1. Introduction

Exco Resources Ltd (Exco) is completing a major amendment to an existing Environmental Authority (EA). The EA currently covers the Wallace Copper (Wallace North) Project but will be amended to include the Wallace Gold Project (Wallace South, East and Wynberg resource deposits).

NRA Environmental Consultants (NRA) was commissioned by Exco to undertake terrestrial ecological assessments at the Wynberg Deposit to meet the applicable requirements of the Queensland Department of Environment and Heritage Protection (EHP) Guideline: Application requirements for activities with impacts to land (Version 3, 15 August 2016).

The terrestrial ecological assessment involved a desk-based review of available information, wet and dry season surveys, analysis and reporting. A development plan for the Wynberg Deposit has not been prepared. Exco requested that information in relation to terrestrial flora and fauna values, and relevant statutory requirements, be provided to assist project planning. The study area for the assessment comprised Exploration Permit Minerals 12409 (the EPM) and proposed haul road (Figure 1).

1.1 Context 1.1.1 Project description The overarching ‘Wallace Project’ is on ML (mining lease) 90236 and ML 100077 near Cloncurry in north-west Queensland. The Wallace Project area is approximately 30 km south-east of Cloncurry, accessed via the Landsborough Highway. A satellite deposit called Wynberg (this Project) (Figure 1) has been identified on EPM 12409. The Wynberg Deposit will target gold ore that will be mined and transported to the Wallace Gold Project for heap leaching and processing (Exco 2016a). The Wynberg site is approximately 23 km south-east of Cloncurry.

The proposed mining activities at the Wynberg site include: • conventional mining of an open cut pit(s) • blasting and excavation • loading and hauling to surface • stockpiling of ore on a Run of Mine (ROM) Pad before loading and transporting to

ML 100077.

Waste rock material will be disposed through a mixture of in-pit and out-of-pit dumps. Wynberg will be serviced by mine infrastructure on ML 100077 via a haul road linking EPM 12409 and ML 100077 (Exco 2016a).

1.1.2 Bioregional context The study area is primarily within the Mount Isa Inlier Sub-region of the Northwest Highlands Bioregion (Figure 1). The Northwest Highlands Bioregion is characterised by stony hills and ranges that rise above the Gulf Plains Bioregion (Morgan 1999a). The Mount Isa Inlier Sub-region is the largest in the bioregion and predominantly contains heavily folded sediments, with small areas of alluvium (Morgan 1999a). The dominant vegetation type of the study area and the surrounding landscape is Eucalypt low open woodland over a

spinifex ground layer. Eucalypt open forest and woodlands on alluvial plains, and tussock grasslands and forblands are also present.

A section of the proposed haul road intersects the Gulf Plains Bioregion (Figure 1). The Gulf Plains Bioregion is characterised by extensive alluvial plains, but includes gently sloping sandstone tablelands along its eastern margin (Morgan 1999b). Within the study area, Mitchell Grass (Astrebla spp.) tussock grassland is the sole vegetation community of the Gulf Plains Bioregion.

The study area elevation varies between approximately 180 m and 220 m Above Sea Level (ASL). Low undulating hills and plains are the dominant landforms.

The study area is in the Cloncurry River Sub-basin (syn. catchment) of the Flinders Basin. Within the EPM, numerous unnamed streams drain primarily to the north-east to merge with Turpentine Creek (Figure 1). These streams are mostly 1st and 2nd order streams. The proposed haul road crosses five streams, the largest of which are Toole Creek and Elder Creek, which are 2nd and 3rd order streams respectively. All streams are ephemeral and, due to their position high in the catchment, may only hold water (flows and pools) for short periods immediately following rainfall. Based on field observations, some stream pools may persist further into the dry season.

The study area and surrounds are primarily used for cattle grazing. The effects of grazing (eg reduced vegetation cover and/or disturbed soil surface) were particularly noticeable on the Mitchell Grass tussock grassland (Regional Ecosystem (RE) 2.3.3x41) and riparian zones. Historic impacts from mining exploration and extraction are present, though generally localised in extent. Current exploration activities have impacted small areas within the EPM. Localised disturbance was also observed around infrastructure such as fencing, vehicle tracks, power line easements and stock watering infrastructure.

1.2 Important terminology In this report, Threatened and Near Threatened (T&NT) flora and fauna species are as listed under the Queensland Nature Conservation Act 1992 (NC Act) and Commonwealth Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act). Migratory fauna are as listed under the EPBC Act. Species and community status is as listed in the legislation on 24 November 2017.

2. Potentially Relevant Legislation

Commonwealth and State legislation specify the manner in which mining developments can be carried out and the permit requirements for particular activities. Legislation that is potentially relevant to the Project, from a flora and fauna perspective, is summarised below. This information is largely based on the Queensland Government’s EIS Information Guideline – Flora and Fauna (EHP 2016a).

2.1 State (Queensland) legislation Nature Conservation Act 1992 (NC Act) The NC Act is the principal legislation that provides for the protection of native flora and fauna. The NC Act is administered by the Department of National Parks, Sport and Racing (NPSR) and EHP. Under the NC Act, native flora and fauna are classified into different categories of conservation significance according to how threatened they are and the action needed to protect them. Certain authorisations or permits under the NC Act are required prior to clearing listed Threatened flora species, interfering with a fauna breeding place, or removing protected fauna unless the activity is exempt. The NC Act status presented in this report is current as at 24 November 2017.

Vegetation Management Act 1999 (VM Act) The Queensland Vegetation Management Act 1999 (VM Act) is administered by the Department of Natural Resources and Mines (DNRM). The VM Act, in conjunction with the Planning Act 2016 (Planning Act), regulates the clearing of woody native vegetation in Queensland unless the clearing is made exempt from the approval requirements under the Planning Act. The VM Act’s objectives include the conservation of remnant REs, prevention of the loss of biodiversity, maintenance of ecological processes, and conservation of vegetation in areas of high nature conservation value or lands vulnerable to land degradation. The regulatory provisions of the VM Act do not apply to regulated mining or petroleum activities on mining lease areas; however, they are relevant to the flora and fauna assessment as they allow for the classification of REs as Endangered, Of Concern, or Least Concern. The VM Act classes are used for determining offset requirements for significant residual impacts to REs under provisions of the Queensland Environmental Offsets Act 2014 (EO Act). The VM Act status presented in this report is current as at 24 November 2017.

Environmental Offsets Act 2014 (EO Act) The EO Act, Environmental Offsets Regulation 2014, and associated policies and guidelines provide a framework for defining the offset obligations where significant residual impacts to Matters of State Environmental Significance (MSES), Matters of National Environmental Significance (MNES) or Matters of Local Environmental Significance (MLES) occur.

Biosecurity Act 2014 (Biosecurity Act) The Queensland Biosecurity Act 2014 (Biosecurity Act) provides the framework and powers for the management of biosecurity matters, including pest flora and fauna. The Biosecurity Act came into effect on 1 July 2016 and replaced the Queensland Land Protection (Pest and Stock Route Management) Act 2002 (LP Act). Under the Biosecurity Act, everyone has a general biosecurity obligation (GBO), which is defined as follows. • Take all reasonable and practical steps to prevent or minimise each biosecurity risk.

• Minimise the likelihood of the risk causing a biosecurity event and limit the consequences of such an event.

• Prevent or minimise the adverse effects the risk could have and refrain from doing anything that might exacerbate the adverse effects.

The Declared Pest Classes under the LP Act have been replaced under the Biosecurity Act by Prohibited Matters and Restricted Matters. Prohibited Matters are diseases and exotic pest species that are not found in Queensland that, if they were to enter, would seriously impact society, the economy and the environment. Restricted Matters are diseases or pest species already found in Queensland that may result in adverse effects on a biosecurity consideration if conditions or restrictions under the Biosecurity Act were not imposed.

Regional Planning Interests Act 2014 (RPI Act) The RPI Act identifies and protects areas of Queensland that are of regional interest and seeks to manage the impact of resource activities and other regulated activities in areas of regional interest. The RPI Act is supported by the Regional Planning Interests Regulation 2014. Together, the RPI Act and Regulation seek to strike an appropriate balance between protecting priority land uses and regional economic outcomes. The RPI Act specifies Areas of Regional Interests (ARIs) including Priority Agricultural Areas (PAAs), Priority Living Areas (PLAs), Strategic Environmental Areas (SEAs) (replaces wild rivers) and Strategic Cropping Areas (SCAs) (replaces Strategic Cropping Land).

2.2 Commonwealth legislation Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) The objectives of the EPBC Act are to: • provide for the protection of the environment, especially MNES • conserve Australian biodiversity • provide a streamlined national environmental assessment and approvals process • enhance the protection and management of important natural and cultural places • control the international movement of flora and fauna, flora and fauna specimens and

products made or derived from flora and fauna • promote ecologically sustainable development through the conservation and use of

natural resources • recognise the role of Indigenous people in the conservation and ecologically sustainable

use of Australia's biodiversity • promote the use of Indigenous people’s knowledge of biodiversity with the involvement

of, and in cooperation with, the owners of the knowledge.

The EPBC Act focusses Australian Government interests on the protection of MNES, with the States and Territories having responsibility for MSES and MLES. The nine MNES are: • world heritage properties • national heritage places • wetlands of international importance (‘Ramsar’ wetlands) • nationally threatened species and ecological communities • migratory species • Commonwealth marine areas • the Great Barrier Reef Marine Park • nuclear actions (including uranium mining)

• a water resource, in relation to coal seam gas development and large coal mining development.

Actions that will or may have a significant impact on MNES should be referred to the Commonwealth Department of the Environment and Energy for assessment under the EPBC Act. The EPBC Act status presented in this report is current as at 24 November 2017.

3. Methods

3.1 Overview The baseline terrestrial flora and fauna assessment involved a desk-based review of relevant information and two field surveys, as follows. • Dry season. The dry season survey occurred between 12 and 17 August 2016 and

primarily involved a field fauna assessment. Flora assessments were also conducted at a limited number of sites. The survey team comprised NRA’s Peter Buosi and Iain Goodrick.

• Wet season. The wet season survey occurred between 9 and 14 February 2017 and involved field flora and fauna assessments. The survey team comprised NRA’s Peter Buosi, Iain Goodrick and Angus McLeod.

The study area for the dry season survey was within the EPM. The wet season study area included the proposed haul road alignment and the EPM (Figure 1). During both surveys, the sampling area encompassed sites adjacent to the study area. These sites contained habitat types and/or resources relevant to the flora and fauna values of the study area.

The survey sites and field traverses implemented during the surveys are shown on Figure 2 and Figure 3.

The methods applied during the desk-based review and field surveys are described below.

3.2 Desk-based assessment The results of the desk-based review informed the design of the field surveys and predictions regarding the presence or potential presence of biodiversity values. The following information sources were consulted. • Results from searches of the following databases.

− EPBC Act Protected Matters Search Tool (DoEE 2016, 2017). EPBC Act Protected Matters Reports were generated for the area within a 10 km radius of point -20.7658 140.7344.

− EHP Wildlife Online database (EHP 2016b, 2017a). Reports were generated for the area within a 100 km radius of point -20.7663 140.7338.

− Atlas of Living Australia search (ALA 2016). Review of specific species records and a database search within a 10 km radius of point -20.7658 140.7351.

− Australia’s Virtual Herbarium (AVH 2017). Review of herbaria records for a 100 km radius of point -20.7658 140.7351.

• RE mapping (Version 8.0) (DNRM 2017). • Broad Vegetation Group (BVG) mapping (DSITI 2017). • Literature relevant to flora and fauna species known to occur in the region. • Aerial imagery (Google Earth).

3.3 Field surveys 3.3.1 Flora Regional Ecosystem mapping and assessments The desk-based review identified a variety of vegetation communities across the study area. RE mapping, in conjunction with aerial imagery, was used to plan the field surveys. The intention was to visit all mapped REs and landforms within the study area.

To verify the RE mapping across the study area, tertiary and quaternary (rapid assessment) vegetation assessments were used following the method of Neldner et al. (2012). Specific effort was devoted to assessing the on-site presence (or absence) and extent of RE 1.3.7 (Eucalyptus camaldulensis woodland on channels and levees (south)), which has an Endangered EHP Biodiversity Status. Vegetation assessment site locations are shown on Figure 2.

The proposed haul road was surveyed on foot along the proposed alignment, focussing on areas within 150 m of the centre line. Quaternary-level flora assessments were undertaken within each DNRM-mapped RE encountered. A storm on the evening of 13 February 2017, and subsequent elevated water levels in Elder Creek, prevented access south of this area; approximately 2.3 km was not assessed (Figure 2).

Flora species An inventory of flora species encountered was maintained during the field survey. Field search areas are shown on Figure 2. Plants that could not be readily identified in the field were collected (a sample of diagnostic plant parts) for later identification at NRA’s office.

Threatened and Near Threatened flora The desk-based assessment determined that three T&NT flora species were known (from recent and/or historical records; EHP 2016b, 2017a, ALA 2016), or predicted (based on habitat modelling; DoEE 2016, 2017), to occur within approximately 100 km of the study area. Targeted field searches were undertaken throughout the EPM and along the proposed haul road alignment.

Non-native species Effort was devoted to searching for non-native flora species and recording their abundance or extent. Search areas included locations that have a higher probability of harbouring non-native species (eg waterways, stock waterpoints, roads/tracks and areas of historical ground disturbance).

3.4 Fauna survey overview The field fauna surveys involved systematic sampling at formal survey sites, targeted sampling (using a subset of techniques) at specific areas of interest, and continuous observation. Advice in the Terrestrial Vertebrate Fauna Survey Guidelines for Queensland (Eyre et al. 2014) informed the timing and methods used for the surveys.

3.4.1 Formal survey sites The following data sources informed the selection of formal survey sites. • Broad Vegetation Group (BVG 1:2M) mapping (DSITI 2017). • Field observations of habitat types and condition.

• Fauna welfare considerations (for trapping). Access across the site was limited, and this constrained the location of trap sites.

Two formal survey sites were established in the dominant habitat types in the study area (Figure 3). The dominant habitat types and corresponding site names are described below. • Trap Site 1. Astrebla spp. (Mitchell grass), Dichanthium spp. (bluegrass) tussock

grasslands (BVG 30). • Trap Site 2. Eucalypt low open woodland over Triodia spp. (spinifex) (BVG 19).

BVG mapping (1:2M; DSITI 2017) shows Trap Site 2 as occurring in BVG 261 (Figure 3). Field observations identified the vegetation type in this area to match BVG 19. The site was chosen because it was one of the few patches of Eucalypt low open woodland over spinifex that was readily accessible, large in size and contained mature/tall spinifex; ie it was the ‘best on offer’ within the logistical constraints of the fauna trapping program.

The formal survey sites (Trap Site 1 and Trap Site 2) were used during the wet and dry season surveys. Formal survey sites were operated for six consecutive days during the dry season and five consecutive days during the wet season.

Elliott trapping, funnel and pit traps, bat detectors, spotlighting, active diurnal searches and dedicated bird surveys were undertaken at each formal survey site. Survey effort afforded to each site is described in Table 1.

3.4.2 Targeted survey sites To supplement the information collected at formal survey sites, additional targeted sampling was employed, as described below. Specific effort was devoted to sampling in the riparian habitat type (BVG 16 – Eucalyptus spp. dominated open forest and woodlands on drainage lines and alluvial plains)2. • Riparian habitat (BVG 16).

− Passive acoustic bat recording/detecting was conducted at waterholes/wetlands during the wet and dry season surveys (Figure 3). The acoustic data was sent to Ecological Management Services Pty Ltd for analysis.

− A harp trap was deployed at one location along a dry creek bed for two nights in the wet and dry season surveys (Figure 3). Observations made across the site identified this location as the most suitable for harp trapping.

− Surveillance cameras were deployed along stream channels (Figure 3). A number of cameras were placed at waterholes to record fauna species coming to drink. Other cameras were pointed at meat baits (sardines), and one camera was pointed at a suspected den site for a small mammal or reptile.

− Timed diurnal bird surveys were conducted during the wet and dry season surveys at locations shown on Figure 3. Surveys involved walking sections of streams.

− Timed nocturnal searches (spotlighting) and diurnal searches for fauna were conducted during the wet and dry season surveys (Figure 3).

− Elliott trapping was conducted in a flood-out area adjacent to a riparian habitat (Figure 3).

• Mitchell grass tussock grassland (BVG 30). − During the dry season survey, a Dunnart (Sminthopsis sp.) was seen during a timed

spotlighting event at Trap Site 1. Camera traps and Elliott traps were deployed at the sighting location to assist in identifying the species (Figure 3). This effort was employed because the Julia Creek Dunnart (Sminthopsis douglasi), which is Endangered under the NC Act and EPBC Act, is known to occur in habitats similar to those found in the southern part of the study area.

• Stock water trough. − Diurnal bird surveys were conducted at a water trough during the wet and dry season

surveys (Figure 3). • Gidgee shrubland (part of BVG 26).

− Timed diurnal bird surveys and diurnal searches for fauna were conducted during the wet and dry season surveys (Figure 3).

• Landzone 11 of Eucalypt low open woodland (BVG 19). − A timed diurnal bird survey was conducted in landzone 11 of BVG 19 (Figure 3). This

was done to increase the spatial coverage of the sampling sites.

Further details of targeted survey activity locations and effort are presented in Table 1.

3.4.3 Continuous observation/opportunistic survey An inventory of incidental sightings was maintained during the wet and dry season surveys. Field search areas, as represented by the track log recorded on the GPS of the primary zoologist, are shown on Figure 3.

4. Results

4.1 Survey conditions The study area was not affected by severe weather events or fires during, or in the months prior to, the field surveys. However, a storm delivered heavy rain to the site on the night of 13 February 2017, causing watercourses to flow. According to fire scar mapping (NAFI 2017), the study area and immediate surrounds have experienced a low fire frequency since 2000, as summarised below. • Parts of the EPM were fire-affected in 2011 and 2012. • Part of the haul road study area (southern) was fire-affected in 2013.

4.1.1 Weather The Bureau of Meteorology (BoM) collects rainfall data at stations near the study area. The closest is the Cloncurry McIllwraith St weather station (029008), which is approximately 23 km from the study area. Rainfall data from the Cloncurry McIllwraith St weather station is shown on Graph 1. The data indicates that rainfall between March 2016 and February 2017 was near or above average for most months (note: no data was available for April). Below average rainfall was recorded in October and November 2016 (BoM 2017).

− minimum daily temperature range: 23.7°C – 27.3°C.

There was no rainfall experienced during the dry season survey; temperatures were cool at night and warm during the day. Site conditions (presence of flowering plants and pools of water in watercourses) indicated rain had occurred at the site prior to the commencement of the survey. Rainfall records from the BoM Cloncurry McIllwraith St weather station show that the region received 47.2 mm of rain between 14 and 20 July 2016 (BoM 2017).

The wet season survey featured hot and humid days and warm nights. A storm on 13 February 2017 resulted in large stream flows and restricted access to parts of the study area.

4.2 Flora 4.2.1 Regional Ecosystem mapping REs mapped by DNRM (2017) across the study area are shown on Figure 2. The REs in this area are listed in Table 3 with a short description of the vegetation community and details about their mapped dominance and status. RE status is listed with reference to the following, and is current as at 24 November 2017. • The EPBC Act, which lists Threatened Ecological Communities (TECs) as Vulnerable,

Endangered or Critically Endangered. • The VM Act, which categorises REs based on the remaining extent of the RE in the

bioregion. REs are listed as Endangered, Of Concern or Least Concern. Vegetation clearing activities on MLs may be exempt from permitting and approvals under the VM Act.

• The Biodiversity Status of the REs according to EHP, which uses the REs for biodiversity planning. The conservation status is based on the extent of the REs in the bioregion, their condition and the presence of threatening processes. REs are listed as Endangered, Of Concern or No Concern at Present.

In many areas, the vegetation observed across the study area is a fine-scale mosaic of different vegetation types. Frequently, the differences and boundaries between different vegetation types are subtle. This situation is reflected in the RE mapping, with many polygons attributed with multiple REs (ie mixed RE polygons). The RE mapping over the study area is generally reliable for its intended use. Notable variations to the DNRM (2017) mapping based on field observations in the study area are summarised as follows. • REs comprising Acacia cambagei (Gidgee) as a defining species (RE 1.3.4, RE 1.3.6x1c,

RE 1.5.6x2, and RE 2.9.4x41a) are under-represented on the ground when compared to the mapped areas. Although Gidgee was a common component of the tree and midstorey layers, only small areas were confirmed as dominated by Gidgee. RE 2.9.4x41 was not detected during field surveys.

• Areas mapped as RE 1.11.2a (dominant) are more closely aligned with RE 1.11.3b based on landform and underlying geology (steep hills and strike ridges suitable for RE 1.11.2a are not present).

• The extent of mapped RE 2.3.3x41 immediately north of the Landsborough Highway is less than what the mapping indicates.

• The on-ground extent of RE 1.3.7b (dominant or subdominant) within the study area (Figure 4) differs from that shown in the DNRM (2017) mapping (Figure 2), as described below. RE 1.3.7b was specifically targeted by NRA during the flora field surveys as its Endangered EHP Biodiversity Status may have implications for mine planning and approvals (discussed further in Section 5). Revised mapping of RE 1.3.7b shown on Figure 4 should be interpreted with reference to the survey areas shown on Figure 2. − The main watercourse within the EPM is mapped by DNRM (2017) as supporting

RE 1.3.6x1c (Acacia cambagei and Eucalyptus leucophylla woodland with a sparse ground layer of tussock grasses and Triodia longiceps) (Figure 2). Field surveys identified the presence of RE 1.3.7b, as defined by the presence of Eucalyptus camaldulensis (River Red Gum), in the northern section of this watercourse (Figure 4).

− The tributary of Turpentine Creek south of Landsborough Highway, at the point of intersection with the proposed haul road, is mapped by DNRM (2017) as supporting RE 1.3.4/1.3.6x1d/1.3.7b (Figure 2). Field observations confirmed its absence at, and within 500 m of, this crossing point (Figure 4).

The area where the proposed haul road crosses the tributary of Weatherly Creek (near ML 100077; Figure 4) was inaccessible due to heavy rainfall and flooding. Interpretation of aerial imagery suggests that River Red Gum is not present at the crossing point; however; field studies are recommended to confirm this.

The ground layer is sparse tussock grasses, including Aristida latifolia, Enneapogon spp. and Sporobolus australasicus. 4.3 Flora species Database searches identified 939 flora species (Appendix A) within the search areas. Field surveys identified 103 flora species in the study area; a list of these species by habitat type is provided in Appendix B. Conditions were generally favourable during the field surveys for surveying and identifying flora.

4.3.1 Threatened and Near Threatened flora species The study area is not located within a ‘high risk area’ on the Protected Plants Flora Survey Trigger Map (EHP 2017b).

No T&NT flora species were observed during the field survey, and none is expected to occur within the study area. Database searches identified the presence of the following three T&NT flora within the search areas. Analysis of distribution and habitat requirements has determined that their presence in the study area is unlikely. • Eucalyptus nudicaulis, NC Act Vulnerable. A mallee; it is confined to the Mount Isa-

Cloncurry area where it is found growing on quartzite ridges, gullies or steep hillsides between 400-520 m ASL (Bean 1991). The nearest species records are approximately 120 km south-west of the study area.

• Ptilotus maconochiei, NC Act Near Threatened. A tufted shrub up to 0.8 m high (Benl 1979), found on stony hills and residuals with Acacia spp., between Mount Isa and Windorah (Bean 2008). The nearest species records are approximately 86 km south-west of the study area.

• Oldenlandia spathulata, NC Act Endangered. An erect annual herb up to 30 cm high and 40 cm across (Halford 1992, ALA 2017). The nearest species records are approximately 107 km north-east of the study area. These records were found on open to sparse Mitchell Grass tussock grasslands on alluvium or Cretaceous sediments (RE 4.3.19, RE 4.3.15, and RE 4.9.1c) (ALA 2017, DNRM 2017). These REs are not present within the study area.

4.3.2 Non-native flora species Database searches identified 81 non-native species within the search areas (Appendix A). The most important non-native flora species in terms of invasiveness, potential for spread and environmental, social and economic impacts are listed in Table 4. These flora species are listed in the Biosecurity Act and/or recognised as Weeds of National Significance (WoNS). Hereafter, non-native flora species are denoted with the ‘*’ symbol.

Ten non-native flora species were recorded during the field survey (Appendix B), most of which were species deliberately introduced into Australia for their value to livestock. Two of the species, Parkinsonia aculeata* (Parkinsonia) and Crypostegia grandiflora* (Rubber Vine), are listed as a Restricted Matter under the Biosecurity Act. They are also listed as WoNS. Calotropis procera* (Calotropis), found adjacent to the study area, Parkinsonia* and Rubber Vine* are listed as significant weeds in the Southern Gulf Catchments Regional Pest Management Plan (SGC 2011).

Vachellia farnesiana* (Mimosa Bush) was commonly encountered throughout the study area. It is identified as a priority weed of the Southern Gulf region of Queensland (March & Wharton 2015). It is not listed as a WoNS or as a Restricted Matter under the Biosecurity Act.

The locations of Parkinsonia*, Rubber Vine* and Calotropis*, as determined through field observations, are shown on Figure 5.

4.4 Fauna 4.4.1 Fauna habitats Four BVGs (1:2M) (DSITI 2017) are mapped to occur on the study area. The BVGs are shown on Figure 3 and are briefly described as follows. • BVG 19 – Eucalyptus spp. (E. leucophloia (Snappy Gum), E. leucophylla (Cloncurry

Box), E. persistens, E. normantonensis (Normanton Box)) low open woodlands often with Triodia spp. (Spinifex) dominated ground layer. Hereafter referred to as the Eucalypt Low Open Woodland Over Spinifex habitat type.

• BVG 16 – Eucalyptus spp. dominated open forest and woodlands on drainage lines and alluvial plains. Hereafter referred to as the Eucalypt Open Forest and Woodland on Floodplains habitat type.

• BVG 26 – Acacia cambagei (Gidgee) / A. georginae (Georgina Gidgee) / A. argyrodendron (Blackwood) open forests to tall shrublands. Hereafter referred to as the Gidgee Tall Open Shrubland habitat type.

• BVG 30 – Astrebla spp. (Mitchell Grass), Dicanthium spp. (Bluegrass) tussock grasslands. Hereafter referred to as the Tussock Grassland habitat type.

Approximately 21 ha (or 1%) of the study area is mapped as non-remnant vegetation. This area is in the north-eastern corner of the EPM.

The habitat types present in the study area are described below.

Eucalypt Low Open Woodland Over Spinifex (BVG 19) The Eucalypt Low Open Woodland Over Spinifex habitat type is the dominant habitat type in the study area (approximately 1,677 ha, or 81% of the study area) and in the immediate landscape. Within the study area, it occurs on hills and on plains where alluvial soils are absent or limited. Soils tend to be rocky and/or gravelly, and the landform is generally low undulating hills separated by watercourses. The groundcover is dominated by Spinifex (Triodia spp.) and is generally sparse to mid-dense, occasionally dense. Non-native flora is uncommon in all structural layers. The tree and shrub layers are generally sparse, except where mid-dense to dense patches of Acacia chisholmii (Chisholm’s Wattle), often dead, are present. Most trees are low in height, and hollows are small and uncommon. Very few trees with well-developed hollows were observed. Spinifex clumps were noted to provide significant habitat resources for a range of reptiles, birds and mammals.

Eucalypt Open Forest and Woodland on Floodplains (BVG 16) Within the study area, the Eucalypt Open Forest and Woodland on Floodplains habitat corresponds with RE 1.3.7b (DNRM 2017, Figure 2) and BVG 16 (DSITI 2017). The field verified extents, and DNRM (2017) mapped extents, of RE 1.3.7b are shown on Figure 4. This habitat is restricted to the riparian areas of the better developed streams and accounts for a small proportion of habitats within the study area. The soils are alluvial and, away from erosive flows, support a sparse groundcover of Spinifex or mid-dense groundcover of Cenchrus ciliaris* (Buffel Grass) and/or Cenchrus setigerus* (Birdwood Grass). The non-native Buffel Grass and Birdwood Grass dominate where deeper and more fertile alluvium is present. The tree layer density is variable, ranging from sparse to mid-dense, with the riparian zone supporting a mid-dense tree layer of River Red Gum, many with well-developed hollows. The shrub layer is generally sparse in the riparian zone and includes Melaleuca spp. and Flueggia virosa subsp. Melanthesoides (White Currant Bush). Non-native flora is uncommon in the shrub layer and absent in the tree layer. The stream supports ephemeral flows and retains pools for short periods following sustained or heavy rainfall.

Waterways supporting River Red Gum are also present within the central and north-western portions of the EPM.

Gidgee Tall Open Shrubland (BVG 26) The Gidgee Tall Open Shrubland habitat type is primarily mapped by DSITI (2017) on waterways and floodplains in the central portion of the EPM, and it intersects with the proposed haul road south of the Landsborough Highway (Figure 3). It occupies approximately 159 ha, or 8% of the study area. The flora field studies determined that Gidgee (Acacia cambagei +/- A. georginae) is a minor component of the mapped BVG 26 areas, which are more likely to be defined by Eucalypt species including Snappy Gum, Cloncurry Box, Western Bloodwood, Ghost Gum and River Red Gum. Buffel Grass and/or Birdwood Grass are occasionally present in areas featuring a more developed alluvial soil profile. Tree hollows are uncommon in pure stands of Gidgee (Acacia cambagei +/- A. georginae).

Tussock Grassland (BVG 30) Tussock Grassland habitat type is present in the south-eastern corner of the EPM and intrudes slightly into the proposed haul road alignment south of the Landsborough Highway (Figure 3). This habitat type comprises approximately 183 ha, or 9% of the study area. Soils are primarily cracking clays interspersed with areas of surface gravel. Species commonly encountered include Aristida latifolia (Feathertop), Astrebla squarrosa, (Bull Mitchell Grass), Bonamia media (Common Bonamia), Bothriochloa ewartiana (Forest Bluegrass), Chrysopogon fallax (Golden Beard Grass) and Heliotropum tenuiflorum (Native Heliotrope). Sparse trees and shrubs are present, including Mimosa Bush*, Western Bloodwood and Cloncurry Box. Arboreal habitat features are sparse. Terrestrial habitat features include cracks in the clay soils.

4.4.2 Habitat condition The results of habitat condition assessments are presented in Table 5 and indicate that habitat integrity was generally high across the site. The main threatening processes and disturbances are as follows. • The presence of cattle, primarily on the tussock grasslands and in riparian areas.

Observed impacts included trampling and heavy grazing of Tussock Grasslands and erosion and fouling of waterways.

• Localised vegetation clearing and excavation (active and historical) in the mineral exploration area.

• The proliferation of Buffel Grass*. It is used as pasture grass in the cattle industry. Has the potential to grow densely, resulting in the exclusion of native plants in the ground layer and the alteration of fire regimes (eg hotter fires that alter vegetation community structure and native species composition).

4.5 Native fauna species Database search results for fauna species that were detected in the search area are summarised in Appendix C.

Six amphibian, 16 reptile, 87 bird and 19 mammal species were recorded by NRA during the wet and dry season surveys (Appendix D). This includes micro-bat species that were tentatively identified based on their calls. The suite of species recorded by NRA is a sub-set of the complete species assemblage that is likely to occur in the study area and is representative of the survey effort and conditions prior to and during the surveys.

4.5.1 Threatened and Near Threatened fauna species Fauna field studies did not detect the presence of T&NT fauna species.

T&NT fauna species identified via database searches as present, or potentially present, within the search area are listed in Appendix E. Based on the desk-based review and habitats (type and condition) observed on-site, no T&NT fauna species are expected to occur in the study area on a regular or predictable basis. A possible exception is the Grey Falcon (Falco hypoleucos, NC Act Vulnerable), which is identified as having a ‘probable’ likelihood of occurrence. The Grey Falcon is present in the local area and may range across the study area; however, its presence is likely to be intermittent. No habitats or resources of particular importance for the Grey Falcon were identified in the study area. All vegetated areas are likely to provide foraging habitat. The Carpentarian Grasswren (Amytornis dorotheae, NC Act Endangered, EPBC Act Endangered) and Julia Creek Dunnart (Sminthopsis douglasi, NC Act Endangered, EPBC Act Vulnerable) are predicted to have a ‘possible’ likelihood of occurrence. The Carpentarian Grasswren requires mature, long-unburnt spinifex as habitat. This habitat type is present in patches across the study area, though is potentially insufficient to support a permanent population. The nearest Carpentarian Grasswren species records occur approximately 120 km west of the study area. The study area features a small area of cracking clays (shown on Figure 3 as BVG 30), which is potentially suitable habitat for the Julia Creek Dunnart. Targeted surveys did not detect this species, and the nearest species records occur approximately 100 km east of the study area.

4.5.2 Migratory fauna No migratory fauna were observed during the field surveys, and none are expected to occur in the study area on a regular or predictable basis. The possible exception is the Fork-Tailed Swift (Apus pacificus), which may occasionally range over the study area. The species spends nearly all of its time on the wing, and no habitats or resources of particular

importance were identified in the study area. Migratory fauna species identified via database searches as present, or potentially present, within the search area are listed in Appendix E.

4.5.3 Fauna breeding places and habitat features Nests belonging to a range of woodland birds were observed at multiple locations in the study area during the field surveys. The nests of most of these species, and locations for nesting, are likely to change annually and sometimes change within a season.

Nests belonging to the Black Kite (Milvus migrans) and Spotted Harrier (Circus assimilis) were recorded along a drainage line just outside the north-eastern corner of the EPM (Figure 5). Several other unattended raptor nests were observed in the local area. These nests suggest that the area may be important for raptors.

Arboreal hollows are rare within areas mapped as BVG 19 and BVG 30 due to the absent, or sparse, low-growing tree layers within these habitats. Arboreal hollows are present in sections of BVG 16 and BVG 26 that support mature River Red Gum. Mature River Red Gums typically have multiple hollows in a range of sizes. These hollows are used as resting, denning, roosting and nesting sites for a range of fauna.

BVG 30 features cracking clay soils, which is known habitat for a range of small mammals (eg Dunnarts), reptiles and amphibians, and their invertebrate prey. BVG 19 features Spinifex, a habitat feature for a variety of reptiles, birds and mammals. A Spectacled Hare Wallaby (Lagorchestes conspicillatus pallidus) hide in a Spinifex tussock was recorded at the proposed haul road south of the Landsborough Highway (Figure 5). This hide may not be permanent, and other hides for this species may occur in areas of dense Spinifex.

4.6 Non-native fauna species Feral Pigs (Sus scrofa), One-humped Camels (Camelus dromedarius), Cane Toads (Rhinella marina) and Wild Dogs (Canis familiaris) or Dingoes (C. l. dingo) were the only non-native fauna species (other than domesticated cattle) confirmed present during the field surveys. Feral Pig activity is likely to be focussed along the larger drainage lines, where signs of their presence were recorded during field surveys. Habitats within the study area are probably of marginal suitability for this species, and low-density populations are expected to occur. One-humped Camels were observed within the southern portion of the proposed haul road. Cane Toads were observed on a number of occasions during the surveys, mainly near water.

Dog prints were observed in the study area. It is not clear if the prints were from a working Domestic Dog(s), Wild Dog(s), and/or Dingo(es). Wild dogs are not considered native fauna under the NC Act, whereas Dingoes are considered native fauna under the NC Act. In agricultural settings where there is livestock, all wild populations in the genus Canis are typically regarded as pest fauna.

Feral Pigs and Wild Dogs are listed as Categories 3, 4 and 6 Restricted Matter under the Biosecurity Act, and Dingoes are Categories 3, 4, 5 and 6. These categories are defined as follows. • Category 3 – a person who has Category 3 Restricted Matter in the person’s possession

or under the person’s control must not distribute or dispose of the Restricted Matter unless the distribution or disposal meets the requirements of the Act.

• Category 4 – a person must not move, or cause or allow to be moved, Category 4 Restricted Matter, unless the moving is for the purposes of its identification by, or at the request of, a relevant entity as defined by the Act.

• Category 5 – a person must not keep in the person’s possession or under the person’s control Category 5 Restricted Matter, unless the keeping is for the purposes of its identification by, or at the request of, a relevant entity as defined by the Act.

• Category 6 – a person must not give food to a Category 6 Restricted Matter unless the feeding is carried out in preparation for, or in the course of, lawfully baiting, trapping or shooting the Category 6 Restricted Matter.

The One-humped Camel and the Cane Toad are not listed as a Prohibited Matter or Restricted Matter under the Biosecurity Act.

In addition to the above, database searches identified the presence of the Rock Dove (Columba livia), House Sparrow (Passer domesticus), Feral Goat (Capra hircus), Red Fox (Vulpes Vulpes), Feral Horse (Equus caballus), Feral Cat (Felis catus) and House Mouse (Mus musculus) within the search areas. The Feral Cat, Feral Goat and Red Fox are listed as Restricted Matter under the Biosecurity Act. It is likely that these pest species are present in and around the study area at low densities.

4.7 Environmentally Sensitive Areas Environmentally Sensitive Area (ESA) mapping is shown on Figure 6. The watercourses in the north-western corner of the EPM and the watercourses that intersect the proposed haul road (south of Landsborough Highway) are mapped as Category B ESAs. These ESAs correspond with the polygons mapped by DNRM (2017) as containing RE 1.3.7b as a dominant or subdominant component of a map polygon. RE 1.3.7b has an Endangered (Biodiversity Status). As discussed in Section 4.2.1, errors were observed in the DNRM (2017) RE mapping; RE 1.3.7b was observed to be absent from some of the areas shown on the mapping, and present in some areas where it is not shown on the mapping (Figure 4).

4.8 Regional Planning Interests The RPI Act identifies and protects areas of Queensland that are of Regional Interest. There are no areas of Regional Interest in or adjacent to the study area. The nearest area of Regional Interest is the Gulf Rivers Strategic Environmental Area, approximately 200 km north-west of the study area (DAMS 2017).

5. Project Planning Considerations: Terrestrial Flora and Fauna

A development plan for the Wynberg Deposit has not been prepared, thereby precluding an assessment of potential project-related impacts on terrestrial flora and fauna values. To assist with mine planning decisions, the potential legislative implications associated with the identified terrestrial flora and fauna values are described below (Table 6). To assist with the interpretation of this information the relevant values are shown on Figure 7.

The opinions expressed below are based on the technical and practical experience of expert environmental practitioners. They are not presented as legal advice, nor do they represent decisions from the regulatory agencies charged with the administration of the relevant acts. Any legislation or code of practice referenced herein is understood to be current at the time of writing. Prior to the commencement of the project, updates to legislation and relevant codes and guidelines should be identified, and implications to the project clarified.

No Migratory fauna were observed in the study area. The Fork-Tailed Swift is the only Migratory species predicted to occur (possible likelihood of occurrence; Appendix E). This species may occur occasionally in the study area; however, the species spends the majority of its time on the wing and no habitats of particular importance were identified in the study area. Searches for Threatened and Migratory fauna species, or their habitat, did not occur along the proposed haul road south of Elder Creek due to flooding.

Avoid impacts to potential Julia Creek Dunnart habitat ie the cracking clays habitat in BVG 30 (Figure 7). If this is not possible, a further survey to confirm the presence/absence of the species should be undertaken to inform impact mitigation and EPBC Act approval requirements. Undertake a field survey in the previously inaccessible section of the proposed haul road (ie south of Elder Creek) to verify the presence/absence of Threatened and Migratory fauna species or their habitat. An EPBC Act self-assessment should be undertaken prior to disturbance to determine if the project is likely to have a significant impact on Protected Matters. The assessment should consider the findings of this study, the potential project-related impacts based on development plans, and the findings of any further field surveys. If a significant impact is deemed likely, an EPBC Act Referral to the Commonwealth Department of the Environment and Energy (DoEE) will be required. Based on the findings of this study, significant impacts to EPBC Act Protected Matters (that relate to flora and fauna) as a result of the project are considered unlikely if the following occurs. • Impacts (direct and indirect) to Julia Creek Dunnart are avoided or, if

unavoidable, the species is deemed absent via further targeted field survey(s).

• No Threatened or Migratory species, or important habitat resources for Threatened and Migratory species, are found along the proposed haul road south of Elder Creek (not surveyed during the current study).

EPBC Act permit Under Part 13 of the EPBC Act, there are circumstances where a permit is required for killing, injuring, taking, trading, keeping or moving listed Threatened species, Threatened Ecological Communities or Migratory species.

A permit does not appear necessary at this time. Confirm the need for an EPBC Act permit prior to disturbance based on the findings of any further pre-clearing surveys.

Queensland B Nature Conservation Act

1992 (NC Act) and associated regulations

Clearing permit A clearing permit is required for clearing T&NT flora listed under the NC Act.

The study area is not located within a ‘high risk area’ on the Protected Plants Flora Survey Trigger Map (EHP 2017b). No T&NT flora species or important habitat for T&NT flora species were found in the study area during the field surveys. Searches for T&NT flora species did not occur along the proposed haul road south of Elder Creek due to flooding. T&NT flora species are unlikely to occur in this area based on published species distribution information and the observed conditions across other parts of the study area.

Based on the findings of this study, a clearing permit is considered unlikely to be required. Confirm the need for a permit following any further pre-clearing surveys.

Species management program A species management program (SMP) is required for activities that involve tampering with native fauna breeding places. A ‘low risk SMP’ is required for tampering with the breeding places of Least Concern species. A ‘high risk SMP’ is required for tampering with the breeding places of T&NT species, Special

Several nesting sites were observed near the study area, including nests belonging to the Black Kite and Spotter Harrier (NC Act Least Concern species). The local area may be an important nesting/breeding site for raptors. In addition to raptor nests, nests belonging to other bird species (NC Act Least Concern) and a hide for the Spectacled Hare Wallaby (NC Act Least Concern) were observed in the study area. The locations of these nests and hides are likely to change seasonally and annually.

Inspect disturbance areas for nesting/roosting fauna prior to clearing. If nesting/roosting places are found, assess the need for a SMP. The requirements for a SMP should be confirmed with EHP at the EA application stage of the project.

Therefore, a permit to clear native vegetation under the VM Act may not be required. Refer to the information below (Table Section D) for potential offset requirements to clear REs mapped under the VM Act.

D Environmental Offsets Act 2014 (Environmental Offsets Act)

Environmental offsets Environmental offsets may be required if the project has a ‘significant residual impact’ (SRI) on a ‘prescribed environmental matter’ (including MNES, MSES and MLES2). The following ‘prescribed environmental matters’ are relevant to the project based on the findings of this study. • Clearing of ‘regulated vegetation’

(intersecting a watercourse as mapped under the VM Act) (referred to as ‘regulated vegetation watercourses’ hereafter).

• Impacting on connectivity areas. • ‘Protected wildlife habitat’ (ie habitat for

species that are Endangered, Vulnerable or Special Least Concern (non-migratory)).

‘Prescribed environmental matters’ not related to terrestrial flora and fauna values (eg waterways for fish passage) have not been assessed in this study. Consideration of all matters is required as part of the application for an EA.

The potential for a SRI on prescribed environmental matters is provided below. The assessment should be reviewed when detailed design plans are available. Regulated vegetation All REs in the study area have a Least Concern status under the VM Act. Therefore, outside of watercourses, these REs are not defined as regulated vegetation for the Environmental Offsets Act. There are several mapped regulated vegetation watercourses in the study area (Figure 7). Based on the SRI criteria (EHP 2014), a SRI is likely if clearing within 5 m of the defining bank of a regulated vegetation watercourse results in the following. • For clearing for linear infrastructure:

− >25 m wide in grassland structure category RE (within the study area this applies to RE 2.3.3x41); or

− >20 m wide in sparse structure category RE (within the study area this applies to all REs other than RE 2.3.3x41).

• For clearing other than for linear infrastructure: − >5 ha loss of grassland structure category RE; or − >2 ha loss of sparse structure category RE.

Connectivity areas The majority of the study area contains remnant vegetation, and the clearing of this vegetation as a consequence of development is anticipated. EHP (2014) states that a SRI is likely if clearing results in the following: • changes to the core RE extent at a local scale is greater than a threshold determined

by the level of fragmentation at a regional scale; or • core areas that are greater than or equal to 1 ha are lost or reduced to patch

fragments. Protected wildlife habitat The sub-category of this prescribed environmental matter that is relevant to the project is habitat for Endangered, Vulnerable or Special Least Concern fauna species. No fauna species listed as Endangered, Vulnerable or Special Least Concern (non-migratory), or important habitat for these species, were found in the study area. The following Endangered and Vulnerable fauna species potentially occur based on habitats observed within the study area and species distribution information. • Julia Creek Dunnart (NC Act Endangered) (possible likelihood of occurrence;

Appendix E).

The potential for a SRI should be assessed when detailed design plans are available. Where possible, the following measures should be implemented to minimise the potential for SRI and associated offset requirements. The offset requirements will ultimately be determined by EHP during the application for an Environmental Authority (EA) under the Environmental Protection Act 1994 (EP Act). In addition to the below measures, a rehabilitation plan should be developed during project planning to minimise the extent and duration of impacts to ‘regulated vegetation’, ‘connectivity areas’ and ‘protected wildlife habitat’. Depending on the proposed rehabilitation approach, this may assist with avoiding or reducing offset requirements. The rehabilitation plan should include progressive rehabilitation of areas disturbed by mining to a condition that is compatible with the local natural environment and environmental values. Regulated vegetation If clearing is required within 5 m of the defining bank of a regulated vegetation watercourse (shown on Figure 7), minimise clearing extents to the following. • For clearing for linear infrastructure (including the proposed haul road):

− minimise clearing to less than 25 m wide in grassland structure category RE (eg RE 2.3.3x41) and less than 20 m wide in sparse structure category RE (applicable to all REs in the study area except RE 2.3.3x41).

• For clearing other than for linear infrastructure: − minimise clearing to less than 5 ha in grassland structure category RE

and 2 ha in sparse structure category RE. Connectivity areas • Once the project-related clearing extents are known, the potential for a SRI

on connectivity should be determined. A GIS tool is available via EHP to assist with this assessment.

Protected wildlife habitat • Avoid impacts to potential Julia Creek Dunnart habitat ie the cracking clays

habitat (BVG 30) shown on Figure 7. If this is not possible, a further survey to verify the presence/absence of the species should be undertaken to inform mitigation measures and an assessment about the potential for a SRI.

E Environmental Protection Act 1994 (EP Act)

Environmental Authority An Environmental Authority (EA) is required prior to undertaking an environmentally relevant activity (ERA), which includes mining activities and some ancillary activities. Information presented in the EA application needs to include details related to Environmentally Sensitive Areas (ESAs) and ‘prescribed environmental matters’ as defined under the EP Act and Environmental Offsets Act, respectively.

ESAs A Category B ESA occurs in the study area due to the presence of the Endangered (EHP Biodiversity Status) RE 1.3.7b. There are discrepancies between the locations of RE 1.3.7b identified in the field and those mapped by the State for the study area (Figure 7). The presence of RE 1.3.7b was not assessed along the proposed haul road south of Elder Creek due to flooding. Interpretation of aerial imagery and RE mapping suggests that the ESA is unlikely along this section. Prescribed environmental matters Information on prescribed environmental matters relevant to the project (ie ‘regulated vegetation’, ‘connectivity areas’ and ‘protected wildlife habitat’) is provided above (Table Section D).

When applying for an EA, include the information provided in this report on the presence of ESAs and potential presence of ‘prescribed environmental matters’ to allow EHP to assess the project and develop suitable EA conditions. ESAs Development plans should be prepared to avoid disturbance to the ESAs (as shown on Figure 7) where possible. If ‘standard’ or ‘variation’ EAs are obtained for the project, conditions associated with buffers around the ESAs need to be considered in project planning. Undertake a further field survey to the previously inaccessible section of the proposed haul road to confirm the presence/absence of ESAs and inform mitigation measures and EA requirements. Prescribed environmental matters Refer to Table Section D for information related to potential SRIs and offset requirements for ‘prescribed environmental matters’.

F Biosecurity Act 2014 (Biosecurity Act)

Requirements to manage biosecurity risks, including Restricted Matters and Prohibited Matters.

Several Restricted Matters were found in and near the study area during the field surveys. This includes non-native plants, Rubbervine* and Parkinsonia*, and non-native fauna, Dingoes/Wild Dogs and Feral Pigs. The Biosecurity Act provides the framework for the management of biosecurity risks. All Queenslanders must comply with the general biosecurity obligation under the Biosecurity Act, defined as follows. • Take all reasonable and practical steps to prevent or minimise each biosecurity

risk. • Minimise the likelihood of the risk causing a biosecurity event and limit the

consequences of such an event. • Prevent or minimise the adverse effects the risk could have and refrain from doing

anything that might exacerbate the adverse effects.

As part of project planning, develop measures to control the introduction or spread of Restricted Matters and Prohibited Matters. This includes undertaking appropriate hygiene practices, monitoring and undertaking regular control programs.

G Regional Planning Interests Act 2014 (RPI Act)

The RPI Act identifies and protects areas of Queensland that are of Regional Interest.

There are no areas of Regional Interest in or adjacent to the study area. The nearest area of Regional Interest is the Gulf Rivers Strategic Environmental Area, approximately 200 km north-west of the study area (DAMS 2017).
