Chaoter-I- Instructions to bidder :1. The firms/suppliers interested to entered into the Comprehensive Annual MaintenanceContract to the equipments as mentioned in Annexure-I can consult, Shri Manohar Singh Bisht,Maintenance Engineer, Films Division, Mumbai (No.022-23551361/23517068) for clarification/specification, on any working day viz. Monday to Friday from 11.00 am to 5.00 pm (exceptholidays) in the office of Films Division, Ministry of Information and Broadcasting,Govemment of Indi4 24-Dr. Gopalrao Deshmukh Mar& Mumbai - 400026. 2. Possession of valid Digital Signature Certificate (DSC) of the bidders is prerequisite fore-tendering. The Comprehensive Annual Maintenance Contract shall be effective and valid for a period

of o+e vear from the date of acceptance by the successful bidder, It may be renewed furttrer

bV written mutual consent by both parties if the performance of the firm is found to be

satisfactory.

The firms must have experience for at least 3 years in Government or Semi Govt. or Public

Sector or large Private Sector OrganizationslCompanieg for maintenance of minimum 02

Projectors in at least two organizations / companies. Bids of the firms not having contract

for Annual Maintenance with at least two firms/organizations for minimum 02 DigitalCinema Projectors will not be eonsidercd.

c) The bidder except those who are registered with the Central Purchasing Organization,

National Small Indusfries Corporation (NSIC) must enclose with their Technical Bid(Hardcopy) and Eamest Money ( Bid Securiry) for Rs. 25,000/- in the form of either cross

Demand Draft, Fixed Deposit Receipl Banker's Cheque (Pay order) or Bank Guarantee

from any of the Cornmercial Bank drawn in favour of "Accounts Officen FllmsMumbai" valid for a period of 45 days beyond the final bid validity period. The Original

DD of the EMD should reach Director General, Films Division Mumbai before bid opqdng

date otherwise the bid will be summarily rejected. The final bid validifi period is 90 days.

d) The scope of coverage of the comprehensive AMC will be for the Digital Cinema Projector

system with 3D Passive System and Surround Sound System at Mahadeo Road AuditoriunlFilms Division, New Delhi. The firm shall provide comprehensive maintenance services

which shall cover both preventive as well as corrective maintenance for all assets covered

under AMC. Under corrective maintenance the firm shall rectify any defects, faults and

failures in the Projector and shall repair, replace any wom out defective parts of the

Projectors, at no o.ira cost. A1l the components of the equipment excluding consumables and

non-functional parts such as plastic casings and covers, shall be covered under the AMC. In

the event of addition of any more Systems with peripherals under the scope of the AMC, the

maintenance will be carried out by the firm for which they will be eligible for an additional

consideration on a pro-rata basis.

A separate health Service Report card shall be maintained for all the machines covered underAMC. The Engineer of firmlfirm shall record therein each incident of Systems malflnction,dateltime' of commencement of downtime and successfrrl completion of therepairslmaintenance work, nature of repair work performed on the Systems together with adescription of the malfunction and the cause thereof. The card is to be signed by therepresentative of the respective user departrnent with name and designafion. Details of thepreventive maintenance activity shall also be recorded.

The firm should repair/replace spare parts of the Systems at the Films Division sites only. Ifthe fault is of serious nature and requires ttre support of the repair center/workshop of theftrm that necessitates shifting of the equipment, the firm should attend toshifting/transportatiorq installatiorl re-installation, loading of the software packages at noextra cost to &e Films Division

The firm should ensure 99% uptime of each system covered under the AMC. If during anyquarter, the Engineer does not maintain the uptime of the equipmen! proportionatemaintenance charges will be deduct€d from the amount to be paid to the firm in thebeginning of the next quarter.

The payment will be made at quarterly basis after completion of each quarter on productionof a Bill in triplicate with the satisfaction report from the concerned users for each location.TDS if any will be deducted as per Income Tax Rules.

The sucsessful bidder has to enter into contract by way of Agreemont, wittr Films Divisionin which the above and other conditions conductive, cofilmensurate & concurrenl to similartlpe of contract are included. The original agreement has to be prepared on stamp papervalued of Rs.500/- and duplicate copy should be on Rs.l00/- vatid for State of Maharashtraat his own cost before taking up this assignment.

4. The reputed companies may only apply for Comprehensive AMC for the equipment asspecifications mentioned in the Annexure-I of the tender document. The last d*e for uploadingthe tender in theNIC portal is 17.10J016 uoto 13..90 hourc.

5. The Bid which is not accompanied by Eamest Money will not be considered. TheBidders who are exempted from submission of bid security must produce the ExemptionCertificate issued"by the concemed authority like NSIC.

6. The Eamest Money (Bid Security) rnay be forfeited by Films Division in the followingevents:-

If bid is withdrawn during validity period or any extension thereon.If bid is varied or modified in a manner not acceptable to this organization during thevalidity period or any extension thereof.If a bidder whose bid has been accepted but fails to fumish the performance secwitydeposit, performance bank guarantee within 30 days of acceptance of bid.

7. The Eamest Money (Bid Securif) of unsuccessful bidders will be retumed onfinalization of bid. The Ernest Money of successful bidder will be retumed on receipt ofperformance security deposit/bank guarantee.

8. All leviable taxes/duties, including Sales Tax, Value Added Tax ard Service Tax etc., ifany may be mentioned separately. If these details are not indicated, it will be assumed that theraie is inclusive of all the tares excluding Octroi.

9. At the first instance the Technical bids will be opened by the Department and the samewill be evaluated by the Competent Committee or Authority. At the second stage, Financialbids of only the Technically acceptable offers will be opened for evaluation and ranking beforeawarding the contract.

10. The successful bidder will furnish a Performance Security Deposit at the rate ofl0o/o of the value of the total AMC in the form of Demand Draft/ Pay Order or Fixed DepositReceipt or Bank guarantee from any commercial Bank drawn in favour of "Accounts Officer,Films Divisiorl Mumbai" within 30 days of the receipt of contract. The Performance SecurityDeposit will remain with the Films Division, till the AMC period of the systems is covered.

11. Right to accept, rejsct, split the erfiire Bid or aily part thereof without assigning anyreason rests with the Director General, Films Division, Mumbai and his decision in this regard isfinal and binding.

12. Income Tar:/Service Tax or any other taxes will be deducted from the bill at source as perGovernment orders.

13. Any disputes arising out of the bid notice" process and fnabz*ion of this bid shall besubject to jurisdiction of the High Court of Mumbai.
