WWBA PRESIDENT’S MESSAGE Love and hate, the two most extreme emotions, are not the antithesis of each other. Actually, sci- entific research has found that some of the neural circuits re- sponsible for hate are exactly the same as those that are ac- tivated when feeling romantic love. However, news stations inform us daily that the world is fractured, and that its disparate members - characterized by their cultural, religious, racial, or gen- der differences - are irreconcilable. As February has been named the Month of Love, it is timely to inquire whether the ties that bind us will outweigh the conflict between us. Clearly, I’m not a prognosticator or a seer. Much to my chagrin, I don’t have a crystal ball or a time machine, either. I can only say that the Westchester Women’s Bar Association will continue to advocate for positive change and the equal administration of justice for women and children in society. This change will come by em- bracing our differences and challeng- ing inequity, not by struggling against each other. Committee, First Judicial Department andHon. John W. Sweeney, Jr., Associate Jus-tice, Appellate Division, First Judicial De-partment. This well attended CLE was heldon January 6, 2016 at the WWBA generalmembership meeting.

As the panel explained, there are sev-eral detailed rules pertaining to attorneyadvertising (see 22 NYCRR 1200 Rules 1.0,7.1, 7.3, 7.4 and 7.5). The most basicrule is that an attorney cannot make falseor misleading statements. The panel alsoexplained that statements claiming that anattorney is an “expert” or “specialist” in aparticular legal field are prohibited. It is,however, permissible to provide details ofeducation and degrees received, the fieldof law in which the attorney practices,teaching positions, memberships in barassociations, and involvement in profes-sional organizations. Copies of computerbased advertising must be kept for oneyear, and screenshots of websites must betaken and saved every 90 days. The firstpage of the website must state that it is anattorney advertisement.

quirements (see 22 NYCRR1200 Rules 1.5 and 1.15 and22 NYCRR Parts 1215 and137). Retainers should set forthhourly rates and expenses. Incases where the client will bebilled more than $3,000, a writ-ten letter of engagement or re-tainer is required. Bills need tobe clearly and sufficiently de-tailed and presented to clientsin a timely fashion and clientsmust be advised about any feesplitting arrangements with an-other attorney. Non-refundableretainer agreements are prohib-ited. If a lawyer advertises afee for a particular service, shecannot charge more than theadvertised fee. Furthermore, feearbitration is mandatory wherea dispute arises and the feesthat are challenged are between$1,000 and $50,000.

Finally, the panel enlight-ened the attendees about someissues that present a prohibitedconflict of interest (see 22NYCRR 1200 Rules 1.0; 1.6;1.7; 1.8; 1.9 and 1.10). Inmost circumstances, an attor-ney should not represent bothparties to a lawsuit or partieswho are forming a joint ven-ture because they may not re-veal a client’s confidential in-

There may be a “thin line between love and hate,” but we canstrive to be on the beneficent side of it. The Westchester Women’sBar Association will support you in your efforts to seek commonground in diversity and to seek harmony where there is discord.February, the Month of Love, is the perfect time to start. ◗

An Interview with Hon. Kathie E. Davidson

Q: You have been a long-standing and active memberof the WWBA. Please tellus about all of your involve-ment with the WWBA overthe years.A: The association is invalu-able to women in the law,and as such I very muchenjoy WWBA events, semi-nars and fellowship with mycolleagues. I have served asa panelist at a Court En-forced Visitation forum, andalso as a participant in theFamily Children and theCourts committee meetingsand programs.

Q: You began as a LawGuardian in Family Court,ultimately became a FamilyCourt Judge, and then the

Q: What challenges have youfaced as a woman lawyer andwoman judge?A. Still, in 2016, I notice thatthere is a trend that womentend to be relegated to “gen-der-normative” roles.

February Litigation Tip

A line of cases developed in the First and Second Departments in which trial judges, in their discretion,were permitted to decline to consider expert affidavits submitted on summary judgment motions wherethe expert was not previously disclosed pursuant to CPLR 3101(d)(1) (see Singletree v Lowe, 55 AD3d861 [2d Dept 2008]; Garcia v City of New York, et al., 98 AD3d 857 [1st Dept 2012]; DeSimone v City ofNew York, et al., 119 AD3d 422 [1st Dept 2014]). In most of these cases, the appellate courts found theexpert affidavit should have been rejected. Without expert proof on the motion, one party faced a direresult. Further confusing matters, the Second Department in 2012 decided Rivers v Birnbaum, 102 AD3d26 [2d Dept 2012], where the court held expert disclosure occurring after filing the note of issue andcertificate of readiness did not render it automatically untimely; rather, it was only one factor in deter-mining whether the disclosure is untimely. This led to further unpredictability as to how trial courtsshould decide expert disclosure issues on summary judgment motions.

With the amendment of the Summary Judgment Motion Rule 3212(b), it is now clear that “the Courtshall not decline to consider the expert affidavit because the expert exchange pursuant to CPLR 3101(d)(1)was not furnished prior to the submission of the affidavit.” This amendment applies to all summaryjudgment motions made on or after December 11, 2015. The change will standardize the submissionof expert proof on summary judgment motions across the state with predictability for the bar andworkability for the bench. What remains to be seen is whether parties will be more inclined to wait toserve expert responses until summary judgment motions are filed or the time to make such motions hasexpired.
