Weight misdeclarers beware!Workable solution in the pipeline to check container weights By Alan Peat

A call to ‘name and shame’ those who misdeclare container weights has drawn mixed response from the industry.

It’s an idea mooted in the UK freight trade press calling for box lines and port operators to publicly name the excessive overweight offenders – with the expectation that this will cure the problem.

The freight industry is utterly dependent on the honesty of the shippers – and their associated container packers/operators/forwarders. The weights declared by shippers on the shipping instruction (SI) and the bill of lading (BoL) are the only indications of just how much a container should weigh.

But that’s not a very certain document. As a recent report by the UK’s Marine Accident Investigation Branch (MAIB)

said: “Only in container shipping is the weight of the cargo unknown.

“This because many shippers either don’t have the facilities to weigh containers before shipment, or because they’re discouraged from doing so by factors such as import taxes, loading restrictions, and rail and road weight restrictions.”

So they leave lots of room for errors – either deliberate, or more likely miscalculation error.

But this “unknown” quantity has not always been the case in SA.

A shipping line executive pointed out to FTW that there used to be weighbridges at each of the ports around the coast, intended to weigh all the trucks and container loads before they entered the terminals.

Indeed, about seven years ago, the grand new weighbridge facility intended

for the Durban container terminal (DCT) on the Bayhead Road access was big news in FTW. But that, along with all the other port weighbridges, has – like many of the other great government ideas – just faded into oblivion.

But it’s not an idea that has faded out of the minds of those in the shipping line and trucking industries who are the ultimate victims of misdeclaration of container weights.

Alex de Bruyn, Safmarine SA trades executive, told FTW that he saw the weighbridge idea as one of the possible solutions.

He suggested introducing measures in ports – similar to those in North America – which allow shipping lines to identify overweight containers before they go into the stack.

Increase in Customs Duty on PigmentsA notice has been published in respect of (i) the proposed increase in the rate of customs duty on pigments and preparations based on chrome oxide green, lead chromate, zinc chromate, barium chromate or strontium chromate, inorganic pigments, classifiable under tariff subheading 3206.20.10 from free of customs duty to 10% ad valorem; and (ii) possible re-instatement of rebate items 306.04/3206.20 /01.06 and 311.01/32.06/01.00, which existed prior to the reduction of tariff subheading 3206.20.10.

Comment is due by 26 March 2010.

Trade Deficit for January 2010On 26 February the South African Revenue

Service (Sars) released the South African trade figures (import and export statistics) for January 2010.

A R3.3 billion trade deficit was recorded in comparison to the R17.7 billion for January 2009. This was the lowest trade deficit for January compared to the 2008 and 2007 figures.

The main reason for the trade deficit is the decline in exports and an increase in imports of mineral products, imports and machinery and electronic equipment.

Income Tax – Meals and Incidental CostsThe South African Revenue Service (Sars) has given notice of the Determination of the Daily Amount in respect of Meals and Incidental Costs for purposes of Section 8(1) of the Income Tax Act,

1962 (Act No.58 of 1962.The commencement date

NAMC Registration Directly Affected Group The National Agricultural Marketing Council (NAMC) has extended an “Invitation to Register as a Directly Affected Group in terms of the Marketing of Agricultural Product Act”.

The NAMC is updating its “Register of Directly Affected Groups” for each commodity in the agricultural sector.

A “directly affected group” means any group of people party to the production, sale, purchase, processing or consumption of an agricultural product and includes labour employed in the production or processing of such a product.

Safmarine has taken a desision to relocate the Technical Vessel Operations’ management of 20 Safmarine vessels to the Maersk Line Vessel Management TVO organisation in Singapore.

This will result in a reduction of 20 positions in Cape Town.

“The decision will allow Safmarine to gain

leverage from the specialist functions and services made available by the AP Moller-Maersk Group. In addition, it will be able to take advantage of the opportunities of scale and savings offered by these,” a spokesman told FTW.

“Safmarine will, where possible, seek alternative opportunities for the shore-based Safmarine technical

organisation employees within the AP Moller-Maersk Group, either on shore or at sea,” the spokesman said.

Plans for the delivery of four new multi-purpose vessels (MPVs), two in 2010 and two in 2011, and three WafMax container vessels (in 2012) to Safmarine remain unchanged.

The Department of Maritime Studies (DMS) at the Durban University of Technology (DUT) is upping its game through extensive development of its curriculum this year.

Currently the only higher education department in the country to offer an

undergraduate qualification aimed at the maritime transport sector, the DMS is expected to launch a new Diploma in Shipping Management in January 2011.

According to a spokesman for the DMS, the structure of the new programme will differ from the existing one.

“Presently the Diploma in Maritime Studies (shore-based) is a generic one suitable for persons who wish to gain knowledge and skills needed in the world of shipping and allied industries. The new course will allow for a more integrated learning environment.”

The cessation of MBG Shipping’s new South Africa/Europe/West Africa reefer service has come as no surprise to the Western Cape fruit export sector.

This after the on-off voyage of the single charter vessel, Alioth, from Cape Town on January 20.

A British maritime report on February 22 not only confirmed FTW’s original information, that the vessel had sailed on December 20 with only one full container and 25 empties, but suggested the vessel had been returned to her German owner.

While the fruit industry was prepared to back a new service, it wanted proof of sustainability.

This did not materialise, and despite assurances, founder and MD Ian Wicks was not able to source the necessary equipment – 350

FEUs required a week to ensure a fully laden vessel, hence several delays in the first weekly sailing.

Deon Joubert, GM operations for Capespan exports, says “any exporter worth his salt” would have welcomed “another platform” (as did Capespan), but four reasons essentially mitigated against support for the fledgling line.

“Firstly, the contract proffered by MBG Shipping held us as contractors responsible to pay (MBG) regardless of how the service performed.”

Capespan was also seeking an assurance that six-odd ships would be engaged to provide a string for a competitive weekly service. But MBG was unable to satisfy on this count, nor could Capespan find any evidence the line had sufficient containers to run the service.

However, the biggest

problem for Joubert was that while he personally has no objection to a “flat rate structure”, that offered by MBG was uncompetitive overall compared with the other lines.

A final concern was no guarantee that someone might not try to attach/arrest Alioth’s bunkers or the vessel itself to recoup monies owing creditors from previous Wicks ventures, such as SA Independent Liner Service (Sails), liquidated in December 2008.

“We exporters all agreed we would like to have another service to allow for more flexibility and security but if you (as a line) want to be part of a contract, you have to be a part of my life every Friday and if so, we will give you the support.”

Capespan remains South Africa’s biggest exporter with around 20% of overall volumes to Europe/

Northwest Continent and the UK, shipping some 13 500 FEUs a year.

Six lines are contracted to Capespan, Maersk Line and MSC each holding about 20% of volumes, Safmarine about 16.3%, MOL 15% ad DAL and Seatrade 10% each, equating to an overall 45 000 conventional pallets a year.

Joubert said had Capespan decided to support MBG Shipping, it would have supplied the line with roughly 25 to 30 FEUs a week and a 1 000-container contract to start with.• Wicks chose not to respond to questions by FTW, uppermost whether this means the end of the line.

Carl van der Westhuizen, fruit trader, long-time friend and former partner of Ian Wicks in the new MBG Shipping Line, has spoken up for the first time about his reasons for quitting. Uppermost was the fact that he had been assured all along that necessary equipment would be in place come the new reefer service launch.

Clearly upset at the apparent termination of the service after only one sailing and problems experienced with existing service providers, he told FTW: “I am not at all well because the way those big guys (the major container shipping lines) jerk us exporters around is a national disgrace.

“With containers booked for all over the world, they just arbitrarily decide they are not coming in (to port) so they do what they like,

because they can.“I am absolutely flabbergasted

He says he was essentially brought on board due to long experience in the fruit industry, still involved in export trade to destinations other than South Africa/Europe/UK – but his December departure from MBG was also triggered by not being privy to day-to-day company goings-on, despite his director status.

Even though he retains no links at all with MBG Shipping, Van der Westhuizen says he received an e-mail from Wicks on February 18 to the effect he (Wicks) was working in conjunction with agents in Europe to salvage the service and hoped to reach finality within a week or so. No further word was received from Wicks.

As we know, the Commissioner for SA Revenue Service requires security to be furnished prior to registration or licensing of certain business activities with the Department of Customs and Excise.

This security must be in the form of a surety bond or a provisional payment when this option is allowed. Sars only accepts surety bonds issued by a South African-registered bank or an insurer registered with the Financial Services Board for the purpose of

issuing guarantees.A change in circumstances

may require a bond to be cancelled. A notice of cancellation by the client or a notice of withdrawal by the financial institution must provide the following information:• the name of the principal;• the type of activity secured;• the bond number; and• the office where the bond is valid.

The surety bonds issued by financial institutions usually

do not reflect the type of security or the office where the bond is valid. It is therefore the responsibility of the principal to ensure that a copy of the confirmation letter issued by Customs is attached to the relevant surety bond. This letter acknowledging that the bond has been registered with Customs should reflect the information mentioned above.

These documents must furthermore be stored in a safe place, separate from documents that are usually

destroyed after five years (the statutory time period for which documents need to be kept according to the Customs and Excise Act).

Failure to do so may result in the documents being lost or destroyed. This would complicate a relatively simple cancellation process and one may even have to seek relief from the courts to have the bond/s cancelled.

Does your company have surety bonds in place which are no longer needed? Are

you aware of the fees that your financial institution is charging on these "obsolete" bonds? Does your company have a system in place that provides for the easy tracking of existing bonds, even though these bonds may be 10 or 20 years old? Does your company conscientiously notify Sars if there is a change in the name or legal identity of your company, including details of mergers or takeovers? These are all issues that we recommend you address.

South Africa will need some 170 new aircraft over the next 20 years to satisfy its demand for air travel, according to the latest Airbus Global Market Forecast.

The country, which has experienced 27% growth in air traffic over the past ten years, will need both passenger and freighter capacity to help ease congestion and to accommodate growth on

existing and new developing routes.

According to Andrew Gordon, Airbus director market analysis, the cost of these aircraft is estimated in the region of US$23.3 billion.

“Airbus anticipates that

the South African region will average annual passenger and freight growth rates over the next 20 years,” said Gordon.

He said following the drop in traffic during 2009 due to the global recession the aviation industry was

in full recovery with world freight traffic up by 22% in December alone. “This is a very optimistic figure if one takes into account that in March 2009 the world freight traffic had dropped by more than 25%.”

Makutu skips CT to avoid 300-hour delay

Whatever happened to Safmarine Makutu? One moment she was off Cape Town, the next she had disappeared from sight and from updated container terminal records – but all finally became clear at week’s end.

She bypassed Cape Town rather than incur delays in excess of 300 hours.

Terminal data for February 24 confirmed her arrival five days previously and a plan to berth her on March 3, by which time her total delay (including 38 hours of wind

stoppage) would have been 305.48 hours.

New container terminal executive Moshe Motlohi explained it was planned to work the non-CTOC vessel on a first come first serve basis at Berth 603, once preference had been accorded CTOC vessels.

Provisional stack dates were planned for February 17-19 but the ship’s operators requested the stack be firmed later and stack dates provisionally were scheduled according to the 72-hour window period.

“Due to wind delays and CTOC vessels arriving within their slot times,

the stack was firmed for between February 22-24 for her to begin working on February 25 at 22h00, with a total of 393 import and 381 export containers to handle.”

On February 23, the vessel’s operators informed TPT’s national planning and IT offices Safmarine Makutu would bypass Cape Town and her cargo was rolled over to the Maersk Dellys.

Latest information from Cape Town Container Terminal is that the terminal was windbound for 9 hours and ten minutes between February 27/28,

holding up work on Empress Haven (Berth 601) and Willi Rickmers (Quay 501).

MSC Carla was most severely affected, 182 hours in all, of which 49.6 hours was weather-related.

port terminals,” he added, “and doing ‘spot checking’ of containers as they arrive at the port.”

He also saw it as a means of providing adequate deterrents. “It would allow us to apply surcharges or penalties relevant to the weight variance, and/or to refuse to transport the overloaded container until corrective action was taken.

“And this physical check would make those who are – intentionally or unintentionally – overloading containers more aware of the dangers and consequences of their actions.”

Kevin Martin, MD of container trucking concern Freightliner and vice-chairman of the Durban harbour carriers’ section of the SA Association of Freight Forwarders (Saaff), was another who supported the need for weighbridges if misdeclaration of container weights was to be beaten.

“The shipping lines have in the past threatened to raise extra fees when cases have been discovered,” he told FTW. “Unfortunately, this is at present rather a toothless threat as suspecting is one thing – but only an assize weighbridge ‘ticket’ is definitive proof.”

However, Martin sees a way to use the modern equipment now being used in the SA container terminals to help turn suspicion into proof.

The present modern stacking machines at the terminals do have “weighing heads” that give an indication of mass – although it’s not a legal proof.

The way that this would work is that, on entry into the terminal of the container, the declared mass by the loading point is entered in the terminal system.

“When the stacking machine lifts the container off of the road/rail vehicle, a comparison should be made between this ‘declared mass’ and that ‘weighing head mass – with a margin of error for both under- and over-mass.

“And, if this is found to be outside of the parameters, the container is staged for later movement to an assize weighbridge – situated inside the terminal, run by SA Revenue Service (Sars).”

Then – once the correct legal mass has been ascertained, a charge would be raised by Transnet on the shipping line. The line, in turn, would bill the client – the guilty party – along with any subsequent costs that might have arisen.

“This,” said Martin, “would then satisfy both Transnet’s need for compensation for assuming this responsibility, and the

shipping line’s need for reimbursement.”

And the port authorities are anything but rejecting the idea.

TPT is currently working on a plan to be able to introduce this vital cross-check of actual container mass against declared mass.

Spokesperson Lunga Ngcobo said that the port’s electronics fundis were currently very busy tweaking all the appropriate connections to switch the port’s previous Cosmos computer system over to the new state-of-the-art Navis system.

Also, she added, this cross-check of declared container mass and actual container mass is still very much part of the engineers’ work on the new system.

And Transnet is not doing it for the good of its soul. The spin-off is for Sars, in that it will assist them in their targeting and help to prevent customs fraud – especially where shippers deliberately under-declare the mass of containers so that they are eligible for rebates.

Contractor dies in barge demolition operationBy Ray Smuts

An intricate maritime operation to obliterate Margaret, the wrecked barge, from the Cape West coastline forever suffered a tragic set-back last week when a contractor was tragically killed.

John Charles Mitchell (55) of Durban and attached to Blasting and Demolition Services, apparently fell and suffered a fatal neck injury.

The South African Maritime Safety Authority (Samsa) has initiated an enquiry into the tragedy, temporarily suspending the operation until further notice last week.

Margaret, fresh from the Chinese shipyards, was on her maiden voyage to her future home port of Rotterdam via Durban when she ran aground in savage

weather at Jacobsbaai on June 24, last year.

One of two barges under tow by the tug, Salvaliant, she had broken free with her cargo of 12 river barges and two floating docks, ending her short seagoing life ignominiously – on the rocks.

In January of this year, after Margaret’s Dutch owner Leo Boer had spent an estimated R21 million trying to salvage the precious wreck and finally given up, Samsa mobilised SMIT Amandla Marine to topple the wreck in a “systematic manner by means of implosion”.

Samsa tells FTW costs of what will clearly be a costly exercise will have to be borne by the South African taxpayer. A plan is however in place to defer some costs by selling the scrap – five smaller, undamaged, barges.
