P, \W. 2621/24.WHEREAS it is provided by Section 233 of "The RoadDistricts Act, 1919," that Rates throughout a Districtshall be uniform, except insofar as a Board may fixRates for any Townsite or any area defined for thanpurpose by Proclamation tut a higher figure theBunts in the said section set forth: And whereas it is(fesired to approve of and define the area hereinafterdescribed as an area within which the Wongan-BalliduRoad Board may rate at such higher figure: Now there-fore I, the said Governor, by and with the advice andconsent of the Executive Council, do hereby approve ofand define the area described in the Schedule hereto asan area in which the Wougan-Ballidu Road Board mayfix its rate at such higher figure as aforesaid, within thelimits mentioned in Section 233 of "The Road DistrictsAct, 1919."

WHEREAS it is enacted by Section 14 of "The Ver-min Act, 1918," that the Governor may by Order inCouncil constitute any defined portion of the State aVermin District for the purposes of this Act, andspecify the boundaries thereof ; and also may assign aname to such District and alter such name: Andwhereas it is enacted by Section 45 of the said Act thatthe Governor may appoint the Board of any Road Dis-trict to be the Board of any Vertnin District, the boun-daries whereof are the same as those of the Road Dis-trict, or which is comprised within the Road District:And wheroas by Order in Council published in the Gov:.,ernment Gazette on the 20th day of June, 1924, theGovernor constituted that portion of the State comprisedwithin the boundaries of Warren Road District to be aVermin District for the purposes of the said Act to beknown his Warren Vermin District; and by Order inCouncil published in the said Gazette of the smile datethe Governor appointed the Board of the said WarrenRoad District to be the Board of the said Warren Ver-min District: And whereas by Order in Council pub-lished in the Government Gazette on the 23rd day ofJanuary, 1925, the Governor altered the name of thesaid Warren Road District to that of Manjimup RoadDistrict: And whereas it is now deemed expedient toalter the name of the said Warren Vermin District tothat of NInnjimap Vermin District and to confirm theappointment of the Board of the said Warren RoadDistrict, under its present name of Ma njimup Road Dis-trict, a-s the Board of the said Manjimup Vermin Dis-trict: Now, therefore, His Excellency the Governor,acting with the advice and consent of the Executive)Council, and in exercise of the powers conferred by thesaid Act, cloth hereby alter the name of the said WarrenVermin District to that of Manjimup Vermin District,and doth, hereby confirm the said appointment of theBoard of the said Warren Road District, under its pre-sent name of Man:runup Road District, as the Board ofthe said Maidininp Vermin District for the purposes ofthis Act.

Lake Grace Road Board.By-law.

P.W. 2864/24; P.W. 1179/27.WHEREAS by "The Road Districts Act, 1919," "TheCattle Trespass, Fencing, and Impounding Act, 1882,"and other Statutes, the Road Board of any Districtempowered to make By-laws for all or any purposes inthe said Acts mentioned, the Lake Grace Road Board,in pursuance of the powers vested in the said Board,under and by virtue of the said Acts, and of every otherauthority enabling it in that behalf, doth hereby makeand publish the following By-laws:

Part 1.Interpretations.

1. In these By-laws the interpretations set out in" The Road Districts Act, 1919," shall apply, in addi-tion to which the following terms shall, unless the con-text otherwise indicates, bear the meaning set againstthem in the Road Districts Act, or respectively, that isto say:

" The Act""The Road Districts Act, 1919," andall amendments thereto which may hereafter comeinto force.

"Board"The Lake Grace Road Board."Board Room" shall be the office, hall, or building

in which the meeting of the Board is held fromtime to time.

"District"The District under the jurisdiction ofthe Lake Grace Road Board.

"Secretary"The Secretary of the Board.All other interpretations to be prescribed in the Road

Districts Act or other Acts or Regulations thereunder.

Duties of Secretary.2. The duties of the Secretary shall be(a) To attend all Board meetings;(b) To attend all Committee meetings;(c) To take notes of minutes and prepare reports of

Committees(d) To conduct all correspondence, and to give the

other officials instructions, as directed by theminutes, and carry out the resolutions of theBoard as contained in such minutes;

To answer all questions on the Board's business;To see that the accounts are audited monthly, and

the balance sheets prepared and published inthe Government Gazette yearly, and any otherduties specified under "The Road Districts Act,1919";

To prepare and place before the Board themonthly financial statement at the end of eachmonth of the financial year;

(h) To supervise the preparation of the Rate Booksand the Board's Electoral Lists, to examineproof of the latter, and to arrange for the dis-tribution of copies prior to the elections; alsoto attend all Courts of Revision or Appeal; tomake the necessary -arrangements for the elec-tions; to issue instructions to the Supervisor inaccordance with the Board 's resolutions ;

To keep all books up to date, in accordance withinstructions issued by the Minister and addi-tional instructions of the Board;

(j) To check all accounts sent into the Board, andsee that all accounts for works have stated inthem the authority under which such workshave been clone, and to check all returns madeby the Collector or other of the Board's officersand see that the counterfoils of the receiptbook accompany all returns; to supervise andattend to the due payment of all moneys com-ing through the hands of the Board's officersand payable to the credit of the Board;

(k) To report to the Board at its next meeting anyofficer neglecting to make his returns as pro-vided, with the necessary vouchers attachedthereto

To pay into the Bank, after receipt, to the creditof the Board, all moneys received by him onbehalf of the Board, when such moneys shallamount in the aggregate to the sum of £5 orover, with the exception of moneys granted bythe Government, which are paid into theTreasury;

(m) To see that all moneys received, with the excep-tion of Treasury credits, are lodged to thecredit of the Board in the Bank not less fre-quently than every second day, and more fre-quently if the total amount held exceeds £50;

(u) To see that no payments to the credit of theBoard shall be made by any officer exceptthrough the Secretary, or such other officer asmay be acting temporarily in that capacity;

(0) To readily and cheerfully obey all lawful com-mands or orders of the Board, and to attend toall other matters affecting the finances andwelfare of the Board and not herein specified;

To see that all bonds and other forms of securityto be taken from the contractors are, prepared,and that the security required of servants istaken within due time, and report as to suchmatters to the Board;

To report to the Chairman any servant of theBoard who has been guilty of neglect of duty,,or who is incapable of performing the dutiesallotted to him;

(r) To exercise, subject to any directions given bythe Board or Chairman, control over all ser-vants of the Board;

To see that no receipt is on any other than theforms prescribed by the Acts and Regulationsunder which authority is given for the issue ofsuch receipts;

(t) To be responsible for the issue of receipts on theproper prescribed forms and that all receiptsissued are in proper sequence.

Duties of Supervisor.if. The duties of Supervisor shall be(a)

The Supervisor shall have the control of works,plant, and all property of the Board, and shallissue instructions to the foreman, and shall secthat same are faithfully carried out. Shouldthe foreman be guilty of insubordination or dis-obedience, or be found incapable of performingthe duties allotted to him, the Supervisor shallreport the matter to the Chairman, who shallinquire into the matter and, if necessary, shallsuspend the foreman, and report the matter cothe next meeting of the Board;

(h) To prepare proper plans and specifications forall works and improvements as regards roadsand culverts under the control of the Board;examine all materials to be employed in suchworks, and to see the same faithfully and pro-perly executed and performed, and watch theprogress and formation thereof ; submit allspecifications and plans to the Board beforetenders are called;

(c) To see that the work of cleaning and repairingall public roads and footways is properly car-ried out;

OD To see that no labourers are engaged but thosethat are able-bodied;

(e) To see that all drains, sewers, culverts, andbridges are maintained in a state of efficiency;

(t) To see that all servants under his control carryout their duties efficiently, and to report anydeparture therefrom;

(g) To attend to Board and Committee meetings ifrequired;

(h) To specially examine all roads throughout theDistrict at least once each six months, or asrequired by the Board;

(i) To supply monthly, or as required, to the Boardreturns of all work completed or in progress,with remarks thereon.

Duties of Collector.4. (a) The Collector shall collect moneys that may

he due to the Board, issuing receipts in the Board'sprinted forums for payment, and entering particulars ofall payments in the book provided by the Board for thatpurpose;

(b) The Collector shall make his financial report andpayments to the Secretary every fourteen clays, or asotherwise required by the Board from time to time.

Appointment of Officers.5. No permanent appointment shall be made to any

office under the Board until after an advertisement hasbeen published in one or more local newspapers callingfor applications from persons competent to fill such anappointment. All appointments shall be made by reso-lution passed by the Board.

G. The election of all officers shall be conducted by ashow ot hands unless a ballot be demanded.

7. The salary or allowance attached to the officeunder consideration of the Board shall be fixed in adcases preceding the appointment, and the salary of anyofficer when fixed shall not at any time be consideredwith a view to its increase or reduction unless speciallyauthorised by a meeting of the Board, at which at leasta quorum is present.

8. All complaints against servauts of the Board mtistbe in writing, and must in every case be signed by theperson or persons complaining, and no notice whatevershall be taken of any complaint not made in aceteidancewith this By-law. All such complaints as are receivableshall be addressed to the Chairman, who, upon the re-ceipt of such complaints, shall have power to investigati,the same, and he shall report thereon to the Board attheir next meeting.

Meetings and -Proceedings.9. Notice shall be given in writing by the Chair-

man or Secretary of ordinary or regular meetings ad-journed.

10. Meetings of the Board shall be of two kinds--'Ordinary'' and "Special." Ordinary meetings are

the regular meetings held in pursuance of these By-laws for the transaction of the general business of theBoard, including meetings adjourned for the purposeof any incomplete business, but An adjourned meetingwould not exclude any business which was considerednecessary to transact. Special meetings are thosecalled under Section 130 of the Act, and shall includethose called by the Chairman in response to a requisi-tion signed by three members, and the notices for suchspecial meetings shall have such special business noti-fied thereon for which the meeting was called, and forwhich each member shall receive seven days' notice.No business shall he transacted at a special meetingother than that for which the special meeting was calledfor: Provided, that any matter of urgency can be dis-cussed, with the ruling of the Chairman and the consentof those present. The ratepayers' meeting shall consistof one called under Section 143 of the Act, and theStanding Orders shall, so far as the Act allows, applyto the proceedings, but the provisions of the Act shallbe first complied with.

11. Ordinary meetings shall be held at the office ofthe Board once in each month, on the day and at thehour appointed from time to time by resolution of theBoard.

12. A special meeting may, on the requisition ofthree members e:-; lie Board, be called at any time in themanner prescril. .1 by the Act, but the Chairman maycall a special mee.i..g of the Board as often as he maythink proper. N.. business will be transacted at anyordinary or spi.lid meeting unless a quorum is present.

13. At any meeting of the Board it shall rest withthe majority of the members of the Board present toexclude the public from such meeting when, in theiropinion, it is expedient to do so.

14. At all meetings of the Board, when there is nota quorum present, or when the Board is counted out(which counting out shall take whenever thereshall be less than a quorum present, or within 30 min-utes after time for which the meeting is called), suchcircumstances, together with the names of the membersthen present, shall be recorded in the Minute Book.

15. The first business of all ordinary meetings ofthe Board shall be the reading of the minutes of thepreceding meeting aloud, with a view to their confirma-tion.

Voting,16. Each member (including the Chairman) shall

have one vote, and such Chairman shall, in case ofequality of votes, have a casting vote in addition tohis ordinary vote, and all questions at such meetingsshall be decided by a majority of the votes of the mem-bers present. All motions and amendments ,shall hedecided by show of hands, unless a division is demanded,before the next business is proceeded with.

Minutes of Meetings.17. The Minute Book prescribed by the Act shall he

kept, in which any item of business transacted by theBoard at a meeting shall be entered by the Secretary.Minutes of special or ordinary meetings shall be con-firmed at the next ordinary meeting. No discussionshall take place upon the minutes of proceedings, ex-cept as to their accuracy or for the rectification of aclerical error.

Standing Orders.The order of business at all ordinary meetings of

the Board shall be as follows, that is to say:(a) Reading and confirmation of minutes of last

ordinary also special meetings (if any);(b) Consideration of business arising out of such

option of the Board, despatched, and takingaction as may be deemed expedient in regardthereto;

(h) Consideration of tenders and ratification of con-tracts;

(i) Presentation of monthly statement and passingof accounts for payment;

(j) Motions of which previous notice has been given;(k) Motions without notice (by leave of the Board

under By-law 19)(1) General business;(m) Notice of motions.19. In the event of any member having urgent busi-

ness to place before the meeting, he may move thesuspension of the Standing Orders, and, if agreed toby the Board, such business shall take precedence ofall other.

Petitions.20. Every petition or memorial shall be respectful

and temperate in its language, and shall be presentedto the Board by a member only, and any member pre-senting a petition or memorial to the Board shall affixhis name to the beginning thereof, with the numberof signatures and any member presenting a petition

Orders of DebateSpeakers must not Digress.22. A member, when speaking, shall not digress from

the subject of debate.

Consideration of Reports.23. (a) If in a report of a Committee distinct re-

eommendations are made, the decision of the Boardmay be taken separately on each recommendation.

(h) Any report of a Committee or any portion there-of may be amended by the Board in any matter if itmay think fit, or may be referred back to the Com-mittee for further consideration.

(c) The recommendations of any Committee, whenadopted by the Board shall be resolutions of the Board.

Precedence of Chairman.24. When the Chairman rises in his place during the

progress of a debate any member when speaking, oroffering to speak, shall immediately resume his seat,and every member shall preserve strict silence, so flint-the Chairman may be heard without interruption, butthe member who was speaking may resume when theChairman takes his seat.

Notice of MotionAbsence of Mover.25. In the absence of a member who has placed a

notice of motion on the business paper for any meeting,any other member may at such meeting move thesame, or such motion may be deferred until next ordin-ary meeting of the Board.

Withdrawal of Motions.26. Except as elsewhere provided, no motion, after

being placed on the business paper, shall be withdrawnwithout the consent of the Board.

Motions to be Seconded.27. No motion shall be debated unless or until it

has been seconded.

Motions not to be withdrawn without Consent.28. When a motion has been proposed and seconded

it shall become subject to the control of the Board,and shall not be withdrawn without the consent of theBoard.

Amendment may be Moved.29. When a motion has been proposed and seconded

any member shall be at liberty to move an amendmentthereon, but no such amendment shall be debated unlessor until it has been seconded.

Motions and Amendments to be in Writing.30. No motion or amendment shall be debated unless

or until it has been reduced to writing, if the Chairmanso directs.

31. A motion or amendment not seconded cannot bediscussed by any member except the mover, nor put bythe Chairman.

32. In submitting a motion or amendment, the Chair-man shall put the question first in the affirmative andthen in the negative.

Further Amendment may be Moved on amendedQuestion.

33. If an amenment has been carried, the questionas amended thereby shall become itself the question 'be-fore the Board, whereupon any further amendment uponsuch question may be moved.

How subsequent Amendments may be Moved.34. If an amendment, whether upon an original ques-

tion or amended as aforesaid, has been negatived, thena further amendment may be moved to the question towhich such first-mentioned amendment was moved, andso on until there are no further amendments and thequestion is decided by the final vote in the affirmativeor negative: Provided that no more than one questionand one proposed amendment thereof shall be before theBoard at any one time.

Motions for Adjournment.35. No discussion shall be permitted upon any motion

for adjournment of the Board. If upon the questionbeing put on any such motion the same is negatived, thesubject then under consideration or next on the businesspaper shall be discussed, and it shall not be competentfor any member to again move a motion for adjournmentuntil half an hour has elapsed from the time of movingthe one that has been negatived.

Mover of Adjournment, when entitled to Priority.36. On resuming any discussion which has been ad-

journed, the mover of such adjournment shall be entitled,if he has not already spoken on the subject under dis-cussion, to speak first.

Notice of Questions to be given.37. Sufficient notice of every question shall be given

to the Chairman or member expected to reply, and, ifnecessary, reference to other persons or to documents.

Questions to be put without Argument.38. Every question shall be put categorically and

without argument.

Replies and Objections.39. No discussion shall ensue upon any reply or re-

fusal to reply to any question except by permission ofthe Board.

Mode of addressing Board.40. Members shall, on all occasions when at a meet-

ing, address the Chairman, and speak to each other bytheir official designation, as Chairman, or Secretary, etc.,as the ease may be, and, with the exception of theChairman, shall rise in their place and stand whilespeaking (except when prevented from doing so bybodily infirmity).

Speaker not to he interrupted if in Order.41. No member shall be interrupted while speaking,

except for the purpose of calling him to order, as herein-after provided for in pursuance of By-laws.

Limitation as to Number of Speeches.42. The mover of an original motion shall have the

right of general reply to all observations which havebeen made in reference to such motion, and to anyamendment thereon, as well as the right to speak uponevery such amendment. Every member, other than themover of an original motion, shall have the right tospeak once upon such motion and once upon every amend-ment moved thereon. No member shall, without theconsent of the Board, speak more than once upon anyone question or for longer than ten minutes at any onetime, unless when misrepresented or misunderstood, inwhich case he may be permitted to explain without add-ing further observations than may be necessary for thepurpose of such exflanation.

Determination of Questions.43. (a) All questions shall, if not otherwise decided

by law, be determined thus: Upon a question being putthe Chairman shah call for a show of hands for andagainst the question, and shall declare whether thequestion has been affirmed by the majority of memberspresent or otherwise. The decision of the Chairmanshall be final, unleas such decision be immediately chal-lenged and any rm mber rise and demand a division.

(b) Where any :member dissents he may request thathis name be recorded in the minutes as opposed to themotion, and it shall be so recorded.

Divisions.44. Upon a division being so called for, the question

shall first be put in the affirmative and then in the nega-tive, and the Chairman and all members present shallvote by show of hands, and the names and votes of theChairman and members present shall be recorded in theminutes by the Secretary.

Chairman may repeat Question.45. Time Chairman shall be at liberty to put any ques-

tion as often as may be necessary, to enable him to formhis opinion as to the result of time voting and declaresame.

Acts of Disorder.46. Any member who at any meeting of the Board

or any Committee commits a breach of ally By-law, orwho moves or attempts to move any motion or amend-ment embodying any matter beyond the legal jurisdictionof the Board or Committee, or who in any other wayraises or attempts to raise any question, or addresses orattempts to address the Board or Committee upon anysubject which the Board or Committee shall have nolegal right to entertain or discuss, or uses any languagewhich, according to the common usage of gentlemen,would be disorderly, or makes use of any expressioninconsistent with good order and decorum, or who saysor does any thing calculated to bring the Board or Com-mittee into contempt, shall be guilty of an act of dis-order.

Ruling of Chairman.47. (a) The Chairman, when called upon to decide a

point of order or practice, shall state the rule or prece-dent applicable to the ease, without further argument orcomment, and his decision shall be final in that particularcase.

(b) If the ruling of the Chairman be disagreed with,then the usual Parliamentary procedure may be adopted.

Members called to Order more than once.48. Any member who, having been called to order by

the Chairman for any infringement of any of the provi-sions of this By-law, or for any breach of decorum, shall,upon the request of the Chairman, withdraw from due

Removal from Board Roost Penalty for continuedBreach of Order, etc.

49. In the event of a member declining to withdrawfrom the Board Room, on being requested so to do bythe Chairman, the Chairmen may order his retirementuntil the termination of the sitting, and should suchmember disobey such order, he shall be deemed guiltyof an offence and shall be liable to a penalty not ex-ceeding one pound.

Disorder.50. If disorder arise at any meeting, the Chairman

may adjourn the meeting for a period of fifteen minutesand quit the Chair. The Board, on resuming shall, onquestion put from the chair, decide without debatewhether the business be proceeded with or not.

Appointment of Committee.51. The Board may at any time appoint one or more

members as a Committee to inquire into any matter andmake a report and recommendation thereon, but no Com-mittee shall incur any financial liability or in any waycommit the Board to any responsibility whatever with-out express and specific authority col:I'm:red by the By-laws or a resolution of the Board.

Finance and Accounts.52. All accounts, hills, and vouchers shall be sub-

mitted to the Finance Committee meeting and the ordin-ary general meeting, and, after being certified as cor-rect, 1111111 be paid by cheque. An account shall beopened with such Bank as the Board may from time totime direct, and all moneys received from whateversource, with the et:ception of moneys paid to the creditof the Board at the Treasury, shall be paid to the creditof the Board's account at such Bank. All cheques andorders drawn against. the Board's Bank or Treasuryaccounts must be signed by the Chairman and any onemember of the Board, and ill all cases countersigned bythe Secretary of the Board.

93. All moneys belonging to the 11 ::rd shall, within24 hours after they come into the hands of any officer,servant, or clerk, be paid to the Secretary or responsible,officer directed by the Board to receive ',awe.

Urgent Work.54. The Chairman, or, in the absence of the Chair-

nmu, any three members, may, in the case of urgentnecessity, authorise the expenditure of a sum not exceed-ing ten pounds on statutory works or undertakings: Pro-vided that, in such ease, they shall report the matter atthe next ordinary or special meeting of the Board.

55. Any member may, in a case of very urgnt neres-authorise the expenditure of a sum not exceeding

two pounds on statutory works or undertakings withinthe ward he represents: Provided that he must. reportthe matter at the next ordinary or special meeting ofthe Board.

Unauthorised Expenditure.56. Every item of expenditure, and every liability in-

curred by any Committee or member of the Board other-iviso than under the authority of the Act or of these By-laws, shall be deemed unlawful expenditure and a breachof this By-law by such person.

Conunon Seal.57. The Common Seal of the Board shall be kept in

the Board's safe. The Common Seal shall not be affixedto any deed or other instrument except by order of theBoard.

Offences, Omissions, or Neglects.58. Any person guilty of the following offences shall,

on conviction thereof, pay a penalty not exceeding Tenpounds:

(a) Damaging or destroying any building, dam, well,tank, pump, windmill, windlass, bucket, rope,piping,, troughiug, fence, gate or other pro-perty under the control of the Board;

Placing any placard or other document, writing,or printing on or otherwise defacing any houseor building abutting or contiguous to a publicroad, or any wall, fence, gate, or lamp-postwithout the consent of the occupier or ownerthereof;

Blasting any rock, stone, or other timber in ornear any road withOut the permission of theBoard, and not attending to such directions inregard thereto given by such Board;

(0)

(d) Placing, stacking, or storing within the imits ofany Townsite, in the open air, any cases, -paper,shavings, crates packed with straw or danger-ous or inflammable substances so as to be orlikely to become a source of danger throughfire.

Preservation of Trees.59. Any person who shall carelessly, wilfully, or

wantonly injure, destroy, carry away, or remove from itsplace any tree or shrub or plant standing in any of theroads, enclosure, public places, or reserves, or who shallcarelessly, wilfully, or wantonly injure, destroy, carryaway, or remove out of its place, or ride or drive against.any of the tree-guards, fences, or other protection tosuch trees, shrubs, or plants aforesaid, shall be liable toa penalty of not more than £10, and, in addition thereto,shall also pay the Board a SUM equal to the damage sodone: Provided, however, that the Board may givewritten permission to any person to grub out and removeany tree or shrub or plant standing in any of the roads,enclosures, public places, or reserves.

Prescribing Removal of Verandahs.GO. Any verandah or balcony which obstructs the

footway or roadway, or is dangerous, and all other ob-structions on the footways or roadways, or over the sanshall be removed, when ordered, within such time as shallbe notified by the Board, and all expenses incurred inremoving same shall be borne by the owner or occupierof such verandah or balcony or other obstruction,whether removed by the Board or otherwise; and anyperson whatsoever interfering or obstructing any offi-cer or person employed by the .Board ill carrying outthis By-law shall be liable to a penalty not exceeding£10.

Encroachment, etc.Removal of.GB On the order of the Board the Secretary or other

appointed officer may direct the removal within fourteendays of any building, fence, or obstruction or encroach-ment in or upon any street, lane, or public place underthe control of the Board.

In any ease where, after service of notice for sueltremoval, any such obstruction or encroachment has notbeen removed within the specified time, it shall be law-ful for the officer appointed by the Board to removesame at the cost and charges of the person so offending,and to proceed against the offender for the breach ofthis By-law, the penalty for which shall not. exceed 1L20for every day or part of a day during wide -h suchoffence shall be committed or continued after the expiryof the notice prescribed. therein.

Lighting.G2. Any unauthorised person shall light, put mt

when lighted, or in any other way interfere withlamp belonging to the Board, or shalt damage or (1,.-.11..,ysuch lamp, shall pay, in addition to the value of t:tichdamage, if any, on conviction, a sum not exceeding

Water Supply.63, person who shall injure or destroy all well,

bore, pipe, tank, or place of storage for water, or anymachinery, appliances, or property used in connectiontherewith, shall be liable to a penalty not exceeding £5,and also shall pay to the Board the sum of such damages.

G4. Any person who shall waste, or allow to escape,foul, pollute, or taint any water contained in a bore,pipe, tank, or place of storage, shall be guilty of anoffence against this By-law, and shall be liable to apenalty not exceeding £20.

65. No person shall pollute, or cause to be polluted,any watercourse, pool, tank reservoir, or other waterwithin the district.

GG. Any person or persons leaving Open the lid of anywell, or any gate of an enclosure surrounding any damor other water supply under the control of the Board,shall be guilty of an offence against these By-laws, andnotwithstanding any remedy for damages so caused shallbe liable on conviction to a penalty not exceeding £5.

07. Any person may with the consent of the Board,and upon Flynwilt of such reasonable fee as may he tle-Jimmied, remove any water from any well, bore, tank,or other place of storage under the control of the Illuar(1.For the purpose of this By-law the consent of the Boardshall be deemed to be given and remain in force untilnotice to the contrary is specifically given to ally suchperson, or is generally given by publication in a local

newspaper, or posted upon or in the vicinity of the well,bore, tank, or other place of storage to which suchnotice shall apply. After service or publication of suchnotice any person removing any water from any well,bore, tank, or other place of storage, the subject of suchnotice, shall be guilty of an offence and be liable to apenalty not exceeding £5.

Saud and Timber.68. Any person who shall remove any sand or other

materials from any lands under the control of the Boardwithout a license shall forfeit and pay on conviction itsum not exceeding £5.

Barbed Wire.69. Barbed wire shall not be allowed on the outer or

road side, or on top of any fence along any road withinany Townsite.

Any person offending against this By-law shall beliable to a penalty not exceeding

Fencing.70. The owner of any land abutting on any road in

any Townsite shall fence all such boundaries so abut-ting with such description of fence as may be directedby the Board, and shall maintain every such boundaryfence erected, or to be erected, in good order. In theevent of such fence not being erected or repaired afterdue notice has been given so to do, the Board may fenceor repair such fences, and recover the cost of so doingfrom the owner or owners of the land.

Bathing.71. No person shall bathe in any river or open pub-

lic water within the limits or abutting on the boundaryof the Road District within the jurisdiction of theBoard without suitable bathing costume or clothing.Every person offending against this By-law shall, forevery offence, be liable to a penalty not exceeding £211.

Depasturing of Cattle.72. Any person who shall turn loose, or suffer any

kind of animal belonging to him or under his controlto stray or go about, or to be tethered or depastured inor upon any road, recreation ground, or reserve shall onconviction be liable to a penalty not exceeding £5.

73. The owner of any animal suffering from an in-fectious or contagious disease shall not permit such ani-mal to be ridden or allowed to stray on any road, un-fenced land, or reserve within the District. Any animalso suffering may be slaughtered and destroyed withoutnotice and at the owner's expense.

71. The owner or driver of any such animal shall beliable, if convicted of a breach of this By-law, to apenalty not exceeding £10 and not less than £2.

Straying Stock.75. No owner or person having the custody or con-

trol of any animal shall cause, permit, or suffer suchanimal to stray on any road, public reserve, or otherpublic place, or in any unfenced laud abutting thereon,within the boundary of the Central Ward of the Dis-trict.

76. (a) Any contravention of By-law 76 shall be anoffence punishable under these By-laws, if the animalis a hull, boar, or stallion, by a fine not exceeding £20and not less than £2.

(b) In any other case by a fine not exceeding £10 andnot less than 10s.

Provided that this By-law shall not apply in the caseof stock whilst in charge of the Town Ranger duly ap-pointed by the Board.

Copulation of Stock.77. Any person who as owner or otherwise while in

charge of an entire horse, bull, or ass shall cause, allow,permit or suffer any such entire horse, bull, or ass totry to cover any mare or cow within any Townshipwithin the District, or shall cause, permit, allow, orsuffer any such entire horse, bull, or ass to be turnedloose in any yard or in any other place with any mareor cow for the purpose of allowing such mare or cowto be tried or covered, except in some yard, building, orother premises as shall be entirely and sufficientlyscreened from public view, shall forfeit and pay on con-viction a sum not exceeding £10.

Goats.78. (a) No person shall keep any goat within thy-

boundaries of the Central Ward of the Lake Grace RoadDistrict unless such goat shall have been registered andthe registration fee of sixpence paid to the Secretary ofthe Board.

(b) Every registration shall be renewed in the mouthof July in each year.

(e) The Board may refuse to register any goat if inthe opinion of the Board suitable accommodation hasnot been provided for keeping such goat.

(d) The penalty for breach of any of the precedingclauses shall be a 511111 not exceeding £5 for each breach,in addition to such sums as the Justices may direct ascompensation for damages done by such goats.

Public Pound, etc.79. The Lake Grace Road Board, under and be

virtue of the powers contained in " The Road DistrictsAct, 1919," and "The Cattle Trespass, Fencing, andImpounding Act, 1882," hereby appoint Lake GraceRoad District Public Pound, situated on Lake GraceTown Lot 115, Reserve 18667, to lie the Public, Poundfor the Lake Grace Road Board.

80. Any person who shall break, damage, or destroyany pound, fence, gate, lock, shed, trough, or other pre-mises, the property of the Board, sho II be liable topenalty not exceeding £5.

81. Any person who shall obliterate, deface, or dam-age any table of fees, placard, or other notice requiredby "The Cattle Trespass, renciiig, and Impounding Act,1882," shall be guilty of uo en'elice against this ID--law, and shall be liable to a penalty not exceeding £5.

82. Any person who shall release or attempt to re-lease any cattle which shall he lawfully seized for thepurpose of being impounded, whether such cattle be inthe pound or on the way to or from the pound, shall beguilty of an offence against this By -law, and shall onconviction be liable to a penalty nut e £5.

Trespass Fees.83. Trespass on unenclosed country land:-

For every entire horse, ass, or bull, in the day-time-not less than £2 nor more than £4.

For every such horse, ass, or bull, in the night-time-not less than £3 nor more than £5.

For every other head of "Great cattle," by day ornight-threepence.

For every head of "Small cattle," by day or night-one penny.

Trespass on enclosed land, whether town, country, orsuburban, not being a public street or thoroughfare in acity or town, or public cemetery:-

For every entire horse, ass, or bull, in the day-time-not less than £2 nor more than £4.

For every such horse, ass, or bull, iu the night-time-not less than £3 nor more than £5.

For every other head of cattle, by day or night -ginsum not exceeding 20 shillings.

Trespass on a public street or thoroughfare in a townor in an enclosed public cemetery:

For every entire horse, ass, nr hull-nut less than£3 nor more than £5.

For every other head or cattle---5 811111 of 10shillings.

Sustenance Fees.84.-For every horse, mare, gelding, mule, ass, camel,

pony, or head of horned cattle over twelve monthsold-3s. 6d.

For every colt, foal, or head of horned cattle under12 months old-3s.

For sheep, per head-6d.For every pig-3s.For every goat-2s.Such rates to be charged for each day of 24 hours.

No charge to be made for less than three hours.

Description and Quantity of Sustenance.85. For each head of "Great cattle"-28 lbs. of

chaff.For each head of "Small cattle " other than

pigs---6 lbs. chaff.For each pig-9 lbs. pollard or corn.

Mileage Fees.86. ''Great cattle"-One shilling and sixpence per

head per mile, with a minimum of one shilling and six-pence (1s. 6d.).

"Small cattle"-Threepence (3d.) per head per mile,with a minimum of threepence (3d.).

Damaging Roads.87. No person shall either wilfully or Begligiq

damage or destroy by means of horse team or any othermeans any road under construction or repair; any per-son found guilty of such damage or destruction shall beliable to a penalty not exceeding £20.

Any person who(a,) cuts or removes, without the emusent of ilw

Board, timber, earth, stone, or other materialfrom a road or reserve; or

(b) erects, without the consent of the 14tarcl, upon aroad so as to encroach thereon; or

(c) draws, without the consent a2oresilid, across thewaterside of a road, or across a drain, nxecptover a property constructed approach or eul-vert, a dray or other wheeled vehicle; or

(d) draws upon any road, timber, stone, or othermaterial otherwise than on a wheeled vehicle.or suffers such material when carried princi-pally or in part upon a wheeled vehicle to dragor trail upon a road, or draws upon a road awhim or timber carriage any portion of whichor any portion of chains attached thereto orany portion of other attachment trails or dragsupon a road,

shall be deemed guilty of an offence, against theseBy-laws and shall be liable to a penalty not exceeding£5 for every such offence.

88. Any person taking any plough, cultivator, orother implement over or along any road and therebydamaging or marking such road in such a manner whichin the opinion of the Board may indirectly cause ulti-mate damage to the road, shall be liable to a penaltynot exceeding £5.

89. Any person who draws upon any road anyvehicle the wheel or wheels of which are locked, unlessthere is placed at the bottom of such wheels somesufficient protection to prevent damage to such road,shall be liable to a penalty not exceeding £5.

To protect Bridges from Fire.90. Any person who shall light a fire (except by the

order of the Board), or who shall place any rushes orother inflammable substance under, near, or againstany bridge in the district, for the purpose of makinga camp or sleeping place, or for any other purpose, shallbe liable to a penalty of not less than £1 and not ex-ceeding £20.

Prevention of Trees falling across Road.91. No person shall make or leave a fire near any

road or reserve without taking proper precautionagainst such fire spreading.

92. No person shall ringbark or set fire to any stand-ing tree upon or near to any road or track.

Park Lands, Reserves, and Recreation Grounds,93. All park lands and recreation grounds shall be

open to the public daily for recreation purposes, except-ing as otherwise provided for in these By-laws. TheBoard shall have power to grant exclusive right to useand occupy any park lands or recreation grounds, orreserves placed under its control within the District,for holding public sports or amusements, to any re-sponsible person or persons or club, and any person orpersons obtaining such right shall be responsible forthe proper care of all fences, buildings, or trees, orother improvements upon or enclosing such park lands,recreation grounds, and reserves, and shall pay theBoard a fee to be fixed for admission on such occasion,and comply with the provisions of these By-laws andany Regulations passed by resolution of the Boardunder which such exclusive rights are granted.

94. No horses, cattle, or vehicles shall be allowedon any park lands or recreation grounds without thewritten permission of the Board.

95. All persons using or being upon any park lands,recreation grounds, or reserves shall at all times con-duct themselves in a becoming manner, and any personcreating any disturbance or annoyance to the publicshall be liable to be expelled from such lands by anypolice officer or officer of the Board.

96. The Board may, in its discretion, prohibit anygames or gymnastics front being played or carried. onby any person or persons upon any park lands, recrea-tion grounds, or reserves on a Sunday, Christmas Day,or Good Friday.

97. No person shall oiler for sale on any reservesoy provisions, refreshments, or other goods of anyKind, nor carry on any games, or boxing or °them sine.-iar shows, nor use any firearms, except with Hi.- expresssanction of the Board and payment of such fee as maybe demanded.

95. The Board or any person duly authorised maymai,- charges for admission for adults, and for horses

hides or motor cars, to any reserve or definedp,- on thereof, with free entry for chiffirea (amine

under live years of age.b. Stun person to whom the use of nay reserve is

gil n for picnic, sports, races, or other use shall lie heldresponsible fur the immediate removal or all rubbishbrought there011 OH the occasion of such use, and adeposit noh (..ccialing £5 shall be paid as it guaranteefor due reline:al of such rubbish. On the removat ofsuch rubbish in the satisfaction of the Board; the de-posit shall be returned.

100. No person shall damage or injure any tree,shrub, or plant in any park lands, recreation grounds,or reserves. Any person offending against this By-lawhall forfeit and pay on conviction a penalty not ox-

tiding £10 for every such offence.101. The Board may allow to any person who pays

the i vs for which he is liable within thirty days ofsuch rates becoming due, a percentage by way of dis-count of five per centum on the amount of such rates.

Hawking.102. No person shall be permitted to hawk fruit, fish,

'neat, poultry-, game, or vegetables, or any article ofmerchandise, without first having obtained a licensefrom the Board and payment of fees as per Schedule" A" hereto annexed.

Schedule " A.''Fees for a Hawker's License.

For a License to hawk fish, meat, poultry, game, fruit,or vegetables-5s.

For a License to hawk merchandise£5.A Hawker's License shall be issued tor a term of 12

months from date of issue.

Penalties.103. Where any person by these By-laws or any of

them is required to do or perform any act, and such actis not done or remains undone or unperformed, it shallhe lawful for the Board to pert urn, the same and chargethe cost and expenses against such person, and theamount thereof may be recovered summarily.

104. Every person who does, permits, or suffers anynet, matter, or thing contrary to any of these By-laws,or commits or permits any breach or neglect thereof,shall be deemed guilty of an offence against these By-laws, and, where not otherwise provided, shall be liableto a penalty not exceeding £20 for every such offence.

105. All penalties or other sums recovered under pro-visions of these By-laws shall, unless otherwise provided,be paid to the Board, and shall become the property ofand form part of the ordinary income of the Board, ex-cept so much as may be paid to any informer.
