Before taking up agenda, Elected Members gave a letter to President, Cantt Board seeking whether the meeting was ordinary or special. The President, Cantt Board informed that a special meeting was fixed by him on 27.05.2016 and agenda was also circulated by office of CEO to all. The meeting could not be held for want of quorum on 27.05.2016 and was adjourned for 10th June 2016. The meeting being held on 10th June 2016 is thus the special meeting adjourned on 27.05.2016 with the consent of members.

The Board proceeds further to take up the agenda.

212. Resolution

The Vice-President & Elected Members gave a note to the PCB.

CEO informed the Board that as per Business Regulation, a motion or resolution may be moved by a member intimating the fact of this in writing attaching copy of proposed motion or resolution to the CEO and sending 5 clear days in advance before date of meeting. Since this is an adjourned meeting, the note of the Elected Members cannot be taken & incorporated in the proceedings, firstly on the ground of meeting being adjourned and secondly the requirement of not sending before 5 clear days has not been met with.

After discussion and on demand of Elected Members of the Board, resolved to refer the matter to the Finance Committee. The elected members demanded that all pending payments of contractors for the year 2015-16 be stopped and no payment for the year 2016-17 be made till the next Finance Committee meeting. CEO stated that the contractual payments cannot be stopped, as per terms of contract, if contractual obligations have been fulfilled by the concerned party. But he would not make any payment to any contractor till next Finance committee meeting despite this position. However, payments to contractual staff and other essential payment not pertaining to contractors shall be made by him as functioning of office cannot be brought to stand still. The payments be made after the meeting of Finance Committee.

Board resolved accordingly.

213. Resolution

The Vice-President & Elected Members gave a letter to the PCB.

Resolved to refer the matter to the Finance Committee. Col AK Vaid, Nominated Member said that Cash Book was asked to be shown by Finance Committee during last Finance Committee meeting but was not made available. CEO informed that there was no related agenda in last Finance Committee meeting pertaining to Cash Book. He informed that all papers connected to agenda only are shown as per Business Regulations and members of committees should not seek unconnected documents which are not permissible under Business Regulations.

214. APPROVAL OF ANNUAL CONSOLIDATED ACCOUNTS FOR THE YEAR 2015-16.

To consider and approve the Annual Consolidated Accounts for the year 2015-16 of Cantt Board Meerut.

OFFICE REPORT :1. The Board is informed that the Annual Consolidated Accounts have been prepared showing the receipts and expenditures made during 2015-16, classified under several major and minor heads contained in the budget estimates under Rule 40 of Cantt Account Code 1924 and compared with the Budgetary provisions for the year 2015-16 and balance shown in the Bank Pass Books as on 31.03.2016 and are correct.

2. The Annual consolidated Accounts of the Cantt Board are to be forwarded to the Directorate of DE HQ CC duly approved by the Board under Rule 41 of the Cantt Account Code 1924. However, a copy of the same has been forwarded to the DG DE &

214. Resolution

The Vice-President & Elected Members gave a note to the PCB.

Resolved to refer the matter to Finance Committee. CEO informed that Annual Consolidated Accounts have been duly audited by audit authorities and already submitted to higher authorities as per requirement. Col. A.K. Vaid stated that Monthly Accounts for March 2016 have not been presented. CEO stated they will be shown to Finance Committee.

215. GRANT OF EX-GRATIA/ADDL PENSION TO 03 PENSIONERS OF CANTT BOARD MEERUT ON ATTAINING AGE OF 85 YEARS.

To consider applications received from Shri Pritam Singh Ex- Sanitary Supervisor dt 07.09.2015, Shri Mam Raj- Jumman Ex- S/W dt 26.10.2015 & Shri Aswani Kumar Mittal Ex- OS dt 11.01.2016 for grant of additional pension by increasing its by 30% after attaining age of 85 Years.

OFFICE REPORT

1. Board is informed that pension/ family pension in r/o of retired employees of the Cantt Board Meerut is being given as per CCS ( Pension) Rules 1972.

2. As per the provision / directions issued by the Govt of India, Ministry of Personnel & Public Grievances, Deptt of Pension & Pensioners Welfare vide letter No. F No.38/37/08-P & PW (A) dt 03.10.2008 has implemented ex-gratia pension/additional pension to old pensioners/family pensioners w.e.f. 01.01.2006 at the following rates of basic pension :

4. It is also reported that the Basic Pension of the above named pensioners has already been sanctioned by the GOC-in-C, CC & based on which they are receiving pension since their date of superannuation.

Board may consider & approve grant of additional pension @ 30% of basic pension as per Govt order to the above-named pensioners with effect from date of attaining age of 85 years as mentioned in the above table.

215. Resolution

Considered & resolved that additional pension at the rate mentioned against the name of each pensioner on the agenda side is approved w.e.f. the date of attaining the age of 85 years.

216. REVISION OF GRADE PAY & CHANGE OF DESIGNATION FROM JUNIOR GRADE CLERK TO JUNIOR ASSISTANT IN CANTT BOARD MEERUT.

To consider application dated 27.02.2016 of Km. Heena Pal, JGC Cantt Board Meerut Cantt requested therein for change of designation from Junior Grade Clerk to Junior Assistant and also revision of grade pay of Rs. 1900/- to Rs. 2000/- in the same Pay Band of Rs. 5200-20200 in term of UP Govt. GO. No. Va-2-401/Das-54(M) 2008 TC dated 18-03-2011 & UP Govt. GO. No. Va-2-44/Das-54(M) 2008 TC dated 22.12.2011, 20.01.2014 & 17.01.2014 regarding change in designation & revision of Grade Pay.

OFFICE REPORT1. Board is informed that Km. Heena Pal was appointed as Junior Grade Clerk on

26.02.2009 in the pay scale of Rs. 3050-75-4590 (pre revised) which was subsequently revised as per 6th pay commission report to Pay Band of Rs. 5200-20200+Grade Pay of Rs. 1900. She possesses educational qualification as BCA, M.A (English) Hindi & English Typing + Technical qualification in Certificate in CCC. She also possesses Registration Course on Computer Concept Certificate issued by DOEACC in NIELIT University.

2. The UP Govt. GO. No. Va-2-401/Das-54(M) 2008 TC dated 18-03-2011 & UP Govt. GO. No. Va-2-44/Das-54(M) 2008 TC dated 22.12.2011, 20.01.2014 & 17.01.2014 has changed the designation of Junior Grade Clerk to Junior Assistant & revised the Grade Pay for the Post of Junior Assistant from Rs. 1900 to Rs 2000.

3. It is reported that as per Establishment Folder of Cantt Board Meerut, the post of Junior Grade Clerk is equated with the post of Routine Clerk in District Office which has been changed to Junior Assistant with qualification Inter+ Course on Computer Concept (CCC) Certificate issued by DOEACC .

4. As per Memorandum of Settlement Cantt Board employee is entitled for Pay and allowances at per with State Govt. Employees. The sanctioning authority for grant of sanction of revision of Pay in the GOC- IN- CC under rule 47 read with 19(b) of Cantt Account Code 1924.

5. Since the applicant fulfill the condition of UP Govt. GO. No. Va-2-401/Das-54(M) 2008 TC dated 18-03-2011 & UP Govt. GO. No. Va-2-44/Das-54(M) 2008 TC dated 22.12.2011, 20.01.2014 & 17.01.2014 , it is recommended that proposal seeking under rule 45-47 read with rule 19-b of Cantt Account Code 1924 for grant of revised Grade Pay from Rs. 1900 to Rs. 2000 w.e.f 26.02.2009 and also change of designation from Junior Grade Clerk to Junior Assistant to Km. Heena Pal be forwarded to the GOC-in-C, HQ CC Lucknow in term of UP Govt. GOs referred above.

6. It is further recommended that for future appointment of Junior Grade Clerk/Junior Assistant in Cantt Board, Meerut the CCC Certificate issued by DOEACC Society be also add as essential qualification as per UP Govt GO. No. Va-2-44/Das-54(M) 2008 TC dated 17.01.2014 and Pay Scale for the post be revised as Rs. 5200-20200 + Grade Pay 2000/-.

Relevant file alongwith UP Govt GOs is placed on the table.

Board may consider and take suitable decision in the matter.

216. Resolution

The elected member Shri Vipin Sodhi, questioned referring of issue to Board and demanded that all such cases be put up after listing. CEO informed the Board that the official/employee had acquired qualification and had requested for change of designation & Grade Pay in terms of G.O and proposal be considered as per detailed office report. There cannot be listing of all cases as cases are referred when situations arise and officials submit applications. However, on the insistence of Shri Vipin Sodhi that he did not agree, the Board deferred the issue for next meeting.

217. CLINICAL RESEARCH UNIT FOR RESEARCH IN UNANI MEDICINES (AAYUSH) AN ORGANISATION UNDER THE MINISTRY OF HEALTH & FAMILY WELFARE, GOVT. OF INDIA.

To consider request dated 25.01.2016 received from research Officer in Charge, Clinical Research Unit in the campus of Cantt General Hospital, Meerut Cantt for renewal of MoU dated 19.03.2013.

Board is informed that accommodation was provided under the authority of the Board vide CBR No. 319 dated 30.11.2012 and subsequent MoU approved by it vide CBR No. 365 dated 25.02.2013 to the Clinical Research Unit for research in Unani medicines (AAYUSH), an organisation under the Ministry of Health & Family Welfare, Govt. of India on the request made by the Director General, Central Counsel for Research in Unani Medicines, Ministry of Health & Family Welfare, New Delhi for running their Unani unit in the campus of Cantonment General Hospital at a nominal

fee and distribution of free medicines to the patients provided by the Govt. of India, Ministry of Health & Family Welfare.

As per clause 11 of the agreement dated 19.03.2013 the agreement is valid for a period of 03 years from the date of execution. However, the agreement may be renewed for a further period on mutual agreement of both the parties. The agreement in question has expired on 18.03.2016.

Board is further informed that the unit is running satisfactorily and patients’ visits in the unit is highest as compared to other departments of the hospital. The MOI/c Cantt General Hospital has recommended for renewal of agreement vide his recommendation dated 08 Feb 2016.

217. Resolution

Considered & resolved that the agreement dated 19.03.2013 be renewed for a further period of 3 years w.e.f. 19.03.2016 on the same terms and conditions. Necessary agreement of renewal be got executed by the CEO.

218. DISCONTINUATION OF INTERVIEW FOR JUNIOR LEVEL GROUP “C”/ NON-TECHNICAL & GROUP “B” NON-GAZETTED/ISOLATED POSTS.

To note the instructions issued by the Govt. of India vide circular No. 39020/01/2013-Estt. (B)-Part dated 29.12.2015 forwarded by the DG DE Govt. of India, Delhi Cantt vide letter No. 102/7/DG DE/ADM/15 dated 14.01.2016 regarding discontinuation of interview for junior level Group “C”/Non-Technical & Group “B” Non-Gazetted/Isolated Posts.

Board is informed that the Govt. of India vide circular mentioned above has decided that for recruitment to junior level group “C’/Non-Technical & group “B” Non Gazetted/Isolated posts there will be no interview w.e.f. 01st Jan 2016 and this decision will be implemented for all such posts in Govt. of India Ministries/Departments/Attached Office/Sub-Ordinate Office/Autonomous Bodies/ Public Sector undertaking. However, skill test or physical test different from interview may continue for recruitment.

The circular received from the Govt. and DGDE letter referred to above are put up on the table.

Board may note & take decision in the matter.

218. Resolution

Noted the Govt/DG DE orders and resolved that except technical posts like RMO etc interview be discontinued for junior level Group ‘C’/Non-Technical and Group ‘B’ Non Gazetted/isolated posts. However, skill test different from interview may continue for recruitment, as per orders.

219. RECOGNITION OF UNION – AKHIL BHARTIYA SAFAI MAZDOOR CONGRESS.

To consider application dated 02.02.2016 of ABSMC, Branch Meerut Cantt Board requesting therein for recognition of union.

Board is informed that Shri Pujesh Lohre Newly Elected President, Akhil Bhartiya Safai Mazdoor Congress has submitted application dated 02.02.2016 alongwith following documents:-

1. Constitution of Akhil Bhartiya Safai Mazdoor Congress2. List of Members of the Union3. Letters of consent of the Members of the union for deduction of contribution

from the salary at source. 4. Affiliation certificate of All India Cantt Board Employees Federation. 5. Election Certificate issued by the Election Officer who conducted the election.

As per the Rules of Recognition of Trade Unions circulated by the DG DE vide letter No. 25/37/JCM/C/DE/2011 dated 26 August 2013, the above union fulfills the condition of recognition.

Board may consider & take suitable decision in the matter.

219. Resolution

The CEO explained the Govt orders and position on the issue and informed that recognition issue needs to be considered as the recognized unions only can represent issues before management and participate in JCM. The applicant union fulfils the laid down criteria for recognition. However, on the insistence of Shri Vipin Sodhi, Elected Member, resolved to defer for next meeting. Shri Vipin Sodhi, Elected Member also demanded to refer the matter to committee. CEO however, stated that the issue needs consideration by Board only which is the Competent Authority in the matter.

220. RECOGNITION OF UNION – CHAWNI PARISHAD KARAMCHARI UNION.

To consider application dated 9.11.2015 of Chawni Parishad Kamamchari Unions, Brancd Meerut Cantt Board Brequesting therein for recognition of union.

Board is informed that Shri Yogesh Yadav, Newly Elected President, Chawni Parished Karamchari Union has submitted application dated 9.11.2015 alongwith following documents:-

220. Resolution

The CEO explained the Govt orders and position on the issue and informed that recognition issue needs to be considered as the recognized unions only can represent issues before management and participate in JCM. The applicant union fulfils the laid down criteria for recognition. However, on the insistence of Shri Vipin Sodhi, Elected Member, resolved to defer for next meeting. Shri Vipin Sodhi, Elected Member also demanded to refer the matter to committee. CEO however, stated that the issue needs consideration by Board only which is the Competent Authority in the matter.

At this stage Shri Rajendra Aggarwal, Hon’ble MP addressed the Board and thereafter left the meeting due to his other engagements.

221. JUDGEMENT : B.NO. 167, CHAPPEL STREET, MEERUT CANTT : LPA NO. 1051 OF 2011 UNION OF INDIA & OTHERS VS. RAJESH AGGARWAL.

To note the Judgement dated 18.02.2016 passed by the Hon’ble High Court, Delhi in the subject LPA. The Hon’ble Court vide order dated 18.02.2016 has dismissed the appeal of Union of India & upheld the order dated 26.07.2011 passed by the Learned Single Judge in WP No.1808/2011.

The matter pertains to sanctioning of building plan of Bungalow No. 167, Chappel Street, Meerut Cantt in year 2008 and the same was rejected by the Govt of India, Ministry of Defence under section 57 of CA, 2006. Against the said decision, Shri Rajesh Aggarwal had filed writ petition and after 3rd round of litigation, the Hon’ble Single Judge of Hon’ble High Court, Delhi allowed the writ petition vide order dated 26.07.2011. Aggrieved with the said decision, the Union of India had filed the subject LPA before the Hon’ble High Court, Delhi.

On behalf of the Cantonment Board, matter was argued by Shri Sanjay Jain, ASG and Smt Rekha Pandey, Advocate of Cantonment Board Meerut. Smt Rekha Pandey vide her opinion dated 05.03.2016 has opined that appellant i.e. Union of India etc should challenge the judgement dated 18.02.2016 before the Hon’ble Supreme Court as there are grounds for challenging of the judgement.

This office has informed the whole position to the higher authorities vide letter dated 09.03.2016 & requested to issue suitable instructions/directions in the matter. Meanwhile, the CB Counsel Smt. Rekha Pandey has forwarded a draft SLP for filling in the Hon’ble Supreme Court which is kept pending for orders of higher authorities as per discussions held at DGDE by CEO.

Board is informed that each applications have been scrutinized by the Sanitary Supdt & Asstt Health Officer has also inspected the site and recommended for grant of licence in respect of applications mentioned in the attached list from Sr. No. 01 to 127 for the year 2014-15 and 1-26 for the year 2015-16 respectively.

Considered & resolved that licence be granted to the applicants Sr. No. 1 to 26 for the year 2015-16. Further resolved that no licence be granted in leasehold/old grant residential bungalows under the management of DEO, Meerut Circle except those properties, which are recorded as commercial in land records. CEO explained that Board’s interests are protected by affixing a seal on Trade Licence as per CBR 185 dated 08.08.2012. 223. REVISION OF RATES / FEES FOR ALLOWING TEMPORARY OCCUPATION OF VACANT LANDS UNDER MANAGEMENT OF CANTT BOARD.

Board is informed that the Board vide CBR No. 392 dated 11.03.2013 fixed Rs. 150/- for fixing of per Shamiyana (measuring 15’x15’), conservancy charges fixed Rs. 200/- and Site plan Rs. 50/- has fixed for per function.

Board is informed that the general public of Cantt area is using lands to organize their functions i.e. marriage party, other religious function and other party functions on the vacant lands under the management of the Cantonment Board. They install Shamiyanas and pay charges as fixed by the Board which are very normal charges. Board is informed that Smt Rajesh Devi the parking contractor at B. No.173 has submitted an application dated 01.02.2016 that she has stated that large number of vehicles are parked unauthorizedly infront of Flavor Restaurant (Nala side) instead of authorized parking stand at B. no. 173. Therefore, she is suffering big loss due to unauthorized parking and requested to allow to collect parking charges from infront of Flavor Restaurant (Nala side).

Board is informed that the auction for transfer of collection rights of parking charges from parking place at B. No. 173, Abu Lane, Meerut was conducted on 03.11.2015 for period of one year. The highest bid of Rs. 401000/- per annum offered by Smt Rajesh Devi w/o Hardan Singh for period of one years w.e.f. 07.11.2015 to 06.11.2016 which was approved by the board vide CBR No. 91 dated 05.11.2015. As per terms and condition of auction the highest bidder has deposited Rs. 100250/- as Ist installament, Rs. 1,00,000/- as security money in shape of FDR and Rs. 2005/- as TCS in Cantt Board, Meerut.

Board is informed that the office vide letter No. 108/R/Parking/312 dated 15.02.02016 has informed to contractor for depositing of IInd instalment but she has not deposited IInd instalment till date which was due on 07.02.2016.

Board is informed that as per clause 5 of terms and conditions of auction that if highest bidder fail to deposit any instalment and delay payment of instalment for 30 days from the due date, the contract will treated to be cancelled and security money will also be forfeited. The all dues will be recovered under the provision of section 324 of CA 2006 through the Court of CJM, Meerut.

The matter for concession for use of Manglam Marriage Place for Cantt Board Staff was placed before the Board in its meeting held on 27.01.2016. The Board vide CBR No. 105 dated 27.1.2016 has deferred the matter and given concession only to Shri Rakesh Kumar, Sanitary Supervisor as special case & a staff welfare measure @ Rs. 5,000/- per day on a/c of use of Manglam and Rs. 5,000/- as security (refundable).

Board is informed that as per letter of DM, DIOS and Memorandum of UP Govt has directed to all educational institution that college building and campus play ground cannot be allowed for any type of fair, marriage function and any commercial activities in the education institution affiliated with UP education Board and the if found strict action will be initiated against the institution by the Govt.

Board is informed that the Bhainsali Ground is situated opposite the CAB Inter College and is a separate ground from CAB Inter College which is maintained by the Cantt Board,Meerut. Since long said ground is being used for organizing Ram Leela,religious purpose,marriage functions, fairs, exhibitions, rallies, politicalactivities and games etc. subject to permission of Cantt Board.The said ground is a source of income of Cantt board and no interruptuions in the education of CAB Inter College is caused by organising events at such ground.

To consider renewal of agreement between ‘Kalyanam Karoti’ NGO and Cantt Board regarding running of ‘Eye Wing’ in Cantt General Hospital.

Board is informed that in the premises of Cantt General Hospital Cantt Board is running an eye wing in association with an NGO called ‘Kalyanam Karoti’. The arrangement is running smoothly since 1994 and the permission is granted by the Board on yearly basis, Proper agreement is also got executed every year on non judicial stamp paper of appropriate value.

The Board vide CBR No. 7 dated 26.02.2015 had granted approval for permission to run the eye wing w.e.f. 01.01.2015 to 31.12.2015. Necessary agreement was executed on 16.06.2015 for the period 01.01.2015 to 31.12.2015.

Board is further informed that the General Secretary of Kalyanam Karoti Brig (Retd) SC Johar, AVSM vide letter dated 07.12.2015 has requested for renewal/extension of permission for another year with further request for modification in existing agreement under para ©(i) regarding deletion of condition to shift administrative functions of ‘Kalyanam Karoti’ from Cantt General Hospital, para (C) (vi) regarding changes in the internal setup of the ‘Kalyanam Karoti’. He has also submitted a draft agreement.

All aspects should therefore be considered while considering and rejecting a bid to avoid loss of revenue to the Board.

On request of contractor, the Cantt Board towed the vehicles by crane, but matter could not be solved. The contractor has again submitted an application on 18.02.2016 and requested that as per clause 10 of agreement, he is unable to carry the contract after 90 days.

As per clause no. 10 of agreement, the Board shall be entitled to terminate this Contract at any time without assigning any reason after giving one week notice to the Contractor & the Contractor shall not be entitled to any claim, or any compensation whatsoever on account of such termination. By giving three months prior notice in writing, the Contractor may also terminate the Contract.

Board is informed that the Notice period of contractor has be completing on 18.05.2016. The contactor has deposited contractual amount up to 06.05.2016 in advance and he is liable to pay Rs. 16471/- as parking charges and Rs. 330/- as TCS total Rs. 16801/- for period of 07.05.2016 to 18.05.2016.

231. CONTEMPT APPEAL NO. 3/2014 ANAND PRAKASH AGARWAL VS. CEO MEERUT & OTHERS & OTHER 23 SPECIAL APPEALS FILED BY THE VARIOUS PERSONS OF B. NO. 210B, WESTEND ROAD, MEERUT CANTT.

To consider the Judgements and orders both dated 01.03.2016 passed by the Hon’ble High Court in the subject two Court cases which are placed before the Board.

Facts of the case

1. B. No. 210B West End Road Meerut Cantt comprising Sy No. 313 having an area of 9.060 acres, recorded in the name of Smt. Pushpa Devi w/o Shri Sumat Prashad (1/2 share) and Chander Prakash & Vijay Prakash minor sons of Shri Sumat Prashad (1/2 share) and the same is situated out side the notified Civil area under the management of DEO Meerut Circle, Meerut Cantt held on old grant terms.

2. In the year 1994 unauthorized construction on open land in subject Bungalow were started by Smt. Pushpa Devi and Anand Prakash Aggrawal and others(Power of attorney holders of Smt. Pushpa Devi and other HOR), against which necessary Notices under the provisions of Cantonment Act, 1924 were issued and served upon the offenders, requiring them to stop construction and demolish unauthorized constructions.

3. Cantonment Board, Meerut issued general public notice in news papers on 21.06.1994 that landlord of land of Bungalow No. 210B is Govt. of India and the same is on old grant terms and construction/sale purchase in the bungalow will be illegal. It was intimated for and on behalf of Govt. of India that necessary legal action was being taken for demolition of unauthorized construction etc.

4. Against the said publication Smt. Pushpa Devi and others filed a Civil Suit bearing No. 581 of 1994 titled as Smt. Pushpa Devi and others v/s Cantonment Board, Meerut and another before the Civil Judge, Meerut with the prayer that by a decree of Court, perpetual injunction be granted in favour of the plaintiff against the defendants, their servants and employees etc be restrained from demolishing the plaintiff’s bungalow bearing Ni. 210B, West End Road, Meerut Cantt. Court of IIIrd Addl. Civil Judge, Meerut vide order dated 06.04.1995 dismissed the 6C2 (Stay) application.

5. Against the above order dated 06.04.1995 passed by IIIrd Civil Judge Meerut Smt. Pushpa Devi and others approached Hon’ble High Court Allahabad by way of filing FAFO bearing No. 298 of 1995 titled as Smt. Pushpa Devi and others v/s Cantonment Board, Meerut and others. The Hon’ble High Court, Allahabad vide order dated 13.04.1995 passed in above FAFO directed to maintain status quo with regard to Bungalow No. 210B, Meerut Cantt, the appellants shall not raise any constructions nor respondents shall demolish any constructions.

6. The orders of the Hon’ble High Court were flouted by the petitioners and they carried out further unauthorized construction in the premises in question, consequently, the Cantonment Board Meerut filed and contempt Petition No. 380 of 2001 Cantonment Board Meerut v/s Smt. Pushpa Devi and others before the Hon’ble High Court Allahabad.

7. The Hon’ble High Court, Allahabad after hearing both the parties had passed final order dated 29.01.2014 directing that u/a constructions raised after 13.04.1995 be demolished and sentenced to six months simple imprisonment and fine of Rs. 2000/- only.

8. Aggrieved with the said order, Shri Anand Prakash Agarwal filed Contempt Appeal No. 3/2014 titled as Anand Prakash Agarwal Vs. CEO Meerut & Others before the Division Bench of Hon’ble High Court, Allahabad. The Division Bench of Hon’ble High Court, Allahabad vide order dated 01.03.2016 dismissed the said appeal holding the sentence given by Learned Single Bench. Against the said dismissal Shri Anand Prakash Agarwal filed SLP bearing No. 11789/2016 titled as Anand Prakash Agarwal Vs. CEO Meerut & Others before the Hon’ble Supreme Court. The Hon’ble Supreme Court vide order dated 26.04.2016 dismissed the said SLP at admission stage. Copy of letter of counsel of Cantonment Board alongwith order is placed on table. Certified copy of order is awaited.

9. It is further informed that against the order dated 29.01.2014 passed by the Hon’ble High Court as stated above, various occupiers had also filed review/recall applications before the Hon’ble High Court, Allahabad and the Hon’ble High Court, Allahabad vide order dated 13.10.2015 had rejected all the review/recall applications.

10. Against the said dismissal, 23 Special appeals were further filed before the Division Bench of Hon’ble High Court, Allahabad by the various persons/offenders of B. No. 210B, Westend Road, Meerut Cantt. All the said appeals have been dismissed by the Hon’ble High Court vide order dated 01.03.2016.

232. ISSUANCE OF NO OBJECTION CERTIFICATE FOR SALE/PURCHASE OF PROPERTY SITUATED IN THE CANTONMENT AREA.

Reference CBR No.155 dated 27.01.2016 and CAC Proceeding dated 25.01.2016.

Board is informed that the Hon’ble High Court, Allahabad vide order dated 28.08.2010 passed in WP No. 12897 of 2008 Cantonment Board Varansi Vs. State of UP & Others directed that the Sub-Registrar (Registration) not to register any document and not to execute any sale deed/lease deed of the land failing within the Cantonment Board and belonging to the Ministry of Defence without their no objection or permission by the Defence Estates Officer of the Cantonment Board Varansi. The said order was communicated to this office vide Dte DE letter No. 41190/Land Policy dated 04.11.2010.

This office vide DO letter dated 16.11.2010 requested the DM Meerut that suitable direction be issued to the concerned department that prior no objection of this office/Cantt Board, Meerut be obtained before registration of any sale/purchase documents of old grant/lease hold properties of Cantonment area. Newspaper publications were also published in the local newspapers in this regard on 17.11.2010.

Thereafter, the Hon’ble High Court vide order dated 22.12.2010 confirmed the order dated 28.08.2010 in PIL No. 74227 of 2010. This office again requested the DM vide DO letter dated 30.03.2011 to issue suitable directions to all concerned for compliance of the order of Hon’ble High Court, Allahabad.

The Dte DE vide letter No. 41190/Land Policy dated 31.08.2010 has issued following terms and conditions for sale permission/mutation etc.

(a) That the applicant agrees the permission to sell is only in respect of the authorized structure of the subject premises ;

(b) That the applicant acknowledges that the Government of India, Ministry of Defence is the owner of the land including trees and the site is held on old grant terms as specified in the relevant Governor General in Council order ;

(c) That the applicant admits Government’s right of resumption of the property in accordance with the OG terms ;

(d) That the sale deed does not mention about the title/absolute title/ownership rights of the bungalow as belonging to the parties/vendors ;

(e) That the property will not be sub-divided by way of transfer/allenation.

(f) That the occupancy rights will not be transferred without obtaining prior sanction of the competent authority.

(g) That in the event of resumption, no compensation whatsoever will be payable for the unauthorized structures. Even in respect of authorized structures, the Government will not be obliged to pay compensation on the basis of the sale price. The compensation will be determined by the competent authority on the basis of the

depreciated cost of the authorized structure on the effective date of the resumption in accordance with the instructions issued by the Government from time to time.

(h) That the property will not be used for purposes other than residential except with the prior sanction of the Govt.

(i) That the sale permission is without prejudice to the rights of the Government to take any action in future as may be deemed fit for the demolition of unauthorized constructions, if any, noticed in the bungalow.

(j) That the sale permission by itself does not condone any breach that may exist in relation to the premises with regard to old grant terms, or any other applicable law/rule in force.

(k) That the competent authority may on its own motion or on receipt of relevant information from any source and after giving reasonable opportunity to the recorded Holder of occupancy rights reverse the permission. If the authority is of the opinion that such reversal would be fair and just and may take further necessary action to mutate the occupancy rights in favour of the rightful person.

(l) That if at a later stage it is found that the permission has been obtained through fraud, misrepresentation or suppression of material facts, the competent authority will be at liberty to rescind the permission and take further necessary action as deemed fit after giving reasonable opportunity to the affected party to state his defence.

(m) That the permission is without prejudice to the rights and interest of the Government in the premises.

Board is informed that matter for NOC of sale/purchase of property was placed before the Board and the Board vide CBR No. 90 dated 02.05.2011 considered and resolved that in general NOC for sale/purchase will be given to those applicants whose names are recorded in GLR and there is no violation i.e. sub-divison of site, change of purpose, unauthorized construction and encroachment on Govt land.

Thereafter, the Dte DE vide letter dated 05.06.2014 was requested to issue suitable instructions/directions for taking further necessary action in the matter of permission/no objection certificate for sale/purchase of property situated inside the notified civil area under the management of Cantonment Board and mutation of the properties on the basis of sale deeds executed without prior permission of competent authority. The direction is still awaited.

The Board vide CBR No. 155 dated 27.01.2016 considered and resolved that the grant of NOC will be considered in accordance with law casewise keeping in view the status of sub-division, change of purpose, unauthorized construction to the HOR duly recorded in GLR maintained by the Cantonment Board in respect of properties in civil area.

Board is requested to consider and take a suitable decision in the matter.

Considered. CEO explained the policy and explained all Govt orders to the Board. Resolved that NOC be granted in civil area to those applicants who fulfil all the laid down and prescribed conditions by Govt. CEO also informed that directions were desired by office/Board in year 2010 from Dte DE on this issue. He stated that he would first seek directions as per pending communication. Board resolved that directions be obtained from the PD DE, Central Command before considering the request of applicants for grant of NOC in civil area & then further action be taken as per them.

233. SUBMISSION AND OBJECTIONS FILED BY CINEMA OWNERS AGAINST THE INCREASED SHOW TAX FROM RS. 20/- PER SHOW TO 100/- PER SHOW.

It is intimated that the Board vide CBR No. 41 dated 16.09.2015 has revised rates of show tax from Rs. 20/- per show to Rs 100/- per show. No cinema owner has been paying show tax since then i.e. 16.09.2015.

The cinema owners of Nishat, Golcha and Regal cinemas vide their joint letter dated 21.09.2015 received in this office on 19.01.2016 has filed joint submission/objection against the revised rates of show tax of Rs. 100/- per show describing therein their financial difficulties to pay the revised show tax.

Board is informed that Smt. Rini Jain, Elected Cantt Board Member has placed a motion before the Board in its meeting held on 27.1.2016 regarding vacation of illegal occupation of Dharamshala situated at R A Bazar Meerut Cantt . The Board vide CBR No. 122 dated 27.1.2016 resolved that a similar action of taking over a property by Cantt Board which is now running as community Hall at Survey No. 183/735(part) B-4 land, the Board has also resolved that on similar lines the building of Panchayati Dharamshala in R A Bazar be taken over by the Board forthwith being illegal occupation on Govt. B-4 land.

Board is informed that in compliance of above CBR, the Board has taken over the peaceful possession of Panchayati Dharamshala in presence of local residents of R A Bazar on 26.04.2016.

The same was not seen implemented till date. Seeing a mark of respect to the soul, it is further submitted that the park be named after her as above said and work be done at the earliest.

Considered. CEO informed that there is no policy or Govt order regarding naming of any place or object in the name of a Elected Member of Cantt Board. He stated that as per records a High Mast Light was installed with the efforts of late member (of previous Board). Resolved that for naming the street after name of a deceased member, Dte DE, Central Command be approached for instructions on the subject.

245. REPAIR OF REVENUE SECTION BUILDING BLOCK OF CANTT BOARD OFFICE BUILDING

It is informed that building block of revenue section has been damaged due to fall of tree on 23.05.2016, in which 05 persons including 02 office staff are injured. The building block is not in usable condition and requires immediate repair/restoration.

The tenders for maintenance works have been invited for the year 2016-17 and the technical bid are scheduled to be opened on 15.06.2016. The estimate for repair of the building block has been prepared on basis of MES SSR 2010 which comes to Rs.9,27,521/- after incorporating the contractors percentage approved by the Board for previous year 2015-16. The work may be got executed through T.C. Contractors.

245. Resolution

CEO informed the Board in detail about the mishap that occurred in office on 23.05.2016.

CEO informed that alternative arrangement for Revenue Branch has already been made in the other part of the building as such the damaged building does not require repairs and may be removed. He stated that vacant site may be developed being in front of office for looks. The Board authorised CEO to incur all expenditure for this purpose.

The Board expressed grief on the incident of death of the person during unfortunate happening and resolved that Ex-Gratia compensation of Rs. 1 lacs be paid out of Cantt Fund to the family of the deceased.

The members demanded a provision of a separate room for Vice-President. CEO informed that there is no provision for giving a separate room/chamber to Vice President/members. He also clarified that Vice President and Elected Members have no administrative authority under the Cantonments Act, 2006 or any other instructions and that they cannot summon any staff or office record in their capacity of Elected Member. Every member may only see prescribed records relating to agenda of Board/committee only during such Board/committee and not otherwise. The Board noted this.

246. COLLECTION RIGHTS OF TOLL TAX WITHIN MEERUT CANTONMENT AREA.

Reference CBR No. 204 dated 31.03.2016.

To consider report submitted by sub-committee which was constituted by the Board for consideration of existing terms & conditions of toll tax and issues raised by the contractors.

OFFICE REPORT

Board is informed that the matter for consideration of existing terms and conditions of toll tax contract and issues raised by the contractor was place before the Board in its meeting held on 31.03.2016. The Board vide CBR No. 204 dated 31.03.2016 has resolved that the committee of members entitled by CBR No. 104 dated 27.01.2016 will consider all aspects and letters/demands made by contractor and submit detail report to Board for consideration in next meeting.

The report submitted by sub-committee is as under :

1- The security deposit may be fixed as Rs. 50 lacs instead of 20% of annual bid amount.

2- The earnest money deposit may be fixed at Rs. 25 lacs instead of Rs. 20 lacs. The earnest money deposit may be adjusted in security.

3- No exemption/rebate be allowed either on account of Kanwar festival, or diversion of traffic under the orders of District Administration for any reason, as the bid is always presumed to have been given after assessment of tentative toll tax collection on all the collection points and also the event of Kanwar festival.

4- The execution of contract agreement is mandatory under the Stamp Act therefore there connot be any exemption in this regard. The contractor after acceptance of the bid will be liable to submit stamp papers of appropriate value as per the bid amount in terms of the Stamp Act/directions/instructions issued by the Central/State Govt from time to time regarding execution of agreement.

5- The committee also recommends that there must be a provision in the tender notice as well as contract agreement that after acceptance of bid and execution of agreement, the contractor my give 90 days prior notice in writing regarding termination of contract if he is not interested to carry on with the contract, but such a notice can be given only after expiry of 03 months from the commencement of contract. In that case, security money will be refundable subject to deduction of Rs. 10 lacs after the period of contract plus 45 days & acceptance of request of the contractor by the Board.

6- The committee has also recommended that in case of death of contractor any criminal activity committed by the contractor or insolvency of contractor declared by the competent authority or any other reason prejudicial to the interest of the Board, the contract will be terminated and security money will be refundable subject to deduction of Rs. 10 lacs after the period of contract plus 45 days & after acceptance of request of the contractor by the Board.

7- The committee also recommends that as per the gazettee notification regarding imposition of toll there is provision of toll tax collection within the limits of Meerut Cantonment. Therefore, feasibility increase toll collection points be also examined by the office for increasing the revenue of the Board.

Board is informed that the matter regarding auction of unserviceable stores on the charge of Cantt Board lying in Central Stores as well as Hospital/CAB Inter College/Primary Schools and other units was placed before the Board in its meeting held on 16.09.2015. The Board vide CBR No. 34 dated 16.9.2015 had constituted a committee of 02 elected members namely S’Shri Anil Jain & Neeraj Rathore to prepare MRP of the unserviceable stores. The committee had checked the unserviceable stores and calculated MRP of Rs. 2,28,000/- with the help of Store Keeper on 02.01.2016.

The auction of unserviceable stores was conducted on 30.01.2016 in the office of Cantonment Board Meerut after wide publicity in daily newspapers. The highest bid of Rs.3,00,000/- was offered by Shri Sanjeev Bhatia S/o Shri Charan Das. The auction proceedings were placed before the Board in its meeting held on 31.3.2016. The Board vide CBR No.203 dated 31.3.2016 resolved that CEO would work out MRP again as per items of scrap. The consideration of highest bid was pended till then.

A Committee of Sanitary Supdt. & Store Keeper of this office has again calculated MRP of unserviceable stores on the basis of present market price. The Committee has observed/rated that due to change in old/Scrap iron prices, the MRP of unserviceable stores is reduced from previous MRP. The MRP of Rs. 2,24,875/- has been worked out by the aforesaid Committee on 27.4.2016, which is less by Rs.3,125/- form previous MRP. The received highest bid of Rs. 3,00,000/- offered by Shri Sanjeev Bhatia is in excess of Rs. 72,000/- from previous MRP and Rs. 75,125/- from present MRP.

The matter was placed before the PCB vide ID No. 341 dated 4.5.2016. The PCB vide order dated 6.5.2016 directed, the PCB’s order with direction is also placed before the Board that the pended bid should be placed before the Board for approval in light of facts mentioned above.

248. PURCHASE OF TATA 8.5Cu. Mt. TIPPERS ON LPK 1613 FOR IMPROVING SANITARY SERVICES IN CIVIL AREA

Reference: CBR No. 78 dated 31.10.2015.

It is bought to the notice of the Board that the Board vide CBR under reference had resolved for purchase of 06 tipper dumpers, the budget provision was also made in revised budget estimates 2015-16. The purchase could not be made as sanction of revised estimates 2015-16 was received only on 19.02.2016 and there was no time left to process the purchase besides non availability of funds.

The purchase of 06 tipper dumpers is now being proposed in original budget estimates 2016-17 and budget provision shall be made appropriately in due course under head F4(b).

Keeping in view the dependence of Board on Grant-in-Aid. Only 06 tippers are being proposed, rest requirement of 05 tippers shall be carried forward to next financial year and provision shall be made in original budget estimates 2017-18.

The technical staff of this office vide report dated 30.12.2015 have reported that the said new unauthorized constructions has been carried out by Smt Sundari W/o Late Shri Jai Prakash in R/o H.No.102 Tandel Mohalla, BC Bazar, Meerut Cantt.The site is situated inside civil area under the management of Cantt Board, Meerut . The land is classified as B-3 comprising part of Survey No. 183/577.

A show cause notice as well as notice to stop the unauthorized constructions bearing No. MCB/BLDG/ENGG/102/675 dated 30-04-2016 & No.MCB/BLDG/ENGG/102/ 676 dated 30-04-2016 were issued and served to the offender on 04-05-2015 directing him to stop construction forthwith.The offender submitted reply on 17-05-2016 against show cause notice as well as notice to stop the unauthorized constructions both dated 30-04-2016 which was not based on facts.The contents of the said reply are wrong and incorrect facts.

The offender has raised new unauthorized construction without prior permission of the competent authority. As per GLR the offender is not recorded HOR of the property in question.

In view of the above it is recommended that the notice u/s 248 of CA 2006 be issued to the owner/occupier requiring him to demolish and remove the unauthorized constructions within 30 days from the receipt of the notice.

A show cause notice as well as notice to stop the unauthorized constructions bearing No. MCB/BLDG/ENGG/270/679 dated 30-04-2016 & No.MCB/BLDG/ENGG/270/ 680 dated 30-04-2016 were issued and served to the offender on 04-05-2016 directing him to stop construction forthwith.

The technical staff of this office vide report dated 25.12.2015 have reported that the said new unauthorized constructions has been carried out by Shri Surender Kumar Jain S/o Shri Madan Lal Jain in R/o House No.52 Jamun Mohalla Bazar, Meerut Cantt. The site is situated inside civil area under the management of Cantt Board, Meerut. The land is classified as B-3 comprising under Survey No.249/501 .

275. MOTION

The following members of the Cantt Board Meerut have observed that a resident of Pant Puri,Lalkurti,Meerut Cantt. NS Nagpal who claims to be a RTI activist has been making applications under RTI Act and seek information in respect of Board office and staff with only a view to harass,humiliate and pressurize them foe obtaining personal benefits.In RTI applications he uses defamatory language and even calls the duly constituted and notified Cantonment Board as illegal Board by making psedonomous complaints. He even sends SMS to officers on agenda points of Board Meeting before the meeting and misguides them on agenda points. His aim is to obstruct the functioning of Cantt Board and not allowing the duly constituted Board to take decision in public interest. More, So he uses highly objectionable defamatory and insulting language for the elected members/staff/officers of IDES services. He also obtains copies of documents and information from office illegally and without lawful process. It is also gathered from public that he approaches them for favour and pressurize them that he will get certain things done/not done by his RTI and SMS activities.

He tries to instigate Cantt Board staff/officers against the Cantt Board and make conspiracy against the Board.The matter of Shri Nagpal has also been considered in Board Meeting during the tenure of Shri KC Gupta & Dr. DN Yadav the then CEOs Cantt bOard Meerut but no action is initiated against him till date.

We request th Board to consider this very important issue and take up the matter with higher authorities intimating the facts about Shri NS Nagpal. The Board may also inform CIC/MoD/DGDE and other authorities similarly.The Board may also take appropriate legal action against such objectionable and illegal act of Shri NS Nagpal in public interest and to safe guard its reputation. The Board may also take strict action against the staff who passes on documents and information illegally and even remove them from Boards employment for doing such act against the interest of Board.

275. Resolution

The Vice President and all the Elected Members withdrew their motion. CEO informed the Board that there is no provision to withdraw or drop any motion in the Business Regulations which permit only giving of motion by Elected Members for consideration of Board. He also stated that Elected Members should state reasons for withdrawal of motion which they have not given. Board noted this. He advised members for not giving motions which they don’t intend to pursue as it results in wastage of precious time of office and Board. He stated that a fresh agenda on the issue shall be brought before Board in due course by office as the issues raised in the motion by Elected Members are also available in office records and staff have also complained against said person reporting illegal acts on his part. The Cantt Board has

also taken some resolutions earlier on this issue and for smooth functioning of office and curbing such illegal acts, Board needs to consider this issue wherever it is brought before it by office to next meeting.

276. GRANT OF NOC FOR LIQUOR LICENCE IN CANTT AREA FOR THE YEAR 2016-17.

To consider letters received from Station Head Quarters Cell Meerut Cantt Forwarding the request received from excise department for grant of NOC for issuing excise licence in Cantt area.

Board is inform that the department has sought NOC for grant of excise licence in the following premises under the provisions of section 277 of Cantonments Act 2006:-

276. Resolution

The Elected Member Shri Vipin Sodhi questioned the action of referring issue of trade licence to Board. The CEO explained the legal position and facts on the issue & strongly stated that trade activities are required to be regulated by Cantt Board as per section 277 of CA, 2006. This also fetches revenues to the Cantt Board. The PCB stated that he would cancel the NOCs given by Stn HQ Cell to Excise Deptt, if Board has any objection. Shri Vipin Sodhi, Elected Member changed his stand and recommended grant of trade licence as per office recommendation. CEO pointed out change in Shri Vipin Sodhi’s stand after PCB’s statement.

Considered & resolved that NOC for grant of Excise licence in the premises mentioned on the agenda side be issued to the concerned authority. CEO strongly recommended that licence fee at following rates be levied on applicants under the provisions of Sec. 277 of Cantonments Act, 2006 for different categories:-

1. English Liquor Shop - Rs 3 lacs per annum. 2. Country Liquor Shop - Rs 3 lacs per annum. 3. Model Shop - Rs 2 lacs per annum. 4. Bear Shop - Rs 2 lacs per annum. 5. Bar - Rs 3 lacs per annum.

The Board resolved to approve the above rates of licence fee.

In total bills for Rs. 13,86,000/- have been received from contractor. As per agreement dated 15.03.2015 the firm was bound to generate at least 15 tons manure per month but firm has generated total manure to the tune of 42.68 tons. There is no penalty clause in the contract agreement for not generating the quoted quantum of manure. In these circumstances it will be appropriate to release payment on the basis of actual generation of manure.

Horticulture wing lifted manure from the Trenching ground and weight was carried out at Dharam Kanta. Coupon indicated weight placed on the file. In total 42.68 ton manure was generated. On the basis of actual generation of manure it cost Rs. 3,75,584/- as final payment @ Rs. 8.80 per Kg.

Concerned file with all relevant papers is placed on the table.

Board may consider and take suitable decision.

Board is informed that the various issues of public importance like JNNURM, release of share of Revenue (i.e. Octoroi compensation, Education) has already been discussed and approved by the Board and the same were forwarded to the Principal Director DE Central Command for taking up them with the higher authorities of the State Govt.

ADDENDUM TO THE AGENDA OF BOARD MEETING SCHEDULED TO BE HELD ON 27.05.2016 AT 11:30 HRS 280. BUILDING NOTICE: COMPOSITION OF UNAUTHORIZED CONSTRUCTIONS IN RESPECT OF HOUSE NO. 263 KABARI BAZAR AND 122 RANGSAZ MOHALLA SADAR MEERUT CANTT.

Reference CBR No. 166 (107) dated 18.06.2012.

To consider building application 21.07.2012 along with composition plan by Col. S.K. Vaid and others in respect of subject property. The Board vide CBR NO. 166 (107) dated 18.06.2012 had resolved that HOR be directed to comply the bye-law No. 16. The Cantonment Board Meerut vide letter dated 13.07.2012 had accordingly requested the HOR to comply with the direction contained in CBR dated 18.06.2012.

The HOR vide application dated 21.07.2012 informed that they had complied with the direction and requested for composition of unauthorized construction. The area as per submitted composition plan is 6274.08 sqft (2091.36 sqft at GF, 2091.36 sqft at FF & 2091.36 sqft at SF).

The engineering staff vide report dated 15.01.2013 has reported that bye-laws No. 16 has been complied with. Therefore, the composition plan conforms to building byelaws of Meerut Cantt.

The Board is intimated that the site of H. No. 263 Kabari Bazar & H. No. 122 Rangsaaz Mohalla, Sadar Bazar comprising Sy No. 357/21 is held on old grant as per GLR & situated inside notified civil area under the management of Cantt Board. The Building plan was sanctioned by the office vide letter No. 2471/322/E7A dated 30.06.2005 with total area 3510 Sqft (2010 Sqft at GF & 1500 Sqft at FF). HOR carried out constructions with deviation from the sanctioned plan at ground floor , first floor and additionally at second floor beyond sanctioned total area . Accordingly, action against the construction was initiated u/s 185 of CA 1924 and PPE Act 1971.

In this regard, GOl issued instructions through Land Policy for old grant sites vide Min. of Def letter No. 11013/1/87/D (Lands) Vol II Dated 09.02.1995 inside notified civil area. As per instructions, para (4)(I-B) ;

“Addition, alteration and re-erection of the building which attract the provisions of the said Section of the Act, within its authorized floor space on the date of issuance of this letter, may be sanctioned on compliance with the requirements of the Cantonments Act 1924, the bye-laws and the orders there under and other relevant laws.”

The instructions dated 09.02.1995 also contain guidelines for regularization of past cases in para 4.4 as;

“Un-regularized unauthorized constructions, if any, may be regularized by the Cantonment Board on collection of compounding fee contemplated in the proviso to Section 185(1) of the Act and execution of the Indenture as in Annexure 'A' with the prior sanction of the Director, Defence Estates, of the Command, on the basis of the preceding two sub-paragraphs.”

Two preceding sub-paragraphs in the instructions are 4.2 & 4.3 are as below;

(4.2) Such cost of re-construction of a building shall not exceed the cost of construction as per prevailing plinth area Rates (at par with MES SSR) approved by the Ministry of Defence for permanent specifications for married' accommodation on the date of sanction of building plans. The cost of repairs shall not exceed 50% of cost of reconstruction determined as above.

(4.3) If the HOR of the old grant site, disputes the terms of holding the land and does not execute and register an Indenture as referred to in the preceding sub-paragraphs, he shall not be accorded sanction to erect or re-erect any building as contemplated under Sections 179 to 181 of the Cantonments Act, 1924. The CEO and the Cantonment Board shall refuse the sanction sought, invoking the provisions of Section 18 (4) (b) of the Act, and shall take follow up action as contemplated in Sections 184, 185, 256 and 268 etc. of the Act and, wherever appropriate, under the Public Premises (Eviction of Unauthorised Occupants) Act, 1971.

The cost of unauthorized constructions based on prevailing plinth area rates of MES SSR comes to Rs. 55,55,003.16. The cost of unauthorized constructions calculated on 15.01.2013 based on rates being used for computation of ARV was Rs. 21,82,921.08.

Board is informed that the Cantt Board Meerut vide CBR No. 83 dated 25.03.1981 has resolved that the composition fee @ 10% of the cost of unauthorized construction be charged while compounding unauthorized construction and the same be reduced at the discretion of the Board in exceptional cases.

281. BUILDING NOTICE: COMPOSITION OF UNAUTHORIZED CONSTRUCTIONS IN RESPECT OF SHOPS NO. 246 TO 249/A AND 263 TO 266/B, RANGSAZ MOHALLA, MEERUT CANTT.

To consider Building Notice dated 29.02.2016 alongwith composition plan by Smt. Sukh Varsha W/o Shri Hansraj Wadhwa in respect of subject property.

The Board is intimated that the site of Shops. No. 246 to 249/A & 263 to 266/B, Rangsaz Mohalla, Sadar Bazar comprising Sy No. 357/324 is held on old grant as per GLR & situated inside notified civil area under the management of Cantt Board. The applicant is HOR as per records.

A Building plan was sanctioned by the office vide PWC Res. No. 6 dated 22.05.1933 in which the constructions of the same portion of shops No. 263 to No. 265 and area for ground floor and first floor was sanctioned as part plan.

The engineering staff vide report dated 20.04.2016 has reported that there is no subdivision of site, no encroachment on Govt. land and composition plan submitted by the applicant conforms to building byelaws of Meerut Cantt.

The cost of unauthorized constructions based on prevailing “Plinth Area

Rates” of MES comes to Rs. 8,17,607.14/-

Board is informed that the Cantt Board Meerut vide CBR No. 83 dated 25.03.1981 has resolved that the composition fee @ 10% of the cost of unauthorized construction be charged while compounding unauthorized construction and the same be reduced at the discretion of the Board in exceptional cases.

Relevant file is put up on the table.

CEO explained the case intimating that the matter of filing SLP consequent to the judgement by Hon’ble Delhi High Court in LPA is pending with the Defence Ministry as per information from DG DE, as the Union of India was the primary party in the LPA and as soon as the instructions are received from the Ministry further action will be initiated by the office as per instructions.

Mrs. Manju Goel raised the issue of divesting the CEE of his normal duties as Executive Engineer and wanted to rescind the previous resolution.

Shri Vipin Sodhi and all other Elected Members stated that necessary SLP should be filed by the Board as opined already the Cantt Board Advocate Mrs. Rekha Pandey who has sent draft SLP. CEO advised the Board to wait for the opinion of Law Ministry/ Defence Ministry, re-explaining the aforesaid position.

The Vice-President and all the Elected Members desired that the CEE be divested of his duties. CEO explained to the Board that such decision is not within the purview of the Board as in accordance with the provisions under section 25 of Cantonments Act, 2006 and rule 7 of CFSR, 1937 CEO is the competent authority to prescribe duties of the staff including CEE. He also read out the CBR No. 60 dated 16.09.2015 & CBR No. 76 dated 31.10.2015 by which the Cantt Board had considered the legal opinion given by Cantt Board Counsel Shri Prashant Mathur and taken a considered decision. He stated that such actions desired by Elected Members cannot be taken as per mere desire unless there are evidence and proofs requiring to take such action which then can be taken by competent authority only. He asked Elected Members to give evidences in support of their demand which Shri Vipin Sodhi, Elected Member refused to give.

Shri Vipin Sodhi and Elected Members stated that the CEE is a supervisory staff appointed by the Board & therefore Board is competent to take such decision and also the Hon’ble High Court at Allahabad in the writ petition filed by Shri Anuj Singh has already considered this issue and rejected his petition. Therefore, the Board is competent and empowered to take such resolution. CEO explained that all such issues have already been considered by Board. He explained that disciplinary authority is different from administrative authority and Shri Vipin Sodhi, Elected Member should not confuse the Board by unilateral interpretation of legal position which is evident from reading of related provisions of CA, 2006 and CFSR, 1937 and when the issue has been adequately considered and decided by Board as per law. PCB opined that the issue may again be referred for a suitable legal opinion and after obtaining legal opinion the matter may be again discussed in the Board meeting.

CEO desired to know the agency from where the legal opinion be obtained. Resolved that legal opinion be obtained from ASG at High Court, Allahabad.
