Aerodrome Landing Fees Act 2003Essendon Airport Pty Ltd gives notice that the following fees have, under the Aerodrome

Landing Fees Act 2003 (‘Act’), been fixed and operate at Essendon Airport on and from 1 September 2015.1. A fee per arrival for a fixed wing or rotary wing aircraft:

Fixed Wing Aircraft

Per 1,000 kg (pro rata) of aircraft max take-off weight

Minimum charge

Up to 4 ton $21.60 $52.40

Above 4 ton $21.20 $51.50

Rotary Wing Aircraft

Per 1,000 kg (pro rata) of aircraft max take-off weight

Minimum charge

Up to 7 ton $14.10 $25.75

Above 7 ton $16.50 $115.30

2. A fee per training flight approach including an ILS approach (as defined under the Act) for a:Fixed Wing or Rotary Aircraft that Touches the Runway

Per 1,000 kg (pro rata) of aircraft max take-off weight

3. Parking Fee:(a) Casual Hardstand Parking charge per day of $0.0047 per kg/MTOW. A minimum

parking charge of $13.90 per day applies to aircraft less than 3,000 kilograms MTOW. (b) A minimum parking charge of $68.00 per day applies to aircraft of greater than or

equal to MTOW 3,000 kilograms.(c) A minimum parking fee for rotary wing aircraft of $68.00 per day.(d) Parking in areas outside aircraft parking clearance lines (without EAPL approval) will

attract a fee of $515 per day.(e) Rotary wing aircraft with MTOW 18 tons and over are subject to a separate parking

charge. Please contact the General Manager Aviation for details.(f) No parking fee is payable where an aircraft arrives at and then departs from Essendon

Airport between 6 am and 5 pm on the same day, provided that the aircraft does not return to the airport until after 6 am the following day.

4. Non-Australian Registered AircraftAircraft not registered on the Australian Civil Aviation Safety Authorities Civil Aviation Register must, in addition to paying the above fees, pay a fee of $43.30 per monthly invoice.

5. Maintenance DiscountThe following parking discount will apply to aircraft under maintenance:(a) First 5 days (including weekends and public holidays) no charges will apply.(b) For 6 days and beyond, a parking fee of 50% of the normal charge will apply.(c) To receive this discount, a Maintenance Claim Form signed by a Licenced Aircraft

Maintenance Engineer (LAME) must be submitted to the General Manager Aviation at [email protected]

6. Passenger TerminalThe following Passenger Terminal fee will apply to arriving and departing passengers:(a) Passenger numbers of 6 or less will not be charged a fee.(b) Aircraft numbers of 7 or more passengers will attract a fee of $10.30 plus GST per

passenger.7. Overdue Fees

All fees are payable within 30 days of invoice. Interest at the rate of 15% per annum will be charged on overdue amounts.

By this notice, the Victorian Commission for Gambling and Liquor Regulation –1. revokes all areas previously specified by notices published in the Government Gazette as

specified areas; and2. subject to the following conditions, specifies the areas shown in the attached Schedule for

the purposes of sections 62AB(4), 62AC(2) and 81AAB(2) of the Casino Control Act 1991, and sections 3.2.3(1)(g) and 3.2.3(1)(h) of the Gambling Regulation Act 2003.

Conditions:The conditions of this notice are that:

(i) the total of – (A) the total number of gaming machines which are operating at any time in a mode where

spin rate, bet limit, autoplay and note acceptors are unrestricted in all areas specified by notice under section 62AB(4) or 62AC(2) of the Casino Control Act 1991; plus

(B) the total number of gaming machines from which winnings or accumulated credits in excess of $2,000 may be paid out in cash in all areas specified by notice under section 81AAB(2) of the Casino Control Act 1991; minus

(C) the total number of gaming machines which are both operating in the mode referred to in sub paragraph (A) and from which winnings or accumulated credits in excess of $2,000 may be paid out in cash as referred to in sub paragraph (B),

must not exceed 1,000.(ii) a gaming machine located in an area specified by a notice under sections 62AB(4), 62AC(2)

and 81AAB(2) of the Casino Control Act 1991 referred to in section 3.2.3(1)(g) of the Gambling Regulation Act 2003 may only operate in a mode where spin rate, bet limit, autoplay and note acceptors are unrestricted if that gaming machine may only be played in that mode by means of a card, Personal Identification Number (PIN) or similar technology which requires the player to nominate limits on time and net loss before play can commence; and

(iii) the payment of winnings or accumulated credits in excess of $2,000 may only be paid by cash if the winnings or credits are from one of the up to 1,000 machines specified in condition (i)(B). This provision regarding the payment of winnings by cash applies to the up to 1,000 machines specified in condition (i)(B) regardless of whether or not the machine:(A) was also a machine capable of operating in a mode described in condition (i)(A); and(B) was actually being played in exempt mode by means of card, PIN or similar technology

at the time of the accumulation or payment of winnings as described in condition (ii).This notice operates with effect from 6.00 am on 30 July 2015.

4. Termination ArrangementsSection 2.4.75 of the Education and Training Reform Act 2006 states that a Board member may resign from Office by sending a signed letter of resignation to the Governor or at any time the Governor in Council may remove a Board member from Office.

5. Payment ProvisionsChairpersons will be remunerated at the rate of $590.00 per session and eligible Board members will be remunerated at the rate of $510.00 per session. Members of the Teaching Service and Public Sector employees are ineligible for payment.

6. Superannuation ObligationsBoard members are eligible for superannuation in accordance with the Superannuation Guarantee (Administration) Act 1992 (Cth).

PREVENTING THE SPREAD OF THE PEST POTATO CYST NEMATODEOrder in Council

The Governor in Council, under section 19 of the Plant Biosecurity Act 2010, makes the following Order.1 Purpose

The purpose of this Order is to declare control areas in Victoria for the purposes of preventing the spread of the potato cyst nematode to other parts of Victoria.

2 Authorising provisionThis Order is made under section 19 of the Plant Biosecurity Act 2010 (the Act).

3 CommencementThis Order comes into operation on the date of publication in the Victoria Government Gazette.

4 RevocationThe Order made on 29 July 2014 under section 19 of the Act, declaring an area in Victoria to be a control area for the purpose of preventing the spread of potato cyst nematode, and published in Victoria Government Gazette G31 at page 1672 on 31 July 2014, is revoked.

5 DefinitionsIn this Order –‘host material’ means host plants, and any earth material, package or used equipment associated with the cultivation, harvesting, handling, transport or processing of host plants;‘host plants’ means any plant or plant product of the Solanaceae family and any root vegetable, bulb, seedling, nursery plant or tree;‘Solanaceae’ means the family of plants which includes potatoes, tomatoes, eggplants, and weeds including nightshade.

6 Control area for preventing the spread of potato cyst nematodeThe areas of land described in Schedules 1 and 2 are declared to be control areas for the purpose of preventing the spread of potato cyst nematode.

7 Prohibitions, restrictions and requirements to apply in a control area(1) For the purpose of preventing the spread of potato cyst nematode from a control area

to another part of Victoria, the removal of any host material from a declared potato cyst nematode control area described in Clause 6 is prohibited.

(2) Sub-clause (1) does not apply if the host material is –(a) grown on, or sourced from, land within the control area described in Schedule 2

of this Order; and (b) accompanied by an assurance certificate, plant health declaration or plant

health certificate.8 Expiry

This order expires 12 months after the date it is published in the Victoria Government Gazette.

Section 20(1) of the Act provides an offence for a person who causes or permits the movement of any plant, plant product, used package, used equipment or earth material into or from a control area or within a control area or within a specified part of a control area contrary to any prohibition or restriction in an order declaring an area to be a control area if the person knows or may reasonably be expected to know that the place has been declared to be a control area, unless the person is authorised to do so under a permit issued by the Secretary. The maximum penalty for this offence is 60 penalty units in the case of an individual and 300 penalty units in the case of a body corporate.

Section 20(3) of the Act provides that a person who contravenes any prohibition or restriction in an order declaring a place to be a control area, where that person is not liable for the offence in section 20(1) of the Act, is guilty of an offence and is liable to a penalty not exceeding 10 penalty units in the case of an individual and 60 penalty units in the case of a body corporate, unless the person is authorised to do so under a permit issued by the Secretary.
