Dear Fellow Conservative,
On behalf of our Board of Directors, I am pleased to present the American Conservative Union’s 2012 State Legislative Ratings for members of the Missouri General Assembly.
Since 1971, our Congressional ratings have become the gold standard in holding every member of Congress accountable for their voting record on the most important issues facing our nation. Last year we brought that same commitment to conservative ideals to the states, by rating members in five legislatures. I am pleased to report that this year we will score 15 states. This is part of the ACU five-year plan to bring our ratings to all fifty states- scoring every legislature in every state, every year. 2012 is a critical election year in the life of our nation and it is important, now more than ever, that Americans have the information to elect true conservatives into office. Now approaching four years under the failed leadership of President Barack Obama, America needs decisive change to rein in reckless spending, restore our standing in the international community and return to the traditional values that made our nation so great. The liberal policies of the Obama administration have energized a national g rassroots conservative movement, bringing change to state and local governments nationwide. Because of this, our 2012 State Legislative Ratings are vital for voters to make informed choices on the future of our nation, especially in battleground states.
We are dedicated to supporting the efforts of courageous conservative leaders fighting for limited government, promoting prosperity and individual freedom, and defending traditional values. Missouri House Vote Descriptions1. HB 1541 Religious Freedom. This bill provides protection for medical care professionals if they refuse to
participate in any phase of medical care that violates their religious beliefs. ACU supports this protection for religious freedom and supports this bill. The bill passed the Missouri House on March 29, 2012 by a vote of 113-41.
2. HB 1274 Abortion drugs. This bill restricts the administration of abortion-inducing drugs to hospitals or abortion facilities which are licensed as ambulatory surgical centers. ACU supports restrictions on abortion and supports this bill. The bill passed the Missouri House on April 19, 2012 by a vote of 109-24.
3. HB 1512 Foreign Laws. This bill protects Missouri citizens from the application of foreign laws in contract disputes when the application of foreign laws would result in a violation of a right under the Missouri or U.S. Constitutions. ACU supports the strengthening of constitutional protections and supports this bill. The bill passed the Missouri House on March 29, 2012 by a vote of 110-42.
4. HB 1319 Second Amendment Rights. This bill strengthens Missouri’s concealed carry law and lowers the minimum age for concealed carry endorsements from 21 to 18 for members of the U.S. Armed forces. ACU supports the strengthening of Second Amendment Rights and supports this bill. The bill passed the Missouri House on March 8, 2012 by a vote of 120-31.
5. HB 1526 Teacher Tenure Reform. This bill overhauls the teacher tenure system to eliminate mandatory seniority preferences. The last-in, first-out requirement when layoffs are required is eliminated as is the prohibition against hiring new teachers while any teachers 70 or younger on leave of absence are available. It adds incompetence as cause for dismissal. ACU supports education reforms that put the education of children first and supports this bill. The bill passed the Missouri House on May 3, 2012 by a vote of 83-76.
6. HB 1219 Tort Reform and Discrimination Protection. This bill places a cap on actual and punitive damages for discriminatory employment practices and requires a fired employee to show that discrimination was the “motivating factor” in firing an employee instead of a “contributing” factor. ACU supports this type of reform and supports this bill. The bill passed the Missouri House on February 9, 2012 by a vote of 89-68.
7. SB 576 Charter School Expansion. This bill lifts a number of restrictions on the expansion of charter schools and strengthens the legal responsibility of the sponsor of charter schools. ACU supports increasing school choice and supports this bill. The bill passed the Missouri House on May 15, 2012 by a vote of 99-54.
8. SB 572 Workers’ Compensation Reform. This bill gives liability protection for employees if workplace injury compensation is available through workers’ compensation unless that employee is directly responsible. In addition, lawsuits involving injury or death are postponed until all administrative remedies are exhausted. ACU supports reasonable limits on litigation and supports this bill. The bill passed the Missouri House on March 7, 2012 by a vote of 87-68.

9. SB 7 Government Subsidies. This bill establishes the Missouri Science and Innovation Reinvestment Act. A new state fund would give grants and tax credits to science and technology companies, including pharmaceutical companies. The legislation did not prohibit funds from being used for abortion, embryonic stem cell or cloning related research. ACU opposes government programs which pick winners and losers in the marketplace and opposed this bill. The bill passed a special session of the Missouri House on September 23, 2011 by a vote of 94-48.
10. SB 464 Implementation of Obamacare. This bill prohibits state agencies from implementing state insurance exchanges under the Affordable Care Act unless authorized through a legislative statute. ACU supports repeal of Obamacare and supports this bill. The bill passed the Missouri House on May 18, 2012 by a vote of 108-38.
11. SJR 51 Judicial Selection Reform. This bill places on the November, 2012 ballot a constitutional amendment to reform the judicial selection process. The amendment would increase citizen accountability over judicial selection by increasing the number of nominees the Governor can choose from and increases the number of “citizen members” of the Appellate Judicial Commission from three to four among other reforms. ACU supports these reforms and supports this amendment. The bill passed Missouri House on May 10, 2012 by a vote of 84-71.

Missouri Senate Vote Descriptions1. SB 749 Rights of Conscience. This bill provides that no one shall be compelled to provide health care
coverage for abortion, contraception or sterilization if these items or procedures are contrary to that person’s religious or moral beliefs. ACU supports rights of conscience legislation and supports this bill. The bill passed the Missouri Senate on May 18, 2012 by a vote of 28-6.
2. SB 489 Second Amendment Rights. This bill allows those people who were issued a firearms safety training certificate prior to the dates standards were increased to be approved for a concealed carry endorsement without retaking a training course. ACU supports strengthening Second Amendment Rights and supports this bill. The bill passed the Missouri Senate on March 29, 2012 by a vote of 29-4.
3. SB 464 Implementation of Obamacare. This bill prohibits state agencies from implementing state insurance exchanges under the Affordable Care Act unless authorized through a legislative statute. ACU supports repeal of Obamacare and supports this bill. The bill passed the Missouri Senate on February 2, 2012 by a vote of 25-8.
4. SB 576 Charter School Expansion. This bill lifts a number of restrictions on the expansion of charter schools and strengthens the legal responsibility of the sponsor of charter schools. ACU supports increasing school choice and supports this bill. The bill passed the Missouri Senate on April 19, 2012 by a vote of 31-2.
5. SB 572 Workers’ Compensation Reform. This bill gives liability protection for employees if workplace injury compensation is available through workers’ compensation unless that employee is directly responsible. In addition, lawsuits involving injury or death are postponed until all administrative remedies are exhausted. ACU supports reasonable limits on litigation and supports this bill. The bill passed the Missouri Senate on February 16, 2012 by a vote of 26-8.
6. SB 7 Government Subsidies. This bill establishes the Missouri Science and Innovation Reinvestment Act. A new state fund would give grants and tax credits to science and technology companies, including pharmaceutical companies. The legislation did not prohibit funds from being used for abortion, embryonic stem cell or cloning related research. ACU opposes government programs which pick winners and losers in the marketplace and opposed this bill. The bill passed a special session of the Missouri Senate on September 14, 2011 by a vote of 30-4.
7. HB 1219 Tort Reform and Whistleblower Protection. This bill places a cap on actual and punitive damages for unlawful, discriminatory employment practices and establishes protection for people who report to the proper authorities unlawful acts or serious misconduct by an employer. ACU supports reasonable limits on damage awards and protection for legitimate whistleblowers and supports this bill. The bill passed the Missouri Senate on March 8, 2012 by a vote of 23-8.

8. SJR 51 Judicial Selection Reform. This bill places on the November, 2012 ballot a constitutional amendment to reform the judicial selection process. The amendment would increase citizen accountability over judicial selection by increasing the number of nominees the Governor can choose from and increases the number of “citizen members” of the Appellate Judicial Commission from three to four among other reforms. ACU supports these reforms and supports this amendment. The bill passed the Missouri Senate on May 1, 2012 by a vote of 19-12.
