1 IntroductionIndustrial,commercial,andinstitutional(ICI)sectorsoftenproduceresidualmaterialsduringtheiroperationsthatareconsideredwaste.Somewastesaremorehazardousthanothers,duetotheirchemical,physicalorbiologicalproperties.Hazardouswasteisthetermusedtodescribewastematerialsthatrequirespecialhandlinganddisposal/treatmenttopreventadverseimpactsonhumanhealthandtheenvironment.

ThisguidelinehasbeendevelopedbytheEnvironmentDivisionoftheDepartmentofEnvironmentandNaturalResourcesfortheICIsector.Thepurposeofthisdocumentisto:• provideguidancetoindustrial,commercial,andinstitutionaloperatorsintheNorthwestTerritories

(NWT)onthepropermanagementofhazardouswaste;• increaseawarenessofthedifferenttypesofhazardouswaste;and• supportthetrackingofhazardouswastefromgenerationtofinaltreatment/disposal.

Section2.2oftheEnvironmental Protection Act(EPA)givestheMinisterofEnvironmentandNaturalResourcesoftheGovernmentoftheNorthwestTerritories(GNWT)theauthoritytodevelop,coordinateandadministerguidelines(SeeAppendix1).ThisguidelinedoesnotalleviatetheneedtocomplywithanyotherActorregulationapplicabletothemanagementofhazardouswaste.Section2.6ofthisGuidelineprovidesadditionalinformationontherolesandresponsibilitiesofotherregulatoryagenciesthatmaybeinvolvedwiththemanagementofhazardouswasteduetotheirlegislativeresponsibilities.

ThisguidelineisforthegeneralmanagementofhazardouswasteandshouldbereadinconjunctionwithhazardouswasteguidelinesforspecificsubstancesthatareavailableonENR’swebsite.

Contaminated water WastewaterorsnowthatcontainsanyofthecontaminantslistedinScheduleIinaconcentrationgreaterthanthecorrespondingamount.

Contaminated site Areasofland,water,groundwater,orsedimentsthathavelevelsofcontaminantsexceedingtheremediationcriteriadescribedintheGNWT’sGuideline for Contaminated Site Remediation.

Dangerous goods Anyproduct,substanceororganismreferredtointheprescribedclassesofdangerousgoodsorincludedbyitsnatureinanyoftheprescribedclassesofdangerousgoodsinthescheduleprovidedbytheapplicabletransportauthority.

Dioxin TEQ Thedioxintoxicityequivalent(TEQ)valuewhichisdeterminedbyaddingtheproductsofthemeasuredconcentrationsofeachdioxinandfuranconstituentlistedinColumnIofScheduleIImultipliedbythetoxicityequivalencyfactor(TEF)listedoppositeinColumnII.

Discharge Includes,butnotsoastolimitthemeaning,anypumping,pouring,throwing,dumping,emitting,burning,spraying,spreading,leaking,spillingorescaping.

Drilling cuttings Thesolidmaterials,fragmentsofrockandothermaterialsbroughttothesurfaceduringthedrillingprocess.

Drilling mud Asuspension,usuallyinwaterbutsometimesinoil(diesel),usedinrotarydrilling,consistingofvarioussubstancesinafinelydividedstate(commonlybentoniticclaysandchemicaladditives),introducedcontinuouslydownthedrillpipeunderpressureandthroughopeningsinthedrillbitandtransportedbackupintheannularspacebetweenthepipeandthewallsoftheholetoasurfacepitortankwhereitisconditionedandreintroducedintothewellbore.Itisusedtolubricateandcoolthebit,carrythecuttingsupfromthebottom,andtopreventblowoutsandcave-ins.

Drilling fluids Anyliquidmixtureofclay,water,sediment,drillingmuds,chemicaladditives,orotherwastesthatarepumpeddownholewhiledrillingandarespecificallyrelatedtodrillingactivity.

Empty container Acontainerfromwhichall:a) Hazardouswastehasbeenemptied,tothegreatestextentpossible,using

regularhandlingprocedures.Itscontentsshallnotexceed0.1%ofthecontainer’soriginalcapacityor0.2litres,whicheverisless.ThisdoesnotincludetoxicgasinClass2.3oftheTDGRorcontainerswhichpreviouslycameindirectcontactwith:i. SubstancesinClass6.1PackingGroupImaterialsoftheTDGR;orii. SeverelyToxicContaminants.

b) Flammablevapourshavebeenreducedtolessthantwentypercent(20%)ofthelowerexplosivelimitforthematerialbypurging,venting,orbytheintroductionofaninertmaterial.

Hazardous waste Afacilitywhichisusedforthecollection,storage,treatment,recyclingordisposalmanagement facility ofhazardouswaste.

Incompatible waste Hazardouswasteswhich,whenincontactwithoneanotherorothersubstancesundernormalconditionsofstorageortransportation,couldreacttoproduceheat,gas,fire,explosion,corrosivesubstancesortoxicsubstances.

Landfill Adesignatedareaoflandwhereresidualwasteisplaced,compacted,andcovered.

Leachable waste AsubstancethatmaycontainanyofthecontaminantslistedinScheduleIinaconcentrationgreaterthanthecorrespondingamountwhensubjectedtotheleachateextractionprocedure.

Leachate extraction Atestmethoddesignedtodetermineboththeorganicandinorganicprocedure parameterspresentinsolidandmulti-phasedwaste.Itisdesignedtosimulatethe

characteristicsamaterialmayexhibitifplacedinalandfill.TestdeterminedbyMethod1311ToxicityCharacteristicLeachingProcedure(TCLP)Test,USEPAorLeachateExtractionProcedure164-GP-1-MPCanadianGeneralStandardsBoard.

Listed waste WasteslistedinScheduleIII.

Long term storage Thestorageofhazardouswasteforaperiodof180daysormorebutdoesnotincludematerialsintransit.

2 RolesandResponsibilities

2.1 EnvironmentandNaturalResourcesTheDepartmentofEnvironmentandNaturalResources(ENR)istheGNWTagencyresponsibleforinitiativeswhichcontrolandpreventthedischargeofcontaminants,includinghazardouswastes,andtheirimpactonthenaturalenvironment.ENRisresponsibleforensuringthatenvironmentallyacceptablemanagementprocedures,emissionlevelsanddisposalmethodsaremaintained.LegislativeauthorityisprovidedbytheEnvironmental Protection Act(EPA)(SeeAppendix1)andthePesticide Act.

TheEnvironmentDivision(ED)ofENRmonitorsthemovementofhazardouswastefromthegeneratortofinaldisposalatthereceivingfacilitythroughtheuseofaspecified6partformcalledahazardouswastemovementdocument.Amovementdocumentform,oranequivalentrecordofdisposal,mustaccompanyallhazardouswasteintransitregardlessofthemeansoftransport.HazardouswastemovementdocumentsareprovidedbytheEnvironmentDivision.

Ifhazardouswasteistobetransportedofftheoriginatingsite,thegeneratormustberegisteredwithED.Onceregistered,anidentificationnumberwillbeassignedwhichisrequiredtocompletethemovementdocument.AcarrierorreceivermayeitherberegisteredintheNWTorintheprovinceorterritoryinwhichthecompanyisbased.Thebasicframeworkfortheoff-sitemovementofhazardouswasteandreportingisoutlinedinFigure1.

ThedefinitionsofhazardouswastevaryacrossCanada,althoughmostprovincesandterritoriesregistergenerators,carriers,receiversandutilizethehazardouswastemovementdocument.ThedefinitionofhazardouswasteintheNWTisuniquebecauseitincludeswastetypessuchas,contaminatedsoilanddrillingwastewhicharefrequentlymanagedunderdifferentregulatoryframeworksinotherjurisdictions.Itisimportanttoconfirmtheirultimatedisposalonahazardouswastemovementdocumentoranequivalentrecordofdisposal.

Theenvironmentalrisksassociatedwiththesewastetypesmaybemitigatedthroughvariousformsofon-sitemanagementandtheirdisposalmaybespecificallyauthorizedbytheapplicableregulator.ItisimportanttoreviewallthesectionsofthisGuidelineasitpertainstotheproposedactivities.

2.2 GeneratorsofHazardousWasteThe responsibility for proper waste management rests with the generator and should be considered part of the cost of doing business.

Thegeneratorisultimatelyresponsibleforensuringhazardouswastewillbeproperlymanagedfromthetimeitisgeneratedtofinaldisposal.Hazardouswastemustbeproperlypackaged,stored,transported,treatedanddisposedof.Contractorsfrequentlymanagewasteonbehalfofthegenerator;however,thegeneratorisresponsibleforensuring,inadvance,thatthewastemanagementmethodisacceptable.

Ingeneral,thegeneratorisresponsibleforthefollowing:• Packaging,classifying,quantifying,labelling,andstoringhazardouswasteproperly(SeeSections4.2and

4.3).• Registeringtheirhazardouswastemanagementfacilityifapplicable(seeSection2.5).• Ensuringanalysis(ifrequired)isperformedbyalaboratoryaccreditedbyCALAorSCC(SeeAssociations

inAppendix4).• Ensuringtheproperdisposalofhazardouswastebyanacceptablemethod.Appendix2ofthisGuideline

describeshowtodetermineifareceiverisauthorizedtoreceivethetypeofhazardouswaste.• Ensuringworkersaretrainedinthemanagementofhazardouswasteincludingemergency/spill

responseintheeventofadischarge.• Complyingwithallotherregulatoryrequirementsforhazardouswastemanagementincluding

transportation,occupationalhealth,andpublichealthandsafety.

Whenhazardouswasteistobetransportedoff-site,thegeneratorisrequiredto:• registerasageneratorofhazardouswaste;• ensurethewasteistransportedbyaregisteredhazardouswastecarriertoareceiverauthorizedto

receivethetypeofhazardouswaste;and• ensureamovementdocument,oranequivalentrecordofdisposal,isproperlycompletedand

accompaniestheshipment(seeSections4.5and4.6).

HazardouswastemanagementflowchartsforgeneratorsareshowninFigures3and4ofSection4.

2.3 CarriersofHazardousWasteCarriersmustberegisteredwithEDpriortotransportinghazardouswaste.Hazardouswastemustbetransportedinaccordancewiththeappropriatetransportauthorityasdefinedbelow.

ReceivingfacilitiesoutsidetheNWTneedtobeauthorizedbytheprovinceorterritoryofdestinationtoreceivethespecifictypeofhazardouswaste.Thereisawiderangeoffacilitiestomanagevarioustypesofhazardouswaste.AcomprehensivelistingisbeyondthescopeofthisGuideline.SeeSection4.6formoreinformation.

2.5 HowtoRegisterasaHazardousWasteGenerator,Carrier, StorageFacility,orReceiver

Ageneratormayalsoberequiredtoregistertheirstoragefacility.Ifthehazardouswasteisnotstoredonthegenerator’sproperty,thepropertyownerwillneedtoregistertheirfacilityasareceiver.Astoragefacilitycanbeabuilding,locker,compoundorareausedtostorehazardouswaste.

AstoragefacilitymustberegisteredwithEDif:• Thefacilityisusedorisintendedforthestorageofhazardouswasteforaperiodof180daysormore;

and• QuantitiestobestoredexceedthequantitiessetoutinScheduleVIforindividualwasteclassesorifthe

aggregatequantityforallclassesofwastestoredexceed5,000kgorL(exceptforcontaminatedsoilanddrillingwastewherequantitiesexceed50,000kgorL).

UndertheEPA,theSpillContingencyPlanningandReportingRegulationssetthestandardsforreportingspillsofcontaminantsandpreparingspillcontingencyplans.

EDrequiresthefollowinginformationwhenregisteringahazardouswastestoragefacility:• Companyname,address,phonenumberandcontactperson,includingposition;• Locationanddescriptionofthefacility;• Expectedtypes,quantitiesandmethodofstorageofthehazardouswaste;• Approvalsrequiredtooperateandoccupythelandforthatpurpose;and• ConfirmationthattheproponenthasprovidedbuildingplanstotheOfficeoftheFireMarshaltoensure

compliancewithadoptedcodesandstandards.

RegisteringasaReceiver

Facilitieswhichstore,treat,reprocess,consolidate,destroyorrecyclehazardouswaste(s)areclassifiedashazardouswastemanagementfacilities,andmustregisterwithEDpriortobeginningoperation.InadditiontotheinformationrequiredforastoragefacilityEDrequiresadescriptionofthewastemanagementactivitiestobeconducted.

AhazardouswastemanagementfacilitymayalsorequirepermitsandlicencesfromtheapplicableLandand/orWaterBoardortheDepartmentofLandsdependingontheactivity,orforthedepositofanywaste(seeSection2.6).Underthesecircumstancesthereviewofproposedhazardouswastemanagementactivitiesthatoverlapwithotheragencies,occurinparallelwithoutaduplicatereviewprocess.

2.6 OtherRegulatoryAgenciesOtheragenciesmaybeinvolvedwiththemanagementofhazardouswaste.Someoftheotheragenciesthatmaybeinvolvedareidentifiedbelow.

2.6.1 Department of Infrastructure, GNWTTheRoadLicensingandSafetyDivisionisresponsibleforadministeringtheTransportation of Dangerous Goods Act and Regulations(NWT).TheDepartmentisalsoresponsiblefordriver,vehicleandroadsafetyunderadditionaltransportlegislation.

Thetransportationofdangerousgoodsbyrail(TDGR),marine(IMDG)orbyair(ICAO)isregulatedbyTransportCanada.

2.6.2 Department of Lands, GNWTTheDepartmentofLandsissuesandmanagesvariousauthorizationsforuseofpublicland.WherepubliclandisleasedtooperatorsbytheGNWT,theleasetermsandconditionsrequirepropermanagementofhazardouswaste,whichisverifiedbyregularinspectionsbytheDepartmentofLands.

2.6.3 Workers’ Safety and Compensation Commission (WSCC)TheWSCCisresponsibleforadministeringtheNWTSafety ActandtheOccupationalHealthandSafety(OHS)Regulations,whichaddressthesafetyofworkersandtheworkplace.TheActstatesthattheemployershallmaintaintheirestablishmentandtakeallreasonableprecautionstoensurethesafetyandhealthofeverypersonintheestablishment.Theregulationsalsoprescribestandardsforprotectiveclothingandequipmenttobeusedbyworkers.TheWorkSiteHazardousMaterialsInformationSystemRegulationswereadoptedtoensureemployeetrainingandsafestorageandhandlingofcontrolledproductsattheemployer’sworksite.

2.6.4 Office of the Fire Marshal, GNWTTheOfficeoftheFireMarshalhasauthorityoverthestorageofflammable,combustibleandhazardousmaterialsundertheNational Fire Code.TheNationalFireCodeisadoptedbytheGNWTthroughthe FirePreventionRegulations.ConsultwiththeGNWTDepartmentofMunicipalandCommunityAffairs’regionalAssistantFireMarshaloryourcommunityFireChiefifyouractivitiesmayrequiretheOfficeoftheFireMarshal’sreview.

2.6.5 Chief Public Health Officer, GNWTTheChiefPublicHealthOfficer,GNWTshouldbeconsultedregardingrequirementsunderthePublic Health Actwhenwastemanagementactivitiesmayaffectpublichealth.

2.6.6 Office of the Regulator of Oil and Gas Operations (OROGO)OROGOregulatesoilandgasactivitieson-shoreintheNWTfortheprimarypurposesofensuringsafety,environmentalprotectionandconservationofoilandgasresources.OROGOdoesnotregulateoilandgasactivitiesinfederalareas,theoff-shore,theon-shoreintheInuvialuitSettlementRegion,theNormanWellsprovenarea,ortheinter-provincial/territorialtransmissionofoilandgas(pipelines).

2.6.10 Canadian Nuclear Safety Commission (CNSC)TheCNSCregulatesandlicensesradioactivewastemanagementfacilities.TheresponsibilityforensuringsafetransportofradioactivewasteisjointlysharedbetweentheCNSCandTransportCanada.TheTDGRdealswiththetransportofallclassesofdangerousgoods,whiletheCNSC’sPackagingandTransportofNuclearSubstancesRegulations areprimarilyconcernedwithhealth,safetyandsecurityofthepublic,andprotectionoftheenvironmentrelatedtothespecialcharacteristicsofradioactivematerial.

2.6.11 Indigenous and Northern Affairs Canada (INAC)INACisthefederalagencythathasthemandatetomanagelandandwaterondesignatedfederallands,aswellasoff-shoreoilandgas.Theyalsomakeappointmentsandprovidepolicydirectiontothelandandwaterboards.

3.1 GeneralHazardouswastesaregeneratedinawidevarietyofworkplacesettingsintheNWTandmaybegases,liquids,solidsorsemi-solids.Thedefinitionofhazardouswasteincorporatesseveraltermsthatdescribethedifferenttypesofhazardouswastegenerated.Wastetypesa)throughe)areclassifiedbasedontheirphysicalpropertiesofbeingcorrosive,flammable,reactive,persistent,bioaccumulativeortoxic.Waste typesf)andg)arenamedashazardouswastesbecauseoftheknownenvironmentalliabilityassociatedwiththesewastetypes.

Hazardous waste must not be mixed or diluted with any substance or divided into smaller quantities to avoid meeting the definition of a hazardous waste.

3.2 HazardousWasteTypes

a)DangerousGoods

Thedefinitionofhazardouswasteinthisguidelineincorporatestheterm“dangerousgoods”asdefinedintheTransportation of Dangerous Goods Act.TheTransportationofDangerousGoodsRegulations(TDGR)outlinesasystemforclassifyingdangerousgoods.Therefore,theclassificationsystemusedintheTDGRshouldbereferredtoforthemostcurrentcriteriawhenitisappliedtohazardouswasteclassification.TherearenineclassesofdangerousgoodsdescribedintheTDGR,howeverthedefinitionofhazardouswasteonlyincludesthecriteriaforClasses2,3,4,5,6,8,and9.Class1explosivesandClass7radioactivematerialsareexemptfromthedefinitionofhazardouswaste.Thesematerialsareregulatedbyfederallegislation.Appendix3outlinesthepropertiesofthesevendangerousgoodschemicalclassesreferencedinthedefinitionofhazardouswaste.

b)LeachableWaste

TheleachabilityofsolidwasteisdeterminedbyanalysingarepresentativesampleaccordingtotheToxicityCharacteristicLeachingProcedure(TCLP),TestMethod1311(asamended)developedbytheU.S.EnvironmentalProtectionAgency.ThepurposeoftheTCLPistodeterminethemobilityoforganicandinorganicanalytespresentinliquid,solid,andmulti-phasewastes.TheTCLPanalysissimulateslandfillconditionswhere,overtime,waterandotherliquidspercolatethroughlandfills.Thepercolatingliquidoftenreactswithsolidwasteinthelandfill,andmayposepublicandenvironmentalhealthrisksbecauseofthecontaminantsitabsorbs.Thetestisintendedtodetermineifawasteissuitablefordisposalinalandfillordisposalfacility.ThegeneratormustuseprocessknowledgetoselecttheapplicableparametersinScheduleIandensurethewastetypesmeetsthenumericalcriteriaassignedtotheparameter.

c)HazardoustotheAquaticEnvironment

Thisclassificationisintendedforpackagedproductsorbulkgoodsthatarebought,sold,orusedinaworkplacesetting.Theclassificationmaybefoundasalabelontheproductoronthesafetydatasheetsoftheproduct.Thishazardclassificationsystemisnotintendedtobereferencedaseffluentcriteriathatrequireauthorizationfromtheapplicableregulator.

Part4EnvironmentalHazardsoftheUnitedNationsGHSoutlinescriteriaforsubstancesthatarehazardoustotheaquaticenvironmentbasedonthefollowingbasicelements:

(a) Acuteaquatictoxicity;(b) Chronicaquatictoxicity;(c) Potentialfororactualbioaccumulation;and(d) Degradation(bioticorabiotic)fororganicchemicals.

d)WasteContainingDioxinsandFurans

Dioxinsandfuransarepolychlorinateddibenzo-p-dioxinsandpolychlorinateddibenzofurans.Duetotheirextraordinaryenvironmentalpersistenceandcapacitytoaccumulateinbiologicaltissues,thereleaseofdioxinsandfuransfromhumanactivityareslatedforvirtualeliminationundertheCanadianCouncilofMinistersoftheEnvironment(CCME)PolicyforManagementofToxicSubstancesandthefederalToxicSubstancesManagementPolicy.

IntheNWT,dioxinsandfuransfromhumanactivitiesaremostfrequentlyformedasaresultofincinerationoropenburningofgarbage,andarealsofoundassolidwasteintheash.Theyarealsofoundinwoodpreservativesthatusedpentachlorophenol.

WastecontainingdioxinsandfuransisclassifiedasahazardouswasteifitcontainsDioxinTEQinaconcentrationgreaterthan0.001mg/kg.

e)ContaminatedSoil/Snow/Water

Contaminatedsoil/snow/waterthatisbeingremovedfromacontaminatedsiteismanagedasahazardouswasteintheNWTtoensurethematerialremovedistransportedtoaregisteredreceivingfacilityauthorizedtoreceivethatwaste.

Contaminatedsoilissoil,sand,gravel,rockorsimilarnaturallyoccurringmaterialthatcontainslevelsofcontaminantsexceedingtheremediationcriteriafoundintheGuidelineforContaminatedSiteRemediation. Thehazardouswastemanagementframeworkisnotmeanttobeappliedtoactivitiesthatfollowthetieredprocessorriskassessmentorin-situremediationaccordingtotheGuidelineforContaminatedSiteRemediation.

Contaminatedsoilmaybeexemptfromthedefinitionofhazardouswastewherecircumstancesallowfor:• on-siteremediation;• re-useofpetroleumhydrocarboncontaminatedsoilinanasphaltpavingplant;• re-useofsoilthatmeetsindustrialcriteriaforlandfillcover;or• re-useofsoilasindustrialfillonceapriorinformedconsentformhasbeencompleted.

UnderthesecircumstancesEDneedstobecontactedtoconfirmanalternativerecordofdisposaliscompletedthatprovidesanequivalentlevelofaccountabilitytoconfirmthedisposaldoesnotcontributetothelikelydischargeofacontaminant.

Contaminatedsnoworwatermaycontainmixturesoremulsionsofwastefuel,usedoil,solvents,antifreeze,orothertypesofhazardouswaste.ContaminatedsnoworwaterisahazardouswasteifitcontainsanyofthecontaminantslistedinScheduleIinaconcentrationgreaterthanthecorrespondingamount.

Ifthecontaminatedwaterissuitablefordisposalinamunicipalsewagelagoonthenitisnotconsideredhazardouswaste.Itisimportanttocheckthemunicipalsewerby-laworwiththemunicipalityabouttheirwaterlicencepriortodisposingofcontaminatedwaterinamunicipalsewagelagoon.

f)DrillingWaste

Drillingwastesaregeneratedfromsub-surfacedrillingactivitiesandareusuallymadeupoftwocomponents:drillingfluidsandsolids(i.e.cuttings).IntheNWT,drillingwastesaretypicallygeneratedfromthefollowingactivities:• oilandgasexploration/production;• mineralexploration;or• horizontaldirectionaldrillingforinfrastructureinstallation.

Themanagementofdrillingwasterequirescarefulconsiderationofthevariousauthorizationsthatmayberequiredfromtheapplicableregulator.Drillingwastesvaryinvolumeandchemicalcomposition,thereforemanagementmethodsvarydependingonthespecifictypeormethodofdrillingactivity.Fordrillingthatrequirestheuseoffluids,thesefluidscanbewater-based,oil-basedandmayincludeawidevarietyofaddedsubstances.

RegulatoryOversight

Thisguidelinemakesadistinctionbetweentheon-site,andtheoff-site,managementanddisposalofdrillingwaste.Individualprojectsmaychoosetomanagetheirdrillingwasteon-siteoroff-site,orsomecombinationofboth.

On-SiteDrillingWasteManagementandDisposal

TheregionalLandand/orWaterBoardauthorizethedisposalofdrillingwasteontolandorintowater,throughtermsandconditionsineitheraLandUsePermit(LUP)oraWaterLicence(WL)(SeeSection2.6.12).Thedepositofdrillwastebyinjectionintoanundergroundformationorreservoirisauthorizedbytheapplicableenergyregulator(seesection2.6.6and2.6.8).Priortoreceivingauthorizationtheoperatorisrequiredtosubmitaprojectproposalwhichincludesdetailspertainingtowastemanagementanddisposal.ApproveddrillingwastemanagementplansintheNWTmayreferencesuitabledrillingwastemanagementguidancedevelopedinotherjurisdictions,butmayalsorequireadditionalmethodssuitablefortheNWT.

Off-SiteTransportationandDisposal

Theoff-sitetransportationanddisposalofdrillingwasteintheNWTrequirespropertrackingandrecordkeeping.Theframeworkformanaginghazardouswaste,suchasgenerator,carrier,receiverregistrationandtheuseofhazardouswastemovementdocuments(oralternativerecordofdisposal),areusedtoaccountfortheultimatedisposalofalldrillingwasteswhentheyaretransportedtootherreceivingfacilities.Inaddition,thegeneratormustalsodetermineifthepropertiesofthedrillingwastesrequireittobeclassifiedasadangerousgood.

Theoff-sitemanagementanddisposalofdrillingwasteintheNWTrequiresauthorizationfromtheapplicableregulator.Thismaybedonethroughthereviewof,butnotlimitedtothe:a) Receivingsitedesign,operationandcapacity;b) Receivingsiteapprovalsandanyassociatedoperationalrequirements;c) Analyticaltestingofthedrillingwastesorthereceivingenvironment;d) Informationthatindicatesnohazardousdrillingadditivesorchemicalswereused;ore) Wastemanagementplansthatreferencesuitabledrillingwastemanagementpracticespriortodisposal

(i.e.storage,transport,handling,disposalmethod,etc.).

g)ListedWaste

EDhasincludedaspecificlistofwastesinScheduleIIIthatareknowntohavehazardousproperties.Thewastetypeslistedarecommontoseveraltypesofindustrial,commercialandinstitutionalactivities.Furthertestingorapplicationofprocessknowledge,ofthesewastesisrequiredtodetermineiftheycanbemanagedasnon-hazardouswaste.Thegeneratormustalsousetheirknowledgeofthespecificcharacteristicsofthesewastetypestohelpdetermineiftheyarealsoclassifiedasdangerousgoods.

Householdhazardouswasteisgeneratedfromcommonactivitiessuchashome,yard,andvehiclemaintenance.Householdhazardouswastefromasingleresidenceisexemptfromtherequirementsofthisguideline,butacollectionofconsolidatedhouseholdhazardouswastefromnumerousresidencesismanagedashazardouswaste.Collectionsofhouseholdhazardouswastearethosethatarecollectedandsegregatedatcollectioneventsorhaveaccumulatedatmunicipalfacilitiesovertime.

3. Incineratorashisaprocessresidualgeneratedinincineratorsusedinvariousindustrialactivities.Incineratorashmightcontainhighlevelsofmetals,dioxinsand/orfurans.Thiswastestreammustundergoanalyticaltestingforleachablemetalsaswellasdioxinsandfuranstoconfirmtheabsenceofcontaminants(ScheduleIandII)priortodisposalinsolidwastefacilitiesintheNWT.

4. UsedoilandusedoilfiltersareregulatedinaccordancewiththeUsedOilandWasteFuelManagementRegulationsthatcontaincriteriafortheuseofusedoilforthepurposeofheatrecovery,aswellashowusedoilfiltersaretobemanaged.Section20oftheseregulationsstatethefollowing.20. No person shall dispose of a filter used to filter oil unless, 24 hours before disposing of the filter,

(a) the inner chamber of the filter is punctured and the contents are drained; or(b) the filter is mechanically crushed or shredded and the contents have been collected.

Awastemightneedtobemanagedasahazardouswasteundercircumstancesnotdefinedinthisguideline.ENRcouldreceivenewinformationthatawastetypeorchemicalishazardous,butnotcapturedbyanyoftheclassificationsinthisguideline.Additionally,ENRmaycontacttheresponsiblepartydirectlyinwriting,orverbally,withspecificwastemanagementrequirements.

4 StorageandManagementofHazardousWasteWastemanagementisintendedtoreduceoreliminatetheeffectsofwasteontheenvironment,toprovideforpublicandworkersafetyandtomaximizetheefficientuseofresources.Oncehazardouswastehasbeencreated,thepropertreatmentanddisposalcanbeexpensive.Whileitistheresponsibilityofthewastegeneratortopayforalldisposalcosts,variouswastemanagementoptionsareavailabletoreducethecostandvolumeofwasterequiringtreatment.

4.1 PollutionPreventionAmoreeffectiveandproactivemanagementpracticeistoeliminateorreducethegenerationofthewaste.Thisisreferredtoaspollutionprevention.

Minimizing or avoiding the creation of pollutants and waste can be more effective in protecting the environment than treating them, or cleaning them up after they have been created.

Pollutioncontroloptionstreatwasteafterithasbeencreated,whereaspollutionpreventionmeasuresavoidthecreationofwaste.

WastegeneratorsintheNWTcanreducecostsandpreventpollutionbyimplementingreduction,reuseandrecyclingprogramsthroughchangesinoperationalprocedures,maintenancepracticesandrawmaterialusage.Anoverallwastemanagementplanshouldincorporatetheseideas.

1. Reduce

Theaimofreductionistoeliminatetheproductionofahazardouswastebyusingrawmaterialsmoreefficiently.Methodsofreductionincludesubstitutionorreductionofarawmaterial,productionredesign,processchanges,andimprovedmaintenanceactivities.Methodswhicharetechnicallyandeconomicallypracticalinanygivensituationshouldbeusedtoreduceoreliminatewastestreams.

2.ReuseandRecycle

Reusingorrecyclinghazardouswasteinoperatingprocesseswithinthegeneratingfacilityisanothermeansofpollutionprevention.Alternatively,otherusersmaybefoundtoreusethematerialthatwouldotherwiserequiretreatmentordisposal.ENRencouragesthereuseandrecyclingofhazardouswasteinthefollowingways:(a) Wasteexchangesandassociationsoffersomeopportunityforthereuseorrecyclingofwaste.Waste

exchangesputpotentialusersofwastematerialsincontactwithwastegenerators.Appendix4listsanumberofwastematerialexchangesandmanagementassociations;and

(b) Recyclingprogramsareinplaceforsomehazardouswastessuchasusedoil,wastefuels,solventsandbatteries.Forinformationonrecyclingprograms,contactthewastemanagementassociationslistedinAppendix4orED.

4.2 GeneralRequirementsforStorageContainersHazardouswasteshouldbestoredincontainersasfollows:• Intheoriginalcontainers,wherepossible,orincontainersmanufacturedforthepurposeofstoring

hazardouswaste.Thecontainersmustbesound,sealableandnotdamagedorleaking.TheTransportAuthorityregulatescontainerspecifications.

• ClearlylabelledaccordingtotheWorkSiteHazardousMaterialsInformationSystem(WHMIS)and/ortherelevantTransportAuthority,iftransportationisplanned.

• BulkedintospecifiedmeansofcontainmentthatisoutlinedintheTDGR.Ifthehazardouswasteisnotadangerousgood,themeansofcontainmentmustbesuitabletoensurethatthecontentswillremainsecureduringstorageandtransportation.

• Thecontainersshouldbesealedorclosedatalltimes,unlessinuse.

4.3 GeneralRequirementsforStorageFacilitiesHazardouswastemustbestoredinasafeandsecuremanner.Ingeneral,hazardouswasteshouldbestoredaccordingtothefollowingpoints:• Drainageiscontrolledtopreventspillsorleaksfromleavingthesiteandtopreventrun-offfrom

enteringthesite.• Wastesaresegregatedbychemicalcompatibilitytoensuresafetyofthepublic,workersandfacility.The

NationalFireCodeaswellasTDGRcanbereferencedforsegregationcriteria.• Hazardouswastesarestoredinasecureareawithcontrolledaccess.Onlypersonsauthorizedtoenter

andtrainedinwastehandlingproceduresshouldhaveaccesstothestoragesite.• Regularinspectionsofstoredhazardouswastesareperformedandrecorded.Containersareplaced

sothateachcontainercanbeinspectedforsignsofleaksordeterioration.Leakingordeterioratedcontainersmustbeimmediatelyremovedandtheircontentstransferredtoasoundcontainer.

• Arecordofthetypeandamountofwasteinstorageshouldbemaintained.• Hazardouswastecontainersmustnotbeallowedtofillupwithwaterwhenstoredoutdoors.Drums

frequentlyaccumulatewaterfromrainfallandsnowmelt,ifstoredupright,outside,withoutpropersealing.

• Emptycontainersneedtobestoredontheirsidetopreventwaterfromentering.• Storagesitesmusthaveemergencyresponseequipmentandmaterialappropriateforthehazardous

wastestoredonsite.• Wherethehazardouswastestoragesiteistobeusedforlongtermstorageandtheamountofwaste

instorageexceedsthequantityrequirementssetoutinScheduleVI,thesiteneedstoberegisteredinaccordancewithSection2.5ofthisguideline.

• Hazardouswastestoragesitesmustmeetalllocalby-lawandzoningrequirements.ItisrecommendedthatthelocalFireChiefbeadvisedofthestoragefacilityanditscontentsforemergencyplanningandresponsepurposes.

4.4 HazardousWasteTreatmentorDisposalIt is not acceptable for hazardous waste to be abandoned, poured down sewers, dumped on land or discarded at a landfill.

Treatinghazardouswastetoreduceoreliminatehazardsisthefinaloptionafterimplementingappropriatepollutionpreventionoptions.Itistheresponsibilityofthegeneratortotreatordisposeofhazardouswasteproperly.Althoughadiscussionoftreatmentanddisposalmethodsisbeyondthescopeofthisguideline,thefollowingaregeneralpointsforconsideration:• Thegeneratorisrequiredtodetermineandfollowthepropermanagementmethodforthehazardous

wastegenerated.Informationonpropermanagementmethodsforhazardouswastetypescanbefoundatthefollowingsources:– themanufacturer’sSafetyDataSheet(SDS)providedwiththerawmaterials;– themanufacturer;– thisguidelineandotherrelevantlegislation;and– wastemanagementconsultantsandassociations.

• Openburningofhazardouswasteisprohibited.• Mixingdifferenttypesofhazardouswasteinthesamecontainermaycausedangerouschemical

reactions.Itisalsoimportanttocontrolthequalityofanywastetoensureitcanberecycledordisposedofproperly.Contaminatingwasteswithotherwastesmaypreventreuse/recyclingoptionsandincreasedisposalcosts.

• Hazardouswastecontainersshouldbeemptied,tothegreatestextentpossible,usingregularhandlingprocedures,orbytriplerinsingwithanappropriatecleaningagent.Rinsingsmustbemanagedaccordingtotheirwastecharacteristics.Containersmustberenderedunusablebypuncturingorcrushingpriortodisposal.Thisisespeciallyofconcernforcontainerswhichcouldotherwisebeusedforwaterorfoodstorage.

4.5 RecordofDisposalRequirementsAcompletedsix-parthazardouswastemovementdocument(wastemanifest)isarecordofdisposalthataccompaniesthetransportationofhazardouswastefromregisteredgeneratorstocarrierstoreceivers.Thecompletedmovementdocumentformprovides:• Detailedinformationonthetypesandamountsofhazardouswasteshipped;• Arecordofwhoisincharge,managementorcontrolofthehazardouswaste;and• Informationonthestorage,treatmentordisposalofthewasteandconfirmationthatthehazardous

wastearrivedatanauthorizedreceiver.

Thegenerator(consignor),carrierandreceiver(consignee)musteachcompletetheirportionofthemovementdocument.Theinformationprovidedonthemovementdocument,aswellasotherTDGRrequirements(i.e.labellingandplacarding)arealsointendedtoassistfirstresponders(police,ambulance,firefighters)withhazardinformationshouldatransportationaccidentoccur.MovementdocumentsareavailablefromED.

4.6 DisposalofHazardousWasteOutsideoftheNWTHazardouswastecanbesenttoahazardouswastemanagementfacilityoutsideoftheNWTifthereceivingfacilityisregisteredinthereceivingprovinceorterritoryandisauthorizedtomanagethatwaste.Wastetypessuchascontaminatedsoilordrillingwastemaynotbeconsideredhazardouswasteinotherprovincesorterritoriesbutmuststillbetransportedtoauthorizeddisposalfacilities.HazardouswastegeneratedintheNWTiscommonlytransportedtoAlbertaorBritishColumbia(BC)fortreatmentordisposal.AlistofhazardouswastemanagementfacilitiesintheseprovincesisavailablebyvisitingAlbertaEnvironmentandParkswebsitehttp://aep.alberta.ca/waste/waste-facilities/hazardous-facilities.aspxortheBCEnvironmentalIndustriesAssociationswebsite(http://www.hazwastebc.com).ThelistoforganizationsinAppendix4canhelptodeterminethebesthazardouswastemanagementoption.

Itisimportantforgeneratorstoknowthedifferencesinhazardouswasteregulationsbetweenprovincial/territorialjurisdictionsandensurethatthehazardouswasteisdisposedofinamannerthatsatisfiesalljurisdictionswherethehazardouswastewillbegenerated,transportedanddisposed.

Itisimportantforgeneratorstouseshippingnamesofhazardouswastethatalignwiththeprovinceorterritoryofdestination.Ifthewastereceivingfacilityisnotfamiliarwiththemovementdocumentforaparticulartypeofwasteitisimportanttoensureacompleterecordofdisposalisutilizedandthatthereceivingsiteprovidesasignedcopythatconfirmstheultimatedisposal.UnderthesecircumstancesthegeneratorintheNWTisrequiredtoprovidethesignedcopytoED.

Internationalandinterprovincial/territorialshipmentsofhazardouswastearealsocontrolledunderthefederalExportandImportofHazardousWasteandHazardousRecyclableMaterialRegulationsandthe InterprovincialMovementofHazardousWasteRegulations.

4.7 AlternativeManagementMethodsEDwillgiveconsiderationtoproposalsforalternatemanagementmethodsthatprovideanequivalentlevelofenvironmentalprotectiontothoseidentifiedinthisguideline.StaffintheEnvironmentDivisionareavailabletodiscussandreviewproposedhazardouswastetreatmentanddisposaloptions.

1. InthisAct,

“contaminant”meansanynoise,heat,vibrationorsubstanceandincludessuchothersubstanceastheMinistermayprescribethat,wheredischargedintotheenvironment,(a) endangersthehealth,safetyorwelfareofpersons,(b) interferesorislikelytointerferewithnormalenjoymentoflifeorproperty,(c) endangersthehealthofanimallife,or(d) causesorislikelytocausedamagetoplantlifeortoproperty;

“discharge”includes,butnotsoastolimitthemeaning,anypumping,pouring,throwing,dumping,emitting,burning,spraying,spreading,leaking,spilling,orescaping;

“environment”meansthecomponentsoftheEarthandincludes(a) air,landandwater,(b) alllayersoftheatmosphere,(c) allorganicandinorganicmatterandlivingorganisms,and(d) theinteractingnaturalsystemsthatincludecomponentsreferredtoinparagraphs(a)to(c).

“inspector”meansapersonappointedundersubsection3(2)andincludestheChiefEnvironmentalProtectionOfficer.

2.2 TheMinistermay(a) establish,operateandmaintainstationstomonitorthequalityof,andthedischargeofcontaminants

intotheenvironmentintheTerritories;(b) conductresearchstudies,conferencesandtrainingprogramsrelatingtocontaminantsandtothe

preservation,protectionorenhancementoftheenvironment;(c) develop,co-ordinateandadministerpolicies,standards,guidelinesandcodesofpracticerelatingto

thepreservation,protectionorenhancementoftheenvironment;

3. (2) TheChiefEnvironmentalProtectionOfficermayappointinspectorsandshallspecifyintheappointmentthatpowersthatmaybeexercisedandthedutiesthatmaybeperformedbytheinspectorunderthisActandregulations.

stubblefordomesticoragriculturalpurposes;(e) thedischargeofthecontaminantresultedfromburningforlandclearingorlandgrading;(f) thedischargeofthecontaminantresultedfromafiresetbyapublicofficialforhabitat

managementofsilviculturepurposes;(g) thecontaminantwasdischargedforthepurposesofcombattingaforestfire;(h)thecontaminantisasoilparticleorgritdischargedinthecourseofagricultureorhorticulture; or(i) thecontaminantisapesticideclassifiedandlabelledas“domestic”underthePestControl

ProductsRegulations(Canada).

(4) Theexceptionssetoutinsubsection(3)donotapply(a)whereapersondischargesacontaminantthattheinspectorhasreasonablegroundstobelieveisnotusuallyassociatedwithadischargefromtheexceptedactivity.

5.1.WhereadischargeofacontaminantintotheenvironmentincontraventionofthisActortheregulationsortheprovisionsofapermitorlicenceissuedunderthisActortheregulationsoccursorareasonablelikelihoodofsuchadischargeexists,everypersoncausingorcontributingtothedischargeorincreasingthelikelihoodofsuchadischarge,andtheownerorthepersonincharge,managementorcontrolofthecontaminantbeforeitsdischargeorlikelydischarge,shallimmediately:(a) subjecttoanyregulations,reportthedischargeorlikelydischargetothepersonorofficedesignated

bytheregulations;(b) takeallreasonablemeasuresconsistentwithpublicsafetytostopthedischarge,repairany

damagecausedbythedischargeandpreventoreliminateanydangertolife,health,propertyortheenvironmentthatresultsormaybereasonablyexpectedtoresultfromthedischargeorlikelydischarge;and

(c) makeareasonableefforttonotifyeverymemberofthepublicwhomaybeadverselyaffectedbythedischargeorlikelydischarge.

Asahazardouswastegenerator,itisimportanttocarefullychooseahazardouswastereceiver.Generatorsareresponsiblefortheirwasteuntilitislegallyandproperlyreceivedatasuitablyauthorizedfacility.

SelectionFactorsBelowisalistofconsiderationswhenselectingahazardouswastereceiver:• Ensurewastehasbeenproperlyclassified,eitherthroughcharacterizationbyaqualifiedconsultant

orenvironmentaltestinglaboratory,orbyreviewingtheprocessgeneratingthewastealongwiththeoriginalrawmaterialsusedintheprocess.

• Ensurethehazardouswastesaremanagedbycompaniesthatarecapableofappropriatelymanagingthewastes.ThisisimportantforhazardouswastedisposaloutsideorinsideoftheNWT.

• Findoutifthehazardouswastereceiverhascarriedoutanyfacilityaudits.Manywastereceiversarerequiredtosubmitauditreportstotheprovincialorterritorialauthority.Requestacopyofthereceiversmostrecentauditreport.Mostcompetentwastereceiversarrangethirdpartyauditsattheirfacilitiesandarewillingtoshareanddiscusstheresultswiththeirpotentialclients.

• Getreferencesfrombusinesscolleagueswhohaveusedaspecifichazardouswastereceiver.• Findoutifthehazardouswastereceiverhastheappropriateauthorizationtomanageyourhazardous

waste(s).Authorizedreceiversarerequiredtohaveafacilityregistrationnumberissuedbytheprovincialorterritorialauthority.

• ChecktheWasteReceiverAssessmentProgram(http://www.wrapaudit.com/index.php)toseeifaWasteFacilityEnvironmentalReviewhasbeencompletedonbehalfofotherwastegeneratorsforthereceivingfacility.
