openingsrestricted by debris. The provisions of this chapter do not imply that areas outside thedesignated floodplain districts, or that construction, development or other land uses

permitted within such district, will be free from flooding or flood damages.3608.2 Disclaimer of Liability: This chapter shall not create liability on the part

of East Vincent Township, the Code Enforcement Officer, the Township Engineer, orany other officer or employee thereof, for any flood damages that may result fromreliance on the provisions of this chapter or on any administrative decision lawfullymade hereunder.

SECTION 3609.0 - STATE LAWS AND REGULATIONS, VALIDITY ANDCONTINUATION OF EXISTING REGULATIONS

3609.1 State Law and Regulations: In all matters that are regulated by the lawsof the Commonwealth of Pennsylvania or by regulations of departments or agencies ofthe Commonwealth promulgated by authority of law, such laws or regulations, as thecase may be, shall control where the requirements thereof are the same as or in excessof the provisions of this chapter. The Code shall control in all cases where the Staterequirements are not as strict as those contained in this chapter.

3609.2 Validity: The invalidity of any section or part of this chapter shall notaffect the remaining Sections.

3609.3 Provisions to be Continuation of Existing Regulations: The provisions ofthis chapter so far as they are the same as those of ordinances and/or codes in forceimmediately prior to the enactment of this chapter, are intended as a continuation ofsuch ordinances and codes and not as new enactments. The provisions of this chaptershall not affect any act done or liability incurred, nor shall they affect any suit orprosecution pending or to be instituted to enforce any right or penalty or to punish anyoffense under the authority of any of the repealed ordinances.(Ord. 143, 11/20/1996, §§1 and 2; as amended by Ord. 185, 8/2/2006)

Part 2

Contractor Registration

§5-201. Title.This Part shall be known as the “East Vincent Township Contractor Registration

Ordinance.”(Ord. 177, 12/1/2004, §1)

§5-202. Definitions.1. As used in this Part, the following terms and phrases shall have the meanings

indicated, unless a different meaning clearly appears from the context. The singularincludes the plural and the plural includes the singular.

Construction permit - a document issued for the construction, alteration, repair,demolition, location, maintenance or installation relating to a building, structure,elevator or equipment as required under the Uniform Construction Code [Part 1].

Contract - an agreement, whether oral or written and whether contained in oneor more documents, between a contractor and an owner, for the performance ofwork, including all labor, services and materials to be furnished and performedthere under.

Contractor - any person, other than a bona fide employee of the Owner, whoundertakes or offers to perform construction, installation, repair, roofing,remodeling, rehabilitation, demolition and any other residential or nonresidentialconstruction or demolition work in the Township, including electrical andmechanical work, whether as a general contractor, specialty contractor or homeimprovement contractor. The term ?contractor” specifically excludes thoseperforming plumbing work which is governed and regulated by Ord.119, 5/19/1993[Part 3].

Owner - the owner of the property for which construction services have beencontracted.

Person - any individual, partnership, limited partnership, association, firm,organization, corporation, trust or other legally recognizable entity.

Registration year - the 12-month period beginning January 1 of each year.Township - East Vincent Township, Chester County, Pennsylvania.

§5-203. Enforcement.The Township's Code Enforcement Officer shall administer and enforce the

provisions of this Part.(Ord. 177, 12/1/2004, §3)

§5-204. Compliance Required.No person shall act as a contractor in the Township except in compliance with the

provisions of this Part. Any person, including an owner, who willfully aids a contractoror participates with a contractor in violating any provisions of this Part is in violationof this Part. The provisions of this Part may not be waived by agreement.(Ord. 177, 12/1/2004, §4)

§5-205. Applicability of Registration.Registration approved pursuant to this Part shall not be construed to authorize the

contractor to perform any particular type of work or type of business which is reservedto qualified licensees under other provisions of State or local law.(Ord. 177, 12/1/2004, §5)

§5-206. Registration Required.It shall be unlawful for any contractor, as defined herein, to do work for which a

construction permit is required within East Vincent Township without first registeringwith the Township.(Ord. 177, 12/1/2004, §6)

§5-207. Registration Application; Issuance; Renewal.1. Every person desiring to engage in the business of acting as a contractor in the

Township shall, at least 5 days prior to performing work for which a constructionpermit is required, apply to register as a contractor in the Township.

2. To register, each contractor shall complete an application furnished by theTownship and pay the registration fee established by the Township Board ofSupervisors. The application shall require a written answer to all questions containedthereon. Failure to answer all questions on the application form shall mean that theapplication is incomplete and will not be considered until completed. Each applicationmust include satisfactory proof of insurance. Each application shall be signed by theapplicant if a natural person, and in the case of an association or a partnership, by amember or partner thereof, and in the case of a corporation, by an officer thereof. Saidapplication shall contain at least the following information verified by oath oraffirmation:

A. The full name of the applicant and local address, if any.B. The applicant's permanent address.C. The name of the applicant's employer (or a statement that such applicant

is self-employed) and/or trade name.D. A brief description of the type of work to be performed.E. A statement as to whether or not the applicant has ever been convicted of

any crime or offense related to the applicant's work as a contractor, and, if theanswer is in the affirmative, the nature of the offense or offenses and thepunishment imposed.3. Each successful applicant shall be registered and issued a registration card.

Every registered contractor, while actually acting as a contractor in the Township, shallcarry said registration card with him or her and shall display it to the Township uponrequest to do so.

4. All contractors' registrations shall expire at 12 midnight on December 31 ofeach registration year unless the registration is revoked or suspended prior theretounder the terms of this Part. Upon the expiration of any registration, if the contractorholding the same shall desire to continue or renew the same, the contractor shall berequired to file a new application and pay a new registration fee.(Ord. 177, 12/1/2004, §7)

§5-208. Executions and Exemptions.No contractor's registration shall be required of any person when acting in a

particular capacity or particular type of transaction as follows:A. An employee of a registered contractor.B. Homeowner, or family member of the homeowner, performing work on the

house which is their primary residence.(Ord. 177, 12/1/2004, §8)

§5-209. Insurance Required.1. Every applicant shall file a certificate of insurance with the Township at the

time of application. The certificate of insurance shall contain a provision that coverageafforded under the policy will not be canceled until at least 25 days prior written noticeof such cancellation has been given to the Township. The certificate of insurance mustevidence policies of insurance, maintained at the expense of the applicant, for publicliability, property damage, products liability and completed operations. Each policymust have a single occurrence limit of at least $300,000. In addition to the above,blasting and demolition insurance shall also be required for blasting and demolitioncontractors, and the reasonable limits of such insurance shall be determined by theTownship at the time of application, based on the nature and extent of the applicant'sproposed operations.

2. All types and limits of insurance for which certificates are presented at thetime of application, and based upon which a registration card is issued, shall bemaintained throughout the registration year or the registration will be suspended orrevoked as hereinafter set forth in this Part.(Ord. 177, 12/1/2004, §9)

§5-210. Fees.Registrations shall be valid only for the specific dates shown thereon, and the

annual contractor's registration fee shall be paid to the Township Secretary inaccordance with the then current East Vincent Township Fee Schedule, as adopted byresolution of the Board of Supervisors, and as amended from time to time. There shallnot be a prorated reduction in the registration fee, and no fee or portion thereof shallbe returned or refunded.(Ord. 177, 12/1/2004, §10)

§5-211. Changes in Ownership, Address or Trade Name.Every contractor registered to perform work in the Township shall, within 10 days

after a change in ownership, address or trade name, notify the Township of such

§5-212. Standards for Refusal of Issuance or Revocation of Registration.No registration shall be issued, and any registration issued hereunder may be

suspended or revoked, under the following circumstances:A. The applicant falsely answered any question or questions contained on the

application form.B. The applicant has been convicted within 2 years prior to the date of the

application for any crimes or offenses under any federal or state criminal statuteor common law criminal offense or for violation of any municipal ordinanceprovided that such convictions were for crimes or offenses related to the applicant'swork as a contractor. The term conviction shall include guilty pleas of nolocontendere.

C. The registrant fails to maintain the policies of insurance required underthe provisions of this Part.

D. The registrant violates any of the terms or provisions of the UniformConstruction Code [Part 1].

E. The registrant fails to obtain a construction permit prior to the commence-ment of work, except in the case of an emergency.

F. The registrant violates any condition or requirement of a constructionpermit issued by the Township.

G. The registrant willfully deviates from or disregards any plans orspecifications for any contracting job in any material respect without first obtainingthe consent of the Owner, in writing, to any such change and without first notifyingthe Township of any such change.

H. The registrant fails to comply with an order, demand or requirementlawfully made by the Township under the authority of this Part or any otherTownship ordinance.

§5-213. Violations and Penalties.In addition to revocation or suspension of registration, any person who fails to

correct a violation or institute a remedial action as ordered by the Township or whoviolates a provision or fails to comply with any requirements of this Part or of any of theother applicable provisions of the Uniform Construction Code [Part 1], upon convictionthereof in an action brought before a magisterial district judge in the manner providedfor the enforcement of summary offenses under the Pennsylvania Rules of CriminalProcedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, indefault of payment of said fine and costs, to a term of imprisonment not to exceed 90days. The fine or penalty imposed under this Section shall be in addition to anyregistration fees imposed under this Part. Each day that a violation of this Partcontinues shall constitute a separate offense. Notwithstanding the aforesaid, theTownship may seek enforcement by means of a request for injunctive relief or otherequitable remedies as may be provided by law in a court of competent jurisdiction.

Registration and Licensing of Plumbers

§5-301. License and Registration Required.It shall be unlawful for a person to carry on or work at the business of plumbing or

building drainage in East Vincent Township until a certificate or license to engage inor work at said business shall have been granted said person by the plumbing officialand until said person shall have registered as such in the office of the plumbing officialof East Vincent Township; provided, however, that nothing in these regulations shallbe construed to prevent the employment of registered journeyman plumbers or theworking of apprentices under the direction of duly registered and licensed masterplumbers.(Ord. 119, 5/19/1993, §1)

§5-302. Definition of Plumbing Official.As used in this Part, the term "plumbing official" shall mean the Township Building

Officer.(Ord. 119, 5/19/1993, §2)

§5-303. Registration and Licensing Requirements.1. Registration of Master Plumbers.

A. All master plumbers duly registered and licensed in any other municipalityshall not be required to undergo an examination, and they shall be entitled toregister for the current year and annually thereafter before December 31 of eachyear.

B. All master plumbers who desire to engage in the business of plumbingand/or building drainage in the Township shall apply to the plumbing official forregistration as provided herein.

C. All plumbers who are not registered or licensed as master plumbers in anyother municipality and who desire to become master plumbers to engage in thebusiness of plumbing and building drainage in East Vincent Township shall applyto the plumbing official for registration, and they will be required to take anexamination as hereinafter provided before receiving such registration.

D. An applicant for master plumber must have been a journeyman plumberfor at least 2 years before taking the examination for master plumber.

E. Plumbing contractors or master plumbers duly registered and licensed inthe current year in East Vincent Township must be present at all times during theinstallation of sewer laterals or have a qualified journeyman plumber dulyregistered and licensed in the current year in East Vincent Township in charge ofthe installation for proper supervision.2. Registration of Journeymen Plumbers.

A. All journeymen plumbers duly registered and licensed as such in any othermunicipality shall not be required to undergo an examination to work in East

Vincent Township, and they shall be entitled to register for the current year andannually thereafter by December 31 of each year.

B. All plumbers who are not registered or licensed as journeymen plumbersin any other municipality and who desire to become journeymen plumbers in EastVincent Township shall apply to the plumbing official for registration, and they willbe required to take an examination as hereinafter provided before receiving suchregistration.

C. An applicant for journeyman plumber must have been a registeredapprentice for at least 4 years before taking the examination for journeymanplumber.3. Registration of Apprentice Plumbers. All individuals working as apprentice

plumbers for a master plumber who has his business or works in the Township shallapply to the plumbing official for registration.

4. Registration Fees.A. The annual registration fee for plumbers shall be as provided in the fee

schedule adopted by the Board of Supervisors by resolution from time to time.B. Delinquent Registration Fees. All plumbers who fail to re-register for the

following year by December 31 shall be considered as delinquent, and they shallpay an additional delinquency fee as provided for in the fee schedule adopted by theBoard of Supervisors by resolution from time to time, prior to re-registering.5. Expiration of Licenses. At the expiration of each calendar year, said certificate

of registration or license shall be null and void. A licensed master plumber and/orjourneyman plumber desiring to continue in or work at the business of plumbing andbuilding drainage for the ensuing year shall, before December 31 of each year,surrender the said certificate or license for the current year to East Vincent Townshipand re-register his, their or its name or names and business or home address upon suchforms as may be furnished by said East Vincent Township.

6. Certificate May Be Revoked. The certificate of registration granted under thissection may be suspended or revoked by the plumbing official when a master plumber,firm or corporation or the registered representative thereof shall violate any of theserules and regulations or shall refuse or neglect to make the necessary corrections towork not approved by the plumbing official within a reasonable time after writtennotification, or shall permit the use of his, their or its name by person or persons for thepurpose of obtaining a permit or permits to do plumbing and drainage work or to dowork under his or their license.

7. Certificate of Insurance. Any person registering with the plumbing officialpursuant to subsection .1 of this section, upon registration, shall furnish a certificateof insurance. No permits will be issued before this certificate of insurance is submitted.

8. Misrepresentation. It shall be unlawful for any person who does not have amaster plumber's license issued by the plumbing official to engage in or to representhimself as engaged in the business of plumbing in this Township or to use the words"master plumber," "plumber" or "plumbing" in any form of advertising or to display asign containing these words or any of them in the Township.

9. Compliance With Section. For each written, certified statement of compliancewith the provisions of this Part, there shall be a charge as provided for in the fee

schedule adopted by the Board of Supervisors by resolution from time to time.(Ord. 119, 5/19/1993, §3)

§5-304. Examination of Plumbers.1. Applications. All plumbers desiring to engage in the business or work of

plumbing and building drainage in this Township shall apply in writing to theplumbing official for a certificate or license. The plumbing official will examine theapplication and determine if the applicant is qualified for certification withoutundergoing an examination (based on his holding a license from another municipalityas described in §5-303 above) or if he will be required to take the examination. If, afterproper examination as hereinafter described said person or persons shall be foundcompetent, the same shall be certified to the plumbing official of East VincentTownship, who shall thereupon issue a certificate or license to such person or persons,which shall for the period of 1 calendar year or fractional part thereof entitle him orthem to engage in or work at the business or work of plumbing and building drainage.

2. Registration. A register of all such applicants and the license or certificatesissued will be kept in the office of the plumbing official, which register will be open tothe inspection of all persons interested therein.

3. Examination. Any applicant, who the plumbing official determines must takean examination, shall take the examination at one of the following locations:

A. Regional testing center.B. Any other location or testing service hereinafter designated by the

Township by resolution of the Board of Supervisors.The applicant shall be responsible for payment of all examination fees.

§5-305. Place of Business.1. Place of Business. Every registered master plumber shall have a bona fide place

of business and shall display on the front of his place of business and on his vehicle asign, "Registered Plumber," bearing the name of the person holding the registration,and shall give his business name, address and telephone upon application forregistration.

2. Advertising. It shall be unlawful for any person, firm or corporation toadvertise himself or itself as a registered master plumber unless said person, firm orcorporation holds a bona fide registration.

3. Notice of Change of Place of Business. Every registered master plumber, firmor corporation shall give immediate notice of any change in its place of business, andupon retirement from business or upon failure to continue to actively engage in thebusiness of plumbing, said registered master plumber, firm or corporation shallsurrender its certificate of registration to the plumbing official.(Ord. 119, 5/19/1993, §5)

1. Plans and Specifications.A. The drainage of all buildings, public or private, and all alterations,

extensions and additions to drainage systems shall be executed in accordance withplans and specifications approved in writing by the plumbing official. No specialequipment of any description for a hospital or institution of similar character,manufacturing establishment, chemical laboratory or other laboratory or any placewhere special equipment is required which necessitates connections with the ventpipes or the general drainage system of a building shall be installed until plans ofthe proposed installation shall be submitted to and approved by the plumbingofficial.

B. There shall be a separate plan placed on file in the office of the Townshipfor each building, public or private, or any addition thereto or alterations thereof,accompanied by specifications describing the drainage of said building on theblanks prescribed and furnished for this purpose, showing the location, size andkind of pipes, traps, closets and fixtures to be used and showing partitions andmethod of ventilating water closet compartments. Plans must be drawn legible inink, and old work shall be shown in red ink. All applications for change in plansmust be made in writing. In replacing any fixtures, the master plumber shall fileapplication for replacement before starting work. Plans filed for the correction ofany complaint must designate the approximate time for the completion thereof.

C. A plot plan showing the location of building, together with the buildingsewer, wells and all drainage piping of every description connected with thesanitary drainage system, shall in all cases be submitted. When plans have beenprepared by registered architects and engineers showing all drainage, venting,piping and fixture location in a manner satisfactory to the plumbing official, theseplans and specifications may be submitted for approval with an approved plot planfurnished for this purpose.2. Approval of Plans and Specifications. A permit of approval will be issued in

writing when a plan is deemed satisfactory by the plumbing official. Under nocircumstances whatever shall a verbal approval or permission given by anyone beconsidered a justification for any deviation from the approved plans or for the violationof any of the rules and regulations governing building drainage.

3. Plumbing Permit Fees. When a plumbing permit is issued based on theapproved plans and specifications, fees will be charged in accordance with the feeschedule adopted by the Board of Supervisors by resolution from time to time.(Ord. 119, 5/19/1993, §6)

§5-307. Plumbing Official.1. The plumbing official shall ascertain that all plumbers doing plumbing and

drainage work in East Vincent Township are registered in accordance with this Sectionto assure competent work.

2. He shall require, examine and check plans, specifications, description andinformation submitted to him by any person applying for permission to do plumbingand drainage work and, upon approval thereof, authorize the work to be done. He shallinspect all plumbing and drainage work authorized for the purpose of determiningwhether or not such work complies with the provisions of this Section, approving or

condemning the same in whole or in part as conditions may require, or he shall ordersuch changes in workmanship and material as will make the same conform thereto. Allwork shall be inspected prior to being covered or concealed. Inspections shall be madewithin 48 hours of notice that the work is sufficiently advanced for inspection.

3. Whenever the plumbing official shall find any building or premises in or uponwhich there is being maintained a plumbing or drainage system in a defective, leakingor unsanitary condition, it shall be his duty to notify in writing the owner of thepremises in which such condition exists to correct such condition within a specified timeafter receipt of notice. Should any person served by such notice fail or refuse to complywith the order contained therein within the tine specified or fail to commence in goodfaith to comply with such order, the plumbing official shall institute proceedings to forcecompliance with such order.

4. The plumbing official or his representative, in the discharge of his duties, shallhave authority to enter any building, structure or premises at any reasonable hour.(Ord. 119, 5/19/1993, §7)

§5-308. Penalties for Violation.Any person, firm, or corporation violating any of the provisions of this Part, or who

fails to act in compliance with this Part, upon conviction thereof in an action broughtbefore a magisterial district judge in the manner provided for the enforcement ofsummary offenses under the Pennsylvania Rules of Criminal Procedure, shall besentenced to pay a fine of not more than $1,000 plus costs and, in default of paymentof said fine and costs, to a term of imprisonment not to exceed 90 days. Each day thata violation of this Part continues or each Section of this Part which shall be found tohave been violated shall constitute a separate offense.(Ord. 119, 5/19/1993, §8; as amended by Ord. 185, 8/2/2006)
