>> Mall plans rejectedfour timesKAVEEL SINGH
EARTHWORKSplans for theTon-gaat mall, outside Durban, which partially caved in last
year, were rejected four times, a com-mission of inquiry into the collapseheard on Thursday.
Rajagopaul Naidoo, who heads upthemunicipality'sdevelopment,appli-cations and approvals department, said theplans for theearthworkswererejected four times for "issues thatcould have been rectified by the archi-tect".
The plans were first rejected inMarchlastyear, andthenagaininMay,July, and finally in August.
Thecommissionheardtheplansforthe earthworks upon which the mallwas to be built had been approved inprinciple by the municipality's landuse department.
But consent was needed fromTransnet as the building was within10m of a railway line.
Abuilding inspectorhadvisited thesite andapproved the earthworks, butthe required consent from Transnetwas never obtained.
Naidoosaideveniflanduseapprov-al had been obtained, it did not meanthat there had been approval from hisdepartment.
Referring to the actual structurethat was to be the mall, Naidoo said:"To date there was no building plansubmitted to our department."
Asectionof themall,whichwasun-der construction, collapsed on 19 No-
vember last year. Twopeople died and29 were injured.
Construction worker SiyabongaZuma testified earlier he believed theconcrete had been given enough timetocure, butthesupportsholdingupthebeamsonwhichaconcrete slabrestedhad been removed too soon.
"The scaffolding was taken downtoo quickly. It was needed elsewhere."
Zumasaidthatbeforeremovingthescaffolding and supports he had notnoticed anything strange.
"There was only a small area thatstill needed tobe stripped [on theday].There were only supports under abeam."
The commission is headed by thedepartment of labour's occupationalhealth and safetymanager PhumudzoMaphaha.
The inquiry continues.

Ngihlale phansi ngazi buza ukuthi ngabe lo oleleuyakuthokozela lokhu okwenzekyo na? Ngibuzeumngani wami uMgiks ngalo mhlola wathi: “Iningi labantu livamise ukuthi uma usushonile, emngcwabeniwakho kwenziwa lokhu obukwenza usaphila emhla

Kuke kwaba nempikiswano phakathi kukaMgiksnomunye umngani wethu uSpijojo, othe: “Ngiyaphikisana nalokhu okushiwo uMgiks. Uma kungcwathswaisosha, yebo ziyaqhuma izibhamu, kodwa lokhokwenziwa ngenhlonipho nesizotha ngoba wayenzaumsebenzi wokuvikela abantu besizwe ezimpiniezahlukene. Kungenzeka ukuthi la mantombazaneaye ‘gruva’ naye umufi noma kunomsebenzi ongalungile ababewenza naye futhi uma ngicabangakahle lomsebenzi wawengamelwe uSathane uqobo.”
Le mpikiswano ithathe cishe ihora noma ngaphezudlwana. Kodwa umbono wami uthi uma umuntueseshonile kuhle ukuthi abekwe ngesizotha, kuhlonishwe umzimba nomoya wakhe ongasekho, nomangabe wayenzahlobo luni lomsebenzi kaSathanengoba akekho noyedwa owaziyo ukuthi waxoxawathini noNkulunkulu ngomzuzu wakhe wokugcina, futhi akekho noyedwa owaziyo ukuthi ngale kwethuna umuntu ufike enzeni.
Ngisho nokhokho bethu ababuyi basitshele ukuthikuphilwa kanjani kulelo lizwe elingaphesheya kwe‘Jolidani’.
Wena mfundi uthini ngalolu daba ngabe kufaneleumuntu afihlwe ngendlela enesizotha noma kumeleafihlwe ngendlela aye phila ngayo emhlabeni?.

I wish you were here today even for just a little while so I could say Happy Birthday“son” and see your beautiful smile.
The only gifts today will be the gifts you left behind; The laughter, joy and happiness... precious memories...the best kind.
Today I’ll do my very best to try and find a happy place...struggling to hide my heavy heart and the tears on my face.
I’ll sit quietly and look at your picture thinking of you with love;hoping you’re doing ok in Heaven up above.
May the angels hold you close and sing you a happy song...and I’ll be sending wishes to you today and all year long.

THEinformal taxi ranknext to theLifestyleCentre finally moved to the new tempo-rary site next to the Sangweni Tourism
Centre yesterday (Tuesday 8 April). The move was delayed despite the deadline
given to the KwaDukuza Municipality civil de-partment last Friday.
Therankisbeingmovedallowingthewiden-ing of the P445 to continue next to Lifestyle, adecision taken at a recent council meeting.
The temporary site is owned by the munici-pality. The council report stated that failure todecisively resolve the matter of a temporaryrank would result in the contractor making fi-nancialclaimsonthemunicipalityfor“standingtime”.
Thecivildepartmentwastaskedwithputtingcrusher on the site before taxis started to use itto prevent the grass and sand turning to mud.
Ward six councillor ColinMarsh said the siteisexpectedtobeusedforat leastsixmonths,un-til September or October, before a permanentrank is built.
“We are hoping the permanent site will becompleted before the December holiday sea-son,” he said.
DolphinCoastTaxiAssociationmemberDanMaharajsaidalthoughtheyhadagreedwiththemunicipality to move temporarily, they havesome concerns about the site.
Taxis will have to go around the small circlenext to the Junction Centre to access the newrank.
“In the short-term it is okay, but we are stillworriedabout thehigh traffic volume in this ar-ea. We just hope there aren’t any accidents, asthe roads and circles are very narrow.
“We did ask for one of the lanes next to theSangweni site tobemade intoa taxi lane tohelpalleviatethetrafficproblem, butthisisstillbeingdiscussed,” said Maharaj.
Headdedthatwithconstructiongoingaheadinthisarea—taxisandnormaltraffic—thesec-tion would be under enormous pressure.
ApermanentsiteneartheShellgarageisear-marked for a rank, but negotiations are still un-der way.
In his council report, acting executive direc-tor of technical services Siyabonga Khanyilesaid themunicipality has an “in principle com-mitment” from Shell South Africa and privatesectorgroup IAMRentalCollector (IRC).There-port states that Shell will sell the land to IRC,which will then donate about 5 000 m2 to the
municipality.“The executive committee is well aware of
thechallengesrelatingtopublictransportfacili-ties in Ballito,” said Khanyile in the report. “Al-though negotiations are progressing, the pacehasbeen slow in termsof thedecisionmaking.”
This is due to the fact that Shell must refer
section and transport facility will cost aboutR5 500 000. IRCpropose to assistwith finance.
Thereport states IRChasmadeanofficial of-fer on the land. “As soon as the twoparties con-cerned reach an agreement on the transaction,KDM and IRC will finalise the donation agree-ment,” said Khanyile.
