1. The tot lot is covered for injuries, however the association may want to require the individual running thedaycare to have a general liability policy which will help create a firewall between the day care operation and theassociation. I do have an outlet to write daycare facilities and coverage can be placed fairly quickly. I wouldrecommend no less than 1million per occurence in liability. The outlet we are able to write thru also carries a

sexual misconduct endorsement which I would strongly recommend to the operation as well. I would alsorecommend the the association be listed as an additional insured on the daycare insurance policy as well.

2. As far as physical damage from a tree falling on a car, that would be covered under the homeowners personalauto policy. The only way it would be a neglegent act that would allow the associations policy to pay thedamages, for example, would be if the association had just planted the tree and it was not properly supportedand fell over and hit the car. This would be considered a neglegent act by the association. As a general rule

there must be neglegence for a liability policy to cover a loss. An act

of god is not considered neglegence and the personal auto would then become primary under the state ofMarylands rule.

Gentlemen, the following is the previous list with comments from our 7/3/06 meeting. I would not be honest if Ididn't express my disappointment in what appears to be a lack of progress/momentum on the issues we decidedto tackle.

Clayton, it is my opinion that as President you need to set an example and light some fires. It sounded like somemembers wanted our next meeting established in order to set a deadline. Why not check with Dwayne to seewhat dates are available for a meeting room in early September and circulate them among us in order to pick amutually convenient date and time.
