services in the amount of $1,929,070 with a Supplemental Work Allowance of $192,900 for a 36
total contract amount of $2,121,970. 37

On April 7, 2015, your Board authorized (Item #57, File C-900761, C-5185) GSA to issue a 39
$893,355 change order to SMC, and extend the current contract term until 6/30/17, and increase 40
the contract amount from $2,121,970 to $3,015,325, with a $200,000 SWA for a total 41
encumbrance amount of $3,215,325. To date, the Agency Director has issued change orders 42
against the SWA bringing the contracted scope to $3,213,293. 43

On November 17, 2015, your Board authorized (Item #44, File C-900761, C-5185) GSA to issue 45
a $755,433 change order to SMC which increased the contract amount from $3,215,325 to 46
$3,970,758 with a $200,000 SWA for a total encumbrance amount of $4,170,758. To date, the 47

With the construction completion at 68%, Alameda County and the Judicial Council of 51
California requested SMC provide additional construction management and cost estimating 52
services to help resolve complex change orders including the Court’s Jury Assembly, Data Center 53
Redesign, and County Fire Marshall site work modifications. The additional services will 54
increase the contract amount by $420,208 from $4,170,758 to $4,590,966. The approval of an 55
additional $100,000 in SWA will yield a total encumbrance amount of $4,690,966. 56

The above complex change orders resulted in time extensions that require SMC’s consulting 58
services to extend into December 2017 in order to complete post-occupancy commissioning. 59

The GSA widely advertised for Program Management/Construction Management services on 63
February 1, 2010. There were 51 firms that attended the mandatory information/networking 64
conference on February 24, 2010, and nine firms submitted proposals by the March 17, 2010, 65
due date. Interviews were held on April 22, 2010, with the five short-listed firms. Evaluation 66
criteria included relevant experience, past performance on similar projects, the capacity to 67
perform the work, schedule, and approach to the required services. Swinerton Management & 68
Consulting (SMC) met the requirements in all categories and did especially well in their 69
organization and approach, the scope of services to be provided, hourly schedule and interview. 70

The GSA solicited a fee proposal from the top ranked firm. The fee proposal competitively 76
conformed to current market conditions, provides the services requested in the Request for 77
Proposal and is deemed appropriate. SMC is a local firm and is sub-consulting with three 78
certified Small, Local, and Emerging Business (SLEB) firms providing 24% SLEB participation. 79
Their percentage of participation as reported in Elation is 16.07% as of June 30, 2016. This 80
number is expected to increase as the project nears completion, and all sub-consultants complete 81
their participation in the project. SMC will be modifying one of their key subconsultants subject 82
to their pending SLEB application. If approved, SMC should exceed the 20% requirement. 83

As the East County Hall of Justice has progressed, several unanticipated issues have resulted in additional effort by the Swinerton team. These include the redesign of the Courts Data Center, work to mitigate impacts of the flawed steel columns, schedule extensions due to regulatory change and Courts program changes, and estimating services related to these changes.
Data Center
The ECHOJ project is experiencing an ongoing comprehensive and complex effort to redesign and construct the Courts Data Center. This effort includes delivering the Data Center as a design/bid/build project within the larger ECHOJ Design/Build project. As GSA knows, this has required a tremendous level of energy an effort from the project team.
Since last spring, Swinerton has been documenting this effort, primarily led by Stan Wong, who has become the project team's technical expert on the Data Center. Stan's ability to understand the design complexity of the Data Center, and work effectively with the Data Center A/E (CFS) has been a valuable asset to the Courts/County team.
The fee hours summarized below include a credit for the effort in our base scope of work that would have been expended for the original Data Center design included in the Bridging Documents. Included here are actual hours through March 2016, and projected hours to complete management of the Data Center on the Courts' behalf:

Schedule Extension
In addition to the Data Center, program revisions by the Courts, and regulatory changes following Hensel Phelps' (HP) contract award have resulted in time extensions to the ECHOJ schedule. In each case, HP has submitted substantial time requests. The Swinerton team (including our schedulers) has been able to negotiate significant decreases to these time extension requests, however some time has been granted for each. The extended schedule will require our team to be onsite longer than planned in order to be able to execute our contractual responsibilities.
Please note that our staffing during construction consists of a full-time Senior PM, Assistant PM, and Project Ad min, and Project Executive 2 days/week, which is a fee of approximately $60,000/month. The additional fee for the time extensions below is just over half this amount - approximately $34,000/month for the 5.5 month extension of Substantial Completion. This makes sense, as some of our base scope of work will simply be extended out further. The additional scope proposed is for additional tasks and inefficiencies due to the schedule extensions:

Last fall, Swinerton's Inspector of Record and Materials Testing & Inspection consultants discovered, during their inspection protocols, cracks in steel moment frame columns. Following a comprehensive inspection, material testing, laboratory analysis, and repair process, these columns were repaired utilizing a design by the Structural Engineer of Record. The flawed columns were very unusual, and required a significant unanticipated effort by Swinerton and our testing & inspection consultants. The complete cost below (including backup detail) has been issued to Hensel Phelps for 100% reimbursement:

Cost Estimating
Swinerton is providing cost estimating services through our SLEB consultant, Leland Saylor associates (LSA). LSA's work has been of great value to our change order negotiating efforts. For change orders executed to date, LSA's efforts have resulted in a reduction of over $750,000 from the original change order requests submitted by HP.
To date, there have been 78 change order requests (CE's) issued by HP for discretionary Owner changes to the project, totaling $5.1 million (62 items totaling $4.0M for the Courts, and 16 items totaling $1.lM for the County). It is unusual to have this magnitude of Owner change orders on a Design/Build project.
Consequently, LSA reached the limit of their contract in October, and will require additional work through the end of the ECHOJ project. Below is the breakdown of this additional effort, showing actual

The ~dditional services will increase the contract amount by $420,208 from $4,170,758 to $4,590,966. The approval of an additional $100,000 in SWA will yield a total encumbrance amount of $4,690,966.
The above complex change orders resulted in time extensions that require SMC's consulting services to extend into December 2017 in order to complete post-occupancy commissioning.
SELECTION CRITERIA/PROCESS:
The GSA widely advertised for Program Management/Construction Management services on February 1, 2010. There were 51 firms that attended the mandatory information/networking conference on February 24, 2010, and nine firms submitted proposals by the ·March 17, 2010, due date. Interviews were held on April 22, 2010, with the five short-listed firms. Evaluation criteria included relevant experience, past performance on similar projects, the capacity to perform the work, schedule, and approach to the required services. Swinerton Management & Consulting (SMC) met the requirements in all categories and did especially well in their organization and approach, the scope of services to be provided, hourly schedule and interview. Following are the evaluation results for the top three ranked firms:

The GSA solicited a fee proposal from the top ranked firm. The fee proposal competitively conformed to current market conditions, provides the services requested in the Request for
- Proposal and is deemed appropriate. SMC is a local firm an_d is sub-consulting with three certified Small, Local, and Emerging Business (SLEE) firms providing 24% SLEE participation. Their percentage of participation as reported in Elation is 16.07% as of June 30, 2016. This number is expected to increase as the project nears completion, and all sub-consultants complete their participation in the project. SMC will be modifying one of their key subconsultants subject to their pending SLEE application. If approved, SMC should exceed the 20% requirement.
