this project has been presented by me but there are many people who remained in veil, who
support and helped me to complete this project.
I am very thankful to my subject teacher Mrs. SOMA BHATTACHARYA without the kind of
whom and help the completion of my project was herculean task for me She donated her
valuable time from her busy time to help me to complete the project. I thanks to all of them who
help in my completion of project.
ABSTRACT
Evidentiary is something constituting evidence or having the quality of evidence and something
that relates to the evidence in a particular case. Section 172 of Cr.P.C states Dairy of
proceedings in investigation. Under the provision of Section 172 Cr.P.C. every Police Officer
conducting investigation shall maintain a record of investigation done on each day in a Case
Diary in the prescribed Form. Case Diaries are important record of investigation carried out by
an Investigating Officer. Any Court may send for the Case Diaries of a case under inquiry or
trial in such Court and may use such diaries, not as evidence in the case, but to aid it in such
inquiry or trial. The Case Diary, which is a record of day by day investigation of a case, shall
contain details of the time at which the information reached the Investigating Officer, time at
which the investigation began and was closed, the place or places visited by him and a statement
of the facts and circumstances ascertained through investigation.

OBJECTIVES/AIMS OF THE STUDY
There are two main objectives/aims of this project are:
To determine the evidentiary value of Case Diary/Daily Diary in the Court of Law.
To analyze the role of Case Diary/Daily Diary in the investigation.
SIGNIFICANCE & BENEFIT OF THE STUDY
This research study provides the information and concept of the Case Diary and related provision
to it. This study would be beneficial for determining the evidentiary value of Case Diary with
related provision and with the help of case laws, in the eye of law. Further this study would
beneficial for understanding the use and purpose behind the Case Diary.
SCOPE OF THE STUDY
In the proposed study, it includes the related provision of Criminal Procedure Code, 1973, which
explain the case diary according to the statutory provision and evidentiary value of case diary.
This project is concentrated on section 172 of Cr.P.C and some other provision of Indian
Evidence Act, 19872 and further it examine the evidentiary value of Case Diary with the help of
some case laws, in the Court of Law.
REVIEW OF LITERATURE
In the proposed study, study is focused on evidentiary value of Case Diary. Justice K.N Basha, in
Appreciation of Evidence discusses the evidentiary value of F.I.R and of Case Diary. In that he
discusses the sending of Case Diary by Criminal Court during proceeding. According to this
article a Case Diary may send by the Criminal Court for the purpose of refreshing mind of the
police officer if he is the witness and contradicting his statement by the Court but it cannot be
used by the accused or by his agent and Court cannot compel the police officer to do the same.
He does not appreciate the evidentiary value of the case diary and hence stated that case dairy
has no evidentiary value and supported it with some case laws.
RESARCH METHODOLOGY
This project is entirely based on the Chapterisation Methodology. This research study would be
consisting of Four Chapters.
Chapter I: first chapter is the Introduction to the topic.
Chapter II: second chapter is about the Object and Evidentiary Value of Case Diary.
