de minimis Summary Brief Description of Project The purpose of the project is to improve vehicular and pedestrian safety along Route 26 in Woodstock. The need for this project is because the corridor does not meet modern standards for roadway structure, drainage infrastructure, and pedestrian facilities. This section of Route 26 was constructed in the 1930s and has not been fully rehabilitated since then. The proposed action (Alternative 3) would include rehabilitation and, in some areas, reconstruction of 2.51 miles of Route 26 in Woodstock. The proposed sections that would require reconstruction at Sta. 46+00 to 62+00 and 96+50 to 112+00. The proposed action would retain 12’ travel lanes and include 5’ shoulders. Drainage improvements would consist of underdrain with the installation of new catch basins and some outlets within the village of Bryant Pond and open ditching outside of the village. All areas with cuts and fill would be loamed and seeded. The existing horizontal and vertical alignments of the roadway would remain largely the same, but one exception would be Sta. 52+00 to 62+00 where the roadway would be lowered and moved approximately 6’ away from the St. Lawrence and Atlantic Railroad. Existing pavement would be recycled in place. The south side of Route 26 from Sta. 17+30L to 39+20L would include sidewalk reconstruction. Sidewalks would meet Americans with Disabilities Act (ADA) compliance. Curbing would be added intermittently throughout the southern half of the project area from Sta. 14+00 to 114+75. Curbing would be bituminous, with the exception of granite curbing at Sta. 33+75R to 39+20R. Crosswalks with ADA compliant ramps with detectable warning pads would be placed at Sta. 21+50L, 22+50L, 33+75, 36+75L, and 39+20. The crosswalks would be located in the village of Bryant Pond. Use of 4(f) Properties and Impacts Section 4(f) of the Department of Transportation Act of 1966 and its revisions protects four types of properties; parks, recreation areas, wildlife and water-fowl refuges, and historic sites. Three Section 4(f) properties were found within the project area: historic sites, one park, and one recreational area. The following section describes 4(f) uses found within the property lines of the Section 4(f) properties. Property owner names & stationing are provided below for all rights impacts. Rights locations are also marked on the attached plans. Figure 1 below pictures the entire project area.
Historic Sites The following historic sites were found within the project area. Whitman Memorial Library, 28 South Main Street (Town of Woodstock; STA 29+40 L to STA 30+53L) National Register-listed Criteria A, & C, Architecture, Education The proposed action would require the use of approximately 1,705 SF of temporary construction rights at this location. Bryant Pond Historic District (Various Owners, STA 11+50R to STA 50+30R; STA 17+00L to STA 60+00L) National Register-eligible Criteria A & C, Architecture, Commerce, Social History

Contributing Resource The proposed action would require the use of approximately 1,160 SF of temporary construction rights and would permanently incorporate approximately 747 SF at this location.
2. 80 South Main Street (Session, Bonita & Stickland, Brian; STA 17+00L to STA 17+95L) Contributing Resource The proposed action would permanently incorporate approximately 509 SF at this location.

Public Parks The following public park was found within the project area. Town Common Park, Southwest corner of North Main Street and Lake Road (Resam Properties, LLC; STA 402+00R to 401+00R, 37+00L to 39+32L) Contributing Resource to Bryant Pond Historic District (also listed under historic sites above) The proposed action would require the use of approximately 173 SF for temporary construction rights at this location. Recreation Areas The following recreational area was found within the project area. Baseball Fields, Main Street before Lakeside Drive (Town of Woodstock, STA 60+05L to STA 70+00L) The proposed action would require the use of approximately .07 acres for temporary construction rights and approximately 506 SF for a drainage easement at this location. Wildlife and Waterfowl Refuges No wildlife and waterfowl refuges were found within the project area. Avoidance, Minimization, and Mitigation The proposed action avoids any physical impacts to historic buildings or structures. It further minimizes harm by utilizing in-kind materials for sidewalk and curb construction. Contributing features, such as stone walls and steps, would be retained. Analysis In coordination with the official with jurisdiction (ME-SHPO and Town Manager of Woodstock, Vern Maxfield) MaineDOT determined that portions of the historic sites, along with the park and recreational area, represent temporary occupancies of land so minimal as to not constitute a use within the meaning of Section 4(f). All conditions in 23 CFR 774.13(d) 1-5 are present, including:
• The land use is of short duration (less than the time needed for the construction of the project);
• There is no change in ownership of the land; • The scope of the work is minor;
• There are no temporary or permanent adverse changes to the activities, features, or attributes of the property;
• The land will be fully restored to a condition at least as good as prior to the project; and
• There is a documented agreement from the official with jurisdiction (SHPO) over the property with the above conditions.
Use of the remaining historic sites, along with the one recreational area, were found to have a de minimis impact due to the project having no adverse effect on the historic sites and recreational area in accordance with 36 CFR Part 800. The transportation use of the Section 4(f) properties, together with impact avoidance and minimization, does not constitute a net adverse effect to the activities, features, or attributes that qualifies the resources for protection under Section 4(f). Measures to avoid and minimize impacts to historic sites have been undertaken. In accordance with 23 CFR Part 774.5(b)(1)(ii) MaineDOT informed the ME-SHPO regarding the intent to make a de minimis impact determination via memorandum on September 4, 2019. On September 5, 2019, the ME-SHPO concurred. In accordance with 23 CFR Part 774.5(b)(2)(i), MaineDOT posted a public notice for review and comment of the 4(f) use of the Town Common and Baseball Fields. In accordance with 23 CFR Part 774.5(b)(2)(ii), MaineDOT informed the Woodstock Town Manager, Vern Maxfield, regarding the intent to make a de minimis impact determiantion via email from the Historic Coordinator. On September 20, 2019, the Woodstock Town Manager agreed via email that there would be no adverse effect to the Town Common and the Baseball Fields. A de minimis summary sheet identifying 4(f) uses and evaluation results for the properties are included below. Finding This transportation project is determined to have a de minimis impact on the historic sites, as well as one park and one recreational area. In accordance with 23 CFR 774.5(b)(1)(ii), the ME-SHPO was informed of the intent to make a de minimis impact determination on the Section 4(f) property for this proposed project on September 4, 2019. In accordance with 23 CFR Part 774.5(b)(2)(ii), the Woodstock Town Manager was informed of the intent to make a de minimis impact determination on the Section 4(f) properties for this proposed project on September 5, 2019.
