What is MDLmedical.com?

MDLmedical.com provides an easy-to-use, transparent marketplace for Buyers and Sellers, enabling hospitals and medical centers to save money, maximize profits and focus on their core mission of patient care.

How does MDLmedical.com work?

Qualified MDLmedical.com members are invited to list excess medical device inventory for sale to other qualified members on the secure MDLmedical.com platform. As well, members may quickly and easily search MDLmedical.com for items to purchase. Members are encouraged to establish “wish lists” of medical devices they currently use, and will be notified by email when those items become available from other MDLmedical.com members.

A Buyer may purchase items from multiple Sellers in a single transaction. MDLmedical.com will notify each Seller, and will track each item until it reaches the Buyer. Upon satisfactory receipt by the Buyer the purchase funds are released to the Seller.

Buyers and Sellers may ask questions of each other and communicate anonymously on the MDLmedical.com platform through its chat room and email notification system. Only after a price is agreed upon and purchase paid are the identities of the members revealed.

Who can use the service? How can my facility join?

To become a member of MDLmedical.com you must be a licensed and accredited hospital or surgical center. Simply fill out the qualification forms, read and accept the terms of use, and MDLmedical.com will review your application. Most applications are processed within 24 hours and members can begin trading immediately thereafter.

How does an MDLmedical.com transaction affect the liability issues for hospitals that buy and sell?

The MDLmedical.com platform is a tool used by one hospital interacting with another. Use of the product resulting in damages is either caused by the product or the misuse of the product by the personnel in contact with it and/or implementing its intended purpose.

MDLmedical has consulted in depth with legal counsel on this issue. The laws affecting products liability vary from state to state, with most, but not all states having adopted some version of the Uniform Products Liability Act. Generally, it is the manufacturer on whom all liability rests for producing a defective product. While those in the sales chain can be, and virtually always are, named as parties in litigation, if they didn’t tamper with

the product, sell it when it was out of date, specifically recommend the product for off-label or inappropriate use or engage in malpractice or negligence in the use of the product, it is usually the manufacturer who is ultimately liable.

We do not believe that a hospital that participates in the MDL sales network increases its exposure beyond that which it would have had if used the product in a surgical setting rather than transferring it to another hospital. If a doctor operating at the hospital made use of the product and the patient was injured by the product, the hospital would likely be sued as the institution providing the product, the doctor would generally be sued for installing the product and the manufacturer would be sued for manufacturing it. If the only claim against the hospital and doctor were based on the use of the product (and not on the hospital’s own negligence), both physician and hospital would probably cross claim against the manufacturer, who would generally be responsible to indemnify both the hospital and doctor for the loss.

Because laws vary from state to state and factual circumstances differ, MDL urges you to consult with your own legal advisors and risk management personnel.

Is there a charge for the use of the MDLmedical.com platform?

There is no charge for MDLmedical.com members to list inventory for sale or to browse items to purchase. Only on a completed transaction is a service fee charged to the Seller. That charge is deducted from the transaction amount.

Who pays the MDLmedical.com service fee?

How long does the Buyer have to approve the purchase?

Within 3 days following the receipt of the item, the Buyer may reject the product by notifying MDLmedical.com and returning the product to the Seller. The Buyer’s funds will then be refunded in full. If MDLmedical.com has not been notified after the 3 days, the product will be deemed acceptable and the transaction complete with release of funds, less MDLmedical.com’s service fee to the Seller.

Who from my facility can use the service?

The MDLmedical.com administrator from your hospital can determine access to the site, add additional users, and set individual user permission levels and passwords.

Is the MDLmedical.com site secure?

Yes, the MDLmedical.com site is certified SSL secure and no financial transaction information is retained within site.

Can I only trade the items that MDLmedical.com retains in its database?

Users may add items not in the database. When entering such items (after clicking on “Item not listed”) certain required information about the items will be requested. The item will be reviewed by MDLmedical.com for approval to assure the items meet MDLmedical.com’s standards and parameters as described in the MDLmedical.com “Terms of Use.” Most applications for new listings are processed within 24 hours.

How long can I keep an item in my “cart”?

Items chosen will remain in the cart for 24 hours, after which they will be returned to the inventory as “Listed Items”.

What if the product in question has been recalled by the manufacturer or FDA?

It is the manufacturers’ responsibility to see that all recalled products are removed from the marketplace, regardless of their location. How is a purchase/sale tracked?

All transactions are tracked through the built-in email messaging system and order tracking and shipment tracking systems.

Can a hospital add its own information into the transaction?

Yes, in various locations Sellers and Buyers can attach shipment and product information that stays with the transaction, such as budget, cost center, or department ID’s.

What form of payment does MDLmedical.com accept?

MDL accepts MasterCard, Visa, Discover and American Express. MDL encourages its members to consider ACH, wire transfer arrangements.

How do I get live support/answers to questions not listed here?

Live support for the MDLmedical.com platform is available during normal business hours across the time zones with member participation. Online support and email questions are also available via the web site.
