While at the offices of DEA in Jacksonville, Florida, prior to her arrival at the United States Courthouse, Phyllis S. BASIS OF INVESTIGATION

1. On 8-31-2004, S/A Thomas Flowers was contacted by Clay County Sheriff's Detective Randy Harris and requested to assist the Clay County Sheriff's Office with an indoor marijuana grow in Keystone Heights, Florida.

2. On the same date, S/A Flowers responded to 7730 Cypress St., Keystone Heights, Florida and met Clay County Sheriff's Deputies Randy Harris, Sgt. Mike Brown and Richard Ceeley. During the afternoon hours the Clay County Sheriff's Office executed a State search warrant at the residence and seized 144 growing marijuana plants.

3. After executing the search warrant, all evidence was seized by the Clay County Sheriff's Office and no arrests were made at that time.

The target(s) of this investigation include Ricky MOSLEY, and others yet to identified.

ON Tuesday AUGUST THZ 3 1,2004 THIS DETECTIVE RECEIVED INFORMATION FROM DEPUTY ABRAHAMSEN , THAT THE FIRST TRAEER ON THE RIGHT SIDE OF CYPRESS ST. HAS GROWING MARIJUANA INSIDE. THE DEPUTY FURTHER ADVISED HE RECEIVED THIS INFORMATION FROM A CONFIDENTIAL SOURCE. WHO ADVISED THE PLANTS WHERE SEEN 3-DAYS AGO. THIS SAME DATE AT 1030 HOURS DET. SEELEY AND MYSELF RESPONDED TO THE W E R THE ADDRESS BARED THE NUMERICAL OF 7730 ON A BLACK MAIL BOX LOCATED IN FRONT OF THE RESIDENCE. I TRIED TO MAKE CONTACT WITH THE HOME OWNER BY KNOCKING ON THE FRONT DOOR, HOWEVER NOBODY WOULD RESPOND. WE THEN WALKED TO THE BACK DOOR OF THE RESIDENCE, I KNOCKED ON THAI'DOOR, AND NOBODY WOULD RESPOND. WHILE OBSERVING THE EXTERIOR OF THE HOME FOR ANY IDENTIFIERS I OBSERVED THREE AIR CONDITIONERS THAT WHERE RUNNING, ALL WINDOWS HAD BLINDS AND THEN CURTAINS BEHIND THE BLINDS, ADDITIONAL ELECTRIC WIRES WHERE RUNNING UNDER THE TRAILER AND THROUGH THE FLOOR, A HUMMING S O W COMING FROM INSIDE THE TRAILER, AND ON THE SOUTHWEST CORNER OF THE HOME PER DET. SEELEY A ODOR OF MARIJUANA COMING FROM THE HOME. THE CLAY COUNTY NARCOTICS UNIT THEN SECURED THE HOME AND I WENT TO OBTAIN A SEARCH WARRANT FOR THE RESIDENCE. AT 1745 HOURS THIS SAME DATE THE SEARCH WARRANT SIGNED BY 3UDGE WILKES WAS EXECUTED BY THE FOLLOWING C.C.S.O. NARCOTIC OFFICERS LT. WRIGHT, SGTS. M. BROWN A??JD C. CURRY, DETS. G. MICHON , R. HARRIS , J. HAWKINS , C. PORTER, R. SEELEY. LOCATED IN THE HOME WAS A TOTAL OF 144 GROWING MARI,JUANA PLANTS, 13 LIGHTS, 12 BALLAST, 5-LIGHT TRACK SYSTEMS, 1- CARBON DIOXIDE GENERATOR, 1- TWRTy-FIVE GALLON FIMCO WATER TANK, AND A BLACK TRASH BAG Will3 1-LB.l4{OZ. OF MARIJUANA. ALSO FOUND WHERE 43 POTS THAT HAD CUT OFF STEMS IN EACH POT THAT WHERE PAST HARVEST. DET. G. MlCHON VIDEOED THE ENTIRE GROW OPERATION. THE ENTIRE TRAILER EXCEPT FOR THE HALLWAY AND THE BATHROOM HAD GROWING MARIJUANA PLANTS RANGING FROM 4- FEET TO A FOOT TALL. 1. On 8- 3 1- 2 0 0 4 , S/A Thomas Flowers was contacted by Clay County Sheriff's Detective Randy Harris regarding an indoor marijuana growing operation located at 7730 Cypress Street, Keystone Heights, Florida. Det. Harris requested S/A Flowers to assist in the investigation in order to prosecute the suspects in Federal Court.

2. On the same date, S/A Flowers met the Clay County Narcotics Unit at 7730 Cypress St. in Keystone Heights. Upon arriving at the address, S/A Flowers met with Sgt. Mike Brown, Det Richard Seeley and Det. Jacob Hawkins.

3. Sgt. Brown informed S/A Flowers that Det. Harris was in the process of obtaining a State search warrant to search a single wide mobile home st ~ 7 - 2 " St. in Eceystc~e IIeights. Sgt. Brown stated that earlier in the day, Det. Harris received information that an indoor marijuana growing operation was being operated out of the mobile home. Sgt. Brown stated shortly after Det. Harris received the information, he and Det. Seeley traveled to the residence in an attempt to do a consent search of the residence.

4. Sgt. Brown stated when Det's Harris and Seeley approached the mobile home they observed three window air conditionings units that were all running. The windows of the mobile home were also covered and they observed electrical wires coming out the bottom of the trailer that led to a breaker box just under the electric meter. While Det's Harris and Seeley were at the front of the mobile home they heard the humming of an electrical ballasts that is common with indoor marijuana grows. In addition, Det. Seeley smexled the odor of marijuana that was emitting from inside the mobile home.

5. Sgt. Brown also stated that a Clay County Confidential Source had recently been inside the mobile home and observed marijuana plants growing inside the residence several days prior.

6.While Det. Harris was obtaining the search warrant Deputies and s/A Flowers secured the outside of the mobile home area to ensure that no one entered the residence in an attempt to destroy evidence.

7.While S/A Flowers, Sgt. Brown, Det. Hawkins, and Det. Seeley were sitting on the roadway Ricky MOSLEY approached the officers and advised that he was the owner of the mobile home. MOSLEY stated that he had two dogs tied up at the residence. MOSLEY stated that one of the dogs had been at the residence for a while and he had just taken the second dog to the mobile home three days prior at the request of the renter.

MOSLEY stated that the renter had been renting the trailer from him for the last three months. MOSLEY stated that the same renter had been renting another residence from him for three years. semi truck and he had seen the semi truck parked on Hwy 214 close to Cypress Street in Keystone Heights.

10. s/A Flowers then asked MOSLEY for his telephone number and he stated that he only had a cellular telephone but he could not recall his telephone number. MOSLEY also stated that he had not been in the mobile home in three months. MOSLEY stated that he belonged to a hunting club in Ridgeland, South Carolina and the dogs tied up had the hunting club's number on it.

11. Following the interview with MOSLEY, S/A Flowers and Sgt. Brown observed that there were two dogs tied up at the mobile home. One dog was tied up at the front of the residence and the second dog was tied up at the back of the residence. Both dogs had collars on them. One dog had the following information on his collar: Long Branch Ch- 5, R. Mosley with a South Carolina phone number. The second dog had the following information on his collar: Roy Kellett, Long Branch, and had Georgia and South Carolina phone numbers on the collar.

12. S/A Flowers also observed that the mail box in front of the mobile home was open and S/A Flowers then looked inside the mail box and observed an article of mail from Clay County Electric addressed to Kimberly Point. The article of mail was left in the mail box.

13. S/A Flowers and the Clay County Deputies then observed that there was an outside water pump in a wooded area behind the trailer. Agents also observed that there was a noticeable walking path between the trailer with the marijuana grow and the trailer that MOSLEY stated that he lived in part time.

14. At approximately 5 :45 PM, Det. Harris returned to 7730 Cypress Street with a State Search Warrant and upon executing the search warrant deputies discovered that no one was present inside the residence.

15. A search of the residence revealed that the mobile home contained 144 growing marijuana plants (Exhibit 1 Information Only) and approximately 43 empty buckets that previously contained

marijuana plants (these plants had already been harvested). The only item of furniture in the mobile home was a kitchen table and a couple of kitchen table chairs that was used to trim marijuana plants on. The mobile home had two grow rooms. T h e main living room area of the trailer contained the mature marijuana plants that were planted in dirt in black buckets. The bedroom of the trailer contained smaller marijuana plants.

Further search of the residence resulted in deputies seizing 12 ballasts units that are used to power high powered grow lights, 13 high power grow lights, one carbon dioxide generator, one 35 gallon chemical tank, five light track unit that the grow lights were attached to, one black trash bag that contained cut marijuana leaves (approximately 1 pound 14 ozs), one cigarette butt, one air conditioner manual, and two notes.

In addition to the above items that were seized, deputies also found the following items inside the trailer but they were not collected as evidence: multiple electrical timers that were used to control the amount of time that the grow lights stayed on, several propane tanks that were used to fuel the carbon dioxide generator, electrical fans, thermometers, various chemicals and fertilizers, cow manure, professional growing mix (potting soil) , and a large shop vac style vacuum cleaner.

1. On 9-1-2004, S/A Thomas Flowers met Clay County Sheriff's Detectives at the Clay County Sheriff's Office to discuss the indoor marijuana grow that was seized on 8-31-2004.

2. During that time, S/A Flowers was advised that Ricky KOSLEY had contacted Det. Jacob Hawkins and left his cellular telephone number on Det. Mawkinsf voice mail (904-813-8210). At that time s/A Flowers telephoned MOSLEY and asked MOSLEY if he had found the renter's records for the current renters of the mobile home at 7730 Cypress Street, Keystone Heights. MOSLEY advised that he had the record and agreed to meet S/A Flowers at the Winn Dixie in Middleburg at 1:30 PM .

3. While at Clay County Sheriff's Office, Det Harris informed S/A Flowers that the previous renters (Daniel and Jammie Nichols) at 7730 Cypress St., Keystone Heights had been evicted by Ricky and Phyllis MOSLEY on May 16, 2004.

Det. Harris also had a copy of the electrical power usage for 7730 Cypress St and it showed that the power was in the name of Ricky and PhylliseMOSLEY from June 17, 2004 to approximately August 19, 2004. Det Harris stated that the power was changed to Kim POINT'S name on or about 8-19-2004. The Power Bill for July 2004 was $222.81 and the Kilowatt hours used was 1814. The Power Bill for August 2004 was $591.31 and the Kilowatt hours used was 6718.

Det. Harris also stated that approximately a year ago he received a call from S/A Wayne Andrews of the Gainesville R.O., who advised that while on surveillance at The Gardner's Edge (a store'in Gainesville, FL that sells equipment used in indoor marijuana growing operations) he observed Robert James MOSLEY and another older white/male drive away from The Gardner's Edge in a white Ford F-250 truck with a load of indoor marijuana grow equipment. S/A Flowers then contacted S/A Andrews and asked if he recalled the incident and he advised that he did. S/A Andrews advised that he could identify the second individual that was in the truck with Robert James MOSLEY.

S/A Flowers then provided Ricky MOSLEYts driver's license number to S/A Andrews and asked S/A Andrews to look at the driver's license picture to see if Ricky MOSLEY was the same individual with Robert MOSLEY on the day they transported the grow equipment from Gainesville. Later on the same date, S/A Andrews contacted S/A Flowers and confirmed that Ricky MOSLEY was the same individual in the truck with Robert MOSLEY on the day the equipment was purchased at the Gardner's Edge.

On the same date at approximately 1:30 PM, S/A Flowers and Det. Richard Seeley met Ricky MOSLEY at the Winn Dixie in Middleburg. MOSLEY stated that he owned and rented approximately 19 mobile homes throughout Clay County. MOSLEY stated that he was retired from Clay Electric and while he worked at Clay Electric he was in charge of the meter reading division.

MOSLEY then provided S/A Flowers with a rental agreement from 1999 that listed Ronald Mueller and Kimberly Point as renters for one of his mobile homes (Exhibit N-1) . MOSLEY stated that Mueller and Point

were the current renters at 7730 Cypress St., Keystone Heights, FL. MOSLEY stated that he seldom updated his renter's records if he did not have a problem with them. MOSLEY stated that approximately six months ago Mueller started trying to rent the mobile home on Cypress Street and approximately four months ago Mueller and Point started paying rent at the mobile home.

9.MOSELY stated he has not been inside the mobile home in approximately five months. MOSLEY stated after his last renters were evicted from the mobile home that he went into the mobile home to pull up the carpet and to replace some plywood in the floor. MOSELY that Mueller and Point previously rented another trailer from him at 814 or 816 Herford Road for the last three years. MOSLEY stated that Mueller and Point had expressed an interest in purchasing the trailer on Cypress St and that is the reason they moved into the Cypress St. trailer.

10. MOSLEY stated once someone moved out of one of his rental trailers the electrical power is put back into his name. MOSLEY stated that some time ago his wife obtained a power bill for approximately $174.00 and at that time his wife (Phyllis MOSLEY) contacted POINT and asked her to make sure the power was in her name.

11. MOSLEY stated after Mueller and Point rented the trailer he (MOSLEY) gave them one of the dogs that was tied up at the trailer. MOSLEY stated approximately three days ago Point contacted his wife and asked for another dog. MOSLEY stated he then tied up the second

12. MOSLEY stated that he saw Mueller and Point moving items into the trailer using a black trailer. MOSLEY stated that he saw them unloading mechanical equipment but did not elaborate on the exact contents.

Cox is a neighbor who lives directly behind the trailer that contained the indoor marijuana grow.

Cox stated that for the last couple of months she has seen a red diesel truck visit both the trailer that contained the indoor marijuana grow and the trailer beside the trailer that contained the indoor grow. For information purposes, the trailer beside the trailer that contained the indoor marijuana grow is the trailer that Ricky MOSLEY stated that he lived in on a part time basis.

Cox stated that every day around 5 PM for the last couple of months she has seen a red diesel truck back into the driveway of the trailer that contained the indoor marijuana grow. Cox stated that the occupants of the red truck were a white male with an untrimmed beard and a white female. Cox stated that the male and female would always

7. Cox stated that she has also seen the female using a Nextel phone at the rear of the trailer that contained in the indoor marijuana grow. Cox stated that she has also observed the female around the water pump that is located behind the trailer with the indoor marijuana grow.

8 . Cox stated that she has heard the air conditioning units running continuously at the trailer with the indoor marijuana grow.

9 . Cox stated that the last time she saw anyone at the trailer with the indoor marijuana grow was on 8-30-2004 and at that time she saw the red diesel truck back into the driveway of the trailer with the tailgate down.

10. Cox stated that 8-30-2004 there were a lot of cars coming and going from the trailer with the indoor marijuana grow.

11. Cox stated that she would not be able to identify the male and females faces because of the distant between her residence and the trailer.

12. Cox then walked S/A Flowers and Det. Harris to the edge of her property and from that area it was clear that Cox could easily view the rear of the both trailers. It should be noted that from the edge of Cox's property the water pump behind the trailer that contained the indoor marijuana grow was also visible.

did not remember the female's name but she could identify a picture of the female and male who she rented from.

S/A Flowers asked MacDonald if she would review a photographic lineup and attempt to identify the female and male who she rented from and MacDonald stated she would. S/A Flowers informed MacDonaPd that he would mail her two photo lineups for her to look at.

S/A Flowers asked if MacDonald had recently had electrical power put in her name in Clay County, Florida and MacDonald advised that she had not.

MacDonald stated that she and Mueller were married during a portion of the time she was in Clay County but they have since divorced and he moved to Mississippi and Alaska. MacDonald stated that Mueller may be back in Florida at the current time but she was unaware of his exact location.

S/A Flowers verified MacDonaldts identity by asking her for her date of birth and Social Security number and the information that MacDonald provided matched the information that S/A Flowers had for Kimberly Point aka: Kimberly Mueller and Kimberly MacDonald.

On the same date, S/A Flowers spoke to the manager at MacDonaldls apartment complex and the manager confirmed that MacDonald had been residing at her current address since April 2004.

On the same date, S/A Flowers mailed MacDonald a photo lineup containing a picture of Phyllis-MOSLEY and a second photo lineup containing a picture of Ricky MOSLEY for her to review and mail back to S/A Flowers.

On 9-15-2004, S/A Thomas Flowers and Clay County Sheriff's Detective Charlie Porter met at the Clay County Sheriff's Office in Green Coves Springs for the purpose of obtaining representative samples from Exhibit 1 (Information Only) which consists of 144 marijuana plants.

While at the Clay County Sheriff's Office, S/A Flowers and Det. Porter obtained the 144 marijuana plants from the Clay County Sheriff's Office Evidence vault and took one whole marijuana plant (1A) and ten representative samples (1B-1K) from ten random marijuana plants. Following the samples process the remaining marijuana plants were returned to the custody of the Clay County Sheriff's Office Evidence Vault.

S/A Flowers and Det. Porter then traveled to the Clay County Sheriff's Office in Orange Park and at the time, S/A Flowers obtained a compact disk (N-2) that contained video footage recorded on the day of the search warrant. The footage also contained footage of Clay County Deputies counting the marijuana plants.

S/A Flowers then transported the exhibits to the Jacksonville District Office and processed them as evidence. While S/A Flowers was processing Exhibits 1A-1K digital photographs were taken by S / A Flowers and the diskette that contains those images is hereinafter referred to as Exhibit N-3.

On 01/14/2004, Detective Randy Harris (CCSO) informed S/A Michael G. Smith that he had received intelligence information from S/A Wayne Andrews (Gainesville R.O.) regarding the drug-related activities of Robert James MOSLEY. Detective Harris advised S/A Smith that S/A Andrews recently observed MOSLEY and an older unidentified white male at a business in the Gainesville, FL area that routinely sells equipment, supplies and nutrients commonly used in the indoor cultivation of marijuana. S/A Andrews observed MOSLEY and the unidentified white male loading a vehicle with a large amount of supplies purchased from this business.

REMARKS: On 8-31-2004, the Clay County Sheriff's Office and Jacksonville DEA seized 1 4 4 growing marijuana plants from a single wide mobile home located at 7730 Cypress Street. SEARCH WARRANT

IN THE NAME OF THE STATE OF FLORIDA TO: ALL AND SINGULAR THE CCSO

WHEREAS, complaint on oath and in writing, supported by affidavit, having been made this day before the undersigned Judge of the Fourth Judicial Circuit, in and

7730 Cypress Street, Keystone Heights, Florida 32656. From the intersection of State Road 100 and County Road 214 you will travel -2 of a mile on CR 214 Northeast to the intersection of Cypress Street and County Road 214. You will turn right traveling .I of a mile on Cypress to the suspected grow house. The house described will be a single wide trailer, white in color with powder blue shudders. The trailer has a wooden porch attached to the front. In front of the suspected grow house is a black mailbox bearing the numerical of 7730.

hereinafier referred to as the "Premises", are being used by an unknown individual for the purpose of cultivating and/or manufacturing Cannabis, commonly known as marijuana, in violation of Section@) 893.1 3(1 )(a)2, Florida Statutes;

AND WHEREAS the facts establishing the grounds for this application are set forth in the affidavit of R.J. Harris #5064, CCSO, Narcotics, copy of which is attached hereto.

NOW THEREFORE, you or either of you, with such lawful assistance as may be necessary, are hereby commanded, in the daytime or in the nighttime, or on Sunday, as the exigencies of the occasion may require, to enter and search the Premises together with the yard and crtilage thereof and any vehicles parked therein reasonably believed to be connected with said illegal activity, and any person on the Premises reasonably believed to be engaged in or connected with said illegal activity, for the property described in this warrant, to-wit: Cannabis plants, seeds, cultivation equipment, money, drug paraphernalia, documents andlor computer files related to the cultivation of Cannabis, documents and/or computer files related to the purchase of cultivation equipment, or any instrumentalities possessed or used in connecfion therewith and if !he same or any part thereof be found, you are hereby commanded to seize and secure same, giving proper receipt therefore and delivering a completed copy of this Warrant to the person in charge of the Premises, or in the absence of any such person, leaving a complete copy where the property is found, and making a return of your doings under this Warrant within ten (10) days of the date hereof; and you are further commanded to bring said property so found and also any person arrested in connection therewith before the Cou of according to law.

hereinafter referred to as the "Premises", are being used by an unknown individual at this time for the purpose of cultivating and/or manufacturing Cannabis, commonly know as marijuana, in violation of Section(s) 893.13(1)(a)2, Florida Statutes;

AFFIANT'S PROBABLE CAUSE for believing the Premises are being used for the purpose of cultivating marijuana are as follows:

Your affiant is a member-of the CCSO and has been so employed for 9 years with 22 years law enforcement experience. Your affiant is presently assigned to the Narcotics Division and has been working in that division for 4 years.

Within the past day, your affiant personally observed the windows of the trailer were covered 'with blinds and curtains. There were three air conditioner units, one on each side of the t

trailer and one in the center. All three units were running at once. There were wires coming out of the bottom of the trailer all leading to the meter box. There were two additional breakers inside the open breaker box. Your affiant approached the front door to make contact with the residence and heard a loud humming noise coming from the trailer. Thro::nh -a training the affiant identified the sound as ballasts. Ballasts control the electric power lights which produce the artificial sunlight needed to grow Cannabis. indoors. Detective R. Seely was present with the affiant. Detective Seely smelled the strong odor of growing Cannabis. The smell came from the interior of the west end of the trailer. Detective Seely was able to identify the smell as being Cannabis, commonly knoviii as marijuana, based on the Detective's observations of Cannabis plants in the past. Within the past 10 days a confidential source witnessed Cannabis plants, commonly known as marijuana, growing in the trailer.

Your affiant has received training in the recognition and identification of Cannabis, Cannabis plants, and Cannabis indoorloutdoor grow sights on numerous occasions. Through experience and training your affiant has found that Cannabis, commonly known as marijuana, is commonly grown within the Premises when the above stated equipment and sounds exist. Your affiant has participated in the execution of approximately 4 search warrants and has never failed to find Cannabis grow sights. Therefore your affiant-believes Cannabis will be found in the Premises.
