The Association of Chartered Certified Accountants (ACCA), Certified Accounting Technician (CAT) and Foundations In Accountancy (FIA) Qualifications develop accounting knowledge and skills as well as professional values. 8. ENTRY REQUIREMENTS

� ACCA

a) 2 GCE ‘A’ Level (grades A – E) and 3 GCE ‘O’ Level (grades A – C or 1 – 6) in 5 separate subjects inclusive of credits in GCE ‘O’ Level English and Mathematics

b) 3 LCCI Higher Level passes (individual passes or diploma) and 2 LCCI Intermediate Level

passes in Book-keeping and English for Business with 2 GCE ‘O’ Level credits in English and Mathematics. All five subjects must be distinct (different) subjects.

c) Polytechnic Diplomas and University Degrees in Singapore

d) ACCA Certified Accounting Technician (CAT) qualification e) ACCA Diploma in Accounting & Business

f) All other local qualifications not listed above and overseas qualifications may be assessed under PER (with or without exemptions). Students are advised to check with the ACCA UK before embarking on courses prior to confirmation of membership.

� FIA

Introductory / Intermediate Certificate

a) Minimum 16 years old

b) You should have IELTS 4.5 or pass in English language at GCE ‘N’ levels or its equivalent.

There is no requirement to complete the Introductory Certificate in Financial and Management Accounting or the Intermediate Certificate in Financial and Management Accounting prior to completing the Diploma in Accounting and Business, although you are strongly recommended to do so.

Diploma in Accounting and Business

a) Minimum 16 year old

b) You should preferably have GCE ‘O’ levels or equivalent and possess IELTS 5.5 or a pass in GCE ‘O’ levels English or its equivalent.

c) Completion of Intermediate Certificate in Financial and Management Accounting will be accepted as fulfilling minimum entry requirement.

d) When students have completed FAB, FMA and FFA, they will claim exemption from the F1, F2 and F3 of the ACCA Qualification and will start at the Skills module exams.

9. INITIAL REGISTRATION / ANNUAL SUBSCRIPTION FEES

All ACCA and FIA students must register themselves as ACCA student members online via www.accaglobal.com/applynow to be eligible to sit for the ACCA/FIA examinations. No paper form registration will be accepted.

ACCA reserves the right to amend the above fees without prior notice.

Students have to pay annual subscription fees to ACCA, which are due in January of each year.

10. MEMBERSHIP SUBMISSION PROCEDURES

All applications for ACCA memberships must be made online. It will take about 10 minutes to complete the online application. Students will have to upload all supporting documents online and also pay online with debit/credit card.

Students must submit online with the following documents:

• £79 registration fee by credit card/debit card • Scan copies of all educational and professional certificates with detailed result

transcripts (and official English translations where appropriate) • Scan copy of identity card or passport • Passport-style photograph

The closing dates for membership registration are based on the early, standard and late exam entry dates as follows: June 2016 Exams 15 February Early Exam Entry 2 May Standard Exam Entry 9 May Late Exam Entry Students are encouraged to register 3 weeks prior the deadline set by ACCA. ACCA will not be liable for any late entries received after the stipulated deadline set.

ACCA will take about 15 working days to process applications. You will receive a unique ACCA Number to have access to MyACCA where you will register for your exams online.

There will be no refund should you withdraw your student registration application after submission.

11. EXAMINATION / COURSE STRUCTURE

Students are expected to study each module - Knowledge, Skills, Essential and Options - in order. Papers may be attempted from different modules at the same sitting as long as the modules are attempted in order. Students may vary the order they attempt exams within each module but they may not vary the order of the modules. It is recommended that papers within a module are taken in order. ° Singapore variant

There is no requirement to complete the Introductory Certificate or the Intermediate Certificate in Financial and Management Accounting prior to completing the Diploma in Accounting and Business, although you are strongly recommended to do so. FOUNDATIONS IN PROFESSIONALISM

The Professionalism and Ethics Online Module is called Foundations in Professionalism. This is an online, interactive module and it is compulsory for students to complete the Foundations in Professionalism in order to achieve any of the awards in FIA.

You can complete Foundations in Professionalism before or after completing the exam component of the qualification you are aiming to achieve and you only need to successfully complete the module once, even if you decide to complete one or more of the FIA qualifications.

12. VARIANT PAPERS IN LAW & TAXATION

Singapore citizens and Singapore permanent residents are advised to opt for the Singapore variant papers in Tax and Law as they will be more relevant to them upon graduation. Non Singaporeans residing in Singapore can opt for the UK variant if they intend to work outside Singapore after graduation.

However, please note that the institutions in Singapore do not offer courses for the UK variant papers.

13. EXEMPTION

Applicants registering as students for the first time and wish to apply for exemptions must include certificates and detailed transcripts of all relevant papers taken at other examinations.

Please note that the exemption guidelines on the ACCA website serve as a reference only. The final decision still rests on the discretion of ACCA. You will need to pay an exemption fee for each paper awarded. Exemptions fees are charged at the early exam entry fee.

Please note that there will be no exemption given for ACCA Professional Level.

14. WRITTEN BASED EXAMINATION

Written based examinations are normally held during the first and second week of June and December every year. All registered ACCA & FIA students must register their exam online. No exam entry forms will be issued. Please note that the submission of examination entry online to ACCA is solely the responsibility of the student. 15. EXAM ATTENDANCE DOCKET

An examination attendance docket will be made available to all students who have entered to attempt ACCA examinations and will be available to download from myACCA around two weeks after standard entry closes.

You must print and bring your exam attendance docket to the examination centre for each exam being attempted as it will ensure your entry to the exam. The docket will be collected by the supervisor during the exam to record your attendance. If you have any other exams during the session, the docket will be returned to you. If it is your last exam of the session, the docket will be retained for ACCA records.

16. EXAM RESULTS

No paper exam results will be issued. The exam results will be made available online via your exam status report. You will have to log into your myACCA account to view your results.

You may also opt in to receive your results by email & SMS. Simply log on to myACCA and update your preference and contact details within 'ACCOUNT ADMINISTRATION'.

18. COMPUTER-BASED EXAMINATIONS (CBE)

Kaplan offers Computer-based examinations (CBE) to our bona-fide Kaplan students for the following FIA & ACCA Modules/Papers:

21. LECTURE NOTES

Lecture notes will be distributed to students on the first day of face-to-face training. Students absent from classes and miss the lecture notes given out in class can collect them from Material Room at Kaplan City campus @ PoMo,1 Selegie Road, Level 6.

No collection of lecture notes and study materials will be entertained after classes have commenced for one month.

Students requesting for replacement of lecture notes (full set) will be charged an administrative fee of S$50 nett per module. Once payment has been made, notes will be

available in one week’s time. 22. HOMEWORK ASSIGNMENTS

All Homework Assignments for FIA Diploma Level and ACCA Papers will be available online via MyKaplan, except for ACCA F4, F6 & P6 Homework Assignments which will be uploaded on Elearning Portal page with answers provided (please refer to Lecture Sequence for schedule). All Students are encouraged to attempt the homework assignments.

23. MOCK EXAMINATIONS

All ACCA and FIA Diploma Level mock examinations will be available online via MyKaplan, except for ACCA F4, F6 & P6 which can be downloaded from the Kaplan website by mid May and November.

FIA Introductory and Intermediate Level Mock Exams will be given out in class.

24. LESSONS MISSED

There will be no replacement of classes if you missed lessons and students may refer to their Elearning Portal for their class notes.

25. ELEARNING PORTAL WEB PAGE All ACCA & FIA Kaplan students who enrolled for Education and Intensive Classes will receive their

Elearning account credentials two weeks after course commencement through email and sms for access to our Elearning Portal Page http://elearning.kaplan.com/KF/login/index.php. Any updates and course articles will be uploaded on this page.

Please note that the ACCA/FIA E-learning portal access is valid on per semester basis and all students’ accounts will expire at the end of their semester (June/December).

26. MYKAPLAN ONLINE RESOURCES

All bona-fide ACCA Kaplan students will be given access to MyKaplan, an Online Learning Support from Kaplan. Students will receive their ISBN number and unique pass code (for every different paper enrolled) through email 2 weeks after commencement of class.

Please note that the MyKaplan access is valid on per semester basis and all students’ accounts will expire at the end of their semester (June/December). Please take note that MyKaplan Online Learning Support is not applicable for Singapore variant papers (ACCA F4, F6 & P6) and FIA Introductory Level (FA1, MA1) and Intermediate Level (FA2, MA2).

CHARTERED FINANCIAL ANALYST (CFA)

The Chartered Financial Analyst (CFA®) is a graduate-level programme for investment professionals. It is administered and awarded by the CFA Institute based in the United States. The CFA® is known to be highly credible, globally relevant and career enhancing.

32. ENTRY REQUIREMENTS

In order to register as a candidate for the CFA® programme, a student must have one of the following:

• Undergraduate education: A bachelor's (or equivalent) degree or be in the final year

of your bachelor's degree programme (you will be required to update your education

information before you can register for the Level II exam), or

• Work experience: Four years of professional work experience (does not have to be

investment related), or

• A combination of professional work experience and education that totals at least

four years (part-time positions do not qualify, and the four-year total must be accrued

prior to enrollment).

Beside meeting the entrance requirements, CFA Candidates must also:

• Meet the professional conduct admission criteria (during the application process, students will be asked to sign statements of Professional Conduct and Candidate Responsibility)

• Be prepared to take the exams in English • Have a valid international travel passport (required for exam registration and

admission to the test center).

33. PROGRAMME ENROLLMENT / EXAM BOOKING

Registering for the first exam also enrolls you as a candidate in the CFA Programme. This requires a one-time programme enrollment fee in addition to the exam registration fee. To book your exam, apply direct to CFA Institute for registration and enrollment. You may register online at www.cfainstitute.org. CFA Institute will acknowledge your registration and enrollment via email. Candidates are to refer to the CFA Institute website for the programme calendar, fee information and the registration deadlines for the June and December** examinations.

Please note that Kaplan is not responsible for candidate’s enrollment and exam registration. (**December examination session is only offered for CFA Level 1)

34. PROCESSING PERIOD

Application processing may take up to three weeks and confirmation notices are sent to candidates by e-mail. After an application is approved, an official confirmation e-mail is sent if all entrance requirements are met. CFA® Programme Curriculum Materials will be sent to applicants when the payment is processed. Receipt of Curriculum Materials does not necessarily indicate acceptance onto the programme. Please notify CFA Institute if you do not receive an official confirmation e-mail or notice of incomplete application within six to eight weeks after submitting your application. 35. EXAMINATIONS

The CFA® examination is offered at locations throughout the world. Candidates must complete three levels of examinations sequentially.

Exam admission tickets will be posted online in May for the June exam and November for the December exam. Candidates are expected to log in, review the admission ticket for any errors and notify CFA Institute for any errors. Candidates must also print the admission ticket and bring it to the test centre on exam day.

Candidates must have received their exam results before registering for the next exam because the results will determine whether a candidate must repeat the current level or advance to the next level.

All candidates who sit for a CFA Programme exam are provided with "pass" or "did not pass" exam result and a summary of their performance in each topic area. Candidates who do not pass the exam are provided with additional information regarding their performance relative to all other candidates who did not pass. Results for Level I and II candidates are available within 60 days of the exam date and within 90 days for Level III candidates. Exam results are available online for approximately one year after the exam date. After this date, candidates may request an official letter confirming their result, but their topic area performance summary will no longer be available. Individual candidate results are only released to the candidate and are never released to a third party; however, lists of passing candidates are provided to societies for membership purposes. The Certified Practicing Accounting (Australia) CPA Australia is a graduate-level programme meant for candidates who would like to port their expertise internationally. The CPA Australia programme is administered and awarded by CPA Australia. The focus of CPA Australia is combining accounting knowledge with strategic thinking and practical experience to aid members to distinguish themselves internationally.

41. ENTRY REQUIREMENTS In order for candidates to enroll into the programme, they will have to undergo a Membership Entry Pathway Assessment by CPA Australia. Candidates will need to have a relevant degree to enter into the programme. The Membership Entry Path Assessment will advice candidates which level of the CPA Australia programme will they be enrolling.

42. PROGRAMME ENROLLMENT/ EXAMINATION REGISTRATION

CPA Australia organizes “Becoming a CPA seminar” before the enrollment each semester and the Membership Pathway Assessment can be done at the seminars. Examinations of the CPA Australia programme are available in April/May and October/November each year. 43. EXAMINATIONS

CPA Australia professional level examinations are conducted at the end of the semester and for each segment, candidates have access to a range of learning resources. Formal assessment for each segment is by one three-hour exam at the end of the semester. The CPA Australia examinations consists of both Multiple Choice and Written Response format questions.

At the moment, all the exams taken in Singapore are computer based testing (CBT). Only Singapore Taxation is a written based paper (PBT).

Each subject’s exam is three hours and 15 minutes’ duration. All exams are open book, except Singapore Taxation, and are based on the whole subject—that is, the subject study guide, supplementary materials, prescribed texts and readings. Candidates will be examined on all materials unless otherwise stated. For Singapore Taxation, the exam is closed book, with candidates able to bring only unmarked copies of the Income Tax and GST Acts into the exam. Exams for Ethics and Governance, Financial Reporting, Malaysia Taxation, Singapore Taxation, Strategic Management Accounting and Global Strategy and Leadership include assessment of higher order conceptual, analytical and problem-solving skills through extended response exam questions. 49. RESEARCH AND ANALYSIS PROJECT (RAP) You must successfully complete the ACCA Fundamentals exams, including sitting and passing all of F7, F8 and F9, and complete the Professional Ethics module before submitting a RAP to Oxford Brookes University. You are required to pay a project submission fee to Oxford Brookes University with your project submission. You will gain access to the Professional Ethics module via myACCA as soon as you become eligible to take Paper P1, Professional Accountant. The Research and Analysis Project (RAP) is the final component of the BSc Degree and consists of two separate documents:

• 7,500 word Research Report (RR) and a • 2,000 word Skills and Learning Statement (SLS)

You will need a project mentor to assist you with your RAP, by providing guidance and advice on your RAP and also to verify that you made an oral presentation at the end of your project research. You will have 3 attempts to pass the RAP. In the unfortunate event that you fail the RAP on 3 separate occasions, you will no longer be eligible to complete the BSc degree. Please note that you can either submit the same project topic 3 times or 3 different RAP.

50. DETERMINATION OF CLASS OF DEGREE

The class of BSc Degree will be based on:

ACADEMIC REQUIREMENTS

All candidates must satisfy the requirements of the Academic Base of the Singapore QP before they can enter the Professional Programme. To satisfy the requirements of the Academic Base, Candidates must either:

A. Hold an accredited accountancy degree;

Non-accredited degree: Hold a degree recognised as being comparable to a 3-year undergraduate degree and complete the Foundation Programme for Singapore QP Applicants without an accredited degree may enrol for the Foundation Programme. Applicants must produce a Notification of Acceptance email printout from the Singapore Accountancy Commission (SAC) confirming the recognition of their degree. Non-accredited degree holders who have studied accounting, business or finance-related modules in their degree programme, may be eligible for module exemptions from the Foundation Programme on the basis that the learning outcomes of their degrees match those of the Foundation Programme. The Foundation Programme of the Academic Base will develop in graduates the base technical knowledge and skills as well as capacities for inquiry, abstract logical thinking, critical analysis, appropriate communication, personal and interpersonal skills required by the accounting profession. These provide a base for further development during the Professional Programme and Practical Experience. The Foundation Programme course covers a set of 6 core syllabus areas: 1. Financial Accounting and Reporting (FAR)

The Financial Accounting & Reporting (FAR) module provides students with a solid grounding in the basics of double entry bookkeeping, thereby enabling students to prepare financial statements for both single entity and group entities applying the Singapore Financial Reporting Standards (SFRS). Students are expected to interpret financial statements for different types of business entities to different stakeholders, recognising the various needs of the respective stakeholders.

2. Management Accounting (MA)

The Management Accounting module introduces and develops cost accounting techniques for decision-making. Students will appreciate the issues surrounding scarce resources, pricing and make-or-buy decisions, and how this relates to performance assessment. As budgeting is an important aspect for many accountants, students will explore different budgeting techniques and their respective inherent problems. Some of the budgeting techniques introduced in this module include standard costing and variances, mix, yield, planning and operational variances. It is important for accountants to be able to interpret the variances in the context of performance measurement. Students will also be required to understand how performance is measured and controlled. Accountants need to understand how a business should be managed and controlled. They should appreciate the importance of both financial and non-financial performance measures in management accounting. Accountants should also appreciate the difficulties in assessing performance in divisionalised businesses and the problems caused by external influences.

3. Audit and Assurance (AA)

The Audit & Assurance module provides students with the requisite knowledge to plan and perform an audit in accordance with appropriate Singapore Standards on Auditing (SSA) and the regulations to form an audit opinion on whether the financial statements are free from material misstatement. Students will be expected to understand the nature, purpose and scope of assurance engagements, including statutory audits and its regulatory environment. Professional ethics relating to audit and assurance will also be introduced. Students are also required to understand the scope of an internal audit and the differences between an internal audit and external audit. Areas covered under the audit of financial statements include planning and risk assessment, evaluating internal controls, audit evidence and procedures. Students will also learn how an audit is completed along with a review of the financial statements and reporting, including statutory audit reports, management reports, and internal audit reports.

4. Financial Management (FM)

The Financial Management (FM) module is designed to equip students with the skills that would be expected from a finance manager responsible for the finance function of a business. Students will be introduced to the role and purpose of the financial management function within a business. An exploration of the economic environment will preclude the discussion of the three key financial management decisions of investing, financing, and dividend policy.

The introduction to investing decisions will be covered in two stages - investment in (and the management of) working capital and the appraisal of long-term investments. The section on financing decisions will examine the various sources of business finance, including dividend policy and how much finance can be raised from within the business. Cost of capital and other factors that influence the choice of the type of capital a business will raise follows. The principles underlying the valuation of business and financial assets, including the impact of cost of capital on the value of business, is covered next. The module concludes with an introduction to, and examination of, risk and the main techniques employed in the management of such risk.

5. Singapore Law (SL)

Singapore Law provides students with a basic understanding of the Singapore corporate and business law and recognising legal issues. The module covers an introduction to the legal system in Singapore, the basics of contract law and tort law and professional negligence. The module will also cover specific legal areas relating to partnerships and companies. This includes the formation and constitution of companies, the financing of companies and types of capital, the day to day management, and administration of companies. Students will also learn the concept of majority control and minority protection, and the insolvency of companies including alternatives to winding up.

6. Singapore Taxation (STX)

Singapore Taxation introduces students to the subject and system of taxation in Singapore and provides the core knowledge of the underlying principles and major technical areas of taxation, as they affect the activities of individuals and businesses in Singapore. In this module, students are introduced to the rationale behind and the functions of the tax system in Singapore. The module then considers the different tax types that an accountant would need to have a detailed knowledge of, such as income tax from self-employment, employment and investments; partnerships; the corporation tax liability of individual companies and groups of companies; and the goods and services tax liability of businesses. Having covered the core areas of the basic taxes, the student should be able to compute tax liabilities, explain the basis of their calculations, apply tax planning techniques for individuals and companies and identify the compliance issues for each major tax type through a variety of business and personal scenarios and situations. These issues include time-bars and penalties for non-compliance.

56. EXEMPTION PROCESS Applicants with non-accredited but recognised accounting and business-related degrees may apply to the SAC for exemptions against one or more areas of the Foundation Programme. The assessment fee per application is $160.50 (GST inclusive) and is non-refundable. Subsequent exemption request(s) will incur additional charge of $160.50 per assessment request. The number of exemptions allowed will be reviewed on a case-by-case basis and the number of exemptions awarded will be stated in the Notification of Acceptance. Students will need to complete the remaining syllabus areas with Kaplan where exemptions were not given in the Notification of Acceptance. Students can choose between full tuition or structured self-study or a mixture of the two. Students are not allowed to make changes to their selection of full tuition and/or structured self study after course registration.

57. PROGRAMMES FOR SINGAPORE QP OFFERED BY KAPLAN Kaplan has received accreditation to run both the Foundation and Professional Programme for Singapore QP. For Professional Programme, Kaplan will be offering revision courses for candidates who are taking the examinations under the Professional Programme. Kaplan Foundation Programme has two offerings: 1. Full Tuition Programme 2. Structured Self-Study Programme Full Tuition Programme The full tuition programme consists of face-to-face classroom lessons including revision lessons. The assessment will comprise of 40% coursework and 60% exam. The detailed learning approach, assessment and exam weighting is found in the Knowledge Bank which the students will receive on the first lesson. To achieve a pass in a syllabus area, the student must achieve at least 50% combining both coursework and final examination. In addition, the student must achieve 40 marks of out 100 marks for the final exam. Structured Self-Study Programme The structured self-study programme consists of four lessons and the final two lessons are revision lessons which will be conducted nearer the examination day. For students under this structured self-study, they must achieve at least 50 marks out of 100 from the exam in order to pass. Students will receive the Knowledge Bank which will guide the students in terms of the breadth and depth of knowledge they need to acquire for the syllabus area.

58. FULL TUITION PROGRAMME – ASSIGNMENT SUBMISSION

All assignments must be submitted to the respective lecturers at the latest by the stipulated submission deadline. The assignment submission date will be indicated in the class schedule.

Students are required to staple their assignments and indicate their names and classes on the cover page. The Lecturer’s Comment Form should be completed and attached to every assignment before submission.

In modules where Turnitin or other referencing software is employed, students must submit the one-page “Turnitin Report” or equivalent report from other officially approved software along with the hard copy of assignment and the Lecturer’s Comment Form listed previously. Students may also wish to acknowledge cooperative work by listing the names of those students whom they have worked with.

Assignments that are handed in on time will be marked and graded according to the grading system.

When applying for an extension in submitting an assignment, students must inform the lecturer and/or Programme Management Office in writing at least one (1) week before the

assignment due date, or no later than one (1) working day after the submission deadline. Documentary evidence must be submitted together with the request. Approval of the assignments extension requests only for the following reasons: • Medical (Medical Certificate required, from panel of registered clinics) • Compassionate (death of parents, spouse or children) • Exceptional-case basis (with supporting documentary proof)

Please note: 1. Approval Granted

Where approval has been granted for the extension of the assignment deadline, there will be no penalty imposed if the student submits the assignment by the new due date granted. Failing which, the students would be penalised for late submission (See point 2 below).

2. Approval not Granted A penalty will be imposed on late submission of assignment when approval has not been granted. Penalties will be imposed on late assignment submissions in accordance with Table 1 unless approval in advance has been granted.

59. EXAM FORMAT

Where calculators are allowed in the examination, only a noiseless, cordless pocket calculator which may be programmable but may not have a print out or graphic/word display facility in any language is allowed. Mobile phones or other electronic devices will not be allowed in the examination room. You must clear the all calculator memory prior to the start of the exam.

60. EXAM MATTERS – GENERAL

The exam fee is non-refundable. If the student fails to turn up on exam day, a ‘FAIL’ grade will be given.

It is the student’s responsibility to provide the correct and most updated contact details which include email address, phone number and mailing address. Communication of exam related information will be made through the contact details provided to Kaplan. Kaplan will not be held responsible if the student fails to receive the information in a timely manner due to incorrect or out-dated contact details. It is the student’s responsibility to check for the most updated exam schedule prior to the exam date. Kaplan will notify the exam results to the student using the contact details provided.

61. EXAM RULES AND REGULATIONS – BEFORE EXAM COMMENCEMENT 1. Students should arrive at least 15 minutes prior to the scheduled exam time to allow

adequate time for identification, verification and checking of seating arrangement.

2. Students will not be allowed to sit for the exam and therefore forfeit your exam fee if you cannot meet the identification and verification requirements.

i. For identification, you may produce your ORIGINAL Singapore Identity Card (for

Singaporean and PR) or ORGINAL Passport (for Singaporean or PR or foreigners). Copies of identification will not be accepted. Your name and identification number on the produced identification must EXACTLY match the name and identification number you have submitted when registering for the exam.

ii. For verification of calculator, the invigilator will check your calculator prior to the start of the exam. Only a noiseless, cordless pocket calculator which may be programmable but may not have a print out or graphic/word display facility in any language is allowed. Mobile phones or other electronic devices will not be allowed in the examination room. You must clear the all calculator memory prior to the start of the exam.

3. Students should be seated 15 minutes before the start of the examination.

4. Students who turn up 30 minutes after the start of the examination will not be allowed to

enter the examination room.

5. Valid identification should be placed at the top left hand corner of the desk for inspection. Students who fail to produce the valid identification will NOT BE PERMITTED to proceed with the examination.

6. Only the necessary stationery (e.g. pens, pencils, rulers, correction fluid and calculators (where applicable) for the purpose of the examination may be placed on the Student’s writing desk. All unauthorised books, reference materials, handbags, pencil cases and other personal belongings including mobile phones must be switched off and placed in the front or at the back of the examination room.

7. Food and drinks are not allowed in the examination room. Only plain water or bottled mineral water is allowed.

8. Students are only allowed to fill in their particulars on the cover page of the examination

answer booklet upon the invigilator’s instructions. Students will need to fill in their student number (the number starting with CT) on the answer booklet.

9. Students are not allowed to turn over the cover page of the question paper until they are told by the invigilator to commence writing.

62. EXAM RULES AND REGULATIONS – DURING THE EXAMINATION

1. Students are not allowed to leave the examination room during the first 30 minutes and

last 15 minutes of the examination.

2. Students found in possession of unauthorised reference materials during the course of the examination may be suspected of cheating and will be reported in writing to the Kaplan Singapore’s Examination Board.

3. All answers are to be written in blue or black INK only. The examination answer booklets

will not be marked if the answers are written in pencil.

4. Students are not allowed to remove any pages from the examination answer booklet.

5. Each student will be given one examination answer booklet. Extra booklets are available upon request.

6. Students will be provided with an exam worksheet for rough work only. Students must

check and ensure that the exam worksheet bears Kaplan’s stamp. Any exam worksheet not bearing Kaplan’s stamp will be considered as unauthorised materials.

7. All exam booklets and exam worksheets (used or unused) must be surrendered to the

invigilator(s) at the end of the examination.

8. Students are not permitted to communicate with other students or borrow stationery from other students during the examination.

9. Invigilators may ask students who disrupt the examination to leave the examination room

immediately. The invigilator has the discretion in determining what constitutes disruptive behaviour.

10. Students who need to use the washroom should raise their hands. They will be

accompanied by an invigilator. Only one student is allowed to go to the washroom at any one time.

11. Students are to stop writing immediately, upon the conclusion of the exam.

12. Students who continue to write after the conclusion of the exam will receive a warning from the invigilator and the names of the students concerned will be submitted to the Examination Board, for further action.

13. Students are to remain seated while the invigilator collects the scripts.

14. Students are not allowed to remove the exam question paper from the examination room during or after the exam. The exam question paper and your answer booklet must be collected by the invigilator. Failure to submit both will automatically result in a FAIL grade.

63. PLAGIARISM AND EXAMINATION MISCONDUCT Kaplan Singapore considers academic honesty to be one of its most important values. Academic misconduct refers to any form of dishonesty by a student related to the submission of course material or assessment. It includes, but is not limited to: • any form of cheating on examinations and may include:

� taking material into an examination contrary to the instructions for that examination, or being in

� possession of material which might be used to convey information about the syllabus area under examination;

• interfering with the orderly conduct of any examination, lecture, tutorial, discussion forum or other teaching class;

• the removal or attempted removal (either physical or electronic) of examination materials from the examination environment;

• altering academic or clinical records;

• falsifying information for any assignments; • impersonating another student; • any form of collusion between students or other individuals other than authorized

collaboration; • any act that may impair or hinder the learning or assessment performance of others; • any action which is contrary to the study and assessment instructions given inside the

Knowledge Bank or Study Guide or Revision Notes; • submitting an assignment(s) that was partially or wholly completed by another student; • copying work or written text from a student, the Internet, or any document without giving

due credit to the source of the information; • submitting an assignment(s) for more than one class without enhancing and refining the

assignment, and without first receiving instructor permission. In cases where previous assignments are allowed to be submitted for another class, it is the responsibility of the student to enhance the assignment with additional research and to also submit the original assignment for comparison purposes;

• assisting another student wherein the other student intends to commit any act of academic dishonesty. This offence would include, but is not limited to, providing an assignment to another student to submit as his or her own work or allowing another student to copy answers to any test, examination, or assignment.

Examination misconduct Examination misconduct refers to the breaching of Kaplan Singapore’s regulations during the examination, for example, possession of unauthorised materials. If a student is accused of examination misconduct, the student is to be informed and reported to the Examination Board in writing. The written report will be submitted to the Examination Board for further investigation. Kaplan Singapore will accord the student proper procedural fairness in any investigation of a report of examination misconduct, this will include ensuring the student has a copy of any report of misconduct, and giving the student a reasonable opportunity to respond to it.

A student may appeal the determination of the Examination Board or the penalty applied to the Appeals Committee.

Penalties for examination misconduct First offence:

Failure in the assessment item in which the offence occurred; or Suspension/Expulsion for serious academic misconduct determined by the Examination Board, such as impersonation of another student

Second offence:

Kaplan Singapore will issue a written statement to notify the student that his or her attendance has been terminated for violation of academic policy; i.e. the student will be expelled from Kaplan Singapore and his/her Student’s Pass, if applicable will be cancelled

Disciplinary actions are also applicable to students who are either directly or indirectly involved in plagiarism and/or cheating.

65. RE-EXAMINATION POLICY To achieve a pass in a syllabus area, the student must achieve at least 50% combining both coursework

1 (quiz and assignment/test) and final examination. In addition, the student must

achieve 40 marks of out 100 marks for the final exam. Students who obtained a “Fail” grade are permitted to sit for a supplementary examination within three weeks of the release of the final results of the syllabus area. The supplementary examination fee of $160.50 inclusive of GST will apply.

Students who are absent from exam without providing any valid reasons (medical or compassionate grounds) or have been found guilty of any form of academic misconduct will not be allowed to sit for a supplementary examination. Specifically: • A student who wishes to defer the main examination, based on valid reasons such as on

medical, compassionate or religious grounds, must submit the necessary documents to the Programme Management Team within three working days after the examination date, or else such request will be considered invalid. Upon approval, students will be allowed to sit for the supplementary examination.

• Students who fail to achieve 40 marks out of 100 for the main examination and/or fail to achieve an overall 50% combining all assessments are required to sit for the supplementary examination after paying the supplementary examination fee.

• If a student passes the supplementary examination (i.e. 50 marks out of 100 marks), a “P” grade will be shown on the transcript. If a student fails the supplementary examination, he will be required to repeat the entire syllabus area and pay the course fee for the syllabus area.

• Students are not allowed to further defer a supplementary examination regardless of reasons. Only one supplementary examination will be available for each syllabus area.

• If the student is absent from the supplementary examination, they will be receive an “F” grade and will be required to re-take the entire syllabus area and pay the course fee for the syllabus area.

66. APPEAL PROCESS Students must fill up the Results Appeal Form, provide detailed reasons for the appeal within 5 calendar days of the results released and pay an appeal fee before the appeal can be processed. The following are valid grounds on which an appeal can be submitted: • a piece of work handed in on time was not marked; • feedback on coursework assessments was not obtained within the specified time; • alleged wrong advice from staff teaching the syllabus area (e.g. about the format of the

examination or approval of an extension for an assignment); • the student's grade was not based on the assessment methods specified; • an allegation of bias that must be supported by specific examples and supporting

evidence; • in exceptional circumstances, other grounds (except those in the list of invalid grounds)

will be considered if the Chair of the Appeals Committee accepts these as reasonable.

The following issues will not be considered as valid grounds for appeal: • the learning objectives of the syllabus area; • disagreement with the assessment methods approved for the syllabus area; • disagreement with the standard required to receive particular grades in the syllabus area; • a study overload has prevented the student from earning a higher grade; • personal and medical problems, which normally are dealt with by supplementary

assessment or a retrospective withdrawal; • financial implications of not passing the syllabus area; • the student received a higher grade in other modules; • the amount of time, work or effort the student has expended; • general grievances; • poor teaching (students can submit these concerns to the Programme Management

Team, they are not considered a valid appeal against final grade);

• the need for additional marks to secure a pass grade; • requesting a review or re-mark (re-mark is covered by another process)

The outcome of the appeal will be made available to the student within two (2) weeks from the date the appeal is received. During the appeal process, students must continue per normal course of studies to ensure no disadvantage pending the outcome of the appeal.

67. AWARD OF CERTIFICATE The final results of each syllabus area will be submitted to the Examination Board for assessment and moderation. Students will be awarded the Certificate of Completion within three months after the meeting of the Examination Board. Students will be notified to collect their Certificate and must do so within one month from the email notification and/or the stipulated timeframe stated in the email notification, whichever is longer.

68. CERTIFICATE REPRINT Students who request for a reprint of the certificate of completion will be charged an administrative fee for every duplicate copy of your certificate.

69. ATTENDANCE The minimum attendance to be attained is 75% for local students and 90% for international students holding a student’s pass. Based on an ICA requirement, international students holding a Student’s Pass must attain a minimum attendance of 90%. Students who do not attain the attendance of 90% (student’s pass holders) and 75% (for local students) for the first time will receive a warning via email. If no improvement is shown in the attendance after the warning, ICA will be informed (for student’s pass holders). Local students failing the attendance requirement will not be allowed to sit for the examination and will have to pay the repeat fee and repeat the module with the next immediate intake. If a student’s attendance continues to fall below 90% after the ICA has been informed on the first occasion, Kaplan Singapore will request ICA to cancel the student’s pass. Students may appeal to the Appeals Committee regarding the circumstances leading to the cancellation of their Student’s Pass.

70. PROGRAMME COMPLETION REQUIREMENTS Students are given 5 years to complete the Foundation Programme from the date of the Letter of Exemption. A student who has completed the Foundation Programme, within the 5-year time bar, will receive a certificate of completion from Kaplan. The certificate will reflect the titles of the subjects completed and exempted, if any.

71. LESSONS MISSED There will be no replacement of classes if you missed lessons and students may refer to their Elearning Portal for relevant contents and updates. 72. LECTURE NOTES Lecture notes will be distributed to students on the first day of class. Students who were absent on the first day can collect the notes from Material Room at Level 6, PoMo. No collection of lecture notes and study materials will be entertained one month after commencement of class. Students requesting for replacement or loss of lecture notes (full set) will be charged an administrative fee of S$50 nett per core syllabus area. Once payment has been made, notes will be available in one week’s time. 73. ELEARNING PORTAL WEB PAGE Students who registered for the Full Tuition Programme of the Singapore QP Foundation Programme will receive their elearning account credentials two weeks after course commencement through email and sms for access to our eLearning portal page http://elearning.kaplan.com/KF/login/index.php.

Tutors will upload relevant content to this portal.

Please note that the e-learning portal access is valid on per intake basis and all students’ accounts will expire on the day of the exam of the relevant module.

All course registrations must be made using the official KLI Course Enrolment Form and student is required to complete the enrolment form with full personal particulars including the ACCA/FIA/CFA/CPAA registration numbers (if available) and indicate clearly the choice of papers and/or classes. It is also compulsory for all students to complete and sign a Student Contract upon registration. The modes of payment available are: cash, cheque (Singapore banks), Nets, Visa/Master, Telegraphic Transfer. For cheque payment, it must be made payable (and crossed) to “Kaplan Learning Institute Pte Ltd”. For Nets and credit card payment, the limit is subject to your available balance and arrangement with the bank.

76. KAPLAN STUDENT ACCESS CARD (SAC)

All bona-fide Kaplan students must apply for Kaplan Student Access Card (SAC) which they are required to have with them at all times within the school campus. This card is a form of identification for our students, especially during our routine spot checks. SAC will also allow students access to all the facilities, eg. borrowing of books from our Kaplan Library. An administrative fee of S$10 nett will be charged for the replacement or loss of SAC. Please note that the Kaplan Student Access Card is not transferable and has to return to KLI upon completion or withdrawal of course.

77. KAPLAN MATERIAL COLLECTION CARD

All ACCA & FIA bona-fide Kaplan Financial students will be issued a Kaplan Material Collection Card. Please ensure that you bring it with you for classes at all times. This card serves as a confirmation of your enrolment in the respective classes and collection of course materials. An administrative fee of S$20 nett is chargeable for the replacement of loss of Material Collection Card; and S$50 nett for the replacement of loss of Material Collection Card and Lecture Notes (applicable for ACCA and FIA only). Please note that the Kaplan Material Collection Card is not transferable.

ACCA/FIA/CPAA/CFA Registration numbers. This will facilitate us to contact you in the event of any important announcements such as changes in course schedule or venue etc.

Student is required to inform the Programme Management team in writing if there are any changes in particulars. Failure to do so would mean KLI would not be able to reach you and inform you if there are any changes in the programme such as timetable, examination, etc.

KLI is not responsible if important information is not conveyed to the student on time due to changes in the student’s contact details.

Being a Platinum tuition provider, Kaplan reserves the right to release your name and ACCA/FIA registration number to ACCA for the purpose of monitoring Kaplan’s performance under the ACCA’s Approved Learning Partner – Student Tuition Programme.

Kaplan shall treat all students’ particulars with the strictest confidence for legitimate purpose and will not disclose to external parties.

It is extremely important for students to also inform ACCA and CFA Institute of any updates in personal particulars. This will ensure that ACCA/FIA students will receive the latest updates, annual subscription and examination entry forms; CFA students will receive their CFA Institute Curriculum Materials.

79. INTERNATIONAL STUDENT PASS HOLDERS

If you are a Singapore Permanent Resident or holding a Work Permit, Employment Pass, or Immigration Exemption Order, you will be granted exemption for Student Pass.

Long Term Social Visit Pass and Dependent Pass holders who wish to study full-time must apply for a Student Pass. Immigration will issue a letter of consent for you to study with Kaplan.

International students holding Kaplan’s Student Pass with Kaplan must observe and comply with the following:-

• It is compulsory for you to submit a copy of your Student Pass to Kaplan and it is solely the responsibility of individual student to inform Kaplan one month before the expiry of your Student Pass for us to renew or to obtain a social visit pass for you.

• You are only allowed to attend classes upon official approval of your Student Pass application.

• The Student Pass issued by ICA is only valid for the course applied, ie. ACCA or FIA, to study at Kaplan. In the event you have completed one course and wish to continue with another new course at Kaplan, you are required to inform Kaplan to reapply for the new course with ICA. ICA will then issue a new student pass based on the new course applied.

• You are strictly not allowed to attend any courses in other schools whatsoever and vice-versa, unless you have obtained permission from ICA in writing.

• You are strictly not allowed to engage in any form of employment, whether paid or unpaid, or in any business, profession or occupation during the validity of your Student Pass unless you have the consent in writing by ICA. Violators will be prosecuted by law. Kaplan also reserves the right to terminate your Student Pass accordingly and there will be no refund of course fees paid.

• If you wish to transfer to another school, you have to withdraw from the course by giving written notice to Kaplan. You are required to cancel your student pass by completing the Cancellation of Student’s Pass Form and submit together with a copy of your results for Kaplan to release your attendance to the school you wish to transfer to.

• If you have completed or do not wish to continue your studies with Kaplan, it is compulsory for you to surrender your original student pass together with a photocopy of your passport to Kaplan. Kaplan will then cancel your student pass online via Immigration website and return your Student Pass to Immigration.

Immigration will then issue a notification for the cancellation of Student’s Pass,Visit Pass and Embarkation Form which you are required to collect from Kaplan City campus @ PoMo, 1 Selegie Road Level 8, Programme Management Office after 3 working days from the date of cancellation. You will need to produce the notification of cancellation of Student Pass,Visit Pass and Embarkation Form at the checkpoint upon departure. It is an offence to retain your Kaplan’s Student Pass if you are no longer our student.

• If you have obtained a valid pass, you will need to inform Kaplan for the cancellation of your student pass, your course fees and revision fees are strictly non-refundable.

• Students who are holding onto Kaplan’s student pass and does not report to school, Kaplan reserve the right to make a police report and to cancel your student pass.

• For renewal of student pass application, please proceed to Kaplan City campus @ PoMo, 1 Selegie Road Level 6, Reception Counters to obtain the form. There will be administrative fee charge of S$50 for Renewal of Student Pass and S$30 for ICA Online Application Fee.

80. CONFIDENTIALITY POLICY

Kaplan is committed to handling and maintaining the confidentiality of Kaplan students’ personal information in accordance with the Personal Data Protection Act 2012 (PDPA) which establishes a general data collection law in Singapore. The PDPA governs the collection, use and disclosure of individuals’ personal data in a manner that recognizes both the rights of individuals to protect their personal data and the need for organisations to collect, use and disclose personal data for purposes that a reasonable person would consider appropriate in the circumstance. Kaplan undertakes not to disclose any information to any third party without prior written consent of the student, and subject to the obligation of Kaplan to disclose to any Singapore government authority any information of student in compliance with the Singapore law and/or to the organisation awarding the qualification.

Student information obtained through the Student Application Form / Student Record Form, completed by the student at the point of enrolment / course commencement, is used strictly for enrolment / administration purposes.

81. COURSE EVALUATION

As part of Kaplan’s commitment to maintaining and improving the learning experience, there will be feedback exercise in the form of an evaluation conducted at the end of subject term. The feedback will evaluate:

• Effectiveness of Lecturer • Effectiveness of Course/Module Materials • Quality of Kaplan’s Facilities & Infrastructure • Service Touch Points Support • Programme Management Support • General Comments

Students are encouraged to provide constructive comments and feedback for the purpose of further improvement on the programme. The students’ feedback data helps Kaplan to monitor various departments & respective lecturer performance and to provide adequate and accurate information for the Academic Review and Academic Board in order to take any necessary action for improvement. Student specific information will not be made known to the lecturers.

In addition, students can also provide their feedback anytime during the course to the Programme Management team or directly to [email protected]. Where applicable, students’ comments and feedback obtained will be discussed with the academic staff and lecturers, and disciplinary actions will be taken if necessary.

82. ACADEMIC FREEDOM AND STUDENT RESPONSIBILITY

The student who has been accepted into an academic programme of study at Kaplan has certain rights and responsibilities. These rights and the associated responsibilities shall establish a student code of professional conduct. Primary to this code is the access to an environment free from interference in the learning process.

• Students have the right to an impartial, objective evaluation of their academic performance. Students shall receive in writing, at the beginning of each course, information outlining the method of evaluating student progress toward, and achievement of, course goals and objectives, including the method by which the final grade is determined.

• Students will be treated in a manner conducive to maintaining their worth and dignity. Students shall be free from acts or threats of intimidation, harassment, mockery, insult, or physical aggression.

• Students will be free from the imposition of disciplinary sanctions without proper regard for due process. Formal procedures have been instituted to ensure adequate notice and hearing for all students subjected to the disciplinary process.

• When confronted with perceived injustices, students may seek redress through grievance procedures established in accordance with Kaplan’s nondiscrimination policy. Such procedures will be available to those students who make their grievances known in a timely manner.

• Students may take reasonable exception to the data or views offered in any course of study and may form their own judgment, but they are responsible for learning the academic content of any course for which they are enrolled.

• Students will be given full disclosure and explanation of all fees and financial obligations to Kaplan.

• Students have the right and responsibility to participate in course and professor evaluations and give constructive criticism of the services provided by Kaplan.

• Students have the right to quality education. This right includes quality programmes; appropriate instructional methodologies and content; professors who have sufficient educational qualifications and practical expertise in the areas of instruction; the availability of adequate materials, resources, and facilities to promote the practice and application of theory; and an environment that stimulates creativity in learning as well as personal and professional growth.

• Students have the responsibility to conduct themselves in a professional manner within the institutional, clinical, externship, and lab settings, and to abide by the policies of Kaplan.

• Students are expected to conduct all relationships with Kaplan staff and faculty, their

83. ATTENDANCE TAKING & MONITORING

Students are required to sign their attendance in person for each lecture/tutorial session in the presence of the lecturer. It is the responsibility of latecomers to mark their attendance with the lecturers during break time. It is compulsory for all international students to sign/clock your attendance for all your classes using the student access card on a daily basis 8.30am to 6.15pm, Mondays to Fridays. In addition, you are also required to sign the attendance registers that are placed in front of the class. The attendance devices are located in all classrooms. Students who did not clock in and out will be consider as absent for the day.

You are not allowed to attend another class in which you are not enrolled on unless you have sought prior permission from the Programme Management Team. You cannot delegate another student to attend the lesson or class on your behalf, should you not be able to make it.

When you do not have a class during the day, you must do your self-study in the library or designated Study Rooms. You are also encouraged to attend the Student Activities planned by Kaplan.

The minimum attendance to be attained is 75% for non-student pass holders & funding students and 90% for student pass holders.

ICA requires student pass holders to achieve at least a minimum of 90% class attendance and Kaplan is required to submit your attendance record to ICA on a monthly basis.

First Warning Students who do not attain the minimum attendance for the first time will receive a warning letter via email and/or hand delivery.

Second Warning If the attendance for the following month is still below the minimum requirement, a second warning letter will be sent to the student concerned. Meanwhile, the Programme Management team may meet him / her for counselling.

Third Warning If the attendance for the following month is still below the minimum requirement, a third warning letter will be sent to the student concerned. In the meanwhile:

1. ICA will be informed (for student pass holders). 2. Students must be sent for counselling with the Programme Management team. 3. The Programme Management team shall closely monitor the minimum attendance

requirements for students taking the exam. Where applicable, student will not be allowed to sit for the examination and will have to pay the repeat fee and repeat the module with the next immediate intake.

No Improvement after the Third Warning

If a student’s attendance continues to fall below the minimum requirement after the third warning, a termination letter will be issued to the student. Student may appeal to the Appeals Committee regarding the circumstances leading to the termination.

For International Student Pass Holders, Kaplan Singapore will request ICA to cancel the student’s pass.

84. LEAVE OF ABSENCE

When you are absent from class, you must fill in an official Leave Application Form (Appendix 2) and attach supporting documents to prove your absence from class (eg. Medical Certificate).

Kaplan will approve leave for the following reasons subject to minimum attendance requirement with official documented evidence. All other reasons for absence will be treated as absent from class.

Approval of Leave will be subject to case by case basis.

*International Students who have to go back home to seek medical treatment have to submit:

*Upon returning to Singapore, International Students have to submit:

85. PROGRESS REPORT

Kaplan will provide all International Student Pass Holders with a progress report at the end of each Intake only upon request. This report includes your attendance and exam results. Upon receipt of your last exam sitting results, please submit a copy of the results to your Programme Management Team. This is to enable us to update the exam result in your report.

86. REFUND PROCESS

Kaplan Singapore is committed towards maintaining a high level of good business and customer practice. We assure our students that we have put in place customer-centric systems and practices to look after the welfare of both our local and international students.

87. REFUND POLICY

Kaplan Singapore shall have a fair and reasonable refund policy for any payment made. The refund policy shall include, but is not limited to, the following:

i. Time taken to process refund request (shall not be more than 7 working days); ii. Any refund condition (if applicable); iii. Any non-refundable fee paid (if applicable); iv. Status of fee paid should any course be cancelled. Kaplan Singapore must state the

conditions under which a course may be cancelled; v. When transfer/withdrawal application is approved; etc.

The refund policy shall be clearly communicated to all students via the website, student contract and student handbook.

The refund policy shall be clearly explained to all students and prospective students. The policy should also be available in students’ native languages where applicable.

Kaplan Singapore shall regularly review the refund policy to ensure that it remains fair to the students. Students/Participants are required to abide by the refund policy specified on the course application form and Standard Student Contract.

Notification and Arrangement

Kaplan Singapore shall inform the Student immediately within three (3) working days if:

i. It fails, for any reason, to commence the Course on the Course Commencement Date; ii. It terminates the Course, for any reason, prior to the Course Commencement Date; iii. It fails, for any reason, to complete the Course by the Course Completion Date; iv. It terminates the Course, for any reason, prior to Course Completion Date; or v. The Student’s Pass application is rejected by Immigration and Checkpoint Authority

(ICA)

Kaplan Singapore shall, within seven (7) working days of notifying the Student in writing of above circumstances (i) to (iv), provide the Student with information and details of the alternative confirmed course arrangement to allow the Student to make timely and appropriate decision on the alternative arrangement.

Kaplan reserves the right to vary or cancel any of the courses described on our brochures, or alter the composition of the relevant lecturing team as well as the venue for lectures should the circumstances so require. In the event of course cancellation, students will receive a full refund of the course fees and any other fees paid. The refund payment will take about 7 working days to process.

Refunds for Withdrawal for Cause

Students shall be entitled to immediately withdraw from the course by giving written notice to Kaplan Singapore of his/her intention. Kaplan Singapore will refund the Students within 7 working days.

• For circumstances (i) to (iv), Kaplan Singapore will refund the entire amount of the Course Fees and Non Tuition Fees paid to Kaplan Singapore.

• For circumstance (v), before course commencement, Kaplan Singapore will refund the

entire amount of the Course Fees, FPS, & international student admin fee. After course commencement, Kaplan Singapore will refund the entire amount of the Course Fees and international student admin fee

• The refunds will be less any applicable bank administrative charges payable.

Refunds for Withdrawal Without Cause

Where students withdraw from the Course for any reason other than those set out in (i) to (v). Kaplan Singapore shall review after receiving the student’s written notice of withdrawal and refund to the Student within 7 working days according to the student contract.

Other Fees • Application Fee is non-refundable under any circumstances. • International student admin fee is non-refundable after commencement of classes

except in circumstance (v) stated above. • Student membership fees payable to respective institutions are non-refundable (if

applicable).

Please note that there is strictly no refund of course fees after the course commencement date.

• Please allow 7 days processing time for all refund payments. • ACCA & FIA membership fee are non-refundable. • CFA Programme enrolment fee are non-refundable. • In the unlikely event that Kaplan fails to start the course on the prescribed date, or

change the type of course offered, you are allowed to withdraw from the course enrolled and get a full refund.

• Kaplan reserves the right to withdraw courses offered as classes will commence subject to meeting minimum student numbers. In the event of course withdrawal, you will receive a full refund of the course fees paid.

88. COOLING-OFF PERIOD

KLI will provide the Student with a cooling-off period of seven (7) working days after the date that the Contract has been signed by both parties. The Student will be refunded the highest percentage of the fees already paid if the Student submits a written notice of

withdrawal to the KLI within the cooling-off period, regardless of whether the Student has started the course or not. In the event that a student wishes to withdraw from the programme, the application fee and the administrative fee are not refundable. Students are liable to pay (where applicable) fees that are imposed by the government authorities or other external partners. For more information on Fee-Protection Scheme and refund policy, please refer to www.cpe.gov.sg 89. EXEMPTION OF PAPER (S) – ONLY APPLICABLE FOR ACCA & FIA

If you withdraw from any paper(s) due to exemption before or after course commencement, you may get a refund for the fees paid, for the exempted papers, in the form of a cheque payment in accordance with our refund policy.

90. WITHDRAWAL AND REFUND PROCEDURE

a) Students must inform Programme Management in writing and complete a Course Withdrawal Form with reason for withdrawal.

b) All requests for refunds must be accompanied with relevant supporting documents.

c) KLI will take no more than 4 weeks to process any withdrawal application upon receiving the complete relevant withdrawal application.

d) The student concern will be informed of the final decision relating to the refund of course fee arising from withdrawal which will be made at the sole discretion of Kaplan.

e) Upon approval, Student will be withdrawn from their course. A crossed cheque will be issued under the student’s name according to the school’s record. Students must inform Kaplan in writing if the cheque is to be made out to a third party.

f) Refund will be available within 7 working days from date of receipt of the refund request. However, if you are not in Singapore, you may write an authorization letter to release the cheque payment to a third party.

g) The student will be required to collect the cheque personally from Kaplan City campus @ PoMo, 1 Selegie Road Level 6 reception. You will need to provide a letter of authorization if you wish to authorize a third party to collect on your behalf.

h) Students who have withdrawn/transferred from the course, material fees of $50 per course will be chargeable if materials have been collected.

91. TRANSFER / WITHDRAWAL POLICY

KLI transfer/withdrawal policy shall include, but is not limited to, the following:

i. Circumstances in which a transfer/withdrawal application will be granted;

ii. Any additional fee payable;

iii. Status of student’s pass for international student (where applicable);

iv. Conditions for refund of any fee paid;

v. A reasonable time frame for assessing and replying to any request for

transfer/withdrawal; etc.

92. TRANSFER POLICY

This policy applies when a student changes the course of his/her study but remains as a student of Kaplan Singapore. Kaplan Singapore will take no more than 4 weeks to process any application for transfer of course upon receiving the complete course transfer application. A Course transfer application fee will be imposed.

93. TRANSFER OF CLASS

a) After the commencement of courses, an administrative fee of S$20 nett will be imposed on each permanent transfer of class for the same paper conducted by the same lecturer.

b) Kaplan does not encourage students to transfer class conducted by another lecturer. However, if a student has a valid reason to do so, an admin fee of S$100 nett is payable.

c) Student must complete a Course Transfer Form (Appendix 2) for any request for class transfer. Class Transfer is subject to seats availability.

d) Student will be informed within 4 weeks whether request for transfer has been approved.

e) Upon approval, student will make payment at Kaplan City campus @ PoMo, 1 Selegie Road Level 6 reception with their Course Material Card.

94. WITHDRAWAL POLICY

This Policy applies when a student requests to stop his/her study and ceases to be a student of Kaplan Singapore. Kaplan Singapore will take no more than 4 weeks to process any withdrawal application upon receiving the complete relevant withdrawal application.

Students who wish to withdraw (or terminate) from the programme after commencement shall inform Kaplan Singapore in writing by filing up the relevant programme withdrawal form and state the reason(s) for withdrawal.

For proprietary and professional programs, withdrawal application is subject to the Head of School / Programme Director’s approval.

KLI has EduTrust Certification (Cert No. EDU-2-2022 Validity : 19 July 2015 to 18 July 2019) and has put in place a number of mandatory requirements which include Fee Protection Scheme (FPS) and Medical Insurance Coverage under this certification scheme regulated by the Council of Private Education (CPE). The CPE Student Services Centre (SSC) is a convenient, one-stop service point to address students’ enquiries, provide authoritative and reliable information on studying and living in Singapore, and offer support to students who encounter problems during their course of study. a) Attending to enquiries and feedback received from the public and students studying in the private education institutions (PEIs);

b) Providing education counselling services to students who seek advice on a range of issues from education options and school registration procedures to Student Pass application processes and accommodation choices;

c) Providing public education through periodic student advisory talks, and organising orientation programmes to guide students in making prudent choices in their selection of private education institutions;

d) Providing internet facilities for students to gain access to updated education information online; and

e) Assisting students who encounter problems with the private education institutions with which they are enrolled.

97. STANDARD STUDENT CONTRACT

It is a mandatory requirement by the CPE that all students, both local and international, to sign the Student Contract during registration of courses with Kaplan. The Student Contract stipulates important terms and conditions governing the relationship between Kaplan Financial and the student and serves to minimize future disputes and hence has to be completely understood by students prior to making course fee payments. By signing the Student Contract, you have agreed to the terms and conditions as stated in the Contract.

Please refer to CPE website for details on EduTrust, Fee Protection Scheme and Standard PEI-Student Contract.

During the course of study, any change to the original contract has to be counter signed by the student and PEI. Otherwise a new contract is required.

98. FEE PROTECTION SCHEME (FPS)

The Fee Protection Scheme (FPS) serves to protect students’ fees in the event a private education institution is unable to continue operating due to insolvency, and/or regulatory closure. The Fee Protection Scheme also protects students if the private education institution fails to pay penalties or return fees to the students arising from judgement made against it by the Singapore courts.

The Fee Protection Scheme is applicable to all students (regardless of nationality and the type of passes, i.e dependent’s pass, student’s pass, work permit etc). It is mandatory for all students to apply for FPS and sign a student contract when they enroll for courses with any Private Education Institution (PEI) with EduTrust Certification.

Both local and international students enrolled into Kaplan are covered under Lonpac Insurance. The scheme covers course fees including GST. A copy of Certificate of Insurance (COI) will be given to students. It contains information such as ID/FIN Number, course title and duration, premium paid, amount insured and period of coverage.

• Our staff will compute the premium amount payable by the student, based on the course fees paid. This premium amount payable will be borne by the student and must be paid upon enrolment at Kaplan.

• Kaplan will apply for insurance via online, on behalf of all students enrolled with Kaplan. Upon approval, a Certificate of Student Insurance (COI) will be issued to each insured student.

• The Certificate will state the insured student’s identity, the period of insurance, the limit of liability (sum assured). This Certificate must be held by the respective student personally.

• Limits of Liability - The amounts payable to an insured student are subject to maximum limits which are specified in his Certificate of Student Insurance.

• Period of Insurance - The period of insurance will cover the course fees paid by the insured student per semester. In certain cases, this period may begin before the course commencement date, upon approval by Lonpac Insurance Bhd.

• Claim - The insured student needs to produce his/her Certificate of Student Insurance and official course fees receipts when submitting a claim under the insurance. Lonpac Insurance Bhd will notify all insured students of the relevant claims procedures to be followed.

Coverage on Fee Protection :

Lonpac Insurance Bhd protects the insured student against the following events:

a) Insolvency or Regulatory closure of PEI. b) PEI failure to pay awarded sum by Singapore courts to the Insured Student c) Accidental Death or Permanent Total Disablement up to S$10,000 to the

Insured Student caused solely and directly by accidental, visible and violent means (excluding any sickness, disease or medical disorder)

- Main Exclusions

a) Failure on the part of the PEI to provide adequate, qualified or suitable teachers or curriculum.

b) Issues of the quality of curriculum or learning experience or satisfaction are excluded.

c) Voluntary withdrawal or abandonment by the PEI to complete their contractual obligation to students.

d) Voluntary withdrawal from the course or abandonment by the students. e) Any losses other than that arising from the insured events.

99. MEDICAL INSURANCE

EduTrust regulations require all students to be covered under a medical insurance coverage for the students’ hospitalization, surgery and treatment costs throughout their course of studies.

Kaplan Singapore provides group medical insurance services for all of its students, unless they are eligible to opt out. International students holding passes other than the Student’s Pass, and students who are Singapore citizens or permanent residents, who are already covered by their own medical insurance plans, may choose to opt out of the medical insurance scheme. 100. ORIENTATION PROGRAMME

International Student Orientation is conducted every intake after 1 week of course commencement. The Orientation covers Student Pass regulations, course administration procedures and other important highlights that can facilitate your course of studies.

101. INDUCTION SESSION

An induction session is conducted for students every intake by the Lecturer during the first lesson in class. The induction covers academic issues and administrative matters.

102. REFERENCE LIBRARY The Reference Library is located at Kaplan City campus @ PoMo, 1 Selegie Road Level 6.

Only current Kaplan students are eligible to borrow books and magazines from the Reference Library. Students can borrow the books during office hours. No one is allowed to remove any library books without prior approval. Each student is allowed to borrow up to a maximum of 2 reference books at any visit for a period of 1 week. No further loan is allowed until the student has returned all the books. A penalty fee of S$0.50 per day (including Sat, Sun & Public Holidays) for per book will be charged for late return of book(s).

We seek your cooperation to handle the library books with care. Please do not highlight,

underline or write in them. Students are responsible for any damage or loss of borrowed books. In such cases, Kaplan reserves the right to ask students to pay the full retail price of the damaged/lost book(s).

For your convenience, there are several computers located in the Reference Library for Kaplan

students to get free access to websites and retrieval of personal email. To use these Computers, you will be required to produce your Kaplan Student Access Card (SAC) to sign in with the librarian.

It is forbidden for students to use this internet access to view obscene, indecent or offensive

images at any time. You are also not allowed to install programmes, software applications or chat programmes, in case of virus transmission. Students caught violating the rules will be banned from future usage. Please be considerate and keep within the 30 minutes limit per usage.

Photocopying facility is conveniently available at the libraries for all students on a self services

basis. It is especially useful for those students who do regular research at library and require copies of reference materials to be made. This facility uses the EzLink stored value system.

Print facility is available at library as well. There is a charge of S$0.10 per page. Students have

to make sure that their materials are aligned, as realignment will not be done.

Strictly no food and drinks are allowed in the Library. The Kaplan Reference Library opening hours are as follows: Mondays to Fridays : 9.15am – 9.00pm Saturdays : 9.15am – 3.00pm Closed on Sundays & Public Holidays.

All our classrooms are air-conditioned and have been set for optimum comfort for all students. We seek the students’ cooperation not to adjust the temperature controls. Please approach your lecturers or the facilities staff if you would like the temperature adjusted.

For the benefit of all students, please do not reserve seats for your friends when you come early for your lesson. Kaplan treats this matter seriously and reserves the right to remove any unattended property in such cases.

Please also help us to maintain the cleanliness of the classrooms at all times. Food and Drinks are strictly not allowed in the classroom.

Using of Mobile Phones and Other Electronic Devices

For the consideration of others, students are advised to turn off their mobile phones or switch them to silent mode during class. For using other electronic devices during class, please seek permission from lecturers in advance.

104. STUDY ROOMS AND STUDENTS’ LOUNGE

The Students’ Lounge which is self -study area for Kaplan students are located at : 1) PoMo Level 7 and the operating hours are as follows:

• Students are to carry their Kaplan Student Access Card at all times and it must be produced for identification upon request by Kaplan staff.

• Students are not allowed to bring in alcoholic drink at all times and all litter is to be disposed off in a proper manner.

• Smoking and gambling in any form are strictly prohibited. • Keep the noise level down at all times. Please be considerate when having group

discussions. • Students will have to be responsible for their own belongings. Kaplan will not be held

responsible for any loss or damage of personal belongs. • No reservation of seats is allowed. • Any unattended belonging may also be removed at the discretion of Kaplan staff. • Students must be properly and decently dressed. • Please observe the operating hours of the study rooms and student lounge. No student is

The Material Room is at Kaplan City Campus @ PoMo, 1 Selegie Road Level 6. Students absent from classes on the first day of lesson and did not collect the lecture notes and study materials given out in class may collect them from the Material Room.

113. ACCA INTERNSHIP PROGRAMME (AIP)

ACCA Singapore had launched a new internship programme called the ACCA Internship Programme (AIP). AIP is open to both outstanding local and international ACCA students who have already completed the Fundamentals module of the ACCA Qualification.

The programme will be administered by the ACCA Singapore office and supported by its vast network of ACCA Approved Employers (Gold and Platinum Approved) as well as the ACCA Approved Learning Partners.

114. COUNSELLING SERVICES

The Student Counsellor in Kaplan is a trained counsellor who provides professional counselling that includes assessment and intervention. The counselling sessions are mostly conducted individually.

Besides basic counselling, the Student Counsellor is also involved in the following activities:

1) Psychological education and skills trainings 2) Academic and personal (relationship, adjustment, etc.) issues 3) Provide students with public crisis helplines in case of urgent matters (the student

counsellor is unreachable after working hours) 4) Conduct research and recommendations 5) Liaison person to professional bodies such as the Health Promotion Board (HPB) to conduct

health talks 6) Investigate specific cases such as academic misconduct, and 7) Provide necessary information for students to obtain specialized psychological assistance

such as psychiatrist assessment and treatment.

In the event that there is a need for more advanced counselling, such as psychological help, Kaplan will refer the case to a professional counsellor to assist the students.

115. STUDENT ACTIVITIES

There will be an activity organised for students every month. Activities may include seminars, workshops, corporate visits, social/recreational events and community service projects, etc. Details of each activity will be released to students via email and student newsletter every month. Most of the student activities are free of charge unless otherwise stated.. Student’s registration is accepted via email on a first-come-first-served basis.

120. STUDENT CODE OF CONDUCT

Kaplan requires students to conduct themselves in accordance with the standards of their future professions. Kaplan has also taken precautions to discourage dishonesty and preserve the academic integrity of its programmes. Students will be held accountable for, or should report, the following violations:

• All forms of dishonesty including cheating, plagiarism, forgery, and intent to defraud through

falsification, alteration, or misuse of Kaplan documents. Theft, deliberate destruction, damage, misuse, or abuse of Kaplan property or the property of private individuals associated with Kaplan.

• Inappropriate or profane behaviour that causes a disruption of teaching, research, administration, disciplinary proceedings, or other Kaplan activities. Failure to comply with Kaplan officials acting within the scope of their employment responsibilities.

• Students are required to be properly attired at all times and to observe a sense of decorum when they are within Kaplan premises. All students must be readily identifiable at all times with their face uncovered and are required to have their Kaplan Student ID with them.

• Students are required to adhere to the Kaplan Dispute and Grievance Resolution Process (refer to 4.16) before escalating the complaint or grievance to the next level. The process is in place to ensure resolution with minimum delay and inconvenience to the student. A student who is seeking dispute or grievance resolution should follow the steps outlined in the process. Each step should be completed before going to the next step.

• Failure to comply with all Kaplan regulations, whether contained in official KAPLAN publications or announced as administrative policy by a Kaplan official or other person authorized by the Campus President/Executive Director/Principal of Kaplan.

• Abuse, violence or threats of violence toward persons or property of students, faculty, staff, or the Kaplan.

• Improper use of email and Internet access. Please see the Electronic Communications Policy for additional information. Failure to comply with federal copyright and criminal laws forbidding the copying or alteration of copyright-protected materials, such as computer programmes, music, movies, photographs, or written materials.

• The use of alcoholic beverages or controlled substances on Kaplan or externship property, including the purchase, consumption, possession, being under the influence of, or sale of such items.

• The use of any tobacco products in Kaplan buildings, and eating or drinking in the classrooms or any location other than designated areas.

• Bringing animals onto Kaplan property. No animals are allowed on the premises unless they are assisting the physically impaired or are being used as classroom subjects.

• Bringing children into the Kaplan teaching areas. Kaplan does not provide childcare services and cannot assume responsibility for their health and safety.

• Failure to comply with all emergency evacuation procedures, disregarding safety practices, tampering with fire protection equipment, or violation of any other health and safety rules or regulations. Inappropriate use of cell phones, or other electronic devices. All electronic devices must be in the “off” position while in the classroom.

• Bringing dangerous items such as explosives, firearms, or other weapons, either concealed or exposed, onto Kaplan property. Physical abuse, verbal abuse, intimidation, harassment, coercion, stalking, and/or any conduct that threatens or endangers the physical or psychological health/safety of another person.

• Rape, including acquaintance rape and/or sexual assault, in any form.

• Unauthorized presence in, or forcible entry into, a Kaplan facility or Kaplan-related premises.

• All forms of gambling is strictly prohibited.

• Being in the presence of and/or aiding/abetting any of the aforementioned conduct violations.

A student committing any of the violations listed above may receive a written warning concerning the misconduct and may receive disciplinary action up to and including immediate suspension and/or dismissal.

121. ELECTRONIC COMMUNICATIONS POLICY

Kaplan expects all students to use electronic communications in a responsible, ethical, and legal manner. Kaplan values freedom of expression and encourages diverse viewpoints endemic to an academic institution. When Kaplan does not provide Internet service for its students, it does not have control and cannot censor electronic communications submitted by students from their personal computers. It may, however, monitor the Kaplan site, such as the seminar or class discussion boards, and Kaplan’s internal email system, to use its best efforts to ensure that offensive, harassing, or other communication jeopardizing the integrity of Kaplan has not been made available to other students. If students become aware of any such communication, they should promptly report such communication pursuant to the procedures set forth in the Problem Resolution, Student Complaints, and Grievance Procedures.

Computer equipment, email accounts, facsimile equipment, Internet access, instant messaging, voicemail, and supplies, if provided, are exclusively to assist students in their educational activities.

Students should not expect that computer files, email, voicemail, or Internet bookmarks are confidential or private, and, therefore, should have no expectation of privacy whatsoever related to their usage of these systems. Even when a message or file is erased, it often is still possible to recover the message or file, and, therefore, privacy of messages and computer files cannot be ensured to anyone.

Messages sent through these media, and the contents of the hard drives of any computer that is the property of Kaplan, as well as saved voicemail messages, may be considered business records and could be used in administrative, judicial, or other proceedings.

Downloading, distributing, or sending obscene material is prohibited. Use of Kaplan facilities or equipment to download, distribute, or send pornographic materials is also prohibited, including, but not limited to, bookmarking any such websites, or opening or forwarding any such email, fax, or voicemail messages. Any communications by students via email, instant messenger, voicemail, or fax that may constitute verbal abuse, slander, or defamation or may be considered offensive, harassing, vulgar, obscene, or threatening is prohibited. Offensive content includes, but is not limited to, sexual comments or images, racial slurs, gender-specific comments, or any comments that would offend someone on the basis of age, race, sex, color, religion, national origin, handicap, disability, or veteran status. Any individual with a complaint about such communications should refer to the Policy of Nondiscrimination section in this Catalog.

Students may not use Kaplan computer system in a manner that infringes the copyright of others. Copyright law protects the exclusive rights in images, music, text, audiovisual materials, software, and photographs. The distribution, display, performance, or reproduction of any copyright-protected material through the Kaplan computer system without the permission of the copyright owner is strictly prohibited. In addition, Kaplan licenses software to support its educational processes. Students are not permitted to copy, remove, alter, or install software.

By using Kaplan computer equipment, software, and communications devices, all students

knowingly and voluntarily consent to their use of these systems being monitored and acknowledge Kaplan’s right to conduct such monitoring. These media and equipment are intended to be used for business and educational purposes only, and any other use by students may result in a written warning concerning the misconduct and further disciplinary action up to and including immediate suspension or dismissal.

122. DISCIPLINARY RULES AND REGULATIONS

A student must not commit a disciplinary offence. Disciplinary Offence includes, but is not restricted to:

• academic misconduct • smoking within the Kaplan campus • littering • fighting • theft • vandalism, destruction or damage to the school’s property • disrespectful, immoral or indecent behaviour • insubordination to lecturers and other staff of the school • acts of disturbance, cheating or dishonesty in examinations • forging of documents or possession of forged documents • unauthorised use and illegal copying of copyright materials • the possession of dangerous weapons • the possession or consumption of drugs or alcohol or intoxicating substance (as defined by

the Intoxicating Substances Act) • non-compliance with or disobedience of orders made by the VP, Teaching and Learning,

School Head or such other officers as may be authorized by or acting on behalf of the VP, Teaching and Learning.

• conduct or neglect that is prejudicial to good order and discipline of the Kaplan or likely to bring the school into disrepute as the VP,Teaching and Learning may determine.

Disciplinary Actions, Suspensions and Dismissals

All students are expected to conduct themselves as responsible adults, to comply with all Kaplan policies and regulations, to attend classes regularly, to meet their financial obligations to Kaplan, and to maintain a satisfactory level of academic achievement. Kaplan reserves the right to suspend or dismiss any student who:

� Fails to comply with the Student Code of Conduct � Exhibits conduct that is found by the administration to be detrimental to fellow students,

other individuals, the community, or Kaplan; � Fails to maintain satisfactory academic progress; � Fails to provide required documents (e.g., transcripts) by the stated deadline or provides

inadequate or false documentation, as required by certain degree programmes; � Fails to meet attendance standards; and/or � Fails to meet financial obligations to Kaplan.

Any violation of Kaplan policies or regulations may result in one or more of the following disciplinary actions:

• Verbal warning from professor or advisor • Written warning • Grade reduction • Suspension • Dismissal

Kaplan administration will determine the action(s) to be taken based on the severity of the infraction and the student’s prior disciplinary record. Days spent on suspension will be

counted as absences and cannot exceed the amount of allowable absences stated in the Attendance/Tardiness Policy.

Students may submit a written appeal to the appropriate Kaplan Review Committee within 10 business days of receiving notification of the disciplinary action. All grade-related and plagiarism appeals are to be directed to the Academic Appeals Committee. The appeal must include a General Report/Compliance Form (available from the student’s Programme Management team or a compliance coordinator) and sufficient information to permit fact-finding and investigation. The Committee will hold a meeting and the student will be notified of the Committee’s decision within five business days after the meeting.

123. ICA REGULATIONS

Declaration by Student’s Pass Applicants

We would like to remind all Student’s Pass holders about your declaration made in ICA forms when you applied for the Student’s Pass:

� “I undertake not to study without a Student’s Pass.” � “I undertake not to misuse controlled drugs or to take part in any political or other

activities during my stay in Singapore which make me an undesirable or prohibited immigrant under the Immigration Act.”

� “I undertake not to comply with any criminal offences in Singapore.” � “I undertake not to indulge in any activities which are inconsistent with the purpose for

which the immigration passes have been issued.” � “I further undertake not to be engaged in any form of employment or in any business,

profession or occupation in Singapore whether paid or unpaid, without a valid work pass issued under the Employment of Foreign Manpower Act (Cap. 91A).”

� “I am aware that overstaying or working illegally in Singapore is a serious offence and on conviction, the penalties may include mandatory imprisonment and caning.”

� “I understand that if the Controller of Immigration is satisfied that or any member of my family breaches this undertaking or becomes an undesirable or prohibited immigrant, he will cancel my immigration pass and the passes of the members of my family, and we may be required to leave Singapore within 24 hours of such cancellation.”

Violators of the above regulations will be penalised by the Singapore Law. Kaplan shall expel the student and cancel the Student’s Pass. For latest information, please go to the ICA website: www.ica.gov.sg.

All international students must hold a valid Student’s Pass and attain the attendance of minimum 90% every month – refer to Pg. 38 Administration Matters / No. 83 Attendance Taking & Monitoring. 124. CONDUCT OUTSIDE THE SCHOOL

Student’s Pass holders are required to adhere to Singapore laws, local rules and regulations. Students must not be studying in any other educational organisation(s) or undertake course(s) other than that indicated on the Student’s Pass.

Should there be any complaint of inappropriate behaviour and misconduct of students, Kaplan will carry out an investigation. If the student is found guilty, the school will not hesitate to take disciplinary action against the student, depending on the severity of the offence.

125. DISPUTE AND GRIEVANCE RESOLUTION PROCESS

A student dispute or grievance may arise from any aspect of their educational experience at Kaplan Singapore which they believe to be unfair, unjust or unreasonable. This would include unsatisfactory services (e.g. poor teaching quality, changes to the curriculum, and delays in awarding certificates).

Where University or Kaplan Singapore policies and procedures exist in relation of student discipline and academic matters (e.g. appeals against results, expulsion, suspension) then these will take precedence over the dispute and grievance process.

A student who is seeking dispute or grievance resolution should follow the 3-steps Dispute and Grievance Resolution Process outlined below. Each step should be completed before going to the next step. This 3-Step process will be effective from 2 January 2014 onwards.

Step 3 If feasible, all disputes and grievances should be resolved between the programme department and student first. If a mutually amicable resolution cannot be found, the student may file an appeal with the Kaplan Senior Manager, Service Quality (SMSQ). The SMSQ will investigate the dispute or grievance from an independent perspective and work with Kaplan Senior management to offer a resolution within 3 working days from the date of appeal to the SMSQ. In the event that the student and Kaplan Singapore are unable to resolve the dispute or grievance amicably, either party may approach CPE’s Student Services Centre (SSC) for help. The officers at SSC will review the issues and may refer the dispute to CPE Mediation –Arbitration Scheme. If the dispute is not resolved through mediation at Singapore Mediation Centre, the dispute will be referred for arbitration by an arbitrator appointed by the Singapore Institute of Arbitrators.

126. COPYRIGHT ACT – IMPORTANT INFORMATION

1. What is Copyright?

Copyright is a form of protection provided to the authors of "original works of authorship," including literary, dramatic, musical, artistic, and certain other intellectual works. In Singapore this is essentially covered under the Copyright Act (Cap. 63). Copyright exists in all forms of works, such as books, periodicals, magazines, compilations of information, photographs, diagrams, dances, scripts for plays, computer programmes, drawings, sculpture, musical scores, lyrics, sound recordings, cinematographic films, television broadcasts, sound recordings and cable programme etc.

2. Who Owns Copyright and What Does It Entitle?

Generally, the author of a literary, dramatic, musical or artistic work is the owner of the copyright. In the case of other forms of copyrighted materials etc, sound recordings and films, the producer is the copyright owner, although in both cases, these rights could be subject to assignments. The owner of a copyrighted work has monopoly rights to reproduce, publish, perform or broadcast the work. It is an infringement of such rights for any other person to do such acts without the consent of the copyright owner. Where a student photocopies an entire or substantial portions of a book he would probably have infringed copyright. In the context of students in Singapore, this is the most frequent type of copyright infringement. It is also an infringement to authorise others to infringe copyright. To illustrate the latter, if you take a book to a photocopying shop and request for a copy of the book, you as the person who authorises the copying are liable for copyright infringement even though the shop does the actual photocopying.

3. What Are The Consequences and Copyright Infringement?

A person found guilty of copyright infringement could be liable for civil and criminal sanctions depending on the nature of the offending acts. Civil liabilities include an order by the Court for the infringer to pay the copyright owner compensation in the form of monetary damages. If you have made any profit from the infringing acts, you could be made to pay all profits you may have made. The copyright owner would probably also obtain an injunction to prevent further infringement. Criminal sanctions may be very serious. A person in the possessions of 5 or more infringing copies of any work is presumed to be in possession of the same for sale. The statutory penalties for copyright infringement for the purpose of sale are a fine of $10,000/- for each infringing article or $100,000/- whichever is lower. The Court may also impose a term of imprisonment not exceeding 5 years. In both cases, the Court may also order that all infringing copies or any article predominantly used for making infringing copies be either destroyed or surrendered to the owner.

4. Is Any Copying Permitted?

Yes, the law provides an exceptions under which copying is not considered infringement. A certain amount of copying by individuals is permissible under certain situations that are deemed as “fair dealings” under the Copyright Act such as copying of a reasonable portion for private study or research.

You are deemed to have copied for the purpose of self-study or research and therefore not infringed copyright if:-

a. Not more than 10% of the total number of pages or total number of bytes in a

published edition of a work; or

b. In a case where the work is divided into chapters, not more than a single chapter of the

work; or

c. In a case where the work comprises an article in a periodical publication, the whole of

the article. ( One article)

5. What if I copy more than the amounts specified above in Para 4?

If you copy in excess of the above limits, you will be deemed not to have copied for the purpose of self-study or research. You will then have the burden of proving that your copying constitutes a fair dealing of the work. The factors to be considered are:-

a) the purpose and character of the dealing, including whether such dealing is of a

commercial nature or is for non-profit educational purpose;

b) the nature of the work or adaptation;

c) the amount and substantiality of the part copied in relation to the whole work or

adaptation; or

d) the effect of the dealing upon the potential market for, or value of, the work or

adaptation.

As this is on a case by case basis it is best to avoid having to resort to the factors in Para 5 to prove fair dealing. The safest course of action would be to keep within the amounts specified Para 4.

6. Is there infringement by the school when multiple copies are made for educational purposes?

There is no infringement making multiple copies of the whole or part of a work or an article for or on behalf of the body administering an educational institution for educational purposes of the school or that of another educational institution; subject to the restrictions in Para 4.

7. How Long Does Copyright Subsists?

You may copy a work after the copyright in the work ceases to subsist. For all literary, dramatic, musical and artistic works, copyright shall subsist for the lifetime of the author and 50 years after his death. Copyright in all other types of works such as sound recordings, films etc. will subsist for 50 years from the date of first publication.

8. Important Reminder

Kaplan Singapore takes a serious view of any infringement of copyright by students and a contravention of the provisions of the Copyright Act is deemed to be a breach of the school’s rules and regulations, which could result in disciplinary action. Kaplan Singapore advises all students to respect the copyright of all copyright owners' works and encourages the purchase of original textbooks and/or other copyrighted materials that are required for your courses of study. The cost of these materials is insignificant compared to the penalties for copyright infringement.
