Property Manager hereby grants the permission to Producer and its employees, agents, independent contractors and suppliers to enter the

property during the dates and times identified above. Producer will use Property as a location for photographing, filming and/or sound recordings.

In the event of a delay in schedule due to photographically unfavorable conditions, or reasons beyond their control, Producer holds the right

to reschedule at the agreed fees and terms provided in this agreement.

Producer may photograph, film and record sound on the Property and use the resulting materials in any way Producer chooses. Property Manager

grants Producer permanent, worldwide and exclusive rights to own all rights to all that Producer records and photographs and agrees to have no right to

inspect or approve recordings.

Producer may bring into the Property crews, actors and equipment. Producer may construct temporary sets and, after completing photography,

filming and/or recording, will restore the property to its original condition as of the initial date of occupancy unless otherwise agreed to by both parties

in writing, reasonable wear and tear expected.

Producer agrees to hold Property Manager harmless from any liability and loss, which may be caused by Producer’s employees or equipment.

Producer represents that Public Liability and Property Damage Insurance cover them.

Property Manager agrees to the fees, statements and conditions stated in this contract concerning Property. Property Manager gives

Producer the right to assign all terms stated in this contract and agrees to waive any further compensation or demand of any kind forever.

Property Manager understands the terms described in this contract. He/she is over 18 years of age and has the authority to sign this contract

and grant Producer the rights given under this contract.

1. I, the undersigned owner or representing agent, whichever is applicable, hereby irrevocably grant to [NAME OF PRODUCTION ENTITY] (“Producer”), and its agents, employees, contractors and suppliers, the right to enter and remain upon and use the property, both real and personal, located at: [ADDRESS AND/OR DESCRIPTION OF PROPERTY LOCATION] (the “Property”), including without limitation, all interior and exterior areas, buildings and other structures of the Property and owner’s name, logo, trademark, service mark and/or slogan, and any other identifying features associated therewith or which appear in, on or about the Property, for the purpose of photographing (including without limitation by means of motion picture, still or videotape photography) said premises, sets and structures and/or recording sound in connection with the production, exhibition, advertising and exploitation of the [TYPE OF PRODUCTION, SUCH AS THEATRICAL FEATURE, TV SHOW, ETC.] tentatively entitled [TITLE OF PROJECT] (the “Picture”). 2. Producer may take possession of said premises commencing on or about [ DATE ], subject to change due to weather conditions or changes in production schedule, and continuing until the completion of all scenes and work required. 3. Producer may at any time elect not to use the Property by giving Owner or agent 24 hours written notice of such election, in which case neither party shall have any obligation hereunder. 4. Producer may place all necessary facilities and equipment, including temporary sets, on the Property, and agrees to remove same after completion of work and leave the Property in as good condition as when received, reasonable wear and tear from uses permitted herein excepted. Signs on the Property may, but need not, be removed or changed, but, if removed or changed, must be replaced. In connection with the Picture, Producer may refer to the Property or any part thereof by any fictitious name and may attribute any fictitious events as occurring on the Property. Owner irrevocably grants to Producer and Producer’s successors and assigns the right, in perpetuity, throughout the universe, to duplicate and recreate all or a portion of the Property and to use such duplicates and recreations in any media and/or manner now known or hereafter devised in connection with the Picture, including without limitation sequels and remakes, merchandising, theme parks and studio tours, and in connection with publicity, promotion and/or advertising for any or all of the foregoing.


6. All rights of every nature whatsoever in and to all still pictures, motion pictures, videotapes,

photographs and sound recordings made hereunder, shall be owned by Producer and its successors,

assigns and licensees, and neither Owner nor any tenant, or other party now or hereafter having an

interest in said property, shall have any right of action against Producer or any other party arising out of

any use of said still pictures, motion pictures, videotapes, photographs and or sound recordings,

whether or not such use is or may claimed to be, defamatory, untrue or censurable in nature. In

addition, neither Owner nor any tenant, nor any other party now or hereafter having an interest in the

Property, shall have any right of action, including, but not limited to, those based upon invasion of

privacy, publicity, defamation, or other civil rights, in connection with the exercise of the permission

and/or rights granted by Owner to Producer. If there is a breach by Producer hereunder, Owner shall be

limited to an action at law for monetary damages. In no event shall Owner have the right to enjoin the

development, production, distribution or exploitation of the Picture.

7. Force Majeure: If because of illness of actors, director or other essential artists and crew, weather

conditions, defective film equipment or any other occurrence beyond Producer’s control, Producer is

unable to start work on the date designated above and/or work in progress is interrupted during use of

the Property by Producer, then Producer shall have the right to use the Property at a later date to be

mutually agreed upon and/or to extend the period set forth in Paragraph 2, and any such use shall be

included in the compensation paid pursuant to Paragraph 3 above.

8. At any time within six (6) months from the date Producer completes its use of the Property

hereunder, Producer may, upon not less than five (5) days prior written notice to Owner, reenter and use

the Property for such period as reasonable and necessary to photograph retakes, added scenes, etc.

9. Owner warrants neither he or anyone acting for him, gave or agreed to give anything of value, except

for use of the Property, to Producer or anyone associated with the production for using said Property as

a shooting location.

10. Owner represents and warrants that he/she is the owner and/or authorized representative of the

Property, and that Owner has the authority to grant Producer the permission and rights granted in this

agreement, and that no one else’s permission is required. If any question arises regarding Owner’s

authority to grant the permission and rights granted in this agreement, Owner agrees to indemnify

Producer and assume responsibility for any loss and liability incurred as a result of its breach of the

representation of authority contained in this paragraph, including reasonable attorneys’ fees.

11. If there is a dispute between the parties, Owner’s remedies will be limited to an action at law for

money damages, and in no event will Owner have the right to seek injunctive or equitable relief or to

otherwise enjoin the production distribution, marketing or exploitation of the Picture.

This agreement constitutes the entire understanding between the parties and supersedes any prior

understanding relating thereto. This agreement shall not be modified in any way except by a writing

signed by the parties.

THIS AGREEMENT, made ________, day of ____________ by and between ___________________, a COMPANY (“Production Company”) and ______________ (“Grantor”). 1. IDENTIFY OF FILMING LOCATION. Grantor hereby agrees to permit Production Company to use the property located at ________________ (“the Property”) in connection with the motion picture currently entitled _________________________ (the “Picture”) for rehearsing, photographing, filming and recording scenes and sounds for the Picture. Production Company and its licensees, sponsors, assigners and successors may exhibit, advertise, promote and otherwise exploit the Picture or any portion thereof, whether or not such uses contain audio and/or visual reproduction of the Property and whether or not the Property is identified or identifiable, in any and all media whatsoever now known or later devised in the universe in perpetuity. 2. RIGHT OF ACCESS. Production Company shall have the right to bring any personnel and equipment onto the Property and to remove the same following completion of use of the Property hereunder. Production Company shall have the right, but not the obligation, to photograph, film and use in the Picture the actual name, if any, connected with the Property or to use any other name for the Property. If Production Company depicts the interior(s) of any structures located on the Property, Grantor agrees that Production Company shall not be required to depict such interior(s) in any particular manner in the Picture. 3. TIME OF ACCESS. The permission granted hereunder shall be for the period commencing on or about _______________________________. The period may be extended by Production Company if there are changes in the production schedule or other unforeseen delays (such as and) due to weather conditions. The permission herein granted shall also apply to future retakes and/or added scenes. 4. PAYMENT. For each day that Production Company uses the location, it shall pay Grantor the sum of __________________________, in consideration for the foregoing. 5. ALTERATIONS TO LOCATION. Production Company agrees that (with Grantor’s permission) if it becomes necessary to change, alter or rearrange any equipment on the Property belonging to Grantor, Production Company shall return and restore said equipment to its original place and condition or make repairs, if necessary. Production Company agrees to indemnify and hold harmless Grantor from and against any and all liabilities, damages and claims of third parties arising from Production Company’s use hereunder of the property (unless such liabilities, damages or claims arise from breach of Grantor’s warranty as set forth in the immediately following sentence); any physical damage done to Property Proximately and being caused by Production Company, or any of its employees, representatives or agents. Grantor warrants that it has the right and authority to enter into this Agreement and to grant the rights granted by Grantor herein. Grantor agrees to indemnify and hold harmless Production Company from and against any and all claims relating to breach of its aforesaid warranty. 6. NO KICKBACKS FOR USE. Grantor affirms that neither it nor anyone acting for it gave or agreed to give anything of value to any member of the production staff, anyone associated with the Picture, or any representative or Production Company, or any television station or network for mentioning or displaying the name of Grantor as a shooting location on the Property; except the use of the Property, which was furnished for use solely on or in connection with the Picture.


8. RELEASE. Grantor releases and discharges Production Company, its employees, agents, licensees, successors and assigns from any and all claims, demands or causes of action that Grantor may not have or may later have for libel, defamation, invasion of privacy or right of publicity, infringement of copyright or violation of any other right arising out of or relating to any utilization of the rights granted herein. 9. MISCELLANEOUS. This constitutes the entire agreement between the parties with no modifications unless in writing signed by both parties. A photocopy of this Agreement shall be as legally valid and binding as the original and is herein granted to inure the benefit of all successors, assigns, heirs, executors, etc. of each party hereto. The undersigned represents that s/he is either rightful or true owner of the Property or empowered as agent or otherwise to execute this Agreement for or on behalf of owner. IN WITNESS WHEREOF, the parties have hereunto set their names and seals as of the date first above-written.

understand that this crew may create some noise, both during the day or night, and agree not to

hold PRODUCTION COMPANY, Inc. responsible for any discomfort, physical or otherwise, that

they, their employees, assigns, other representatives, or equipment may cause me between the

NON-FILMED LOCATION AGREEMENT

To the Producer: I, the undersigned owner or agent, whichever is applicable, hereby irrevocably grants to Producer, its employees, agents, contractors and suppliers, and such other parties as it may authorize or designate, to enter and use, for the purpose of: [INDICATE WHETHER PARKING, HOLDING, SERVING MEALS, STAGING, ETC.] the Property located at the address set forth above hereinafter referred to as the “Property” which Property consists of: [ADDRESS AND/OR DESCRIPTION OF PROPERTY LOCATION] (description), which permission includes access to and from the Property and the rights to bring and utilize thereon personnel, personal property, material and equipment. Producer shall leave the Property in substantially as good condition as when received by Producer, expecting reasonable wear and tear and use of the Property for the purposes herein permitted. Producer further agrees to hold the undersigned harmless from any and all third-party suits, claims, or loss or liabilities caused by Producer in connection with the aforementioned use of the Property. If there is a dispute between the parties, Owner’s remedies will be limited to an action at law for money damages and in no event will Owner have the right to seek injunctive or equitable relief or to otherwise enjoin the production distribution, marketing or exploitation of the Picture. This Agreement may not be altered except by a written instrument signed by both parties. This Agreement shall be binding upon and inure to the benefit of the undersigned and Producer and their respective successors and assigns. The undersigned warrants that the undersigned has the full right to enter into this Agreement and that the consent of no other party is necessary to effectuate the full and complete permission granted herein. Producer may place all necessary facilities and equipment, including temporary sets, on the Property, and agrees to remove same after completion of work and leave the Property in as good condition as when received, reasonable wear and tear from uses permitted herein excepted. Signs on the Property may, but need not, be removed or changed, but, if removed or changed, must be replaced. In connection with the Picture, Producer may refer to the Property or any part thereof by any fictitious name and may attribute any fictitious events as occurring on the Property. Owner irrevocably grants to Producer and Producer’s successors and assigns the right, in perpetuity, throughout the universe, to duplicate and recreate all or a portion of the Property and to use such duplicates and recreations in any media and/or manner now known or hereafter devised in connection with the Picture, including without limitation sequels and remakes, merchandising, theme parks and studio tours, and in connection with publicity, promotion and/or advertising for any or all of the foregoing.


6. All rights of every nature whatsoever in and to all still pictures, motion pictures, videotapes,

photographs and sound recordings made hereunder, shall be owned by Producer and its successors,

assigns and licensees, and neither Owner nor any tenant, or other party now or hereafter having an

interest in said property, shall have any right of action against Producer or any other party arising out of

any use of said still pictures, motion pictures, videotapes, photographs and or sound recordings,

whether or not such use is or may claimed to be, defamatory, untrue or censurable in nature. In

addition, neither Owner nor any tenant, nor any other party now or hereafter having an interest in the

Property, shall have any right of action, including, but not limited to, those based upon invasion of

privacy, publicity, defamation, or other civil rights, in connection with the exercise of the permission

and/or rights granted by Owner to Producer. If there is a breach by Producer hereunder, Owner shall be

limited to an action at law for monetary damages. In no event shall Owner have the right to enjoin the

development, production, distribution or exploitation of the Picture.

7. Force Majeure: If because of illness of actors, director or other essential artists and crew, weather

conditions, defective film equipment or any other occurrence beyond Producer’s control, Producer is

unable to start work on the date designated above and/or work in progress is interrupted during use of

the Property by Producer, then Producer shall have the right to use the Property at a later date to be

mutually agreed upon and/or to extend the period set forth in Paragraph 2, and any such use shall be

included in the compensation paid pursuant to Paragraph 3 above.

8. At any time within six (6) months from the date Producer completes its use of the Property

hereunder, Producer may, upon not less than five (5) days prior written notice to Owner, reenter and use

the Property for such period as reasonable and necessary to photograph retakes, added scenes, etc.

9. Owner warrants neither he or anyone acting for him, gave or agreed to give anything of value, except

for use of the Property, to Producer or anyone associated with the production for using said Property as

10. Owner represents and warrants that he/she is the owner and/or authorized representative of the

Property, and that Owner has the authority to grant Producer the permission and rights granted in this

agreement, and that no one else’s permission is required. If any question arises regarding Owner’s

authority to grant the permission and rights granted in this agreement, Owner agrees to indemnify

Producer and assume responsibility for any loss and liability incurred as a result of its breach of the

representation of authority contained in this paragraph, including reasonable attorneys’ fees.

11. If there is a dispute between the parties, Owner’s remedies will be limited to an action at law for

money damages, and in no event will Owner have the right to seek injunctive or equitable relief or to

otherwise enjoin the production distribution, marketing or exploitation of the Picture.

This agreement constitutes the entire understanding between the parties and supersedes any prior

understanding relating thereto. This agreement shall not be modified in any way except by a writing

signed by the parties.

THIS AGREEMENT, made ________, day of ____________ by and between ___________________, a COMPANY (“Production Company”) and ______________ (“Grantor”). 1. IDENTIFY OF FILMING LOCATION. Grantor hereby agrees to permit Production Company to use the property located at ________________ (“the Property”) in connection with the motion picture currently entitled _________________________ (the “Picture”) for rehearsing, photographing, filming and recording scenes and sounds for the Picture. Production Company and its licensees, sponsors, assigners and successors may exhibit, advertise, promote and otherwise exploit the Picture or any portion thereof, whether or not such uses contain audio and/or visual reproduction of the Property and whether or not the Property is identified or identifiable, in any and all media whatsoever now known or later devised in the universe in perpetuity. 2. RIGHT OF ACCESS. Production Company shall have the right to bring any personnel and equipment onto the Property and to remove the same following completion of use of the Property hereunder. Production Company shall have the right, but not the obligation, to photograph, film and use in the Picture the actual name, if any, connected with the Property or to use any other name for the Property. If Production Company depicts the interior(s) of any structures located on the Property, Grantor agrees that Production Company shall not be required to depict such interior(s) in any particular manner in the Picture. 3. TIME OF ACCESS. The permission granted hereunder shall be for the period commencing on or about _______________________________. Grantor agrees to indemnify and hold harmless Production Company from and against any and all claims relating to breach of its aforesaid warranty. 6. NO KICKBACKS FOR USE. Grantor affirms that neither it nor anyone acting for it gave or agreed to give anything of value to any member of the production staff, anyone associated with the Picture, or any representative or Production Company, or any television station or network for mentioning or displaying the name of Grantor as a shooting location on the Property; except the use of the Property, which was furnished for use solely on or in connection with the Picture.


8. RELEASE. Grantor releases and discharges Production Company, its employees, agents, licensees, successors and assigns from any and all claims, demands or causes of action that Grantor may not have or may later have for libel, defamation, invasion of privacy or right of publicity, infringement of copyright or violation of any other right arising out of or relating to any utilization of the rights granted herein. 9. MISCELLANEOUS. This constitutes the entire agreement between the parties with no modifications unless in writing signed by both parties. A photocopy of this Agreement shall be as legally valid and binding as the original and is herein granted to inure the benefit of all successors, assigns, heirs, executors, etc. of each party hereto. NON-FILMED LOCATION AGREEMENT

To the Producer: I, the undersigned owner or agent, whichever is applicable, hereby irrevocably grants to Producer, its employees, agents, contractors and suppliers, and such other parties as it may authorize or designate, to enter and use, for the purpose of: [INDICATE WHETHER PARKING, HOLDING, SERVING MEALS, STAGING, ETC.] the Property located at the address set forth above hereinafter referred to as the “Property” which Property consists of: [ADDRESS AND/OR DESCRIPTION OF PROPERTY LOCATION] (description), which permission includes access to and from the Property and the rights to bring and utilize thereon personnel, personal property, material and equipment.
