Annual Conference Friday, September 13
We are looking forward to a great educational and
networking opportunity at the Association’s annual confer-
ence. There are three tracks again this year: Legal, Medical
and Practice with a wide array of topics to choose from. The
keynote speakers Judge Jack St. Arnold, Senator Jack Lat-
vala and Dr. James Messina will provide not only infor-
mation but inspiration as well. Early registration discount
ends 8/31. So, if you haven’t already registered, you only
have a few days left before the price increases.
There is also an opportunity to promote your busi-
ness by becoming a table sponsor. The cost is $ 100 and in-
cludes lunch for the sponsor, recognition on the table center-
piece and in the conference book and association newsletter.
And you can take the centerpiece home. The fee does not
include conference registration however. See page 11 for a
glimpse of the centerpiece.

For the first time, the election of new board members will be held on-line via Survey Monkey. There will be a 2 day window of time to vote on-line. Dates for voting will be announced in the newsletter and members receive a notice via email. If you do not choose to vote on-line, you may attend the general meeting November 19 and vote in person. Installation of new board members will take place at the January 2014 general membership meeting
Officers The board elects the officers of the Asso-ciation; this has taken place at the Board Plan-ning Retreat that occurs in early January. The by-laws require that the offices of President, Vice President and Secretary be a guardian. The office of Treasurer may be a guardian or affiliate member.

Membership Dues Renewal date was 7/31. If you missed the deadline, you will have to pay your dues in order to register for the conference at the member rate. Procedure
Interested persons must submit a resume and Letter of Intent stating their desire to run for the Board of Directors. To qualify, an individual must be a member in good standing for one year. Qualifying documents should be emailed to Sher-ry Dunn and must be received by September 20 in order to be considered. A list of potential candidates along with a short bio will be published in the October newsletter and on the website. Candidates will be given 3 minutes to introduce themselves & their platform at the October 15 general meeting

Are You A Successor Guardian And Having Conflicts With The Ward’s Family? Recently, the family of a ward filed allegations against the successor professional guardian (guardian).
The guardian visited the ward, who resided in the son’s home; the guardian took the ward out to lunch, and did not bring the ward back.
The guardian notified the ward’s son, the ward was relocated to an assisted living facility.
The guardian would not provide the location of the ward’s new residence to the son or the family. As you can imagine the family became upset! The guardian would not return telephone calls or provide updates on the ward; this went on for a few weeks. The ward’s family notified Division of Inspector General (IG) Guardianship Fraud Hotline, who notified the Court immediately. A hearing was scheduled and the family received access to the ward. Most common complaints received by IG is from family members of the wards, claim guardi-ans:
Will not return telephone calls or emails timely.
Will not keep families informed of a change in medical condition of the ward,
Will relocate the ward to another facility or admit them to a hospital without informing the family.
Do not allow the families to telephone the ward or severely regulate their (wards & family) tele phone calls.
Relocate wards for the convenience of the guardian with no consideration for ward needs. To avoid complaints maintain a positive line of communication with the ward’s family, notify them immediately when there is a change in medical condition, or if the ward is relocated or transferred to another location.

When is Guardianship Appropriate? Michael W. Porter, Esq.

Elder Law Attorney Mike Porter used a fictional scenario—a client hires an attorney to draft Estate Plan-
ning Documents (durable Power of Attorney, Healthcare Surrogate Designation, Living Will, Will)—to illustrate
the ramifications and complications that figure into the situation while attempting to resolve issues that ensue
when the client health situation declines.
Mike discussed what can happen when the real life outcome is a far cry from the intended outcome that the
previously drafted legal documents were supposed to take care of.
Mike also explained the types of existing guardianships, including VA Guardianship, Voluntary Guardian-
ship, Limited Guardianship, Plenary Guardianship and Emergency Temporary Guardianship.
Since all of us guardians basically use the
same hardware which I wrote about last month, I
decided this month I should talk about “software”
or in Wikipedia terms, any set of machine-readable
instructions (most often in the form of a computer
program) that directs a computer's processor to
perform specific operations. Hardware and soft-
ware require each other and neither has any value
without the other.
I’m speaking about the same kinds of soft-
ware such as word processing software in the ge-
neric sense or more specifically programs
like Word or Wordperfect or some other
kind of program that permits creat-
ing/editing/printing documents on
your printer. I’m also speaking about pro-
grams like Excel that allow you to manage
your time-logs, a list of tasks for each
guardianship case you maintain.
I’m more than happy to share the Excel-
based worksheet that has built in features that
offer a dropdown list of activities such as Banking/
Financial and other activities when selected auto-
matically that populate the column referred to as
the “safeguard” code. The sheet can also automati-
cally calculate the hours and minutes of any given
activity based upon the start time and end time en-
tered. There is also a button that can clear all data
entries (very dangerous if you are not paying atten-
tion). There is also a button that will automatically
enter the date (current date) in the column marked
date.
A neat feature, at least in Windows soft-
ware and in most software (except our forms soft-
ware) is a feature called “Cut and Paste”. Let’s say
that you are entering transactional data in the
schedule called B-4 (expenses) and you need to enter
the name of the facility over and over again. By
holding down your left mouse button and dragging it
over the facility name you will notice that the data
becomes highlighted in blue. At the beginning of the
Payee description hold down the CTRL key and press
the “C” key on your keyboard. This causes Windows
to copy the string of characters you just highlighted to
an area in the computer memory called the Clip-
board. The next time you need to type the name of
the facility simply place your mouse pointer (it will
look like a flashing “I” bar at the beginning of the
Payee column, then press and hold the CTRL
button and press the “V” key.
Voila! Instant data entry on your PC!
Other software you may use is Outlook
2010. Outlook is a full-featured program
that offers a Calendar, Notes, Task or
to-do lists and of course that all im-
portant contact list. One of the neat
features in Outlook offers the ability
to have certain calendar entries repeat
themselves each month. Something like the monthly
meeting of the Guardian Association is plugged into
every month in my calendar which synchronizes with
my Windows Smart Phone.
And, of course there are a multitude of pro-
grams that do a variety of tasks depending on your
needs. I’ve used Publisher to create business cards,
flyers and other printed material with the click of a
mouse. I’ve used WebEasy to create my own web-
site.
