1.1 AbouttheChildmindingGuidelines
Theseguidelinesareintendedtoassistchildmindersbyprovidingthemwithguidanceforgoodpractice.Theguidelinesinclude:
• nationallyagreedguidelinesforgoodchildmindingpractice(seeChapter2);
• detailedinformationonstatutorynotificationtotheHealthServiceExecutive(HSE)andvoluntarynotification(seeChapter3);

1.2 Roleofachildminder
Achildmindercaresforasmallgroupofchildrenofmixedagesina‘homefromhome’setting.Childrenarewelcomedasindividuals.Theyareofferedaffectionandrespect,andtheirdevelopmentalandrecreationalneedsaremet.Childmindersofferaflexibleservice,tailoredtoeachchild,therebyhelpingparentsandguardianstobalancetheirworkandfamilycommitments.Achildmindernegotiatesandagreesthetermswithparents.
Thechild’swelfaremustbetheprimeconsiderationofthechildminder.Childmindershavesoleresponsibilityatalltimesforthehealth,safetyandwell-beingofeachchildentrustedtotheircare.
1.3 Termsandreferencesusedintheseguidelines
Inordertounderstandtheseguidelines,pleasetakethetimetoreadthefollowingdefinitionsoftermsandreferencesusedthroughoutthetext.
• Achildminderisaself-employedpersonwhomindsotherpeople’schildreninthechildminder’sownhome.PleaserefertoAppendixBforthelegaldefinitionof‘childminder’and‘childmindingservice’.

2.1 Corerequirementsforchildminders
ChildminderswhoarerequiredbylawtonotifytheHealthServiceExecutive(HSE)areboundbytherequirementsofPartVIIoftheChildCareAct1991andtheChildCare(Pre-SchoolServices)(No.2)Regulations2006.
Therearealsofournationallyrecognisedcoreareaswherecertainrequirementsshouldbemetbychildminders:
1. SuitabilityofthepersonThechildmindermustbeapersonaged18oroverwhoisgenuinelyinterestedincaringforchildrenandisofasuitablecharactertodoso.
2.Well-beingofthechildThechildmindermusthaveacommitmenttoprovidingqualitychildcare,whichensuresthatthewell-beinganddevelopmentofthechildisparamount.
3. PhysicalenvironmentThechildminder’shomeshouldprovideasecureandhappyenvironmentinwhichthehealth,safetyandwelfareofthechildisassuredandinwhichthedevelopmentalneedsofthechildaremet.
4.HealthandsafetyThechildmindermustprovideevidencethatadequatehealthandsafetyproceduresareinplace.
Detailsofthechildminder’sresponsibilitiesinthesefourareasareprovidedinSections2.2–2.5below.MoredetailedinformationandadviceonallareasisavailablefromlocalCCCs,localCMAOsandChildmindingIreland(seeAppendixCforcontactdetails).
2.2 Suitabilityoftheperson
Achildmindershould:
• begenuinelyinterestedincaringforchildren,beofsuitablecharactertodosoandhavetheabilitytocommunicatewithchildren;
• besuitabletohavesolecareofchildrenandmustbefreeofacriminalconvictionorofapendinginvestigationthatmaydeemthemunsuitable;
• beingoodhealth;
• beaged18orover;
• providereferencestotheparentthatwillattesttotheirgoodcharacterandsuitabilitytobeachildminder(e.g.pastemployer,parentofapreviouslymindedchild,GeneralPractitioner);

• respecttheconfidentialityofthechildrenandtheirfamilies;
• bewillingtoundertakeaccreditedtraininginFirstAid;
• bewillingtotakepartinchildcaretraining.
2.3 Well-beingofthechild
Achildmindershould:
• haveacommitmenttoprovidingqualitychildcare,whichensuresthatthewell-beinganddevelopmentofthechildisparamount;
• haveanunderstandingofchildren’srightsandneeds;
• recogniseandrespectthechildren’sindividualcharacters;
• recognisetheimportanceofplayandlearninginthestructureofachild’sdaybysharinginplayandprovidingappropriatematerialforplayactivities.ParticularattentionisdrawntoSíolta:TheNationalQualityFrameworkforEarlyChildhoodEducation,publishedbytheCentreforEarlyChildhoodDevelopmentandEducationin2006(availableatwww.siolta.ie),andtheNationalFrameworkforEarlyLearning,tobepublishedbytheNationalCouncilforCurriculumandAssessment(www.ncca.ie)inSpring2009;
• putinplaceaprocedureforrecordingrelevantinformationinrelationtothechildandensurethatparentsaremadeawareofthisprocedure;
• respecttheparentastheprimarycarerandeducatorofthechild;
• ensurethatthereisstructuredqualitycommunicationtimewithparentstodiscusstheirchild’sprogress;
• provideahealthy,balanced,nutritionaldietforeachchildandbeawareofanyspecialrequirements;
• ensurethatallvulnerablefoodsarestoredundersuitablerefrigeratedstorageconditionsasnecessary;
• befamiliarwiththemostup-to-dateChildProtectionPolicybyparticipatingintrainingandensurethatthispolicyisputintopracticeinaccordancewiththeChildrenFirst:NationalGuidelinesfortheProtectionandWelfareofChildren,publishedbytheDepartmentofHealthandChildren.AfreeSummaryeditionoftheChildrenFirstnationalguidelinesisavailablefromtheHSE.AfulleditionmaybepurchasedfromtheGovernmentPublicationsOffice,MolesworthStreet,Dublin2.BotheditionsareavailableonthewebsiteoftheOfficeoftheMinisterforChildrenandYouthAffairs(www.omc.gov.ie).
Childmindersmustensurethatnocorporalpunishmentisinflictedonachildandthatachildisneversubjectedtoanydegradingorabusivebehaviourwhileintheircare.

2.4 Physicalenvironment
Attentionmustbepaidtothefollowingphysicalaspectsofachildminder’shome:
• thechildminder’shomeshouldprovideasecureandhappyenvironmentinwhichthehealth,safetyandwelfareofthechildisassuredandinwhichthedevelopmentalneedsofthechildcanbemet;
• thehomeshouldbeofsoundandstablestructure,andshouldbefitforthepurposeofchildminding;
• thehome,bothindoorsandoutdoors,shouldbekeptinagoodstateofrepairandinacleanandhygieniccondition;
• thechildmindershouldhaveaccesstoatelephonewithinthehome.Itisalsorecommendedthatthechildminderhasacontactpersontocalluponintheeventofanemergency;
• theexitdoors,gatesandperimeterofthehomeshouldbesecure;
• childrenshouldhaveadequatespaceinwhichtoplayandthereshouldbeadequatefloorspace;
• workandplayareasshouldbesuitableandbeinagoodstateofrepair,andprecautionsshouldbetakentoensurethattheyarenotasourceofinfection;
• particularattentionshouldbepaidtoallindoorareas,including:
– kitchen
– bathrooms
– playareas
– sleepingarea
– stairs
– anyotherareastowhichmindedchildrenhaveregularaccess.
• specialattentionshouldalsobepaidtothefollowingoutdoorareas(whereapplicable),particularlywherethereareadditionalfeatures:
– frontgarden
– backgarden
– sandpitarea
– waterhazards
– driveways
– garage
– gardenshedorotheroutdoorbuildings,etc.

2.5 Healthandsafety
Thechildmindershould:
• provideevidencethatadequatehealthandsafetyproceduresareinplace;
• ensurethatgoodhygienepracticesareadheredto;
• haveappropriateinsurancecoverformindedchildreninthechildminder’sownhomeandwhiletravellinginthechildminder’scar;
• ensurethesafetyofchildrenintheircareatalltimes;
• betrainedinFirstAidforchildren.Anup-to-dateaccreditedFirstAidCertificateshouldbeprominentlydisplayedandaproperlyequippedFirstAidkitforchildrenshouldbeinplace;
• haveinplacefire-fightingblankets/equipmentandsmokealarms,andobservefiresafetyandemergencyprocedures(e.g.anevacuationplan);
• ensurethatanimals/petsonthepremisesdonotputthehealth,safetyorwelfareofthechildrenatrisk;
• informparentsofanyaccident,injuryorincidentinvolvingtheirchildren.

3.1 Whatisnotification?
CertaincategoriesofchildmindersarelegallyobligedtonotifytheHSEthattheyareprovidingachildmindingservice.OtherchildmindersarenotobligedtonotifytheHSE,butitcanbeworthwhiletodosovoluntarily(seeSection3.4below).
3.2 WhoisobligedtonotifytheHSE?
UndertheChildCareAct1991,apersonmindingmorethan3pre-schoolchildrenfromdifferentfamiliesisobligedtonotifytheHSEofthechildmindingservice,withtheexceptionofthosewhoareexemptfromnotifying(seeAppendixBonlegislation).
Apre-schoolchildisdefinedundertheActas‘achildwhoisunder6yearsofageandwhoisnotattendinganationalschooloraschoolprovidingeducationsimilartoanationalschool’.
AchildmindermustprovidespecificinformationtotheHSEaspartofthenotificationprocess.ThisinformationissetoutintheScheduletotheChildCare(Pre-SchoolServices)(No.2)Regulations2006.AchildmindershouldcontactthelocalHSEPre-SchoolOffice(seeAppendixC2forcontactdetails)toobtainacopyoftheNotificationForm(forthoseobligedtonotify).TheHSEprovidesanadvisoryserviceandaninspectionserviceforallchildcareservices,includingchildminderswhoarerequiredbylawtonotifythem.TheHSEhasalegalobligationtomakeinformationavailabletointerestedpersonsonpre-schoolservices,includingchildminderswhoareobligedtonotify.
UndertheChildCare(Pre-SchoolServices)(No.2)Regulations2006,achildmindershouldlookafternotmorethan5pre-schoolchildren,includingtheirownpre-schoolchildren.Nomorethan2childrenshouldbelessthan15monthsold.Exceptionsinrelationtonumbersunder15monthscanbemadeformultiplebirthsorsiblings.
3.3 ChildminderswhoarenotobligedtonotifytheHSE
AchildminderisnotobligedtoinformtheHSEinordertocarryoutachildmindingserviceifthechildminderisminding:
• childrenundertheageof6yearswhoareattendinganationalschooloraschoolprovidingasimilareducationalprogramme;or
• pre-schoolchildrenwhoareallfromthesamefamilyorwhoarethechildrenofthechildminder’srelatives1; or
• nomorethan3pre-schoolchildrenwhoarefromdifferentfamilies.

However,achildmindermightwishtovoluntarilynotifytheHSEthataserviceisbeingprovidedandthiscanbedonebycontactingthelocalCMAO(seeAppendixC3).
ChildminderswhoareunsureastowhethertheyareobligedtonotifyornotshouldcontacttheirlocalCCC,CMAOorChildmindingIrelandforadvice.
3.4 Voluntarynotification
3.4.1 Benefitsofvoluntarynotification
VoluntarynotificationbenefitschildmindersbyopeningupaccesstoarangeofservicesandsupportsthroughtheirlocalCCCsandCMAOs,includinginformation,networkingandtraining(seeChapter4).Thiswillhelpchildminderstoimprovethequalityoftheirservices.Italsobenefitschildminderswhowishto:
• operatetohighstandards;
• havetheirworkvaluedandtheircontributiontothechildcaresectorrecognised;
• obtainguidanceonthedevelopmentofpoliciesandstandardsinchildcare;
• participateintraining,networkingandotheropportunities;
• attendconferences,seminarsandothereventsforchildmindersorganisedbytheCCCs;
• availofvariousCapitalGrantSchemesforchildminders;
• removetheisolationoftenexperiencedbychildminders;
• contactparentswhoareseekingfamily-basedchildcareplaces;
• havetheirnamesincludedonapubliclistofchildmindersthatismadeavailabletoparents(optional).
3.4.2Howtovoluntarilynotifyachildmindingservice
1. Thechildmindershouldfirstofallreadcarefullyandthoroughlythroughtheseguidelines,whichincludethenationallyrecognisedcorerequirementsandgoodpracticerecommendationsforchildminders.
2. ThechildmindershouldcontactthelocalCMAO,requestingaVoluntaryNotificationPack.ThiswillcontainaVoluntaryNotificationFormandaSelf-evaluationForm,bothofwhichmustbecompletedandreturnedtotheCMAO.

3. TheCMAOwillthencontactthechildminderinadvancetoarrangeadateandtimetovisitthechildminder,toreviewtheself-evaluationandtoensurethatallthecriteriaaremet.
4. TheCMAOwillbeavailablethroughouttheself-evaluationtohelp,adviseandguidethechildminderthroughtheprocessandresolveanyproblemsthatmayarise.Whenthisprocessiscomplete,theCMAOwillsignoffontheVoluntaryNotificationForm,followingwhichthechildminderwillbesentawrittenconfirmationthatheorshehasvoluntarilynotified.
AsampleoftheVoluntaryNotificationFormandSelf-evaluationFormisgiveninAppendixA.Thechildmindershouldreadbothformstolearnmoreaboutwhatisinvolved.
ItisrecommendedthattheVoluntaryNotificationFormisaccompaniedbyaDisclaimer(seeAppendixA),whichshouldbesignedbyboththeCCC/CMAOandthechildminder.
InlinewiththeChildCare(Pre-SchoolServices)(No.2)Regulations2006,childmindersundertakingthevoluntarynotificationprocessshouldnotlookaftermorethan5pre-schoolchildren,ofwhichnomorethan3maybefromdifferentfamilies.
4.4.4.

CCCs and CMAOs
Allchildminders,whethertheyareobligedtonotifytheHSEornot,canavailofservicesprovidedbytheCity/CountyChildcareCommittees(CCCs)andChildminderAdvisoryOfficers(CMAOs).SomeoftheseservicesareoutlinedbelowandfulldetailscanbeobtainedfromlocalCCCsandCMAOs(seeAppendixC).
4.1 Training
TheCCCsofferatrainingcoursecalledtheQualityAwarenessProgramme(QAP)forchildminders.Thisisgenerallya10-hourcourse,dividedintofive2-hourclassesanddeliveredoveranumberofweeks.Thecoursecoverstopicssuchaschilddevelopment,childwell-being,play,hygieneandhealthandsafety.FollowingcompletionofaQAP,childminderscangoontopursuefurtherrecognisedqualificationsviatheirCCCoravailofotheraccreditedtrainingoptions.IfchildminderswishtoavailofcertainGovernmentgrants,theymustcompletetheQAP(seeSection4.2.1).
4.2 Financialsupports
ChildminderscanavailofvariousfinancialsupportsundertheNationalChildcareInvestmentProgramme(NCIP)2006-2010.Thesesupportsareoutlinedbelow.
4.2.1ChildmindingDevelopmentGrant
TheChildmindingDevelopmentGrantisdesignedtohelpchildminderswiththecostoftoys,equipmentorminorhouseholdadaptations.Withtheexceptionofchildminderswhohavecompletedthenationalvoluntarynotificationsystem,itisaconditionoftheChildmindingDevelopmentGrantthatchildmindersparticipateintheQAPoperatedbytheirlocalCCC.ItisalsoaconditionofthegrantthatallchildminderswhoaresubjecttotheChildCare(Pre-SchoolServices)(No.2)Regulations2006musthavenotifiedtheHSEabouttheirservice.
Althoughthegrantislimitedto90%ofthetotalcost,itallowsthechildmindertoclaimupto€1,000ofthecostoftheequipmentorhouseholdadaptation.Forexample,inordertoclaim€1,000,thechildmindermustpresentreceiptstotheirlocalCCCshowingexpenditureofatleast€1,111.Asanalternative,someCCCsoperatethegrantbyprovidingpre-paidpacksofequipmentvaluedat€1,000andthechildminderisaskedtomakeacontributionof€100.

Subjecttoavailableresources,thegrantsareavailableforthedurationoftheNCIP2006-2010.Childminderswhoreceiveagrantmustundertaketostayinoperationfortwoyearsafterthedateofthegrant;theymayre-applyforanothergrantafterthosetwoyearsandbeforetheendoftheNCIPon31December2010.Ifachildmindercanonlygiveashortercommitment,thenthegrantwillbereducedaccordingly,e.g.acommitmentforoneyearwillreducethemaximumgrantavailableto€500.Inaddition,childminderswhoreceivedagrantundertheEqualOpportunitiesChildcareProgramme(EOCP)2000-2006mayapplyforagrantundertheNCIPscheme.
4.2.2OtherNCIPcapitalgrantschemes
AllprivatechildcareprovidersmayapplyforlargerscalecapitalgrantaidundertheNCIPscheme,subjecttoanumberofcriteria.Theseincludethenumberofchildcareplacesthatwillbecreatedandconsiderationsaboutthequalityoftheserviceprovidedanditsvalueformoney.Themaximumgrantavailabletochildmindersis€75,000,basedonthemaximumforeachnewfull-timechildcareplacebeing€15,000andtheChildCare(Pre-SchoolServices)(No.2)Regulations2006limitingthenumberofchildmindingplacesto5.
Asmallerscalecapitalgrantschemeforchildminders,whichdoesnotrequirethecreationofnewchildmindingplaces,isavailabletoassistwiththecostofessentialrepairsandrefurbishmentassociatedwiththeservice.Themaximumgrantunderthisschemeis€5,000perfull-timeplace.
Inthecaseofbothgrantsreferredtoabove,itisarequirementthatchildmindershavecompletedthenationalvoluntarynotificationsystem,whichisimplementedthroughthelocalCCCs.
4.2.3Taxexemption(ChildcareServicesRelief)
Childminderstakingcareof3orfewerchildrenundertheageof18maybeentitledtoavailofataxexemption(calledChildcareServicesRelief)fromtheRevenueCommissionersiftheirannualchildmindingincomecomestonomorethan€15,000.2
Toapplyforthetaxexemption,childmindersareobligedtomakeanannualtaxreturn(before31Octobereachyear)oftheirchildmindingincometotheRevenueCommissioners.ChildmindersmustalsoprovideevidencethattheyhaveinformedtheirlocalCCCorCMAOthattheyareprovidingachildmindingservice.TheCCCorCMAOwillprovidewrittenconfirmationofreceiptofthisinformation,whichcanbeusedbythechildminderasevidencefortaxexemptionpurposes.

2ThisexemptionwasintroducedinBudget2006andamendedintheFinanceAct2007;thislimitappliesforthetaxyear2007andeachsubsequentyearunlessrevisedoramendedsubsequently.

NotificationofaserviceforthepurposesofclaimingthisreliefwillbesatisfiedwhereachildminderformallyadvisestheCCC/CMAOoftheservice.However,childmindersshouldbeencouragedtocompletethenationalvoluntarynotificationprocess.

Iftheannualchildmindingincomeisoverthetaxexemptionlimitof€15,000,thetotalamountwillbetaxableasnormalforaself-employedperson.FurtherinformationabouttaxreturnsisavailablefromtheRevenue’swebsite(www.revenue.ie).
AchildminderwhoqualifiesforthetaxexemptionwillberequiredtopayanannualPRSIcontributionof€253inrespectofthechildmindingincome.ThisshouldbepaiddirectlytotheDepartmentofSocialandFamilyAffairs,andwillensurethatallchildminderswhoavailoftheexemptionhavetheopportunitytobuildupasocialinsurancerecord,whichcan,intime,beadvantageousforbenefitssuchaspensionsandmaternitybenefit.
4.3 Childmindingnetworks
Childminderscanoftenfeelisolatedsincethereareno‘co-workers’withwhomtodiscussandreviewthechallengesandjoysofcaringforchildren.However,networksofpeopleinthesamelineofworkprovideopportunitiesforchildminderstocometogethertosharetheirexperiences,tolearnfromoneanotherandtooffermutualsupport.Networksalsoprovideavenuesforinformaltrainingandfacilitatetheidentificationofanyadditionalsupportsorformaltrainingrequired.AnotherbenefitisthegainingofadviceandinformationfromtheCMAOsaroundthecountry.ChildminderscangetfurtherinformationonnetworksintheirareabycontactingtheirlocalCMAO(seeAppendixC3).

Ifachildminderwishes,theCCCcanputtheirnameandcontactdetailsonalistofchildmindersfordistributiontoparentsinthelocalarea.Thiswillenableparentswhomayneedachildmindingservicetomakecontactwiththechildminder.
