NEW LAWS GO INTO EFFECT JULY 1ST!!!!By Abdulaziz, Grossbart & Rudman
You’ve known for a while that things were changing but are you prepared? SB 189 and SB 190 make numerous changes and although these changes are not very substantive they will need to be complied with. This is especially true since there is no grace period on compli-ance. This is meant to just be a very brief over-view of the items that are changing effective July 1, 2012. The biggest item is the statutory reference changes. The Civil Code sections that deal with Mechanic’s Liens, Stop Notices and Payment Bonds have been completely renumbered. As an example, the information currently found in Civil Code section 3081.1 will be found in the new Civil Code sections 8014 and 8300 begin-ning July 1, 2012. Some of the common terms that the industry is accustomed to dealing with have been rede-fined in the statutes. Effective July 1, 2012, “ma-terialman” will be “material supplier”; “original contractor” will be “direct contractor”; “Stop Notice” will be “Stop Payment Notice”. In ad-dition, the definition of a contract has been broadened. If the contract is with the “direct contractor” it will be called a “direct contract”. Lastly, the definition of a “design professional” will include a licensed landscape architect ef-fective July 1, 2012. The “Preliminary 20-Day Notice” will simply be referred to as a “Preliminary Notice”. The pri-
vate works Preliminary Notice will have new language for the Notice to Property Owner effective July 1, 2012. This language can be found in the new Civil Code section 8202 or on our website. The waiver and lien releases have been com-pletely re-written by the new legislation. The statute indicates that “the waiver and release shall be null, void, and unenforceable unless it is in substantially the following form:” and pro-ceeds to have the suggested text for each waiv-er. We believe it is better to be safe rather than risk the waivers and releases being unenforce-able and use the exact same language provided in the statutes. The Conditional Waiver and Re-lease on Progress Payment, Conditional Waiver and Release on Final Payment; Unconditional Waiver and Release on Progress Payment and Unconditional Waiver and Release on Final Pay-ment can be found in the new Civil Code section 8132, 8134, 8136 and 8138 or on our website. Effective July 1, 2012, an owner, including a public entity, will have 15 days after the date of completion of a work of improvement in order to record a Notice of Completion. The owner currently has 10 days. Additionally, if the No-tice of Completion contains an erroneous state-ment of the date of completion, it will not affect the effectiveness of the Notice if the true date of completion is 15 days or less before the date of recordation of the notice. The new Civil Code section 8180 no longer rec-ognizes acceptance by the owner as an event that constitutes completion in private works. The Notice of Extension of Credit statute is cur-rently not very clear as to who must execute the Notice of Extension of Credit. Effective July 1, 2012, there is some clarification and the new Civil Code section 8460 explicitly provides that both the contractor (the claimant of the Me-chanic’s Lien) and the owner must sign the No-tice of Extension of Credit and have it notarized before recording. The statute also specifies the exact additional time granted to file the suit to foreclose. The Notice of Extension of Credit will also be able to be recorded after the expiration of the Mechanic’s Lien if it is recorded before any purchaser or encumbrancer for value ac-quires rights. There are slight changes to the language of the Mechanics Lien Warning that is required on Home Improvement Contracts as per Business and Professions Code section 7159 and there is now a different Mechanics Lien Warning for New Residential Contracts as per Business and Professions Code section 7164. Also in Business and Professions Code section 7159, the spelling of “Down Payment” which is in the contract twice, has been changed to read as one word so it should now be “Down-

CHOCKING AND BLOCKING SAFETY
Chocking and blocking prevent accidental or unintended movement of mobile equipment and cargo while workers are loading, unloading, hitching, unhitching, or performing service or maintenance. Chocking the wheels of a truck, trailer, tractor, or other piece of mobile equipment provides a physical stopper to the wheels to prevent runaways that can crush and injure workers. Blocking stabilizes cargo loads to prevent shifting and trailer overturns or provides a physical barrier on equipment to prevent accidental activation during maintenance.
When chocking, use specially designed truck wheel chocks of the appropriate size and material to securely hold the vehicle. Don’t use lumber, cinder blocks, rocks, or other make-shift items to chock. Make it easy to find and use the correct chocking equipment; store chocks inside trailers, truck rigs and/or other mobile equipment. Keep chocks available at loading docks; chain the chocks to the dock to prevent them from being misplaced.
If you drive a truck, tractor, or other mobile equipment, use special caution when exiting the vehicle. Ensure that the brakes are set, the vehicle is at a complete standstill, and that it will not roll forward or backward before you exit. If you are performing maintenance or parking the vehicle for an extended period of time, chock the wheels. To properly chock a free-standing vehicle, place chocks on the left and right rear axle wheels. It is safest to chock both the front and back wheels on both sides of a vehicle. Some vehicle wheels may also need to be chocked at the front and back of each tire.
Ensure that trailers are firmly placed against the loading dock edges and prevent rollaways by using chocks. Place chocks on the left and right wheels that are closest to the loading dock. This placement allows a forklift to push down on the trailer wheels and seat them more firmly against the chock. If only the front axle is chocked, a forklift could push the trailer forward and loosen the chock or cause the wheel to jump the chock. The driver, dock workers, and forklift drivers share the responsibility to ensure that the truck and trailer wheels are properly chocked.
Use extra caution when driving a forklift into a trailer from the dock edge; if the trailer rolls away from the dock edge, the forklift can fall into the gap and cause severe injuries or death. Never drive a forklift into a trailer until you ensure that the wheels are properly chocked. Ensure that the trailer floor is in good condition and that it can support the weight of the forklift and its load.
Block or secure trailer cargo to prevent the load from shifting during transit and unloading. Shifting loads can strike, injure, and engulf workers while a sudden shift in center of gravity can overturn a trailer. Securely block all cargo, not just wheeled equipment and round items (e.g., wire reels). Block items separately and on all four sides using lumber thick enough to prevent cargo movement. Use nails or spikes long enough to secure the lumber and drive them in at opposing angles. Don’t use other freight or cargo as a block. When performing maintenance on equipment that could pose a pinch hazard, block it to prevent accidental activation.
Don’t be a blockhead; chocking and blocking prevents serious injuries caused by runaway vehicles, shifting cargo, and accidentally activated machinery.

SEGURIDAD CON EL USO DE CUÑAS Y CALZOS
El uso de cuñas y calzos evita el movimiento accidental o inesperado de equipos móviles y carga cuando los trabajadores están cargando, descargando, conectando desconectando remolques, o haciendo mantenimiento o servicio. El uso de cuñas en las ruedas de los camiones, remolques, tractores u otros equipos móviles brinda una barrera física al movimiento de las ruedas para evitar que el equipo se desplace y atropelle o lesione a un trabajador. Los calzos estabilizan la carga para evitar que se desplace en tránsito volcando el remolque, o proporciona una barrera física en los equipos para evitar que se accionen accidentalmente durante las operaciones de mantenimiento.
Al poner cuñas en las ruedas, use cuñas especialmente diseñadas para ruedas de camiones, del tamaño y materiales apropiados para detener con efectividad el vehículo. No se deben usar a guisa de cuñas pedazos de madera, bloques de cenizas, piedras u otros materiales improvisados. Facilite encontrar y usar las cuñas apropiadas; guárdelas dentro de los remolques, camiones u otros vehículos. Si usted conduce un camión, tractor u otros vehículos, tenga especial cuidado al salir del mismo. Asegúrese de dejar puesto el freno, que el vehículo esté completamente inmóvil y que no pueda desplazarse hacia adelante o hacia a tras antes de que usted salga del mismo. Si está haciendo mantenimiento o estacionando el vehículo por largo tiempo, póngale cuñas bajo las ruedas. Para acuñar correctamente un vehículo, coloque cuñas bajo las ruedas traseras izquierda y derecha. Lo más seguro es poner cuñas bajo las ruedas delanteras y traseras en ambos lados del vehículo. En algunos vehículos también puede ser necesario poner cuñas adelante y atrás de cada rueda.
Asegúrese de que los remolques queden firmemente apoyados contra el borde del andén de carga y evite que se desplacen usando cuñas. Coloque las cuñas bajo las ruedas izquierda y derecha más cercanas al andén de carga. Calce o asegure la carga en el remolque para evitar que ésta se desplace en tránsito o durante su descarga. Las cargas que se desplazan pueden golpear, lesionar o sepultar a un trabajador, y un desplazamiento súbito puede cambiar el centro de gravedad y hacer volcar al remolque. Calce correctamente todas las cargas, no sólo los vehículos y los artículos redondos (ejemplo: rollos de cables). Calce cada artículo por separado y por los cuatro lados usando tablas de suficiente tamaño para evitar que la carga se mueva. Use clavos o púas de suficiente longitud para sujetar la madera y póngalos en ángulos opuestos. No use otras partes de la carga como calces. Al hacer mantenimiento en equipos que puedan presentar un peligro de quedar atrapado, cálcelo para evitar que se desplace accidentalmente.
Sea precavido; el uso de cuñas y calces previene lesiones graves causadas por el desplazamiento accidental de vehículos, de la carga o de maquinaria.

WATER • Is there plenty of fresh, cool drinking water located as close as possible to the workers?
• Is there a plan for refilling water coolers throughout the day?

Does a “C-10” need Worker’s Comp if he hires a contract ‘installer’? CA offers a ‘family waiver’ but what about Arizona or Nevada? John Len-non is credited with saying ‘life happens while you’re making plans’, and our first contractor is discovering that. The government bureaucracy isn’t required to keep your address up to date, you are. Failing to do so can have some serious consequences…
Q: I noticed this morning that my license has ex-pired. We have jobs going right now under con-tract with this license. Since we did not receive this renewal in the mail, I asked our Responsible Managing Officer (RMO) to contact you so we could get a copy of the renewal application and hopefully get it posted before it expires. He as-sured me he had a plan to overnight it to you and you would run it over to CSLB in time. Looks like it didn’t happen. Do I need to stop all work under contract until this gets fixed?
A: We talked with the RMO regarding this issue; however, the renewal was not sent through our office. We picked up a copy of the renewal appli-cation at the CSLB and emailed it to your Quali-fier. He called a few days ago to say that the re-newal was inadvertently sent overnight directly to the CSLB (and he did not retain a copy). Since,
we did not have a chance to review the docu-ment before submission, I cannot say if all items were correct. Unfortunately, since the license now shows “expired”, you technically should stop all work until the license is back in good stand-ing. Assuming there are no problems with the renewal (i.e. proper signatures/fees, corporate status), it should be processed soon. If there is an issue, the CSLB will reject the application, send a letter detailing the problem, and require payment of a delinquent fee.
Q: I was wondering if I could get an answer to a question about Worker’s Compensation. If a “C-10” license holder hires an installation com-pany to come in and do a particular job, and that company does not have a license, is it the responsibility of the “C-10” license holder to pro-vide Worker’s Compensation Insurance? Or is it the responsibility of the unlicensed company to carry it? Thank you for your time. I look forward to hearing back from you.
A: Generally speaking, if you hire someone it’s ul-timately your responsibility to make sure they’re covered by Worker’s Compensation. If they are covered through another licensed contractor, this is fine. However, since UNLICENSED “con-tractors’ rarely cover their employees, if some-
one gets hurt, they’re probably going to come after your insurance.
Q: My father recently retired and I was able to re-place him on our CA license with a waiver of the exams. I have worked for the company for over 15 years. We need to do this same process for our Nevada and Arizona licenses; can you help with that?
A: We would be happy to help you with the appli-cation process in Nevada (NV) and Arizona (AZ); however, while CA allows individuals who are a close family member (son, daughter, spouse, etc.) to waive the exams, NV and AZ aren’t as generous with granting these waivers. The only way either State will grant a waiver is if you’ve been listed as the Qualifier on a NV or AZ license within the last 5 years, or if you have been licensed for at least 5 years and have passed an equivalent exam in CA or UT. In other words, these states do not have a “family waiver” option.

A public entity shall give notice to a claimant that has given a Stop Payment Notice of the time within which an action to enforce pay-ment of the claim stated in the Stop Payment Notice must be commenced if the claimant paid the public entity ten dollars ($10) at the time of giving the Stop Payment Notice.

Unlicensed Operators
Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.
The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.
If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:
any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.
If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.

RUN TIME - The Santa Barbara Contractors Association web site www.sbcontractors.org, had more than 2.7 million visitors in the year 2011. Ads run for 12 seconds each on every page of the site. All banner ads can link to your company website. The online planroom site runs per click in each zone, and a biannual report of ad views and ad clicks can and provided upon request. DISTRIBUTION - The Santa Barbara Contractors Association Newsletter is distributed 52 times a year to over 600 subscribers. Copies are delivered electronically on Wednesdays. The Newsletter is provided free to association members.
