It happened again: Dozens of vehicles got stuck on local mountain roadsover the weekend as many folks, some of them woefully unprepared,drove up to enjoy the pristine snow conditions.

Although California Highway Patrol, Caltrans and other local agenciesregularly take to social media and make other efforts to warn motoristsabout potentially hazardous driving conditions in the mountains after awinter storm, it seems many motorists don’t heed the advice when theymake the trek up the mountain.

That leads to vehicles stuck in snow, and emergencies all along icy,winding roads.

“Starting on Saturday we started receiving calls of vehicles stuck in thesnow,” said CHP Officer Jesus Garcia on Monday, referring to thevehicles stuck on Mt. Baldy Road over the weekend. “When officers werefinally able to get in the area, they found several vehicles —about 20 —stuck in the switchbacks because they had no chains, it was snowingand they simply stopped in the roadway. We also find every year thatpeople come up to the mountain unprepared and not realizing that thereare no services (such as) gas stations.”

On Sunday, dozens more vehicles became stuck on the winding road, hesaid.

There were also reports of motorists stranded on highways androadways heading toward the Big Bear areas.

“We get the word out in advance and during but the ones that don’t thinkthey need them make it unsafe for all involved,” said Terri Kasinga,spokeswoman for Caltrans.

Many people began posting on social media when they were unable toreach their friends and family members who hadn’t returned from theirsnowy excursions.

“Yes, there are deputies and CHP officers around to help, but in manyareas of the mountains there is no cell phone reception,” explainedDavid Wert, spokesman for the county of San Bernardino. “When youpull off the main highway and head just a short distance down a one-laneroad because it looks like they’ll be some good free sledding, you canfind yourself and your family very alone, unable to drive and unable toreach anyone if you need help.”

As a new weather system promises to bring a little more snow to thearea this week, authorities are again advising anyone planning onmaking the drive to the local mountains to be prepared and they advise:

Always carry chainsBring extra clothing, blankets, food and waterHave a full tank of gasolineHave a fully charged cell phone of a way to charge it

There was a second freeway shooting on SanBernardino County highways in as many days,with officials saying they do not appear to berelated.

An unknown shooter shattered the front window ofa motorist’s Nissan Pathfinder on Friday, Feb. 8,as the unharmed victim was driving from theeastbound 10 Freeway to the 215 Freeway,California Highway Patrol officials said on Monday.

On Thursday, at about 9 p.m., a 10-year-oldHesperia boy was wounded when a bullet wentthrough a rear window of the BMW sedan he wastraveling in on the northbound 15 Freeway through

Fontana is on the hook for $106,916 in legal fees after a judge ruled infavor of a resident who argued that the city’s restrictive policy for peoplewho want to grow cannabis at home violated California law.

The city was expected to appeal the ruling, which was the first legal testof how far California cities can go in restricting residents’ newfoundfreedom to cultivate their own marijuana. Instead, Fontana let thetimeline to protest the decision run out.

Now, on the judge’s orders, city officials are drafting a new ordinance formarijuana growers. A revised policy is tentatively scheduled for a vote atthe Feb. 26 City Council meeting, according to city spokeswoman MarthaGuzman-Hurtado.

“It is a win,” said Mike Harris, the Fontana resident who sued the city withhelp from the American Civil Liberties Union of California and the DrugPolicy Alliance.

The lawsuit was over a city ordinance approved in January 2017 inresponse to Proposition 64. The ballot measure legalized recreationalcannabis California. It also gave every Californian 21 or older a right tocultivate up to six marijuana plants for personal use.

But the law says cities or counties can ban outdoor gardens and“reasonably regulate” indoor grows. And a growing number of cities haveinstituted rules for in-home cultivation that test the limits of what’sconsidered “reasonable.”

Fontana’s policy required residents who wanted to cultivate marijuana athome to first get a $411 permit from the city. They also had to pay forbackground checks, they couldn’t have overdue city fees, renters had toget a notarized OK from their landlords and growers had to agree toallow city officials to inspect their homes.

the ordinance, including the$411 fee. And he ordered thecity to revise the policy so itdidn’t include such restrictivemandates.

On Wednesday, Feb. 6, Cohnruled Harris is entitled to$106,916 in legal fees, which

all are expected to be donated to the ACLU and Drug Policy Alliance.Tamar Todd, senior director of legal affairs for the Drug Policy Alliance,said Monday that a final order to pay the fees still has to be settled incourt.

“It’s a real shame that the city brought this on themselves and then hadto charge the taxpayer for their hubris,” Harris said.

He admits he actually hoped Fontana would appeal the ruling since, ifthey won at that level, the case could set precedent for the entire state.

As it stands, attorneys can cite the Fontana ruling in their own suits.Harris already heard that happening as he sat in Wednesday on a casefiled against the city of Colton over its marijuana permitting system. AndTodd said other cities are expected to take note of the ruling whendrafting home cultivation policies.

But one day soon, the retired iron worker said, he intends to start takingadvantage of his right — now solidified in court — to grow marijuana athome.

Three San Bernardino residents are running for the vacant 3rd Ward CityCouncil seat.

In a special vote-by-mail election May 7, voters in the southern ward willelect either Treasure Ortiz, Juan Figueroa or Anthony Aguirre to be theirnew representative. Mayor John Valdivia vacated the council seat aftervoters elected him mayor in November.

The 3rd Ward, and the seven-member council at large, has been down arepresentative since Dec. 19.

San Bernardino experienced one of the pitfalls of having only six cityleaders last week. The council lost its quorum after threemembers walked out of a meeting Wednesday, Feb. 6, moments beforea vote on adding staff in the mayor’s office.

The panel needs four council members present to have a quorum.

On her campaign website, Ortiz, a Cal State San Bernardino graduateand former city employee, says she has been a resident of the 3rd Wardthe past seven years.

According to his campaignwebsite, Figueroa is a lifelongSan Bernardino resident whogrew up in the 3rd Ward.

The 40-year-old medical social worker and city commissioner says histop priority is to make the community safer. He also wants to combathomelessness, repair city streets and make City Hall more accountableand responsive to residents’ concerns.

“We must always put the people first at City Hall,” Figueroa said.

According to city officials, Aguirre pulled his candidate statement andballot designation Monday, Feb. 11, effectively withdrawing from therace. Since he missed the deadline to officially bow out, however, city

The recent evolution in the Board of Supervisors’ thinking about how to replace the dangerous anddecrepit Men’s Central Jail has been breathtaking. After years of insisting on building a multibillion-dollar treatment-oriented replacement jail, the supervisors in a matter of weeks have soured on the ideaand are considering instead an actual psychiatric hospital, operated by mental health professionals.

The change in attitude is welcome. Throwing mentally ill people routinely in jail instead of treatmentfacilities is foolish and morally suspect, even if some of those people have been accused of crimes.

The supervisors are moving so quickly, though, that they are in danger of getting ahead of themselves.Over recent weeks they have asked for several studies on incarceration-related topics, including thecounty’s needs for mental health beds, for gender-responsive treatment and incarceration, and fordiversion from the criminal justice system. They are the right questions. Now the supervisors ought toget the answers before making any final decisions on how to spend between $2 billion and $4 billion inbond funding.

The supervisors are right to rethink jail spending and focus onmental health care. But building a huge county mental hospitalmay not be the right step.

They’re scheduled to vote Tuesday on whether to go ahead with the original plan for a jail known as theConsolidated Correctional Treatment Facility, or alternatively to sign a deal with the same contractor fora different facility with a different name to serve a different purpose — mental health care — presumablyon the same site, in the jail complex on the northern edge of downtown Los Angeles.

illness, and many become warehouses for patients suffering from all variety and degree of psychiatricand emotional ailments.

In signing his very last bill, President Kennedy in 1963 spoke of the promise of community-basedtreatment for the mentally ill. He used words reminiscent of his call to put a man on the moon.

“Under this legislation,” he said, “custodial mental institutions will be replaced by therapeutic centers. Itshould be possible, in a decade or two, to reduce the number of patients in mental institutions by 50% ormore. The new law provides the tools with which we can accomplish this objective.”

Mental hospitals closed, but few of the promised community clinics and centers were built. Over thefollowing decades, federal laws and state bonds raised billions for jails, and that’s where many untreatedmentally ill people have ended up. How different would things be today if the $16 billion authorized forprison construction in the 1994 crime bill, for example, had been used to build mental health facilitiesinstead?

The supervisors are right to rethink jail spending and focus on mental health care. But building a hugecounty mental hospital may not be the right step. Supervisors need to better understand the differentneeds of the patient population.

Some may well need a mental hospital of the type the state still operates. Some no doubt will have to livein such places long term. Many others will need treatment for acute episodes and then move to “step-down” beds that transition them to either permanent supportive housing or their own homes andnormal lives with or without continuing treatment. Many need outpatient clinical care. And some,mental illness notwithstanding, belong in jail or prison. The supervisors need to know how many peoplecan be expected to fall into each category.

Some things the supervisors already know. For example, they know they have to demolish the existingMen’s Central Jail, which has an outmoded cellblock design that endangers both inmates and staff.

And the supervisors apparently have come to realize that a jail of any type — even one oriented towardtreatment — is not the right place for many of the mentally ill people currently housed there. The mentalhealth jail wouldn’t actually change the very bad jail-as-healthcare paradigm, but would merely dress itup in more contemporary clothing. The board should be wary of a large mental hospital doing the samething.

The supervisors finally appear to have the courage and vision to do their moonshot. They do need tomove quickly. But they should give themselves enough time and collect enough data to make sure theydon’t miss their target.

Jenna Garland, 34, the press secretary during the bulk of Reed’s two terms, is accused of ordering a subordinate in the city’s watershed department in March

2017 to delay handing over public records that contained information damaging to Reed and other city officials. The records were requested by Channel 2

Action News.

The two citations carry light punishment if Garland is convicted. Criminal violations of the law are misdemeanors punishable by up to $1,000 in fines and a year

in jail, but jail time is unlikely. Still the complaints carry symbolic weight.

It’s rare for a public official — in Georgia or elsewhere — to face criminal consequences for obstructing the public’s right to know. The charges could serve as a

jolt to cities, counties and state agencies that don’t comply with the law, experts said.

In March of last year, Georgia Attorney General Chris Carr ordered the GBI to open the state’s first-ever criminal probe of open records practices at City Hall.

That came after reporting by The Atlanta Journal-Constitution and Channel 2 revealed the city’s communications and law departments under Reed acted to

hinder production of public documents.

“Openness and transparency in government are vital to upholding the public trust,” Carr said in a news release. “I am confident that this action sends a clear

message that the Georgia Open Records Act will be enforced.”

Georgia’s sunshine laws were written to ensure that governments remain accountable to citizens. State law requires public agencies to respond to records

requests within three days and provide records as soon as they are available.

In 2012, a criminal statute was added to the law.

Jennifer Little, Garland’s attorney said, “We are surprised and disappointed by … Carr’s decision today given the facts of this case and my client’s full

cooperation with the investigation.”

“While my client may have spoken out of frustration, she acted in good faith at all times and did not violate any statutes,” Little said. “We plan to look at all

options moving forward.”

Reed did not respond to messages left via text and through a spokesman. In the past, Reed and others tied to his administration have denied any wrongdoing.

Richard T. Griffiths, president of the Georgia First Amendment Foundation, said the criminal complaint “will definitely echo all over the state and perhaps in

other parts of the country.”

“It sends a really clear message that ignoring the state’s open records law … comes with a heavy price,” he said.

In March 2018, the AJC and Channel 2 published text messages Garland sent a year earlier to then-watershed spokeswoman Lillian Govus.

Channel 2 sought water billing records in March 2017 for Reed, his brother Tracy, and members of City Council.

The texts showed Garland and Govus knew the records contained damaging information for city officials, including a history of outstanding balances by then-

councilwoman and mayoral candidate Keisha Lance Bottoms. Reed supported Bottoms’ candidacy. The records also revealed a disconnect notice at a property

Reed owned and a $9,000 unpaid bill at property owned by Tracy Reed.

In the messages, Garland instructed Govus to “drag this out,” “be as unhelpful as possible” and to “provide the information in the most confusing format

available.”

Garland later instructed Govus to “hold all” records until a Channel 2 producer contacted Govus for an update. Those text exchanges form the bases for the two

criminal citations.

The water department delayed production of the records for months, and the city only provided the records after Channel 2 hired an attorney, who drafted a

letter threatening legal action.

Govus, who declined to comment for this story, provided Channel 2 and the AJC the messages after she left her job with the city.

Garland is, so far, the only individual charged in the state open records probe, though text messages obtained by the AJC show other possible violations.

A spokesman for Carr did not respond to an inquiry about the status of the investigation into other members of the Reed administration.

Jonathan Peters, a media law professor at the Grady College of Mass Communication at the University of Georgia, called the charges “a prosecutorial unicorn.”

Peters said prosecutors typically don’t expend resources on open records violations, which happen frequently. That’s because the laws are often weak and

“provide some cover to all but the worst violators,” Peters said.

To track the charges filed, “You’d just need your fingers and toes. That’s how rare this is,” he said.

Last April, the AJC and Channel 2 filed a complaint with the attorney general’s office alleging “a culture of political interference” with open records requests and

sought mediation to reform city behavior. The city under Mayor Bottoms settled the matter in September and agreed to overhaul open records practices.

The City Council last year approved the creation of a transparency officer, a cabinet-level post, that was in part birthed from mediation. It’s groundbreaking for a

local government in Georgia, and a rarity nationally for a municipality, to have a dedicated officer oversee records production and public records training.

The city’s new ordinance also codifies that employees are subject to disciplinary action, up to and including termination, for failure to comply with state records

law, and that violations “may be referred to appropriate authorities for criminal prosecution or civil enforcement.”

In December, Bottoms said she planned to name Kristen Denius, a veteran attorney in the city’s law department, as the new transparency officer. Denius’

appointment is expected to take place before the end of March.

Bottoms entered office in January 2018, amid a well-publicized federal corruption investigation of City Hall. In her first year, Bottoms settled the open records

mediation with Carr’s office, launched an online portal for the public to track city spending and with the City Council instituted new reforms for the use of city

credit cards.

“The Bottoms Administration is committed to restoring public trust between Atlanta residents and its government,” Bottoms’ office said in a statement.

Greg Lisby, a communications professor at Georgia State University and an expert on the state records law, said the charges show “somebody is finally being

held accountable.”

But, Lisby said, it’s unlikely Garland acted alone.
