Executive Summary
This is a request to permit used automobile sales on a site along
Washington Highway that has been utilized for automobile-related
uses for many years. The site has recently been used as an
automobile service and repair shop as well as a vehicle tow and
storage lot, and the applicant would like to continue those uses.
Only a portion of the site is zoned B-3; therefore, a companion
rezoning request has also been submitted to rezone a portion of the
A-I property to B-3 for the used automobile sales and repair and
the remaining portion to M-2 to permit the vehicle tow lot
use.

Planning Analysis
The applicant is proposing to utilize the existing building on the
site as an office for used automobile sales as well as an
automobile service and repair business. No new buildings are
proposed. The applicant has indicated that this request will allow
for rehabilitation of the building, and renovations will be
generally consistent with the existing character. The building
awning and parking area align the existing right-of-way and are
within the ultimate right-of-way for Washington Highway. Because a
portion of the building is located within the required 25’
thoroughfare buffer, the applicant has also submitted an
application for a Special Exception for a buffer reduction. New
tree and shrub plantings are still proposed, which should help to
enhance the appearance of the property.
Currently, there is no defined driveway for the site along
Washington Highway, and access is unrestricted. The sketch plan
shows a one-way entrance and one-way exit, each to be narrowed to
20’ wide, which should improve safety to and from the site. A
painted barrier adjacent to the entrance should also allow for more
orderly access to the site.
The plan shows vehicle display areas on both sides of the building
along front of the property. Twelve (12) parking spaces for
employees and customers have been provided on the northern and
southern boundary of the property, which exceeds the ten space
minimum. A six (6) foot board-on-board fence is proposed for
overflow parking and vehicle storage and display areas. In
addition, staff is recommending that all vehicles waiting for
service be screened from view from the public right-of way.
Comprehensive Plan
The subject property is designated for Industrial use on the
General Land Use Plan Map of the Comprehensive Plan. A portion of
the site has been zoned B-3 since 1974, when the Comprehensive
Rezoning of the County took place, likely to accommodate existing
commercial use of the property. This request is consistent with the
historic use of the property for automobile repair and service and
vehicle storage. The site is surrounded by A-i zoned properties,
including one with a residence to the north but it is also adjacent
to the South Anna River and land that is within the floodplain. The
required screening between the property with the existing residence
to the north and the existing and proposed businesses improves the
compatibility between these uses. Therefore, the proposed use is
appropriate and compatible with the surrounding area.
Agency Analysis
There were no substantive comments from any of the reviewing
agencies.
In accordance with Section 26-325, the site shall be developed and
maintained in substantial conformity with the sketch plan titled,
“Concept Plan #1 — Britt Motors,” dated June 1, 2018, revised
August 20, 2018, and prepared by Silvercore.
A site plan, prepared in accordance with the requirements of
Chapter 26, Article 6, Division 2, of the Hanover County Zoning
Ordinance, shall be submitted for review and approval prior to
commencement of the requested use.

1. No outside speaker systems shall be permitted.
2. The applicant shall provide evidence that the State-issued
license to sell used vehicles has been issued prior to issuance of
a Certificate of Occupancy.
3. All vehicles awaiting repair shall be screened from view from
Washington Highway in accordance with Section 26-263.
4. Storage of inoperable vehicles, as referenced in the Hanover
County Code, shall be prohibited on the property.
5. All development and use of the property shall comply with all
federal, State and local statutes, ordinances and regulations
Planning Commission Recommendation
At their meeting of September 20, 2018, the Hanover County Planning
Commission, on a motion by Ms. Iverson, seconded by Mr. Hadra,
voted to recommend APPROVAL of the request for a Conditional Use
Permit to allow used automobile sales on GPLN 7871-99-8453(part),
consisting of approximately 3.73 acres, subject to the
staff-recommended conditions.
