Rules and regulationsPerhaps inevitably it hasn’t allbeen plain sailing for theaccidental landlords, withdemand not always forthcomingfor certain types of properties incertain areas. Many landlords ofcourse were also not au fait withthe responsibilities of a landlordand the rules and responsibilitiesthey are required to comply with.As a result of a lack of planningand foresight, tenants were alsoleft under threat of eviction ifstruggling accidental landlordswere no longer able to pay theirmortgage.
All changeSince the market started to stabilise in the summer,accidental landlords have beenselling up in great numbers,illustrating the continuingstrength of the sales market. The disappearance of accidentallandlords has, in turn,strengthened the rental market,as supply has tightened. Thisstate of affairs was highlighted by property expert Sarah Walker,who recently gave a seminar on“How to make more money fromyour property portfolio in thecurrent market” at the inauguralMerseyside Landlords Expo inNew Brighton. The sentimentwas echoed by a spokesman forthe Royal Institution ofChartered Surveyors, whocommented: “The number ofproperties coming on to therental market has slowed as thesales market has begun tostabilise. This is good news forlandlords, who were comingunder pressure to reduce rents asa result of oversupply. The needto respond in this way is easingand, providing the housingmarket holds firm, the outlookfor the rental market shouldcontinue to improve.”
Professionals returnThe main beneficiaries of thecurrent market conditions appearto be buy-to-let investors, whohave been able to capitalise on asteady demand for a diminishedsupply. Carrol Corran, city centrelettings manager for Sutton
Kersh, commented: “We haveseen a decline in the number of“accidental” Landlords comingto the market. As people’s faithin the property market isbeginning to be restored andsales are picking up, those whoconsidered renting as a last resortto selling are now tailing off. Onthe flip side the increase in sales,particularly in the city, has leadto an increase in the number of“professional” landlords comingto the market. Those who werefortunate enough to pick up abargain over the past twelvemonths are seeing an excellentreturn from renting.”
Waiting gameSue Taylor, head of KeppieMassie Residential, believeslandlords, be they reluctant orotherwise, should always adopt a long-term approach to theletting if they are to benefit. Shecommented: “Certainly, we hadmany investor owners, who wereforced into the rental market asthe market started to decline.But we have noticed that theyare now appreciating theinvestment value of theirproperties, some of which are now offeringreturns of between six and eightper cent. The property marketshould always be treated as a
long term investment and not as a quick profit maker.” Sueadded: “Using a good rentalagent can increase the value of an investment portfolio andminimise void periods. KeppieMassie is currently offeringinvestment portfolio’s in the citycentre, complete with corporatetenants offering amazing yields.”
Future directionThe sharp decline in the numberof accidental landlords is a goodindicator that the housingmarket has stabilised, butinevitably they are always likely to have a presence in the marketplace. Alan Bevan,from Victoria Street-based CityResidential, does not believe wehave seen the last of accidentallandlords. He commented:“There is no doubt there hasbeen a decline in numbers asincreased sales activity has“relieved” some landlords oftheir properties. We do notexpect this decline to necessarilycontinue however, as a tighterselling market and strongerlettings market may wellencourage some new “accidental”landlords. Obviously the futuredirection of interest rates maywell have a more defining effectas well.”

Q. I have worked out of the UK for several years as anoverseas contractor, and have always claimed non-residenceand made sure I was in the UK for less than 90 days each taxyear. Lots of my colleagues do the same, but one of them isnow being investigated by the Revenue who are saying thathe has been resident in the UK all along. What is the position?
A. There have been a number of recent changes in the way thatHMRC will assess someone’s residence. The long standing practice ofmany people like yourself and your colleagues to rely on the ‘90 day’rule is now under severe threat.
Firstly for 2007/8 onwards HMRC changed the rules for day-counting, so that days of arrival and departure in the UK which hadpreviously been ignored in counting towards your UK days, werebrought in. This makes a real difference for people who makefrequent short trips to the UK.
Secondly and much more importantly on 6 April 2009 HMRCwithdrew their old IR 20 Booklet and replaced it with more detailedguidance including HMRC 6, a new (as yet draft) manual. Buoyed upby victory in a couple of recent high profile cases, this new bookletprovides a flavour of how an Inspector will tackle a residence enquiry.
Q. So does the 90 day rule still apply?
A. Yes, but only if you are judged to have left the UK first. CriticallyHMRC are placing much more emphasis on this test. To decidewhether an individual has left the UK they will consider, for example
• availability of accommodation in the UK (i.e. have you kept any property in the UK?)
• business ties in the UK (particularly if the business is the main source of income)
• social ties in the UK ( i.e. have you retained membership of clubs,season tickets (!) etc)
• family ties in the UK ( i.e. have immediate family, spouse/partner and children remained here)
...it is clear that they consider that non-UK residence can no longerbe established by carefully structured holidays and business trips, andHMRC intend to look at the ‘bigger picture’ and the pattern of anindividual’s life.
Certainly it is no longer enough to just ‘count days’, as lifestyle andfamily choices can jeopardize residency status. There is no doubt thatmany individuals will have to reassess their arrangements as a resultof this.

Sue Weir, director at Amazon ManagementServices Ltd, worked in property beforelaunching the family-run lettings andmanagement company. Sue now oversees allaspects of the business, offering a smooth andreliable process for landlords and tenants.
How did you get into property?My husband had been buying properties, refurbishing themand selling them on. He was doing very well, and eventuallybegan keeping some properties to let and I began doing theaccounts for those properties as I was ATT qualified. I hadbeen working for a landscaping company but after it wentinto liquidation I continued with the accounts for myhusband. As things were going so well we decided to set upAmazon Management Services. From the word ‘go’, landlordsbegan approaching us just via word of mouth asking if wecould deal with their properties.
How has your career progressed?Things have taken off with the business really quickly! A year ago I was dealing with 30 or so properties and now it’sover 150. The company has also grown. Initially it was justmyself but now we have more staff and are hoping things willexpand even more. It’s very rewarding when people areappreciative of the work we do, and there’s a real sense ofloyalty from our clients.
What would be your dream pet?At the moment I have my hands full as I have a parrot calledBobby. I sometimes bring him into the office as he hates to beleft alone. I would choose another outlandish animal such as a peacock as their tails are so beautiful and they’re suchquirky animals.

Q I have just viewed a property which I am told is “shared
ownership”. What does this mean and what are the
implications of ownership?
A Shared ownership is simply part buying and part renting a
home. The Shared Ownership Lease will grant you the
percentage share of the property you have bought from the
Landlord, for example 50%. For the remaining share you
don’t own, i.e. The other 50% you will have to pay a
monthly rent to the Landlord, and this agreement will be
contained in the Lease. You will pay rent until you have
bought the full 100% of the property.
The Lease will also contain provisions to enable you to buy
any remaining shares in the property after a certain amount
of time (if you wish until full ownership is achieved); this is
known as staircasing. A valuation will be carried out on the
property and the price of the share you wish to buy will be
apportioned accordingly.
As with any Lease, it is usual that you will pay a yearly
ground rent to the Landlord and in addition to this, a
service charge for maintenance of the communal areas, eg.
Structure of the building, lifts, cleaning, lighting, heating
and management. You will pay a proportion depending on
your share of the building i.e. Either the number of
apartments in the block, or based on square footage of the
apartment.

What do you make of yournew home?The house came with blindsand was fully carpeted whichsaved a massive expense, so wedidn’t have to do much at all.We used to live in one of theold Victorian terraces in thearea, which was a lovely oldhouse with great big ceilings.Unfortunately it cost a fortuneto heat and maintain. Having anew build is just totallydifferent. In the old house theboiler was falling to bits buthere you only have to have theheating on for two minutes forthe house to heat up.
Tell us about the layout...We have three bedroomsupstairs, a bathroom, a lovelymodern kitchen, a large livingroom and a downstairs toilet.There’s a gated driveway onthe front and also a backgarden.
What’s the garden like?It’s great, just a nice size forus. There’s a little bit of a patioand a nice bit of grass. We’venever really had a gardenbefore so I’m not sure where to start, but I’ll be lookingforward to getting stuck in!
And the masterbathroom?The walls are white and part tiled and theunits - toilet, sink, power shower over bath– are all white. It’s just a nice clean look.

Take us upstairs...We bought a German bedroom suite from London Road for the masterbedroom and there are two double wardrobes and a bed unit on one wall.Charlotte is in the other room and my son is in the box room, which is adecent size. We had to get rid of the gaming chair he had so we bought him abed with a remote control. He also has a plasma screen TV on the wall, a chestof drawers, bookcase and a wardrobe were he keeps all of his X-Box games.
What haveyou done withthe livingroom?We bought a three piece black leather suite from CSLand there’s a big black mirror and a couple of pictureson the walls. We have two display cabinets, red and blue,which feature all of our designer glass ornaments.

Tim Smit Interview
You studied archaeology atuniversity. How did you endup in the music business?When I was at uni’ I wascompletely skint so I formed aband with my mate CharlieSkarbeck and ended up gettingloads of gigs. We went down toLondon thinking we wereGod’s gift to music, butimmediately ended up on thedole. We realised that on anyparticular week in Londonthere were 10,000 musiciansbetter than us. Fortunately wemade friends with a guy whowas a sound engineer at AbbeyRoad. He allowed us to use thestudio when it wasn’t bookedand we got five or six recorddeals back to back.
What was your greatestsuccess?We had a monster hit with alady called Louise Tucker whohad actually been babysittingfor me at the time. The dayafter she had been babysittingfor me, the artist who wassupposed to turn up to thestudio didn’t arrive. I phonedLouise up on spec and said itwould be nice to work withher. We sold a million copies of
the album and the rest washistory. We went to numberone in 14 or 15 countries anddid a few albums with herwhich were very big.
Why did you start to moveaway from the business?We got very arrogant anddecided we were God’s gift tomusic all over again and thatwe had much better taste thaneverybody else. We decided tobuild a studio to work withother artists, but we blew allour money on it and didn’thave any hits. It was a greatlesson in life. I’m really glad ithappened because it taught meto be grateful for every goodthing as opposed to beingarrogant. Over the next fewyears Charlie and I producedand wrote for a whole load ofacts like Twiggy, the NolanSisters and Barry Manilow butI fell out of love with themusic business and decided to move to Cornwall.
How did the Lost Gardensof Heligan come about?I was going to build arecording studio so I couldproduce film music without
having to deal with artists.While I was doing that I met aguy building a nearbyfarmhouse. When we talkedand he heard that I was anarchaeologist he asked if I’dlike to see the estate that he’djust inherited next doorbecause nobody had been inthere since 1915. So thefollowing day I joined himwith a machete and we walkedinto this big estate and cut ourway through and it was justunbelievable - like a secretgarden – completelyovergrown. I fell in love with itand decided within 45 minutesI was going to change mycareer and restore this garden.
What inspired the EdenProject?I’d long had the idea ofsomething very spectacularand I guess there was amoment when I was drivingalong the A30 and saw the sunsetting on Goonbarrow ClayQuarry, in a way that made itlook like a ziggurat. I starteddreaming about Arthur ConanDoyle’s lost worlds, lostcivilisations in craters ofvolcanoes. I thought how could
you create a metaphor for acivilisation that was adistillation for all that’s best inour world; to draw attention tohow we could work better witha growing nature.
Have you been surprisedby its success?We’ve had 11million visitorssince we opened in 2001 andput over a billion pounds backinto the Cornish economy,which is more than double theentire European budget for thewhole of the south west in thesame time. I guess the reason itworks is because it’s a globalmust-see – bigger than atourist destination.
Do you still have a day-to-day involvement?I do but I’m moving awayfrom the tea and toiletsbecause I believe that the stageis now right for us to dosomething as big as Eden allover again.
What are your hopes for the future?When I look at most of theenvironmentalists who talkabout climate change they borethe pants off me. Most of themseem to have bad breath anddandruff. They want to tell youthe world is going to go to hellin a handcart with charadescience, which in most cases iscod science. Most of theenvironmentalists I know don’tactually understand the sciencebut they’re quoting fromothers who say they do. Weactually need a vision of whatthose sunny uplands mightlook like – a story of why it’sgreat to be alive today and whymaybe we’re at the dawning ofa renaissance.

I loved thesuggestions you made, especially about how to divide the roominto different areas for various activities. I’m about toredecorate my son’s room. He is ten and loves cars. Zest Lets’ quirky radio advert hasbecome a favourite with Juice FMlisteners and landlords lookingfor a ‘fresh approach’ in lettings,as has the unmistakable zebra-print Smart car on the city’sstreets. Managing director, MarkPhilip Cooper, is as enthusiasticin the flesh as you’d expect fromZest – and Savina, the Mexicanrestaurant on Duke Street makesa tantalising venue for our lunchmeeting.
Mark’s experience in propertyis substantial for his young years,and his current role heading upthe relatively new brand sees himexplore his passion for theindustry.
“I’ve been in property since Iwas 16, working as a site managerfor a local property developer. It was a great experience – itreally opened me up to theopportunities in this sector. Idecided that I wanted to work in lettings and sales, and took on a position at The Waterforddevelopment in the GeorgianQuarter.” This experience inmanaging properties provedinvaluable when he was offeredthe position at Zest Lets, Marktells me, as we enjoy wine andsoda with nachos, salsa,guacamole and sour cream. He’sfully equipped to offer landlordssupport by managing properties,advising on where to invest, and a full range of services.
“I’ve been working really hardsince I took on the business, andit’s been challenging, but I’vealways had my own ambitionsand I want to make this a successwhile I’m still young. I’mprepared to put the time in forthat, and this afternoon is fully
booked up with viewings.”The first birthday celebrations
for Zest Lets are set to take placeon 8 October at Palm Sugar, andwill also form the launch of ZestRes, the estate agency side to thebusiness. The themed event willoperate a dress code, seeing guestspay homage to the colours of thepink and zebra-patterned logoand branding. “I’m really excitedabout the launch, as it’s going tobe a real celebration of everythingthat’s different about the Zestbrand. We provide a professionalservice, but we’re not obviouslycorporate and formal – we relateto people on their level and earntheir trust. That’s how I like to do business.”
Savina’s friendly service,fronted by Antonio, iscomplemented by a wide range of Mexican-themed meals. Markchooses the Cajun chicken fajitaswith mixed peppers and rice,while I opt for the pan-friedsnapper. Mark’s plate sizzles as
my fish dish arrives with smallcut roast potatoes, and served ona bed of green beans and sweetcorns. The restaurant is alsolaunching a new takeawayservice, which is set to prove afavourite with city centre dwellersand other patrons. For Mark too,new business in the city looms ashe looks to take on more citycentre-based landlords andmanage properties across southLiverpool and the suburbs,including properties for studentsand graduates. The recentMerseyside Landlords Expo alsoproved successful, generating new business and contacts.
“My aims are to grow thecompany, and I’ve been busynetworking to reach morelandlords and tell them about our competitive rates and whatwe can offer. I want to leave mymark.” Somehow, I don’t thinkthat that’s going to be a problem– this brand is one that’s sure tomake an impression.
