REAPPORTIONMENT/JUDGES: Provides relative the composition of the electionsections of the Second District of the Third Circuit Court of Appeal
1 AN ACT
2 To amend and reenact R.S. 13:312(3)(b)(ii), relative to the second district of the Third
3 Circuit Court of Appeal; to provide for the composition of the election sections for
4 the election of judges to the second district of the Third Circuit Court of Appeal; and
5 to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 13:312(3)(b)(ii) is hereby amended and reenacted to read as follows:
8 §312. Courts of appeal; circuits and districts
9 There shall be five court of appeal circuits, which shall be subdivided into
10 districts as follows:

14 (b) Districts of third circuit.

16 (ii) The parishes of Beauregard, Calcasieu, Cameron, Jefferson Davis, and
17 Vernon shall compose the second district of the third circuit. The second district
18 shall be further divided into two election sections.
19 (aa) Election section one shall consist of precincts 20, 21, 22, 30, 31, 31A,
20 81, 100, 101, 102, 103N, 104E, 105, 106, 107, 108, 109, 112E, 113, 123N, 124A &

25 Section 2. The judgeship designated on the effective date of this Act as division "C"
26 of the second district of the Third Circuit Court of Appeal shall be assigned to election
27 section one for election purposes and the judgeships designated on the effective date of this
28 Act as divisions "A" and "B" of the second district of the Third Circuit Court of Appeal shall
29 be assigned to election section two for election purposes.

1 Section 3.(A) The precincts referenced in this Act are those contained in the file
2 named "2018 Precinct Shapefiles" published on the Louisiana House of Representatives
3 website. The 2018 Precinct Shapefiles are based upon those Voting Districts (VTDs)
4 contained in the 2010 Census Redistricting TIGER/Line Shapefiles for the state of Louisiana
5 as those files have been modified by the staff of the Legislature of Louisiana to represent
6 precinct changes submitted through July 3, 2018, to the Legislature of Louisiana by parish
7 governing authorities pursuant to the provisions of R.S. 18:532 and 532.1.
8 (B) When a precinct referenced in this Act has been subdivided by action of
9 the parish governing authority on a nongeographic basis or subdivided by action of
10 the parish governing authority on a geographic basis in accordance with the
11 provisions of R.S. 18:532.1, the enumeration in this Act of the general precinct
12 designation shall include all nongeographic and all geographic subdivisions thereof,
13 however such subdivisions may be designated. The territorial limits of the election
14 sections as provided in this Act shall continue in effect without change regardless of
15 any changes made to the precincts by the parish governing authority.
16 Section 4. This Act shall become effective upon signature by the governor or, if not
17 signed by the governor, upon expiration of the time for bills to become law without signature
18 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
19 vetoed by the governor and subsequently approved by the legislature, this Act shall become
20 effective on the day following such approval.

Abstract: Changes the composition of the election sections for the election of judges to thesecond district of the Third Circuit Court of Appeal.
Present law provides that the parishes of Beauregard, Calcasieu, Cameron, Jefferson Davis,and Vernon compose the second district of the Third Circuit Court of Appeal. Divides thesecond district into two election sections and provides for the composition of those electionsections. Present law provides that the three judges of the second district shall be elected byelecting one judge from election section one and by electing two judges from electionsection two.

Proposed law changes the composition of election section one and election section two ofthe second district (see attached map and statistics); specifies that the judgeship designatedas division "C" shall be assigned to election section one for election purposes and thejudgeships designated as divisions "A" and "B" shall be assigned to election section two forelection purposes, and otherwise retains present law.
Proposed law specifies that precincts referenced in district descriptions in proposed law arethose contained in the file named "2018 Precinct Shapefiles" published on the La. House ofRepresentatives website. Specifies that the 2018 Precinct Shapefiles are based upon thoseVoting Districts (VTDs) contained in the 2010 Census Redistricting TIGER/Line Shapefilesfor the state of La. as those files have been modified by the staff of the legislature torepresent precinct changes submitted through July 3, 2018, to the legislature by parishgoverning authorities pursuant to the provisions of present law (R.S. 18:532 and 532.1).
Proposed law additionally provides that when a precinct is subdivided on a nongeographicor geographic basis under present law (R.S. 18:532.1), the general precinct designation inthe district description includes all nongeographic and geographic subdivisions of theprecinct, and specifies that the territorial limits of the election sections as provided inproposed law shall continue in effect without change regardless of any changes made to theprecincts by the parish governing authority.
Population data in the summaries accompanying this digest are derived from 2010 CensusRedistricting Data (Public Law 94-171), Summary File for Louisiana. Population data,statistical information, and maps are supplied for purposes of information and analysis andcomprise no part of proposed law.
