    Summary

    A�Generals 1. The WB-loaned Urban Environment Project is in two categories, i.e., (1) water

    pollution prevention and control of major river basins (the Dianchi Lake and the Erhai Lake) and (2) urban infrastructure construction of main cities (Lijiang City and Wenshan Prefecture), and is in the four prefectures (cities) of Kunming (Dianchi Lake), Dali (the Erhai Lake) and Lijiang as well as Wenshan. It deals with the sectors in drainage (including sewage disposal), water supply, garbage treatment, integrated river dredging, widespread pollution control, environmental monitoring & management and cultural heritage conservation. The project is composed of 27 sub-components distributed in 15 counties (cities and districts) of four prefectures (cities).

    2. Yunnan Urban Environmental Construction Project Leading Group Office and each prefecture (city) leading group is the executive organization of the project and each project-affected city and prefecture office and Project Owner are the implementation organizations. According to the latest feasibility study results and detail socio-economic investigation and project impact survey, the World Bank Representative Office in Yunnan Province has, with the assistance of East China Investigation and Design Institute, the Guope Huit Co. of France and the World Bank experts, compiled the RAPs respectively for the four prefectures and cities, and based on which, the Office prepares the RAP herein.

    B Project impact 3. In the period of Nov. 2006 ~ Jan. 2007, the Project owner, with the cooperation of

    local governments at different levels, administrative villages, village groups and PAPs as well as the project design unit, had carried out the main inventory in-kind survey item by item, including the population, houses and attached buildings, land and special facilities, within the preliminarily defined scope of project land requisition. In April –December 2007, an inventory in-kind survey for checking was carried out according to the latest F/S design output. Based on the field survey, the consulting unit had exchanged opinions with the project design unit and the Project Owner; by which, the potential project impact on the local society and economy have been considered and taken as key factors in comparative selection of the schemes. The design unit and the Project Owner has adopted some effective measures to reduce, where possible, the quantity of land requisition and number of inhabitants to be resettled; in selection of the scheme and arrangement of associated facilities, efforts have been made to keep the project away from the resident area, reduce the quantity of cultivated land to be requisitioned and observe the local planning requirement and the opinions of the local governments.

    4. The project will affect 28 administrative villages in 22 townships (towns) of 15 counties (cities), and a total of 3121 PAPs of 767 households will be affected, including 1870 persons of 442 households to be affected by land requisition, 971 persons of 263 households by temporary land occupation, 5 persons of 1 household by land borrowing for the project. In addition, 23 enterprises (807 person) and 130 individual business households (392 persons) will be affected. The detail survey into the project impact shows that a total of 3105.12 mu

    lands of various types will be acquired timelessly, including cultivated land 710.9 mu, garden plots 37.34 mu, fish ponds 32.0 mu, water pools 15 mu, woodland 476.25 mu, reclaimed waste land 177 muconstruction land 1120.63 mu, and the remaining lands are of unused land.

    5. Beside the land requisition, there are three sub-components of the project which will involve house relocation. The houses of totally 64084.81 m2 will be affected, including private houses of 13235.3m2 (9923.1 m2 belonging to 30 rural households with 139 persons), the urban residence of 3312.2m2 (32 households of 141 persons), collective-owned houses of 50689.51m2. Of the 62 households (280 persons) whose houses are to be relocated, 14 households (66 persons) should be resettled at other places, and 48 households (214 persons) will be resettled at original places. The project-affected properties include the special facilities such as for telecommunication and power supply, and the tombs and economic trees.

    C. Policy frames and entitlement 6. For those inhabitant unavoidably affected by the project, the resettlement policy

    target of the project is to avoid, to the possible extent, the negative impact of the project caused by the land requisition and house relocation according to the “Decision of The State Council on Deepening the Reform and Tightening Land Management” (No. 28 Document of 2004), “Land Management Regulation of Yunnan Province” and “Instructive Opinions on Improvement of Compensation System for Land Requisition” (Guotuzifa No. 238 Document of 2004) as well as “Involuntary Resettlement” OP4.12 and BP4.12 of the World Bank and the requirements set forth in its annexes. The properties of the PAPs will be compensated at their replacement cost, and efforts will be made to help the PAPs have sufficient opportunities to restore their original living standard or even better. The main principles are as follows.

    7. The key principles in the policies: (1) Efforts should be made to adopt measures to minimize the negative impact to the minimal; (2) The compensation and resettlement schemes should be such that the living standard of the PAPs can be improved or, at least, restored to that before resettlement; � Careful consultation should be carried out with the PAPs, so as to let them to have chance to participate in the activities from the planning to the implementation of the resettlement plan; (4) All the affected properties will be compensated on the replacement cost; (5) the principle of “house building first and house demolishing second” should be always be followed. Before land requisition and house relocation, the PAPs should receive the compensations of all the lost properties, i.e., the land requisition should never be carried out before the land and related properties have been compensated and the new residence is ready and transition subsidies are paid; (6) The borrower is responsible for raising the fund for resettlement compensation including the contingency for resettlement; (7) Confirmation of the qualification of the resettlers. The deadline for confirmation of the resettlers’ qualification should be on the date of issuance of the notice on land requisition and house relocation. After the date of the issuance, the PAPs should not be allowed to build new houses, extend or rebuild old houses; the use of the houses and lands should not be changed; and leasing of land and leasing and purchasing houses should not be allowed. In addition, the persons rushing into the defined areas after that date should not be qualified as resettlers; (8) the house compensation should be based on the replacement cost of the houses.

    8. According to the “Land Management Regulation of Yunnan Province”, the compensation for the vegetable plots and paddy fields is 6-8 times the yearly average output value of the previous three years before the land acquisition (same as below); that for irrigated fields, garden plots and lotus ponds are 7-9 times; the dry lands are 6-8 times; rotation cropping lands are 6 times, grassland and fish ponds are 3-5 times. The standards of resettlement subsidy for land requisition is: (1) for those units whose per capita cultivated land holding is over 6667 square meters, the total resettlement subsidy is 4 times the yearly average output value of the previous three years before the land acquisition (same as below); for those with per capita cultivated land holding is less than 6667 square meters, one time should be added for each reduced 50 square meters, and the max. resettlement subsidy for land requisition should not exceed 15 times the yearly average output value of the previous three years before the land acquisition; (2) the resettlement subsidy for requisition of garden plots, lotus ponds is 6 times and that for fish ponds is 4 times. According to the policies of the local counties and cities on compensation of land requisition, the regional comprehensive prices are adopted at Songming of Kunming City, Ancient Town and Ninglang of Lijiang City, and other counties and cities adopt the calculation by the times of the yearly average output value of the previous three years before the land acquisition. Because of the difference in geographical locations and in the output value of the crops, the land compensation standards are different from area to area, ranging 12880~88450 Yuan for paddy fields, 10380~29858 Yuan for dry land, 4900~9360 Yuan for woodland.1

    9. The compensation for temporary land occupation of the project will be calculated with the one-year cultivated land loss, standing crop and land reclamation fee. The project office will state in the construction contract to be signed with the construction contractor the way of using temporary occupied land, restoration requirement, compensation criteria for temporarily used land, etc. The contractor should sign the compensation contracts with affected villages based on the actual land area to be occupied by the project, and the contractor should restore the temporarily occupied land or pay additional expenses to the land owners for land restoration.

    10. In the F/S stage of the project, the design should be such that the quantity of house relocation should be reduced where possible. For those having to be affected by house relocation, the strategy is to get the substitutive houses, land, property, basic facilities and income source. In the 27 sub-components, there are three components which involve house relocation (Funing County Urban Garbage Clearing & Disposal Project, Waste Wastewater Management in Lijiang Ancient Town and Urban Drainage System under Dali City Jurisdiction). For the former (Wastewater Management in Lijiang Ancient Town), there are

    two resettlement methods for house relocation: (1) The existing buildings which are not consistent with the surroundings will be demolished and new buildings consistent with the old town style will be built (in the Ancient Town area), and the house replacement cost will be compensated to the affected households (or collectives), i.e., the building of framed- structure is 626.98 Yuan per square meter, that of brick-concrete structure 494.71 Yuan per square meter, that of brick-wood structure 367.9 Yuan per square meter and that of clay-wood structure 276.81 Yuan per square meter; (2) the compensation (replacement cost of houses plus land cost ) will be paid at one time to the households that are relocated to new host site, i.e., 600000 Yuan per mu for house plot. For Urban Drainage System under Dali City Jurisdiction, only simple houses (totally 100 m2) owned by collectives will be affected, and the compensation is 100 Yuan per square meter. For Funing County Urban Garbage Clearing & Disposal Project, only the collective houses of brick-wood structure (totally 60 m2) will be removed and the compensation of 350 Yuan per square meter will be paid to the Owners for the house replacement.

    11. the Project Owner of each sub-component should ensure that the entitlement of the PAPs relating house relocation should be obtained before the land leveling, house demolishing. The land compensation and house relocation subsidies should be paid to the affected villages or individuals. The compensation for houses, standing crop and lost properties should be directly paid to the affected individuals and enterprises. The compensation for affected power supply and telecommunication facilities and other infrastructures should be paid to the relevant departments for restoration.

    E�Measure for income and house restoration 12. All the PAPs will continue farming or the job that they are good at. In the 14

    administrative villages affected by requisition of contracted cultivated land, 13 villages are affected only by less than 5% the total cultivated land of the village (including 7 villages having affected by less than 1%), thus, the impact in this regard is little and will not impose serious impact on agricultural economy. After consulting with the affected village managements and PAPs, the rational restoration plans have been formulated for them and incorporated into the RAP in detail. According to the RAP, all the PAPs can either receive compensation directly or get land after land adjustment by the villages, so as to ensure that they can have land for farming. Those villages adopting land adjustment will use the compensation to improve the planting conditions, develop economic crops and conduct other non-planting activities. In the process of project construction, the affected households will have the priority to get the jobs without requiring special technical skills.

    The implementation of the project will bring about benefits and economic development chances to most of the public in the area. The effective implementation of the RAP will bring to some of the villagers affected by land requisition and house relocation the chances for improving living and production conditions and improving living quality. The project will play the active role in gearing up the economic development in the project-affected areas and will provide good environmental and social benefits.

    13. Among the 62 households (280 persons), fourteen households (66 persons) should be moved. In which, 4 households (22 persons) are of rural residents, they will be

    compensated by one-time cash payment, and will be resettled in new houses at the reserved construction land in (or outside of) the villages; and 10 households (44 persons) are of urban residents, they will be resettled by one-time cash compensation and at other places (i.e., on the west side of the fish pond of CCB on Shangrila Avenue in Ancient Town, where there is a piece of land totally 60 mu in area belonging to the state-owned land of urban construction). The house plot size should be 1.2 times the land size of the original house. The resettlement provides a good chance for the resettlers to improve the housing condition. For the households who have shops, their resettlement will be given priority in choosing host site for continuing their business. The houses will be compensated at the replacement cost.

    F�Institutional Organizations 14. Each prefecture (city) leading group, coordinated by Yunnan Urban Environmental

    Construction Project Leading Group, will entrust the Project Owner to assume the overall responsibility for implementation of land acquisition and resettlement work of the project strictly according to the RAP. All the four affected prefectures and cities and the affected counties and cities will set up leading groups and land requisition and house relocation offices.Each sub-project Owner shall assume the main responsibility for consultation, implementation, and timely payment and other entitlement of the PAPs, and the relevant townships and towns should provide assistance in this regard.

    G�Vulnerable groups 15. Of the villages affected by land requisition, those in Kunming City are Han’s

    villages, those in Dali Prefecture are Bai and Yi minority village, those in Lijiang City are Naxi, Bai and Yi minority villages, and those in Wenshan Prefecture are Zhuang minority villages. Of the PAPs, the minority population affected by permenant land requisition and house relocation accounts 61.7% the total affected population. For esteeming the traditional habits and maintaining the social relations of the minority people, all the PAPs will be resettled in their original villages and communities.

    16. For the economically vulnerable people, including old people living alone, widows’ households and households in extreme poverty, the project will provide additional financial and material support. In implementation, the vulnerable groups, whenever found, will receive the following additional assistance according to the RAP: (i) assistance free of charge in building houses and family moving; (ii) special subsidy for them to maintain the living level during house building period. The actual amount of subsidy should be determined according to the actual conditions and their needs.

    H�Appeal and discrepancy solving mechanism 17. The PAPs who loss houses will have the chance to select house plots, the PAPS who

    lose farmland will have the chance to select suitable income sources instead. All the affected villagers have their right to express their opinions on how to use the compensation fee received by the collectives.

    18. In case of occurrence of discrepancies, the PAPs should first appeal orally or in writing to the village committees or the township land requisition and house relocation office. If their appeal cannot be settled in two weeks thereafter, they can request re-check the case at the county land requisition and house relocation offices in one month; if it can nor solved in

    two weeks thereafter, the WB-loaned project coordination leading group will make efforts to coordinate with the project office of the related project sub-component so as to get a solution. If necessary, the discrepancy can be settled finally at the court according to the Civil Procedure Law of the People’s Republic of China.

    I�Monitoring and Evaluation 19. The internal and external monitoring and evaluation are detailed in the RAP. The

    IBRD-loaned Environment Protection Project Office of Yunnan Province will engage an independent monitoring organization to implement the external monitoring and evaluation. This organization should evaluate whether and to what extents the PAPs (1) have received their entitlement on time; (2) have completely restored their living, production and income levels. The organization should also conduct a baseline survey before the house relocation, one survey in half a year during house relocation and a yearly follow-up survey in the two years after the relocation; the representative samples (affected households/ villages) should be selected.

    20. The IBRD-loaned Environment Protection Project Office of Yunnan Province is now establishing a seasonal reporting system. The office will report to the WB on the progress of land requisition and house relocation by means of Seasonal Project Report. The office will submit the annual independent monitoring and evaluation report (or twice reports for a year) during implementation of the resettlement work.

    J�Fund raising and planning 21. The budgetary resettlement cost is totally 164701300 Yuan (including taxes),

    accounting for 7.8% of total, including 15878700 Yuan for Kunming (9.64% of the total), 16478700 Yuan for Dali (10.01%), 112481400 Yuan for Lijiang (68.29%) and 19862600 Yuan for Wenshan (12.06%); of which 40000100 Yuan is for land (28.1%) and 69632500 Yuan for house (48.9%). It includes all cost including compensation for house, land and other properties, transition subsidies, subsidy for vulnerable groups, overhead for implementation, cost of monitoring and evaluation, etc. Project-affected prefecture and city governments will ensure the associated fund for the budgetary cost of the resettlement work so as to prevent any fund shortage in the process of the resettlement.

    22. The resettlement implementation schedule has been formulated according to the project construction schedule agreed by the World Bank after submitted by the project executive agency. It is planned to start land requisition by the end of 2007 and completed in Jan. 2008; and the house relocation is planned to complete from April 2007~ Dec. 2008, and the land adjustment will be finished in Dec. 2008.

    Project Description

    Project Background

    Yunnan Province is located in the southwestern frontier of China, neighboring Guizhou Province and Guangxi Chuang Autonomous Region on the east, linking Sichuan Province on the north, leaning against Tibet Autonomous Region on the northwest and bordering Burma, Laos and Vietnam to the west and south. It has a total land area of 394000 km2, including mountainous areas about 94% of the total, and has a total population of 44.15 million, in which the minority population accounts for 33.4%. Since reform and opening-up to the outside, especially during the 10th Five-Year Plan, its economy keeps in rapid growth. The GDP in 2005 reached 347.2 billion RMB yuan, per capita GDP 7,833 RMB yuanannual GDP growth rate 8.9%and urbanization rate amounting to 29.5%.

    However, the following two main development problems arose in the course of rapid urbanization and economic growth.1 Degradation of urban environment, such as the decline in water quality of Dianchi Lake;2 universal shortage of urban infrastructure supporting urbanization process, especially in small towns. Although pollution control has been strengthened in recent years, pollution problems of surface water near the cities in Yunnan and main lakes remain serious. Moreover, urbanization and rapid development in tourism has exceeded the existing capacity of urban infrastructure and brought large pressure and challenge to urban living conditions.

    Yunnan has regarded solving of the aforesaid development problems as the priority to promote urbanization and the precondition to realize the 11th Five-Year Plan as well as the sustainable development of social and economy. Based on summing up the experience in execution of WB-loaned first-stage projects and motivated by a desire to seek for further cooperation with the WB, the province raises the Yunnan WB-loaned Urban Environment Project. The project covers four parts of two categories, i.e., water pollution prevention and control of major river basins (the Dianchi Lake and the Erhai Lake) as well as urban infrastructure construction of main cities ( Lijiang City and Wenshan Prefecture), deals with the sectors in drainage (including sewage disposal), water supplly, garbage treatment, integrated river dredging, widespread pollution control, environmental monitoring & management and cultural heritage conservation in the four prefectures (cities) of Kunming (Dianchi Lake), Dali (the Erhai Lake) and Lijiang as well as Wenshan. The Project was approved by the State Council in September 2005 and has been listed in the WB-loaned candidate project plan of the state in the fiscal year of 2006-2008.

    Project Components and Description

    The WB-loaned Urban Environment Project is composed of 27 sub-components distributed in 15 counties (cities and districts) of four prefectures (cities). The sub-components of the project are described in Table 1-1, the land occupation is shown in Appendix 1 for details, and the locations thereof are shown in Fig. 1-1.

    Resettlement Plan

    According to domestic capital construction procedures and the WB’s requirements for safeguard policies, the resettlement action plan of the WB-loaned Yunnan Urban Environment Project is carried out. The report includes four sub-reports prepared according to the packaged projects of the four prefectures (cities) and the the report on resettlement action plan of the provincial packaged project is prepared on the basis of the four sub-reports.

    During the report preparation, the site work was conducted according to the project construction site scope defined by the current design output of the project design organization and the project owner.

    Measures to Mitigate Project Impacts

    Project construction will certainly involve land acquisition, relocation and resettlement and meantime inevitably have impacts on the original productive and living conditions of the local residents. In project planning and design stage, impacts of the project construction on local society and economy should be considered as far as possible in scheme optimization and selection and it will be regarded as the key factors for scheme optimization and selection. In designing sanitory landfills, it should be fully demonstrated whether leakage will occur in the landfill sites which results in pollution for groundwater and soil. With a view to decreasing land acquisition and resettlement where feasible, the design institutes and Project Owners have taken some effective measures. In the aspects of scheme selection and arrangement of other auxiliary facilities, they have avoided residential areas and occupied less farmland as far as possible and conform to the local planning and oppoinons of the the local governments.

    � On the equal conditions, they avoided relocation and impacts on the surrounding villagers’ living in siting of refuse dumps, pipeline, sewage disposal facilities and environmental monitoring devices. Take Xundian Urban Refuse Disposal Project as an example. The refuse landfill of the project has two optional sites, i.e., Xiacun Site (Option 1) and Qingshuigou Site (Option 2). The site of Option 1 is too close to the city zone, there are villages within a range of 200m, the refuse dump is less than 100m to the railway, thus resulting in great pollution on the villages and moreover the storage capacity is small and far from the requirements set forth in relevant specifications. Qingshuigou Refuse Landfill in Option 2 is located 7.5km to the north of Xundian county town, about 5km to the original refuse piling sites and its west is 1km to the railway from Kunming to Dongchuan and 2.5km to Tianshengqiao Highway and there is no village within a range of 1km. The design institute at last recommended Optiion 2 as the final scheme.

    � Under equal conditions, cropland has been avoided or occupied less where possible in siting of refuse dumps, pipeline, sewage disposal facilities and environmental monitoring facilities. Take the drainage system under Dali City Jurisdiction as an example. Through site investigation and research, the project design institute proposed that most sewerage pipeline be laid along highways or in wasteland and exposed pipes be avoided where possible and meantime, it is also considered that the ground surface will be restored after construction, which can not only satisfy requirements of engineering

    design but also avoid permanent land occupation of the local villagers’ farmland or decrease damage to crops. The sanitory landfill is desinged in light of the topographic conditions and valley and wasteland are used as far as possible. The refuse disposal center is arranged by making use of the existing urban idle land.

    � Pay attention to environmental protection and avoid such environmentally sensitive areas as water source, schools, hospitals, cultural relics and historic sites and scenic spots as far as possible. The sites should not produce pollution on the surrounding environment or the pollution should not exceed the allowable range set forth in relevant natioal laws and regulation as well as current standards. During siting, it is considered that there is a certain safe distance from the lower wind direction place of the dominant wind direction to the residential area.

    � Potential inconvenience brought to the local residents’ production and living by project construction has been fully consided in design. For example, setting pedestrian passageways in the sections with relatively concentrated residents to facilitate their traffic; damage to infrastructure of channels due to project construction will be restored to ensure its integrity.

    � Optimize construction organization planning to shorten construction period and decrease excavation and filling in large quantity and reasonably arrange the time period for restoration of special items and construction to reduce impacts of project construction on local areas. For instance, housing demolishing and reconstruction is generally chosen in the slack seasons, and land acquisition after harvest of young crops and construction of bridge and culverts are completed as far as possible before spring ploughing to facilitate farmland irrigation and drainage and flood prevention.

    Implementation of Land Acquisition and House Relocation for Stage I Yunnan

    Environment Project

    The Yunnan Environment Project Office has rich experience in implementing the WB-loaned projects accumulated since 1996 when the managemen and implementation of the WB-loaned Stage I Yunnan Environment Project, which has 20 sub-components distributed in Kunming, Chenggong, Puning, Gejiu, Shilin, Mengzi, and Xuanwei countyies and cities, covering sewager treatment, water supply, solid waste disposal, industrial pollutino control, environmental monitoring and measurement, etc.

    In order to ensure the successful completion of the Stage I project, Yunnan Province established in Jan. 1996 the “Land Requisition and House Relocation Leading Group for Yunnan Environment Project” which was headed by the leader of the provincial government and membered by the leaders of the governmental departments. Under the group, an office was set, and the land requisitin and house relocation group of the provincial project office was responsible for planning, implementation, organization and coordination of the project. The corresponding leading groups were also established at the project-affected cities and counties. The work involved in the land requisitin and house relocation is carried out on the principles of observation of the state laws, regulations and the WB guidelines, and strictly followed the RAP of WB-loaned Stage I Yunnan Environment Project approved by the World Bank.

    The key conclusions of the external monitoring for the WB-loaned Stage I Yunnan Environment Project are: (1) the project is implemented on the principles of close observation of the state laws, regulations and the local regulations; (2) the project is implemented in comformity with the involuntary resettlement policy of the World Bank; (3) the land requisition and house relocatin are carried out based on the Yunnan Provincial Action Plan for Land Requisition and House Relocation; (4) the resettlement of the PAPs of the project is mainly by means of internal land adjustment and providing a few of job opportunities. The individual project components and relevant cities and counties provide corresponding resettlement methods based on the needs and possibilities and the principles followed are targeting at the wills and interest of the PAPs; (5) the living standard of the PAPs are improved or at least reach the standard before resettlement.

    Project Impact

    Determination of project impact scope

    Permanent land acquisition for project

    The permanent land to be acquired by the project is mainly for construction of the landfill, rubish transition station, sanitation center, rubish storage, access road, sewage treatment plant, soil purification trough, automatic monitoring station for river flow to the lake, automatic river flow monitoring station, river harnissing works, man-made wetland, afforestation along the river. The areas which are within the scope of the permenant land acquisition and where the living and production of the local inhabitants will be seriously affected by the project construction and can not be restored afterward, shall be determined as the project impact scope for the project land acquisition and house relocation. Based on the project proposal or the feasibility study reported completed by various design institutes in April ~August 2006 for the sub-projects of the City Environmental Construction Project of Yunnan Province, the scope for the land acquisition and house relocation for each sub-project was respectively determined during that time, and was adjusted according to the revised F/S reports completed in April –December 2007.

    Temporary land use for project construction

    The land to be temporarily used for the project inlcude that for spoil area, construction camps, construction plant, temporary accesses, water diverting and sewage interceptor network, and temporary slurry store, etc.

    Result of project impact investigation

    From the end of Nov. 2006 to mid Jnuary 2007, with the participation and cooperation by the local government, administrative villages, village groups and the PAPs, the Project owner, with the assistance of the project design units, conducted the investigation, item by item, into the main inventory in kinds within the preliminarily determined project impact scope of land acquisition and house relocation, covering status and number of the PAPs, houses and attached building, lands, and special facilities, etc., which lasted 45 days. In April ~Dec. 2007, based on the revised F/S study result, the investigation team conducted check on the inventory in kinds.

    The project impact scope for the project land acquisition and house relocation will affect 28 administrative villages of 22 towns (townships) in 15 counties (districts). A total of 3121 inhabitants in 767 households will be affected, including 1870 of 442 households affected by permenant land acquisition and 971 of 263 householde. In addition, 392 inhabitants of 130 individual bussiness households will be affected and 807 inhabitants of 23 enterprises will also be affected. A total of 3105.12 mu land will be requisitioned, and 1123.79 mu land will be temporarily occupied. The project will also affect some scattered fruit trees, part of living and production facilities as well as some telecommunication, broadcasting, Unicom and Mobilecom facilities and cables will be affected. The land acquisitin will affect 1326 minority people, and 424 mu cultivated land belonging to the minority people will be permantly acquired. The project will affect

    The PAPs of this project include those affedted by permenant and temporary land requisition, house relocation, and those working with individual bussiiness households and staff of enterprises. A total of 4320 inhabitants will be affected by the project, including 3121 of 442 households are affected by land requisition and house relocation (including 1870 of 442 households affected only by land requisition, 280 of 62 households affected only by house relocation (urban residents); 971 persons of 263 households are effected by temporary land occupation), 807 persons of 23 households are affected by relocation of enterprises they work with; and 392 of 130 individual bussiness households will be affected, which are excluded in the residents.

    Land to be permanent acquired

    The project will permenantly acquired land of 3105.12 mu for its 24 sub- components, in which, the land acquired by 19 sub-components includes collective-owned land and that by 13 sub-components includes state-owned land. Of all the acquired land, the cultivated land is 710.9 mu (22.9% of the total), garden plot 37.34 mu (1.2%), fish pond 32 mu (1%), water pool 15 mu (0.5%), woodland 476.25 mu (15.3%), reclaimed waste land 177mu (5.7%), unused land 536 mu (17.3%) and construction land 1120.63 mu (36.1%). The details are shown in Table 2-3 and 2-4.

    Temporary land acquired for project construction

    The land to be temporarily acquired means the land to be temporarily borrowed during the porject construction period, for arranging the temporary construction plants or facilities such as spoil areas, construction camps and plants, water diversion and interception stockpiling of slurry. Among the 27 sub- components, 14 components will have the construction activities within the acquired land and will not temporarily borrow land, the remaining 13 components will temporarily occupy a total of 1123.79 mu land at this project stage. The Project Office will define in the contract to be signed with the construction contractor the way of using the temporarily acquired land and the requirement of land restoration after the construction, etc.

    Houses and attached buildings to be relocated

    In this project, only the Wastewater management in Lijiang Ancient Towm component, the Urban drainage system under Dali County Jurisdiction, and Solid Waste Management in Funing County require the house relocation, totally 64084.81m2 (only 100 m2 collective-owned simple houses effectd by the Urban drainage system in Dali and 60m2 collective management house effected by Solid Waste Management in Funing County ), including private-owned houses of 13235.3m2 (which is divided into rural houses and urban houses according to the land property). Of the houses, 9923.08 m2 are of rural residence (139 persons of 30 households), 3312.22m2 of urban residence (141 persons of 32 households) and 50849.51m2 of collective-owned houses. No illegally-built houses are found so far. The details for the urban residence to be relocated are detailed in Table 2-6, and the rural residence to be relocated is indicated in Table 2-7.
