WHAT IS A NO FAULT DIVORCE?
Fault Divorce
When divorce was first made possible,
it was available only in situations where
one of the two spouses did something
“wrong”
A couple who wanted to divorce had to
state grounds for divorce
Grounds for divorce typically included
adultery, abandonment, cruelty or
similar breaches of good conduct
No Fault Divorce
No fault divorce, on the other hand,
means that neither spouse did any
specific action or made any specific
breaches leading to the divorce
Instead, a no fault divorce means that
the couple simply cannot get along or
has irreconcilable differences
No Fault Divorce in California
In California, all divorces are now No
Fault divorces
It is not possible to file for divorce in
California on fault grounds
This means even if your spouse
cheated on you, was abusive or
abandoned you, you will still file for a
no fault divorce
Irreconcilable Differences
When a person files for a no fault
divorce, he will list irreconcilable
differences as the grounds for the
dissolution of the marriage on his
divorce forms
An attorney can assist with the
completion of divorce forms in order to
help move the divorce along as quickly
and effectively as possible
