1. INTRODUCTION
1.1. General introduction on project
1.1.1. MFF Power Transmission Investment Program
1. Electricity Viet Nam (EVN) is developing transmission networks and substations in Viet Nam to support economic growth and ensure access to a reliable supply of electricity throughout the country. The Government of the Socialist Republic of Viet Nam hopes to connect 90% of the population to electricity by 2020, and provide 100% coverage by 2025. The Master Plan for Power Development of Viet Nam No. VII for the 2011-2020 period includes a program for development of transmission lines and substations, provision of meters, and rehabilitation of urban and rural low voltage distribution networks.
2. The Asian Development Bank (ADB) is co-financing the Power Transmission Investment Program (PTIP) through a Multi-Tranche Financing Facility (MFF). The PTIP will enhance the capacity of the transmission network to balance power loads in northern, central, and southern Viet Nam. It will (i) expand the electricity transmission infrastructure by constructing and upgrading 500 kilovolt (kV) and 220 kV transmission lines (TLs) and associated substations; (ii) improve the operational effectiveness and efficiency of the NPT; and (iii) support the implementation of the investment program. The expected total number of MFF tranches is 4.
3. The National Power Transmission Corporation (NPT) is the PTIP Executing Agency (EA). The Northern Power Project Management Board (NPMB) is the Implementing Agency (IA) for the subprojects in northern Viet Nam; the Central Power Project Management Board (CPMB) is the IA for the subproject in central Viet Nam; and the Southern Power Project Management Board (SPMB) is the IA for subprojects in southern Viet Nam.
1.1.2. Tranche 03 Overview
4. Tranche 03 consists of 09 subprojects as following:
(i) 500kV My Tho – Duc Hoa transmission line
(ii) 500kV Duc Hoa substation and connections
(iii) Installation of the second transformer of 220kV Duc Hoa Substation
(iv) Installation of the second transformer of 500kV Cau Bong Substation.
(v) Installation of the second transformer of 220kV Trà Vinh Substation
(vi) Installation of the second transformer of 220kV Uyen Hung Substation
(vii) Installation of the second transformer of 220kV Vung Tau Substation.
(viii) 500kV Chon Thanh Substation
(ix) 500kV Binh Long – Tay Ninh transmission line
5. Owner of project: The National Power Transmission Corporation (NPT) is the executive agency for the 09 subprojects. The Central Power Projects Management Board (CPPMB) is the implementing agency for the two subprojects of 220kV Binh Long – Tay Ninh TL and 500kV Chon Thanh substation and the remaining 07 subprojects will be implemented by The Southern Power Projects Management Board (SPMB). Until now, subprojects of installation of the second transformer of 220kV Duc Hoa substation, installation of the second transformer of 500kV Cau Bong substation, installation of the second transformer of 220kV Tra Vinh substation, installation of the second transformer of 220kV Uyen Hung substation and installation of the second transformer of 220kV Vung Tau substation have been completed construction and put into use in which four subprojects have been completed construction and only the subproject of installation of the second transformer of 220kV Vung Tau substation has been not completed compensation and site clearance. Therefore, this report only mentions to three subprojects implemented by SPMB, including the 500kV Duc

Hoa substation and connection line and 500 kV My Tho – Duc Hoa transmission line and the subproject of installation of the second transformer of 220kV Vung Tau substation.
1.2. Brief subproject description and impact
6. SPMB implements seven subprojects under the Tranche 3 with eight safeguard planning documents approved by ADB in 2015 during the stage of preparing feasibility study (FS). The documents include four resettlement plans under three subprojects [(500kV Duc Hoa substation and its connection line; installation of second transformer in 220 kV Vung Tau substation; 500kV My Tho - Duc Hoa Transmission Line (section passing Long An Province)]; 500kV My Tho - Duc Hoa Transmission Line (section passing Tien Giang Province) and five due diligence reports (DDRs) under four subprojects (220kV Tra Vinh substation, installation of second transformer in 220 kV Uyen Hung substation, installation of second transformer in 500 kV Cau Bong substation and installation of second transformer in 220kV Duc Hoa substation).

According to updated Resettlement Plans (uRPs) of 500kV Duc Hoa substation and 500kV My Tho – Duc Hoa transmission line, section passing Districts of Duc Hoa, Thu Thua, Thanh Hoa and Ben Luc approved by ADB in May 2019 and Due Diligence Reports (DDRs) established for subprojects and approved by ADB in March and May 2015 and information provided by District Construction and Investment Project Management Board of Long An province (Table 1), Land Fund Development and Project Management Unit of districts of Tien Giang and Land Fund Development Center Vung Tau provinces, the scope impact of the subprojects is on the territory of six provinces/cities (including Ho Chi Minh, Long An, Tra Vinh, Binh Duong, Tien Giang and Ba Ria Vung Tau) with 11 districts and 30 communes/wards/towns. The Summary of impacts in subprojects are described in the table 1 below:

8. According to the summary in Table 2, there are 4,4499 households and 13 organizations being affected by land acquisition (not including households being affected by ROW, these households will be updated in monitoring reports when the DMS result is available). The project affects 3,050,050 m² of various types of land and assets on land. The affected quantity has been updated in detail in the monitoring report basing on the implementation progress of the project and compensation and site clearance progress as of the monitoring in 6/2019.

1.3. External monitoring of RP/uRP/DDR
1.3.1. Objective of external monitoring
9. The main objective of external monitoring is to provide an independent periodic review and assessment of the subproject’s: (i) achievement of resettlement objectives; (ii) changes in living standards and livelihoods of affected persons (APs); (iii) restoration and/or improvement of the economic and social conditions of the APs; (iv) effectiveness and sustainability of entitlements; and (v) the need for further mitigation measures.
10. In the fifth monitoring, the consultant has focused on discussion with SPMB on the overall progress of the project, progress of implementing compensation, site clearance and bid award. Simultaneously, the consultant also reviewed the implementation of remaining issues, recommendations in the first/second, third and fourth monitoring and remaining issues in the implementation of RP/uRP/DDR found in the fifth monitoring. Monitoring activities were carried out from 1st July 2019 to 5th July 2019 and Covering activities from 1-6/2019.
1.3.2. Tasks of the consultant
11. The external monitoring expert has undertaken the following specific tasks as outlined below:
(i) Review the internal monitoring result on the implementation of RP/uRP/DDR
(ii) Review the implementation of RP/uRP/DDR, especially proposed CAP, which has been approved by ADB.
(iii) Verify the process of the detailed measurement survey and determine whether activities are carried out in a participatory and transparent manner.
(iv) Determine the level of participation of affected people in the updating and implementation of RP/uRP/DDR.
(v) Determine whether payment of compensation and allowances are provided at full replacement cost in a timely manner to all affected people as approved in the RP/uRP/DDRs.
(vi) Determine whether public consultations and awareness programs have been conducted as approved in the RP/uRP/DDRs.
(vii) Verify whether the implementation of resettlement activities is well coordinated with the civil works schedule of each subproject.
(viii) Verify the land acquisition and land transfer procedures.
(ix) Verify the level of satisfaction of affected people with the provisions and implementation of the RP/uRP/DDRs.
(x) Assess the adequacy of the Grievance Redress Mechanism (documentation, process, and resolution).
(xi) Determine the effectiveness, impact, and sustainability of entitlements and income restoration programs and the need for further improvement and mitigation measures.

(xii) Assess the capacity of affected people to restore livelihoods and living standards with special attention to be given to severely affected people and vulnerable groups including female headed households and ethnic minorities.
(xiii) Assess whether there are any impacts on the host communities with regards to gender, HIV/AIDS and other infectious diseases, and human trafficking.
(xiv) Assess whether any resettlement impacts are incurred during construction activities.
(xv) Assess the institutional capacity of NPT and SPMB with regards to the implementation, internal monitoring and reporting resettlement and compensation activities and recommend appropriate measures to enhance identified capacity gaps.
(xvi) Prepare and submit detailed monitoring reports on a semiannual basis. The reports will describe in detail the findings, including (a) progress of RP/uRP/DDRs implementation, including any deviations from the provisions in the RP/uRP/DDRs; (b) identification of issues and recommended solutions for improvement and resolving issues; (c) identification of specific issues related to gender, and other vulnerable groups; (d) reporting on progress of resolving issues and problems identified in previous reports; (e) reporting on good practices on the implementation of RP/uRP/DDR.
(xvii) Preparation and submission of a detailed resettlement monitoring completion monitoring report within 6 months from the time of completing resettlement activities for each subproject.

1.3.4. Monitoring methodology
13. The consultancy has used the following methods to monitor and evaluate:
- Meeting with the SPMU and ADB on the progress of implementing compensation, assistance and resettlement, especially the subprojects of (i) 500kV My Tho – Duc Hoa transmission line; and (ii) 500kV Duc Hoa Substation and connection line and (iii) 220kV Vung Tau substation and 110kV connection line.
- Collection of reports on the project implementation progress, compensation and site clearance progress, status of award of contract;
- Review of internal reports on the implementation of RP/uRP/DDR, review of compensation dossier/document and data kept at SPMB.
- Discussion with SPMB on: (i) the general process of the project; (ii) the process of implementing award of contract, compensation and site clearance; (iii) status of implementing remaining issues recommended in the second monitoring; (iv) grievance and status of redressing the grievances (if any);
- Discussion with Construction Investment Management Board and Land Fund Development Unit/ Land Fund Development Center and Project Management Unit on: (i) process of implementing compensation and site clearance; (ii) advantage and disadvantage during the implementation process; (iii) checking of compensation dossier/document and collection of document; (iv) grievance and status of redressing the grievances (if any);
- Field survey at substations of (500kV Duc Hoa and connection line and 500kV My Tho – Duc Hoa transmission line); discussion with staffs of substations, Construction Investment Management Board and Land Fund Development Unit/ Land Fund Development Center and Project Management Unit on the implementation status of compensation as well as site clearance including general progress, implementation of community consultation, DMS/SES, RCS, establishment of compensation plan, publication of draft of compensation plan and status of updating RP/uRP and implementation of CAP; discussion with leaders of villages and interview with affected households by 500kV My Tho – Duc Hoa transmission line and 500 Kv Duc Hoa substation and connection line on the disseminated information, opinions of affected persons, the accuracy of DMS data, the participation in the DMS process of affected people, the time of receiving compensation amount and handing over the site in comparison with the time of commencement, compensation unit price and the impact level of livelihood/income, the possibility of relocation of households, status of households under vulnerable groups, archiving of DMS document and project documents of households. 22 households have been interviewed in which there are 17 households under relocation households have received compensation amount without complaints, 02 households under relocation households have not received compensation amount with complaints and 03 households have complained about compensation and site clearance of the project.

2.2.1. Internal monitoring
16. The resettlement consultant has assisted SPMB in conducting quarterly internal monitoring. As of 7/2019, there have been nine quarterly internal monitoring reports, including seven quarterly reports and two semi-annual reports submitted to ADB for approval and three reports (quarter 3, 4/2017 and quarter 1/2018) have been prepared by staffs of SPMB and submitted late in 5/2018 because it has been not recruited resettlement specialist to change for position of Mr. Nguyen Cong Hiep. These internal monitoring reports have been prepared using all of the prescribed forms and with detailed information. These reports were prepared mainly in table format, so it is easy to fill in information, and a lot of detailed data were provided. The reports provided to SPMB and ADB with much information on the status of RP/DDR implementation. The internal monitoring reports could be used to support efforts by the Project for management and coordination. Internal monitoring reports of quarter 2, 3 and quarter 4/2017 and quarter 1/2018 have been not timely prepared and submitted so that it has been not timely reflected the progress of updating and implementing the compliance with RP/DDR in subprojects.
17. The internal monitoring reports of quarter 2, 3 and 4, 2018 and Quarter 1, 2019 have been timely prepared and submitted which timely reflects the progress of updating and implementing the compliance with RP/DDR.
18. Compensation and assistance dossiers/document have been being collected/gathered and put into management/archiving by SPMB, and Project Construction and Investment Management Board of districts/Land Fund Development and Project Management Unit of districts.
19. Checking of compensation dossiers in SPMB, Project Construction and Investment Management Board of Duc Hoa, Ben Luc, Thu Thua, Thanh Hoa districts of Long An province and Land Fund Development and Project Management Unit of Tan Phuoc and Chau Thanh districts of Tien Giang province, it shows that it has been well complied with the management and archiving of compensation dossier. Internal discussion and coordination between Project Construction Investment Management Unit/Project Management Unit with SPMB to speed up the implementation progress of RP/uRP of 500kV Duc Hoa substation and connection line and 500kV My Tho – Duc Hoa transmission line.
2.2.2. Information disclosure and public consultation
20. During the project preparation process: SPMB and consultant establishing resettlement plan/due diligence monitoring report have organized consultation meetings with affected people in seven subprojects at CPC’s headquarter. Contents of the meetings include dissemination of general information on the project such as the scale, scope, technical design, compensation and site clearance policy including the law of Vietnam on compensation and site clearance, policies of ADB and the project policy framework, impact scope of land acquisition and resettlement of the project, grievance redressing mechanism as well as monitoring of the implementation of resettlement plan/ due diligence monitoring report.
21. In the implementation process: during the process of implementing resettlement plan/due diligence monitoring report, the consultation meetings are organized with project affected households to inform about the policies on compensation and site clearance of the project, positive and negative impacts on people, benefit from the project, grievance redressing mechanism and details of affected assets. Besides, affected households are also directly participated in the DMS process and recorded their feedback on detailed compensation plan.
22. As of the fifth monitoring, the time for organizing information dissemination meetings in the implementation process of two subprojects is as follows: 1) Thu Thua district on 19/3/2017, 15/7/2017 and 18/5/2018; 2) Thanh Hoa district: 3/8/2018 and 3/9/2018; 3) Duc Hoa district: 25/9/2018 and 29/8/2018; 4) Ben Luc district: 26-28/2/2019. Chau Thanh and Tan Phuoc districts only carried out information dissemination on the scale and scope of the project in 2017. The contents and results of information dissemination meeting in Thu Thua,

Thanh Hoa and Duc Hoa districts (substation) have been presented in the previous monitoring report. The information dissemination meetings have been conducted during the monitoring report including the time, participants and results of these consultation meetings are showed in the table 9 below.
23. Comparing to the fourth monitoring for period of 12/2018, as of 6/2019, there have been more four information dissemination meetings organized in Ben Luc district, under the subproject of 500kV My Tho – Duc Hoa transmission line and 10 meetings in 10 communes under connection line under the subproject of 500kV Duc Hoa substation and connection line, Duc Hoa district. The time, participants and results of the consultation meetings are presented in Table 9 and 10 below:

2.2.3. DMS
24. As of the fifth monitoring, five uRPs of the two subprojects have been approved, including uRP of 500kV Duc Hoa substation; the RP has been not updated for connection lines because it has been not carried out 100% DMS; four uRPs of four districts of Thu Thua, Thanh Hoa, Duc Hoa and Ben Luc under the subproject of 500kV My Tho – Duc Hoa transmission line were approved by ADB in 5/2019. The DMS implementation progress in the two subprojects is as follows:
(i) 500kV My Tho – Duc Hoa transmission line: it has been completed DMS in 12
communes of Long An and Tien Giang provinces. As of the fifth monitoring, there
have been 969 households and one organization being carried out DMS by the
subproject. Project Construction Investment Management Unit/Land Fund
Development Center and Project Management Unit of districts has conducted
community consultation and information dissemination, informed about the DMS plan
in all communes. The DMS process has been lasted longer because some
households are absent from their locality and the coordination between unit in charge
of cadastral measurement and Project Construction Investment Management
Unit/Land Fund Development and Project Management Unit of districts is not closely
and it has been not determined head of household.
(ii) 500kV Duc Hoa Substation and connection line: it has been being implemented DMS,
(i) 500kV Substation has been completed DMS; (ii) 500kV double transmission lines
connecting from 500kV Substation to 500kV My Tho – Duc Hoa transmission line has

been completed DMS for 452/455 households; (iii) 220kV transmission line No. 1 has
been completed DMS for 497/508 households and 220kV transmission line No. 2 has
been carried out DMS for 80/82 households. It is expected to be completed DMS for
the transmission lines in quarter 2 of 2019.
(iii) 220kV Vung Tau substation: DMS has been completed. The implementation of DMS
has been complied with regulation of the Law and RP. Households have been
announced about the DMS plan, participated in the DMS process and confirmed that
the DMS results are adequate and accurate. Households signed in the DMS minutes.
There are 20 households being affected by 110kV transmission line and carried out
DMS and compensation plan has been approved for the households. Seven
households which have land and assets on land under 110kV transmission line in
Ward 11 being missed during the DMS process have been carried out DMS,
including:

25. The implementation of DMS has been being well complied by Project Construction Investment Management Unit/Land Fund Development and Project Management Unit. All affected households are informed in advance about the DMS plan. Households are delivered a form to list total area of land plots by themselves, area of types of house, structure on land, number of types of tree, family members and information on vulnerable groups. And then Project Construction Investment Management Unit/Land Fund Development Center and Project Management Unit collected the form of all households before conducting DMS in the site. During the DMS in site, head of households/representatives of households are also participated in the process to determine boundary and types of affected asset and confirm affected quantity.
26. After checking the DMS minutes, it can see that, the DMS minutes is numbered, specified name of works/subprojects, household and participant of the DMS group. The minutes also specify number of labors directly participating in production of agriculture and number of person in household and determine if household is under preferential treatment policy.
27. However, total land area being owned and used by household is not shown in the DMS minutes and it is also not determined the proportion of land acquisition area for the project. Project Construction Investment Management Unit/Land Fund Development and Project Management Unit of districts has established a separate list to determine the total land area and the proportion of land acquisition area which are not included in the DMS minutes because it needs to be verified and determined by cadastral official and CPCs. However, the list of severly affected households and vulnerable affected households have been showed in the uRPs.
28. According to the DMS results in subprojects, total number of severely affected households is 65 households in which 26 households having more than 10% of total productive land affected (500kV Duc Hoa substation with 26 households; 500kV Duc Hoa transmission line with no household being affected more than 10% of production land) and

40 households being relocated. Because there is one household which is not only relocated but also has land affected more than 10%, the total number of affected households is 65. Number of seversely affected households and relocated households is presented in Table 11 below. See Annex 2 for the attached DMS minutes.

2.2.4. Establishment of Compensation plan
29. LFDC/PMUs are being established compensation plan according to five approved resettlement plans out of seven toal acquired uRP of two subprojects (500kV Duc Hoa substation and connection line; 500kV My Tho – Duc Hoa transmission line) five uRPs have been updated and approved by ADB, exception of uRPs of Chau Thanh and Tan Phuoc districts, Tien Giang province. The progress and status of preparing the compensation plan in two subprojects are summarized by each subproject as below:
(i) 500kV Duc Hoa substation and connection line: only 500kV Duc Hoa substation has
been prepared compensation plan and submitted the plan to Duc Hoa DPC for
approval on 7th May 2018. However, the assistance for job changing and creation is
only equivalent to 0.4 times of compensation price for agriculture land of the same
type for all AHs with affected agriculture land, not distinguishing marginal impacts or
sigfinicant impacts (according to Decision No. 4314/QĐ-UBND dated 23/11/2019 by
Long An PPC) meanwhile it is equivalent to 1.5 times according to approved RP for

severely affected households and 0.4 times for insignificantly affected households.
See Annex 4 on the detailed compensation option for households.
It has been established compensation plan for both 500kV transmission line, 220kV
transmission line No. 01 and 220kV transmission line No. 2 and it is being appraised
for households who completed DMS. All of the three transmission lines have been
conducted replacement cost survey. According to Project Construction Investment
Management Unit/Project management Unit and land fund development unit, DMS is
expected to be completed in quarter 3 of 2019.
(ii) 500kV My Tho – Duc Hoa transmission line: in Long An province, Project
Construction Investment Management Unit of districts of Thu Thua, Thanh Hoa, Ben
Luc and Duc Hoa and Ben Luc. Specifically, compensation plan was approved on
11/5/2018 for Thu Thua district, on 3/9/2018 for Thanh Hoa district, on 19/102018 for
Duc Hoa district and on 10/122018 for Ben Luc district. In Tien Giang province, the
DMS, application of unit price and establishment of compensation plan have been
completed by Project management Unit and land fund development unit of Chau
Thanh and Tan Phuoc. And the plan has been submitted for approval. Specifically,
compensation plan of Chau Thanh district was started to establish on 3/102018 and
compensation plan of Tan Phuoc district was started to establish on 15/10/2018.
However, the option of unit price is being re-submitted for approval, it will be reviewed
the DMS result. It is expected to be completed before 20/8/2019 for Chau Thanh
district and before 30/9/2019 for Tan Phuoc district.
(iii) 220kV Vung Tau substation: completed compensation plan for 69/69 household.
DCARC has conducted payment to 69/69 HHs. The compensation plan has been
approved by Vung Tau City’s PC for 110kV transmission line and LFDC has
conducted payment to 17/20 HHs. The remaining three households have not received
compensation and local authority has not determined landowner because the land
has been transferred to many households.
Currently, seven households which have assets being missed during the DMS
process under 110kV transmission line, have been conducted DMS; however,
compensation plan has been not established for them because land position map
with signature of households is not available.
Thus, total number of households affected by 220kV Vung Tau substation and
connection line is 92.
2.2.5. Payment of compensation
30. The compensation payment has been conducted for the 3 subprojects. As of the fifth monitoring, 392 households in the approved compensation plan have been conducted compensation payment. The compensation unit price has been calculated and approved and applied based on the market price and complied with resettlement policy of the project. In addition, it has been conducted advance payment to 47 households in the unapproved compensation plan. However, the progress of compensation payment in each subproject is different. Specific amount of households conducted compensation payment is presented in the Table 12 below:

Mr. Nguyen Dinh So with his wife named Thai Thi Dung. The
household has land permanently affected by pole foundation.
Currently, the household has not agreed to receive compensation for restoration of affected land
due to construction activity. According to opinion of the
household, the pole foundation is constructed on the field plot with
total area of 11,000 m2. The construction of pole foundation has affected 575m2; however,
during the construction process, the excavated soil has caused
alum earth for a half of total area of the field with about of 5,000m2.
The household has received advance payment of VND 23
million from the construction unit. According to opinion of the
household, total cost for treatment of alum is about VND 30 million. Total remaining land
area for growing rice has productivity of 800kg/labor and total number of five labors will
create a yield of 5,000 kg. Total value of damage to rice land area
is about VND 24 million. Therefore, the household requires to be additionally
compensated with the amount of VND 60 million without acquiring the advance payment VND 23
million he has received by advance payment before.

Currently, DCARC only agrees to compensate to the household with value of VN 40 million,
including treatment of alum and affected rice and does not agree
to additionally compensate to household with value of VND 60 million without paying back the advance payment with value of 23 mililion/household that the households received before.
DCARC has been persuading the household to agree with the
compensation level proposed by DCARC.
According to the opinion of external monitoring, DCARC
needs to agree with household about compensation value in accordance with the value of
treatment of alum and the value of affected rice basing on the

2.2.6. Relocation and site clearance
31. 500kV My Tho – Duc Hoa transmission line: According to data provided by districts (not including Chau Thanh and Tan Phuoc districts), total number of relocated households by 500kV My Tho – Duc Hoa transmission line is 39 in which 15 households in Thu Thua district have relocated and handed over the site and the remaining households have not relocated due to reasons presented in the Table 13 below.
32. 500kV Duc Hoa Substation: Total number of relocated households is one household. The household has received compensation and handed over the site.
33. 220kV Vung Tau substation and connection line: According to the DMS data, in the subproject of 220kV Vung Tau substation, 15 relocated households in the construction site of 220kV substation have received compensation from 2014 to 2016 and been applied compensation, assistance and resettlement policy in compliance with the policy framework of the project. All the 15 households have been handed over resettlement land or self arranged resettlement land and relocated in 2016. The new resettlement site is in ward 10, Vung Tau city and the old site is in ward 11, Vung Tau city. Through field survey and interview with household of Mrs. Pham Thi Ton who was handed over resettlement land B1, hill 2, ward 10, it can be realized that the resettlement land is near residential area and road with full technical and social infrastructures (mentioned in the third periodical monitoring report, 6/2018).

2.2.7. Income and livelihood restoration program
34. The affected people are subject to livelihood restoration program including, severely affected households (relocated households and AHs losing 10% and more of total productive land) and vulnerables households.
35. Up to the fifth monitoring in July 2019, all two subprojects have 40 households identified to be relocated (Table 13), 26 households identified to be severely affected with 10% loss of production land under the impact of subproject Duc Hoa 500 kV substation, Duc Hoa District and no affected households belong to the vulnerable group. As of 6/2019, there have been five approved livelihood restoration programs, including Duc Hoa, Thu Thua, Thanh Hoa, Ben Luc under 500kV transmission line and Duc Hoa substation. It is expected to conduct survey on the need of livelihood assistance of households in 3/2019 after households stabilize their living by the internal social safeguard expert of SPPMB. The independent monitoring consultants will continue to observe and monitor this issue in the coming monitorings.

2 220kV Vung Tau substation and connection line
07 households affected by 110kV connection line and substation have been carried out DMS but not received compensation due to not completing cadastral map with full signature of households. The households also complained about the reason for not receiving compensation.
SPMB issued Official Letter No. 0427/SPMB-ĐB dated 16/1/2019 to Digital Photo Painting and Measuring Enterprise on proposal of completion of cadastral map under the subproject of 220kV Vung Tau substation and connection line. However, until now, signature of adjacent households has been not fully supplemented, the enterprise cannot complete the map.
Ward PC 11 has considered the use of land for the seven households and also transferred dossiers to the Department of Environmental and Natural Resource of Vung Tau city for consideration. However, the Department of Environmental and Natural Resource of Vung Tau city requires to have full signature of adjacent households. Ward PC 11 has publicly posted and announced to households; however, none of the households come to sign.
According to the process, after gaining signature of adjacent households, the cadastral map will be transferred to Land Registration Office to certify, and then it will be transferred to the Department of Environment and Natural resource of Vung Tau city to consider. If it is accepted, it will be established compensation plan and submitted for approval.
The Vung Tau Land Fund Development Center states that in case of expiry of notice at the Ward and households still donnot come to sign, it will be established dossier to transfer to the Department of Environmental and Natural resource of the City for consideration and establishment of compensation plan.
The Land Fund Development Center of Vung Tau city needs to continue announcing and inviting adjacent households to supplement their signature. In case that households cannot come due to force majeure reason, it needs to work with Department of Environment and Natural resource of Vung Tau city to find resolution.

2.2.9. Compliance with civil works plan
37. As of the fifth monitoring, all packages have been awarded. Although the compensation payment to is in good progress in comparison with the fourth monitoring and some project districts have conducted compensation payment to affected households, the progess of land acquisition and compensation at the subproject of 500kV My Tho – Duc Hoa is still slower than the progress of award, construction and handing over the site for construction, specifically:
(i) 500kV My Tho – Duc Hoa transmission line: Currently, in Long An province, only Thu
Thua district has conducted compensation payment to 100% affected households
and it has been handed over all the site to the project. The remaining households
have not completed compensation payment, therefore, it has been not completed
handing over the site to the project. Specifically, in Thanh Hoa district, it has
conducted compensation payment to 90% affected households, Ben Luc district has
conducted compensation payment to 60% affected households, Duc Hoa district has
conducted compensation payment to 40% affected households. In Tien Giang
province, Chau Thanh and Tan Phuoc districts have not conducted compensation
payment. The contractor only reached agreement with households to conduct
advance payment for 15 households affected by pole foundation in order for them to
hand over the site to facilitate construction unit in prior construction (in Chau Thanh
district, 11 households out of 206 affected households received advance payment
and; in Tan Phuoc district, four out of 336 affected households received advance
payment) from 2017. The advance payment has been stopped. As of the fifth
monitoring, no arising household receives advance payment before compensation
plan is approved. The list of households received advance payment is presented in
Annex 3.
(ii) 500kV Duc Hoa substation and connection line: completed compensation payment to
all 32 affected households/organizations under substation and handed over the site to
the construction unit.
(iii) The subproject of 220kV Vung Tau substation has been basically completed
compensation and site clearance based on the construction progress.
Compensation and resettlement for affected households, which have not received
compensation, will continue to be monitored to ensure the compliance with the
approved policy framework and updated resettlement plan.
2.2.10. Review of the monitoring indicators
(i) Basic information on displaced persons’ households
- Some basic information on relocation has been collected (position of the project, component of households, age, education level, skill and gender of householders).
- Households access to services of health, education and other social services; participate in community groups.
- Assistance for stabilizing life has been not carried out for households identified in the RP.
(ii) Restoration of living standards

- Compensation amount is enough for replacement of similar assets (the same type, size and level of use).
- Replacement land area is fully equipped with technical and social infrastructures.
- Job opportunities in new place will facilitate households in improving their living standards to be equal or better living standards of the post-project stage.
(iv) Levels of displaced persons’ satisfaction
- Relocation households are fully disseminated information on the process and entitlement of resettlement.
- Relocation households assess that their life is now stabilized and better than before. And households have been disseminated information on the independent complaint process.
(v) Effectiveness of resettlement planning
- Relocation households confirm that their affected assets are accurately and fully measured and inventoried (DMS).
- Reviewing of households under vulnerable groups in accordance with the project’s policy.
3. CONCLUSIONS AND RECOMMENDATIONS
3.1. Conclusions
38. The compensation and site clearance have been completed for subproject of 500kV Duc Hoa substation. All of the affected households have received compensation without complaint.
39. Regarding the subproject of 500kV My Tho – Duc Hoa transmission line: SPMB and Project Construction Investment Management Unit/ Land Fund Development and Project Management Unit of districts are speeding the progress. Currently, only two districts of Chau Thanh and Tan Phuoc of Tien Giang province have not conducted compensation payment due to not yet compteted compensation plan. The remaining districts have conducted from 40-100% compensation payment to affected households. The implementation progess of compensation and site clearance in districts has complied with social safeguard policy of ADB and policy framework and uRP of the project such as: project information dissemination meetings, meetings to announce the DMS plan, land acquisition plan, transparent and public DMS, public posting of compensation plan at CPC’s headquarter, once time compensation payment under the witnessing of the stakeholders and people. People are kept DMS minutes and sign on the compensation payment list.
40. As of the fifth monitoring, the construction progress reached 100% in subproject of 220kV Vung Tau substation and 110kV connection line, 55% in the subproject of 500kV My Tho – Duc Hoa transmission line and about 10% for subproject of 500kV Duc Hoa substation and connection line.

41. Comparing to the fourth monitoring, some remaining issues need to be handled as follows:
It has been conducted compensation payment in Ben Luc district. By the fourth monitoring time, the compensation plan of Ben Luc district has been not approved; therefore, It has been not carried out compensation payment to households. Only advance payment was conducted for households affected by pole foundation.
- The districts of Thanh Hoa, Duc Hoa and Ben Luc under the subproject of 500kV My Tho – Duc Hoa transmission line: it has been conducted compensation payment to affected households. Households, which received advance payment from the construction unit, have received compensation amount as the approved plan and also implemented reimbursement for the construction unit.
- Some complaints about compensation and site clearance of households have been handled. Households agreed to receive compensation amount without any more complaint such as household of Le Hoang Dam, Thu Thua district, household of Duong Van Tam, Thach Hoa district under the subproject of 500kV My Tho – Duc Hoa transmission line and household of Mrs. Ho Thi Ban, Duc Hoa district, under the subproject of 500kV Duc Hoa substation and connection line.
42. However, the fifth monitoring results shows that there are still some remaining issues and complaints in the compensation and site clearance including:
(i) In the subproject of 500kV My Tho – Duc Hoa transmission line, the progress of DMS,
establishment of compensation plan and land acquisition is still slow in comparison
with the progress of biding award and requirement of handing over the site for
construction, especially in Chau Thanh and Tan Phuoc districts, Tien Giang province.
(ii) The compensation plan established for 500kV Duc Hoa substation is only calculated
the assistance for changing occupation equivalent to 0.4 time of compensation price
for agriculture land of the same type for all households having agriculture land
affected by the project in accordance with Decision No. 4314/QĐ-UBND dated
23/11/2018 by Long An PPC which has been not complied with RP/uRP. According to
the requirements of RPF/uRP, it will be provided assistance for job transition
equivalent to 1.5 times for severely affected households and 0.4 time for marginally
affected households.
(iii) In the districts of Thanh Hoa, Thu Thua and Ben Luc under the subproject of 500kV
My Tho – Duc Hoa transmission line, some households have not agreed to receive
compensation because they complained that the compensation unit price is low or
they are not satisfied with the compensation for arising effect (Soil contaminated alum
due to construction of pole foundation).
(iv) 19/39 households, which have to relocate, have not removed to the new place and
not handed over the site to the project: two households are building house in Thu
Thua, 14 households in Duc Hoa district and three households in Ben Luc district
have not received compensation due to complaining about the low unit price.
(v) As of the fifth monitoring, 15 households, which received advance payment for effect
by pole foundation in Chau Thanh district (11 households) and Tan Phuoc (4
households) in Tien Giang province, have not received the remaining compensation.
The list of households affected by five pole foundations in Chau Thanh district has
been not provided by the contractor because the contractor proactively carried out
advance payment to affected households. The consultant will continue updating in the
next monitoring report. In addition, in 5/2019, in Duc Hoa and Ben Luc districts, the

construction unit proactively carried out advance payment for 32 households affected
by pole foundation under 500kV Duc Hoa substation and connection lines to be
handed over the site for construction.
(vi) The updated RP reports in Chau Thanh and Tan Phuoc disricts under the subproject
of 500kV My Tho – Duc Hoa transmission line is very slow in comparison with the
progress of award of bid and the requirement of handing over the site to serve
construction. As of 30/6/2019, there have been only five updated RPs being approved
by ADB, including: (i) uRP of 500kV Duc Hoa substation (the substation) and, (ii) uRP
of 500kV My Tho – Duc Hoa transmission line (Duc Hoa district). (iii) uRP of 500kV
My Tho – Duc Hoa (Thanh Hoa District), (iv) uRP of 500kV My Tho – Duc Hoa (Thu
Thua District) and (v) uRP of 500kV My Tho – Duc Hoa (Ben Luc District). uRP for
Chau Thanh and Tan Phuoc districts have been not established and submitted to
ADB for approval.
3.2. Recommendation
43. On the base of the implementation result of the compliance with RP/DDR/uRP and some issues found in the fifth monitoring, the independent monitoring consultant have some recommendations as follows:
(i) It needs to speed up the implementation progress of uRP for districts of Chau Thanh
and Tan Phuoc, Tien Giang province and uRP for connection lines of the subproject
of 500kV Duc Hoa substation and connection lines. After uRP of the two districts is
approved, it needs to monitor the reimbursement status of advance payment of
affected households in comparison with the advance payment minutes between the
contractor and households. For districts of Thu Thua, Thanh Hoa, Duc Hoa and Ben
Luc, it has been carried out the remaining amount for households which received
advance payment. It also needs to monitor the reimbursement status of advance
payment of affected households due to effect by construction of pole foundation
because in the fact that the advance payment is agreed between the construction unit
and affected households. After compensation plan is approved, affected households
will receive compensation payment in accordance with the approved plan and self
implement reimbursement to the construction unit.
(ii) Recommend SPMB to require the construction unit to stop advance payment to
affected households by connection lines under the subproject of 500kV Duc Hoa
substation and connection lines until the uRP of connection lines is approved by ADB.
After compensation plan is approved, it needs to be compared and referred the
compensation amount and entitlement of households which received advance
payment with the approved compensation plan to assess the suitability between
advance payment and handed over site.
(iii) For cases which have not agreed to receive compensation, it needs to propagandize
and explain to households for them to agree to receive compensation.
(iv) For arising effect due to alum infection to productive land of households after
construction, DCARC needs to agree with households about compensation value in
accordance with the value of alum treatment and the value of affected rice area at
market price.

(v) Carry out assistance for changing occupation and creating job for households being
severely affected by 500kV Duc Hoa substation and connection line equilavent to 1.5
times for the agriculture land of the same type in accordance with RP/uRP of the
project. The established compensation plan is only calculated the assistance
equivalent to 0.4 time of compensation price for agriculture land of the same type.
(vi) Speed up the progress of implementing income restoration programs for 65 severely
affected households, including 26 severely affected households (losing more than
10% productive land) and 40 relocated households (including one households which
is both relocated and lost more than 10% productive land) determined in accordance
with uRP of 500kV Duc Hoa substation and 500kV My Tho – Duc Hoa transmission
line
(vii) .Although there is not any more advance payment activities in the period of fifth
monitoring but the consultant still give recommendation on not continue implementing
advance payment to households when constructing pole foundations in Chau Thanh
and Tan Phuoc districts, Tien Giang province under the subproject of 500kV My Tho
– Duc Hoa transmission line.
(viii) Continue to carry out social-economic survey and community consultation to
serve the updating of RP for Chau Thanh and Tan Phuoc districts under 500kV My
Tho – Duc Hoa transmission line and update RP for connection lines under the
subproject of 500kV Duc Hoa substation and connection lines to submit to ADB for
consideration and acceptance before conducting compensation payment to the
project affected households.
44. All the findings and recommendations by IMC per subproject are provided in the in Table 15 below.

Annex 4: The form of detail compensation plan of households
Compensation rate applied to the 500kV Duc Hoa SS and connection lines
Compensation rate for Land
Approved based on the results of the independent valuation for land for subproject conducted in july 2018 by Southern Information and Valuation Joint Stock Company. The aims of the survey is to provide a market price on land in the project area. The valuation results have been submitted to the appraisal council including representatives of Long An Provincial Department of Natural Resources and Environment, Department of Finance, Department of Tax and Department of Construction to appraise the specific land prices which is applied for compensation for the affected land under the subproject. The appraisal result was then approved by Long An PPC in Decision No. 2529/QD-UBND dated 30 July 2018 by Long An PPC on approval of specific land prices for the construction of the 500 kV Duc Hoa SS and connection lines owned by SPMB in Hoa Khanh Dong Commune. The proposed land prices for compensation, site clearance in Hoa Khanh Dong commune are in the table below this table.
Compensation rate for house and other assets
Based on current market prices of materials and labour without depreciation nor deductions for salvaged building materials. Compensation rates for affected structures are calculated based on construction price index which announced by Long An Provincial Department on a monthly, quarterly and annually basis and include labor costs;
Compensation rate for crops and trees
Annual crops equivalent to current market value of crops at the time of compensation. For cash crops, the compensation unit price is calculated by the Department of Agriculture and Rural Development based on the actual yield of the crop for three consecutive years and the market price; For perennial crops and trees, cash compensation at replacement cost is equivalent to current market value given the type, age and productive value at the time of compensation. Timber trees based on diameter at breast height at current market value.
