NEPAS is the first successful jointventure between a foreign investor and a State Owned Enterprise. The jointventure was established in September 2015.Downstream petroleum products tender – Importation, storage, distributionand sales of petroleum products throughout Myanmar. The tender was launchedin July 2015 and a winner is expected to be announced in December 2016.Thanlyin LPG import terminal tender: Importation, storage and sales(including wholesale) of LPG utilizing the existing MPE Thanlyin LPG importterminal. The tender was launched in September of 2015 and a winner isexpected to be announced in December 2016.New LPG import terminal tender: Importation, storage and sales of LPGincluding the construction of a new terminal. The tender was launched inSeptember of 2015 but is currently on hold.Nyaung Don LPG Plant tender: This tender was launched in December 2015 andsubsequently cancelled.Thanlyin Refinery Tender: This tender was launched in July 2014 andsubsequently cancelled. The MOEE has shown interested in re‐tendering theproject, however, it has not been confirmed.

An Environmental Impact Assessment (“EIA”) is almost always the first step ofany LNG project regardless of the project’s size. An EIA is always requiredunder Notification 616/2015 for the following:
offshore/onshore gas production activities;
offshore/onshore gas transportation activities;
pipelines;
pump stations;
compressor stations; and
storage facilities
natural gas refineries, processing plants, liquefaction plants
natural gas terminals
liquid gas depots ≥ 2,500 t
gas transmission or distribution systems ≥ 10km

When an EIA is required, an Environmental Management Plan (“EMP”) andSocial Impact Assessment (“SIA”) will also be required.
An EIA must be carried out by a third party registered with the Ministry ofNatural Resources and Environmental Conservation (“MONREC”)
Any LNG project should also consult Notification No 615/2015 the NationalEnvironmental Quality (Emission) Guidelines to make sure that the design andoperation of the plant (as well as the data in the EMP) conforms with the law.
For example, in the case of a re‐gasification plant that utilizes a jetty orterminal, both Section 2.1.8 Section 2.6.2 will apply. Those sections areconcerned with the effluent levels from the following sources:
Discrete point source sanitary wastewater and storm water;
Hydrotest water;
Hazardous storm water drainage; and
Cooling water
