    “Condition ”, “innominate term ”, and “warrantie ” are three categorie u ed to cla if term in a contract. Their level of importance in the e eof the law varie , with “warrantie ” eing the lea t important, and “condition ” eing the mo t important.

    “Condition ” are term that the partie con ider o important that it mu t e performed. If a part fail to perform a condition, the other part i

    entitled to treat the contract a eing at an end. Once the reach of a condition ha een e ta li hed, the innocent part ma choo e to either:

    1. Terminate the contract and ue for damage , or

    2. A ffirm the contract (i.e. the innocent part continue to perform it contractual o ligation ), ue for damage and pur ue other remedie like

    injunction or pecific performance.

    For in tance, in a contract for the rep air of a computer, a condition could e expre l tipulated the partie uch that the repairer ha to u e

    afe part to replace the fault one . If the repairer utili e u par replacement part , the cu tomer ma choo e to regard thi a a reach of an

    e ential condition and ue the eller for damage . The cu tomer ma even choo e to terminate the contract and look for another repairer.

    “Warrantie ”, on the other hand, do not refer to warrantie that come together with the purcha e of certain item like mo ile phone or

    electronic good . In legal terminolog , the word “warrant ” i u ed to identif a le important term of the contract. If a warrant i reached, the

    innocent part ma ue for damage for the lo uffered, ut he i not allowed to terminate the contract. If he doe o, he ma in tead find

    him elf eing ued in turn for unju tified contract termination.

    “Innominate term ” refer to contractual term that lie in lim o. If the innominate term i an important one (i.e. a reach of the term would e o

    eriou a to deprive the innocent part of u tantiall the whole enefit it wa to o tain from the contract), the innocent part ma terminate

    the contract and o tain other remedie . However, if it i read to e a minor term (i.e. a reach of the term would not e o eriou a to deprive

    the innocent part of u tantiall the whole enefit it wa to o tain from the contract), the innocent part ma not terminate. It ma onl ue for

    damage and other remedie uch a pecific performance.

    The general rule to differentiate etween a “condition” and a “warrant ” i to determine whether the term deal with the primar o ligation of the

    contract. The intention of the partie toward that particular term i al o an important con ideration. In the event of a reach, whether an

    innocent part can terminate the contract depend on the following factor :
