Pursuant to your requests to the Regional Office and to theRegional Ombudsman, Kenneth Kryszczun, enclosed is a listing ofthe documents and information that EPA has compiled as a recordsupporting its decision to incinerate the soils and sludges atthe Drake Chemical Site in Lock Haven, PA.

In terms of the record supporting the issuance of the 1988Record of Decision, the record maybe over-inclusive in regard towhat the Agency might present to a reviewing court in a challengeto the Agency's actions, e.g., maybe the Agency would not chooseto submit answers to inquiries from elected representatives orthe governmental accountability project ("GAP"). However, toensure that you have the opportunity to review any informationthat you might consider relevant to your investigation into AIR'sallegations, the Drake Site file index is being provided to you.As you can see, the record contains at this time 249 entries. Ofcourse, a number of these documents have been supplied to youpreviously, so maybe you will be able to winnow out those youhave already seen.

In addition, while not currently a part of this record, Iunderstand that the Agency For Toxic Substances and DiseaseRegistry ("ATSDR") has done its own independent review of issuespertaining to the alleged health risks from the incineratorproject. I am sure that Regional ATSDR personnel would be happyto be interviewed by you. The ATSDR contact person in the regionis John Kelly at.(215) 566-3141.

Another optionthat I offer is that you contact me and we can arrange for you toreview this file in the Regional Office. Finally, I believe that you asked Mr. Kryszczun thatRegional Counsel "certify to the record". This is not theprocedure that the Region follows. If we were to go to court wemight have to certify to the court that the documents were bonafide records from EPA's system of records in order to overcomeevidentitiary objections to their use. In such a case either theRemedial Project Manager or some other•individual from the wastedivision signs such a certification. The Drake RPM, GreggCrystall, has been at the Site most of this week and it is notnecessary or feasible to have him certify to this index. I,however, as the attorney assigned to the Site certify to you thatthis enclosed site index contains documentation that the Agencyhas compiled to support its decision to incinerate the DrakeChemical Site soils up to and through the most recent riskassessment for the full production burn.
