Persuant to Section 743.28 of the Ohio Revised Code

as amended by Amended House Bill No. 156, 113th General

Assembly, the council .of ~1t;6 &aam~1L hereby noti-

fies Columbia Gas of Ohio and the Public Utilities Commis-

/ 1 sion of Ohio of its intent to negotiate jointly with other

municipal corporations in Fairfield, Hocking, Licking,

Perry, Pickaway, and Ross Counties for the purpose of estab-

lishing a uniform gas rate; using the Ohio Constitution

Article XVIII Home Rule Provision and House Bill 156 Pro-

visions.

SECTION 1. That, for the purpose of this ordinance

uniform rate shall be d~fined as a single gas rate

which would apply to energy municipal corporation

in the group. Group shall be defined as ~11 of the

municipalities which enact ordinances expressing

their intent to negotiate jointly for a uniform

rate and give jointly written notification by the

-'·-,i-fa§8'r·s to the company. Mayors shall mean the

mayors of all the municipalities in-the group, and

Company shall mean Columbia Gas of Ohio, Inc.

notification by the Mayors of the group of munici-

palities which have enacted ordinances expressing \.

a desire to negotiate a uniform gas rate, the

mense negotiations with the.uniform gas rate com-

mittee to be comprised of representatives from the

municipalities who chose to attend such negotia-

tions. All correspondences, communications, in-

formation, etc. shall be provided to the Council

SECTION 3. That the date the company receives

joint notifi~ation by the Mayors shall be the date

which designates the commencement of the first

90-day period of negotiations for a uniform gas

rate.

SECTION 4. Where such negotiations do not, within

ninety days _after commencement, result in an agree-

ment-between the group and the company, the group

may exercise the rights of a municipal corporation

under,Sectl.on 743.26 of the Ohio Revised Code and

Article XVIII of the Ohio Constitution on the same

basis as if it were a single municipal corporation

and enact a uniform rate ordinance(s) fixing and

regtilating the price that may be charged by s

assigns, for the gas to the group of municipal

corporations and to their inhabitants, in accord­

Columbia Gas Five Year Ordinance connnenceing January 10, 1983

Fixing and regulating the price that may be charged by Columbia Gas of Ohio, Inc., its successors or assigns, for gas to the Village of South Bloomfield, Ohio, and to its inhabitants, for the period of Five (5) Years from and after bills rendered January 10, 1984.

BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF SOUTH BLOOMFIELD, OHIO:

SECTION 1: That, for the period of One (1) Year from and after the effective date of this ordinance, the maximum price which Columbia Gas of Ohio, Inc., its successors or assigns, shall be permitted to charge for and the minimum price at which it or they shall be required to furnish gas to the Village of South Bloomfield, Ohio, (Municipality), and to its inhabitants, shall be and the same is hereby fixed for each individual consumer, as follows:

A "Customer Charge" of $4 .. 75,· per meter per month, regardless of gas consumed and 13.462¢ per 100 cubic feet, per meter per month, for all gas consumed.

A "Customer Charge" for each customer each month of Four Dollars and Seventy-five Cents ($4.75) shall be made. If service urider this rate schedule is discontinu~d at the request of customer, the Company shall not be under any obligation to resume service to the same customer on the same premises uritil the cus-tomer has made payment of an amount equal to the -"Customer Charge" for each month of the intervening period, but not to exceed twelve (r-2) months.

From and after the expiration of the aforesaid One (1) Year period, and for a further period of One (1) Year thereafter, as follows:

From and after the expiration of the aforesaid One (1) Year period, and for a further period of One (1) Year thereafter, as follows:

A "Customer Charge" of $4.75, per meter per month, regardless of gas consumed and 21.040¢ per 100 cubic feet, per meter per month, for all gas consl;lined.

A "Customer Charge" for each customer each month of Four Dollars and Seventy-£ive Cents ($4.75) shall be made. If service under this rate schedule is discontinued at the request of Qustomer, the Company shall not be under any obligation to resume service to the same customer on the same premises until the customer has made payment of an amount equal to the "Customer Charge" for each month of the intervening period, but not to exceed twelve (1:"2-) months. ·

4-From and after the expiration of the aforesaid One (1)

Year period, and for a further period of One (1) Year thereafter, as follows:

A "Customer Charge" of $4.75, per meter per month, regardless of gas consumed and 23.611¢ per 100 cubic feet, per meter per month, for all gas consumed. ·

A "Customer Charge" for each customer each month of Four Dollars and Seventy-five Cents ($4.75) shall be made. If service under this rate schedule is discontinued at the request of customer, the Company shall not be under any obligation to resume service to the same customer on the same premises until the customer has made payment of an amount equal to the "Customer Charge". £.or each month of the intervening period,. but not to exceed twelve (±-i!i months. ·

The above rates exclude gas costs and the Ohio Gross Receipts Tax. All bills rendered pursuant to this ordinance shall be adjusted to reflect the effect of the Ohio Gross Receipts Tax and are subject to decrease or increase in accordance with the "Gas Cost Recovery" Provisions of the Company's Rules and Regulations, on file with the Public Utilities Commission of Ohio. The Company shall file with the Clerk of Council of the municipality computations ~n support of the above "Gas Cost Recovery" adjustments in the same form as is filed by the Company with the Public Utilities Commission of Ohio.

SECTION 2: That it is expressly conditioned the service to be rendered by said Company, its successors or assigns,. pursuant to this ordinance shall be primarily for domestic and commercial purposes and that service shall not be extended to other consumers of different classes until after all reasonable requirements for domestic and commercial purposes are fully met, and this provision shall be binding upon said Company, its successors or assigns, during each month of each year; but during any month or year, subject to the foregoing limitations and after compliance with the foregoing provisions, gas may be delivered to any other consumer and' additional classes of consumers at such times and under such conditions and for such rates as may be agreed upon between the Company and such consumer or consumers.

SECTION 3: The terms and conditions of the service to be rendered shall conform with and be subject to the Rul~s and Regulations for furnishing gas service of the Company on file with and approved by the Public Utilities Commission of Ohio.

SECTION 4: That the gas furnished or delivered pursuant to the terms of this ordinance, by the said Company, shall have an average heating value of 1,000 British thermal units per cubic foot ·for any consecutive twelve (12) month period sub,ject to a variance of not more than five percent (5%) upward or downward .

. SECTION 5: In the event the State of Ohio, or the Muni~ cipality, should hereafter impose a tax upon the Company that is not· now imposed, or should hereafter increase·the rate of any tax now imposed upon the Company above the tax rate.now existing, other than the rate on property listed in the real estate tax list and duplicate, then the rates prescribed in Section 1 shall be increased to the extent necessary to compensate the Company for the increase in cost due to such new tax or higher tax rate. This shall be done in the following manner:

(a) If the new tax or higher tax rate is computed in direct relation to gas sold or revenues received for the sale o= gas, the rates set forth herein shall be adjusted to the extent necessary to recompense the Company for the amount thereof.

(b) If the new tax or higher tax rate is not related directly .to gas sold or to revenues received for the sale of gas, then the total dollar effect thereof upon the cost of se~ving gas by the Company in the Municipal~ty shall be determined, based upon operations of the Company in the Municipality during the most recently available twelve (12) month period ending on the last day of the December preceding the effective date of the new tax or higher tax rate; the total dollars so computed shall then be divided by the total sales made to the types of customers covered by this ordinance during the same twelve· (12) month period and the rates prescribed herein shall be correspondingly adjusted.

The adjustment of the rates prescribed in this ordinance, as provided in subparagraphs (a) and (b) above, shall be made by rounding the mathematical result of the computations so prescribed to the nearest one-quarter cent (~¢) per one thousand cubic feet.

The adjus~ed rate shall be placed in effect and shall apply to all meter readings occurring on and after the effective date of the sta~ute, ordinance or resolution pursuant to which the new tax or increased tax rate is imposed.

Written notification of the adjustment shall be sent to the Clerk of Council of the Municipality as quickly as possible after the effect of the new tax or higher tax rate can be determined.

SECTION 6: That any ordinance or resolution, or part of an ordinance or resolution,- inconsistent herewith, is, to the extent of such inconsistency, hereby repealed.

SECTION 7: That should any section or part of a section or provision of a section of this ordinance be declared void, the remainder of this ordinance shall not be affected thereby.

An Ordinance amending the codified ordinances of South Bloomfield

An Ordinance Amending Sections of the Codified Ordinances of South Bloomfield.

NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF SOUTH BLOOMFIELD, STATE OF OHIO:

Section 1: That Sections 331.34, 333.0l(a), 333.0l(c), 333.02 and 335.07 be amended, Section 333.0l(d) (333.0l(g)) ·be amended for the purpose of adopting a new section number as indicated in parentheses, and new Sections 333.0l(a), 333.0l(c), 333.0l(d), 333.0l(e) and 333.0l(f) of the Codified Ordinances of the Village of South Bloomfield be enacted to read as follows:

Section 331.34

(a) No person shall operate a motor vehicle on any street, highway, or property open to the public for vehicular traffic without being in reasonable control of such vehicle. (ORC 4511.202)

(b) No person shall operate a motor vehicle upon any street or highway in a weaving or zigzag course unless such irregular course is necessary for safe operation or in compliance with law.

(c) No person shall operate a motor vehicle or motorcycle without giving his full time and attention to the operation of such vehicle.

Section 333.01

(a) No person shall operate any vehicle within the Municipality if any of the following apply:

(1) The person is under the influence of alcohol or any drug of abuse, or . the combined influence of alcohol and any drug of abuse;

(2) The person has a concentration of tenhundredths· of one per-Cent or more by weight of alcohol. in his blood;

(3) The person has a concentration of tenhundredths of one gram or more by weight of alcohol per 210 liters of his breath;

(4) The person has a concentration of. fourteen-hundredths of one gram of more by weight of alcohol per 100 milliliters of his urine. (ORC 4511.19(A))

(b) No person who is under the influence of alcohol or any drug of abuse, or the combined influence of alcohol and any drug of abuse, shall be in actual physical control of any vehicle within the Municipality.

(c) In any criminal prosecution for a violation of subsection (a) of this section, the court may admit evidence on the concentration of alcohol in the defendant's blood, breath, or urine at the time of the alleged violation as shown by chemical analysis of the defendant's blood, urine, breath, or other bodily substance withdrawn within two hours of the time of such alleged violation. . When a person submits to a blood test at the request of a police officer under Ohio R.C. 4511.191, only a physician or a registered nurse or a qualified technician or chemist shall withdraw blood for the purpose of determining its alcoholic content. This limitation does not apply to the taking of breath or urine specimens. A physician, a registered nurse, or a qualified technici?-n or chemist may refuse to withdraw blood f<;>r the purpose of determining the alcohol content of the blood, if in his opinion the physical welfare of the person would be endangered by the withdrawing of blood.

Such bodily substance shall be analyzed in accordance with methods approved by the director of health by an individual possessing a valid permit issued by the director of health pursuant to Ohio R.C. 2701.143.

If there was at the time the bodily substance was withdrawn a concentration of alcohol less the amount referred to in subparagraph (2), (3), or (4) of subsection (a) of this section, such fact may be considered with other competent evidence in determining the guilt or innocence of the def en&ant.

Upon the request of the person who was tested, the results of such tests shall be made available to him, his attorney, or agent, immediately upon the completion of the test analysis ..

The person tested may have a physician, a registered nurse or a qualified technician or chemist of his own choosing administer a chemical test or tests in addition to any administered at the direction of a police officer, and shall be so advised. The failure or inability to obtain an additional test by a person shall not preclude the admission of evidence relating to the test or tests taken at the direction of a police officer. (ORC 4511.19)

(d) Any person under arrest for a violation of subsection (a) of this section shall be advised in accordance with the provisions of state law of the consequences of his refusal to submit to a blood, breath, or urine test designated by the law enforcement agency.

The arresting officer shall verify the current residence _of any person under arrest for a violation of subsection (a) of this section. If the current residence differs from that on the person's operator's or chauffeur's license or permit, the officer shall notify the registrar of motor vehicles of the change. (ORC 4511.191)

(e)° If the. results of a chemical test adminstered pursuant to this section indicate that the blood of a person arrested for a violation of subsection (a) of this section contained a concentration of alcohol in an amount ref erred to in subparagraph (2), (3), or (4) of subsection (a) of this section, or if the person refused to submit to a chemical test, the arresting law enforcement officer shall seize the Ohio or out-of-state operator's or chauffeur's licnese or permit of the arrested person and immediately forward it to the court in which the arrested person is to appear.

If the arrested person fails to surrender his operator's or chauffeur's license or permit because he does not have it on his person or in his motor vehicle, the arresting law enforcement officer shall order him to surrender it within 24 hours. If the person fails to do so, the law enforcement officer shall notify the court in which the arrested person is scheduled to appear of that fact. · (ORC 4511.191)

(f) If a person is charged with a violation of subsection (a) of this section and if the results of a chemical test administered pursuant to this section indicate that blood of the person contained a concentration of alcohol in an amount ref erred to in subparagraph (2), (3), or (4) of subsection (a) of this section, or if the person refused -to consent to a chemical test of his blood, breath, or urine to determine alcohol content under this section, the court shall immediately suspend the person's operator's or chauffeur's license or permit or non-resident operating privilege, if the court at the initial appearance, which shall be held within five days from the date of the citation or arrest, determines that one of the following is true:

(1) The person has previously been convicted of a violation of Ohio R.C. 4511.19 or of a municipal ordinance relating to operating a motor vehicle while under the influence of alcohol;

(2) At the time of the arrest, the person's driv~r's or chauffeur's license or permit or non-resident operating privilege was suspended or revoked;

(3) If the person caused death or serious physical harm to another person;

(4) If the person failed to appear at the initial appearance;

(5) The court determines that the person's continued driving will be a threat to public safety.

The suspension shall continue until the complaint alleging a violation of subsection (a) of this section is adjudicated on the merits by the trial court, or until the trial court, upon motion, determines by a preponderance of the evidence that there was no probable cause for the arrest. (ORC 4511.191)

(g) As used in this section "drug of abuse" means any controlled substance as defined in Ohio R.C. 3719.01, any harmful intoxicant as defined in Ohio R.C. 3719.01, any harmful intoxicant as deinfed in Ohio R.C. 2925.01 and any dangerous drug as defined in Ohio R.C. 4729.02. (ORC 3719.0ll(A))

Section 333.02

(a) No person shall operate a vehicle on any street or highway in willful or wanton disregard of the safety of persons or property. (ORC 4511.20)

(b) No person shall operate a vehicle on any public or private property other than_ streets or highways, in willful or wanton disregard of the safety of persons or property. This subsection does not apply to the competitive operation of vehicles on public or private property when the owner of such property knowingly permits such operation thereon. (ORC 4511.201)

Section 335.07

(a) No person whose operator's or chauffeur's license or permit or non-resident operating privilege has been suspended or revoked under Ohio R.C. Chapter 4507 (Driver's License Law) or under applicable law in any other jurisdiction where the license or permit was issued, shall operate any motor vehicle upon the highways or streets of this municipality which such license, permit, or privilege is suspended or revoked. No person who is granted occupational driving privileges by any court shall operate any motor vehicle upon the highways or streets of this municipality except in accordaney with the terms of the privileges. (ORC 4507 .38(A))

(b) No non-resident or other person whose operator's or chauffeur's license or permit or non-resident operating privilege has been suspended or revoked shall operate a motor vehicle in this municipality under a license, permit, or registration certificate issued by any other jurisdiction, or otherwise operate a motor vehicle in this municipality during a period of such suspension, or within on year after the date of such revocation. (ORC 4507.39(A))

(c) No person whose operator's or chauffeur's license or permit or non-resident operating privilege has been suspended under O~io R.C. 4511.191 shall operate a motor vehicle upon the highways or streets in ~his municipality. (ORC 4511.192(A))

(d) No person whose license or registration or non-residence operating privilege has been suspended or revoked under Ohio R.C. Chapter 4509 (Financial Responsibility Law) shall, during such suspension or revocation, drive any motor vehicle upon any highway in this municipality or knowingly permit any motor vehicle owned by such person to be operated by another upon any highway in this municipality except as permitted under the provisions of such Chapter. (ORC 4509. 76)

(e) It is an affirmative defense to any prosecution brought pursuant to subsections (a), (b) or· (c) of this section that the alleged off ender drove under suspension because of a substantial emergency, provided that no other person was reasonably available to drive in response to the emergency. (ORC 4507 .38(B), 4507 .39(B), 4511.192(B))
