ORDINANCE NO. 2012-1AN AMENDED ORDINANCE REGULATING THE

USE OF MOTORIZED CARTS WITHINTHE CITY OF RISING SUN

(REPEALING ORDINANCE NO. 2008-3)WHEREAS, the current Ordinance regulating theuse of motorized carts within the City of Rising Sundoes not adequately address the requirement of li-ability insurance on motorized carts and other simi-lar devices within the city limits; andWHEREAS, the improper use of motorized carts oncity streets creates a potential for liability as well asa traffic hazard for other vehicular traffic and a dan-ger to the occupants of motorized carts within thecity limits of Rising Sun; andWHEREAS, the intent of this Ordinance is to regu-late the use of motorized carts within the corporatelimits of the City of Rising Sun and to require Proofof Financial Responsibility at the time of registra-tion and in the operation of motorized carts.NOW, THEREFORE, BE IT ORDAINED BY THE COM-MON COUNCIL OF THE CITY OF RISING SUN, INDI-ANA, that the Rising Sun Code of Ordinances ishereby amended by adding the following provi -sions:1. Definitions.

a. Motorized Carts means a conveyance that is: otor vehicle.

b. The term does not include:(1) an electric personal assistive mobility device(as defined in IC 9-13-2-49.3);(2) a motorcycle (as defined I IC 9-13-2-108);(3) a motor scooter (as defined in IC 9-1 104);(4) a motorized bicycle (as defined in IC9-13-2-109); or(5) an off-road vehicle.

2. Operations & Limitations.a. Motorized carts may be operated 'within thecorporate limits of RisingSun by:

(1) Those persons who are 16 years of age andolder and have a validmotor vehicle drivers license, or State of Indianaphotoidentification card;(2) Those persons who are 15 years of age, butnot yet 16 years ofage, if accompanied in the front seat by a per-son at least 18 yearsof age who holds a valid motor vehicle drivers li-cense;

b. No person under the age of 15 years of ageshall be permitted to operatea motorized cart on any public street within thecorporate limits of theCity of Rising Sun.c. No person whose driving privileges are sus-pended for the commission ofa crime (including Operating While Intoxicated)shall be permitted tooperate a motorized cart on any public streetwithin the corporate limitsof the City of Rising Sun.d. A person may not register a motorized cart oroperate a motorized cart ona public highway in Rising Sun if financial respon-sibility is not in effectwith respect to the motorized cart in accordancewith Section 5 of thisOrdinance.e. All operators of motorized carts shall abide byall traffic regulationsapplicable to vehicular traffic.f. Motorized carts shall not be operated on side-walks or in City parks otherthan in parking areas or recognized vehicle trafficareas.g. Motorized carts shall be operated only if suchcarts are equipped withfunctional headlights, taillights, windshield, and abrake light.h. Motorized carts may not traverse streets andhighways under thejurisdiction of the Indiana Department of Trans-portation. Motorizedcarts may cross these streets to access otherstreets at streetintersections only. The specific streets and high-ways referenced includeNorth High Street (SR 56), South Walnut Street(SR 56), Street and WestMain Street (SR 262) throughout the corporatelimits of the City.Crossings must be made at a right angle.

3. Registration. Before any motorized cart may beoperated within the corporate limits of Rising Sun, aperson shall bring documentation setting forth adescription of said cart, along with said cart, to theRising Sun Police Department. The Rising Sun Po-lice Department shall complete a motorized cartchecklist and confirm the working order of saidcart. Once the checklist is completed and signed byan Officer, the person shall bring the completedchecklist to the Clerk Treasurer's Office, along withproof of Financial Responsibility and payment ofTwenty Dollars ($20). The Clerk-Treasurer shall is-sue a decal to be applied to the rear of such cart soas to be plainly visible. The decal, when issued,shall be non-transferable from the cart for which itis issued. The registration shall be effective untilsuch time as the cart is sold.4. Slow Moving Vehicle Emblem. Before any motor-ized cart may be operated within the corporate lim-its of Rising Sun, the cart must have affixed theretoa slow moving vehicle emblem as required by IC9-21-9-2. The emblem shall conform with thosestandards and specifications adopted for slow-mov-ing vehicles in 205 IAC 1-1 1 et. seq. Such emblemshall be mounted on the rear of such vehicles, inthe approximate horizontal geometric center of thevehicle, at a height of three (3) to five (5) feet abovethe roadway, and shall be maintained at all times ina clean and reflective condition.5. Financial Responsibility Required. No personshall operate a motorized cartwithin the city without financial responsibility. Fi-nancial responsibility is ineffect if a motor vehicle insurance policy is in effectwith respect to the vehicle,with minimum amounts of financial responsibilityas follows:

(a) Twenty-five thousand dollars ($25,000.00) forbodily injury to or the death of one (1) individual;(b) Fifty thousand dollars ($50,000.00) for bodilyinjury or the death of two (2) or more individualsin anyone (1) accident; and(c) Ten thousand dollars ($10,000.00) for damageto or the destruction of property in one (1) acci-dent.

6. Exceptions.a. Nothing in this Ordinance shall apply to anyself-propelled, two-wheeled vehicle.b. 8. Penalties.a. All penalties for violations of this ordinanceshall be treated under Section 10.99 of the RisingSun Municipal Code which states "any person,firm or corporation who violates shall, upon con-viction, be subject to a fine not exceeding$2,500.00."b. Any person violating any provision of this Ordi-nance shall be punished by a fine for the first of-fense of not less than Twenty Five Dollars($25.00). For the second offense, not less thanFifty Dollars ($50.00). If a third offense is commit-ted within one (1) year of conviction of a secondoffense, the minimum fine shall be One HundredDollars ($100.00) and the owner's registrationshall be revoked. If a registration is revoked, theowner shall pay a re-registration fee of Two Hun-dred Dollars ($200.00). The registered owner orfamily member cannot thereafter register a motor-ized cart for use in the City for a period of two (2)years following a third conviction.c. A further violation of this ordinance may besubject to a fine as set forth in this Ordinance andsubject to prosecution in an Ohio County Court ofLaw.

9. Conflict Provisions. Any ordinance or portionthereof in conflict with thisordinance is hereby repealed. Ordinance 2008-3 ishereby specifically repealed.10. Effective Date. ORDINANCE NO. 2012-1AN AMENDED ORDINANCE REGULATING THE

USE OF MOTORIZED CARTS WITHINTHE CITY OF RISING SUN

(REPEALING ORDINANCE NO. 2008-3)WHEREAS, the current Ordinance regulating theuse of motorized carts within the City of Rising Sundoes not adequately address the requirement of li-ability insurance on motorized carts and other simi-lar devices within the city limits; andWHEREAS, the improper use of motorized carts oncity streets creates a potential for liability as well asa traffic hazard for other vehicular traffic and a dan-ger to the occupants of motorized carts within thecity limits of Rising Sun; andWHEREAS, the intent of this Ordinance is to regu-late the use of motorized carts within the corporatelimits of the City of Rising Sun and to require Proofof Financial Responsibility at the time of registra-tion and in the operation of motorized carts.NOW, THEREFORE, BE IT ORDAINED BY THE COM-MON COUNCIL OF THE CITY OF RISING SUN, INDI-ANA, that the Rising Sun Code of Ordinances ishereby amended by adding the following provi -sions:1. Definitions.

a. Motorized Carts means a conveyance that is: otor vehicle.

b. The term does not include:(1) an electric personal assistive mobility device(as defined in IC 9-13-2-49.3);(2) a motorcycle (as defined I IC 9-13-2-108);(3) a motor scooter (as defined in IC 9-1 104);(4) a motorized bicycle (as defined in IC9-13-2-109); or(5) an off-road vehicle.

2. Operations & Limitations.a. Motorized carts may be operated 'within thecorporate limits of RisingSun by:

(1) Those persons who are 16 years of age andolder and have a validmotor vehicle drivers license, or State of Indianaphotoidentification card;(2) Those persons who are 15 years of age, butnot yet 16 years ofage, if accompanied in the front seat by a per-son at least 18 yearsof age who holds a valid motor vehicle drivers li-cense;

b. No person under the age of 15 years of ageshall be permitted to operatea motorized cart on any public street within thecorporate limits of theCity of Rising Sun.c. No person whose driving privileges are sus-pended for the commission ofa crime (including Operating While Intoxicated)shall be permitted tooperate a motorized cart on any public streetwithin the corporate limitsof the City of Rising Sun.d. A person may not register a motorized cart oroperate a motorized cart ona public highway in Rising Sun if financial respon-sibility is not in effectwith respect to the motorized cart in accordancewith Section 5 of thisOrdinance.e. All operators of motorized carts shall abide byall traffic regulationsapplicable to vehicular traffic.f. Motorized carts shall not be operated on side-walks or in City parks otherthan in parking areas or recognized vehicle trafficareas.g. Motorized carts shall be operated only if suchcarts are equipped withfunctional headlights, taillights, windshield, and abrake light.h. Motorized carts may not traverse streets andhighways under thejurisdiction of the Indiana Department of Trans-portation. Motorizedcarts may cross these streets to access otherstreets at streetintersections only. The specific streets and high-ways referenced includeNorth High Street (SR 56), South Walnut Street(SR 56), Street and WestMain Street (SR 262) throughout the corporatelimits of the City.Crossings must be made at a right angle.

3. Registration. Before any motorized cart may beoperated within the corporate limits of Rising Sun, aperson shall bring documentation setting forth adescription of said cart, along with said cart, to theRising Sun Police Department. The Rising Sun Po-lice Department shall complete a motorized cartchecklist and confirm the working order of saidcart. Once the checklist is completed and signed byan Officer, the person shall bring the completedchecklist to the Clerk Treasurer's Office, along withproof of Financial Responsibility and payment ofTwenty Dollars ($20). The Clerk-Treasurer shall is-sue a decal to be applied to the rear of such cart soas to be plainly visible. The decal, when issued,shall be non-transferable from the cart for which itis issued. The registration shall be effective untilsuch time as the cart is sold.4. Slow Moving Vehicle Emblem. Before any motor-ized cart may be operated within the corporate lim-its of Rising Sun, the cart must have affixed theretoa slow moving vehicle emblem as required by IC9-21-9-2. The emblem shall conform with thosestandards and specifications adopted for slow-mov-ing vehicles in 205 IAC 1-1 1 et. seq. Such emblemshall be mounted on the rear of such vehicles, inthe approximate horizontal geometric center of thevehicle, at a height of three (3) to five (5) feet abovethe roadway, and shall be maintained at all times ina clean and reflective condition.5. Financial Responsibility Required. No personshall operate a motorized cartwithin the city without financial responsibility. Fi-nancial responsibility is ineffect if a motor vehicle insurance policy is in effectwith respect to the vehicle,with minimum amounts of financial responsibilityas follows:

(a) Twenty-five thousand dollars ($25,000.00) forbodily injury to or the death of one (1) individual;(b) Fifty thousand dollars ($50,000.00) for bodilyinjury or the death of two (2) or more individualsin anyone (1) accident; and(c) Ten thousand dollars ($10,000.00) for damageto or the destruction of property in one (1) acci-dent.

6. Exceptions.a. Nothing in this Ordinance shall apply to anyself-propelled, two-wheeled vehicle.b. Nothing in this Ordinance shall apply to motor-ized carts operated by the City of Rising Sun orcarts being operated for special events with per-mission of the Mayor or Chief of Police. Enforce-ment.
