PRESIDENT’S MESSAGE

This has been a fun and busy year, serving as your president, and I am truly honored for the opportunity to serve you all. We have a great group of people volunteering with the chapter on the board and on the executive committee, and nothing would be possible without all the efforts of this amazing group. Thank you to everyone who has participated this year, whether serving in the chapter or in attending our events. Serving the members is why all of us are here, and it is always great to meet our members around the state. I am encouraged by the attendance at our past two chapter meetings, in Toledo and Cincinnati, which had strong attendance and many new faces. As a board, we want to provide opportunities for our members to network not only among each other, but to have access to talking with us directly in sharing their ideas for where the chapter should go and how to better serve everyone. Last year Aaron Wright, MAI, began the residential roundtable series to great success here in the Columbus area. Our event this year was held on November 20 in the Cleveland area, and had a strong attendance and outreach to the residential community like we saw last year. Our hopes are to continue these events around the state in order to further our reach into the residential world. Both nationally and locally, the Appraisal Institute has struggled to capture and maintain our residential membership. We hope to boost our outreach to this sector in order to provide the best service to this group where we have such an opportunity to expand and better serve our community. In addition to residential outreach, we have expanded our efforts in working with area universities. Currently, our Columbus course offerings are held at the Ohio University Dublin campus and we have recently offered our first course on the University of Cincinnati campus. This is to provide spaces better equipped to serve our students and provide the best experiences we can. In addition to holding courses at the local universities, we have been reaching out to the real estate department professors and students in order to build interest in the appraisal profession. We have maintained our “no cancelation” policy for all courses this year, with many seeing strong attendance levels, including the Litigation series that was offered in coordination with the Hoosier and Bluegrass Chapters. Starting this December and through the spring of 2020, we will be offering the USPAP courses around the state in order to bring the most up to date information to our members throughout our chapter. Continued. . . The Economic Seminar this year was a great event. The pre-seminar social was expanded this year in order to include the installation of officers and designation recognition moved from the crowded lunch hour on Friday. This was done to better recognize those who serve the Chapter and the achievements of our members as well as to offer more time for networking at the main event on Friday. Our hope is to continue to grow this event and hope as many of you attend as are available. We had a large group in attendance and a wonderful opportunity to talk one on one with the new designees and speakers from the seminar. There have been several changes behind the scenes in how the chapter operates this year. The first was the switch to the new Chapter Financial Management and Administration Program (CFMAP), which we began in April of this year. Thanks to the efforts of our treasurer and executive director, this seems to have been a fairly smooth transition so far. Secondly, national upgraded their management software with changes to the interactions of both chapter management and membership to the various components of the organization, most notably on the education side. While there are still some kinks being worked out, the new system should allow for easier navigating of the site and bringing our systems up to modern standards. In addition, the Mahoning Valley Chapter voted to dissolve in November, with those members now being brought into the Ohio Chapter’s group of professionals. We will continue to hold education and events in the area, as we do around the state and we hope to maintain the level of connectivity and service that the former Mahoning Valley members have experienced in the past. Finally, I want to again thank all of the members for the opportunity to serve as your president this year and all of the officers who have made this busy and eventful year a fun and educational time for me. State Level:

States address waiver valuation restrictions with legislation

supporting appraisers. Colorado, Illinois and Ohio are among the

states that have reconciled waiver valuation restrictions with

appraiser licensing laws. Other states are currently attempting to do

so. Here, the Appraisal Institute addresses the issue of valuation

waivers and explains how appraisers can provide them.

The federal Uniform Relocation Assistance and Real Property

Acquisitions Policies Act, known as the Uniform Act, requires state

and federal agencies that are engaged in the acquisition of real

property for projects receiving federal funding to have the properties appraised prior to negotiations with

the owners.

However, the legislation allows for a waiver valuation in two instances:

1. When property is donated, and the donor releases the agency from its obligation to appraise the

property, and

2. When property is purchased, and the acquiring agency determines an appraisal is unnecessary

because the transaction is uncomplicated, and the value of the property is estimated to be $10,000

or less. A federal agency funding a project may exceed the $10,000 threshold — up to a maximum

of $25,000 — if the agency offers the property owner the option to have the property appraised.

A waiver valuation is not an appraisal and typically cannot be prepared by an appraiser because it is not

required to comply with the Uniform Standards of Professional Appraisal Practice. Because an agency is

required to obtain a waiver valuation prepared by an individual who has “sufficient understanding of the

local real estate market,” waivers typically are prepared by federal or state agency employees who have

completed a minimum level of appraisal training and have demonstrated competence in completing

valuations for use in real property acquisitions by government agencies.

However, many state appraiser licensing laws contain an exemption from licensing requirements for

employees of federal, state, or local government agencies, so these employees are not required to be

licensed to provide an opinion of the value of real estate — appraisal or waiver valuation. They also are

not required to comply with USPAP because the preparers are not required to hold a state-issued

appraiser credential.

There might be circumstances where an agency has to utilize an appraiser, but since most state laws

require credentialed appraisers to comply with USPAP, they are prohibited from providing waiver

valuations. Some states have attempted to address this issue with appraiser licensing laws, which clarify

that an appraiser may provide a waiver valuation and not be subject to other licensing law provisions,

including the requirement to comply with USPAP.

Ohio - 5501:2-5-06 Real Property Acquisition Language:

(a) When an appraisal is determined to be unnecessary, the agency shall prepare a waiver valuation.

Persons preparing or reviewing a waiver valuation are precluded from complying with standard rules 1,

2, 3 and 4 of the "Uniform Standards of Professional Appraisal Practice" (USPAP), as in effect in the

2018-2019 edition, as promulgated by the Appraisal Standards Board of the Appraisal Foundation.

The Agencies:

FHFA pauses GSE Appraisal Modernization to focus on ending conservatorship. The Federal Housing

Finance Agency has paused Fannie Mae and Freddie Mac programs that address appraisal innovation

and modernization in order to focus on taking the government-sponsored enterprises out of

conservatorship, the Appraisal Institute reported November 11. The pause also gives the FHFA time to

gather more information on the valuation profession and the GSEs’ modernization efforts.

While there is no official announcement of the pause, the move is consistent with comments from FHFA

Director Mark Calabria about Fannie Mae and Freddie Mac, especially about preventing them from

competing with each other for market share while in conservatorship. Calabria, speaking at the

Mortgage Bankers Association conference in Austin, Texas, in late October, reportedly said that he

wanted the GSEs to leave conservatorship with the same market share they had when taken in, and

that once they’ve exited, they can compete.

Testing of so-called ”hybrid” or bifurcated appraisals is expected to continue while the FHFA gathers

additional industry and stakeholder feedback. Pre-existing and narrowly focused appraisal waiver

programs also will continue. However, some elements of the appraisal modernization plan that involved

data will now only involve a desktop appraisal or a full interior inspection appraisal. Joint development of

the Uniform Appraisal Dataset and the Uniform Collateral Data Portal is unaffected by the pause.

The information gathering and review process may involve a request for information early next year in

which input will be sought on an array of issues related to the valuation process.

The Chapter's annual economic seminar included various members of the banking, appraisal, and real estate-related industries, i.e. economists.

Donald J. Gossman, SRA was the dynamic keynote speaker. His topic, My Client The FBI, had the nearly 200 attendees riveted as he recounted the brave and fascinating story of how he helped the FBI bring an illegal home flipping/mortgage fraud team to justice.

The Appraisal Institute and the AQB require full attendance (100%) to obtain credit while the Ohio Appraisal Board requires 100%. A Designated Member will

not receive credit for a seminar more than once in a 5 year cycle. An appraiser will not receive credit for a seminar more than once in three years.

**As of 3/6/2019, Business Practices & Ethics has been adjusted by the AQB and OH Appraisal Board to allow for 6 hours continuing education credit. It will
