1. Introduction CIDCO – India's Premiere Town Planning Agency. When it says, “We make Cities”, that does not solely attribute this claim on the creation of eminent housing infrastructure rather various urban development projects, which are unique, justifying CIDCO's vision in the city planning and development. The CIDCO planned city; Navi Mumbai is witnessing rapid development in the construction activities. Govt. of Maharashtra vide notification dated 10-1-2013 appointed CIDCO as The Special Planning Authority (SPA) for the area, identified as Navi Mumbai Airport Influence Notified Area (NAINA). Under section 40(1) of the MR & TP Act, 1966 for area admeasuring 560 sq.km. Comprising 256 villages of Raigad District and 14 Villages of Thane District. Subsequently, the Government of Maharashtra reduced the project area to 461 sq. km. comprising 224 Villages. As a part of the transparency and reform initiatives, NAINA is implementing NIAMS (NAINA’s Integrated Approval Management System) for sanction of building plans to make it simple, transparent, and stakeholder friendly, leveraging information and communication technology. It’s an initiative to make Navi Mumbai smart city with cutting-edge technology solutions likes GIS, Online Building Plan Approval system, SAP, etc. It is a unique and innovative Software solution NIAMS enables online plan submission, automatic scrutiny of building proposal by reading CAD (Computer-Aided Design) drawings submitted by Applicant/ Architect/Licensed Engineer, assessment of charges to be paid online and issue commencement, Occupancy, and another certificate online.

What is NIAMS?

NIAMS is the automation of the approval process, followed for approval of architectural plans. It is an application customized for efficient management and approval of the drawings. It helps in attaining standardization and hence transparency in the total process of building permission. The complete building approval management system will be a web-based system, where Architects submit the plans and attached required documents online. The customized software available for approval is based on the DCPR (Sanctioned NAINA IDP DCPRs 2017, Modified Draft DCPR) of NAINA. The submitted proposals will be scrutinized automatically and which will be accepted or rejected based on the scrutiny sheet generated by the system.

Advantages of NIAMS

NIAMS is an online application system that will be used for submission of a proposal for Building permission. It is a system driven scrutiny Building Plans and Approval Management System. It is a unique software to scan CAD drawings and map them to Development Control Regulation rules for approval by NAINA. The system seamlessly integrated into the online approval workflow to monitor the approval process with associated document scrutiny. SMS and Personal Digital Assistants are used for creating alerts and notifications at every stage of the approval process to the architect/owner.

2. NAINA’s Integrated Approval Management System (NIAMS)

2.1. Permission Process

Planning Authority of the Department is the office concerned for grant of building permission of

(residential, commercial, and industrial, etc.) based on DCPRs (Sanctioned NAINA IDP DCPRs 2017,

Modified Draft DCPR), and stipulated set of rules and policies. As per the relevant provisions of the Act,

any person desirous of undertaking a construction activity (New as well as modifications), is required to

be obtained prior to clearances from the NAINA-CIDCO before embarking on the same.

Architect/Licensed Engineer shall also prepare and shall indicate his name, address, qualifications and

license number as allotted by the Council of Architecture/Indian Institute of Civil Engineering. The plans

shall also be duly signed by the Licensee indicating his address and submit the same on the proposal site.

The Planning Authority performs scrutiny and processing of building plans and issues Building Permissions

(CC). No person shall carry out building construction activity without obtaining permission from the

NAINA-CIDCO.

In case the Owner/LTP of authorized & legal plot wishes to carry out construction, he/she shall apply to

the Planning Authority, NAINA-CIDCO in the prescribed (Pre-DCR) format with plan and building drawing

prepared by using AutoCAD (architectural) in a particular format along with the requisite scrutiny fees and

mandatory documents. Compliance with the provisions of Development Control and Promotion

Regulations (DCPR) (Sanctioned NAINA IDP DCPRs 2017, Modified Draft DCPR), MR & TP (Maharashtra

Regional and Town Planning) Act & Rules to DCPRs is must for any building plans. Architectural drawings

submitted by the architect would be scrutinized using NIAMS and scrutiny reports are generated.

All construction or work for which permissions are required shall be subject to inspection /scrutiny of

Document, Site, and Drawing by the NAINA-CIDCO. Inspection, where required, shall be made within the

stipulated time period following the receipt of application. The plan may be approved or shortfall after

scrutiny. Once the plan is approved and Commencement Certificate (CC) is issued after which the owner

shall be free to carry out the construction according to the sanctioned plan.

Architects should submit site photographs with latitude and longitude from all sides (as plot shapes may

be zigzag and not geometrical). Site inspection authority should also take site photographs with latitude

and longitude from all sides during the site inspection and the system would match the coordinates

(latitude & longitude) of submitted site photographs for the correctness and further processing. The

system provides verification checkboxes and space to write comments for site photographs provided by

the architect and option to attach site photographs with latitude and longitude taken by site inspection

authority during the site inspection.

Proposal for building permission may be shortfall after scrutiny (Scrutiny of Documents, Site, and Drawing)

by Planning Authority. In case of shortfall after scrutiny, the subsequent resubmission can be made by the

architect/licensed engineer.

The system generates buildings as well as fire scrutiny reports using NIAMS based on building bye-laws

(DCPRs), fire norms and NBC norms.

Architect /License Engineer should submit the proposal with attached documents, site image and drawing

to pre scrutiny cell, once the scrutiny is done the file move to a higher authority (for further Process) that

base on a load balance system.

Once Scrutiny of Document, Site and Drawing Scrutiny is completed. At the first inspection, the Authority

shall determine to the best of its ability that the building has been located in accordance with the

approved site plans.

Planning Authority of the planning department provides details of various fees such as scrutiny fees,

security deposits, developmental charges, infrastructure development charges, premium charges for fees

of FSI components, etc.

Online Payment (Challan Payment) can be done by using a Credit card, Debit card, Internet Banking or e-

payment request slip. Once the payment is done, a payment receipt will be generated.

Architect or (Owner) is required to pay scrutiny fees on proposal submission. Proposal acceptance

acknowledgment and permanent file number are generated by the system after payment of scrutiny fees.

The system provides an interface to both the Architect and Owner to view and pay scrutiny and other fees

(challans) online.

The application system has the provision of reassignment of the proposal for scrutiny to the competent

authority by the higher level of authority to deal with unforeseen situations that arrived due to sickness,

leaves, etc.

A resubmission (Revision) of drawing due to deviations as per building bye-laws (DCPR) (Sanctioned NAINA

IDP DCPRs 2017, Modified Draft DCPR), is allowed for a maximum 5 times.

The application system has provisions to blacklist or cancels the registration of Architects based on

malpractices such as submission of false documents, a number of attempts for submission of false

documents, submission of drawings with failed entities >3 times, etc.

Once the submitted plans are in accordance with the DCPR (Sanctioned NAINA IDP DCPRs 2017, Modified

Draft DCPR), rules at the compliances are made the Building permission shall be granted online including

parameters. The architects/Licensed engineer/owner shall be communicated through SMS / email alerts.

It is expected that through the system a maximum of 30 working days would be required for seeking

permission subject to all required compliances to be made by the applicant. In case any compliance not

made, the permission cannot proceed further till the same complied.

Only registered Architects/Licensed Engineers with a valid license should be allowed for proposal

submission. Architects/Licensed Engineers with invalid/expired licenses will not be allowed to

submit/resubmit proposals. Such architects would have view-only rights of earlier submitted proposals.

NAINA-CIDCO issues LETTER OF INTENT (LOI) for proposals with gross built-up an area greater than 20,000

square meters for obtaining Environmental Clearance from authorities concerned and issues CC after

receiving Environmental Clearance Certificate.

The permission once accorded shall remain valid for up to one year. The permission shall be got

revalidated before the expiry of this period. Such revalidation may be permitted for three consecutive

terms of one year each (i.e. 1 + 3), after which proposals shall have to be submitted afresh. No drawing

scrutiny is done at the time of CC renewal, only documents are validated. Renewal fees (Premium for

extension of the time period) is taken. CC extension /Revalidation letter is issued by the NAINA-CDICO

after renewal.

Renewal of Building Permission (CC) will not be required if the plinth completion certificate is already

granted within one year from C.C.

The Authority may either sanction or shortfall the plans and specification or may sanction them with such

modifications or directions as it may deem necessary and thereupon shall communicate its decisions to

the person giving the application.

In the case of a shortfall, the Authority shall give the reasons and relevant provisions of the rule which the

plans contravene. The Authority shall as far as possible advise all the objections to the plans and

specifications in the first instance itself and ensure that no new objections are raised when they are

resubmitted (revised) after compliance of earlier objections.

The Authority may revoke any permit issued under the provisions of these rules wherever there has been

any false statement or any misrepresentation of any material fact in the application on which the

permission was based.

Once Building Permission (Commencement Certificate) is issued /granted, the Owner/ Architect will start

building construction work strictly as per approved plan and complete up to the plinth level.

After giving Building Permission, NAINA-CIDCO would upload Commencement Certificate (CC), approved

drawing and building floor details on its website that should be viewable/downloadable to everyone.

(Owner/Architect/Citizen).

As the CC is valid till plinth, on completion of the construction of the plinth the owner of the building shall

obtain from the NAINA-CDICO, a certificate to the effect that the plinth has been constructed strictly in

accordance with the permissible covered area. The owner shall give an application to the NAINA-CDICO,

which shall either issue the Plinth Completion Certificate (PCC) or order suitable changes to be made as

per the approved plan. The owner shall carry out such instructions as are given, failing which the authority

will be competent to demolish such part of the plinth as in under objection. The granting of a certificate

or the issue of instructions (Shortfall) regarding necessary changes will be done in the application, failing

which it will be deemed that the certificate has been issued.

After completion of the building and on the application of the licensee, NAINA-CIDCO will scrutinize and

validate as-built drawing for deviations if any at the occupancy stage and issue an occupancy certificate

or shortfall of the building occupancy within 30 days from the receipt of such request.

The system identifies gaps in CC and OC stage drawings. In the case of major deviations, amended CC will

be required.

At the request of the owner, Part Occupancy may be granted as per “DCPR” (Sanctioned NAINA IDP DCPRs

2017, Modified Draft DCPR) for one or more buildings in a layout of multiple buildings. In the case of multi-

dwelling units, part of the building where more than 50% construction is completed and safe occupation

of completed structure is not obstructed due to ongoing activities. In the case of Residential-cum-

Commercial Plots, either residential or commercial part provided that the portion, for which Part OC is

applied, shall be completed in all respects. Provided further that the owner/supervisor of the project shall

take responsibility for public safety and health of the occupants in such part Occupancy issued buildings

and indemnify NAINA-CIDCO in the prescribed format. As per the direction is given by Honorable MD, Part

OC in a single building may be permitted.

If any construction is initiated without permission/work is commenced beyond plinth without obtaining

PCC / possession is given without OC, suitable action will be taken by the NAINA-CIDCO and if the

construction is strictly in accordance with law and regulations the same may be regularized after

Paying the condonation charges as approved by the NAINA-CIDCO Board.

As per the High Court order (2005), no construction activity is allowed within 50 meters buffer area of

mangroves.

The system generates MIS reports, displays status on a GIS map, displays site photographs, plan drawing

in PDF, permission certificates, online payment interface, and proposal status on the citizen search

interface.

The license will not be required to obtain the NOCs being issued by various NAINA-CIDCO departments.

The application will be processed further after receiving all the documents including NOCs. However, in

special cases of additional FSI requesting exemptions, an extension of time limits will be given.

For speedy clearances of OC proposals and to bring out transparency, the licensee shall be required to

attach video footage of the site showing main features.

3. Screen Help This Architect’s User Manual will illustrate the basic steps to be followed for the submission of a proposal in the NAINA Integrated Approval Management System (NIAMS).

3.1. Link from CIDCO Website.

The NIAMS link is available on the City & Industrial Development Corporation of Maharashtra Ltd, i.e. (CIDCO) website.

1. Go to https://cidco.maharashtra.gov.in/#. On the official CIDCO website.

2. Move the cursor over CITIZEN/ BUSINESS SERVICES.

3. Click NIAMS, it redirects you to the NAINA Login page.

Figure 2 shows the Login page of NAINA. If an architect is registered and having the credentials (username and password), he/she can log in directly to the NIAMS. Otherwise, register yourself with NIAMS (Click “Register” link) if you are not registered. The following options are also available on the NAINA login page:

For new architect registration:

1. Click Register link on NAINA login Page (Registration form opens). Refer (FIGURE 2: NAINA LOGIN PAGE)

2. Fill the Registration form with all the required information as shown in Architect Registration Form Figure 3 above.

3. Click Submit, to submit the registration form.

After submission of the registration form, all the details will be sent to the NAINA authority for approval. Once approved by the NAINA authority, the User Name and Password will be sent to the architect via SMS and E-Mail. Now, Architect can log into NIAMS using login credentials received and submit the application for different permissions.

5. Application for Permission

Following Building permission application stages are provided in the left menu panel of the architect’s console.

The workflow (file movement and user actions) as required is configured into the NIAMS system.

After clicking on the SIGN-IN button, the architect’s console opens as shown in Figure 6 above.

1. Under the Scrutiny Stage CC Application on the left menu panel. , Click Draft Application link.

2. Then, click Apply For.

There are three permission options available:

a. Building Permission

b. Layout Permission

c. Revalidation of CC

1. Choose the Case Type as per requirement.

Addition and Alteration in the building plan

Compound Structure/ Regularization

Choose this option, if there are any discrepancies in the actual structure and the sanctioned drawing, in this case, an applicant can apply for compounding/ regularization. In this, he/she can get the case sanctioned as per the actual construction. There are rules for compounding too.

1. Select the Application Information tab.

2. Click +Add, Check the box and add the owner information.

3. Select the ownership value (Freehold or Leasehold).

4. Fill up other fields and also add Consultant information.

After submitting the general and applicant information, the temporary file gets created that is available under the Draft Application tab and other details like Plot Details, Application Checklist, Geo-Location, and Building details get visible to the architect for providing further details of the application.

1. Click the checkbox “Select plot co-ordinates from map”.

2. Select the corners (geo coordinates) of the plot on a map.

3. When you select the geo-coordinates on the map, the system automatically fetches the latitude and

longitude (geo coordinates) into the form.

4. Enter length (Mt.) between two geo-location coordinates and then click Save.

5.1.8 Documents Tab

Figure 15: Documents Details tab To upload the documents, go to the Document tab. There are three sub-tabs under the Document tab as follows.

Mandatory Documents: These documents are mandatory for all the proposals and are selected as default.

Conditional Mandatory Documents: These documents display based on the yes responses on the Application

Checklist.

Additional Documents: These documents are additional required documents and added by the deputy

planners based on the proposal requirement during scrutiny. If some additional documents are required then

Deputy Planner adds the document under Additional Documents tab and raises documents shortfall

(objection) and a file is returned to the Architect to provide required documents as attachment.

An architect needs to attach files (PDF, JPEG, PNG, BMP) against all selected documents under all the document sub-tabs as shown in figure 15 above.

5.1.9 Drawing Tab

Go to the Drawing tab. There are two sections namely Architectural Drawing and Super Imposed Drawing under the Drawing tab. Attach .dwg file against Architectural Drawing and .zip or .rar file against Super Imposed Drawing.

The .zip/.rar file should contain:

i. Superimposed AutoCAD drawing for physical survey & TILR map.

ii. Scanned images of physical survey and TILR map.

iii. In case of reservation, Road widening/Acquisition, Attach DP sheet or road NOC/Acquisition sheet.

1. Go to the Architectural Drawing section and click Select Files button to attach the Architectural Drawing (.dwg) file. (You cannot attach more than one drawing).

2. Go to the Super Imposed Drawing section and click Select Files button to Attach Super Imposed Drawing (.zip or .rar file) file. Click on Submit button to submit the attached Super Imposed Drawing.

Important: The system does not accept the file which contains special character as a file name.

3. Click Submit, the confirmation window appears, check the “Agree” checkbox and then click OK, as shown in the figure 17.

4. Now the scrutiny fees challan is generated and file moves to Submission Pending tab for making scrutiny challan payment and submitting the proposal-file to NAINA for scrutiny.

5.1.10 Fees (Scrutiny Fee Payment)

You can pay the scrutiny fees online using the Pay Now button provided against a proposal-file under Submission Pending option left menu panel in your console. Alternatively, you can pay the scrutiny fees online using the Payment link provided on the login page of the NAINA online application.

1. Go to the Submission Pending tab on the left menu panel, by clicking on the file number link opens your proposal-file.

2. Go to the Fees tab. Click Pay Now, it redirects you to the online payment portal for making payment.

After paying scrutiny fees, click Send (Send to Drawing Scrutiny) button. The proposal is sent to the Deputy Planner (Scrutiny stage) for scrutinizing of drawing, documents and site inspection based on load balancing system and the file is displayed under “Submitted Files” tab of left menu panel with the message in red color displayed on the screen as shown in figure 26. Note: An architect can submit the proposal files to Deputy Planner (Scrutiny stage) for scrutinizing drawing, documents and site inspection only after making scrutiny challan payment.

1. Click Send, then select Send to Drawing Scrutiny. The proposal-file will move to higher authority as

shown in red text in figure 26.

1. Go to Submitted Files tab, select and open a proposal- file.

If the proposal is lacking in required documents, site conditions, deviation in drawing format or drawing scrutiny report is not as per DCPR rules, then scrutiny officer i.e. (Deputy Planner) can raise the objections and proposal will display under shortfalls tab of the left-hand side panel as shown in figure 29 above. An architect can check the Site Visit Report, Shortfall Letter, Scrutiny Report and Drawing PDF using the Report link provided on the top right corner of the file. The architect needs to comply with the objections raised and resubmit the proposal to the scrutiny officer after compliance.

5.1.13 Scrutiny Stage Clearance

After scrutiny of the proposal-file, Deputy Planner sends the file to the Associate Planner for verification and remarks. If all documents & NOCs are received and the file is found okay, Associate Planner sends intimation letter (i.e. Form 1) to the architect for final submission under section 44 and the file is displayed under Scrutiny Stage Clearance tab on the left menu-panel.

On receiving intimation for final submission from Associate Planner, Architect submits Form10 (FORM OF APPLICATION FOR DEVELOPMENT PERMISSION UNDER M R & TP ACT, 1966) duly signed by Architect and owner and the file is displayed to Architect under Final Stage CC Application >>Submitted Files tab of the left menu panel. Refer to figure 33.

1. Choose proposal-file, for which you want to generate FORM 10.

2. Select the Application Form tab, click From 10.

3. Below Form 10 appears, click Download, to download the form. The architect and owner need to sign

Form 10.

4. Click Upload, to upload signed Form 10 for final submission.

5. Click Application for Final Submission, to send the proposal file for Final Stage CC application.

5.2. Final Stage CC Application

5.2.1 Submitted Files

Deputy Planner receives the file under “Received Files “and opens it by clicking the file number link.

The Deputy Planner generates the permanent file number, verifies the documents and sends it to the Associate Planner for further approval.

5.2.2 Approved File

Once the Associate Planner approves the proposal, then the file is accessible to Architect from the

“Approved File” tab in the final stage CC application.

After approval charges intimation letter (Development, labor cess, FLP, BEP, etc. Charges, etc.) And Assessment Order will be displayed to the Architect for payment.

1. Click Report, and then click Acceptance Letter. The below alert message appears, click Ok to proceed further.

2. Click Pay now, to pay online, once payment is done, the Associate planner will issue CC letter and the same can be downloaded by the Architect from Report link.

For further approvals, an architect can apply for Plinth and Occupancy certificates.

1. Under the Scrutiny Stage CC Application tab, click Apply for Old Cases option as shown in the above figure 37.

Now an architect needs to fill all necessary fields, upload approved drawing pdf and CC letter.

Based on the earlier sanctioned CC file number, an architect can apply for the Plinth completion

certificate (PCC) and Occupancy Certificate (OC).

To apply for Plinth Completion Certificate (PCC) follow the step given below:

1. Log in to architect’s console

2. Under Final Stage CC Application, select Approved Files.

3. Choose the proposal.

4. Click Apply for button.

5. Select Apply for Plinth, confirmation window appears.

6. Click OK.

Once the Plinth stage is approved, the plinth certificate gets generated as shown in Certificate and Letters. After completion of the above procedure, the architect can able to apply for obtaining the Occupancy Certificate.

The following are the guidelines for the issuance of Fire NOC for the occupancy certificate.

9. ATTACHMENT OF VIDEO CLIP/ FOOTAGE

As a step towards speedy clearances, a new approach is introduced in the NIAMS. As a part of this, the

applicant at the time of seeking O.C., will upload a video clip featuring the site, type of construction carried

out, trees planted, execution of works related to drainage system, sewerage system, the testing

conducted for Fire protection/ equipment’s installed in this respect, provision of parking made within the

plot, etc., which will comprehensively cover all the aspects verified by each Dept. before issuance of NOC.

This video clip will be kept in the public domain for the benefit of citizens.

The video clip has to indicate the location of the plot through its co-ordinates (GPS), the date and time of

the video footage. The Architect has to submit this video clip as a self-certification of the completed

project, for which the OC is sought. Also, Architect's and Owner's name shall be displayed and they will

be part of the Video Footage.

As this will be the basis for the Authorities to process the application for granting NOCs, misrepresentation

of facts and malpractices shall be treated serious and punishable. It is proposed to take penal action

against the Architect and also the Owner in such cases, which the NAINA/CIDCO authority may determine. This will ensure that the Departments issuing NOC to visually assess for themselves the status of work

carried out at the site by the applicant and if the prior conditions for issuance of NOC are fulfilled or

otherwise. By keeping this in the public domain, it will bring in transparency.
