    Himachal Pradesh government has decided to increase the income limit of the creamylayer of Other Backward Classes (OBCs), from Rs 2.5 lakh to Rs 4.5 lakh per year.

    Apex court serves to government on quota creamy layer; Bench wants to know

    why definition of privileged was changed.

    The Supreme Court sought a reply from the Centre on a batch of petitions challengingthe move to raise the annual income ceiling for the creamy layer among the OBC can-didates, seeking admission to central educational institutions, from Rs 2.5 lakh to Rs

    4.5 lakh.

    Reservation has to be finished now: HC

    Plurality of seats must for reservation: SC

    In a significant ruling, the Supreme Court held that for reservation to apply there

    must exist more than one post/seat.

    Applying this rule, a scheduled caste candidate was denied the job of a History

    Lecturer in a private college in Karnataka, as there exited a single post in the

    colleges History department.

    We debate about youthful

    vigor v/s experience. Lets

    take the case of Tendulkar.

    He was drafted into the

    Indian cricket team at the

    age of 16. Let's suppose

    there is only one vacant

    position and for that Kapil

    Dev and Tendulkar are pit-

    ted against each other.Whom should we take?

    Normally people say that it

    depends on the opposition.

    However there is no clear

    answer provided to this

    question.

    Look at the above picture

    carefully. Now look away

    and try to draw it.

    Not so easy, is it? Let meexplain why it is so.

    Brain builds concepts called

    schemas. Schemas are men-

    tal moulds into which we

    pour our experience. By

    adulthood we have built

    countless schemas that

    range from knowing how to

    tie a knot to our concept of

    love. When we talk about

    the need for experience, we

    mean to say the ability to

    make sense of our experi-

    ences and use that to deal

    with situations.

    The Devils tuning fork is

    an impossible object. It is

    not easy to draw just by say

    one look because we have

    no schema for such an im-

    age. So all our experience

    of things is useless here.

    The same goes with the

    youth v/s experience de-

    bate. In the dynamic world

    of today situations arisingare of very complex nature.

    So much so that we are fac-

    ing situations never ever

    seen or foreseen. In such a

    situation, both youth and

    the experienced are on the

    same platform. Herein, the

    youth tends to score a point

    because of the openness of

    mind. The experienced per-

    son tries to place the situa-

    tions as per his experiences

    and tries to deal with it.Many a time he realizes that

    the solutions don't work &

    that he has to think afresh.

    However a lot of time, ef-

    fort and energy is wasted.

    The youth has no such

    schema. So he goes for the

    kill immediately.

    This explains Lawrence

    Bragg getting a Nobel prize

    at the age of 25, or a chess

    player becoming a grand-master at the age of 13.

    All said and done, there

    needs to be a mix of both

    youth and experience. Ex-

    perience definitely gives

    more confidence in the set

    patterns of work. Open-

    mindedness to continuous

    learning and new ideas will

    help. The combined powers

    of both coming together is

    limitless.

    The Ministry of

    Social Justice and Empow-

    erment has done what it

    considers politically oppor-

    tune and what is the mainoccupation of the political

    bosses, who refuse to think

    beyond the next election. In

    an elite-oriented system of

    governance it surprises no

    one that the union cabinet

    has raised the upper limit of

    the creamy layer in the con-

    text of OBC reservations.

    Apparently, the

    union cabinet is more wor-

    ried about those in the in-come range of Rs.2.5 lakhs

    to Rs.4.5 lakhs. In fact it

    filed an affidavit in the Su-

    preme Court that many

    elected representatives de-

    manded the limit raised to

    25 Lakhs! What a concept

    of equality of opportunity

    of access and success in a

    country with a population

    of over 30 crores classified

    under the BPL category!

    The existence of the Na-

    tional Commission for the

    Backward Classes (NCBC),

    which recommended raising

    the limit, has come handy

    for the Ministry and the

    government. Commissions

    of this nature are always

    ready to substantiate the

    desires of the politicians

    through professional sup-

    port and expert advice!

    The present case is just one

    of the umpteen other exam-

    ples. Media reports do pointout the impending elections

    as one of the motivating

    factors responsible for this

    decision. However, media

    has shown no inclination to

    analyze the situation and

    educate people on the un-

    tenability of the supportive

    logic put forward by the

    NCBC or the government.

    The creamy layer

    uplift comes in the wakeof certain alarming facts

    that are regularly docu-

    mented by various agencies

    and do deserve some con-

    sideration. An UN assess-

    ment published recently

    indicates that India would

    not be able to reduce the

    number of its hungry by

    half even up to 2015. Sev-

    eral other Millennium De-

    velopment Goals would

    also remain unattainable forIndia. 46% of Indias chil-

    dren are malnourished

    which is not unexpected

    when 27.5% people are

    classified under below the

    poverty line! The projected

    target to reduce it to

    18.75% appears distant.

    How will these people and

    their children compete on

    par with those earning

    around Rs 4.5 lakhs per

    year?

    Clearly, the Con-

    gress party, under pressure

    from within and also from

    its allies who survive on

    caste politics, pretends to

    help the poor and the weak

    under an astonishing defini-

    tion of the creamy layer.

    The NCBC claims huge

    support for enhancing the

    upper income limit. To

    judge the veracity of the

    claim, talk to common peo- ple in villages and towns

    who are not the beneficiar-

    ies of the Sixth Pay Com-

    mission, and they would tell

    you the real story. The en-

    hanced limit is just another

    way of circumventing the

    spirit of the Supreme Court

    directive that the creamy

    layer has to be excluded and

    only those who genuinely

    deserve state support should

    get it. Government was notin favour of even defining a

    creamy layer. It has found a

    via media. Now, this layer

    between Rs.2.0 lakh to Rs.

    4.5 lakh will practically

    reap all the benefits and

    those unlucky enough to

    remain below Rs. 2.5 lakh

    will practically be no

    where. Let it also be known

    that such a data will never

    be published by the govern-

    ment.

    The UPA govern-

    ment has played havoc with

    schooling and higher educa-

    tion for over four years in

    the name of helping the

    poor, downtrodden and the

    destitute. At present, in the

    MHRD, for every problem

    in education, he only solu-

    tion is reservations, more

    reservations and still more

    reservations. It is all for the

    benefit of the Aam Aadami!

    Further, at no stage; minori-

    ties could complain that

    they were not being given

    generous dose of supportive

    proclamations. After all

    what is the harm in making

    announcements? It is an-

    other matter why minority

    concentration areas were

    never provided with func-

    tional schools, vocational

    centers and teaching learn-

    ing materials in the mothertongue of the children for

    all these years? They weregiven the great Sachar

    Committee Report to re-

    joice and live under the

    illusion, once again, that

    something substantial will

    really be done for them!

    One wonders how many of the

    minority community (read Mus-

    lims0 are still not disillusioned

    with the innumerable measures

    announced for their benefit!

    What advantages have come tothe Muslim Community because

    of the Sachar Committee Re-

    port? At least the Muslim

    friends and families I know

    could not tell me even a single

    one!

    The OBC reservation

    Card is another political mis-

    adventure, like the farmers loan

    waiver scheme. If there were

    any doubts earlier, the newly-

    defined creamy layer should not

    leave even an iota of doubt

    about it in any ones mind on

    how the real interests of the

    weaker sections are sacrificed atthe alter of the next election

    syndrome which limits the total

    thinking and vision of the de-

    cision makers. Even apparently

    right-looking decisions are

    twisted and truncated in the

    process of politicizing everyaspect of governance. Take the

    recent decision to ban smoking

    practically everywhere except

    within ones own home. One

    would like to support it in prin-

    ciple but the manner of its pro-

    posed implementation reduces it

    to another gimmick being

    played by the political bosses.

    Harassment of the ordinary

    would gain new dimensions.

    Another avenue for corruption

    opens up. If the concern of gov-ernment was indeed genuine, it

    would have improved upon the

    functioning of its health

    schemes and improved the in-

    frastructure in health centers in

    the rural areas, which have been

    languishing for ages to get

    equipments, doctors and medi-

    cines!. This is one of the many

    sectors that have seen no im-

    provement at least during the

    last four years. Who could re-

    mind the central governmentthat the best government is one

    that governs the least!

    After six decades of

    independence, it is time to seri-

    ously conduct a scientific as-

    sessment of the impact of reser-vations. Political exploitation of

    reservations takes place across

    the board. When political intents

    overshadow every other con-

    cern, it sends disturbing signals

    all around! Gandhiji wanted the

    last man down the line to be in

    focus, the present government

    thinks of the one who could tilt

    the balance in its favour at the

    cost of the really weak and de-

    serving. As for the expectations

    of political dividends are con-cerned, this venture is also

    slated to meet the same fate as

    of several other adventures

    launched over the recent past.

    Salute the spirit of Mumbai ?As the fresh blasts

    rocked the financial capital

    of the country, Spirit of

    Mumbai has once again

    "defeated" the motive ofterrorist to create painic.

    Even after 24 hours of the

    attack, battle is till going on

    at Trident Hotel and Nari-

    man House (28th Novem-

    ber, 00:33 hrs IST) but

    Mumbai woke to the morn-

    ing of the 27th with the

    same spirit as it has always

    does. As I was reading the

    newspaper to get the latest

    updates, I got a call from

    my colleague askingwhether office will remain

    open ? I called up and was

    told that my office is open.

    Few of my friends offices'

    declared holiday and so

    they enjoyed it watching

    latest flicks on DVD. I

    reached my office and there

    was an announcement of

    "Proud to be Working to-

    day". It gave great "solace"

    to my heart.

    There were few

    people chatting about the

    terror attacks that hit the

    city last night and few of

    them were visiting website

    and watched news channels

    to find the latest update on

    the encounter between secu-

    rity personnel's and terror-

    ists.

    As usual media

    was trying to give its latest

    updates by telecasting the"old footages" and repeat-

    ing the same stories and few

    lines again and again. They

    asked a wounded man, who

    was hit by bullet and run-

    ning for help to show his

    wounds on camera and in-

    terviewed family of de-

    ceased and asked questions

    like: Where do they belong

    to? When they are planningcremation and many other

    irrelevant and illogical

    questions but then that is

    expected of our media

    houses who are trying to get

    more viewer-ship. After all

    this is also part of spirit of

    Mumbai.

    I saw many people

    in the campus listening to

    music, discussing latest

    movies, having pastries andgiving weird views and

    comments on the latest de-

    velopment at the battle

    ground in South Mumbai. A

    lady commented after the

    news of chief chef being

    killed in Taj Mahal Hotel,

    Are the terrorists fool, who

    will cook food for them?

    and entire group of hers

    laughed loudly on this com-

    ment. As I was returning

    back to my home, I ob-

    served that people have no

    fear and were carrying on

    with their usual business

    with great "callousness".

    This is called

    Spirit of Mumbai. Well I

    just beg to differ and I call

    this INSENSITIVENESS

    and APATHY.

    The phrase "Spirit

    of Mumbai" has just be-

    come hollow in last fewyears and it just "sounds

    nice" when we hear these

    days. The same chronology

    was followed as in many of

    the terror attacks that have

    hit the country in last few

    months. PM and inept

    Home Minister condemned

    the attack. It was good to

    see PM addressing the na-

    tion "after 18 hours" of theattack. Now in next few

    days a probe will be set in,

    we will await the results till

    the next terror strikes.

    Meanwhile, everyone hailed

    the spirit of the city and its

    resilience.

    It does take a great

    deal of courage and a soul

    of steel to go back to work

    the next day after an attack

    like this. But you were atthe work because you have

    no other option. You don't

    have time to pause and

    think. An email is circulated

    that "Terrorists, you cannot

    defeat us".

    But let me tell you,

    my friend that if 150 people

    of your city have been

    killed because they were at

    wrong place and at wrong

    time-- and you still get up

    early in the morning and

    behave as nothing has hap-

    pened, Sorry to say that--

    You are already defeated!!

    The enemy has

    broken your spirit and has

    won over your soul. The

    enemy has subdued the rage

    that should boil over and it

    has taken the tears from

    your eyes that should flow.

    The same soul will pretend

    as nothing has happenedeven when we as a nation

    will loose our identity,

    when we will be

    balaknized. This fatalism

    will ultimately lead us no-

    where.

    I read one interview of Sir

    VS Naipaul where he says

    that--

    "I feel all of this

    tells people that they shouldbe defeated again, it s good

    for them to live with defeat,

    and that somehow beauty

    comes out of defeat. I don t

    think beauty comes out of

    defeat, I think the Indian

    wretchedness comes out of

    the Indian defeat, and this

    idea of experiencing is ut-

    terly wrong. I dont think

    the Sanskrit texts pre the

    Muslim conquest, dealt in

    this kind of negation. Ithink this negation has

    come with the years of

    squalor and defeat. Defeat-

    ism, denial and helplessness

    have become the defining

    Indian traits and this is the

    battle that needs to be

    fought."

    There is need to

    send the Spirit of Mumbai

    on a vacation and it should

    not come back unless gov-

    ernment has taken concrete

    measures to protect the citi-

    zens. I as a citizen of the

    country don't feel safe in

    my country. It feels that

    anyone can come from any-

    where and kill people at

    will. I don't want condem-

    nation of attack but some

    concrete steps. I don't wantreaction but some sort of

    action. Can my government

    guarantee that? If not then

    let Defence take over the

    reign of this country be-

    cause our politicians have

    become spineless and

    eunuchs like millions of us.

    Lightning candles,

    observing silence, changing

    display pictures etc is not

    going to help. Neither gov-ernment nor future attackers

    are going to see it. One

    thing is for sure that I am

    not going to do this thing. I

    want my conscience to con-

    tinuously pinch me till I do

    something.

    As a blog post on

    Bharat-Rakshak by Sbajwa

    acidly says,

    They have attacked Red

    Fort, wives and children ofArmy personnel, Parlia-

    ment, Stock Exchange,

    Educational institutes and

    professors, Amarnath/

    Ayodhya/Sankat mochan/

    etc temples, mosques,

    bombs in buses/trains/

    streets. What is left?

    I guess they will have to

    start exploding bombs atop

    Himalaya or Ganga to get

    Indians to wake up and do

    something." Indeed.

    Does your con-

    science pinch you? If yes

    then let's come together and

    pressurize our government

    to take some strong and

    bold steps. This can perhaps

    be the first step towards the

    long journey that citizens of

    this nation need to start.

    I would prefer to

    die after killing an enemy of

    nation than being killed on

    a street as a mute victim.

    Remember,

    Patriotism is not

    short, frenzied outbursts of

    emotion, but the tranquil

    and steady dedication of a

    lifetime.

    Techniques for action1. Concentration of

    M i n d .

    Our brain is the Mas-

    ter computer of our body. Itis well known that brain

    cells like other body mus-

    cles, need regular exercise

    to keep healthy and work-

    ing. To concentrate effec-

    tively you are to sustain

    your attention for a longer

    time and without any out-

    side distraction. It will be

    much better to maintain

    emotional balance during

    this period to concentrate

    for a longer period on oneproject in hand.

    2 . T r y t o k n o w

    what motivates you.

    Most of the intel-

    lectuals, businessmen know

    what makes them to know

    the correctness of the idea.

    They know what it takes to

    get the creative thinking

    flowing. They know how to

    bring their passion and cre-

    ate the energy needed for

    the project. They make their

    self-assessment what they

    enjoy and what motivates

    them and then find opportu-

    nity to avail the chance.

    Motivation of ones mind is

    very important and useful

    for completion of any type

    of work or project in hand.

    3. Self-confidence.

    Self-confidence is

    very important part of our

    mental ability, which re-flects assessment of our self

    -worth. It plays important

    part in the area of Self-

    m a n a g e m e n t . S e l f -

    confidence permits you to

    take all types of risks in life,

    as you have enough confi-

    dence in your own abilities

    to be sure that you can put

    the wrong things to right.

    4. Have a strong de-

    sire towards action.Planning and creat-

    ing situation is essential for

    action. When the right time

    comes to act, then the per-

    former goes for its full ac-

    tion. This type of person is

    aware of how much time

    they devote to complete the

    job, and he/she feels pride

    of such action and feels

    very much satisfied fromhis/her success.

    5. Use your happiness and

    love for life.Success is moving

    towards the goal while be-

    ing content and grateful for

    what you have to day. Use

    your happiness and love for

    life as springboard for even

    more success every day in

    future. Suck your dreams

    with gifts you have given

    now and dont put happi-

    ness off until something

    better than before knocks

    your door.

    6. Habits

    We change ourselves

    and our environment to

    attain maximum comforts

    of life. It is the effort that

    goes into these adaptive

    processes that forms habit.

    The habit can be in good

    sense and it can be in a badsense. The habit is intended

    to prevent us from constant

    experimenting and risk tak-

    ing in our daily life. Actu-

    ally when we get used to

    something, we get used to

    follow that habit.

    7. Use success to boost

    your courage.

    You must celebrateyour large and even small

    victories achieved by you

    with your hard work. It will

    boost your confidence and

    help you to be successful in

    even hard tasks. Peak per-

    fumers do celebrate all

    types of successes in their

    life. They seek opportuni-

    ties to reinforce their efforts

    so that they are continu-

    ously motivated and stay on

    track to perform at higherlevels with high risks in-

    volved.

    8. Realize that life is a Do-

    It-Yourself Project.Most of the successful

    people in life dont wait for

    anyone help them, or to

    train them. They of course

    seek help as needed, but

    first and foremost they take

    on pledge I must help

    myself first approach to

    life. They realize that suc-

    cess begins and ends with

    them, and that they must

    take the initiative in helping

    themselves first. In learning

    driving you are to get little

    training and then you are to

    do it yourself to be a suc-

    cessful driver.

    .9. Life is short, so

    take full advantage of this.

    Life is unpredictableand is of short span. It is to

    be lived to day, in the pre-

    sent. Most of the peak per-

    formers carry a continual

    will be the best effort to

    act.Successful people in

    life are mentally prepared

    all the time to avail the

    chance, and put all efforts

    into action to achieve the

    target. They purposely take

    time before any act tomentally, physically and

    also emotionally get ready

    so that they can operate

    optically for that special

    moment.

    11. Responsibilities.

    If you are a student,

    then you are responsible for

    the submission of home

    assignments, regular in at-

    tending the classes and pay-

    ing respect to your teachers.Suppose you are an em-

    new opportunities. This

    does not mean to move

    slowly, but to create mental

    state of mind, so that you

    have clarity over the day.

    You can create this clear

    focus by starting the day

    and each activity with time

    and clear purpose. Most of

    the successful people are

    aware of the peak time ofthe day for their perform-

    ance.

    13. Understand yourself

    and stop Procrastination.

    Best performer decides tohave the mental discipline it

    takes to make decision, to

    hold themselves accountable

    and also minimize the num-

    ber of tasks that they forget

    about. If you ignore some-

    thing you must do is actually

    a decision you made not to do

    it. They assess in reality what

    is possible and note down

    these tasks in there To do

    Diary. Identify your causes

    of procrastination and startfighting with them from now.

    The most important skill to

    learn is the ability to beat

    procrastination and laziness

    in your life.

    As you climb the ladder of

    success, be sure it's leaning

    against the right building.

    Welcome to the fourth

    issue of YFE Crusader. I am

    pleased to mention that, we

    have reached to the 4th edition

    and with confidence I can say,

    the vast response of contributors

    will certainly take this initiative

    to a new height.

    I am hopeful that this

    paper will serve its purpose in

    uniting more and more people to

    fight against caste terror. Caste

    clash in Rajsthan and MNS

    violence in Mumbai should be

    an eye opener for casteist

    forces, those who use caste for

    their narrow political gains.

    Perhaps this caste based politics

    has given birth to MNS, whose

    action has been proved as a

    threat to national integration.

    But if we see it from anotherangle, activities of MNS activ-

    ists are not at all different than

    the casteist politicians. The only

    difference is, MNS violence led

    to instant reaction, on the other

    side the caste based reservation

    will give its result in long term.

    Lets not forget the

    similarity between casteist poli-

    ticians who use casteism as their

    vote bank and MNS, who use

    Regionalism as their vote bank.

    Days are not far, if this situation

    continues, all of us will witness

    our nations disintegration with-

    out any doubt.

    Lets all join hands against caste

    based division to take this na-

    tion ahead.

    I appeal all like minded

    citizens to come forward and

    raise their voice against injus-

    tice. As a part of our awareness

    campaign against ill effects of present reservation policy we

    have taken this initiative and I

    welcome the scholarly contribu-

    tions from all the well meaning

    citizens who oppose caste based

    reservation. This e-paper will be

    school days and into his judicial career,

    of educated intellectuals in India whoare driving the country... rest all are

    there to create obstacles in whatso-

    ever way on the road of progress for

    the country.

    My name is Shivam Markan.

    I am a Indian living in UK. When this

    bill was introduced I was very disap-

    pointed that the stupid Indian govern-

    ment is trying to divide the nation the

    on the basis of caste and the educated

    deserving people would not be treated

    equally.

    Yesterday i was listening to

    the news where Star news told that the

    OBC system would come in place next

    year. I am totally against this system

    and want to spread the word to the

    Indian government that how unfair this

    OBC would be. I want to show the

    Indian government this system is to-

    tally ridiculous. I would appreciate if i

    can join your organization or at least

    help in some way so that Indian gov-

    ernment can come out of sleep, open

    it's eyes and try to treat every person

    equally and fairly.
