The Department of Commerce's Bureau of Industry and Security (BIS) is pleased to offer Web Data Entry Software for Industry (Web-DESI). Web-DESI allows industry to submit Chemical Weapons Convention (CWC) declarations and reports for Schedule 1, 2, and 3 chemicals and Unscheduled Discrete Organic Chemicals via the Internet in a secure environment. Web-DESI is a voluntary tool designed to reduce your burden in complying with CWC declaration and report requirements under the CWC Regulations (CWCR, 15 CFR Parts 710-729). Web-DESI allows you to perform the following actions: Add a new declaration or report Copy a previously submitted declaration or report to create a new declaration or report Submit a UDOC "No Changes" Authorization Amend a previously submitted declaration or report View declarations or reports previously submitted by a facility, plant site, or trading company Delete a declaration or report that has not yet been submitted Submit completed declarations or reports Submit a declaration or report by uploading an export file produced by DESI Print a declaration or report(SEE NOTE)

NOTE: To print declarations created in Web-DESI your computer (or local area network) must allow temporary files to be downloaded from the Internet and stored onto your computer. If you are having problems printing a declaration, contact your Computer Help Desk about your Internet security settings.

REQUIREMENTSPrior to using Web-DESI, you must have: Internet access, web browser with 128-bit encryption (Netscape 6 and above, Internet Explorer 4 and above, Opera, or Mozilla), and Adobe Acrobat Reader (free shareware). Requested authorization from BIS to use Web-DESI.

You will need to complete and submit a certification letter. Detailed procedures for submitting the letter are set forth in Section 711.8 of CWCR. [ and below ]

DESCRIPTIONWeb-DESI was created to give industry the option to submit declarations and reports for Schedule 1, 2, and 3 chemicals, and Unscheduled Discrete Organic Chemicals (UDOCs), via the Internet. You must have a

valid password (USC password) for your facility, plant site or trading company as well as a user account (user name and password) to access Web-DESI. The procedures and requirements for obtaining and using these accounts are set forth in Section 711.8(b) of the CWCR. You may obtain account passwords to access Web-DESI by sending a certification letter entitled "Electronic Declaration or Report Request", on your Company's letterhead, with the title and signature of the owner, operator or senior management official (e.g., plant/plant site manager, regulatory compliance official), to the Treaty Compliance Division, Bureau of Industry and Security (TCD/BIS). Each facility, plant site or trading company that has a USC Number must submit a separate certification letter. Each facility, plant site or trading company granted authorization to use Web-DESI will be assigned a password (USC password) that must be used in conjunction with the US Code Number. A facility, plant site or trading company shall reveal the assigned password only to the individual users, their supervisors, employees, or agents of the applicant facility, plant site or trading company with a commercial justification for knowing the password. Each individual who will be accessing Web-DESI must have his/her own account with assigned user privileges and must have signed the "Electronic Declaration or Report Request" certification letter. There are several types of privileges that an individual may be assigned, as follows:

Internet Submissions Upon submission of the required certifications and approval of the facility, plant site or trading company's request to use Web-DESI, TCD/BIS will provide instructions both on the method to electronically submit declarations and reports. TCD/BIS may modify these instructions from time to time. The electronic submission of a declaration or report will constitute an official document as required under Part 711 of the CWCR. Such submissions must provide the same information as written CWC declarations or reports and are subject to the recordkeeping provisions of Part 721 of the CWCR. The facility, plant site or trading company and Web-DESI user submitting the declaration or report will be deemed to make all representations and certifications as if the submission were made in writing by the facility, plant site or trading company and signed by the owner, operator or senior management official of the company. Electronic submission of a declaration or report will be considered complete upon transmittal to BIS. A document submitted electronically has the same legal effect as one submitted on paper and you are as accountable for the accuracy of the statements you make electronically as you are for statements made on paper. Maintenance of Records You shall maintain a log, either manually or electronically, specifying the date and time of each Internet submission, the declaration or report type and year of each submission, and the name of the employee or agent making the submission. This log may not be altered. Written corrections must be made in a manner that does not erase or cover original entries. If the log is maintained electronically, corrections may only be made as notations.

THIRD PARTY ELECTRONIC SUBMISSIONBIS/TCD permits third parties to submit declarations or reports on behalf of facilities, plant sites, or trading companies, via Web-DESI. In order for a third party to be authorized to make electronic submissions to WebDESI for a facility, plant site or trading company, it must submit a certification letter. OVERVIEW

What is the Chemical Weapons Convention? The Chemical Weapons Convention (CWC) is an international treaty that prohibits the development, production, stockpiling, use, and transfer of chemicals that could be associated with chemical weapons. - The full text of the CWC can be found at http://www.opcw.org. The CWC permits toxic chemicals and their precursors to be researched, developed, produced, otherwise acquired, retained, transferred, or used within the territory of a State Party or any other place under the jurisdiction or control of a State Party for purposes not prohibited under the Convention. The purposes that are not prohibited include industrial, agricultural, research, medical, pharmaceutical, protective, law enforcement, or other peaceful purposes. A State Party to the CWC is a country that has ratied or acceded to the treaty. Your country has ratied the treaty and is, therefore, a State Party to the CWC. - There are currently 181 States Parties to the CWC. - A list of States Parties can be found at http://www.opcw.org. The CWC requires States Parties to implement the collection of data and on-site verication requirements related to the production, processing, consumption, importation, and exportation of certain toxic chemicals and their precursors as well as unscheduled discrete organic chemicals (DOCs). The CWC is internationally administered by the Organisation for the Prohibition of Chemical Weapons (OPCW), which is located in The Hague, the Netherlands. The CWC requires that States Parties establish a National Authority to serve as the national focal point for implementing the CWC and interfacing with the OPCW. Your point of contact on all CWC related matters is your countrys National Authority. - A list of National Authorities, including points of contact, mailing addresses, and telephone numbers can be found at: http://www.opcw.org/docs/NationalAuthorities.pdf or http://gc-icp.cwc.gov. The OPCW reviews and veries declarations submitted to it by States Parties for accuracy and completeness.

What is a Global Chemical Industry Compliance Program (GC-ICP)? A Global Chemical Industry Compliance Program (GC- ICP) is a handbook designed to assist the global chemical industry to comply with the CWC. The GI-CP provides a step-by-step methodology for determining if chemicals at your facility/company are subject to reporting requirements to your National Authority under the CWC. While the GC-ICP provides you assistance in complying with the CWC, you must consult with your countrys National Authority concerning CWC regulations and reporting requirements specic to your country. The GC-ICP is intended to assist facilities in determining if any chemicals located at your facility/company are subject to the provisions of the CWC. The development of a GC-ICP will require someone at your facility/ company to answer the following three questions: 1. Is your facility/company involved with chemicals listed on the Schedules of Chemicals or identied as an unscheduled DOC, as dened by the CWC? The Schedules of Chemicals are a list of chemicals and families of chemicals that are subject to reporting under the CWC. (See pages 7 - 9.) 2. Introduction to Chemicals Before determining if you have chemicals that are subject to reporting to your National Authority, it is important to rst understand why certain chemicals are subject to data monitoring and verication under the CWC, including their capability for use for chemical weapons or non-prohibited purposes. Overview of CWC Chemicals The CWC specically addresses chemicals listed in three Schedules and unscheduled discrete organic chemicals (DOCs). The Schedules of Chemicals are contained in the treatys Annex on Chemicals. (See pages 7 - 9.) Scheduled chemicals are grouped based on their industrial or commercial uses and the potential risk they pose to the object and purpose of the CWC. Unscheduled DOCs are monitored under the CWC due to the process equipment used to produce them and the potential applicability of such equipment for use in chemical agent production.

Organisation of the Schedules of Chemicals Toxic chemicals are listed in the A part of the Schedules. Dened as any chemical which through its chemical action on life processes can cause death, temporary incapacitation, or permanent harm to humans or animals.Example: Phosgene: Carbonyl dichloride, Schedule 3 Precursor chemicals are listed in the B part of the Schedules, and have been used in the production of toxic chemicals. Dened in the treaty as any chemical reactant which takes part at any stage in the production by whatever means of a toxic chemical. Example: Thiodiglycol, Schedule 2 Note: Not all chemicals listed in the CWCs Schedules of Chemicals are chemical weapon (CW) agents.

ANNEX ON CHEMICALS A. Guidelines for Schedules of Chemicals Schedule 1 Chemicals 1. The following criteria shall be taken into account in considering whether a toxic chemical or precursor should be included in Schedule 1: (a) It has been developed, produced, stockpiled or used as a chemical weapon as dened in Article II; (b) It poses otherwise a high risk to the object and purpose of this Convention by virtue of its high potential for use in activities prohibited under this Convention because one or more of the following conditions are met: (i) It possesses a chemical structure closely related to that of other toxic chemicals listed in Schedule 1, and has, or can be expected to have, comparable properties; (ii) It possesses such lethal or incapacitating toxicity as well as other properties that would enable it to be used as a chemical weapon; (iii) It may be used as a precursor in the nal single technological stage of production of a toxic chemical listed in Schedule 1, regardless of whether this stage takes place in facilities, in munitions or elsewhere; (c) It has little or no use for purposes not prohibited under this Convention. Schedule 2 Chemicals 2. The following criteria shall be taken into account in considering whether a toxic chemical not listed in Schedule 1 or a precursor to a Schedule 1 chemical or to a chemical listed in Schedule 2, part A, should be included in Schedule 2: (a) It poses a signicant risk to the object and purpose of this Convention because it possesses such lethal or incapacitating toxicity as well as other properties that could enable it to be used as a chemical weapon; (b) It may be used as a precursor in one of the chemical reactions at the nal stage of formation of a chemical listed in Schedule 1 or Schedule 2, part A; (c) It poses a signicant risk to the object and purpose of this Convention by virtue of its importance in the production of a chemical listed in Schedule 1 or Schedule 2, part A; (d) It is not produced in large commercial quantities for purposes not prohibited under this Convention. Schedule 3 Chemicals 3. The following criteria shall be taken into account in considering whether a toxic chemical or precursor, not listed in other Schedules, should be included in Schedule 3: (a) It has been produced, stockpiled or used as a chemical weapon; (b) It poses otherwise a risk to the object and purpose of this Convention because it possesses such lethal or incapacitating toxicity as well as other properties that might enable it to be used as a chemical weapon; (c) It poses a risk to the object and purpose of this Convention by virtue of its importance in the production of one or more chemicals listed in Schedule 1 or Schedule 2, part B; (d) It may be produced in large commercial quantities for purposes not prohibited under this Convention.

Quantity threshold for declaring production, processing, consumption, export and import for a Declared Plant Site A declaration is triggered if at least one plant on a plant site produced, processed or consumed a Schedule 2 chemical above the applicable threshold quantity. A declared plant site must also declare exports or imports as part of its declaration if the total exports from or imports to the entire plant site (not just to or from the declared plants on the plant site) exceeded the applicable threshold quantity. Note that a plant site declared for the production, processing or consumption of one Schedule 2 chemical may also have a reporting requirement for exports or imports of another Schedule 2 chemical that it did not produce, process or consume above the applicable threshold quantity. Quantity threshold for reporting exports and imports for declared or undeclared plant sites, trading companies and other persons An export or import report is triggered if a plant site (declared or undeclared) or trading company or any other person subject to the CWCR exported or imported more than the applicable threshold quantity of a Schedule 2 chemical. Quantity threshold for reporting exports to or imports from individual foreign destinations Once an export or import declaration or report is required, report the specific quantity exported to or imported from a particular destination using the rounding rules in the above table. Report all quantities exported to or imported from a particular destination regardless of the quantity involved. Concentration threshold for a Schedule 2 chemical in a mixture to be counted for declaration or report purposes For a mixture that contains a Schedule 2 chemical, only count the Schedule 2 chemical if the concentration of the Schedule 2 chemical in the mixture is 30% or more. You would determine whether the concentration of the Schedule 2 chemical was 30% or more by calculating the percentage by weight and by volume and using the lesser percentage. If the concentration is 30% or more, count only the weight of the Schedule 2 chemical in the mixture, not the total weight of the mixture. Guidance for adding quantities of Schedule 2 chemical for declaration or report purposes Add all the quantities of Schedule 2 chemical from each plant at your plant site that produced, processed or consumed, including the Schedule 2 chemical in mixture concentrations of 30% or greater, to determine whether production, processing or consumption of the Schedule 2 chemical at any one or more plants on your plant site exceeds the applicable threshold. Plant sites, trading companies and other persons subject to the CWCR would proceed in similar fashion to count exports and imports to determine declaration or report requirements (in the case of declared Schedule 2 plant sites) or report requirements (in the case of all other persons subject to the CWCR). Note that exports from and imports to plant sites are determined for the plant site as a whole, including all units at the plant site. Concentration threshold for a Schedule 2 chemical contained in a mixture that may trigger import restrictions No person subject to the CWCR may import a Schedule 2 chemical from a non-State Party. This import ban applies to a mixture that contains a Schedule 2 chemical at a concentration above 10% by weight. Concentration threshold for a Schedule 2 chemical in a mixture that may trigger an export license requirement or other export restriction (1) Export license requirements for Schedule 2 chemicals subject to the Export Administration Regulations (EAR). Most Schedule 2 chemicals are subject to the export control jurisdiction of the Department of Commerce. Depending on the destination, the export of a Schedule 2 chemical may require an export license from Commerces Bureau of Industry and Security (BIS). However, in most instances, a mixture containing a concentration of 10% or less of a Schedule 2 chemical, by weight, would not trigger a license application requirement under the Export Administration Regulations. In other instances, such as in the case of proposed exports from the United States to embargoed destinations or entities, even mixtures containing 10% or less concentration of a Schedule 2 chemical would require specific authorization from BIS (e.g., Cuba) or from another federal agency (e.g., the Department of the Treasury is responsible for licensing exports to destinations such as Iran and Iraq). (See 15 CFR parts 742, 744 and 746 and 31 CFR Chap. V.) (2) Export license requirements for Schedule 2 chemicals subject to the International Traffic in Arms Regulations (ITAR)(22 CFR parts 120-130). The 10% de minimis exception does not apply to Schedule 2 chemicals subject to the jurisdiction of the State Department. You should consult with the State Department to determine license application requirements and licensing policy for exports of Schedule 2 chemicals controlled under the ITAR (i.e., Amiton and BZ). 34

FORM 2-3B Exports and Imports of a Schedule 2 ChemicalDeclaration and reporting requirements are set forth in Part 713 of the CWC Regulations (15 CFR 713). All plant sites and trading companies that have exported and/or imported a Schedule 2 chemical above the applicable threshold in the previous calendar year must submit this form. Use this form for all types of declarations or reports: past activities, combined declaration and report, exports and imports, and amended. You do not use this form to declare exports as part of your Annual Declaration on Anticipated Activities. You have a declaration or reporting requirement if the total exports from or imports to your entire plant site (not individual declared plants) or your trading company exceeded the applicable threshold for the Schedule 2 chemical. If your plant site has declared a specific Schedule 2 chemical for production, processing or consumption reasons, and has also checked Yes in questions 2-3.7 and/or 2-3.8 on Form 2-3, then you must submit this form as part of your ANNUAL DECLARATION ON PAST ACTIVITIES. If your plant site has not declared a specific Schedule 2 chemical for production, processing or consumption, but has exported or imported a Schedule 2 chemical above the applicable declaration threshold, you must submit this form as part of your ANNUAL REPORT ON EXPORTS AND IMPORTS. If your trading company has exported or imported a Schedule 2 chemical above the applicable declaration threshold, you must submit this form as part of your INITIAL REPORT ANNUAL REPORT ON EXPORTS AND IMPORTS. Plant Sites declaring a specific Schedule 2 chemical: ANNUAL DECLARATION ON PAST ACTIVITIES. If your plant site has a declaration requirement for the past production, processing or consumption of a Schedule 2 chemical and has also exported and/or imported that Schedule 2 chemical above the applicable threshold in the previous calendar year, you must also complete this form. NOTE: A plant site that is declared because of the production, processing or consumption of one Schedule 2 chemical may also have a reporting requirement for exports or imports of another Schedule 2 chemical that it did not produce, process or consume over the applicable declaration threshold. Plant Sites that have not declared a specific Schedule 2 chemical for production, processing or consumption and all Trading Companies: If your plant site does not have an ANNUAL DECLARATION ON PAST ACTIVITIES for a Schedule 2 chemical, but your entire plant site exported or imported that Schedule 2 chemical above the applicable threshold in the previous calendar year, you must submit an ANNUAL REPORT ON EXPORTS AND IMPORTS on this form. If your trading company exported or imported a Schedule 2 chemical above the applicable threshold in the previous calendar year, you must submit an ANNUAL REPORT ON EXPORTS AND IMPORTS on this form. In the upper right-hand corner of this form, enter a Plant Site or Trading Company Name, and/or the U.S. Plant Site or Trading Company Code (once assigned) that you entered on Form 2-1 (Schedule 2 Plant Site or Trading Company Identification). For each exported or imported Schedule 2 chemical being declared or reported, provide the CAS Registry Number, if assigned, and the Chemical Name. If the chemical is not specifically listed by Chemical Name and CAS Registry Number in Supplement No. 1 to part 713 of the CWC Regulation (15 CFR 713), you must attach the structural formula of the chemical to Form A. Check the box to indicate that you have attached the structural formula. Questions 2-3B.1 and 2-3B.2: Use a separate form 2-3B for each Schedule 2 chemical. Total the annual exports to each destination and total the annual imports from each destination. Use a separate block in Question 2-3B.1 and 23B.2 to indicate the quantities exported to each recipient destination and the quantities imported from each source destination. Report the specific quantity exported to or imported from a particular destination and round to the nearest 0.1 metric tons. (Use Supplement No. 3 to identify the Destination Code.)
