Application Procedure & Basic Requirements

Once married the foreign spouse or partner will be eligible to extend his or her stay by applying for the Spouse/Civil Partner Visa. This application can be made within the United Kingdom or overseas and is valid for a period of 27 months. Once obtained, the foreign spouse or partner can engage in employment.

Alternatively you and your fiancée/partner may wish to consider marrying in Thailand and then apply for the UK Spouse/Civil Partner Visa in the first instance. This will reduce the number of visa applications required to remain in the UK indefinitely.

Please also note that it is not possible to undertake a Civil Partnership in Thailand.

IMPORTANT REMINDER

The Requirements for immigration on a UK Fiancée Visa are quite similar to the rules for married couples also called the UK Spouse Visa.

You may wish to consider very carefully whether it is best to marry first and then apply for entry as this will avoid the necessity of making a Thai Fiancée visa application and then a second application to remain as a spouse.

However, please note that it is no longer possible for most visitors to change status to a spouse visa.

The UK Fiancée Visa is for those couples who wish to be married in the UK and remain there. It is known as the Proposed Civil Partner visa for same sex couples but the requirements are exactly the same. The visa is valid for a period of 6 months during which time the couple will need to marry.

In order to obtain a Fiancée / Proposed Civil Partner visa, the following requirements must be met;

• During the 6 months validity of the visa you will be expected to marry your fiancée / proposed civil partner and therefore both parties must show that they intend to do just that.

• You and your fiancée / proposed civil partner must show that there will be sufficient funds in the UK without requiring your partner to engage in employment or seek recourse to public funds.

• Accommodation for you and your partner, and any dependants, must be available and suitable for the purpose of applying for a visa

• You must have met your future spouse or partner and demonstrate that you intend to live together permanently following your marriage.

• It is a requirement that both you and your partner are at least 21 years of age. • Your fiancée / proposed civil partner will need to demonstrate a basic command of English (speaking

and listening) at level A1 of the Common European Framework of Reference. • Your fiancée / proposed civil partner must obtain satisfactory medical clearance showing that he/she

is free from infectious tuberculosis • Must be available and suitable for the purpose of applying for a visa

Requirements of the UK Fiancée Visa / Proposed Civil Partner Visa?

A UK Settlement visa such as the Fiancee Visa can be applied for in Thailand. The British Embassy Bangkok is in partnership with VFS (Thailand) also known as the UK Visa Application Centre. Your partner’s application should be submitted at the VFS office who in turn forwards it to the British Embassy for assessment.

The Visa Section of the British Embassy is governed by UK Border Agency (or UKBA). UKBA is an agency of the UK’s Home Office.

The processing time for Settlement applications varies depending on the number of applications currently being received. The time taken to process your partner’s application will depend on whether it is deemed straightforward. British Embassies, High Commissions or Consulates Visa Sections are obliged to process all Settlement applications within 3 months from the date of submission.

Settlement Visa Overview Process

Your partner will be notified once the result of his or her application is ready for collection. Their passport will be returned endorsed with a visa if the application is successful. If the visa is refused, a letter explaining the reasons of the refusal is given together with the passport.

A Settlement entry clearance is issued with a multiple entry endorsement which means that your partner will be able to enter and leave the UK without restriction.
