Executive Session6:00 PM

The regular meeting of the Mansfield Township Committee was held on the above shown date with the following in attendance: Mayor Robert Higgins, Deputy Mayor Alfred Clark. Committeeman Sean Gable, Committeewoman Janice DiGiuseppe, Committeeman Arthur Puglia, Solicitor Michael Magee, and Clerk Linda Semus.

           Mayor Higgins called the meeting to order followed by the following opening statement.

               Public notice of this meeting pursuant to the Open Public Meetings Act NJSA 10:4-6 to 10:4-21 has been satisfied. Notice of this meeting was properly given in the annual notice, which was adopted by the Mansfield Township Committee on January 2, 2014. Said Resolution was transmitted to the Burlington County Times and the Trenton Times, filed with the Clerk of the Township of Mansfield, posted on the official bulletin board at the Municipal Complex, filed with the members of this body and mailed to each person who has prepaid any charge fixed for such service. All of the mailing, posting, and filing having been accomplished as of January 8, 2014.

A motion was offered by Committeeman Puglia and second by Committeeman Clark to go into executive session by adoption of the following resolution. Motion carried.

RESOLUTION 2014-9-1RESOLUTION AUTHORIZING CLOSED EXECUTIVE SESSION

WHEREAS, Section 7 of the Open Public Meetings Act, Chapter 213, P.L. 1975 [NJSA 10:4-12(B)] permits the exclusion of the public from a meeting in certain circumstances; and, WHEREAS, this public body is of the opinion that such circumstances presently exists; NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Mansfield, County of Burlington and State of New Jersey as follows: The public shall be excluded from discussion of, action on and reviewing the Minutes of

the hereinafter specified matters. 1. The general nature of the subject matter to be discussed is as follows: pending litigation,

on-going litigation and personnel3. It is anticipated at this time that the above subject matter will be made public when the

matter has been resolved and approved for release by the Township Solicitor.

Regular Meeting 7:30PM

            The regular meeting of the Mansfield Township Committee was held on the above shown date with the following in attendance Mayor Robert Higgins, Deputy Mayor Clark, Committeeman Sean Gable, Committeewoman Janice DiGiuseppe, Committeeman Arthur Puglia, CFO Joseph Monzo, Engineer Michael Galante, Attorney Michael Magee, Clerk Linda Semus, and Deputy Clerk Barbara Crammer.

Mayor Higgins called the regular meeting to order followed by the Salute to the Flag and a moment of silence.

A motion was offered by Committeeman Puglia and second by Committeeman Gable to come out of executive session.

Attorney Magee explained that the discussion in executive session included pending litigation, on-going litigation, and personnel.

ENGINEER’S REPORT

Filling in for Engineer Staszewski was Engineer Michael Galante, who reported that they are working on the proposal for the reconstruction of White Pine Road and this should be available early next week.

Bids were received on the municipal fire prevention riser pipe renovations. Direction from the Committee to see if funds are available is pending. Falasca Contractors were the low bidders although action will be taken tonight.

Engineer Galante said they are waiting for direction for soliciting quotes for the drainage repairs at the Meadows. Solicitor Magee said there will be a meeting with the developer and their attorney and engineer with Administrator Fitzpatrick and Jef Jones on Friday.

Work is to start the week of the 8th on the municipal water service.

The contractor is waiting for a delivery in order to start the Lynwood Farms pump station and they anticipate its arrival the week of the 15th.

They are waiting for the revised roadway improvement plan for Tuscarora Enterprises so that a contribution amount can be determined for that project.

Mayor Higgins spoke of prior conversations about drainage improvements on property off Mansfield Road East. Engineer Galante said they did an analysis for the cost. They predict around $5,000 to $7,000. They can either solicit quotes for the work or do a change order to the existing contract which is what he recommended. Mayor Higgins felt someone from Remington & Vernick to contact Administrator Fitzpatrick with information so we can move forward.

A motion was offered by Committeeman Puglia and second by Committeeman Gable to accept the Engineer’s Report. Motion carried.

ORDINANCES

ORDINANCE NO. 2014-12

AN ORDINANCE TO AMEND THE CODE OF THE TOWNSHIP OF MANSFIELD BY DELETING AND REPEALING SECTION 13.2 OF CHAPTER 60 THEREOF, “STATUTORY PROVISIONS APPLICABLE TO THE MAPLETON AND FOUR SEASONS COMMUNITIES” AND REPLACING IT WITH A NEW SECTION 13.2 OF CHAPTER 60, TO BE ENTITLED “STATUTORY PROVISIONS APPLICABLE TO THE MAPLETON AND FOUR SEASONS COMMUNITIES”

Be it enacted by the Mansfield Township Committee as follows:Section 1.

The Code of the Township of Mansfield is hereby amended by deleting and repealing Section 13.2 of Chapter 60, Statutory Provisions Applicable to the Mapleton and Four Seasons Communities.Section 2.

The Code of the Township of Mansfield is hereby amended by adding thereto a new chapter, to replace Section 13.2 of Chapter 60, hereinabove repealed, to be Section 13.2 of Chapter 60, Statutory Provisions Applicable to the Mapleton and Four Seasons Communities, to read as follows:

WHEREAS, the community of Four Seasons within the Township of Mansfield is among one of the newer neighborhoods in the Township; and

WHEREAS, the community of Four Seasons Public Offering Statement prohibits overnight parking on certain streets within the community, and WHEREAS, the community has experienced an increase of overnight parking on the streets within the community; and

WHEREAS, the original developer of the neighborhood, K. Hovnanian at Mansfield, Inc. has filed a written request with the Township for the application of the provisions of Subtitle One of Title 39 of the Revised Statutes of the State of New Jersey to the semi-public roads, streets, driveways and parking lots in the community to enhance, among other things, the safety of the public; and

WHEREAS, the Department of Transportation has conducted a field investigation with regard to this request and has advised the Township of various regulations that can be recommended for approval:

NOW THEREFORE BE IT ORDAINED AND ESTABLISHED, by the Township of Mansfield in the County of Burlington and State of New Jersey that the following amendment shall be established and become enforceable:

A. General Parking Regulations.1. All vehicles must park in designated areas and between the lines

provided.2. No person shall stop or stand a vehicle upon any of the streets or

parts of streets described below, except in areas covered by other parking restrictions.

G. Tow-Away Zones. Any vehicle parked or standing as to obstruct or impede a normal flow of traffic or block, entrances or exit ways, loading zones, no parking zones, oil -fills, any grassy area pedestrian walkway, or present in any way a safety or traffic hazard may be removed by towing the vehicle at the owners or operators expense. I. Signs. All signs shall conform to the current edition of the Manual on Uniform Traffic Control Devices pursuant to N.J.S.A 39:4-198 and N.J.S.A. 39:4-183.27. The developer shall erect all such traffic control devices in accordance with this Ordinance.

J. Penalties. Unless another penalty is expressly provided for by statute, every person convicted of a violation of this ordinance or any supplement thereto shall be subject to a penalty of not less than $35.00 nor more than $350.00 or imprisonment for a period of not more than fifteen (15) days or both. K. Dedication.

In the event of the dedication of any of the roads, streets, or parking lots encompassed by this Ordinance to the Township of Mansfield and the acceptance of such roads, streets, or parking lots by the Township, such roads, streets, and parking lots shall become subject to the provisions of Title 39 of the Revised New Jersey Statutes in the same way and manner as any other public street including the penalty provisions of laws and ordinances applicable to public rights of way, notwithstanding the provisions of Section J, above. L. Severability.

Should any portion of this Ordinance be declared invalid or unenforceable by a Court of competent jurisdiction, the remaining portions shall remain valid and of full force and effect.

M. Effective Date. This Ordinance shall become effective upon adoption, approval by the Commissioner of the Transportation, and publication in accordance with law.

Mayor Higgins opened the Public Hearing. Hearing no comments, the publichearing was closed.

Committeewoman DiGiuseppe made a motion to adopt Ordinance 2014-12. Themotion was second by Committeeman Clark.

Barbara Willis, 63 Greenbrook Drive, questioned the purpose of the ordinance.

Committeeman DiGiuseppe explained the ordinance gives the police authority to enforce

overnight parking in Four Seasons from 1am to 5am.

The above motion was carried.

ORDINANCE 2014-13REFUNDING BOND ORDINANCE PROVIDNG FOR THE REFUNDING OF PRIOR BONDS ISSUED BY

THE TOWNSHIP OF MANSFIELD, IN THE COUNTY OF BURLINGTON, NEW JERSEY, APPRORIATING NOT TO EXCEED $6,500,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF NOT TO EXCEED $6,500,000 BONDS OR NOTES OF THE TOWNSHIP FOR FINANCING THE COST

THEREOF

BE IT ORDAINED BY THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MANSFIELD, IN THE COUNTY OF BURLINGTON, NEW JERSEY (not less than two-thirds of all members thereof affirmatively concurring) AS FOLLOWS:

Section 1. The Township of Mansfield, in the County of Burlington, New Jersey (the “Township”) is hereby authorized to refund on a current basis all, or a portion of, the Township’s outstanding $5,890,000 General Obligation Bonds issued in 2006 in two series with $5,025,000 General Improvement Bonds, Series A outstanding and $865,000 General Improvement Bonds, Series B outstanding, and maturing in the years 2017 through 2025 (the “Refunded Bonds”) at a redemption price equal to 100% of the principal amount outstanding of the Refunded Bonds and interest through the redemption date for the Refunded Bonds and to pay the costs related to the issuance of the Refunding Bonds (as defined below) and the expenses related to redeeming the Refunded Bonds.

Section 2. An aggregate amount not exceeding $100,000 for items of expense listed in and permitted under N.J.S.A. 40A:2-51(b) has been included in the aggregate principal amount of refunding bonds authorized herein.

Section 3. In order to finance the cost of the project described in Section 1 hereof, negotiable refunding bonds are hereby authorized to be issued in the principal amount not in excess of $6,500,000 (the “Refunding Bonds”) pursuant to the Local Bond Law.

Section 4. In anticipation of the issuance of the refunding bonds, negotiable bond anticipation notes are hereby authorized to be issued pursuant to and within the limitations prescribed by the Local Bond Law. All refunding bond anticipation notes issued hereunder shall mature at such times as may be determined by the chief financial officer, provided that no note shall mature later than one year from its date. The notes shall bear interest at such rate or rates and be in such form as may be determined by the chief financial officer. The chief financial officer shall determine all matters in connection with notes issued pursuant to this ordinance, and the chief financial officer’s signature upon the notes shall be conclusive evidence as to all such determinations.

All notes issued hereunder may be renewed from time to time, but all such notes including renewals shall mature and be paid no later than the fifth anniversary of the date of the original notes; provided, however, that no notes shall be renewed beyond the first or any succeeding anniversary date of the original notes unless an amount of such notes, at least equal to the first legally payable installment of the bonds in anticipation of which the notes are issued, determined in accordance with the maturity schedule for the bonds approved by the Local Finance Board, is paid and retired on or before such anniversary date; and provided, further, that the period during which the bond anticipation notes and any renewals thereof and any permanent bonds are outstanding, shall not exceed the period set for the maturity of the bonds by the Local Finance Board.

The chief financial officer is hereby authorized to sell part or all of the notes from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from their dates to the date of delivery thereof. The chief financial officer is directed to report in writing to the governing body at the meeting next succeeding the date when any sale or delivery of the notes pursuant to this ordinance is made. Such report must include the amount, the description, the interest rate and the maturity schedule of the notes sold, the price obtained and the name of the purchaser.

Section 5. The chief financial officer of the Township is hereby authorized to prepare and to update from time to time as necessary a financial disclosure document to be distributed in connection with the sale of obligations of the Township and to execute such disclosure document on behalf of the Township. The chief financial officer is further authorized to enter into the appropriate undertaking to provide secondary market disclosure on behalf of the Township pursuant to Rule 15c2-12 of the Securities and Exchange Commission (the “Rule”) for the benefit of holders and beneficial owners of obligations of the Township and to amend such undertaking from time to time in connection with any change in law, or interpretation thereof, provided such undertaking is and continues to be, in the opinion of a nationally recognized bond counsel, consistent with the requirements of the Rule. In the event that the Township fails to comply with its undertaking, the Township shall not be liable for any monetary damages, and the remedy shall be limited to specific performance of the undertaking.

Section 6. The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and filed in the office of the Clerk, and a complete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey. Such statement shows that the gross debt of the Township as defined in the Local Bond Law is increased by the authorization of the bonds and notes provided in this bond ordinance by $6,500,000, and the obligations authorized herein have been authorized in accordance with that Law.

Section 7. The full faith and credit of the Township are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this bond ordinance. The obligations shall be direct, unlimited obligations of the Township, and the Township shall be obligated to levy ad valorem taxes upon all the taxable real property within the Township for the payment of the obligations and the interest thereon without limitation of rate or amount.

Section 8. A certified copy of this refunding bond ordinance as adopted on first reading has been filed with the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey prior to final adoption, together with a complete statement in the form prescribed by the Director and signed by the chief financial officer of the Township as to the indebtedness to be financed by the issuance of the refunding bonds authorized herein.

Section 9. This bond ordinance shall take effect 20 days after the first publication thereof after final adoption, as provided by the Local Bond Law, provided that the consent of the Local Finance Board has been endorsed upon a certified copy of this ordinance as finally adopted.

CFO Monzo explained that we issued two series of bonds in 2006 for about 5.9 milliondollars. At this point, we can refinance the balance by issuing a refunding bond at a lower interest rate which will save us a minimum of $20,000 a year for the next 10 years. The bonds were issued at a rate of 3% to 4% in 2006. Now we can expect a rate of 1% to 3% on the refunded bonds.

A motion was offered by Committee Gable and second by Committeeman Puglia tointroduce Ordinance 2014-13 with a public hearing to be held on September 24, 2014. Motion carried on a Roll Call Vote, recorded as follows:

Ordinance No. 2014-14AN ORDINANCE OF THE TOWNSHIP OF MANSFIELD, IN THE COUNTY OF BURLINGTON DISSOLVING THE ZONING BOARD OF ADJUSTMENT AND TRANSFERRING THE AUTHORIZED POWERS OF ZONING BOARD OF ADJUSTMENT TO PLANNING BOARD PURSUANT TO N.J.S.A. 40:55D-25 AND FURTHER AMENDING SECTION 27-1 OF THE TOWNSHIP CODE TO INCREASE THE MEMBERSHIP OF THE TOWNSHIP PLANNING BOARD

WHEREAS, it appears based on the findings of the Committee of the Township of Mansfield that the dissolution of the Zoning Board of Adjustment and transfer of its powers to the Planning Board will serve several important goals, including but not limited to reducing expenses, assuring continuity in land use decisions, eliminating confusion among applicants as to the proper seat of jurisdiction for land use decisions, and preventing “forum shopping” among applicants; and

WHEREAS, N.J.S.A. 40:55D-25c.(1) provides as follows: In a municipality having a population of 15,000 or less, a nine-member planning board, if so provided by ordinance, shall exercise, to the same extent and subject to the same restrictions, all

the powers of a board of adjustment, but the Class I and Class III members shall not participate in the consideration of applications for development which involve relief pursuant to subsection d. of section 57 of P.L. 1975, c.291 (C.40:55D-70);

AndWHEREAS, pursuant to the statute referenced above, Mansfield Township, as a municipality with a

population of less than 15,000, may dissolve the existing Zoning Board of Adjustment and transfer its powers to the Planning Board, subject to the statutory limitation cited above that prohibits the Planning Board’s Class I and Class III members from participating in the consideration of applications involving “d” variances; and

WHEREAS, the best interests of Mansfield Township and its residents will be sewed by dissolving the Zoning Board of Adjustment and transferring its powers to the Planning Board; and good cause having been shown.

NOW, THEREFORE, BE IT ORDAINED by the Committee of the Township of Mansfield as follows:1. Pursuant to N.J.S.A. 40:55D-25c.(1), the Mansfield Township Planning Board (the “Planning

Board”) is hereby authorized to exercise, to the same extent and subject to the same restrictions, all the powers of a zoning board of adjustment, with the exception that the Class I and Class Ill members of the Planning Board shall not participate in the consideration of applications for development which involve relief pursuant to N.JS.A. 40:55D-70d, more commonly known as “d” variances.

2. As of January 1, 2015, the Planning Board shall have all powers set forth currently in Sections 27-14, 27-15, 27-16, 27-18, and 27-19 of the Township Code, subject to the restrictions set forth at N.J.S.A. 40:55D-25c.(1). Any and all land use applications previously filed with the zoning board secretary that have not been deemed complete as of the effective date of this ordinance shall be heard by the Planning Board.

3. As of December 31, 2014, the Township Zoning Board of Adjustment shall be dissolved and Article II, Chapters 27-9 to 27-20 of the Township Code shall be deemed repealed and of no further force and effect. At that time, all funds budgeted to the Zoning Board of Adjustment that have not been expended shall be transferred to the Township’s surplus.

4. Upon the dissolution of the Zoning Board of Adjustment pursuant to Section 3 above, any and all references in the Mansfield Township Code to the “Zoning Board,” “Zoning Board of Adjustment” or the like shall be deemed to refer to the Planning Board. Any and all references to the Planning Board and Zoning Board of Adjustment, in the conjunctive or disjunctive, shall be deemed to refer solely to the Planning Board.

5. Section 27-1 of Chapter 27 is hereby amended, revised and replaced to read as follows:§ 27-1. Establishment; composition.There is hereby established pursuant to C. 291, P.L. 1975,[1] in the Township of Mansfield, a Planning Board of nine members consisting of the following classes:

A. Class I: the Mayor.B. Class II: one of the officials of the municipality other than a member of the governing body to be

appointed by the Mayor.C. Class III: a member of the governing body to be appointed by it.

[Amended 2-27-1992 by Ord. No. 1992-3]D. Class IV: other citizens of the municipality to be appointed by the Mayor, the number of which shall bring

the total membership to nine.E. Alternate members: four (4) in number meeting the qualifications of Class IV members. [Added 10-20-

1981 by Ord. No. 1981-7](1) Alternate members shall be designated at the time of appointment by the Mayor as “Alternate No. 1”,

“Alternate No. 2”, “Alternate No. 3”, and “Alternate No. 4”. The terms of the alternate members shall be for two years, except that the terms of the alternate members shall be such that the term of not more than one alternate member shall expire in any one year; provided, however, that in no instance shall the terms of the alternate members first appointed exceed two years. A vacancy occurring otherwise than by expiration of term shall be filled by the appointing authority for the unexpired term only.

(2) No alternate member shall be permitted to act on any matter in which he has either directly or indirectly any personal or financial interest. An alternate member may, after public hearing if he requests one, be removed by the governing body for cause.

(3) Alternate members may participate in discussions of the proceedings but may not vote except in the absence or disqualification of a regular member of any class. A vote shall not be delayed in order that a regular member may vote instead of an alternate member. In the event that a choice must be made as to which alternate member is to vote, Alternate No. 1 shall vote.

6. If any section, subsection or paragraph of this ordinance shall be declared to be unconstitutional, invalid, or inoperative, in whole or in part, by a court of competent jurisdiction, such section, subsection or paragraph shall, to the extent that it is not unconstitutional, invalid or inoperative, remain in full force and effect, and no such determination shall be deemed to invalidate the remaining provisions of this ordinance.

7. This Ordinance shall take effect as provided by law.

Attorney Magee explained that the Township qualifies pursuant to the Municipal Land Use Act to have a single board and, in this case, would be called the Planning Board. It will be a combination of current Planning Board Members and some existing Zoning Board Members. It allows this board to carry on the function that were previously carried on by two boards. Usually this is done for continuity, cost savings and convenience on the part of the residents.

AN ORDINANCE TO AMEND THE CODE OF THE TOWNSHIP, ENTITLED “RECYCLING AND SOLD WASTE DISPOSAL” CHAPTER 39B, ARTICLE 1, SECTION 39B- 5 AND SECTION 39B-8

BE IT ENACTED by the Township Committee of the Township of Mansfield, County of Burlington, State of New Jersey as follows:The code of the Township of Mansfield is hereby amended by creating and adding thereto to section 39B-5 and 39B-8 the following language:§39B-5. Establishment of Curbside Programs:G. The township will not be responsible for any additional cost for carts for any residents who failed to exercise their options for an additional cart by June 30, 2014 through the Burlington County Recycling Program any and all costs associated with same shall be borne by the residents.H. NEW CONSTRUCTION/RESALE - The provisions of paragraph G above shall not apply to new construction or resale within the township of Mansfield. New Construction and resale are governed already in Chapter 39B-45.§39B-8. Common area Recycling Storage Locations.F. The owner or manager of each of the above referenced locations shall be responsible for the all cost of the curbside recycling container including any administrative fees if applicable provided through the County referred to in section 39B-3.REPEALER, SEVERABILITY AND EFFECTIVE DATE.

A. Repealer . Any and all Ordinances inconsistent with the terms of this Ordinance are hereby repealed to the extent of any such inconsistencies.

B. Severability . In the event that any clause, section, paragraph or sentence of this Ordinance is deemed to be invalid or unenforceable for any reason, then the Township Committee hereby declares its intent that the balance of the Ordinance not affected by said invalidity shall remain in full force and effect to the extent that it allows the Township to meet the goals of the Ordinance.

C. Effective Date . This Ordinance shall take effect upon proper passage in accordance with the law.

Attorney Magee said the foregoing ordinance adds the provision that those people who have not taken advantage of the free cart and they want on in the future, the resident will be responsible for the cost. In addition, those of multiple dwelling users will be responsible for the extra containers as well. Mayor Higgins further explained the ordinance. Clerk Semus added that any new construction or resale properties will not be charged the fees.

A motion was offered by Committeeman Clark and second by Committeeman Gable to introduce Ordinance 2014-15 and hold the public hearing on September 24. Motion carried.

RESOLUTIONS

CFO Monzo explained that the next three Resolutions are for grants the Township was awarded after the budget was adopted. In order for the Township to spend money against any appropriation, it can be included in a resolution to amend the budget. Mayor Higgins added that Remington & Vernick prepared the application for White Pine Road and received the largest grant awarded in New Jersey. The location is White Pine Road from Route 68 to Chesterfield.

WHEREAS, the Chief Financial Officer has certified that funds are available in that amount; andNOW, THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Mansfield,

County of Burlington, and State of New Jersey that:1. The Township Committee hereby awards a Contract to Falasca Mechanical, Inc. for the Fire Protection

documents necessary to effectuate this award in a form substantially the same as that included in the specifications.

Engineer Galante said the foregoing resolution is for the riser pipe improvements with the low bid of $168,000 from Falasca Contractors. He recommended this award.

CFO Monzo said a municipal ordinance had been adopted for several municipal improvements, one of which was for water and one for septic. Two contracts have been awarded for the water. With this contract in place, most of the money has been spent. If we move forward with the septic, we will have to provide additional funding.

Mayor Higgins explained that the water in the fire suppression system is stagnant. The riser valve prevents the water from going back into the drinking water. It also keeps pressure in the system for any possible need for fires. Committeeman Gable said the issue is that the main running into the facility is not sufficient for the size of the facility and the number of sprinkler heads to provide the needed pressure should there be a major fire in the facility. However, he questioned if this is the only option. Mayor Higgins suggested tabling the motion and asking Administrator Fitzpatrick to follow up on this. Administrator Fitzpatrick noted that Falasca is starting a project here on Monday running pipes to connect to the riser. Committeewoman DiGiuseppe felt this amount of money was more than the estimate and questioned whether it has been reviewed. Engineer Galanta said the bid was 10% over the estimate. Mayor Higgins felt questions need to be answered. Committeeman Gable questioned whether the existing pump can be fixed. Administrator Fitzpatrick asked whether they can proceed with the pipes to be laid on Monday and was told yes. Therefore, a motion was offered by Committeeman Puglia and second by Committeeman Gable to table this resolutions.

RESOLUTION 2014-9-6A RESOLUTION REQUESTING PERMISSION FOR THE DEDICATION BY RIDER FOR

REVENUES DERIVED FROM THE CHARGING OF CONTRIBUTIONS TO DEVELOPERS IN LIEU OF SIDEWALK IMPROVEMENTS AS REQUIRED BY NJSA 40A:4-39

WHEREAS, permission is required of the Director of the Division of Local Government Services for approval as a dedication by rider of revenues received by a municipality when the revenue is not subject to reasonably accurate estimates in advance; and

WHEREAS, NJSA 40A:4-39 provides for charging of in lieu of sidewalk contributions to provide for the operating costs to administer this act; and,

WHEREAS, NJSA 40A:4-39 provides the dedicated revenues anticipated from the Sidewalk Contributions is hereby anticipated as revenue and are hereby appropriated for the purpose to which said revenue is dedicated by statute or other legal requirement:

NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the Township of Mansfield, County of Burlington, and State of New Jersey as follows:

CFO Monzo said that, when items come up unexpectedly to support expenses that are not known at the time of budget adoption, a dedication by rider can be adopted. This is a trust fund where money can be put away for a specific purpose and has to be approved by the Committee and the Division of Local Government Services who gets to approve it or deny it. CFO Monzo noted that the Planning Board has, in the past, waived the fee. The Planning Board is to be told to collect the fee from applicants and developers to use around town for sidewalk improvements that we deem necessary. This resolution has to be adopted first.

services for the new Police and Public Works Facility at the Mansfield Township Municipal Complex; and WHEREAS, during the design stage an issue has arisen that was not part of the original proposal; and WHEREAS, Rodier Ebersberger Architects have proposed the following change order in order to accommodate the issue raised during the design stage; and WHEREAS, the following change order is necessary to the contract in order to move forward to the design phase; and NOW, THEREFORE BE IT RESOLVED that the Township of Mansfield, County of Burlington, State of New Jersey authorizes the attached listed change order attached hereto and made a part hereof.

BILL LIST

Committeeman Gable questioned the animal control services bill. CFO Monzo explained the bills are being paid for from the Animal Trust fund and are being caught up. Committeeman Gable also questioned the Lou Glass bills and was told they were from Planning Board. Committeeman Gable questioned the State Environmental bills and asked if they were all from the municipal complex expenses. CFO Monzo explained some were for Lynnwood Farms and some for the Municipal Building. The only continuing expense is the $635 monitoring charge at Lynnwood Farms. Currently, however, we will continue the municipal expenses until the system is fixed. CFO Monzo will provide Committeeman Gable more information on this. Lastly, he questioned the electric bills, specifically the old municipal building on East Main Street, PO Number 13656 in the amount of $1,736.25 and Complex, various locations for $7,868. CFO Monzo explained we pay Public Service for a lot of services and their bills are poorly defined. He will pull them all and meet with Committeeman Gable at a later date.

DISCUSSIONMunipod – Mem of Doug Borgstrom OEM CoordinatorAdministrator Fitzpatrick said Douglas Borgstrom,OEM Coordinator, had approached

him about being tasked by the Burlington County Board of Health to validate our approved strategic national stockpile which is dealing with medications. Currently the old municipal building is listed as the location of the stockpile in case of emergency. Mr. Borgstrom asked if he can continue to utilize the facility until the NJDOT completes their traffic assessment and corrective action plan for access to the present building where we are located now. Once the project is completed, he would amend the plan to reflect our current location. A motion is offered by Committeeman Puglia and second by Committeeman Gable to grant this request. Motion carried.

Vending MachinesCommitteeman Gable said there had been some discussion about having some vending

machines available for the employees since we are no longer located in the village. In addition, JIF started a new health incentive and they hired a coordinator for all towns in JIF and one of their recommendation was having vending machines available with some healthy snack choices. A vendor was here from Capital City Vending who is willing to put some machines in our facility, preferable in a place available to the public. He asked the Committee if there is interest in moving forward with this. Mayor Higgins asked Committeeman Gable to speak to Administrator Fitzpatrick first. Committeeman Gable agreed and will bring this topic back for the next meeting.

Tractor Crossing Signs – Memo of Don Knezick/NJ Farm BureauDon Knezick had sent a memo, on behalf of the NJ Farm Bureau, said he felt there

should be some type of sign on the road stating there will be tractors crossing the road. He felt the Township should install traffic signs to slow traffic down to 20 miles per hour. This has been done in other areas of the township. Committeewoman DiGiuseppe said she wanted to know the cost. A motion was offered by Committeeman Puglia and second by Committeeman Gable to approve this request. Mayor Higgins agreed since this is a farming community and we should do something to protect the farmers. The motion was carried on a Roll Call Vote, recorded as follows:

Fence Repair at Civic Club field, $1,200 funds from Trust General Fund

Mayor Higgins said this is a request to use funds collected from the Concession Stand to repair the fence. A motion was offered by Committeewoman DiGiuseppe and second by Committeeman Puglia to approve this expenditure. Motion carried on a Roll Call Vote, recorded as follows:

PUBLIC COMMENTBarbara Willis, 63 Greenbrook Drive explained a lamppost had been knocked down

between Arlington Drive and Route 68. She asked Public Service to fix it. They came out and took the pole down but wrapped it up. She feels a child, if he should mess with it, might get hurt. She has asked someone else to look at it. Clerk Semus said she has sent an emergency order to Public Service.

Donna Morgan, 1174 Jacksonville Road, referred to the blue toters saying she ordered a small cart and did receive it. However, now she doesn’t want or need the bigger cart and asked what she should do with the big cart now. Clerk Semus is to speak to Jef Jones about this.

Susan Henry, 28 Oaklynn Drive, asked if some of the cost being accessed to her development be covered by the contract with the Mansfield Municipal sewerage facility. CFO Monzo said there is a monthly contract for $635 for monitoring the facility. Mrs. Henry questioned the bills for pumping the system every day. She was told this is not in the monthly fee. All bills of a emergent nature are separate and apart from the monthly monitoring duties. This is covered in a bond ordinance recently adopted by $75,000. The cost could be less. Mrs. Henry asked if there any type of protection plant or insurance that the facility could have so the costs would be protected. She was concerned over the expense. Mayor Higgins felt that the concern is that this is less than 10 years old and probably failed in the 7 th year. The people hooked up to it are responsible for the repairs. Engineer Galante felt it there is a manufactured part with a warranty, he would look into it. A Maintenance Bond will run for two years to cover the contractor’s workmanship. In regard to parts, he could look to see if there is a warranty. Deputy Mayor Clark explained the problem with the pump which he understood was not installed properly and, as the pump got older, it started to fail. Engineer Galante said that with the new pump, there will be a 2 year maintenance contractor and also a warranty on the pump. Deputy Mayor Clark questioned why it went on for so long and why it wasn’t fixed before. Engineer Galante said he will look into this. Committeewoman DiGiuseppe said Mount Construction did the original work. If that pump wasn’t installed properly, why aren’t we talking to Mount Construction about getting it done. Engineer Galante said he will look into this and have an answer by the end of the week.

Bob Harrison, Mansfield Road West, spoke of the new speed machine he had requested before. It has been on West Main Street and wondered if it will be placed around the township. Mayor Higgins said it will be moved to coincide with the volume in the Township. With school starting, it will be changed closer to the school. It will be on Mr. Harrison’s road. Mr. Harrison said that, although the cars have slowed down, the motorcycles go from 70 to 80 mph at

all different hours. There are also a lot of tractor trailers using the road. Mayor Higgins said he speaks to the Police Chief continuously and will mention it to him again.

Judy Harrison, Mansfield Road West, spoke of the park permits and asked it the Committee was aware of one that starts at 6am and there is a noise ordinance that allows noise after 7am. She wouldn’t want this noise at her property.

Tom Minard, 24755 East Main Street, said he was confused about the water line and why it wasn’t bid at the same time, not broken into two separate bids where more money will be spent. Engineer Galante said he was not involved with the property and couldn’t answer the question. Administrator Fitzpatrick offered Mr. Minard his card for him to call for an answer. He thanked the Committee for water to the Fire Department.

With no further public comment, Mayor Higgins closed this session.

MAYOR AND COMMITTEE COMMENTCommitteeman Gable gave an update on the Civic Club property. We are in the process

of getting the old building demolished. Low bidder has been contacted and the architect is in process of doing the demolition permit with the Construction Office. There is a preliminary concept drawing to distribute to the committee and asked for their comments within the next week. Upon contacting the county, there has been an extension on the funding from last year’s grant. A portion will pay for the demolition of the old facility.

Committeewoman DiGiuseppe asked if we have heard anything about this year’s county grant. She was told no, not yet.

Administrator Fitzpatrick asked for guidance to utilize some free millings were had the opportunity to obtain. Mayor Higgins felt the millings were to be used on our driveway and on White Pine Road. However, Administrator Fitzpatrick said the millings do not sit well on asphalt and therefore, White Pine Road cannot be included. We can store the millings and use them as necessary. Deputy Mayor Clark said the intention of the millings was to use them on “craters” in the roadway as they do tighten up and we don’t have the money for the pot holes. He said something has to be done about these big holes. Engineer Galante said that, if we are taking millings from the contractor, it will benefit the contractor as well as the town. He thought maybe the contractor could provide some asphalt if we take millings, thus working out a deal. Deputy Mayor Clark didn’t think the contractor would give us asphalt which is very expensive. Administrator Fitzpatrick is to contact Jef Jones and Deputy Mayor Clark to see what they will do.

Administrator Fitzpatrick said there is word that Mapleton Park will have cameras installed. A resident had asked that, once the cameras were installed, would the facility be open on a regular basis. Committeewoman DiGiuseppe said the cameras are part of the grant and we didn’t get the grant yet so we aren’t sure. Mayor Higgins felt it shouldn’t be open 24 hours a day.

Administrator Fitzpatrick said he had been made aware of cracks on Fitzgerald Lane in Four Seasons. Deputy Mayor Clark said we had a small paving outfit doing crack repair work but we ran out of money. Our own Maintenance men were out there repairing the cracks. Administrator Fitzpatrick said he will look into this.

Administrator Fitzpatrick received an e’mail from Douglas Borgstrom from the Office of Emergency Management, that there is a problem with the current state of the parking lots for the Fire Company. There were three lights. One fell down and the other two are non-functional and in danger of falling down. He was concerned over the lack of light for the first responders when they are here at night. He questioned if they could be included in the site lighting project for the police department. Committeeman Puglia suggested contact with Jef Jones and Doug Borgstrom to see what can be done. CFO Monzo recommended someone speak to the Architect who are designing the improvements to the Public Works/Police Facility to get their input and whether it can be included in their bid. It could be an alternate to the bid.

Mayor Higgins questioned whether we have enough money in the bond to do everything we want to do. Committeeman Gable suggested taking care of the dangerous lights first and then do the other ones under the building maintenance line item. Committeewoman
