Freight Transportation Tariffs and Additional Values

(According to the Statement by September 1st, 2010 Taking into account the inserted Changes and Amendments)

Article I. General Terms

1. The presented document includes LLC “Georgian Railway” Freight Transportation Tariffs and Values of the related Additional Services hereto, and enters into force from July 1st, 2006.

2. LLC “Georgian Railway”, while defining the Freight Transportation Tariffs and the Values of the related Additional Services hereto, operates on basis of the existed international normative acts, the Georgian Legislation in force, and LLC “Georgian Railway” resolutions.

3. In the event of the demand regarding the shipment and the service not foreseen according to the presented document, LLC “Georgian Railway” will define the shipment conditions by the particular single agreements.

4. The Tariffs and the Values can be changed due to the commercial interests of LLC “Georgian Railway”. In case of their increase, the change enters into force in one month period from its publishing or placing on LLC “Georgian Railway” electronic web-page, and in case of their decrease, at the very moment of its publishing.

5. The shipment tariffs baseline valuations are given in Swiss Francs. The tariffs denomination in Georgian Lari is also available. The tariffs baseline valuation and the additional values are presented without value added tax, accruing of which is implemented on basis of the existing legislative system in force.

6. The shipment price conversed into the national currency is implemented by LLC “Georgian Railway” for every parcel according to the shipment obligations (road charter) raised for the very day of the processing (consignor station calendar stamp), according to the rate fixed by the National Bank of Georgia. The shipment price is calculated by the tariffs, which operate on basis of the shipment documentation for the day of the sender station calendar stamp sealing.

7. The additional values are conversed into the national currency for the very day as LLC “Georgian Railway” has procured the service, the fixed rate of the National Bank of Georgia.

8. The payment currency is Georgian Lari, US Dollars, Swiss Francs, Pounds and Euro, according to the rate on the payment day fixed by the National Bank of Georgia, according to the legislation in force.

9. While defining the freight type “the Freight Harmonized Nomenclature” positions are utilized unless otherwise indicated.

10.While transporting of the goods by wagons, in the event of the existence of the different coefficients, and while calculating of the transportation value, the maximal coefficient is taken among the above mentioned, in addition the parcel factual weight is referred to the collective goods summarized weight.

11.By the Georgian Railway and by other railways for the wagons leased, when they liberate the Georgian Railway from the wagons utilization value, the condition set for the own wagons by the presented document, cover the leased wagons as well, if the appropriate agreement exists by the Georgian Railway regarding the issue.

12.Shipment of the container weighing more than 40 pounds is agreed upon with the railways participant to the shipment.

Article II. Definitions

1. The own wagon is considered to be the one, which belongs to the physical body or the legislative entity (except for the railways).

2. The value for the freight transportation is defined according to the shipment distance among the stations, which is deducted from the station axis. The distances among the Georgian Railway Stations are given in the table #1 of the attachment.

3. While shipment via Georgian Railway in the event of the state border crossing, the distance is deducted in the following mode:

a) In case of Russia – Station GANTIADI + 6kmb) In case of Armenia – Station SADAKHLO + 9kmc) In case of Azerbaijan – Station GARDABANI + 9km

Article III. Freight Transportation Values Calculation Rule and Tariffs Baseline Valuations.

1. The shipment price is calculated in the following mode:a) For the Wagon Parcels

b) For the Container Parcels

c) Empty Wagon Traffic

d) Contrailer and Minor Parcels Shipment Value calculated according to the Wagon Parcels existing rule.

e) While defining the Shipment Value, the calculated by the presented document T calculated, N wagon, N container is rounded up to the full centime (0.5 centime and more is rounded up to the full centime, and the less is not taken into account), then the sum is conversed into Georgian Lari in accordance with the Article I, paragraph6 and is rounded up to the full Tetri (0.5 Tetri and more are rounded up to the full Tetri, and the less is not taken into account).

2. The Table of the Attachment # 2 represents tariffs baseline rates for the freight unit (ton, container) according to the shipment distance.

3. While freight transportation the parcel calculated weight is represented by the parcel factual weight rounded up to the full ton, but no less than the weight category. 500 kg and more are rounded up to the full ton, and less than 500 kg is not taken into account.

4. While transportation on the limited weight railway sectors, if the calculated weight indicates to the limited weight, then while calculating the shipment value, the rate of 60 tons weight categories is considered on the whole route of the Georgian Railway traffic. In the wagon less than the limited weight shipment value is calculated according to the general rules. The Table of the Attachment # 3 represents the limited weight railway sectors.

5. One conductor travelling fee for every initial 100 km is 12.00 Swiss Francs.

6. Participating the Georgian Railway transmitter station while shipment of the “Oil and Petroleum Products” by wagon-cisterns, the freight transportation value is calculated with the rates of 60 tons

weight categories and taking into account the parcel factual weight (rounded up to the full ton). This rule does not cover the shipments loaded on the other railways and then redirected to Georgia.

Article IV. Tariff Correcting Coefficients According to the Freight Types (K cargo)

1. Correcting Coefficients according to the freight types are given in the Table # 4 of the Attachment. In addition, for the container parcels only the coefficients defined for the hazardous freight are used.

Article V. Tariff Correcting Coefficients According to the Distances and the Shipment Directions (K distance and direction)

1. The Coefficient 0.5 covers the Tariff Baseline Rates, except for:

- From the Stations Batumi, Poti via the Station Sadakhlo, and via the Station Sadakhlo to the Stations Batumi, Poti “Oil and Petroleum Products” while transportation of wagon and all freight container shipment;

- For the freight loaded in the Ports of Batumi and Poti (among them the containers) via the Stattion Sadakhlo, and for the freight shipped via the Station Sadakhlo to the Ports of Batumi and Poti (among them the containers).

From the Station Batumi and Poti via the Station Sadakhlo, and via the Station Sadakhlo to the Stations Batumi and Poti, while wagon transportation of the “Oil and Petroleum Products”, the coefficient 0.76 is spread, and at the presented paragraph, in case of the above mentioned exception – 0.83. The same covers the freight inflow /outflow by the ferryboat.

These coefficients are utilized in cases of the freight redirection, and accordingly, taking into consideration the through-passing and the ending stations (Ports, Ferryboats), they are used towards all the shipment documentation.

2. While shipment from the Stations Batumi and Poti via the Stations Sadakhlo or Gardabani, the coefficient 1.2 is used regarding the inflow freight, among them the goods entered from the ports and the ferryboats.

3. On the Georgian Railway, on the distance less than 100 km including, in the event of the shipment of the “Oil and Petroleum Products” the coefficient 2.5 is represented, and for the rest of the goods on the Georgian Railway, on the distance less than 50 km, in the event of the shipment, the coefficient 2 is represented.

4. In case of the shipment onto the main forking of the Georgian Railway, the coefficient 1 is spread. Besides, if the presented shipment is carried out by the main lines, the shipment costs are calculated as the curved tariff, that is the sum of the shipment tariffs for the main line and the forking. The branches of the main line are given in the Table 6 of the Attachment.

5. The Coefficient of the short distances and the forking is not used simultaneously. The Maximal one is taken among them.

6. While the cargo shipment by the cisterns, except for the “Oil and Petroleum Products”, the coefficient 2 is used. In addition, in the event of the above mentioned loads transportation, via the Stations Gardabani and Sadakhlo to the Stations Poti or Batumi, and from the Stations Poti or Batumi via the Stations Sadakhlo or Gardabani the coefficient foreseen by the presented paragraph is not utilized.

The conditions given in the presented paragraph cover the inflow and outflow freight from the ferry boat.

7. While transportation of the container parcels, when the transmitter and the destination stations both are the Georgian Railway Stations, the coefficient 0.5 is used in addition.

8. From the stations allocated onto the Sachkhere-Zestaponi forking while the sand (position – 25051000, 25059000) transportation, the coefficient 0.5 is used in addition.

Article VI. Tariff Correcting Coefficients According to the Wagon and Container Ownership (K wagon ownership coefficient, K container ownership coefficient)

1. While shipment of the cargo and the container parcel by the own wagon the coefficient 0.85 is utilized, and while the freight shipment with the own refrigerator section – 0.80. 

2. In case of the own empty containers shipment the coefficient 0.5 is utilized.

Article VII. Tariff Correcting Volume Discount Coefficient (K discount

coefficient) and the Volume Tariffs

1. The cargo shipment and the related service volume discounts and tariffs are used during the calendar year, except for the cases, when the client in advance agrees upon with the Georgian Railway the appropriate cargo shipment beginning date.

2. In the event of changing in the cargo shipment and the related service volume discounts and tariffs, those changes are spread after their entering into force for the implemented shipment and the provided service.

3. The cargo shipment and the related service volume tariffs for the whole volume of the defined shipment is spread immediately, if the client represents the bank guarantee or the letter of credit for the conditions affordable for the LLC “Georgian Railway” in the event of the defined volume cargo shipment to secure the admitted discount. Besides, it is possible to provide the increased guarantee according to the shipment volumes. Otherwise, the discount will only cover the volume exceeded for each ton. The bank guarantee issuing body can be not only a bank, but some other credit entity and even the insurance organization (the Guarantor). In addition, the guarantees not issued by the bank together should compile no more than 25% of the whole risk undertaken by the client liabilities. The credit entity (except for the bank) and the insurance company are obliged to re-insure onto the international insurance market the presented risk for the companies owning the international rating agency “Standard & Poor’s)” minimum BBB.

4. During one year from the Stations Batumi and Poti via the Station Gardabani, while shipment of more than 500 000 tons of aluminum ore and concentrate (26060000), and aluminum oxide (28182000), the coefficient 0.7 is to be adjusted for each exceeded ton of the total volume, and in the event of the shipment more than 1 500 000 tons – the coefficient 0.6 is to be assigned to each exceeded ton of the total volume.

5. During one year from the Stations Poti and Batumi – via the Station Gardabani, and via the Station Gardabani to the Stations Poti and Batumi, while the shipment of the dry freight more than 100 000 tons, except for the aluminum ore and concentrate (26060000) and the aluminum oxide (28182000), the coefficient 0.9 to be assigned for each exceeded ton of the total volume.

6. During one year via the Station Gardabani towards the Stations Poti, Batumi, Chaladidi, Kolkheti or to the Wide Water (after launching into exploitation), while shipment of four millions and more tons of the “Oil and Petroleum Products”, the following volume tariffs are defined:

a) For the “Damp Oil” (27090090) for one ton of the whole volume 5.85 Swiss Francs, including the costs for the return own empty cistern shipment.

b) For the “Oil and Petroleum Products” (27090010, 2712, 2713 except for 27131100 and 27131200, 27149000, 2715 2721-2749, 340319, 340399, 3404, 381121, 381129, 38170050, 38241000) for one ton of the whole volume 8.40 Swiss Francs.

7. In the event of the “Oil and Petroleum Products” volume tariffs spreading, in order to define the parcel calculating weight the factual weight is used rounded up to the full ton.

8. In the event of the “Oil and Petroleum Products” volume tariffs spreading, the coefficients foreseen by the Article VI of the presented document are not utilized.

9. In the event of the “Oil and Petroleum Products” volume tariffs spreading, while returning one’s own empty cistern and defining its shipment costs, the tariffs foreseen by the Article VIII, paragraph 1 of the presented document are not utilized.

10.With the participation of the transmitter station of the Georgian Railway while shipment of the black metal scrap (7204), for the parcels of 30-50 tons factual weight, the calculation for

the shipment costs is implemented with the rates of 50 tons weight categories, taking into account the condition of rounding up to the full ton of the parcel factual weight.

11. During one year, while the shipment of the soon rotten products of 50 000 and more tons (the list is available in the Attachment 4.1. of the International Railway Freight Traffic Convention), the following volume tariffs are to be assigned to the whole volume of the shipment:

a) For the cargos shipped by the Georgian Railway owned refrigerator sections, towards the tariffs set in accordance with the Article X of the presented document, the coefficient 0.5 is utilized;

b) For the cargos shipped by the other railways owned refrigerator sections, towards the tariffs set in accordance with the Article X of the presented document, the coefficient 0.8 is utilized;

Article VIII. Additional Fees

1. The transmitter or the destination station service fees are as follows:

a) The presented service means the railways owned wagons provision and export, and for the own wagons provision and export.

b) The presented service fee covers the following: documents formation, rolling stock utilization, rail-tracks occupation for the own wagons and other operations necessary for the cargo supply/exportation.

c) Working with the client maneuvering locomotive means to implement the ejection for dispatching and loading of the cargo to the front/from the front, from the station rail-track/to the station rail-track by the client locomotive.

d) In the commercially cancelled stations the clients service to be implemented in accordance with the agreement, form the commercially working nearby station, according to the fees defined in the Table 1.1.for the indicated stations.

2. At the Georgian Railway transmitter station, as the sum, undergoing on the road and at the destination station by fault of the client for the service more than 24 hours, for each initiated day the railway additional fee is the following:

By the fault of the client onto the course road in case of the cargo shipment delay, in the event if the destination station is not the Georgian railway station, the railway additional service fees are accrued for each initiated day from the very first hour of delay, according to the fees defined by the presented paragraph.

a) In the event of spreading of the “Oil and Petroleum Products” volume tariffs, for each single cistern of the whole volume, the service fee is to be defined according to the following amounts:

b) Via the Station Gardabani to the Stations Batumi and Poti, with the cisterns owned by the Georgian or the Azeri railways pyrolysis resin (39111000), white alcohol (27210000) and isopropyl alcohol (29051200) while the international shipment for each single cistern the service fee is to be defined in the amount of 50 GEL.

c) After 30 days the fees indicated in the presented paragraph are multiplied by 3.

d) Towards the black metal scrap-iron loadable and dischargeable wagons from the second day 200 GEL are accrued to the wagon, and from the fifth day – 500 GEL.

e) With the destination of the Georgian Railway Stations while the transportation of the bitumen with the wagons (27132000, 27149000), at the transmitter and the receiver stations the service fee is to be defined in the amount of 50 GEL for each wagon. Besides, for the indicated wagons the condition of the paragraph “c” subsection of the presented documentation is not valid (in force till December 31, 2010).

f) Towards the Oil and Petroleum Products dispatching railway inventory park wagon-cisterns from the second day each wagon is accrued with 500 GEL, except for the wagons loaded and arrived at the stations of destination of Batumi, Poti, Chaladidi, Kolkheti or Wide Water (after launching into exploitation).

3. In the event when the client has not carried out the assimilation of the planned transportation before expiration of the terms set for the task implementation, the latter is accrued with the fee for the non-assimilation, which is defined as the following:

4. Roll in and Roll out Fee for the Ferry Boat is the following:

5. With the support of Poti and Batumi Ports, while freight shipment between them by the ferryboat, when the transmitter/receiver is at the Stations of Poti or Batumi, towards the fees foreseen by the paragraphs 1, 2 and 4 of the presented article the coefficient 1.5 is valid.

6. On demand of the client, the additional fee for the railway owned maneuver locomotive service for each initiated half an hour is 60.00 GEL.

While defining the additional fees, the fees given in Swiss Francs are to be converted into Georgian Lari in accordance with the paragraph 8, article I of the presented document and

accordingly are rounded up to the full Tetri (0.5 Tetri and more are rounded up to the full Tetri, and the less is not taken into account).

7. Towards the railway owned refrigerator section technical service and maintenance wagons, the fees foreseen by the article VIII of the presented document are not applied.

Article IX. The Empty Cargo Wagons Traffic and the Rolling Stock on the Own Axis

1. The empty own cargo wagons (99220000, 99223000, 99221000, 99222000, 99224000), the Georgian Railway owned empty cargo wagons repair, during the other railways owned empty wagons repair/out of the repair, moving on the own axis empty cargo wagons compiles 0.10 Swiss Francs for the axis-kilometer, and the own empty cisterns traffic rate compile 0.05 Swiss Francs for the axis-kilometer.

In the rolling stocks of the trains during the passenger wagons repair/out of the repair the costs for their transportation is calculated as 0.15 Swiss Francs for the axis-kilometer.

2. The costs for the own refrigerator section and the refrigerator containers service-technical wagon traffic is calculated with the rate of 0.12 Swiss Francs for each axis-kilometer. The costs for the own empty refrigerator section wagons transportation is calculated with the rate of 0.10 Swiss Francs for each axis-kilometer, for the loaded as well as for the empty wagons only in the loaded refrigerator section rolling stock moving.

3. According to the other railways demand, the Georgian Railway owned empty transporter provision and return after the goods dispatching are implemented with the formation of the full package of the shipment documentation and upon the shipment costs reimbursement with the rate of 0.14 Swiss Francs for each axis-kilometer. Besides, if the transporter owned by the Georgian Railway is loaded at the Georgian Railway Station with the destination aimed to the other railway, or the goods are loaded at the other railway station with the destination aimed to the Georgian Railway Station, then in such case, after provision and return of the empty transporters the transportation fees are not charged.

4. In case of the transportation with the Freight Train rolling stock moving on its own axis (Locomotives, Railway Hoisting Cranes and other – positions 8601-8605), the transportation fee is calculated the same as for the wagon parcel. In addition, each unit of the rolling stock is counted as the separate parcel, and its own weight is considered to be the parcel factual weight.

Article X. Tariffs of the Freight Transportation with the Refrigerator Section

1. Special tariffs for the freight transportation by the railway and the own refrigerator section for one ton of the cargo, according to the stations, in Swiss Francs are as follows:

Besides the shipments foreseen by the presented paragraph, the shipment costs are calculated according to the wagon parcels rules, based on the parcel calculated weight, using the appropriate coefficient 2.5.

While transportation with the refrigerator section, in the event of the special tariffs spreading, for the parcel calculated weight definition the factual weight is taken, rounded up to the full ton. If the shipment by the refrigerator section wagon (without Service-Technical Wagon) is carried out instead of the wagon-thermos or the covered wagon, the shipment costs are calculated the same as for the wagon parcels.

2. According to the quantity of wagons in the refrigerator section, towards the tariffs set by the paragraph 1 of the presented article, the correcting coefficients are to be used:

a) Any type hoper-dosing unit and at the doom-doors – more than 40 tons, notwithstanding the freight type;

b) All the other type 4 axis cargo wagons more than 50 tons, except for the construction pumice stone, the loading of which is to be limited up to 40 tons;

The freight weight in both cases is defined on the wagon scale, and in case of absence of such scale – according to the volume weight.

With the destination of the sector stations towards the odd directions, the cargo shipment is possible only in the frameworks of the load-carrying capacity with the loaded 4 axis cargo wagons.
