Another optionthat I offer is that you contact me and we can arrange for you toreview this file in the Regional Office. We could then arrangefor Mr. Kryszczun to make copies of any selected documents youmight want for your files.

Finally, I believe that you asked Mr. Kryszczun thatRegional Counsel "certify to the record". This is not theprocedure that the Region follows. If we were to go to court wemight have to certify to the court that the documents were bonafide records from EPA's system of records in order to overcomeevidentitiary objections to their use. In such a case either theRemedial Project Manager or some other•individual from the wastedivision signs such a certification. The Drake RPM, GreggCrystall, has been at the Site most of this week and it is notnecessary or feasible to have him certify to this index. I,however, as the attorney assigned to the Site certify to you thatthis enclosed site index contains documentation that the Agencyhas compiled to support its decision to incinerate the DrakeChemical Site soils up to and through the most recent riskassessment for the full production burn.
