I would like t o draw your kind attention towards the following b c t s as my humble appeal.

compulsory retired from service with immediate effect with the

order No.NPCIL/Disc.ce11/2(09)/2010/M/285, Dated July, 28, 2010

issued by HON'ble CHAIRMAN AND M.D.1 DISCIPLINARY AUTHORITY OF NUCLEAR POWER CORPORATION OF INDIA LIMITED,

2. The alleged charges framed against me are as follows-

(a)The habit o f remaining on unauthorized absence from duties

without intimation to/permission of the competent authority.

(c)The Habit of quarrelling, behaving rudely and violently, abusing,

shouting using unparliamentary language, indecent behavior and

indulging in misconducts and misbehavior with superiors, fellow

colleagues/ employees on duties. (ARTICLE-Ill)

ARTICLE-I

As mentioned the alleged charges in article-1 about remaining on unauthorized absence from dutieqJpr a period of 35 days as mentioned below.

a) 10.02.2006 to 28.02.2006. (19 days)

b) 06.03.2006 to 18.03.2006. (13 days)

C) 01.06.2006. (1 day)

d) 21.06.2006. (1 day)

e) 16.12.2006. ( 1 day)

Alleged charges are as follows-

i) Without intimation to/prior permission of the competent

authority.

ii) Not applied for leave for the above period of his absence in spite

of repeated adviceldirection by TMS authorities.

iii) Habit of remaining on unauthorized absence from duties without

intimation to /permission of the competent authority in spite of

advice and instructions given to him by TMS authorities in this

regard time t o time.

Herewith I am submitting the explanation for your considerations & the support in favour to me.

It is false allegation. As I am senior Engineer of this organization and served this department DAEINPCIL from my joining date i.e. 07/01/1986 and leading the team of more than 10 subordinates from last 18+ years. I am aware of leave rules and guide line. I have never officially communicated about unauthorized absence in 18 +years service period a t NAPS and KAPS.

- No advice / instruction and official communication given to me in this regard time to time by my section.(lged and TMS authorities.

Please verify the official record for official communications as it is alleged charge. It is in my general practice that before going to leave, I always taking permission to my section head and applied the leave before leaving the head quarter. As per my section head.Sh P.M.Deshpande,SO/F R&D Centre TMS Site, Whom I was reporting during that period, I followed all the instruction issued by him and applied this period of absence 2 times (with the note-Duplicate leave application) and this matter is already settled by appropriate authority at TMS site in l8 th Januarv 2008. vide letter neTAPS-3&4/DGM/HW257. Hence the alleaed c h a m shown above are not adicable to me.

Respected sir,PO/IA could not show the magnetic I-card

punching detail / muster record, and (HR) record, When I asked

during hearing please show the evidence on record for the period of

absence f rom my joining t o R&D centre TMS Site i.e. 27/06/2005 t o

till the date for proving habitual nature of absence charge. PO/IA

could not show the record which is mentioned i n DOS (Daily order

Sheet).Hence I have not violated the provisions of the NPClL Conduct

rules-1994 7.2(f), (g),(p),7.1.9,8.land 8.2. Therefore this article of charges could not be proved so they are false charges.

ARTICLE-II

The alleged charges given in ARTICLE I & ARTICLE II are interrelated with each other. Respected sir, the leave matter was already closed by Appropriate Authority at TMS Site. I had never refused, nor not accepted any official communication on evidence on record. (Proof is enclosed on my defense statement as well as in my Presentation dated 15/07/2009.) Letter no-TAPP.3&4/HR/-66/1/2007/E/489/ dt 12/2/07 was never given to me. The charges framed against me are fabricated and misleading. The complainant (Sh P.M. ~esh~ande:?~/~ R&D) was so confused that once he was stating that letter was given back to me after tear off into pieces, after ward then he states it was in envelope again in another cross examination he says it was thrown in dustbin.(He is distorting his statement many times refer his respective daily order sheets DOS-8 dated05/03/09 and DOS- dated 13/03/b9 by Sh PM Deshpande SOIF). I have always accepted the official communication a d never refused to accept any official communication. letter was not received to me, how it can be torn into pieces it does not proved by any evidence, witnesses. TAPP-3&4/HR/66/1/2007/E/480, that was not shown to me respected sir in front of IA on which charge is labeled against me. So this charge is falsie, fabricated made under conspiracy against me and liable to be rejected.

I was never officially communicated the alleged charges a t the time of

incidence mentioned in the memorandum, and Complaint letters.

Complaint letters were given to me a t the time of Inspection of documents

during preliminary disciplinary proceeding only on dated 11/12/2008 and

19/12/2008.PO has given Xerox copy but he did not provided the

inspection of documents with original copy.

In this charge it is said that the incident occurred on dated 1642- 08 but Complaint letter is of dated 06/03/2008, from Sh SK Mahajan SO/F R&D. Complainant should report this serious incident in writing without

any delay to superior officer he has added his impression or guesses but not narrated the actual facts. I never misbehaved with respected Sh S. K. Mahajan SO/F R&D. I always have given respect to him. I was unknown about his anger upon me, due to which he made such type of complaint against me.

It was also concluded in his witness during examination and cross examination statements on 18/3/2009 DOS on page no-2 & 3. Witness Sh K.P.Sharma SO/E, R&D DOS-dated 20/03/2009 . Witness Sh Manish.J.Chauhan, SO/D DOS -dated 25/03/2009. Witness Sh A.K.Shit

SO/G R&D, DOS -dated 25/03/2009 15.00 hrs proceeding: During cross examination it was observed that their statements are contradictory t o each other. It is concluded that statements were delivered under the pressure of authority i.e. CS (R&D). Respected IA has not given reasonable Opportunity due consideration to ask more - questions during cross examination and remarks mentioned on respective R0~ 'by me.

Out of 11 witnesses 09 witnesses were produced by the PO for

examination, cross examination and re examination in which 06 witnesses

are superior subordinate of CS(R&D) i.e. Sh P.M. Deshpande, SO/F R&D,

Sh S.K. mahajan, SO/F R&D, Sh A.K. Shit, SO/G R&D, Sh K.P. Sharma, SO/E,

R&D, Sh Manish. J.Chauhan, SO/D R&D, and Sh M. Vijayan, Manager (HR)

TMS. one who can not dare to speak truth they will see their benefit only

and they are awarded different mode of benefit also.

Sh D.K.Sisodia,CS(R&D) and Sh S.K.Mahajan, SO/F Is Main complainant

and main witnesses in this charge in charge sheet. The witness - Based on

his statements the alleged charge is not proved.

(Out of 09 witness 06 witness are working under CS(R&D).They have

given witness against me under pressure and benefits, Respected sir

During disciplinary preceding (2008 to 2010) the witnesses above said

officer enjoyed the benefits like early promotion, Tours, and Trainings

etc ,this can be verified from official records also, how above said officer

/witness could go against CS(R&D) ,hence Respected sir these witness

shall not be considered as a proof of alleged charges. At present Sh

S.K.Mahajan, SO/F is promoted as SO/G in 2008.

Respected sir, Therefore these above said letters in article of

alleged charges are Vague, Fabricated and untrue incidents, and filed

with a calculated mala fide intention for harassing me and my family.

Para (ii)

I was never officially commu;n'icated the alleged charges a t the time

of incidences mentioned in the memorandum, and Complaint letters.

Complaint letters were given to me a t the time of Inspection of documents

during preliminary disciplinary proceeding only on dated 11/12/2008 and

19/12/2008.PO has given Xerox copy but he did not provided the

inspection of documents with original copy.

Date of incident 05/08/2007, and report dated 8/08/2007 from

TAPS Hospital Dr Vidarshana wankhede MO/D.I was not visited hospital

On 05/08/2007 on this day it is Sunday. My son alone was visited hospital I

was not along with him. It is a matter of confusion only she wrongly

understood a gentle man standing near sister ward office as father of

patient .Please see the DOS-17 dated 28/03/2009.( No Eye Witness was

called for cross examination hence no reasonable opportunity was given

,To cross examine the eye witness mentioned on said complaint letter)

Respected IA has mentioned his impression or guesses on the basis of

probability of doubt even that not considering defense witness statement

on WS-21 (daily Order sheet) dated 07/04/2009 It is clearly stated the

misconduct of complainant on page3 also. Sir,the same can be viewed from my file record, medical file no 20545A.

As per Memorandum NoTAPS3&4/R&D/2007/S/101

(Confidential) dated 17/11/2007, three charges of different dates were stated . Respected sir the above said allegation was

mentioned however the complaint against me written by the

complainant through proper channel was not communicated to

CS(R&D) or me till 27/11/2007 which is last signatory date

mentioned in the letter.

Hence it is proved Sir, that allegation against me is false and fabricated t o harass me and my family. Respected sir such type of complaint never happened with me and my family with hospital

staffs at any NPClL Hospitals else where. I have not violated any NPClL Conduct Rules and Guidelir)~ I am innocent.

The charges mentioned in para-iii & para-iv are fabricated. I never misbehaved with our boss respected Shri D. K. Sisodia, chief superintendent R&D. I am unknown why he made such type of complaint against me. I never misbehaved with respected Shri P.M. Deshpande, SO/F (R&D), Shri A.K. Shit, SO/G (R&D). It seems under any conspiracy they made such complaint against me.

Sh V.S.B. Babu has written a formal letter to CS(R&D) for Advice To Manoj kumar that Guest house is small, Plan accommodation in guest house Before to start journey. Sh Pankaj Johari,DM HS,NPCIL Guest House The witness - Based on his statements the alleged charge is could not

proved by respected IA report.

I have not violated any NPClL Conduct Rules and Guidelines I am innocent. para-vi is considered on Basis of Probability on doubt, Respected sir -No- Memorandw, warning letter issued from KAPS Management during my stay period about 8 years a t KAPS. Complaint letter of Sh K. Manoharan SO/SB at KAPS (Not shown) on

which Sh Jagdish Valluri SME(FHS) report generated in which he has

mentioned his impression or guesses but wt narrated the actual

facts like. date and time of incident, place of occurrence, Hence it is

hypothetical assumption only. Therefore respected sir, it should not be

considering Proved, because no (PW) Witness was called for cross

examination in this regard

Hence I have not violated the provisions of the NPClL Conduct

rules-1994- 5.1,6.1 (a),(b),(c),6.3,6.5.1(a),7.1.2,7.1.3,7.1.7,7.1.8, and

7.1.8 and 7.2 (j),l&(t) 7.2(f), (g),(p), ,8.1.

I have not violated any NPClL Conduct Rules and Guidelines I

am innocent. Hence ARTICLE- Ill, of all six para (i),(ii),(iii),(iv),(v) &(vi):

Charges could not be proved on the basis of evidence on record and they

are formed under conspiracy against me.

Respected IA was biased during disciplinary proceeding i.e. hearing,

he has not conducted enquiry with open minded. In his report it is

observed that punishment is recommended. Respected sir, Respected IA is

biased, in his report he has narrated on SI no-13 paged para i&ii and

page- 6 last Para- (iii) Sh manoj kumar is highly arrogant, misbehaves

with his colleagues on slight disagreement and becomes violent and

dangerous to work with.. Hence Respected IA has mentioned his

impression or guesses on the basis of probability of doubt. On my

arguments of the alleged charges with PO, It should not be considered a

part of misbehavior/misconduct because I was in double role, my role of

defense assistant as well as charged officer. I, always argued in the

relevance of my case. I had co-operated the disciplinary proceedings even

it has gone out of the way.

They are (PO/IA) pressurizing me to accept the charges and they

are not permitting recording of uy genuine argued points in respective

003, writing of remarks and not signing on DOS by me is the only way to

keep away the prevailing adverse situation, in lieu of that (PO/IA)

crewted and rdected frrlse charges to hide the proceduml mistakes

occurred in Disciplinary proceedings. I did not signed in DOS.16 dated

25/03/2009 in last page and DOS-19, dated 02/04/2009 without signing

further p m e d i n g was stopped reason not known to me .But I requested

please do not think that I am fighting with our beloved NPCll PARIVAR PI consider it, I am exploring the truth of fcrlse allegations by cross

examinatiun and defending my alleged charges with argument In the

incidences in the interest of truth. Principle of Natural Justice was

violated many times by respected PO/IA.

Some additional facts, achievements and circumstances

1- joined Department of Atomic Energy (Government of India)

on 7th January 1986 as SA/ST Stipendiary Trainee for 1-112 years

training, after successful completion of training, I joined as SA/B + 1

Increment at NAPS in July 1987 and involved In commissioning

Operation & maintenance of the plant about 10 years

i.e.31/12/1998.

At present my age is about 47 years and my service is left

approx 12 years in NPCIL.

2- My son Sh Himanshu kesharwani is studying in final year civil

engineering. This major penalty affects him badly because our family

already faces economical crisis since long time. Sir My Daughter Priyal

studying in 7 th class in (AECS) Atomic Energy Central School# 3 Tarapur,

Due to this measure penalty her condition in class with her classmate,

school and town ship is very miserable. Sir people of town ship and our

relative also critics, my son, my daughters and myself. Because they heard

major penalty imposed. We are w4t having any economical support from

any body, so kindly reconsider the withdrawal of decision --the penalty of

compulsory retirement from service, with immediate effect, presently

survival of our family is very difficult. I have taken Home Lone, Education

Lone so much economic burden's are on me. I am suffering from economic

crises.

Therefore you are requesting, to kindly reconsider the situation of

our family's sympathetically. Your hon'ble office must consider Social

responsibility, economical crisis, and education of children's. This major

penalty not affecting only me but it affects my son my daughter and my

wife also. I hope that your hon'able office will reconsider the decision for

survival of my family and education of my children,

3- Sir, please look into the past service record that will be enable you

to change your views in favouring and support to me. Herewith I am

representing in table form to view the excellence, past 20+ years senice

record (Annexure-Achievements and others) and my behavior was always

excellent to my superiors, colleagues and other official staff. In (Annexure-

B) I am giving the full details of my behavior, my conduct, my nature with

those officials/superiors/ colleagues and other official staff of the places

where I worked in my whole service, for your kind consideration to

reinstate my service In NPClL PARIVAR.

4- Some new facts are also which are summarized as follows-

I was not communicated about any adverse remarks against me in

the official communication. After about 2-1/2 years joining at TMS Site from October, 2007-onwards I was being harassed, with various alleged

chargeswhich are given below sequentially in chronological order.

It is big Question? From NOVEMBER 2007 to July 2010, Majority of the charges

alleged to me which is a very small w i o d of service rendered by me about 2+ years, excluding this period my service record was excellent and every thing was normal. Perhaps my representation to you sir, regarding my promotion in NOVEMBER-2007, was treated as misconduct/misbehavior by my superiors CS

(R&D), however my intention was not to hurt any of my superior "for this I

express my regrer. Majority of the complaint letters and complainant are

Superiors subordinate officers of CS (R&D) retired Sh D.K.Sisodia, and Witnesses

are complainant and subordinates of complainant whose relationship are more than 10 years back ,i.e.( Sh A.K.Shit,SO/G, ACE(M)- Sh P.M.Deshpande,SO/F and Sh K.P.Sharma,SO/E -Sh Deshpande ji and Sh Sharma ji both are reporting to Sh

A.K.Shit even that Sh K.P. Sharma ji reporting to Sh A.K.Shit from last 15 years

both of them belong From RE Group) and (Sh S.K. Mahajan, SO/G, R&D and Sh Manish chauhan, SO/D, R&D.Sh Chauhan ji reporting to Sh Mahajan ji). They have given witness under pressure and undue benefits.

a)My take home salary was withheld for two months NOV-07, Dec-

07 and thus harassed me and my family mentally and financially.

With out any proven, valid reason.

b)Dateof incident 05/08/2007 in the complaint letter. False allegation

was fabricated through hospital where I was not involved in

narrated incidence After above harassment in order to keep my self

away from prevailing situations, I had applied Transfer application in

2007-2008, to other sections/other unit i.e. HQ Mumbai, but the same was

not considered and my application was not sent to HQ also, so Respected sir, I was not given reasonable opportunity to improve and keep my self away from prevailing situations.

Respected sir, also I had applied Posting in CMM against the published

vacancy but the same was also not considered even I was having relevant

experience in said requirements.

c).The allegation was made for misbehaving at NPClL Guest house Dated03/08/2006, Ref no-NPCIYNUB/HRS/-GH-COMP/2006/606 dated

05/09/06.The above letter was not allegation against me, It is simply information and advice to me (Sh k3.B. Babu has written a formal letter to CS(R&D) for Advice To Manoj kumar that Guest house is small Plan accommodation Before to journey) . Earlier t o this incident, I had not communicated about any complaint from

any NPClL Guest house (It is included in the charge sheet t o harass me and

my family with calculated mala fide intention).

d).'rhe allegation was made for misbehaving respected sir at KAPS with

my colleague Sh K. Manoharam SO/SB .which I could not even know

during my stay period about 8 years at KAPS, and there was no any official

communication regarding above said incidence.

e). In 5 spell leaves there is i.e. 01/06/2006,21/06/2006 and 16/12/2006

these three days leave are casual in nature. The leave period o f

9/3/2006 t o 18/03/2006 transfer leave EL, and 10/02/2006 t o

28/02/2006 it is wrongly reflected pl verify wi th respective

sectional record. This leave matter was closed by appropriate TMS-

authority. Once matter is subsided, than it is wrong, t o form it in

the form o f a new charge again.

My son was studying in 121h class on that ground my family was

staying at KAPS T/Ship, and shifted house during the leave period

o f 9/3/2006 t o 18/03/2006 then how it is possible sir not t o

applying leave, intimation with superior or permission t o competent

authority. I have never officially communicated about unauthorized

absence in 18+ yeafs service period at NAPS and KAPS.

f).l was not found any Defense assistant to present my case, while

defending my case with PO respected sir; I have to argue my case, because

I was in the role of Defense assistant as well as charged officer. Therefore

during the disciplinary proceeding if any, arguments knowingly or

unknowingly might have hutted to any Authority, the arguments should

not be considered as misbehavior and awarding me punishment.

g)Respected IA was biased during disciplinary proceeding, he has not

conducted enquiry with open mmt#d. IA has mentioned his impression or

guesses on the basis of probability of doubt. Findings of the honorable Inquiring authority are not warranted of the evidence on record I had not misbehaved with Respected IA and I am not indiscipline employee who is

affecting the life of majority as reflected in referenced order page 410-7, Para N@ 15&16.Please Refer sir, IA REPORT Part -A ,page no-4, Para No-12 and Part-0 page No-4. Failures of the proper procedure either w~llfully or through negligence is

liable vitiate the entire proceedings rendering them null and void.

h).Due to delay of more than one year in decision of disciplinary

proceeding, delay which has resulted me in financial loss of about 40% less

salary from the years besides mental agony.

i). AttemptsjEfforts have been made for collecting one more untrue and

vague incident of misbehavior with Sh S.C. Ghosh SO/C R&D from section

to strengthen the case and through light on misbehavior aspect during the

disciplinary proceeding period with mala fide intention and also included

in the said order prejudicially. In enquire report on page 16 IA has also

observed an expressed in such words "It appears that the above letter was

forwarded to HR Group only to in create the population of complains

against the charged official"

j) Article of charges mentioned in ARTICLE-I, 11, 111 -could not be proved

I always argued in the relevance of my case. I had co-apemted the disciplinary proceedings even it has gone out of the way. My argument if considered as part of misbehavior and that is cause to punish me then

may please pardon me.

Within these two under arching statements I always followed in

governing of my behavior-(Team work, Quality, respect for the individual,

Innovation and continuous learning, Harmony and social responsibility).

*I.) Truth, Integrity, transparency all the action in every aspect of my

work life.

*2.)Excellence will be continuous pursuit in my thoughts, words and

deeds. . i..

k. At R&D Centre,TMS Site- healthy work environment was not established in such a way, which attract me to feel help and utilizing my full potential (2Wyears of rich experience in Reactor components and as licensed engineer -FHS O&M experience). By Ex- CS(R&D),Sh D.K.Sissodia and my Section head Sh P.M.Deshpande,SO/F, froni 2007 to 2009, Respected Ex CS (R&D) (retired in February, 2010,) has not taken any decisions relating to (relationship, training, promotion, compensation, and transfer )i.e. no action taken when required to sort out personnel frustration and misunderstanding .Instead of that he was collecting and searching the ground for removing me from service.

I am innocent and accommodate me in NPCIL PARIVAR, provide me one opportunity to serve my best services to NPCIL; I had not misbehaved with any employees intentionally, my sound pitch is l i t t le bi t higher it is hereditary affect and also I am taking medicines of Diabetes from last 6 years. I am spiritual and very down t o earth person; hence I may be fully exonerated of all the alleged charges. I have not violated any NPCIL Conduct Rules and Guidelines this is for your kind information please.

The above charges leveled against me never happened; herewith I am ensuring not will happen in future during my service. I t is humbly

requested, may Please do in favorable to providing speedy and

inexpensive relief t o reinstatement of my NPClL Service along wi th

my withheld benefits, which wil l result in normalization of my

family life.
