and product loadout. The EPC contractor claimed for
increased costs due to alleged owner-caused delays and
disruption arising from late delivery of proprietary design
information, and late delivery of materials and equipment, and
impacts to labor productivity due to numerous changes to the
work and contractor’s alleged acceleration to overcome
delays.
On behalf of the owner, evaluated a piping contractor’s claim
associated with increased piping quantities for the
construction of a cement plant. Prepared an Expert Report and
testified in arbitration.
Cement Plants; Schedule Quality Assurance Services
On behalf of the owner, analyzed a $60 million claim from the
general contractor related to alleged project delay, increased
scope and loss of labor productivity. The project was for the
expansion of an existing cement manufacturing plant in
Florida and involved the construction of an additional 2800 ton
per day production line from raw material handling through
bulk material load out. Performed schedule quality assurance
reviews of the contractor’s contemporaneous schedules to
correctly quantify project delay and disruption from alleged
late delivery of owner equipment. Worked closely with the
owner to resolve problems contained within the contractor’s
contemporaneous schedules such as open-end activities,
overuse of constraints, missing original scope, incorrect as-
built dates, missing as-built dates, and missing logic links.
Coal/Gas-Fired Conversion to Natural Gas Only
Assisted with the preparation of the contractor’s delay claim
for late delivery of owner supplied piping and equipment;
extensive rework on improperly fabricated superheat panels;
unrealistic, overzealous and extra-contractual inspections and
QA/QC demands by owner personnel; extensive additional
work associated with the electrical scope; late and incomplete
submittal of necessary design information; and, excessive
changes to design data subsequent to Issue for Construction
drawings, particularly for the electrical work.
Cogeneration Power Plants
Prepared an entitlement analysis and a preliminary analysis of
schedule and damages associated with delays and disruptions
experienced by an insulation subcontractor during the
construction of a cogeneration project.
Condominium Complexes
On behalf of the underwriter, evaluated the owner’s property
damage claim and delays resulting from heavy rains and
flooding on a residential and commercial condominium
project.
On behalf of the insurance company, performed a schedule
delay analysis and provided expert testimony in litigation
brought by the insured against an underwriter for severe
weather-related delays during the construction of a
condominium and commercial retail development in Miami
Beach. The parties settled the litigation following deposition

On behalf of the contractor and underwriter, performed an
analysis of reduced operating cash flows for a mixed-use
building, including $5.1 million in damages claimed by the
plaintiffs for alleged loss of profits related to the conversion of
the apartment units to an independent living facility.
Analyzed a contractor’s claim on a Miami condominium
involving disputed scope changes, design omissions and
evaluated costs for responsible parties for the contractor’s
claim against the owner.
Reviewed a subcontractor’s claim for delay and extra work
cost against a contractor for a condominium development.

Reviewed and analyzed contracts of various parties involved in
the development and operation of a major hotel & residences

Fossil Fueled Power Boiler Erection
The EPC contractor designed and supplied two 300 MW
Circulating Fluidized-Bed (CFB) boilers to replace the oil and
gas fired boilers, as well as boiler islands on two units.
Engaged to prepare a schedule delay analysis related to a
claim filed for an equitable adjustment of the contract price on
behalf of the EPC contractor, against the owner. The project
team later made a presentation for mediation to the owner on
the EPC contractor behalf.
Gas-Fired Heat Recovery Generator
On behalf of the piping manufacturer, performed an analysis
of the fabrication of piping components as an element of the
fabrication and erection of Heat Recovery Steam Generators
including the identification of aspects of the delay resulting
from the actions of the various parties included in the project.
Prepared an Expert Report which led to settlement of the
matter.
Housing
Provided cost estimate analysis and contract analysis for a
single family luxury custom home located on the Florida coast.
Municipal Park Project
Defended an owner from a $4.1 million alleged delay and
disruption damages claim by a general contractor for the
construction of a municipal park project. Evaluated the
contractor’s entitlement to costs and delays that the
contractor purported to be based on outstanding change
orders and unresolved issues related to potential change for
conditions and impact. Based on the findings, the contractor’s
claims were grossly overstated and unsupported for which the
owner received a favorable settlement.
Prisons
Prepared a damage and schedule analysis on behalf of a
general contractor for a $560,000 claim on a new cafeteria
building and dormitory renovation project at a youth detention
facility in Okeechobee. Designated as a CPM expert witness for
the jury trial and presented preliminary findings at the court
ordered mediation which resulted in a successful settlement.
Re-Powering of Power Plant
Analyzed delay claims and supporting documentation
submitted by the contractor for the manufacture of four Heat
Recovery Steam Generators (HRSGs) for the Bartow
Repowering Project.
Reclamation Project
Prepared a preliminary damage analysis for an electrical
subcontractor on the South Cross Bayou Water Reclamation
Project in Pinellas County. Designated as an expert witness on
the electrical subcontractor’s loss of productivity and extended
overhead damages. Claim settled in negotiations after
preparation of an Expert Report.

Reviewed and analyzed a contractor’s claim for scope changes
and differing conditions encountered on branch creek
remediation project.
Roads, Highways &
Bridges
Analyzed a claim asserted by a general contractor who was
engaged in the construction of a cable-stayed bridge main
span and high-level approaches across Tampa Bay. Issues
included delays caused by late completion of an earlier
contract (performed by others), multiple design changes, and
resulting delays and cost impacts.
Analyzed claims asserted by two separate (bridge and
roadway) general contractors who were engaged in the
construction of an interchange of two interstate highways and
a toll road located in Broward County, Florida. Issues involved
included coordination between the two contractors, earthwork
balances, alleged design defects, and the resulting delays and
cost impacts.
Performed an analysis of a delay and disruption claim on the
engineering and construction of a causeway project located in
Tampa.
Prepared a schedule delay analysis for an underground piping

through detailed cost comparison and analysis of as-priced
and as-designed construction documents in support of
contractor’s claim for unforeseen added project costs on a
comprehensive critical care center located on Skidaway Island.

Mixed-Use & Retail
On behalf of the insurance company, performed an analysis of
a contractor’s claim for costs associated with repairs to
damage resulting from a tower crane jacking failure on a

analyses and reports to identify reasonableness of costs
claimed in preparation of negotiation and settlement between
the insurers, insured, and the insured’s contractor.
Reviewed and performed delay and cost analysis services for a
mixed use and retail development project in Roswell. Prepared
detailed schedule, damages, and delay analysis in preparation
of litigation and support for trial.

Prepared a damage analysis on behalf of a municipality
authority for a $1.0 million claim against the designer on a
new riverquarium and omniplex project facility in the
Southeastern U.S. Provided Expert Report supplements
leading to the successful settlement of the case prior to State
District Court trial. Supplemental reports were also utilized in
the successful settlement of a secondary settlement of claims
against the structural engineer.

on various tilt-up concrete warehouse/office build outs in
Atlanta.

Analyzed a pipe tunneling contractor’s claim for extended
equipment cost and prepared evaluation and cost related
damages on a delay and disruption claim.
Kentucky
Gas-Fired Power Plants
Testified regarding damages on behalf of a HRSG
manufacturer on a gas-fired power plant project. Analysis
work and testimony related to the independent analysis and
rebuttal of significant cost overruns alleged by the prime
contractor for schedule delays and changes.
Wastewater Treatment Plants
The project involved the expansion and redevelopment of an
existing wastewater treatment plant while maintaining service
and operation of existing plant. Provided contract and claims
support to the EPC contractor joint venture to ensure recovery
of owner caused impacts throughout the construction process.
This involved weekly contract support during construction as
well as claims preparation including delay and disruption
analysis and entitlement to damages.
Louisiana
Chemical Plants
On behalf of the owner, performed an analysis of entitlement,
schedule delay and damages related to a contractor’s $12
million claim against a major international chemical company
associated with the construction of two process units in an
existing chemical plant. The initial EPC contractor was
terminated, and sought recovery of its cost overruns as a
result of field change orders. The owner alleged that the work
was defective as a result of engineering errors, field
installation errors, and welding defects.
Provided construction claims consulting services, claims
analysis, and change order reviews related to a methanol
plant construction project. Reviewed the EPC contractor’s
contract and the EPC contractor’s unresolved claims and
change order requests to develop more complete descriptions
of the claim issues, evaluate the merits of the claims, and
prepare a summary of the claim documentation to support
client's settlement discussions with the EPC contractor.
On behalf of the contractor, performed an analysis of an EPC
contractor’s change order and delay claims on a chemical
plant project.
Chemical Storage Facility
On behalf of the operator of a chemical storage facility,
evaluated a claim associated with delays and cost overruns
caused by scope changes and hurricane impacts. Operator
alleged that the cost of the facility significantly increased as a
result of owner-caused changes and impacts from Hurricanes
Katrina and Rita, and that the owner agreed to compensate
the operator for the Hurricane impacts. The owner alleged that
the operator mismanaged the project, and that the delays and
cost increases were primarily caused by other problems not
related to the hurricanes.
Combined Cycle Power Plants
Performed an analysis of a contractor’s $9 million delay and
disruption claim against the owner of 4x2 combined cycle
power plant in Eunice. The scope of the work included a
detailed CPM Schedule analysis to determine delay and
acceleration responsibility.
Dams
Prepared schedule delay and damages analyses and an Expert
Report on behalf of the electrical subcontractor on claims
against the general contractor on two Corps of Engineers lock
and dam projects on the Red River.
Electrical Transmission Lines
On behalf of the power company, performed an analysis of
labor productivity costs associated with repair of damaged
electrical transmission lines following Hurricane Rita.
Gulf of Mexico; Offshore Oil & Gas Production Facility
On behalf of the paint manufacturer, prepared an Expert
Report refuting the EPC contractor’s claim for delay and
disruption allegedly resulting from work associated with
removal of lead-containing paint from the process plant
modules and platforms of an offshore oil production facility
installed in the Gulf of Mexico. Case settled prior to trial. This
project also involved the defense against the owner’s delay
claim for recovery of lost profits due to the delay to the
achievement of First Oil allegedly caused by the lead
abatement program. Presented an Expert Report
demonstrating that the project would have been delayed
because of concurrent delay by the EPC contractor, and
testified in deposition, resulting in a successful settlement of
the dispute.
Heat Recovery Steam Generation
On behalf of the manufacturer of the heat recovery steam
generators, performed an analysis of a contractor’s claim for
delay, acceleration, scope of work changes, and loss of
productivity on the installation of three waste heat recovery
steam generators.
Nuclear Power Plants
On behalf of the owner, provided litigation support of a
nuclear power plant project involving assessment of cost
overruns, delays, inadequate QA/QC documentation, and
defective electrical and instrumentation installations.
Offshore Gas Compression and Wellhead Platforms
On behalf of a major U.S. oil company, performed an analysis
and provided deposition testimony regarding a claim against a
contractor for $29 million in improper charges on a
reimbursable contract for the fabrication of one offshore gas
compression platform and two wellhead platforms.
Oil Terminal Project; Oil Terminal Projects
On behalf of the insurer representing the contractor, prepared
an Expert Report and provided testimony regarding the
analysis of an owner’s property damage claim following a fire
at an oil terminal which damaged the tank areas, including
associated equipment, piping, electrical and instrumentation.
Also evaluated the validity of the owner’s warranty claims that
existed prior to the fire and included in the owner’s alleged
damages. Prepared an Expert Report and testified in
deposition, which led to a settlement of the dispute.
Pipeline and Compressor Station Projects
On behalf of the owner, performed an assessment of the
contractor’s performance and construction productivity, an
evaluation of the contractor’s target cost to complete a natural
gas pipeline project, and quantification of costs associated
with removing and replacing defective pipe.

a natural gas pipeline project caused by weather delays,
defective pipe, and poor performance by the pipeline

Retained by the owner of a surfactants expansion project to
defend a claim by the electrical contractor for increased costs
and loss of productivity. Evaluated standard of care, schedule,
causation, labor productivity (including loss productivity due
to changes), and damages.
Coal-Fired Power Plants
Provided schedule delay, loss of productivity, extra work, and
damages testimony in State Court of West Virginia regarding a
$3 million claim on a $100 million Waste Coal Power Plant.
The testimony resulted in a jury award slightly greater than
client’s settlement offer.
Hydroelectric Power Plants
Provided entitlement analysis and evaluation for back charges,
for a contractor, related to the supply of equipment for a
