PERFORMANCE CRITERIA Project and study allocations targeted to eligible states IAW PL 115-123

All eligible projects considered

A study/project allocation is considered a commitment to fund to completion with available supplemental funds

A risk management and future investment reserve will both mitigate delivery risk and support subsequent allocations for implementation of additional projects

Investment plans will be reviewed and updated over time

Performance criteria included: Project Benefit Cost Ratios Assessment of potential damage reduction provided by the project or study Advancement of non-structural and high life risk projects Confidence in efficient project delivery Study area impacted by disaster

Classification: Ongoing vs Not On-going Construction “Ongoing construction projects" include authorized Corps projects that have received Construction

account appropriations (i.e. an initial work allowance from a Statement of Managers, work plan, or supplemental appropriation) in any of the previous three fiscal years (FY 2015, 2016, or 2017)…includes all separable elements of the project and authorized projects with executed agreements for non-Federal sponsor construction w/potential reimbursement (i.e. Sections 211 or 206).

Financing: Cash Contribution For “not-ongoing” (new start) construction projects, Public Law 115-123 is explicit that the special

financing provisions apply to the non-federal cash contribution only. The FY18 Supplemental allows the Corps to use Supplemental funds to cover what would otherwise would be the required non-federal cash contribution, with the non-federal interest paying back that financed amount in accordance with the provisions of section 103(k) of Public Law 99-662 over a period of not more than 30 years from the date of completion of the project or separable element. It does not authorize the Corps of Engineers to finance the acquisition of real estate, with such acquisition remaining a non-federal responsibility.

Use of Previously Funded Federal Funds: For on-going studies/projects with existing and FY19 Federal funds, pre-approved work for the use of

those funds will be used for that specific purpose and upfront. FY18 “Supplemental work” can begin immediately with work that is different than the non-supplemental work. Accountability must be maintained for the funding source, applicable cost-share and the executed work.
