Minutes of the ordinary Cantt Board meeting held on 19.09.2016 at 1400 hrs in the office of the Cantonment Board, Meerut.

Board observed two minutes silence for paying respects to the departed soul of Shri Prahlad Singh Singhal, Ex Vice President and the soldiers/officers who lost lives in Uri sector on 18.09.2016 during terror attack.

PCB addressed the Board before start of meeting and informed that the meeting was rescheduled at 2 pm due to certain exigencies. He also informed that certain new Ex-officio and nominated members will join as the present incumbents/ members have proceeded on posting. The issues of unauthorized constructions, improvement in state of cleanliness, electricity, water supply and other civic amenities were raised by PCB along with need for strict action against the officials/employees who fault in performance of their duties. He stated that there is no dearth of funds for development activities, and there is urgent need to show improvement as without these improvements, the vision of Smart Cantt would not be successful. He solicited suggestions and concern from all members of the Board assuring that strict disciplinary action shall be taken against concerned staff for any persistent failure in showing improvement.

291. ACTION U/S 26 OF C.A. 2006

To note the actions taken by the CEO with the prior sanction of PCB U/S 26 of C.A. 2006:-

(i) Sanction dated 17/07/2016 regarding technical examination of construction material in respect of unauthorised construction of mall in the compound of B.No.210/B West End Road Meerut Cantt.

(ii) Sanction dated 26/07/2016 regarding auction of transfer of collection rights of temporary parking on account of kanwar festival w.e.f. 30/07/2016 to 01/08/2016 @ of highest bid of rupees 19500/- per day in favour of Shri Sanjeev Sharma S/O Brahmanand Sharma.

(iii) Sanction dated 29/07/2016 regarding expenditure on account of legal assistance provided to Shri. Anuj Singh CEE Cantt Board Meerut in the Court of District Judge Meerut in case relating to demolition of B.No. 210B (Mall).

(iv) Sanction dated 29/07/2016 regarding expenditure on provision of temporary lighting/decoration on the route of kanwar.

291. Resolution

Noted the sanctions of PCB for Rs. 50000/-, 19500/-, 105000/- & 142200/- in respect of items (i) to (iv). Also resolved that the panel of counsels be revised to engage counsels who could produce results & reduce pendency of cases.

Further resolved that a treasury A/c be got opened for recovery of fines ordered by competent courts.

292. CONFIRMATION OF MINUTES OF FINANCE COMMITTEE MEETING DATED 23.08.2016.

To confirm the minutes of adjourned special finance committee meeting held on 23.08.2016 in the office of the Cantonment Board.

292. Resolution

Confirmed with the following modifications:-

1. In the Agenda point No. 14 of the Finance Committee to read under the heading closing balance Closing Balance on last day of “March 2016” instead of “February 2016”.

2. Mr Vipin Sodhi, Member Cantt Board desired to re-study Annual Consolidated Accounts for the year 2015-16 forwarded to the Govt. of India. This was allowed by Board.

3. The recommendation on agenda point No. 20 of Finance Committee be modified to read the lines “reasonability of rates quoted by the firms be given by the office in future” instead of “further recommended that reasonability be also given by the office on rates in case of rates quoted by 01 or 02 firms in future”.

293. REVISION OF RATE OF HOUSE RENT ALLOWANCE ( INCREASE IN EXISTING RATE BY 20%) IN R/O OF EMPLOYEES OF CANTT BOARD MEERUT.

To consider & approve the revision of Rate of House Rent Allowance by 20% in the existing Rates to the employees of Cantt Board Meerut as per UP Govt Order No. 47//2016/Vee-Aa-2-1017/Das-08(Mu.Se.Se.) 2011 TC dated 19.08.2016 & GO No.1/2016/G-119/Das-2016-226/2008 dt 12.08.2016.

by increase of 20% (by rounding off in next Rs.10) to its employees w.e.f. 01.08.2016 as under :-

2. As per clause 4 read with 14 of Memorandum of Settlement, Cantt Board employees are entitled for the pay and allowances at par with state Govt. employees. As per Clause 14, the following allowances shall be paid at the same rate and under the terms & conditions as specified with Respective State Govt s in r/o State Govt employees.i. Dearness Allowances. ii. Hill or Compensatory Allowanceiii. House Rent Allowance ( HRA) iv. Cash Allowance.v. CCA. Vi. High Altitude Allowance.

3. Since, the state Govt of UP has revised the rate of HRA to its employees vide Go referred above , the employees of Cantt Board are also entitled to get revised rate of HRA w.e.f. 01.08.2016.

4. Presently, the Board is paying Rs.5,75,740/ per month on a/c HRA to its employees. After proposed revision of rates of HRA by 20%, there will be additional financial implication of Rs.1,15,200/- per month. Necessary Budget provision for the same exists in respective Budget Heads under Revised BE 2016-17.

5. It is recommended that proposal seeking sanction for revision of rate of HRA as mentioned in Col.4 of above table to the employees of Cantt Board Meerut w.e.f. 01.08.2016 under Rule 47 read with Rule 19 (b) of Cantt Account Code 1924 be forwarded to the Directorate DE CC, Lucknow.

294. GRANT OF EX-GRATIA/ADDL PENSION TO 03 PENSIONERS OF CANTT BOARD MEERUT ON ATTAINING AGE OF 80 YEARS.

To consider applications received from S/Sh. Govind Ram Kukreja, Ex- AE (E&M) dt 08.07.16, Kailash S/O Budhan, Ex- S/w dated 23.07.16 and Smt. Shakuntala Khosla ( Family Pensioner) dt 04.08.2016 for grant of additional pension by increasing 20% after attaining age of 80 Years.

OFFICE REPORT

1. Board is informed that pension/ family pension in r/o of retired employees of the Cantt Board Meerut is being given as per CCS ( Pension) Rules 1972 under Rule 31 of CFSR 1937.

2. As per the provision / directions issued by the Govt of India, Ministry of Personnel & Public Grievances, Deptt of Pension & Pensioners Welfare vide letter No. F No.38/37/08-P & PW (A) dt 03.10.2008 has implemented ex-gratia pension/additional pension to old pensioners/family pensioners w.e.f. 01.01.2006 at the following rates of basic pension :

4. It is also reported that the Basic Pension of the above named pensioners is already sanctioned by the GOC-in-C, CC & based on which they are being granted pension since their respective date of superannuation.

Board may consider & approve grant of additional pension @ 20% of basic pension as per Govt order to the above-named pensioners with effect from date of attaining age of 80 years in each case as mentioned in the above table.

Considered and resolved that additional pension at the rates, may be granted to eligible pensioners mentioned on the agenda side w.e.f. the dates of attaining age of 80 years by respective pensioner.

295. RENEWAL OF CONTRACTUAL ENGAGEMENT OF DENTIST IN CANTT GENERAL HOSPITAL, MEERUT CANTT.

To consider issue of renewal of contractual engagement of Dr. Richa Gupta, Dentist in Cantt General Hospital, Meerut Cantt on sharing basis.

Board is informed that Dr. Richa Gupta, BDS was engaged by the Board on 04.07.2014 on sharing basis which was extended for the period of one year w.e.f. 08.07.2015 vide CBR No. 43 dated 16.09.2015, the ratio of sharing of profit is 70:30 i.e. 70% share of Dentist and 30% share of Board in fee. The period of engagement is over on 08.07.2016. The RMO has recommended for renewal as the performance of individual is satisfactory.

Dr. Richa Gupta has requested for renewal of another period of one year on the same terms and conditions. The office however proposes reformation of terms & conditions of engagement and invite fresh offers/applications.

Board may consider and take suitable decision in the matter.

295. Resolution

CEO informed that the services of Dentist through private contractual engagement is being provided on profit/revenue sharing basis. An analysis of the revenue sharing basis system as well as services being provided through this contractual engagement do not give any satisfactory result. There is a need to reframe terms and conditions of engagement of the dentist in view of the above so that better services are provided with better yield of revenues for the Board as entire infrastructure is provided by the Board. Moreover, the beneficiaries of the hospital services are mostly from outside Cantt area & only limited numbers of Cantt residents utilize the services from this engagement which defeats the bonafide services of providing expert medical facility intended basically for the Cantt residents through Cantonment General Hospital.

Considered & resolved that a detailed study will be carried out by the office, and report alongwith fresh terms and conditions brought before the Board in the next meeting. Based on new terms and conditions or the suggestions as may be made by the office, fresh engagement be undertaken thereafter. Board also noted that after completion of engagement on 08.07.2016 the engagement has been extended by the CEO till further decision of the Board and the same may be continued till fresh decision is taken by the Board as per above resolve.

Board also resolved that with immediate effect the OPD charges for residents of outside Cantt area be revised to Rs. 100/- per patient per day and only consultation services provided to them without any supply of medicines, by hospital.

296. RECOGNITION OF UNION – AKHIL BHARTIYA SAFAI MAZDOOR CONGRESS .

Reference : CBR No. 219 dated 10.06.2016.

To consider application dated 02.02.2016 of ABSMC, Branch Meerut Cantt Board requesting therein for recognition of union.

Board is informed that Shri Pujesh Lohre Newly Elected President, Akhil Bhartiya Safai Mazdoor Congress has submitted application dated 02.02.2016 alongwith following documents:-

1. Constitution of Akhil Bhartiya Safai Mazdoor Congress2. List of Members of the Union3. Letters of consent of the Members of the union for deduction of contribution from

the salary at source. 4. Affiliation certificate of All India Cantt Board Employees Federation. 5. Election Certificate issued by the Election Officer who conducted the election.

As per the Rules of Recognition of Trade Unions circulated by the DG DE vide letter No. 25/37/JCM/C/DE/2011 dated 26 August 2013, the above union fulfills the condition of recognition.

The CEO informed the Board that despite office report that the applicant union fulfilled criteria for recognition, the matter of recognition was pended by the Board on demand of Elected Members. The Dte. DE Central Command has issued direction that if the union fulfills criteria of recognition the Board should recognize the unions before 30.09.2016. Board resolved that the applicant union namely Akhil Bhartiya Safai Mazdoor Congress is recognized by the Board for a period of one year as it fulfills the criteria of recognition.

Board is informed that Shri Yogesh Yadav, Newly Elected President, Chawni Parished Karamchari Union has submitted application dated 9.11.2015 alongwith following documents:-

1. Constitution of Chawni Parishad Karamchari Union. 2. List of Members of the Union3. Letters of consent of the Members of the union for deduction of contribution from

To consider revision of rates of fixing of Shamiyana, Conservancy charges for use of Govt. land for purpose of fixing of Shamiyana.

Office note

Board is informed that the Board vide CBR No. 392 dated 11.03.2013 fixed Rs. 150/- for fixing of per Shamiyana (measuring 15’x15’), conservancy charges Rs. 200/- and Site plan Rs. 50/- has fixed for per function.

Board is informed that the general public of Cantt area seeks permission to organize their functions i.e. marriage party, other religious functions and other party functions on the vacant lands under the management of the Cantonment Board. They install Shamiyanas and pay charges as fixed by the Board which are very normal charges. The existing rates were fixed in March 2013 and they require revision. Therefore, to increase the revenue, the office proposes to revise the said charges are as under:

299. PERMISSION FOR USE OF MANGLAM MARRIAGE PLACE AT ABU LANE AND USE OF GOVT LAND FOR MARRIAGE FUNCTION WITHIN THE LIMIT OF MEERUT CANTT FOR CANTT BOARD STAFF.

Reference: CBR No. 225 dated 10.06.2016 and CBR No. 105 dated 27.01.2016.

To consider allowing concession in booking amount of Manglam marriage place, and use of Govt Land without any charges for marriage purposes of Cantt Board staff.

Board is informed that the Board has developed marriage place in B. No. 173, Abu Lane Meerut named as “MANGLAM” and fixed charges for general public vide CBR No. 335 dated 27.09.2014, which are as under :

The matter for granting concession for use of Manglam Marriage Place to Cantt Board Staff was placed before the Board in its meeting held on 27.01.2016. The Board vide CBR No. 105 dated 27.1.2016 had deferred the matter and given concession only to Shri Rakesh Kumar, Sanitary Supervisor as special case & as a staff welfare measure @ Rs. 5,000/- per day for use of Manglam and Rs. 5,000/- on account of security (refundable).

301. Resolution

CEO read the motion & informed the Board that an FIR has already been filed in the Police Station against builder Shri Anand Prakash Aggarwal holding him responsible and also District Admistration and Police have been informed for arresting the said builder as per High Court order. However, no action of arrest has been taken so far by the concerned authority. An application has also been filed with the Chief Judicial Magistrate, Meerut for execution of order of arrest of the said builder given by the Hon’ble High Court on 29.03.2016. The matter is pending with the court of CJM, Meerut. In case of no action,

Hon’ble High Court shall be approached again with the facts. Regarding request No. 2, CEO stated that any such action is beyond purview of Board. CEO informed the Board that decision to recover expenditure on account of compensation from the builder has already been taken by the Board vide CBR No. 282 dated 14.07.2016. The office also recovers cost of demolition from the concerned person. The Builder Shri Anand Prakash Aggarwal has also offered to pay the cost of demolition while simultaneously requesting that fallen debris (Malba) be allowed to be removed by him as it belongs to him. CEO further informed that the auction was carried out to invite bids for removal of malba in which 03 highest bidders who had given bids did not turn up for accepting contract & their security deposits have been forfeited by the office. advised that Board may also consider further action regarding removal of malba from site while considering the motion in view of above position. Resolved that the entire expenditure incurred by Board as per CBR No. 282 dated 14.07.2016 be recovered from builder by initiating a recovery case through DM Meerut/Court of CJM as per provisions of Cantt Act if he fails to pay the same. 304. PROMOTIONS TO THE POST OF OFFICE SUPERINTENDENT, TAX SUPERINTENDENT & REVENUE SUPERINTENDENT.

To consider promotion to the post of Office Superintendent, Tax Superintendent & Revenue Superintendent.

Board is informed that the post of Office Superintendent, Tax Superintendent & Revenue Superintendent are lying vacant since long due to various reasons like seniority, reservation in promotion etc. Board is competent authority for filling vacancies in these cases as these posts are supervising posts under Rule 2(f)(f) read rule 7 of CFSR, 1937. For the promotion to the post of Revenue Supdt & Tax Supdt, feeding cadre is selection grade clerks.

For promotion to the post of Office Supdt selection is to be made on the basis of seniority cum merit and selection is to be made amongst the Tax Supdt, Revenue Supdt & Accountant.

304. Resolution

CEO informed that Shri M.A. Zafar is performing presently the duty of Office Supdt and such performance is in existence since 2007. Therefore, at present promotion on the post of Office Supdt is not considered for the time being as the existing arrangement is satisfactory & therefore his request for relieving the additional charge is not accepted. However, the post of Tax Supdt and Revenue Supdt in the supervisory grade may be filled up by promotion of the eligible employees from the feeding cadre of selection grade which are Shri Jaypal Singh Tomar and Shri Brijesh Singhal respectively. Resolved that pending the promotion and filling up the post of Office Supdt Shri Jaypal Singh Tomar is promoted to the post of Revenue Supdt & Shri Brijesh Singhal to the post of Tax Supdt on adhoc basis (as Shri Promod Kumar has declined promotion for one year) in the Pay Scale of Rs. 5200-20200 + Grade Pay Rs. 2800/- with immediate effect.

Shri Vipin Sodhi, Elected Member dissented from decision & questioning the fresh seniority list. CEO informed that the seniority list was approved by Board vide CBR No. 310 dated 28.07.2014 & promotions are being recommended strictly as per it. Regarding the issue of reservation in promotion as per latest High Court/Supreme Court order, he informed that the issue order has been referred to Dte DE Central Command & action as per decision shall be taken by office/Board.

305. GRANT OF OFFICIATING ALLOWANCE.

To consider grant of officiating allowance of the post of Office Superintendent to Shri M.A. Zafar, Officiating Office Superintendent.

Board is informed that Shri M.A. Zafar is performing additional duty of Office Superintendent in officiating capacity in addition to his substantive duties of V. Inspector

since 15.11.2007 but he is not getting officiating allowance under FR 49. The office had earlier forwarded a proposal to the Dte DE, Central Command vide letter No. 104/A/82/187 dated 08.05.2012 but no response has been received so far from the Dte DE, Central Command. Under FR 49 an employee if performing onerous duties of higher grade for more than 3 months is entitled to get the difference of pay in the higher grade and the substantive grade of the employee. The post of Office Supdt is duly sanctioned and the pay & allowances in the budget of the said post are also sanctioned.

Since there is no revision of pay scales involved therefore, there was apparently no need to seek sanction of the GOC-in-C. Under the circumstances and in view of the FR 49 Board being competent authority may consider grant of officiating allowance to the individual and the Dte DE Central Command may be informed of the rule position.

Considered and resolved that since the issue relates to competent authority under FR 49 and is not in the nature of revision of establishment under rule 5 of CFSR, 1937 read with rule 17-A and rule 45 of Cantt Account Code, 1924, the Board may grant officiating allowance to the official. However, the reference made earlier may be pressed for clarification. Further resolved that officiating pay of the post of Office Supdt be granted to Shri M.A. Zafar for the period of his officiating as Office Supdt on receipt of clarification. The Board is informed that Shri Sandeep S/O Shri Naresh Kumar S/W C.No.6-A vide application referred above has stated that he got severe injury in a road accident while on duty on 21.06.2016 and he has been referred to Dayanand Nursing Home Meerut by the RMO Cantt General Hospital Meerut for treatment vide not dt 21.06.2016. Dayanand Nursing Home vide note dt 21.06.16 further referred the patient to higher centre for orth. Treatment i.e. Mratunjaya Hospital which is not on Board’s panel.2. It is reported that as per Rule 53 of CFSR 1937 the matter regarding health facilities of Cantt Board’s employees are governed with Medical Attendance Rules. 3. Shri Sandeep Kumar has submitted the bills of his treatment in Cantt General Hospital duly signed by the Doctor of treating hospital and RMO Cantt General Hospital vide report dated 08.08.2016 has recommended the bills to the tune of Rs.3,62,174/- 4. 2. The UP Govt. GO. No. Va-2-401/Das-54(M) 2008 TC dated 18-03-2011 & UP Govt. GO. OFFICE REPORT

1. Board is informed that Sh. Anurag Chaudhary was appointed as Junior Grade Clerk on 26.02.2009 in the pay scale of Rs. 3050-75-4590 (pre revised) which was subsequently revised as per 6th pay commission report to Pay Band of Rs. 5200-20200+Grade Pay of Rs. 1900. He possesses educational qualification as Intermediate, Hindi & English Typing + Technical qualification in Certificate in CCC. He also possesses Registration Course on Computer Concept Certificate issued by DOEACC in NIELIT University.

2. The UP Govt. GO. No. Va-2-401/Das-54(M) 2008 TC dated 18-03-2011 & UP Govt. GO. No. Va-2-44/Das-54(M) 2008 TC dated 22.12.2011, 20.01.2014 & 17.01.2014 has changed the designation of Junior Grade Clerk to Junior Assistant & revised the Grade Pay for the Post of Junior Assistant from Rs. 1900 to Rs 2000.

3. It is reported that as per Establishment Folder of Cantt Board Meerut, the post of Junior Grade Clerk is equated with the post of Routine Clerk in Distict Office which has been changed to Junior Assistant with qualification Inter+ Course on Computer Concept (CCC) Certificate issued by DOEACC .

4. As per Memorandum of Settlement Cantt Board employee is entitled for Pay and allowances at per with State Govt. Employees.The sanctioning authority for grant of sanction of revision of Pay in the GOC- IN- CC under rule 47 read with 19(b) of Cantt Account Code 1924.

5. Since the applicant fulfill the condition of UP Govt. GO. No. Va-2-401/Das-54(M) 2008 TC dated 18-03-2011 & UP Govt. GO. No. Va-2-44/Das-54(M) 2008 TC dated 22.12.2011, 20.01.2014 & 17.01.2014 , it is recommended that proposal seeking under rule 45-47 read with rule 19-b of Cantt Account Code 1924 for grant of revised Grade Pay from Rs. 1900 to Rs. 2000 w.e.f 26.02.2009 and also change of designation from Junior Grade Clerk to Junior Assistant to Sh. Anurag Choudhay be forwarded to the GOC-in-C, HQ CC Lucknow in term of UP Govt. GOs referred above.

6. It is furthure recommended that for future appointment of Junior Grade Clerk/Junior Assistant in Cantt Board, Meerut the CCC Certificate issued by DOEACC Socity be

also add as essentital qualification as per UP Govt GO. No. Va-2-44/Das-54(M) 2008 TC dated 17.01.2014 and Pay Scale for the post be revised as Rs. 5200-20200 + Grade Pay 2000/-.

To consider and approve the waiving earlier condition of stopping HRA of those employees whose spouse is also a Govt Servant & are residing in the same house vide UP Govt GO No.V201105/G-1=01/das/2015-226/2008/TC-II dated 11.02.2015.

OFFICE REPORT :

1. Board is informed that the 05 employees of Cantt Board Meerut have requested UP Govt GO.No.V2015/g-1/das/2015/TC-II dated 11.02.2015 has waived the condition in earlier GO dated 15.12.1981,28.04.2000 for grant of HRA to any one of the spouse who both are Govt servant and are residing together in one house .As such they have requested to restore their HRA as per revised GO.dt.11.02.2015.

2. As per revised GO dt 11.02.2015,HRA will be admissible to both husband & wife w.e.f. date of issue of GO i.e. 11.02.15 and no pervious cases will be reviewed/re-considered.

3. As per clause 14 of Memorandum of Settlement, the pay & allowances (including HRA) is being paid to the Cantt Board employees at the same rate & terms conditions as specified by the UP Govt in r/o o State employees. Now the applicants are also entitled to get HRA on the parity of other employees of the Cantt Board Meerut duly sanctioned by the GOC-in-C, CC conveyed vide Directorate DE letter No.34238/Gen dated 19.08.2009.

4. Board is also informed that as per GO dt 11.02.2015, there is no revision in rates of HRA only few (5-8) employees whose HRA was stopped in last few years on

the basis of previous GOs dt 15.12.1981,28.04.2000. will now be entitled to get HRA on the same approved rates in revised pay structure at the parity of other employees of the Board.

5. Board is informed that Dte DE HQ CC vide Sanction Letter No.8334/HRA/CB/CANTT/15 dt.22.02.2016 has accorded Sanction in r/o 07 other employees of Cantt Board Meerut in the same cases.

To consider the sanction under FR 44 with para 14 of the Memorandum of settlement to grant the dearness relief @ 125% of the basic pension w.e.f. 01.01.2016 to the Pensioners/Family Pensioners of Cantt Boards as per UP Govt GO No. 16/2016/Sa-3-476/X2016-301/2000/T.C. dated 14.06.2016 accorded vide Directorate DE HQ CC letter under reference.

It is submitted that the proposal for grant of DR @ 125% of the basic pension to the Cantt Board pensioners/family pensioners w.e.f. 01.01.2016 as per UP Govt GO referred above was forwarded vide this office letter No. 641/A/Pension/335 dated 24.08.2016.

The Directorate DE letter under reference has accorded sanction under FR 44 read with the Momorandum of settlement para 14 and Rule 19(b) of Cantt Account Code 1924 @ 125% w.e.f. 01.01.2016 with the direction that the payment of arrears, if any, be regulated strictly in accordance with the terms and condition stipulated in UP Govt GO and only getting it approved by the Board and a copy of CBR be forwarded to the Dte. DE, HQ, CC within month.

Board is informed that in compliance of the sanction of the Directorate DE, the pension for the month of Jan 2016 is being paid @ the revised rate of DR 119% of the basic pension and there is financial effect of Rs. 13,62,976/- w.e.f. 01.01.2016 to 31.08.2016 as arrear and monthly increase of pension liabilities will be Rs. 1,70,372/- approx.

Necessary budgetary provision of above arrears of DR has been made in the Budget Estimate for the year 2016-17(o) & (R) in Budget Head H1 (b).

To consider highest bid of Rs. 42,10,000/- per annum offered by M/s M G Prachar Pvt Ltd, Hapur for grant of advertisements rights on unipoles/hoardings/LED based video walls on govt land, kiosks on electric/street poles and hoardings on private properties within the limit of Meerut Cantonment for a period of 03 years with enhancement by 5% every year on annual amount.

Board is informed that subject e-tenderS through portal at www.eprocure.gov.in were invited on 29.8.2016 at 1500 hours from eligible companies/co-operative societies/registered partnership firm/individuals for grant of advertisements rights on unipoles/hoardings/LED based video walls on govt land, kiosks on electric/street poles and hoardings on private properties within the limit of Meerut Cantonment for a period of 03 years after wide publicity in leading newspapers namely “Danik Jagran & Indian Express on 09.08.2016.

As per schedule of tender, technical bids were opened on 30.8.2016 at 1500 hours, 05 tenders were received. After valuation of technical bid, only 04 tenders were found qualified for opening of financial bid. The financial bids were opened on 5.9.2016 at 1400 hours. As per above, the highest bid of 42,10,000/- per annum has been offered by M/s M G Prachar Pvt Ltd, Hapur for a period of 03 years with enhancement by 5% every year on annual amount, as per table.

Board is informed that previously the contract for grant of advertisements rights on Unipoles/Hoardings etc was awarded to M/s Balaji Advertising Agency, Meerut for period of 03 years @ Rs. 42,29,000/- per annum with enhancement by 5% every year w.e.f. 21.5.2012 to 20.5.2015. The Contractor had not deposited III installment due against him. The matter was placed before the Board in its meeting held on 30.3.2013. The Board vide CBR No.449 dated 30.3.2013 resolved that the “contract of Hoardings/Unipoles be cancelled forthwith being violation of terms and conditions of contract agreement. After cancellation till the time the hoardings/structures are removed by the contractor, damages be recovered”.

Board is informed that the said auction was again conducted on 08.09.2013 for period of 01 year after wide publicity in newspapers named “Dainik Amar Ujala & Dainik Hindustan” on 03.09.2013. 04 bidders had participated in the auction proceedings. The highest bid of Rs, 40,70,000/- per annum was offered by M/s Midas Infratech Pvt. Ltd. Ghaziabad. The Board vide CBR No. 103 dated 26.11.2013 had approved the highest bid of Rs. 40,70,000/- per annum offered by M/s Midas Infratech Pvt. Ldt. Ghaziabad for period of 01 year. But highest bidder had not deposited contractual amount. Therefore, the contract was cancelled with forfeited earnest money worth Rs. 1,00,000/-.

The fresh auction was invited on 19.02.2014 after wide publicity in newspaper but no bidders participated in the auction proceeding. The auction was again and again conducted on 20.03.2014, 02.06.2014, 24.06.2014, 28.08.2014 & 17.01.2015 but bidders were not interested to participate in the auction proceedings and no bid was received. Due to non participation of bidders, the Cantonment Board has suffered huge losses on account of license fee on advertisement under the provision of section 67 (b) of Cantt Act, 2006.

A campaign was lodged in past few months by office to remove unauthorized hoardings and advertisement & all unauthorizedly erected structures have been seized by the office. The proposed action shall increase the Board’s revenues from idle resource of hoardings.

Considered and resolved that highest bid of Rs. 42,10,000/- per annum offered by M/s M.G. Prachar Pvt. Ltd., Hapur mentioned on the agenda side is approved for a total period of 03 years subject to the condition of enhancement for the second & third year by 5% of amount of contract. The contract be enforced strictly as per the terms & conditions of the contract. Necessary agreement of contract be got executed in due course by the office.

315. E-TENDERING BIDS FOR GRANT TO TRANSFER OF COLLECTION RIGHTS OF TOLL TAX FROM 06 POINTS WITHIN THE LIMITS OF MEERUT CANTONMENT FOR PERIOD OF ONE YEAR.

To consider highest bid of Rs. 93100/- per day offered by Shri Ashok Kumar Goel, Meerut for grant of transfer of collection rights of toll tax from 06 points within the limits of Meerut Cantonment for period of one year from the date of allotment of rights.

Board is informed that subject e-tenders through portal at www.eprocure.gov.in were invited on 08.09.2016 at 1400 hours from eligible companies/co-operative societies/registered partnership firm/individuals for allotment of collection rights of toll tax from 06 points within the limits of Meerut Cantonment for a period of one year after wide publicity in leading newspapers named “Danik Jagran & Times of India on 18.08.2016. The Technical Bids were opened on scheduled date i.e. 08.09.2016 at 1600 in presence of representatives of Bid Opener and received 02 technical bids.

After valuation of technical bids, 02 technical bids were found qualified for opening of financial bids. The financial bids were opened on 9.9.2016 at 1100 hours in presence of participants bidders. The details of received financial bids are as under :-

The highest bid of Rs. 3,39,81,500/- per annum and Rs. 93,100/- per day has been offered by Shri Ashok Kumar Goel, Meerut.

Board is informed that the subject tenders through two bids system were invited on 27.7.2015 for period of one year after wide publicity in leading newspapers named Dainik Jagran & Indian Express on 14.7.2015 The highest bid of Rs. 105,151/- per day was offered by Shri Subhodh Kumar, Muzaffarnagar for a period of one year which was approved by the Board vide CBR No.54 dated 16.9.2015. Due to short collection of toll tax, the highest bidder was not interested to carry out the said contract for period of one year, therefore, as per terms & conditions of tender, he left the contract in mid term.

After withdrawal of contract by the contractor, fresh tenders were invited on 02.1.2016. In response only one tender was received by this office .The sealed financial bid of the same was opened and resealed and kept in safe custody which was re-opened in the presence of the Board on 27.01.2016 wherein bid @ 95,000/- per day was quoted by Smt Rajesh Devi W/o Shri Hardan Singh. This was rejected being single tender by the Board vide CBR No. 104 dated 27.1.2016.

The Board had started the work of collection of toll tax through Cantt Board’s staffs and by engaging 40 casual labours on daily wages since 29.01.2016 and has collected Rs. 21479077/- w.e.f. 30.01.2016 to 31.8.2016, which comes to Rs. 99903/- per day without Development charges 3% +2% TCS & 2% Stamp Duty.

An amount of Rs 5,05,800/- per month i.e. Rs. 16833/- per month (approx) is being incurred on a/c of overtime of Cantt Board Staff and salary of casual labours and other expenses except the salary of Cantt Board’s regular staff, who are engaged in the collection of toll tax work. Therefore net income on a/c of Toll tax comes to Rs. 83070/- per day after deduction of expenses incurred by the Board and without taking into account salary of regular staff who are engaged in the collection of Toll tax, departmentally.

Considered & resolved that highest bid of Rs. 93100/- per day (Rs. 3,39,81,500/- per annum) given by Shri Ashok Kumar Goel, Meerut is approved for a contract period of one year from the date of handing/taking over of toll points. Board noted that the bid is reasonable in the light of recovery made by the office staff and expenditure incurred by the Board since the termination of last contract.

PCB also directed that toll points should be improved and road bye lanes created for giving a beautiful look to the toll point at Sardhana Road as it is at the entrance point of Cantt. As per AE’s estimation, Board approved Rs. 10 lacs for building, road and allied improvements. CEO is authorized to execute works after completing all formalities & incur expenditure.

316. MAKING OF PHAR AT MANGAL PANDAY BAZAR

To consider representation dated 21.8.2016 received from the traders of Mangal Pandey Bazar for making of Phar at Mangal Pandey Bazar, Meerut Cantt.

OFFICE NOTE

Board is informed that a representation dated 21.8.2016 has been received from the traders who are trading their business in the Mangal Pandey Bazar, Meerut Cantt , stating therein that in rainy season, in the said area, there is no drain to take out the rain water from Mangal Pandey Bazar and this problem has baffled everybody. They have requested to construct drains in the said area. They have also requested to construct phars under the tehbazari bye-laws and allotted to them. They are ready to pay monthly tehbazari fee as fixed by the Board.

Board is informed that the Mangal Pandey Bazar situated at Abu Lane is property of Cantt Board Meerut. The said area was developed by the Board during the year 1982 by making 168 pacca platforms which were allotted to traders on annual license basis. Due to filling of rain water in the said area, maximum traders had left the Mangal Pandey Bazar and licensee of Amrit Hotel had also objected for non providing of parking, therefore, since long no license fee was recovered from any trader.

Board is informed that if the Board construct the phars in the said area, under the tehbazari bye-laws good revenue may be collected per month as monthly thebazari fee which will be new source of income of Cantonment Board.

Board is informed that as per provision of section 282(13) and 283 of the Cantt Act 1924 framing bye-laws for regulation of the use of occupation of any street or place in the Meerut Cantonment that No street or place shall be used or occupied by itinerant vender or by any person for sale of articles or the exercise of any calling or the setting up of any booth or shall without the previous sanction in writing of the Executive Officer and payment of fees set forth in the schedule attached to these bye-laws and then only provided that there shall be left in the street a clear space of sufficient width to allow the passage of vehicles.

317. ENHANCEMENT OF MONTHLY TEHBAZAR FFE FOR USE OF GOVT LAND/KIOSK PERMITTED UNDER TEHBAZARI BNYE-LAWS

To consider enhancement of monthly tehbazari for use of govt land/kiosks permitted under tehbazari bye-laws within Meerut Cantonment.

OFFICE NOTE

Board is informed that 237 old sites and 17 new sites were permitted by the Board/CEO under tehbazari bye-laws by paying of tehbazari fee as monthly basis within the Meerut Cantonment area.

Board is informed that owing to implement of Seventh Pay Commission report and hike in the prices of general product and other product, it has become expedient to revise the prevailing fee chargeable by the Cantt Board to enhance the revenue of Cantonment Board Meerut.

The venders of old sites are paying Rs.122/- to 360/- per month and new venders are paying Rs.930/- per month as tehbazari fee for use of 100 Sq.ft govt.

The Board vide CBR No.432 dated 18.3.2013 had fixed daily tehbazari fee @ Rs. 38/- per day for use of 100 Sq.ft govt. land.

In view of above, there is a need to revise monthly tehbazari fee.

Considered and resolved that the tehbazaari fee be revised to Rs. 150/- per day per 100 Sq ft for Sadar Bazar, Abulane & Begum Bridge, Rs. 100/- per day per 100 Sq ft for Lalkurti & Cantt Railway Station and Rs. 75/- for Rajban, Topkhana & other remaining areas with effect from 01.01.2017.

Further resolved that necessary proposal seeking sanction of the Govt. of India, Min. of Defence for conversion of land of B. No. 197, Delhi Road and B.No. 28, Bakery lane from class A-1 to class ‘C’ in the light of the NOC granted by the Hqr Paschim UP Sub-Area be forwarded through the GoC-in-C/ PD DE Central Command.

A show cause notice as well as notice to stop the unauthorized constructions bearing No. MCB/BLDG/ENGG/240/887 dated 31-05-2016 & No.MCB/BLDG/ENGG/ 240/888 dated 31-05-2016 were issued and served to the offender on 10-06-2016 directing him to stop construction forthwith.

The offender has raised new unauthorized construction without prior permission of the competent authority. As per GLR the offender is not recorded HOR of the property in question.

In view of the above it is recommended that the notice u/s 248 of CA 2006 be issued to the owner/occupier requiring him to demolish and remove the unauthorized constructions within 30 days from the receipt of the notice.

No.213 Westend Road , Meerut Cantt.The site is situated outside civil area under the management of DEO Meerut Circle, Meerut. The land is classified as B-3 comprising Survey No.342 .

The land is classified as B-3 comprising Survey No.441 part .

A show cause notice as well as notice to stop the unauthorized constructions bearing No. MCB/BLDG/ENGG/240/921 dated 31-05-2016 & No.MCB/BLDG/ENGG/ 240/922 dated 31-05-2016 were issued and served to the offender on 18-06-2016 directing him to stop construction forthwith. The offender submitted wrong reply against show cause notice and notice to stop dated 14-07-2016 which was based on wrong facts.

The offender has raised new unauthorized construction without prior permission of the competent authority. As per GLR the offender is not recorded HOR of the property in question.

In view of the above it is recommended that the notice u/s 248 of CA 2006 be issued to the owner/occupier requiring him to demolish and remove the unauthorized constructions within 30 days from the receipt of the notice.

Singhal R/o Part of Bungalow No.70 Boundary Road, Meerut Cantt The site is situated outside civil area under the management of DEO Meerut Circle, Meerut. The land is classified as B-3 comprising Survey No.298 .

A show cause notice as well as notice to stop the unauthorized constructions bearing No. MCB/BLDG/ENGG/70/927 dated 31-05-2016 & No.MCB/BLDG/ENGG/ 240/928 dated 31-05-2016 were issued and served to the

offender on 20-06-2016 directing him to stop construction forthwith. The offender submitted wrong reply against notices dated 04-07-2016 which was based on wrong facts.

The offender has raised new unauthorized construction without prior permission of the competent authority. As per GLR the offender is not recorded HOR of the property in question.

In view of the above it is recommended that the notice u/s 248 of CA 2006 be issued to the owner/occupier requiring him to demolish and remove the unauthorized constructions within 30 days from the receipt of the notice.

The technical staff of this office vide report dated 27.01.2016 have reported that the said new unauthorized construction has been carried out by Shri Chiranjeet Chaudhary S/o Shri Bhim Sain Chaudhary R/o House No.125 Kerai Ganj,

BC Bazar, Meerut Cantt. The site is situated inside civil area under the management of Cantt Board, Meerut Cantt. The land is classified as B-3 comprising Survey No.183/515 .

A show cause notice as well as notice to stop the unauthorized constructions bearing No. MCB/BLDG/ENGG/125/929 dated 31-05-2016 & No.MCB/BLDG/ENGG/ 125/930 dated 31-05-2016 were issued and served to the offender on 20-06-2016 directing him to stop construction forthwith. The offender submitted wrong reply against show cause notice dated 24-06-2016 and against stop notice dated 24-06-2016 which was based on wrong facts.

The offender has raised new unauthorized construction without prior permission of the competent authority. As per GLR the offender is not recorded HOR of the property in question.

In view of the above it is recommended that the notice u/s 248 of CA 2006 be issued to the owner/occupier requiring him to demolish and remove the unauthorized constructions within 30 days from the receipt of the notice.

335.UNUATHORIZED CONSTRUCTION IN CANTONMENT AREA DURING STRIKE PERIOD

Board is informed that after demolition of unauthorized construction of Mall of B. No. 210-B Westend Road, Meerut Cantt and due to registration of FIR against staff of Cantt Board large scale unauthorized construction have taken place in differend parts of Cantt area regarding which a public notice was issued in "Dainik Hindustan" and "Amar Ujala" dated 01.08.2016 about 114 properties. Necessary FIR was also sent against the offenders to the Police Station Sadar/Lalkurti/SSP, Meerut. Now the technical staff is inspecting each property for measurements etc for taking legal action under the provision of CA, 2006/PPE Act, 1971.

The Board is informed that the matter was placed before the board and the Board in its meeting held on 27-01-2016 considered and resolved that on the request of the wife of appellant and grounds cited in request the case is adjourned. One more opportunity is given to Mr. Nazim Hassan and he be asked to appear before Board in next meeting.The decision of the Board has already been communicated to the petitioner vide this office letter No.MCB/BLDG/ENGG/92-95/2019 dated 26-11-2015. Online E-tenders were invited through e-procurement portal by e-publishing as well as press advertisement in national/local newspapers for annual white washing/colour washing/painting of CF assets to be carried out in year 2016-17, based on two bid system on two occasions, since no bids were received through portal (on 15.06.2016 & 16.07.2016), tenders are re-invited third time on 08.09.2016.

2. In the 3rd tender proceeding, 01 tenderer i.e. M/s Vision Constructions, 59/B, Madhuban Colony, Baghpat Road Meerut has participated and it’s financial bid has been opened on 14.09.2016, the tender was floated for an estimated work of Rs.

20 Lakhs during 2016-17 under (D2-a) budget head. The firm has quoted rates at par with MES SSR 2010.

Considered & resolved that the estimates mentioned on the agenda side for maintenance works to be undertaken under Budget Head D-2 during the year 2016-17 are approved subject to modification in respect of Sr. No. 2 regarding improvement/repair of streets and lanes/roadside berms by providing Rs. 80,00,000/- (Rs. 10 lacs in each ward from ward No. 1 to 8). CEO also informed that certain works eg. for improvements in Gandhi Bagh, Children Park and traffic lanes/roundals shall be undertaken departmentally within estimates. Board authorized CEO for these works as per his decision and incur expenditure accordingly.

341. REPLACEMENT OF SVLs/MHLs LUMINARIES BY LED LUMINARIES AND MAINTENANCE UNDER STREET LIGHTING SCHEME OF CANTONMENT BOARD IN MEERUT CANTONMENT UNDER SMART CANTONMENT MISSION

To consider the tenders for replacement/maintenance of energy saving & environment friendly led light fitting in lieu of SVLs street lights in cantt area in the year 2016-17 (including maintenance for 05 years).

Board is intimated that;

1. Conversion of existing street light points (SVLs /MVLs) with more energy efficient LED fittings is part of Smart Cantt Mission of Meerut Cantt. Dte DG DE, MoD and Dte PD DE, CC has emphasized and highlighted the conversion of street lights into

energy efficient lights as a major step in the instructions issued in the matter in order to reduce the electricity bills on this account.

2. Online E-tenders were invited through e-procurement portal by e-publishing as well as press advertisement in national/local newspapers for replacement/maintenance of energy saving & environment friendly LED light fittings in lieu of existing SVLs street lights in cantt area based on two bid system, (technical bid and financial bid) including maintenance & complete replacement onsite warranty for 05 years on 16.06.2016. Tenders were invited from applicant/firm / Contractors/firms who are manufacturer / authorized dealers of LED Street Light of approved makes & eligible contractor having valid registration in appropriate class & category in CPWD/MES / Deptt. of Telecommunications / Railways in the relevant category for makes Phillips, Bajaj & Havells for an estimated cost of Rs. 2.4 Crores. 04 bids were received out of which 03 tenderers were not found eligible for opening of financial bids. Requests from other local makes/ manufacturers were also received for the same. In review meeting taken by DG DE in presence of AS(J), MoD nad JS(C&W), Mod on the progress of Smart Cantt initiatives taken by Cantonment Board on 15.06.2016 and decisions & instructions communicated vide Dte DG DE, MoD letter No 76/67/Smart Cantt/C/DE/2015/ Vol. II dated 28.6.2016 emphasizing the projects with medium term maturity and long term beneficial impact and pointing out that LED streetlights be undertaken with specific realistic target dates alongwith roof top SPV’s, RWH, Senior citizen pathways & plantation.

3. Accordingly, tenders were re-invited on 08.09.2016. 02 tenders were received out of which one tenderer i.e. M/s Utkarsh Enterprises was found eligible for opening of financial bids in the light of eligibility criteria mentioned in the tender document. Financial bid were opened on 16.09.2016. The rates quoted by M/s Utkarsh Enterprises as Joint Venture with the Manufacturer Havells India Ltd are as below: .

Necessary agreement be got executed before commencement of the work on ground by the agency. Necessary reappropriation/ additional provision, as the case may be, over the budgeted amount be made by CEO whenever required.

342. CONVERSION OF RACE ROAD FROM CLASS ‘C’ TO ‘A-1’ DEF LAND FROM NALA CULVERT TO RAILWAY CROSSING RAMRAL VATICA MEERUT CANTT

To consider recommendation of Station Commander, HQ Pashchim UP Sub Area dated 13.06.2015 and officiating GoC, Uttar Bharat area dated 26.11.2015 for conversion of 30600 sqm or 7.5614 acres of class ‘c’ land of Race road from Abu nala (Sarwatra chawk) culvert to Railway crossing (Ramtal Vatica) in Sy No. 460 (Part) to A-1 Defence land and merge into Sy No. 459 which is existing MES road on A-1 Defence land in Meerut Cantt, as per GLR records of DEO Meerut.

The Board is intimated that the “Augharnath Temple” which is famous sacred site of Meerut is situated at Race road having only entry on the same stretch proposed to be converted from Class ‘C’ to ‘A-1’ in the proposal. The famous ‘Kawar Mela’ is also held in and around the temple every year on the occasion of ‘Mahashivratri Festival’ since long during which lakhs of pilgrims visit the said temple. The subject road is widely used by large number of civil devotees for visiting temple to worship Lord Shiva during Mahashivratri and other festivals throughout the year. Further, the justification given in the statement of case is that the said Cantonment roads being used by civil population is considered as security hazard for units & army establishments located nearby.

The Dte DE vide letter no. 57165/LC-2 dated 04.03.2016 & dated 28.06.2016 has forwarded the above mentioned letters alongwith statement of case and desired to furnish comments and recommendations of the Board for further necessary action in the matter, which has been replied accordingly. Recommendations and comments of the Board are to be forwarded.

Numbers of time in the year the pipeline leakage at different points from Shantikanti Namkeen wala to Parshuram lohe wala, Sadar due to heavy traffic and AC pipeline it needs to replace the same by CI/DI pipe. The current rates/ tender of pipe line is not available, the necessary estimate is prepared based on available rate of 2014-2015.

Board is informed that online tenders were invited through vide publication published in Dainik Hindustan and Dainik Prabhat dt.17.6.16.

Total one tender has been received on 12.07.16 the rates received of different items have been compared with rates received during the last financial year. There is average 10to 12% increase in the rates of all items. The rates highlighted in orange color are reasonable . The tenderer has also quoted that vat @5% will be charged over and above billed amounts. VAT @ 14% will be charged File cover and printer Cartridge.

Considered and resolved that lowest rates received for supply of different stationary items mentioned on the agenda side for the year 2016-17 received through E-tender alongwith VAT @ 5% over and above the billed amounts and also VAT @ 14% for file cover & printer catridge over and above the billed amount are approved for the tenderer M/s Sanjeev Offset Printers. CEO is authorized to incur expenditure.

345. TENDER FOR SUPPLY OF PRINTING ITEMS FOR THE 2016-2017.

To consider tenders for supply of Printing for the year 2016-2017.

Board is informed that online tenders were invited through vide publication published in Dainik Hindustan and Dainik Prabhat dt.17.6.16.

Total Two tenders have been received on 12.07.16 the rates received of different items have been compared with rates received during the last financial year. There is average 09to 12% increase in the rates of all items. The rates highlighted in orange color are reasonable. The tenderer has also quoted that vat @5% will be charged over and above billed amounts. VAT @ 14% will be charged File cover and printer Cartridge.

The Comparative statement along with relevant document is put up on table.

Board is requested to consider and take a suitable decision in the matter.
