Introduction
One of the fundamental rights the EU (European Union) citizens
enjoy consists in the free movement of people throughout the
European Economic Area. The European citizens’ mobility can be
done both for lucrative and non-lucrative purposes. In certain cases,
they need to have access to constant education and training and to
practise their profession on the internal market. For this purpose,
standards have been adopted in order to facilitate the mutual
recognition of the professional qualifications among the Member
States.
As it is already known, one of the objectives set by the project
“The Network of Competent Authorities for Professional
Qualifications in Romania” is the creation and development of a
network at national level IMI NET for the professional
qualifications in Romania.1 For this purpose, as part of the said
project these Qualification Certification and Recognition Guidelines
have been elaborated for the veterinary surgeon profession. These
guidelines are meant to support the competent authorities in Romania

in its efforts to standardize the certification and recognition processes
for the regulated veterinary surgeon profession. Moreover, these
guidelines provide information referring to the practices in other
seven EU Member States (Austria, the Czech Republic, Denmark,
Germany, Italy, Great Britain and the Netherlands), for a better
orientation of all the people who have obtained qualifications in their
respective field of business in Romania and who want to practise the
veterinary surgeon profession in any of the EU Member States
shown in these guidelines. Therefore, these guidelines are designed
for the competent authorities, the social partners and the individuals
who are interested in the certification and recognition of the
veterinary surgeon profession in the seven EU Member States,
compared to Romania.
The methodology for the application of the of the Qualification
Certification and Recognition Guidelines for the veterinary surgeon
profession consisted in the research of the documents (European
legislation, national regulations, types of qualification titles, etc.) for
the profession in question in each individual country, the processing
of the information – statistics in the internal market information
system (IMI) and comparative studies at EU level for that respective
field, including research in the field by collecting information from

the Romanian Veterinary Medical Chamber (CMVRO). Starting
from the standard procedures for validation and certification of the
competences corresponding to the regulated professions and for
qualification recognition, which have been developed as part of the
project2, these guidelines have been structured by also taking into
account the results of the workshop rounds attended by the IMI PQ
NET target group members.
I. Regulation status for the veterinary surgeon
profession in Romania and in seven other EU Member
States
The veterinary surgeon is regulated in 27 Member States of
the European Economic Area (EEA), i.e.: Denmark, Iceland,
Finland, Poland, Germany, Estonia, Lithuania, Spain, the Czech
Republic, Sweden, Slovenia, Italy, Romania, Cyprus, Ireland, Great
Britain, Luxembourg, Austria, Norway, Liechtenstein, Portugal,
Slovakia, Latvia, Malta, France, Hungary and Greece.3 As said

before, seven EU states have been selected and for them the
regulation of the veterinary surgeon profession is compared to that in
Romania.
Table 1 indicates the name of the regulated profession in the
country of origin and the competent authorities corresponding to
each analyzed Member State.

The specific information referring to the certification of the
competences, the recognition of the professional qualification and
the practising of the veterinary surgeon profession in all of these
states may be obtained directly from the competent authorities in
each Member State (see Table 1) or through the national/unique
points of contact for the authorities managing the regulated
professions based on the principles laid down in Directive
2005/36/EC regarding the recognition of the professional

qualifications. The national points of contact4 are liable for the
provision of general information regarding the recognition of the
professional qualifications laid down in Directive 2005/36/EC, as
well as with reference to the national legislation regulating the
practising of these professions.
The veterinary surgeon profession is regulated per sectors in all
the Member States in question, the qualification level and the
methods for the recognition of the professional qualifications being
harmonized based on Directive 2005/36/EC of the European
Parliament and of the Council dated September 7th, 2005 regarding
the recognition of the professional qualifications, according to
Article 38. Moreover, in this field, the directive that also used to be
applied too prior to October 2007 is Directive 78/1026/EEC of the
Council, dated December 18th, 1978, regarding the mutual
recognition of diplomas, certificates and other official qualification
titles in veterinary medicine, including the actions meant to facilitate
the actual practising of the right to settle down and of the freedom to
provide services. Although the sectoral directive 78/1026/EEC, with

current amendments, was abrogated5, it is still a reference document
on the webpage of the competent authorities in several Member
States (Italy, the Czech Republic etc.).
At the moment in the studied European countries, this
profession is automatically recognized, meaning that each Member
State recognizes the veterinary surgeon qualifications allowing the
access to the professional activities and the practicing thereof, having
the same effect on its territory as the qualifications the state itself
issues do. The community regulation6 indicates the minimum
training level that is necessary for the automatic recognition of the
professional qualifications by identifying the titles in the educational
system in each EU Member State. The respective training titles have
to be issued by the competent authorities of the Member States and
should be accompanied by the indicated certificates – as applicable.
In Romania, the veterinary surgeon profession is a liberal and
independent profession with regulated automatic organization. It is
organized and functions based on the principle of autonomy within
the professional forum represented by the Romanian Veterinary
5 according to Article 62 in Directive 2005/36/EC regarding the recognition of the
professional qualifications 6 see Directive 2005/36/EC regarding the recognition of the professional
qualifications (Articles 17, 18, 19, 38).

Medical Chamber. According to the Veterinary Surgeon Status7 the
following shall be defined:
a) veterinary surgeon – the Romanian or foreign person who
holds a veterinary surgeon degree issued by a higher education unit
in Romania or abroad and officially recognized in Romania by the
competent authority;
b) official veterinary surgeon – the veterinary surgeon
employed and remunerated by the state, appointed by the veterinary
authority in order to carry out public veterinary activities indicated
by it under the law;
c) free practice veterinary surgeon – the veterinary surgeon who
caries out free practice veterinary activities under the law.
The veterinary surgeon profession is practiced in Romania by
any person who is a Romanian citizen and who holds the veterinary
surgeon degree validated under the law, as well as by the citizens in
the Member States of the European Union, of the European
Economic Area and of Switzerland who hold veterinary surgeon
degrees, certificates or other documents certifying this qualification
laid down by the law and issued by an education unit in these states.

The objectives of the veterinary surgeon profession are the
protection of the animal health and of the public health, the consumer
and environmental protection for the improvement of the livestock,
for the assurance of the population food safety, for the improvement
of the commercial relations and for the maintenance of the ecological
balance.
In Romania the veterinary surgeon profession has exclusiveness
in the following fields of competence:
a) animal health;
b) veterinary public health and hygiene of animal products and of
products of animal origin;
c) border inspection and veterinary controls;
d) veterinary laboratory supervision and diagnosis;
e) fodder hygiene control;
f) coordination of animal identification and registration;
g) ongoing veterinary training and education;
h) testing, registration and authorization of processes focused on the
manufacturing and trading of veterinary use products and of other
materials that might have an influence on the animal health status;
i) retail sale and use of biological products, special use anti-parasitic
and veterinary use medicines;

j) veterinary consultancy and audit.
The veterinary surgeon may carry out professional activities in
collaboration with other professions in the following fields:
a) protection of public health and consumer protection;
b) animal growing and feeding;
c) animal selection, improvement and reproduction;
d) manufacturing of veterinary use products and of other
materials influencing the animal health;
e) fundamental and applicative animal genetics research;
f) protection of domestic animals and of wildlife;
g) industrialization and capitalization of animal products and of
products of animal origin;
h) environmental protection and pollution control;
i) medical-veterinary statistics;
j) marketing of veterinary use products, except for those
indicated in Article 4 letter i);
k) control of movement of animals, of animal products and of
products of animal origin;
l) medical-veterinary research;
m) animal nutrition;
n) medical-veterinary biotechnologies;

o) medical-veterinary education.
In the practicing of the profession, the veterinary surgeon
applies, respects and is protected by the state laws as well as by the
provisions laid down in the Veterinary Surgeon Bylaws and in the
Medical and Veterinary Deontological Code approved by the
National Congress of Veterinary Surgeons, in compliance with the
law. The National Council of the Veterinary Surgeons Chamber may
attest – under this law – veterinary surgeons in various professional
profiles. Moreover, the National Council of the Veterinary Surgeons
Chamber makes proposals regarding the criteria for the professional
ranks to be achieved according to the legal standards in force, in:
a) veterinary medical care;
b) veterinary epidemiology;
c) laboratory supervision and diagnosis;
d) veterinary public health and hygiene of animal products and
of products of animal origin;
e) reproduction pathology.
The activities carried out through the medical-veterinary free
practice are: veterinary medical care, artificial inseminations, various
specialized services and sanitary-veterinary technical and legislative
consultancy, manufacturing and marketing of anti-parasitic and

veterinary use medicines and of veterinary use devices and
instruments. The particular medical-veterinary services are part of
the national sanitary-veterinary unique system.
The veterinary surgeons with free practice rights may carry out
their activity independently both as self-employed and as legal
entities.
The legislative particularities referring to the recognition of the
professional qualification and the practising of the veterinary surgeon
profession in Romania are highlighted by the following documents:
• Law no. 160/1998 for the organization and practising of the
veterinary surgeon profession, republished on May 23rd
, 2005;
• Government Resolution no. 860/2004 regarding the recognition
of the veterinary surgeon qualification and the regulation of various
aspects regarding the practising of the veterinary surgeon profession;
• Resolution no. 79/2008 for the amendment and completion of
the Government Resolution no. 860/2004 regarding the recognition
of the veterinary surgeon qualification and the regulation of various
aspects regarding the practising of the veterinary surgeon profession;
• Government Resolution no. 1477/2004 for the approval of the
minimum mandatory criteria of authorization and accreditation for
the higher education units in the following fields: medicine, dental

medicine, pharmacy, medical nurses, midwives, veterinary medicine,
architecture, as well as for the general practicing medical nurse
colleges for the basic training;
• Law no. 213/2010 for the amendment of Article 36 in the Law
no. 160/1998 regarding the organization and practising of the
veterinary surgeon profession;
• Government Resolution no. 890/2008 regarding the
qualification names and titles granted to the graduates of the higher
education being awarded the bachelor’s degree;
• Order no. 5289/2008 issued by the Ministry of Education,
Research and Youth with reference to the Degree Supplement;
• Order no. 5703/2011 issued by the Ministry of Education,
Research, Youth and Sport for the implementation of the National
Framework for the Higher Education Qualifications.
The legislation mentioned above and referring to the practising
of the veterinary surgeon profession is also available on the webpage
of the competent authority – the Romanian Veterinary Medical
Chamber (www.cmvro.ro). Pursuant to the Law no. 160/1998
amended in 2004 and republished in 2005, with current amendments,
the criteria for the qualification recognition and for the practising of
the veterinary surgeon profession are laid down for the Romanian

citizens holding a veterinary surgeon degree validated according to
the law, as well as for the citizens of the Member States of the EU, of
the EEA and of Switzerland, who hold veterinary surgeon degrees,
certificates or other documents certifying this qualification as set out
by the law, documents issued by an education unit in these
states. Moreover, the veterinary surgeon profession in Romania may
also be practiced by the citizens of the Member States of the
European Union, of the European Economic Area and of
Switzerland, as long as they hold degrees, certificates or other
documents attesting the veterinary surgeon qualification and issued
by the veterinary higher education units in third party countries,
which are recognized in an EU Member State or which confirm this
qualification; these documents should be validated under the law.
The veterinary surgeons, Romanian citizens living abroad, as
well as veterinary surgeons who are citizens of the Member States of
the European Union, of the European Economic Area and Swiss
citizens who practice the veterinary surgeon profession in Romania
shall enjoy the same rights and obligations regarding the practising
hereof as the veterinary surgeons who are members in the Romanian
Veterinary Medical Chamber (CMVRO) do.

Pursuant to Article 38 in Directive 2005/36/EC regarding the
recognition of the professional qualifications, the qualification level
for the veterinary surgeon in all of the eight Member States – i.e.
Austria, the Czech Republic, Denmark, Germany, Italy, Great
Britain, the Netherlands and Romania – has to be consistent with a
training form consisting in total in at least five years of full-time
theoretical and practical studies at an university, a higher education
unit at a level recognized as being equivalent to or higher than an
university and which provides the proof that the person in question
achieved the results of the specific education8, adapted to the
scientific and technical progress. This training is consistent with
Level 6 pursuant to the European Qualification Framework (EQF).
Moreover, the updating of the academic curriculum for the
achievement of the professional competences cannot involve for any

Member State an amendment of the existing legislative principles
regarding the natural persons’ training and access to the veterinary
surgeon profession within the European Economic Area. Regarding
the results of the education, the training for becoming a veterinarian
provides the guarantee that the person in question has achieved the
following knowledge and competences:
(a) he/she has to have good knowledge of the sciences used as the
basis for the veterinary activities;
(b) he/she has to have good knowledge of the structure and functions
of healthy animals, of their growing, reproduction, hygiene in
general, as well as of their feeding, including the technology used for
the manufacturing and preservation of food according to their needs;
(c) he/she has to have good knowledge of the field referring to the
animal behaviour and protection;
(d) he/she has to have good knowledge of the cases, of the nature of
performance, of the effects, of the diagnostic and treatment of the
animal diseases, whether they are treated individually or as a group;
among them, particular knowledge of the diseases that can be
transmitted to humans;
(e) he/she has to have good knowledge of preventive medicine;

(f) he/she has to have good knowledge of hygiene and of the
technology used for obtaining, manufacturing and sale of food for
animals or of animal food meant for humans;
(g) he/she has to have good knowledge of the acts having the power
of a law and of the administrative acts regarding the fields mentioned
above;
(h) the proper clinical and practical experience under the correct
supervision.
Annex 2 summarizes the regulation status for the veterinary
surgeon profession in the studied Member States. Directive
2005/36/EC regarding the recognition of the professional
qualifications, with current amendments, as well as other regulations
amending Directive 78/1026/EEC regarding the mutual recognition
of degrees, certificates and other official qualification titles in
veterinary medicine, including the actions meant to facilitate the
actual practising of the right to settle down and of the freedom to
provide services (Directive 2006/100/EC, Directive 2001/19/EC etc.)
have simplified the procedure for updating the list of degrees that
might benefit from automatic recognition and have facilitated the
free movement of the veterinary surgeons and the mutual recognition

sufficient level of legal security.
The workers’ actual mobility for the practising of the veterinary
surgeon profession in the European Economic Area is difficult to be
quantified in a real system, but there are several statistics available at
European and national levels with reference to the number of
applications of the recognition of the professional qualifications or to
the number of decisions made for the automatic recognition at
sectoral level. If we take into account all the professions for which
applications were filed for the qualification recognition on the
internal market, we may observe that the veterinary surgeon
profession is one of the top 10 regulated professions9.
Out of the studied countries, the statistics regarding the workers’
geographical mobility on the internal market, whose professional
qualification as veterinary surgeons have been recognized, show that
the highest number of favourable decisions in the country of origin
was in Great Britain (32%) and Italy (11%).10
For the veterinary
surgeons who obtained the qualification title in Romania and who
requested the sectoral recognition for the practising of their

professional activity in other Member States of the European Union,
the data are differentiated depending on the used source. According
to the data available at
http://ec.europa.eu/internal_market/qualifications/regprof/index.cfm,
328 decisions were made prior to 2012 for the recognition of the
professional qualifications in view of the applicants settling down in
EU Member States and 9 statements offered by other Member States
as host countries for the Romanian veterinary surgeons who wanted
to temporarily and occasionally provide services. Out of the 328
applications mentioned above, 307 decisions (corresponding to 94%
out of the total number) were favourable and most of the applications
were filed for the practising of the veterinary surgeon profession in
Great Britain, in France and in Italy.
According to the data provided by the Romanian Veterinary
Medical Chamber representatives, the competent authority in
Romania (CMVRO) received by April 2013 11 applications for the
recognition of the veterinary surgeon professional
qualifications for the practising of the profession in Romania,
and 730 veterinary surgeons in Romania received the
certificate of conformity in order to practice the veterinary
surgeon profession in the European Union.

II. Competence validation/certification procedures
applied by the competent authorities in the countries
where the veterinary surgeon profession is regulated
The competence validation/certification process is the
process through which an accredited institution certifies that a person
has competences in a given field by issuing a document called a
certificate of professional competence. A certificate of professional
competence is not a study degree; it certifies that a person has a
certain level of expertise in a given field. The basic principles of the
professional competence certification process are the following:
The competence certification is an optional and not
mandatory process. However, certain institutional policies
might require the competence certification of its members as
a requirement for becoming part of that organization;
The assessment of the professional competences may be
done by the same organization that had certified the
competences or by another organization;
Generally, the professional competence is certified in its
entirety, not only parts of it;

The training centres may facilitate the professional
competence certification process by entering into
partnerships and agreements with the competence
certification organizations.
For the regulated veterinary surgeon profession validation/
certification and/or recognition in the studied Member States, the
competent authorities indicated in Table 1 were appointed.
As mentioned in the previous chapter, the training titles for the
veterinary surgeon have to be issued by the competent authorities in
the Member States and they have to be accompanied by the indicated
certificates, as applicable. The minimum level of training necessary
for the automatic recognition of the veterinary surgeon professional
qualification based on the community regulations11
is consistent with
Level 6 in the European Qualification Framework (EQF). Pursuant to
Directive 2005/36/EC regarding the recognition of the professional
qualifications, the veterinary training consists in the graduation of a
university study program of at least five years, the requirements
being the same for all the studied European countries.
The study program leading to the issue of the veterinary surgeon
qualification titles includes at least the basic and specific subjects indicated

in Table 3, including the hands-on training in the field. The teaching of one
or more subjects may take place as part of the other subjects or in
connection with them. The hands-on training may be done as a rotation,
provided that it is based on an integral program and that it is directly
controlled by the competent authority or body and that it does not exceed
six months out of the total 5-year study program. Moreover, the allotment
of the theoretical and hands-on training among the various groups of
subjects is balanced and coordinated so that the knowledge and experience
may be properly achieved in order to allow the veterinary surgeons to fulfil
all of their duties.

As seen in Tables 3 and 4, if we take into account the learning
results and the competence descriptors, we find similarities in the
training and the obtaining of the qualification titles for the veterinary
surgeon profession for all the studied Member States. The bodies
issuing the education degrees are represented by universities, the
competence certification being done in a similar way for the higher
education units in the European Union. In this case, the procedure for
receiving the veterinary surgeon title entitling the practicing of the
regulated profession complies with the specific requirements of the
specialized higher education programs.

However, in the studied countries the competent authorities for
this regulated profession are different as far as the institutional
organization is concerned and their duties are focused either on the
qualification acknowledgement or on validation or certification
activities.
At national level, the professional recognition of the degrees,
certificates or other documents confirming the quality as a veterinary
surgeon is done by the Romanian Veterinary Medical College. The
Veterinary Medical College issues certificates of conformity for
occupational purposes for the recognition – in one of the EU
Member States – of the official titles for qualification in the
veterinary surgeon profession, titles that are issued by the higher
education units accredited in Romania.
In a similar way, the other competent authorities in the Member
States (see Table 1 and Annex 2) in charge with the competence
validation / certification are involved in the professional recognition
of the qualification titles, which attest the quality as a veterinary
surgeon and provide the information necessary for the granting of the
right the nationals have to practice the profession (see also Chapter
III).

III. Recognition processes for the qualifications
achieved in other Member States of the European
Union
The professional recognition refers to the assessment
methodologies and procedures in view of practicing the veterinary
surgeon profession.
In order to work as a veterinary surgeon in a country of the
European Union (called the host country) other than the country
where the qualification title was achieved (the country of origin), you
have to apply to the competent authority supervising the profession
in that Member State and to provide a proof of your qualifications. In
the case of the studied countries, the competent authorities in any of
the EU Member States have to recognize any of the qualification
titles for the veterinary surgeon profession, which are indicated in
Table 4, the qualification automatic recognition taking place only if
the minimum requirements are met with reference to the
qualification level and to the learning results based on the study
programs including the subjects indicated in Table 3. We have to add
that if the qualification obtained in a country of origin does not meet
the basic criteria for the automatic recognition laid down in Directive

2005/36/EC regarding the recognition of the professional
qualifications (for instance, your qualification title is not laid down
in Annex V.5.4.2 in Directive 2005/36/EC), the veterinary surgeon
profession might be recognized either as part of a regime of achieved
rights (example: at least three years of professional experience over
the last five years) or through a non-automatic recognition process as
part of the general system for qualification recognition.13
In the
concrete case of the studied Member States, there might be aspects
regarding the recognition system with compensatory actions only if
the study programs completed by the nationals do not meet the
requirements laid down in Directive 2005/36/EC with reference to
the contents of the curriculum and to the acquiring of the proper
professional competences.
A) Similarities regarding the recognition of the
qualifications acquired in view of practising the veterinary
surgeon profession in the eight EU Member States (Austria, the
Czech Republic, Denmark, Germany, Italy, Great Britain, the
Netherlands and Romania)
If the focus is on the ways to recognize the veterinary surgeon
qualification in various EU countries, we can see that there are

certain common elements regarding the procedure for the regulated
profession recognition including the following stages:
1. The information of the migrant / applicant (you) – through
national / unique points of contact (UPC) or from the competent
authorities,
2. The submission of your documents in the form requested by the
competent authorities in the host country (see the documents
requested by each Member State). At the moment, the European
Commission proposes the minimization of bureaucracy14
through
the elimination of the Apostille and of a series of administrative
requirements for the legalization of the official documents
pertaining to the people living and working in other Member
States. For the citizens of a country of the European Union or of
the European Economic Area, in most of the cases the documents
are forwarded electronically or by mail to the Unique Point of
Contact (UPC) or to the competent authority in charge with
processing your application.
3. The verification of the applicant's file contents and the control
meant to identify whether or not the conditions are being met
(including requirements regarding linguistic and legislative

knowledge, requirements regarding the registration in the
profession records, fees, etc.). The respective competent authority
has to solve your application within 1 month since the receipt of
the file and to ask for the missing documents if they are necessary
for the proper processing of your application.
4. The processing of the application / file through the analysis of the
documents and the making of the recognition decision: the
competent authority has to assess the qualifications and to decide
whether or not to issue a decision for the recognition of the
qualification referring to your application within three months (or
four months for certain complicated cases in the non-automatic
recognition field). Following the analysis of your file, the
decision for the professional qualification recognition shall be
issued.
5. In the case of a favourable decision for the recognition of the
veterinary surgeon qualification, the competent authority shall
issue a certificate and you shall be registered in the records of the
respective authority. If a Member State decides to recognize a
degree, a certificate or a title, it may or may not justify its
decision.

6. If the qualification automatic recognition is not accepted, the
rejection or the compensation decision has to be justified and it
may be subject to an appeal in court.
We have to add that the rejection decision or the failure to make
a decision within the set timeframe has to be subject to the means of
appeal laid down in the internal law. The Member States have to
justify such decisions regarding the recognition of veterinary surgeon
degrees, certificates or other titles.
On the other hand, a more easy way to solve the problems
regarding the recognition of the professional qualifications or the
competence certification is the SOLVIT15
network, where the EU
Member States cooperate in order to solve – without using the legal
proceedings – the problems occurring due to the inappropriate
application of the legislation regarding the internal market by the
public authorities.
SOLVIT deals with the cross-border problems16
between an
enterprise or a citizen (on one hand) and a public authority (on the
other hand) where the community legislation might have been

incorrectly applied. The SOLVIT national centres in the eight EU
Member States analyzed by the guidelines are indicated in Annex 3.
B) The particularities of the processes for the recognition of
achieved qualifications in view of practising the veterinary
surgeon profession in the eight Member States of the European
Union
Below there are the particularities of the processes for the
recognition of the qualifications achieved in other EU Member
States.
1. The information referring to the conditions for the
qualification professional recognition and for the practising of the
veterinary surgeon profession in Romania is summarized in the
regulated profession sheet in Annex 4.
2. The procedure for the recognition of the professional
qualifications in view of practising the profession in the Czech
Republic consists in the same stages mentioned above. You may get
the application for the recognition of the veterinary surgeon
professional qualification from the Veterinary Medical Chamber in
the Czech Republic (as the competent authority) or from the Ministry
of Education, Youth and Sport (as the point of contact / UPC). You
have to fill out the application file and to submit the requested

documents. According to the national legislation, besides the
identification details (personal data), the application shall have to
indicate: the regulated profession the application refers to, the
regulation profession practicing duration and form (as an employee
or as self-employed). The documents requested from the applicant
are as follows:
• the ID Card, the proof of his/her citizenship and other legal
certification evidence, as applicable;
• the proof of the professional qualifications; the proof of other
achieved competences – with clear indication of the level of
completed education (bachelor or master’s degree, the education /
training duration and contents); a certificate of conformity or another
document certifying the profession; just as in Romania, there are
requirements referring to the linguistic knowledge;
• the document confirming the payment of the fees; the
administrative fee for the submission of the application form for the
recognition of the professional qualifications is of – CZK 2,000, in
addition to the fee for the processing of the file by the Professional
Chamber (according to the Veterinary Medical Chamber
regulations).

The proofs regarding the professional qualifications and the
achieved competences have to be translated into Czech, unless an
international treaty or the Czech legislation provides otherwise.
When the competent authority cannot establish the authenticity of the
documents through the administrative cooperation, the authority may
request the originals or legalized photocopies of the professional
qualification evidence and other competences / documents (which
shall be returned within 15 business days since the issue of the
recognition decision).
The file may be submitted both at the competent authority and
at the Unique Point of Contact, but the professional qualification
recognition process is done by the Veterinary Medical Chamber in
the Czech Republic (CA). Within maximum 3 months (90 days)
since the verification of the file and the processing of the application,
the competent authority has to assess the qualifications and to decide
whether or not to issue a decision for the qualification recognition
regarding your application. Pursuant to the national legislation, the
authority has the obligation to make its decision without any delay
and not later than 60 days since the submission of the applicant’s
complete file. The Veterinary Medical Chamber in the Czech
Republic shall issue a decision attesting either the recognition of the

professional qualification or the rejection of the application for the
professional qualification recognition. There may also be cases when
compensatory actions have to be taken prior to the recognition (see
Chapter III). Moreover, an appeal may be filed against the competent
authority’s decision under the legislation in the Czech Republic.
3. In Denmark the procedure for the professional qualification
recognition in view of practising the veterinary surgeon profession is
simplified as there is no application form. In exchange, the
justifying documents have to be accompanied by a letter in which
you indicate the profession you want to be recognized and provide
reasons for your intent to practice your profession by settling down
in Denmark. The file may be submitted at the Danish Veterinary and
Food Administration (the competent authority) or at the Unique
Point of Contact.
Under the national legislation (see Table 2) and the community
legislation, the requirements regarding the application file consist in:
your contact details (name, address,....); your citizenship proof (a
copy of your ID Card or passport); the qualification titles providing
you with access to the veterinary profession; other documents /
additional information that might influence the qualification
assessment (degrees, Resume, etc.); a certificate issued by the

competent sanitary authorities (issued in English), which has to
confirm that you have the legal right to work in this profession
("Certificate of Current Professional Status / Good Standing")
(valid for 3 months); the fee payment proof, if applicable. You have
to provide translations (in Danish or English) of the important
documents (the professional qualifications, the certificate confirming
the conferred rights, certificates of professional experience, etc.),
except for the documents issued in English, Norwegian or Swedish.
Non-certified translations shall be accepted for this profession. The
applicant’s file has to include documents complying with certain
special conditions that are not covered by the EU standards only if
the candidate is not an EU / EEA citizen.17
The provision of temporary or occasional services from the EU /
EEA Member States in Denmark by carrying out professional
activities in the veterinary field shall be done by notifying the Danish
competent authority through a written statement accompanied by the
following documents / information: contact details, citizenship proof,
veterinary practice certificate, certificate of good conduct, a
document confirming your legal settlement, legalized photocopies of
the professional qualification documents. Besides this, the competent

authority shall not verify the veterinary surgeon professional
qualifications.
4. If we talk about the practising of the veterinary surgeon
profession in Germany, the qualification recognition process follows
the same stages as the process proposed above.
The applications may be forwarded directly to the competent
authority or to the Central Office for Foreign Education (ZAB),
which resends the applications to the competent authority. The
necessary documents for the submission of the professional
qualification recognition application are the following: the identity
document (a copy of the ID Card or passport); a table with an
overview of the training (in German) as well as of any paid
workplace up to that moment; the proof of the professional
qualifications; the proof of the relevant work experience; other
certificates of competence (i.e. continuous training); a statement
indicating that no application has been filed before for the
determination of the equivalence. The competent authority may ask
for copies of original certificates or documents. In certain cases, the
authority may accept plain copies of the documents. The documents
have to be translated into German by public appointed and sworn
interpreters / translators.

Compared to other studied Member States, there are certain
particularities regarding the assessment of the applicant’s file with
focus on the professional experience necessary for a certain field of
business. As fields of business, the national veterinary surgeons may
work mainly in veterinary offices and clinics. Other employment
opportunities are provided by the veterinary authorities, the
veterinary research or veterinary use institutes or by higher education
units.
As a veterinary surgeon, your professional qualification has to
be recognized by the Veterinary Chamber in the German land where
you want to work under the community regulations and in
compliance with the specific regulations applicable in the German
land where you want to practice your profession. For the veterinary
surgeon specialist, the professional qualification recognition is
granted only if the theoretical and practical training led to the issue
of the certificate for professional competences as being equivalent to
the continuous qualification and training in Germany, and the
procedure may vary from one German land to another. In principle,
the procedure compares the foreign professional qualifications with a
similar German occupation and there is certain flexibility in the
processing of the application. For example, the professional

experience achieved in Germany or abroad may also be taken into
account in addition to the training; if no proper evidence may be
provided in support of the qualifications, an analysis of the
qualifications may be conducted for the professional skills to be
determined (i.e. technical discussions or hands-on test). If there are
significant differences between the learning results leading to the
foreign professional qualifications and the German ones, the
qualification recognition involves compensatory actions (an
adjustment course or a skills test, as applicable).
The procedure should not last longer than three months; in
difficult cases, the decision period may be extended only once for
justified reasons. The period of time during which the decision has to
be made starts with the receipt of all the necessary documents.
5. Regarding the recognition of the veterinary surgeon
qualification in Italy, it is done through automatic recognition under
in the Legislative Decree no. 206/2007 for the regulated professions
in the community area, which transposes in Italy Directive
2005/36/EC regarding the recognition of the professional
qualifications, including the mutual recognition of degrees,
certificates and other official qualification titles in veterinary
medicine (see Chapter I). The procedure regarding the issue of the

veterinary surgeon professional qualification recognition decision
mainly complies with the ways mentioned above, and the documents
requested for the submission of the file are similar to those in the
other studied Member States. In this process, as it is performed in
Italy, there is a particularity shown below.
As mentioned above, for the practising of the veterinary surgeon
profession there is a professional register and this is why the degree /
qualification title prior recognition is necessary (see Chapter II). For
example, for the recognition of the veterinary surgeon degree
obtained in Romania, the applicant has / you have to submit to the
Italian Ministry of Health a standard application together with the
following documents:
1) a legalized photocopy of the degree to be recognized;
2) the authenticated photocopy of the certificate granting the right to
practice the profession;
3) a certificate of conformity issued by the competent authority in the
country having issued the degree, according to the community
legislation and referring to the name of the specialty and the
minimum training criteria;
4) the Certificate of Good Standing issued by the competent
authority in Romania, which confirms that you are the lawful holder

of the degree and that there are no restrictions regarding the
practising of the profession in your country of origin.
As the veterinary surgeon profession is regulated in Romania,
the following documents shall be submitted for the qualification
recognition in Italy:
1) a certificate / an attestation issued by the competent authority in
Romania, indicating that the degree in question authorizes in the
country of origin the practising of the applicant’s profession;
2) the detailed academic curriculum with a clear indication of the
hours done and of the topics debated for each individual subject as
well as the number of rotation hours done; this document has to be
issued by the university having issued the degree (see the descriptive
supplement / official transcript);
3) a certificate confirming the activity carried out in the country of
origin after the issue of the degree to be recognized;
4) a certificate confirming the performance of rotations, specialty
courses or other continuous training diplomas.
All the documents in Romanian have to be accompanied by the
translation into Italian, which has to be certified by the Italian
Embassy in Romania or by an Italian court.

6. In Great Britain the practising of the veterinary surgeon
regulated profession may be done only after the recognition of the
professional qualification and the registration at the competent
authority appointed by the British authorities. For the recognition of
the professional qualifications obtained in another Member State of
the European Union, the competent authorities usually request that
the following formalities are fulfilled when the file is submitted: a
form has to be filled out; the citizenship / identity has to be proven
(passport, ID Card or birth certificate); the qualification title (the
degree / document confirming the completion of the necessary form
of training in order to have access to the regulated profession); other
evidence for the professional qualification and experience in the
veterinary field (the proof confirming the completion of a rotation
stage or the registration with a similar body in the country of origin;
the proof of the professional experience); a medical certificate; a
certificate regarding the professional reputation, issued by the
competent authority in the country of origin.
As in other Member States (the Czech Republic,...) the
competent authorities shall inform you – within one month – if the
file is complete or if you have to submit other additional necessary
documents. Within 4 months since the submission of the complete

file the authorities shall have to issue a decision referring to your
access to the profession in question. For the processing of the
applications you might have to pay certain commissions that cannot
be higher than the costs actually paid by the competent authorities in
order to provide this service.
The authorities may decide on the recognition of the
professional qualifications and grant the right to exercise a regulated
profession in Great Britain or they may recommend the application
of compensatory actions if there are differences between the
qualifications obtained in the country of origin and the professional
qualifications necessary in Great Britain for you to practice the
veterinary surgeon profession. The compensatory actions may
consist in an adaptation stage of maximum three years or they may
require you to take a skills test. Most of the times, the people asking
for access to a regulated profession would have the opportunity to
chose between the two compensatory actions.

training qualifications (bachelor’s degree, master’s degree, doctoral
degree) in Austria. The recognition of the academic qualifications is
done by the higher education units and the veterinary surgeon
professional qualification recognition is done by the Federal Ministry
of Health or the authorities in the Lands (as the competent
authorities). The recognition procedure consists in the same stages:
the submission of the standard application and of the file compiled
for the qualification recognition, the verification of the submitted
documents, the application assessment with reference to the
recognition of the qualification obtained in other states, the
equivalence and identification of the potential training differences as
well as the issue of the decision regarding the qualification
recognition, may even conditioned by compensatory actions. The file
compiled for the qualification recognition application for the
practising of the profession in Austria has to include the
confirmations issued by the authority in the different type providing
the same functional role with reference to the documents pertaining
to the person in question, and the necessary documentation is similar
to the one in the other Member States (regarding the qualification
evidence). All the justifying documents have to be drawn up in
German or as a legalized translation. The recognition process may

last between 2 and 6 months. Sometimes fees are being charged for
the recognition procedure. It is deemed that the positive decision for
the qualification recognition through the procedure mentioned above
replaces the Austrian qualification title and allows the person to have
access to the labour market by granting him/her the right to practice
the said profession. Moreover, there are cases when based on special
training agreements, certain training programs attended in Germany
or Hungary are being considered equivalent.
8. In the Netherlands, the Organization for International
Cooperation in Higher Education - Nuffic is the institution
authorized (in Hague) for the recognition of the higher education
degrees and to also provide the necessary support to the applicants
asking for their academic qualifications to be recognized. The
veterinary surgeon professional qualification recognition is done
under the national and community legislation19
(see also Chapter I),
and the competent authority is the Ministry of Health, Welfare and
Sport. In the Netherlands the veterinary surgeon is a profession
regulated by the Veterinary Practise Act, and this is why the
registration in the Veterinary Medicine Register is mandatory.

IV. Practising of the veterinary surgeon profession in
the European Union
Directives 2005/36/EC regarding the recognition of the
professional qualifications and 2006/123/EC regarding the services
on the internal market provide an explicit legal framework for the
European citizens’ mobility in view of them practising the veterinary
surgeon regulated profession.20
Obviously, the practising of the
profession in the veterinary medicine field may have a significant
socio-economic impact on the animals’ health, on the public health
and consumer protection, on the food safety and environmental
protection and this is why the workers’ free movement in order to
practice this profession has to be consistent with the requirements
laid down in the sanitary-veterinary legislation and the transfer of
information21
in the field should be proactive. Moreover, at the
moment22
the workers’ movement is also subject to the specific
access conditions applicable to the labour market in that host country
(for example, the existence of the Denmark residence permit, the
issue of a work permit in Great Britain etc.).

The veterinary surgeon profession may be practiced by an
European citizen in an EU / EEA Member State other than the one
where he/she obtained his/her professional qualification either as
self-employed or as an employee. The veterinary surgeon may carry
out activities in the exclusively dedicated fields of business or both
as a natural person or as a legal entity; he/she may carry out free
practice veterinary activities as an official veterinary surgeon or as an
employee working for veterinary clinics, veterinary education and/or
research units. Moreover, for the practising of the veterinary surgeon
profession there is a distinction between the “freedom to settle
down” and the “freedom to provide services” according to well-
defined criteria (duration, frequency, periodicity and continuation of
service provision).
The settling down conditions require the registration of the
veterinary surgeons in the records held by the competent authorities
in the countries where they practice their profession (example: the
National Registry of Veterinary Surgeons).
As seen in the previous chapter, for the temporary or occasional
provision of the veterinary services in a Member State other than the
country of origin, you do not have to ask for the professional
qualification recognition, but the professional competences have to

be validated / certified (see the case of Italy). For the provision of the
temporary veterinary services a file is put together including proof of
your nationality, your legal residence and your professional
qualifications / competences, together with a statement (usually it is
updated every year). The documents are forwarded to the competent
authority (the professional organization).
Conclusions
As part of the IMI PQ NET project, these certification and
recognition guidelines have been prepared for the veterinary
surgeon profession. The necessity to draw up these guidelines is
justified by the mobility of the workers in this field, which means
that the veterinary surgeon profession is in top 10 regulated
professions in the ranking made based on the number of
qualification recognition decisions on the internal market.
The study regarding the aspects related to the veterinary
surgeon profession regulation in the eight EU Member States, i.e.
Austria, the Czech Republic, Denmark, Germany, Italy, Great
Britain, the Netherlands and Romania, has indicated that there is a
national legislative framework harmonized with the European

directives regarding the professional qualification recognition and
the sectoral directives for access to and practising the veterinary
surgeon profession in these countries, which facilitates the free
movement of veterinary workers throughout the European
Economic Area for settling down and/or for temporarily practicing
their profession in a Member State different from the one where
he/she had obtained the respective qualification title. The
veterinary surgeon profession is a sectoral regulated profession in
all of these countries being automatically recognized. The
minimum level of training for the veterinary surgeon is consistent
with Level 6 CEC/EQF, for the veterinary surgeon specialist or the
veterinary surgeon additional competence requirements being
applicable.
The competence validation/certification procedures applied
by the competent authorities have been simplified, which has led to
requirement standardization.
The veterinary surgeon professional qualification recognition
process is regulated in the EU Member States and the guidelines
define a framework procedure for the veterinary surgeon
qualification recognition.

Description of the profession regulated in Romania

conditions The veterinary surgeon is the Romanian or
foreign citizen who holds a veterinary surgeon
degree issued by an academic education unit in
Romania or abroad, which is officially
recognized in Romania by the competent
authority (the Ministry of National Education). The membership in the Veterinary Medical
College is mandatory for the practising of the
veterinary surgeon profession. The membership in the Romanian Veterinary
Medical Chamber is confirmed by the veterinary
surgeon’s ID Card (MSIDC), a document issued
upon enrolment. The veterinary medicine free practice certificate
is the document issued by the county or
Bucharest Council Executive Office attached to
the Romanian Veterinary Medical Chamber,
upon the veterinary surgeons’ request so that
they are granted the right to freely practice the
veterinary medicine. For the issue of the free practice certificate, the
veterinary surgeon has to hold the MSIDC ID

For the issue of the ID Card the veterinary
surgeon files the following documents at the
Bucharest or county Council Executive Office
attached to the Veterinary Medical College:
a) a standard application (Annex no. 2)
b) a copy of the degree, certificate or official
title confirming the veterinary surgeon
qualification, issued by the competent
authorities in a Member State or – as applicable
– confirming that person’s professional
experience;
c) a copy of the ID Card;
d) a certificate of criminal record issued with
maximum 15 days prior to the submission of the
application;
e) a medical certificate confirming the physical
and mental health, issued by a specialized
medical unit; as the case may be, a health
certificate issued by the competent authority in
that state is accepted (valid for 3 months) f) a certificate issued by the domicile County
Executive Office at which the applicant was
already registered for that profession,
confirming the disciplinary status and the causes
that led to the termination of the veterinary
surgeon quality;
g) a 3/4 colour photography;
h) the registration fee payment proof;
i) an envelope file;
j) for the Romanian veterinary surgeons residing
abroad, as well as for the veterinary surgeons

who are citizens of the European Union or
European Economic Area Member States as
well as for the Swiss citizens and for the citizens
of third party countries, a certificate of good
standing issued by the professional forum in the
country where they are members in the national
professional organization has to be submitted. For the foreign citizens to be granted the
right to practice the veterinary surgeon
profession, the Romanian Veterinary Medical
Chamber (CMVRO) asks for: a) the proof of the applicant’s citizenship; b) a copy of the degrees, certificates or the
official qualification title confirming the
veterinary surgeon qualification and – as
applicable – the confirmation of that person’s
professional experience; c) documents issued by the competent
authorities in the Member State of origin or
regarding: the moral character of the person in
question, the lack of any bankruptcy case, the
lack of any serious professional error or offence
leading to the suspension or interdiction in
practising the profession; if the competent
authorities in the Member State of origin do not
issue such documents, they shall be replaced by
an affidavit or a solemn statement that has to
fulfil the validity conditions stipulated by the
Member State of origin in which it was issued
(valid for 3 months); d) a document regarding the physical and/or
mental health, which is requested in the Member

State of origin; if such a document is not
requested in the Member State of origin, a health
certificate issued by the competent authority in
that state is to be accepted; e) a certificate issued by the competent
authorities in the Member State of origin, which
certifies the conformity of the official
qualification titles for access to the veterinary
surgeon profession; f) a copy of the certificate confirming that the
person speaks a foreign language and for the
natural persons who are citizens of the EU/EEA
states, the file has to include also a copy of the
certificate confirming that the person speaks the
Romanian language; an interview may be
scheduled for the determination of the Romanian
linguistic and communication knowledge. The veterinary surgeon asking for the issue of
the free practice certificate has to file at the
Bucharest or county Council Executive Office
attached to the Veterinary Medical College the
following documents: a) a standard application (Annex no. 3); b) a copy of the veterinary surgeon degree or of
the document confirming that the person holds
the veterinary surgeon title; c) a copy of the ID Card; d) a copy of the ID Card issued by the CMVRO
Veterinary Medical College; e) a certificate of criminal record issued with
maximum 15 days prior to the submission of the
application;

f) a medical certificate confirming the physical
and mental health, issued by a specialized
medical unit; g) a certificate issued by the domicile County
Executive Office at which the applicant was
already registered for that profession,
confirming the disciplinary status and the causes
that led to the termination of the veterinary
surgeon quality; h) a 3/4 colour photography; i) the evidence of the person having paid his/her
contribution up to date; j) the evidence that the person paid the free
practice certificate issue fee; k) an affidavit confirming that the person has not
simultaneously applied for the issue of another
free practice certificate; l) an envelope file. The documentation shall be submitted at the
Veterinary Medical College - CMVRO. Description of

stages
For the registration at the CMVRO and the issue
of the ID Card, the applicant shall fill out a
standard application and shall file the set of
documents indicated by the Veterinary Surgeon
Bylaws at one of the county subsidiaries of the
Romanian Veterinary Medical Chamber.
Afterwards the ID Card (MSIDC) is issued in
original on a stamped paper bearing an
embossed press. After the MSIDC is issued, the veterinary
surgeon may ask for the issue of the free practice
certificate. The applicant has to fill out a

standard application and to file the set of
documents indicated by the Veterinary Surgeon
Bylaws at one of the county subsidiaries of the
Romanian Veterinary Medical Chamber. The veterinary surgeon asking for the issue of
the free practice certificate has to indicate in the
standard application the activities in the
following fields:, , , a) veterinary medical care; b) artificial inseminations; c) various specialized services and sanitary-
veterinary technical and legislative consultancy; d) manufacturing and marketing of anti-parasitic
and veterinary use medicines and of veterinary
use devices and instruments. Afterwards the free practice certificate is issued
in original on a stamped paper bearing an
embossed press and the applicant’s photography. Authorization

For the certificate: The free practice certificate is endorsed by the
issuer every 2 years. The temporary or permanent withdrawal of the
free practice certificate is done by the Bucharest
or county Council Executive Office in any of the
following circumstances: a) non-compliance with the obligations
stipulated by this statute; b) breach of the current sanitary-veterinary
standards; c) deviations from the Veterinary Medical
Deontology Code, accompanied by the
application of the sanctions decided by the
higher or county or Bucharest deontology and
litigation commission; d) performance of activities other than those laid
down in Article 43 or failure to comply with the
conditions stipulated by the free practice
certificate; e) upon the termination of the activities or
purpose it was issued for; f) in any case of professional incapacity or
mental problem, all of these having to be
confirmed by an evaluation medical
commission; g) following the failure to reach the score
decided by the CMVRO Veterinary Medical
College National Council for the mandatory
continuous training. For MSIDC: indefinite, provided that the person
