II. J U R I S D I C T I O N A N D V E N U E

4. Th i s Cour t has jur isdic t ion ove r this matter pursuant to 28 U.S .C. § 1331. In addit ion, this

Cour t has ju r i sd ic t ion pursuant to 28 U.S .C. § 1332. Plaint i f f and Defendan t s are res idents

o f d i f fe rent states and the amoun t in controversy is in excess of $75 ,000 .00 .

5. De fendan t s il legally intercepted EchoS ta r ' s b roadcas ted satel l i te s ignal for its o w n personal

f inancial gain.

6. V e n u e is p roper under 2 8 U.S .C. §§ 1391(b). A substantial part of the ac ts and omiss ions

g iv ing rise to EchoS ta r ' s c l a ims occurred in and caused d a m a g e s to EchoS ta r in Colorado.

7. Three M e d i a c o m employees , inc luding Med iacom Ch ie fTechn ic i an John Duran , entered into

th ree separa te EchoSta r Satel l i te , L.L.C., Resident ial C u s t o m e r A g r e e m e n t s in order to

subscr ibe to the D I S H Network , obtain D I S H Ne twork p r o g r a m m i n g and retransmit the

p r o g r a m m i n g to its cus tomers .

8. Each mon th , these M e d i a c o m employees wou ld remi t checks to D I S H Ne twork for their

mul t ip le subscr ip t ions . T h e checks that D I S H Ne twork keeps in the o rd inary course of

bus iness in Denver , Co lo rado were issued on " M E D I A C O M C O M M U N I C A T I O N S

C O R P O R A T I O N " pre-pr inted checks .

III. F A C T S

9. EchoSta r Satel l i te L L C , is involved in the D i r ec t -To-Home satellite te levis ion D B S (Direct

Broadcast Satel l i te) bus iness . A s part of that bus iness , EchoSta r uses h igh-powered satellites

to broadcast " p a c k a g e d " television p rogramming to c o n s u m e r s w h o have purchased o r leased

the necessary equ ipment ( typical ly the an tenna and rece iver ) and the necessary authorizat ion

(the television subscr ip t ion) to view the p r o g r a m m i n g . EchoSta r opera tes its D B S service

under the trade n a m e "Di sh N e t w o r k . "

8. Med iacom C o m m u n i c a t i o n s Corpora t ion and M C C G e o r g i a , L L C d/b/a / Med iacom

( " M e d i a c o m " ) own , opera te and deve lop cable te levis ion sys t ems serving rural communi t i e s .

M e d i a c o m is the na t ions e ighth largest cable te levis ion c o m p a n y , and the leading cable

opera tor focused on serving smal le r ci t ies and towns in the Uni ted States. Currently,

M e d i a c o m prov ides serv ices to m o r e than 1.5 mill ion subscr ibers in 23 states.

9. M e d i a c o m is a cab le opera tor within the mean ing of 47 U .S .C . § 522, as it p rov ides cable

serv ices over a cab le sys tem and directly o r through one or m o r e a f f i l ia tes o w n s a s ignif icant

interest in such cab le sys tem or o the rwise con t ro l s or is respons ib le for, through any

ar rangement , the m a n a g e m e n t and opera t ion of such a cable sys tem. Cab le services m e a n s

the o n e - w a y t ransmiss ion to subscr ibers o f (i) v ideo p rog ramming , o r (ii) o ther p r o g r a m m i n g

service, and subscr iber interact ion, if any, wh ich is required fo r the se lect ion or use of such

v ideo p r o g r a m m i n g o r o ther p r o g r a m m i n g service.

10. M e d i a c o m opera tes in n u m e r o u s c i t ies , inc lud ing Georg ia ci t ies such as Bainbr idge and

Albany.

11. EchoStar has n u m e r o u s p r o g r a m m i n g packages avai lable to c o n s u m e r s such as A m e r i c a ' s

T o p 60 and A m e r i c a ' s T o p 160. EchoSta r broadcas ts en te r ta inment p r o g r a m m i n g such as

C N N , E S P N , and M T V on its p r o g r a m m i n g packages .

12. EchoSta r a l so broadcas ts the s igna l s of local n e t w o r k af f i l ia tes for va r ious ci t ies and

c o m m u n i t i e s th roughout Amer ica , such as A B C , CBS , N B C , and F O X .

13. EchoSta r enters into Ret ransmiss ion Agreemen t s wi th the local ne twork af f i l ia tes to provide

A B C , C B S , N B C , and F O X to subscr ibers residing in the appropr ia te geograph ic location.

14. EchoSta r recently d iscovered that a cable c o m p a n y in Georg ia w a s in tercept ing

p r o g r a m m i n g provided by EchoSta r to residential accounts and rebroadcas t ing it through

its cable sys tem to its cable cus tomers .

15. EchoSta r recently d iscovered that there are several satel l i te d i shes m o u n t e d next to one of

M e d i a c o m ' s t ransmi t t ing towers .

16. Based upon E c h o S t a r ' s invest igat ion, EchoSta r conc luded that, upon in fo rmat ion and belief ,

M e d i a c o m is us ing D I S H Ne twork equ ipmen t ac t ivated unde r three residential accounts

registered to Michael Cou tu , account # 9 0 9 1 1 1 8 5 9 0 5 1 ; J o h n n y Duran , account

Bainbr idge locat ion, and has been dis t r ibut ing those s ignals , through its cab le system, to its

cus tomers .

17. Gary Palka of E c h o S t a r ' s Signal Integrity divis ion in, Eng lewood , Co lo rado , conducted an

invest igat ion o f M e d i a c o m . Mr. P a l k a ' s responsibi l i ty was to v iew the televis ion screens

o f two individual and separa te M e d i a c o m cus tomers , in Ba inbr idge , Georgia , that we re

rece iv ing DISH N e t w o r k ' s p r o g r a m m i n g via a M e d i a c o m subscr ip t ion .

18. Invest igator Palka then coordinated with DISH N e t w o r k ' s up l ink facil i ty to interrupt the

dis t r ibut ion o f p r o g r a m m i n g to DISH Ne twork satel l i te rece ivers in the Ba inbr idge area. The

uplink facil i ty is the broadcast dis t r ibut ion point fo r DISH N e t w o r k p r o g r a m m i n g .

19. The upl ink facil i ty a long wi th invest igator Palka created a pre-selected test pattern that

wou ld b e shown br ie f ly on all area DISH Ne twork satellite receivers dur ing the commerc ia l

breaks o f regular scheduled p r o g r a m m i n g on D I S H Ne twork channel W S B / A B C .

20. T h e pre-selected test pat tern consis ted o f a set o f mul t ip le colored vert ical bars with a s ingle ,

black hor izontal banner ac ross the screen. Wi th in the b lack banne r w a s a pre-de termined

message for each interruption o f the DISH N e t w o r k signal .

21. W h i l e the D I S H Ne twork signal was interrupted wi th a pre-selected test pat tern, Invest igator

Pa lka was ab le to v ideo tape the pat terns appear ing on the te levis ion sets o f two individual

and separa te M e d i a c o m subscr ibers w h o did not have D I S H N e t w o r k satellite receivers.

22. Invest igator Pa lka a l so captured M e d i a c o m ' s p r o g r a m m i n g gu ide on channel 21, including

the local wea ther for Ba inbr idge , Georgia , M e d i a c o m ' s logo, the da te and t ime o f recording,

and the channel listings fo r W S B / A B C , M e d i a c o m channel 6 .

23. M e d i a c o m advert ises , via the Internet, its car r iage o f local channe l s on the Ba inbr idge

Deca tu r C h a m b e r o f C o m m e r c e websi te .

24. EchoSta r does not have a contractual re la t ionship with M e d i a c o m conce rn ing re t ransmiss ion

o r p r o g r a m m i n g rights. M e d i a c o m never obta ined E c h o S t a r ' s consen t to rebroadcast the

At lanta local aff i l ia te channe l s to its cus tomers . M e d i a c o m neve r in fo rmed EchoS ta r that

it was go ing to rebroadcast At lanta local aff i l ia te p r o g r a m m i n g to its cus tomers .

25. EchoSta r has suf fe red d a m a g e felt in the state o f Co lo rado because Defendan t s obta ined

subscr ip t ions to DISH Ne twork p rogramming , ext rac ted local channel W S B / A B C and

rebroadcas t E c h o S t a r ' s signal in a manner that was not au thor ized by EchoSta r as well as

breached all three Resident ia l C u s t o m e r Agreemen t s wi th EchoSta r .

IV. C A U S E S O F A C T I O N

F I R S T C A U S E O F A C T I O N

(Violat ion of 47 U.S.C. § 605)

26. P la in t i f f he reby incorpora tes the above al legat ions as if ful ly set forth in this Coun t I of the

First A m e n d e d Compla in t .

27. T h e Federal C o m m u n i c a t i o n s Act o f 1934, as amended , 47 U .S .C . § 6 0 5 (the "Statute") ,

p rovides in part:

N o person not be ing author ized b y the sender shall intercept any radio

c o m m u n i c a t i o n by rad io and use such c o m m u n i c a t i o n (or any

in fo rmat ion therein con ta ined ) fo r h is own benef i t o r fo r benef i t o f

ano ther not enti t led thereto. N o person h a v i n g received any

intercepted radio commun ica t i on or hav ing b e c o m e acquain ted with

the contents , substances , purpor t , e f fec t , o r m e a n i n g o f such

c o m m u n i c a t i o n (or any part thereof ) k n o w i n g that such

c o m m u n i c a t i o n was in tercepted, shall d ivulge o r publ i sh the

ex i s tence , contents , substance, purpor t , e f fec t , or m e a n i n g o f such

c o m m u n i c a t i o n (or a n y part thereof ) or use such commun ica t i on (or

a n y informat ion therein conta ined) for h is own bene f i t o r for the

benef i t o f ano ther not enti t led thereto.

28. De fendan t s ' w r o n g f u l ac t ions in connec t ion w i t h rebroadcas t ing the D I S H N e t w o r k local

p r o g r a m m i n g signal to M e d i a c o m ' s cus tomers were in viola t ion of the Statute.

29. E c h o S t a r ' s encrypted p r o g r a m m i n g that is b roadcas t na t ionwide via satel l i te const i tu tes

interstate commun ica t i on b y radio under federal law.

30. Under sec t ions 605(d) (6) and 605(e ) (3 ) (A) "any person wi th propr ie tary r ights in the

intercepted c o m m u n i c a t i o n " m a y br ing a pr ivate cause o f act ion against o n e w h o acts in

v iola t ion o f the Statute.

31. A s a direct and p rox ima te result of De fendan t s ' acts, EchoS ta r has lost revenue which would

have been der ived f rom the del ivery and exhibi t ion o f the D I S H N e t w o r k signal, caus ing

substantial and irreparable harm, including, but not l imited to, a loss o f revenue and profi ts ,

d a m a g e to its goodwil l and reputat ion, potent ial liability o f EchoSta r b reaching its cont rac ts

wi th p r o g r a m m e r s ; loss o f its substantial inves tment of f inancia l resources , t ime and effort

in the p romot ion of the signal and loss o f its right and abili ty to control and rece ive fees for

the recept ion o f the s ignal ; all o f wh ich injuries a re felt in the state o f Colorado .

32. Because o f De fendan t s ' wrongfu l act ions , EchoStar is enti t led to col lect f rom all Defendants :

(1) s ta tu tory d a m a g e s in the amoun t o f Ten Thousand Dol lars (510 ,000) per violation,

pursuant to § 605(e)(3)(C)( i ) ( I I ) ; (2) s tatutory d a m a g e s in the amoun t of O n e Hundred

Thousand Dol lars ($100 ,000 .00) per violat ion, pursuant to § 605(e)(3)(C)( i i ) ; and (3) full

costs , inc luding reasonable a t to rney ' s fees, pursuant to § 605(e)(3)(B)( i i i ) .

33. De fendan t s ' v io la t ions o f 47 U.S .C. § 6 0 5 w e r e commi t t ed wi l l fu l ly and for purposes o f

commerc i a l advan tage and private f inancial gain.

S E C O N D C A U S E O F A C T I O N (Violat ion of T h e Digital M i l l e n n i u m Copyr ight Act, 17 U.S .C. § 1201(a)(1))

35. Each instance o f D e f e n d a n t s ' w r o n g f u l conduct , set for th a b o v e , cons t i tu tes a violat ion o f

the Digital Mi l l enn ium Copyr ight Act, 17 U .S .C . § 1201(a)(1) because Defendan t s have

c i rcumvented EchoS ta r ' s technological measures that e f fec t ive ly control access to the DISH

36. De fendan t s knew or should have k n o w n that the c i rcumvent ion o f E c h o S t a r ' s technological

measu re s that e f fec t ive ly control access to the D I S H Network satellite television subscript ion

p r o g r a m m i n g services and the copyrighted works that it broadcasts , was and is illegal, and

is prohib i ted .

37. Pursuant to 17 U.S .C. § 1203, EchoSta r is enti t led to equ i t ab l e rel ief , d a m a g e s (either

s ta tutory d a m a g e s of $200 to $2 ,500 pe r violat ion, or actual d a m a g e s p lus any prof i ts

real ized by M e d i a c o m as a result o f this un lawfu l conduct ) , and reasonable a t torneys ' fees

and costs .

40. Th i s representat ion is literally false because , upon informat ion and bel ief , M e d i a c o m is

unable to o f f e r re t ransmiss ion o f local channe l W S B / A B C to its cus tomers in the

Bainbr idge , Georg ia v iewing area. However , D I S H Ne twork does main ta in the r ights to

re t ransmit local channe l s t o D I S H Ne twork cus tomers in the Bainbr idge , Georgia v iewing

area.

41. M e d i a c o m ' s fa l se and mis lead ing representa t ions are l ikely to cause confus ion or mis take

as to the actual qual i t ies or services o f f e red by M e d i a c o m ' s cable service and D I S H Ne twork .

42 . C o n s u m e r s may bel ieve that Med iacom o f f e r s local channe ls to its cus tomers in the s a m e

fashion that D I S H N e t w o r k of fe rs local channe ls to subscr ibers .

43 . M e d i a c o m ' s decept ive representa t ions regard ing its o w n p r o g r a m m i n g m a y cause confus ion

regard ing the va lue and var ie ty o f p r o g r a m m i n g of fe red b y DISH Ne twork .

F O U R T H C A U S E O F A C T I O N (Reques t for T e m p o r a r y Restraining O r d e r and Pre l iminary Injunct ion)

44. P la in t i f f he reby incorpora tes the above a l legat ions as if ful ly set for th in this Coun t VI of the

45 . Absen t in junc t ive rel ief , EchoSta r has no adequa te legal r emedy because the ha rm caused b y

Med iacom is d i f f icul t , if not imposs ible , to ascertain.

46. The subscr ipt ion te levis ion industry is p remised upon e m e r g i n g technology , and therefore ,

volat i le and ex t remely compet i t ive . An establ ished subscr iber base is not only valuable but

critical to the ex is tence o f a satellite o r cable provider .

47. None the les s , because the marke t is cons tant ly changing , any a t tempt to calculate moneta ry

d a m a g e s resul t ing f rom a loss of subscr ibers o r marke t share w o u l d be d i f f i cu l t , if not

imposs ib le . For th is reason, the harm that EchoStar is cont inu ing to incur (e.g., the loss of

current and potent ia l subscr ibers) , caused b y M e d i a c o m ' s mis representa t ions , const i tu tes

i rreparable harm.

Further , E c h o S t a r ' s loss o f marke t ing and sales potent ial in the subscr ip t ion television

indust ry ampl i f i e s the extent o f this harm. Moreover , M e d i a c o m ' s misrepresenta t ions expose

EchoSta r to potent ial liability for b reach o f its o w n contracts wi th p rogrammers .

T h e ba lance o f ha rms is in E c h o S t a r ' s favor as it is los ing potent ial and current subscr ibers

based upon the ac t ions o f Med iacom. Whereas , an in junct ion wi l l not prohibi t Med iacom

from accura te ly p romot ing its p roducts nor will it d i scourage compet i t ion wi th DISH

Network .

At mos t , M e d i a c o m would incur the expense of r emov ing local channe l s f rom its services

o f f e red to M e d i a c o m cus tomers in the subject v i ewing area, cor rec t ing its false adver t is ing

and moni to r ing the recall o f previous ly distr ibuted mater ia ls that bea r false and mis lead ing

informat ion — a ha rm which Med iacom brought about itself.

The publ ic interest w o u l d be served b y an in junct ion by a f f i r m i n g that there is a publ ic

interest in t ru thful adver t is ing and proper representa t ion of the serv ices that Med iacom

actual ly has the right to o f f e r to subscr ibers .

The re is a substant ia l l ikel ihood that EchoSta r will prevai l on the mer i ts .

EchoS ta r ' s c l a ims arise out of M e d i a c o m ' s re t ransmit t ing the local channe l s purchased b y

DISH Ne twork as well as represent ing to its subscr ibers that it o f f e r s local channe ls in an

a t tempt to compe te against D I S H Network . M e d i a c o m purpose fu l ly pub l i shed false and

mis lead ing represen ta t ions descr ib ing the qual i t ies of its cable service . Th i s type of decept ive

adver t is ing is s tr ict ly prohibi ted under Sect ion 43 (a) of the Lanham Act. 15 U.S .C. §

1125(a)(1)(B).

54. Plaint i f f hereby incorporates the above a l legat ions as if fu l ly set for th in this Coun t V of the

55. DISH N e t w o r k ' s investigation found three names in E c h o S t a r ' s subscr iber database c l a iming

the s a m e address : P.O. Box 1707, 509 Flint Avenue , Albany, Georgia 31702-1707 . Fur ther

invest igat ion found that the address belonged to M e d i a c o m .

56. T h e three subscr ibers , M e d i a c o m Chie f Technic ian , J o h n n y Duran , a long wi th Jodi Walke r

and Michae l Cou tu entered into the t e rms of the EchoS ta r Satelli te, L.L.C. Resident ial

C u s t o m e r Agreemen t by subscr ib ing to DISH Ne twork fo r p r o g r a m m i n g .

57. T h e EchoStar Satelli te, L.L.C. Resident ial C u s t o m e r Agreemen t strictly prohibi ts the

rebroadcast , and t ransmiss ion of D I S H Ne twork p r o g r a m m i n g .

58. T h e EchoSta r Satel l i te , L.L.C. Resident ial C u s t o m e r Agreemen t strictly prohibi t s cus tomers

f rom using their DISH Network subscr ip t ions for any pu rpose o f than for pr ivate v iewing.
